The Union of Students in Ireland (USI) has backed up the claims stating that many Third Level students are struggling and unable to pay for rent and food due to the on-going delays in the processing of their grants. Deputy Seán Crowe said “We are now into the second term of the college year and there are still 5,500 students out there who have yet to receive any of their grant payment. The delays have always been a source of great stress for those affected but the situation is now at crisis point. “I am also extremely concerned at the news that students may be forced to drop out of their courses because they are hungry or because they cannot afford somewhere to live close to their college. This is the new the reality for students in the Ireland of 2013. “The new student delivery payment or SUSI system has been an unqualified failure for government and a disaster for thousands of students awaiting their vital financial supports. Sinn Féin has constantly highlighted that the website requires major improvements and the need for a proper tracking process is FOOd PaRceLS FOR STUdeNTS obvious. “Late last year we also raised our growing concerns about the standard of communications in relation to the status of grant applications which we and others regarded as being extremely poor. Clondalkin Sinn FéinCouncillor MatthewMcDonagh, has stated thatClondalkin Sinn Féinmembers are activelycampaigning to oppose theimposition of the Familyhome Tax.

Councillor McDonagh said“We in Clondalkin Sinn Féinoppose the government’sunfair tax on the familyhome. This is not a propertytax, it is a tax on familyhomes.“It is not acceptable thatthe government is preparedto use all means possible toenforce this tax on familiesalready struggling to putfood on the table, and

Local Fine gael TD andMinister of State, brianhayes, has welcomed theannouncement that freeeducating and trainingplaces are being providedfor up 6,500 people who arelong-term unemployed. TheMOMenTUM programme is anew government initiative,which has been launched bythe Minister for education,Ruairí Quinn TD, and theMinister of State for Trainingand Skills, Ciarán CannonTD.

“Creating job opportunities,particularly for thelong-term unemployed, is akey aim for thisgovernment. We arecompletely rebuilding whatwas a broken economy, anda crucial part of this processis ensuring that ourworkforce has the rightskills to meet the challengesof tomorrow. These 6,500new education and trainingplaces are particularlyfocussed on givingjobseekers access to areas

of the economy where thereare opportunities.“Under this initiative, ahuge range of programmeswill be provided by 36education and trainingproviders in the public andprivate sector. Derek Keating TD, has received a positiveresponse from his correspondence to theMinister for the environment, Phil hogan,and a reply to his Dáil Question on 4thDecember 2012 to which Derek Keatingdrew attention to the low standards ofservice being provided by privateoperators who have replaced Localauthorities to collect refuse.

Keating said “not a week has gone by butI receive numerous complaintsparticularly about the private operator,greyhound, with the disastrous andenvironmentally unfriendly service that isprovided since they were awarded thecontract in Dublin Mid-West. I met withthe Minister on a number of occasionsinformally and raised questions in the Dáilon 4th December to highlight the plight ofmany residents.”

“The Minister has given me a commitmentthat he is planning to review his WasteManagement Policy published in July2012. The Minister will in the new Yearbring in a customers’ charter which willrequire that service providers such asgreyhound will be obliged to clearly setout information such as chargingstructures, procedures for dealing withcustomers who fall into arrears, theending of contracts with waste collectorsand the standard of service that will beprovided in the waste industry. Thischarter will come ahead of a newregulatory regime. This regulatory regimewill have statutory obligations on privateoperators and will also aid Localauthorities to develop and enhanceenvironment performance and ensurethat a quality service is delivered.earlier this year, I sought to have a

meeting with Deputy Robert Dowds andthe CeO of greyhound Refuse. The CeO ofgreyhound did not have the courtesy toreply to my invitation. he ignored everypiece of correspondence andcommunication. This is the standard thathe has operated throughout the County ofDublin and indeed the city. I drew all ofthis to the Minister’s attention recentlyand today I received a formal reply fromthe Minister outlining his plans to dealwith unacceptable standards, negativebehaviour and in many cases a breach ofcontract for customers who have paid forservice in advance.I am satisfied that legislation andregulation will be implemented in thenew Year and refuse operators will beobliged to answer directly to customersand to Local authorities for theirshortcomings.” Keating concluded.

Dublin South West Sinn Féin TD, Seán Crowe, has said thatthe government needs to wake up to the growing homelesscrisis in Dublin and across the state. The delay in releasingsuitable naMa housing for families and individuals isunacceptable. a recently released report from the DublinRegional homelessness Consultative Forum shows that therehas been a sharp rise in the number of people sleepingrough in the capital.

