1. Attractions, Amusement Parks and CasinosBuyerandSellerareadvisedthatvariouspublicattractionsandamusementparksmayimpactthetrafficintheareanearthePropertyorcreatenoisewhichmayconcernsomeBuyers.Buyerisadvisedtoinvestigatetheimpactsfromsuchattractions,includingtheSanDiegoZooandSafariPark,SeaWorld,QualcommStadium,PetcoPark,Legoland,MattressFirmAmphitheater,AquaticaWaterpark,MissionBay,variouscasinosandresortsthroughoutthecountyandotherpubliceventvenues.

2. County of San Diego County General Plan UpdateTheCountyofSanDiegoadoptedanewGeneralPlanonAugust3,2011.Duringthe2011hearingsanum-berofpropertyownersexpressedconcernswiththelandusedesignationsthatwereappliedtotheirland.OnJune27,2012,theBoardofSupervisorsdirectedstafftoprocessaGeneralPlanAmendment(GPA)for47separatepropertyspecificrequestsalongwiththeirassociatedstudyareas.ItiscurrentlyestimatedthatthisGPAshouldbereadyforBoardofSupervisorsconsiderationbysummer2017.FormoreinformationontheGeneralPlan,thePropertySpecificRequestsGPAanditsimpact,contacttheCityofSanDiegoorvisitwww.sandiegocounty.gov/pds.generalplan.html.

3. Construction and Soils Defects—Prior, Pending or Threatened Litigation

BuyerandSellerareadvisedthatmanysubdivisionsandcondominiumsinSanDiegoCountyhavebeensubjecttolitigationforconstructionandsoilsdefectsarisingoutoftheoriginalconstructionofhomes.ThestatusofanylegalactionandtherepairstoremedythedefectmayimpactthevalueanduseoftheProperty.Itisimportanttoverifythestatusofanythreatened,pendingorresolvedlegalaction,includingwhatrepairsweremade,fortheresidenceandsubdivision.Forfurtherinformation,contacttheHomeownersAssociation,ifoneexists,ortheoriginalhomebuilder.

4. FireplacesBuyerandSellerareadvisedthatsomeareasofSanDiegoCounty,includingareasinSantee,Tierrasanta,ScrippsRanch,RanchoPeñasquitosandRanchoBernardo,mayhaveRampartGeneralfireplacesinsomehomes.RampartGeneralfireplaceswerepre-castconcretefireplaces,broughttothesiteanderectedin-steadofbuiltatthesitethroughmasonrywork.Thesefireplaceshavebeenknowntocrack,andrepairsarelimitedanddifficult.ManySanDiegoCountyfireplaceinspectors,chimneysweepsandcontractorswillnotattempttorepairRampartGeneralfireplaces.Repairsmaybecostly,ifavailable.andreplacementmaybenecessary.

5. High Wind and Flooding ConditionsBuyerandSellerareadvisedthatifthePropertyislocatedinanareasubjecttohighwinds,orduringstorms,thePropertymayexperiencedamagefromblowingdust,sandanddebriswhichcandisengagerooftiles,shinglesorothermaterialsandcausetreestofall.Floodingcanalsooccurthroughoutthecountyduringstorms,resultinginpropertydamage,slippageofembankments,orleakstostructuresthatoccurdur-ingsuchweatherconditions.

6. Homeowners’ AssociationsBuyerandSellerareadvisedthatthePropertymaybesubjecttomandatorymembershipinoneormoreHomeowners’Associations(HOAs).HOAsmayim-poserestrictionsontheuseanddevelopmentofthePropertyaccordingtotheHOA’sConditions,CovenantsandRestrictions(CC&Rs)andBylaws.IftherearemultipleHOAs,theymayeachchargeseparatedues.

7. Prisons and Jails BuyerandSellerareadvisedthatthereareprisons, jailsanddetentioncenterslocatedintheCountyof SanDiegowhichmayinfluenceBuyer’sdecisionto purchase.Buyerisadvisedtoinvestigatetheimpact,if any,ofsuchfacilities.

Proposition 65BuyerandSellerareadvisedthattheCaliforniaSafeDrinkingWaterandToxicEnforcementActof1986,alsoknownasProposition65,whichbecameeffectiveonJanuary1,1988,concernspotentialhealthdangerfromhazardouschemicals.Proposition65requiresallbusinesses(includingallbuildersofresidentialhomes)toprovideawarningtothepublicofthedangerofpotentialharmbyexposuretothesechemicals.

