  • A SNAPSHOT of OBERON COUNCIL OBERON COUNCIL consists of 9 Elected Councillors who are

    elected for a 4 year term.

    Mayoral elections are held annually in September (and Deputy Mayor).

    The 2012 Local Government Elections for NSW will be held on

    Saturday 8th September

    The Oberon LGA Election will be conducted by the NSW Electoral

    Commission

    30 July 2012 - Close of Authorised Roll (6pm) - Open Nominations

    8 August 2012 - Close of Nominations (12noon) Registration of Electoral Material (how-to-vote) opens

    Note: OBERON BUSINESS ASSOCIATION will be running Meet the Candidate sessions on 18/8 & 22/8

    27 August 2012 - Pre-poll voting starts

    31 August 2012 - Registration of how-to-vote closes (5pm)

    3 September 2012 - Postal Vote Applications close (5pm)

    7 September 2012 - Pre-poll voting closes (6pm)

    8 September 2012 - ELECTION DAY

  • HOW TO NOMINATE? Nominations can be lodged with the Returning Officer from the day the rolls

    close, 30 July 2012, up to 12 noon on Nomination day, 8 August 2012.

    Nominations must include a Candidate Information Sheet that contains:

    Candidates full name

    Candidates enrolled address

    Signature of the candidate and

    Witnessed by a Justice of the Peace

    The Candidate Information Sheet may also include:

    Endorsements by registered political parties,

    Statements regarding the candidates policies and beliefs

    The nomination deposit is $125 for an individual candidate, or $625 for a group of 6 or more candidates

    wishing to form a group.

  • The Local Government Act 1993 provides the

    legal framework for Council's in New South Wales

    to operate

    establishes Councils Charter,

    encourages effective participation of local people in local government affairs,

    gives councils the ability to provide goods, services and facilities

    gives the responsibility for administering regulatory systems under the act

    allows councils to take a role in the management, improvement and development of the

    resources of their area and

    requires Councils, Councillors and Council employees to regard principles of ecologically

  • COUNCIL MEETINGS and COMMITTEES

    Ordinary Meetings are currently held on the third Tuesday of each month (except January)

    commencing at 5.30 pm. Occasionally an extraordinary or Special Meeting will be called to deal with

    an issue of high importance.

    THE TIMES FOR MEETINGS IS DETERMINED BY COUNCIL / CODE of MEETING PRACTICE

    Councillor information briefing sessions are held as required to enable Council staff to present

    information to the Councillors concerning upcoming projects or reports that will be going to a later

    Council meeting.

    Councillors also nominate to Chair and sit on the numerous Section 355 Committees and external

    organisations and Committees (as delegates).

    Representatives on external organisations and Committees (delegates) are decided annually in

    September on the same night as the Mayoral elections.

  • CODE of MEETING PRACTICE

    The Code of Meeting Practice has been developed in accordance with the

    Local Government Act 1993 and the Local Government (General) Regulation –

    Part 10 – Meetings.

    All Meetings are conducted in accordance with this Code.

  • CODE OF CONDUCT Section 440 of the Local Government Act requires that every Council adopts a Code of Conduct.

    Councillors, members of staff, independent conduct reviewers, members of Council Committees

    including the Conduct Review Committee and delegates of the Council must comply with the

    applicable provisions of Council’s Code of Conduct in carrying out their functions as Council officials.

    Councillors have two distinct roles under the Local Government Act 1993: as a member of the

    governing body of the Council; and as an elected person. Councillors, as members of the governing

    body, should work as part of a team to make decisions and policies that guide the activities of the

    Council.

    The role as an elected person requires Councillors to represent the interests of the community and

    provide leadership. The Model Code sets the standard of conduct that is expected when Council

    officials exercise these roles.

  • COUNCIL POLICIES

    Policies are guidelines that govern how Oberon Council deals with the many

    and varied issues that arise in the Oberon Local Government Area.

    When a policy is being created, it is reported to Council in draft format. Council

    then resolves to place the policy on exhibition to the public for a period of 28

    days. During this time, the community are able to write submissions to the

    General Manager regarding the proposed policy.

    Following the exhibition period, the policy and comments are reported back to

    Council with any recommendations. Council then votes to adopt the policy.

    Council reviews each policy in accordance with the relevant legislation but at a

    minimum timeframe of every two years

  • STATE RECORDS ACT

    Oberon Council is regarded as a public office and therefore Council must

    comply with the State Records Act.

    A state record refers to any record made and kept, or received and kept, by

    any person in the course of the exercise of official functions in a public office.

    This can include correspondence such as letters and emails, notes of phone

    calls and minutes of meetings.

    To comply with the Act, Council must ensure the safe custody and preservation

    of the records it is responsible for. The records are disposed of under the

    guidelines of the General Disposal Authority.

    Council has a number of electronic systems to assist with compliance,

    primarily the electronic document management system known as “InfoXpert".
