Attractions, Amusement Parks and CasinosBuyerandSellerareadvisedthatvariouspublicattractionsandamusementparksmayimpactthetrafficintheareanearthePropertyorcreatenoisewhichmayconcernsomeBuyers.Buyerisadvisedtoinvestigatetheimpactsfromsuchattractions,includingtheSanDiegoZooandSafariPark,SeaWorld,QualcommStadium,PetcoPark,Legoland,MattressFirmAmphitheater,AquaticaWaterpark,MissionBay,variouscasinosandresortsthroughoutthecountyandotherpubliceventvenues.

County of San Diego County General Plan UpdateTheCountyofSanDiegoadoptedanewGeneralPlanonAugust3,2011.Duringthe2011hearingsanum-berofpropertyownersexpressedconcernswiththelandusedesignationsthatwereappliedtotheirland.OnJune27,2012,theBoardofSupervisorsdirectedstafftoprocessaGeneralPlanAmendment(GPA)for47separatepropertyspecificrequestsalongwiththeirassociatedstudyareas.ItiscurrentlyestimatedthatthisGPAshouldbereadyforBoardofSupervisorsconsiderationbysummer2017.FormoreinformationontheGeneralPlan,thePropertySpecificRequestsGPAanditsimpact,contacttheCityofSanDiegoorvisitwww.sandiegocounty.gov/pds.generalplan.html.

3. Construction and Soils Defects—Prior, Pending or Threatened Litigation

BuyerandSellerareadvisedthatmanysubdivisionsandcondominiumsinSanDiegoCountyhavebeensubjecttolitigationforconstructionandsoilsdefectsarisingoutoftheoriginalconstructionofhomes.ThestatusofanylegalactionandtherepairstoremedythedefectmayimpactthevalueanduseoftheProperty.Itisimportanttoverifythestatusofanythreatened,pendingorresolvedlegalaction,includingwhatrepairsweremade,fortheresidenceandsubdivision.Forfurtherinformation,contacttheHomeownersAssociation,ifoneexists,ortheoriginalhomebuilder.

4. FireplacesBuyerandSellerareadvisedthatsomeareasofSanDiegoCounty,includingareasinSantee,Tierrasanta,ScrippsRanch,RanchoPeñasquitosandRanchoBernardo,mayhaveRampartGeneralfireplacesinsomehomes.RampartGeneralfireplaceswerepre-castconcretefireplaces,broughttothesiteanderectedin-steadofbuiltatthesitethroughmasonrywork.Thesefireplaceshavebeenknowntocrack,andrepairsarelimitedanddifficult.ManySanDiegoCountyfireplaceinspectors,chimneysweepsandcontractorswillnotattempttorepairRampartGeneralfireplaces.Repairsmaybecostly,ifavailable.andreplacementmaybenecessary.

5. High Wind and Flooding ConditionsBuyerandSellerareadvisedthatifthePropertyislocatedinanareasubjecttohighwinds,orduringstorms,thePropertymayexperiencedamagefromblowingdust,sandanddebriswhichcandisengagerooftiles,shinglesorothermaterialsandcausetreestofall.Floodingcanalsooccurthroughoutthecountyduringstorms,resultinginpropertydamage,slippageofembankments,orleakstostructuresthatoccurdur-ingsuchweatherconditions.

6. Homeowners’ AssociationsBuyerandSellerareadvisedthatthePropertymaybesubjecttomandatorymembershipinoneormoreHomeowners’Associations(HOAs).HOAsmayim-poserestrictionsontheuseanddevelopmentofthePropertyaccordingtotheHOA’sConditions,CovenantsandRestrictions(CC&Rs)andBylaws.IftherearemultipleHOAs,theymayeachchargeseparatedues.

7. Prisons and Jails BuyerandSellerareadvisedthatthereareprisons, jailsanddetentioncenterslocatedintheCountyof SanDiegowhichmayinfluenceBuyer’sdecisionto purchase.Buyerisadvisedtoinvestigatetheimpact,if any,ofsuchfacilities.

Proposition 65BuyerandSellerareadvisedthattheCaliforniaSafeDrinkingWaterandToxicEnforcementActof1986,alsoknownasProposition65,whichbecameeffectiveonJanuary1,1988,concernspotentialhealthdangerfromhazardouschemicals.Proposition65requiresallbusinesses(includingallbuildersofresidentialhomes)toprovideawarningtothepublicofthedangerofpotentialharmbyexposuretothesechemicals.

LandfillsBuyerandSellerareadvisedthatwithinSanDiegoCountythereareseveralactivelandfills,includingtheBorregoLandfill,LasPulgasLandfill,MiramarLandfill,OtayLandfill,SanOnofreLandfillandSycamoreLandfilllocatedinSantee.Theremaybeotherknownorundiscovered,inactivelandfillslocatedwithinSanDiegoCounty.Formoreinformationabouttheseandotherpossiblelandfillsvisitwww.sandiego.gov/environmental-services.com.

6. Chinese DrywallBuyerandSellerareadvisedthatsomehomesbuiltbetween2003and2008maycontainimporteddefectivedrywallknowninthepressas“Chinesedrywall.”Someresidentsofpropertieswiththisdry-wallhavereportedproblems,includingastrongsulfursmell,likerotteneggs;healthissues,likeirritatedanditchyeyesandskin;difficultybreathing;apersistentcoughandheadaches;andprematurecorrosionordeteriorationofcertainmetalcomponentsintheirhomes,likeairconditionercoilsandwiringbehindelectricaloutletsandinsideelectricalpanelboxes.Eliminatingproblemsassociatedwiththedrywallmayrequireitsremovalfromthehome.Formoreinforma-tion,visittheConsumerProductSafetyCommissionwebsiteatwww.cpsc.gov/info/drywall/index.html.

7.