Deputy Seán Crowe said “The report from the DublinRegional homelessness Consultative Forum shows that aminimum of 87 people were sleeping rough when theyconducted their count on the night of november 13.“however they usually conduct a self-reporting follow upcount the next morning at the Merchants Quay early

breakfast service, which on average adds 14 more peopleto their count. This unfortunately could not happen becausethe breakfast service was not running on the morning of thenovember 14. So the real figure could 101 people sleepingrough on Dublin’s streets.

“In the same report in april, 73 were counted as sleepingrough, in last winter’s report 87 were counted, in the winterof 2010 it was 70 and 60 in 2009.“This report clearly indicates that there has been a sharprise in the number of people sleeping rough and thegovernment must take action on this issue immediately.The delay in releasing suitable naMa housing for families

and individuals is unacceptable“In the 2013 budget the government cut support forhomelessness services by 7%. To cut this vital support, at atime when homelessness is increasing, is a mistake by thegovernment and it needs to be reversed.“This cut coupled with on-going austerity measures insuccessive budgets will ensure that more people willbecome vulnerable to the risk of homelessness.

“The government needs to act immediately to help themost vulnerable in our society or we will continue to see arise in homelessness and people sleeping rough in our townsand cities.”

Figures released from theCentral Statistics Office showthat 238 people a day leftIreland during 2012, asemigration surged to levelsnot experienced since thefamine.

Sinn féin spokesperson forenterprise trade andemployment, Peadar Tóibín,said that while thegovernment is launching 'Thegathering' the reality is that‘The Scattering’ of Irishpeople across the globecontinues apace.

“This is a disastrous situationfor tens of thousands offamilies who have been forcedto up sticks and separate fromtheir extended families.

“Many of these people will beboarding planes and boats andreturning abroad after theChristmas. emigration is alsohaving a detrimental effect onthe society that's being leftbehind. The 15-24 age group isshrinking significantly here inIreland.

“In 2006 there were 638,000people of this age group in thecountry. In January 2012 thenumber had fallen by 130,000,almost all accounted for byemigration.

“In the years leading up tocrash, there were about325,000 employed under-25sin the State. That has reducedto 130,000. For every 10 jobsthat existed at the beginning

of 2008, six have disappeared.emigration is also taking itstoll on the Irish birth rate.There were 1,200 fewer bornin 2011 than the previous yearmostly due to the highemigration rate amongstyoung mothers.

“These shocking numbers area direct outcome of thisgovernment’s economic policy.The Fine gael/Labourgovernment is committed toone priority and that is therepayment of private debt.The debt collector is beingpaid but whole sections ofsociety are being deleted frombefore our eyes. Unbridledausterity without stimulus andinvestment is ravaging themost vulnerable and sending

our young people abroad.”

Itannounces a cut of 2.6% to the budget for olderpeople, the biggest reduction in funding for anysingle care group in 2013. Worryingly, the planprovides no detail about how this cut is going tobe implemented.”Patricia Conboy said that Older & bolder wouldlike to celebrate the commitment in the 2013Service Plan to maintain home help hours atJanuary 2012 hours. however, she said “Wecannot celebrate this commitment just yet”.She explained: “There is a need for moreinformation on the commitment in the 2013Service Plan to maintain home help hours atJanuary 2012 levels. Originally, the hSe set itselfa target of providing 10.7 million home helphours in 2012. now the hSe is saying that, dueto ‘a technical adjustment’, the target shouldhave been 10.3 million home help hours and thecommitment now is to deliver that same numberof hours (10.3m) in 2013. What we need is someforensic detail on ‘the technical adjustment’and why the lost 400,000 hours should not formpart of a service target in 2013”.

Ms. Conboy concluded: “Over the course of twobudgetary years, we have gone from 11.9 millionhours of home help in 2011 to 10.3 million in2013. This reduction will hurt older peoplesuffering disability, frailty and life limitingillnesses, as well as children and people withdisabilities”.

While completing the CaO form can be adaunting task for students, it is animportant step towards securing theircollege and course of choice. griffithCollege schools liaison officer RichardMurphy explains that there is no need forstudents or parents to be fazed by it.he gives his top tips for completing thisyear’s CaO form:

· do research your course choices inadvance. Sites such as www.cao.ie andwww.qualifax.ie are very useful to assiststudents with their decision.

· do check the basic entry requirementsfor each of the courses you areinterested in. Some courses will havelanguage requirements or may require acertain grade in Maths.

· do apply online, as opposed to thepaper format. The online form issignificantly cheaper and it does notallow applicants to make mistakes byentering a course code that does notexist.

· don’T leave it to the very last minuteeven with the online form, as computers

can crash!

