I n t e r r u p t i o n : The Company s h a l l have t h e r i g h t t o i n t e r r u p t service t o t h e a i r cond i t ion - i n g compressor u n i t f o r up t o 10 minutes dur ing any 30 minute p e r i o d from June 1 through September 30 of each y e a r when deemed n e c e s s a r y by t h e Com- pany t o c o n t r o l peak e l ec t r i c l o a d s .

The Company w i l l i n s t a l l underground e l e c t r i c d i s t r i b u t i o n f a c i l i t i e s iJ i thin new r e s i d e n t i a l s u b d i v i s i o n s i n accordance w i t h i t s s t a n d a r d p o l i c i e s m d p rocedures and the r u l e s of the P u b l i c S e r v i c e Commission of Kentucky s p p l i c a b l e t h e r e t o (807 KAR 5:041E, S e c t i o n 2 1 , E l e c t r i c ) under t h e f o l l o w i n g Zondi t ions :

1. These r u l e s s h a l l apply o n l y t o 120/240 v o l t , s i n g l e phase service to :

( a ) R e s i d e n t i a l s u b d i v i s i o n s c o n t a i n i n g t e n o r more l o t s f o r t h e c o n s t r u c t i o n o f new r e s i d e n t i a l b u i l d i n g s des igned f o r less than f ive- fami ly 3 c cup an cy.

(b ) High d e n s i t y , multiple-occupancy r e s i d e n t i a l b u i l d i n g . p r o j e c t s c o n s i s t i n g o f two o r more b u i l d i n g s n o t more than t h r e e s t o r i e s above grade l e v e l and c o n t a i n i n g n o t less than f i v e fami ly u n i t s p e r b u i l d i n g .

2. When an Appl icant has complied w i t h t h e s e r u l e s and w i t h t h e a p p l i - cab le r u l e s of t h e P u b l i c S e r v i c e Commission, and h a s g iven t h e Company a t least 120 days ' w r i t t e n n o t i c e p r i o r t o the a n t i c i p a t e d d a t e of comple t ion ( i . e . , ready f o r occupancy) of t h e f i r s t b u i l d i n g i n t h e s u b d i v i s i o n , t h e Com- pany w i l l under take t o complete t h e i n s t a l l a t i o n o f i t s f a c i l i t i e s a t l eas t 30 days p r i o r t o such e s t i m a t e d d a t e of comple t ion . However, no th ing h e r e i n s h a l l be i n t e r p r e t e d t o r e q u i r e t h e Company t o ex tend s e r v i c e t o p o r t i o n s o f s u b d i v i s i o n s n o t under active development.

The Appl icant may be r e q u i r e d t o advance t o t h e Conpany t h e f u l l e s t ima ted c o s t of c o n s t r u c t i o n of i t s underground e l e c t r i c d i s t r i b u t i o n ex tens ion . This advance, t o t h e e x t e n t i t exceeds t h e non-refundable charges s e t f o r t h above, s h a l l be s u b j e c t t o re fund .

( a ) I n t h e c a s e of r e s i d e n t i a l s u b d i v i s i o n s , t h i s advance, i f r e q u i r e d , s h a l l be c a l c u l a t e d a t a u n i t charge of $8.75 p e r aggrega te f r o n t - f o o t and t h e re fund s h a l l be made, on t h e b a s i s of 2000 times t h e amount by which such u n i t charge advance exceeds t h e non-refundable u n i t charge set f o r t h i n Paragraph 3 above, f o r each permanent customer connected t o t h e underground d i s t r i b u t i o n system d u r i n g t h e t e n year p e r i o d fo l lowing t h e d a t e such advance i s made.

When Company i s unable t o r ead cus tomer ' s meter a f t e r r easonab le e f f o r t , o r when Company expe r i ences c i rcumstances which make a c t u a l meter r e a d i n g s imposs ib l e o r i m p r a c t i c a b l e , customer may be b i l l e d on a n e s t ima ted b a s i s and t h e b i l l i n g w i l l be a d j u s t e d as necessa ry when t h e meter i s r ead .

In t h e event Company's e l ec t r i c meter f a i l s t o r e g i s t e r p r o p e r l y by ' r e a s o n of damage, a c c i d e n t , e t c . , t h e Company s h a l l have t h e r i g h t t o estimate t h e cus tomer ' s consumption du r ing t h e p e r i o d of f a i l u r e on t h e b a s i s of such f a c t o r s as t h e cus tomer ' s connected load and h i s consumption dur ing a p rev ious cor responding pe r iod and du r ing a tes t p e r i o d immediately fo l lowing r ep lace - ment o f t h e d e f e c t i v e meter.
