(Documents submitted) MSC 85/2 (Secretariat) - Outcome of the fifty-eighth session of the Technical Co-operation Committee This document provides information on the outcome of the TC 58 on matters of interest to the Committee. MSC 85/2/1 (Secretariat) - Outcome of the one hundredth regular session of the Council The Committee is invited to note the outcome of C 100 on matters relevant to its work and take action as appropriate. It includes endorsement of holding a conference for the adoption of amendments to the STCW Convention and the STCW Code in 2010. MSC 85/2/2 (Secretariat) - Outcome of the fifty-eighth session of the Marine Environment Protection Committee This document reports on the outcome of the fifty-eighth session of the MEPC on matters of interest to the Committee. The Committee is invited to note the above information, in particular, on issues given hereunder: - approved, subject to MSC’s concurrent decision, an MSC-MEPC circular on Blanking

of bilge discharge piping systems in port: - approved, subject to MSC’s concurrent decision, an MSC-MEPC.3 circular on

Reports on marine casualties and incidents; - noted the FSI Sub-Committee’s view that the draft MSC/MEPC circular on Blanking

of bilge discharge piping system in port did not need any changes - approved, subject to MSC’s concurrent decision, an MSC/MEPC circular on Unified

interpretation of the application of regulations governed by the building contract date, the keel-laying date and the delivery date for the requirements of the SOLAS and MARPOL Conventions;

- concurred with the recommendation to add an annex 7 to the Code for the Implementation of Mandatory IMO Instruments showing the amendments to

- IMO instruments not yet accepted at the date of revision of the Code, but expected to be accepted and to enter into force within the following months, and instructed the FSI Sub-Committee to develop this accordingly, subject to MSC’s concurrent decision and the endorsement of the Council;

- The MEPC noted, in general, the outcome of C 100 on issues of relevance to its work, as reported in paragraphs 11.9 to 11.15 of document MEPC 58/23. In the context of considering applications for consultative status, the MEPC recommended to the Council that consultative status should be granted to the World Shipping Council (WSC) and not to be granted to the International Council on Clean Transportation (ICCT) and NACE International;

- Having noted the relevant decisions of MSC 84 regarding work programmes of the Sub-Committees, the MEPC: 1. approved the work programmes of the BLG and FSI Sub-Committees and the

provisional agendas for BLG 13 and FSI 17; and 2. agreed to the environmental-related items in the work programmes of the DSC,

NAV and DE Sub-Committees. - The MEPC, taking into account the technical workload of the Organization, the

priorities assigned by the Assembly in resolution A.990(25) to subjects for consideration by the MSC and the MEPC and the advice provided by the Chairmen of the sub-committees, approved, subject to the MSC’s concurrent decision, the plan of meeting weeks for the MSC and the MEPC and their subsidiary bodies for the biennium 2010-2011, as reflected in paragraphs 19.15 to 19.20, for inclusion in the Secretary-General’s relevant budget proposals, taking into account that the two sessions planned for the DE Sub-Committee in 2010 will be decided by MSC 85.

MSC 85/2/3 (Secretariat) – Outcome of the ninety-fourth session of the Legal Committee This document reports on the outcome of LEG 94 on matters relevant to the Committee’s work. It includes the following: - Joint IMO/ILO Ad Hoc Expert Working Group on Liability and Compensation

Amendments to the 1974 SOLAS Convention

Background: The expanded Committee will consider for adoption, draft amendments to the International Convention for the Safety of Life at Sea, 1974, as amended. The aforementioned proposed amendments, approved by MSC 83 and MSC 84, are contained in annex 1 to document MSC 85/3. They have been circulated, in accordance with article VIII of the 1974 SOLAS Convention, by circular letter No.2876 of 21 May 2008 (annex 1). The summary of the changes are given below. Since the text has been approved, there will not be substantial discussion on the regulation at this session. The Committee, at this session, will only review these texts from editorial/drafting viewpoints. The entry into force date of these requirements is to be decided by the Committee at this session. Specific changes (SOLAS Reg. II-1/2 (Definition), II-1/5 (Intact stability information) and II-1/5-1 (Stability information to be supplied to the master)

Background: These amendments are proposed in order to make the Intact Stability Code, 2008 (2008 IS Code) mandatory

Implication: Refer to the introduction of the 2008 IS Code.

(SOLAS Reg. II-2/9.4.1.1.2 - Containment of fire - Protection of openings in fire-resisting divisions (doors with three-sided frames)

Background: The following is the summary of the amendment:

- Gap under door – shall be less than 12mm & non-combustible sill shall be installed under the door.

- Doors approved without the sill being part of the frame shall be installed such that the gap under the door shall not exceed 25 mm.

- Doors approved A class without the sill being part of the frame shall be installed so that the gap under the door does not exceed 12 mm and a non-combustible sill shall be installed under the door such that floor covering do not extend beneath the closed door. Doors approved as B class without the sill being part of the frame shall be installed such that the gap under the door does not exceed 25 mm.

Implication: New Fire doors will need to meet new requirements

Application: These requirements will be applied to new ships and doors of existing ships which will be installed (replaced) on or after the date decided by the Committee.