· do fill in all 20 spaces provided for theten Level 8 choices and the ten Level 6and 7 choices to give yourself as muchchoice as possible.

· do put course choices in order ofpreference with what you really want todo first. Don't try to second-guess whatthe points will be in august.

· don’T forget the "Change of Mind"facility that is available after May 1stuntil July 1st.

RPa is pleased to report that2012 has been the mostsuccessful year to date interms of Luas passengernumbers. The past year hasbeen extremely challengingfor all sectors of the Irisheconomy and theperformance of Luas isparticularly hearteningwhen seen in that context.

Passenger numbers on Luasin 2012 are up byapproximately 300,000 on2011 figures to their highestever level. It is expectedthat 29.4 million passengerjourneys will be made onLuas in 2012, compared tojust over 29 million in 2011.These record numbers havebeen achieved despitelosing a week’s service dueto a major fire adjacent tothe Red Line early in theyear.

The busiest times of 2012were at the end of august,

during the Tall Ships festivaland during December whenwe saw an increase inshoppers and revellersduring the Christmasseason.

2012 was also a verysignificant year for thefuture development of Luas.In august, an bord Pleanalagranted a Railway Order forthe 5.6km extension to theLuas green Line betweenSaint Stephen’s green andbroombridge.

The business Case for theproject was brought toCabinet by the Minister forTransport, Tourism andSport, Leo Varadkar T.D. andthe project was givenpermission to commenceconstruction in 2013. Thenew line, which will finallysee the Red and green lineslinked to form a light railnetwork, is conservativelyexpected to generate an

extra 10 million passengerjourneys in a full year. Thenew Luas line is expected togo into operation in 2017.

Welcoming the recordpassenger numbers and thecontinued strongperformance of Luas, RPa’sChief executive RoryO’Connor said that it wasgratifying that Luascontinued to operatesuccessfully without anypublic subvention. “Wehave worked hard to reducecosts on the one hand andto increase passengernumbers on the other andwe are delighted with theincrease in passengernumbers for 2012, whichcertainly bucks the trend”.Mr O‘Connor added that thisstrong performanceunderpins governmentsupport for the newextension at this verydifficult time in theeconomic cycle.

Firstly, it has to be clarified that,under the provisions of Section 2 of theSuccession act, 1965, the personalrepresentative of a deceased person hasone year from the date of death to dealwith the estate and during which time noaction can be brought against thePersonal Representative, without leave ofthe Court, in relation to the distributionof the estate of the deceased. What thismeans is that proceedings may notnormally be brought by beneficiariesagainst the Personal Representative tocompel a distribution before theexpiration of 12 months from the date ofdeath. In exceptional circumstances, onapplication to the Court, proceedings maybe brought against a PersonalRepresentative but it would have to be aparticular case possibly involving hardshipto a beneficiary. In a case where thebequest is of a relatively small nature, itis highly unlikely that you would besuccessful in such application. The ideabehind this section is to allow thePersonal Representative an opportunity toassess the extent of the estate, call in allthe assets, deal with tax issues andindeed deal with any potential claimunder the estate. You mention that thereis a possible dispute between the twochildren of the deceased. In the eventthat the estate is on notice of an action

under Section 117 of the Succession act,dealing with claims by children againstthe estate then, it would be very unwisefor the Personal Representative to makeany distribution on foot of the Willpending the outcome of suchproceedings. It would certainly appearin this case as if there is good reason whya distribution has not yet been made.

Q. My elderly mother diedrecently and in her Will she lefteverything to be divided equallybetween her three children. althoughi know that this is very fair,nonetheless, i do feel a bit hard doneby as i have been living in the housewith my mother for many years while inursed her through her last illness. ialways assumed that i would at least beleft the house for my lifetime. is thereanything i can do?

a. You raise a number of importantissues here. Firstly, you operated underthe assumption that you would be lookedafter in your mother’s Will and, with thatin mind, you undoubtedly gave up certainopportunities to forge your wayindependently in life and possibly buyyour own house. In the presentcircumstances, if the house is sold anddivided three ways then, this affords youlittle opportunity to buy your own home.In the circumstances, it is reasonable toassume that you may not have beenproperly provided for by your mother.

It is also very important to know aboutthe time limits involved in dealing withcases under Section 117 of the Successionact, 1965. There is a very strict timelimit in all these cases. You do not saywhether or not you are the executor inyour Mother’s estate. assuming that youare not the executor then, applicationwill be made by the executor for a grantof Probate. In order to initiate a claimyou MUST do so within 6 MonThs FroMThe daTe oF Taking ouTrepresenTaTion. as soon as the grantissues, your proceedings must beinstituted. It is possible to issueproceedings in advance of the grantprovided there are executors named inthe Will. You do not mention any timesin relation to your Mother’s date of deathor an application for a grant of Probate.It is very important therefore to seekimmediate and urgent legal advice inorder to ascertain whether or not you arestill on time to make a claim.