9. Historic Review/Historic DistrictsBuyerandSellerareadvisedthatmanymunicipalitiesinSanDiegoCountyhavehistoricresourceordi-nanceswhichcanimpactapropertyowner’sabilitytomodifyordemolishaproperty.IntheCityofSanDiego,forexample,abuildingnotlocatedinanexemptareathatisatleast45yearsoldmaybesubjecttohistoricreviewbeforedemolitionorexteriormodificationispermitted.TheCityofSanDiegoalsohasanumberofHistoricDistrictsthatmayimpactwhetherapropertymaybemodified.Buyershouldcontacttheplanningdepartmentofthecity(orthecounty)todeterminewhatimpactahistoricordinancemayhaveontheProperty.Forpropertieslocatedinunincorporatedareas,contacttheCountyDepartmentofPlanningandLanduse,HistoricSiteBoard,(858)694-2960,orvisitwww.sandiego.gov/planning/programs/historical/districts.Formoreinformationonhistoricdistricts,visitwww.sohosandiego.org/resources/historicdistricts.htm.

12. Water RetrofitBuyerandSellerareadvisedthatvariouscities,includ-ingDelMarandSanDiego,mayrequireinstallationoflow-flowwaterdevicesinsinks,showerheadsandtoiletsupontransferofaproperty.CompliancewiththeselocalregulationsmayberequiredinadditiontothoseimposedunderCaliforniaCiv.Codesection1101.4and1101.5.ItisgenerallySeller’sresponsibilitytocomplywiththeserequirements,unlessexemptionsapply.Anynecessarywaiverorcertificateshowingcomplianceshouldbeobtainedfromtheapplicablecityauthoritybeforeclosingescrowontheproperty.

13. Illegal EncampmentsIllegalencampmentsarelocatedthroughoutSanDiegoCounty,ofteninopenspaceorcanyonareas.Lawenforcementauthoritieshavenotbeenabletoeradicateallsuchencampments.ConcernedBuyersshouldinvestigatethispotentialissue.

14. Soil and Geologic ConditionsSeeparagraphs3and4oftheCaliforniaAssociationofREALTORS®StatewideBuyerandSellerAdvisory(SBSA).

15. Gas PipelinesBuyerandSellerareadvisedoftheexistenceofun-derground“transmission”pipelinesusedtotransportnaturalgas,crudepetroleum,andrefinedpetroleumliquidssuchasgasoline,jetfuel,andethanolinSanDiegoCounty.Inaddition,smaller“distribution”pipelinesthatoperateatlowerpressuresalsoexistinSanDiegoCounty.Eachhomethatusesnaturalgasisconnectedtoanundergroundgasdistributionpipe-line.PipelineproximityhasbecomeaconcerntosomehomeownersfollowinganumberofpipelinedisastersintheU.S.Whileburiedpipelinescanpre-sentariskofexplosion,fire,andotherhealthhazards,proximitytoapipelinedoesnotofitselfindicateasafetyrisk.InformationonthelocationoftransmissionpipelinescanbeobtainedfromNaturalHazardDisclosure(NHD)providers.Atthistime,notallNHDpro-vidersreportthisinformation.Informationonthelocationofhazardousliquidandnaturalgastransmis-sionpipelinescanalsobeobtainedfromtheNationalPipelineMappingSystemathttp://www.npms.phmsa.dot.gov/default.htm. LandfillsBuyerandSellerareadvisedthatwithinSanDiegoCountythereareseveralactivelandfills,includingtheBorregoLandfill,LasPulgasLandfill,MiramarLandfill,OtayLandfill,SanOnofreLandfillandSycamoreLandfilllocatedinSantee.Theremaybeotherknownorundiscovered,inactivelandfillslocatedwithinSanDiegoCounty.Formoreinformationabouttheseandotherpossiblelandfillsvisitwww.sandiego.gov/environmental-services.com.

6. Chinese DrywallBuyerandSellerareadvisedthatsomehomesbuiltbetween2003and2008maycontainimporteddefectivedrywallknowninthepressas“Chinesedrywall.”Someresidentsofpropertieswiththisdry-wallhavereportedproblems,includingastrongsulfursmell,likerotteneggs;healthissues,likeirritatedanditchyeyesandskin;difficultybreathing;apersistentcoughandheadaches;andprematurecorrosionordeteriorationofcertainmetalcomponentsintheirhomes,likeairconditionercoilsandwiringbehindelectricaloutletsandinsideelectricalpanelboxes.Eliminatingproblemsassociatedwiththedrywallmayrequireitsremovalfromthehome.Formoreinforma-tion,visittheConsumerProductSafetyCommissionwebsiteatwww.cpsc.gov/info/drywall/index.html.

7. 4. Flooding ValleysBuyerandSellerareadvisedthatpropertiesinrivervalleys,includingMissionValley,SanDieguitoRiverValleyandSanLuisReyRiverValleymaybesubjecttofloodinginperiodsofheavyrain.Aproperty’shis-toryoffloodingandpotentialtofloodmayimpactitsvalueanduse,andavailabilityandcostoffloodinsur-ance.