Representatives (L.P.R.) have a heavyduty and obligation in relation to theadministration of estates and onewhich is not always fully appreciatedby them. In particular, in the presenteconomic climate, not only are theremore estates with considerableliabilities but in many cases, theliabilities outweigh the assets. Thereis a Common Law rule that the LegalPersonal Representative of thedeceased WiLL be personaLLyLiabLe for the deceased debts butonly to the extent of the deceased’sassets not withstanding that he (theL.P.R.) may have distributed them tobeneficiaries because he wasunaware of the debts in question.The problem is that the L.P.R. maynot know the full extent of thedeceased liabilities as at thedeceased’s date of death or, worsestill, may not know them even by thetime that he is ready to distribute theestate. To some extent, the liabilityof the L.P.R., is dealt with underSection 49 of the Succession actwhich states as follows: -

Where the Personal Representativeshave given such notices to creditorsand others to send in their claimsagainst the estate of the Deceased as,in the opinion of the Court in whichthe Personal Representatives aresought to be charged, would havebeen given by the Court in anadministration Suit, the PersonalRepresentative shall, at theexpiration of the time named in thesaid notices, or the last of them, forsending in such claims, be at libertyto distribute the assets of thedeceased, or any part thereof,amongst the parties entitled thereto,having regard to the claims of whichthe Personal Representatives havethen notice.

In other words, Section 49 of theSuccession act confer the protectionon a Legal Personal Representative byproviding that if the L.P.R. has issuedsuitable notices (usually referred toas Section 49 notices) to Creditorsand anyone else with a claim againstthe estate, and he has not receivednotification of any such claims, thenhe may proceed to distribute theestate and cannot afterwards bemade responsible for any claim whichwas not known to him. With regardto what is normal practice fornotification to Creditors, it isgenerally accepted that placing anadvertisement in a newspaper with anational circulation for twoconsecutive weeks and normally, inaddition, an advertisement in aregional newspaper in the area wherethe deceased lived. any notice should specify clearlydetails of the deceased and notify thepublic that the Legal Personal

Representative is about to distribute theestate. It should call on anyone with aclaim against the estate to contact theL.P.R. (or more normally their solicitors)within the period specified in the notice.The period specified is usually onecalendar month after the date of thesecond or last notice. You should please note however that theL.P.R. will noT be proTeCTed FroMLiabiLiTy where he or she has actualknowledge of a claim even when aCreditor does not respond to the notice.Please note however that the publicationof a notice will not prevent a claim frombeing subsequently made. It simplyprotects the L.P.R. The whole idea of thisnotice is to protect the L.P.R. againstCreditors in respect of any distribution ofassets which he makes. however, anydistribution should be postponed until allthe relevant notices have been placed inthe relevant papers and the notice periodhas expired. as you can imagine, this isquite an expensive procedure but it is onewhich should be used in cases where thereis a possibility that there may beoutstanding liabilities not known to theL.P.R. While it is expensive, it is aprotection for the L.P.R. in thesecircumstances. Remember, it is not theassets of the Personal Representativewhich are at risk, merely the assets of thedeceased but, the exposure of the L.P.R.to the value of those assets could result inan expensive claim unless correctprocedures are followed. We wouldadvise that you contact a Solicitor in acase such as this as you need to make surethat you protect yourself.

Q. i have been named as one ofthe personal representatives in theestate of a distant relative. i do notwant to act as administrator. Can i doanything about this?

a. Section 117 (c) of the Successionact 1965, deals with the renunciation ofan executor to act in the administrationof an estate. The Renunciation must bein writing and the signature of theexecutor announcing must be witnessed.The Renunciation must be done as soon aspossible and certainly before the executorstarts to administer the estate. If thereare Solicitors appointed in theadministration of the estate then, theRenunciation should be sent by registeredpost to the Solicitors. If there are noSolicitors involved, then the Renunciationshould be sent to the other namedexecutors in the Will. There is no formalwording for the Renunciation, merelystating clearly that you do not wish to actas executor in the estate of the deceased.The effect of Renunciation is to end theexecutor’s rights in respect of theexecutorship of the Will as if he or she hadnot been appointed by the Will. It doesnot affect your right to inherit under theterms of the Will if you are also named asa beneficiary. I hope that this has beenhelpful.