(SOLAS Reg. II-2/9 - Containment of fire - Ventilation systems (ventilation duct be of steel or equivalent))

Background: FP 52 agreed with the amendment to the SOLAS Reg. II-2/9.7.1.1, 9.7.1.1.2, 9.7.4.4.2, 9.7.4.4.3, 9.4.4.3.1and the 2000 HSC Code paragraph 7.6.7 for requiring that ventilation duct to be steel or equivalent with some exceptions given therein. Implication: Shipbuilders and manufacturers of fire dampers will have to meet new requirements. Application: New ships.

(SOLAS Reg. II-2/9.7.5.2 - Containment of fire - Ventilation systems (Fire damper at both ends))

Background: The FP Sub-Committee prepared a text to expand the requirements of installing fire dampers at the both end of the duct currently imposed to only passenger ships with more than 36 passengers, to passenger ships with not more than 36 passengers and cargo ships. Subsequently, the draft text of the SOLAS Regulation II-2/9.7.5.2 was agreed. No proposal was made with regard to the HSC Code. The Sub-Committee further agreed that these requirements will be applicable to new ships only. Implication: Shipbuilders and manufacturers of fire dampers will have to meet new requirements. Application: New ships.

(SOLAS Reg. II-2/10.2.6 - Fire-fighting - Fire-fighter’s outfits (Recharge of emergency breathing apparatus for passenger ships))

Background: FP 52 reviewed requirements for the spare breathing charge given in SOLAS Reg.II-2/10.2.5 agreed new text of Reg. 10.2.6 utilizing the high pressure system to 1200 per Breathing Apparatus set. Implication: Instead of requiring two spare charges per one emergency breathing apparatus, recharging arrangement will be required. It might be a practical solution for shipowners. Application: This proposed amendment is intended to apply to new passenger ships with 36 passengers or more on the date set by the IMO.

(SOLAS Reg. II-2/1 and II-2/19 - Carriage of dangerous goods (Note to table 1 and 2 and entire table 19.3

Background: The proposal was to update the Note 1 to table 19.1 and 19.2 as well as replace entire table 19.3 with the relevant amendments to regulation 1.

Amendments to the Protocol of 1988 relating to the International Convention on Load Lines, 1966

Background: The expanded Committee will be invited to consider for adoption, draft amendments to the Protocol of 1988 relating to the International Convention on Load Lines, 1966. The proposed amendments, approved by MSC 83, are contained in the annex to document MSC 85/3/1 and have been circulated, in accordance with article VI of the 1988 Load Lines Protocol, by circular letter No.2877 of 19 May 2008. In order to make the Intact Stability Code (2008 IS Code) mandatory under 88 Protocol to 1966 Load Line convention, amendments to the following regulations will be adopted:

- Regulation 1 – Strength and intact stability of ships - Regulation 3 – Definitions of terms used in the Annexes

Further, an amendment to the following regulation will also be adopted to make the carriage requirements of stability information mandatory.

- Regulation 10 – Information to be supplied to the master Implications: While Regulation 1 and 3 are procedural issues (to make the 2008 IS Code mandatory), Regulation 10 has substantial impact, i.e., previously, an Administration or its Recognized Organization are to approve the form of the information but now they are required to approve the content.

Amendments to the International Code for the Safe Carriage of Packaged Irradiated Nuclear Fuel, Plutonium and High-Level Radioactive Wastes on Board Ships (INF Code)

Background: The expanded Committee will be invited to consider, for adoption, draft amendments to the International Code for the Safe Carriage of Packaged Irradiated Nuclear Fuel, Plutonium and High-Level Radioactive Wastes on Board Ships (INF Code). The proposed amendments, approved by MSC 84, are contained in annex 2 to document MSC 85/3 and have been circulated, in accordance with article VIII of the 1974 SOLAS Convention, by circular letter No.2876 of 21 May 2008 (annex 2). Background: Regulation 1.1.1.8, 1.2.1 and 11.1 will be revised. These amendments are editorial changes as a result of the mandatory introduction of the BC Code. There is no implication out of this amendment.

Amendments to the International Code of Safety for High-Speed Craft, 2000 (HSC Code)

Background: The expanded Committee will be invited to consider, for adoption, draft amendments to the International Code of Safety for High-Speed Craft, 2000 (2000 HSC Code). The proposed amendments, approved by MSC 84, are contained in annex 3 to document MSC 85/3 and have been circulated, in accordance with article VIII of the 1974 SOLAS Convention, by circular letter No.2876 of 21 May 2008 (annex 3). (Paragraph7.6.7 Fire Safety – Ventilation (ventilation duct be of steel or equivalent))

Background: FP 52 agreed with the amendment to the SOLAS Reg. II-2/9.7.1.1 and the 2000 HSC Code paragraph 7.6.7 for requiring that ventilation duct to be steel or equivalent with some exceptions given therein. Application: New ships, including High Speed Crafts. Implication: Shipbuilders and manufacturers of fire dampers will have to meet a new requirement.

(Paragraph7.17 - Fire safety – note 1 to table 17.1 and entire table 7.17.3 (Application of the requirements of section 7.17.3 to different classes of dangerous goods except solid dangerous goods in bulk))

Background: Similar amendments were approved for SOLAS Chapter II-2. Members were invited to make final comments to DSC 13 prior to the adoption at MSC 85. Subsequently comments presented at DSC 13 will be considered by the Committee. Application: Ships which carry dangerous goods onboard. Implication: Nominal, as this is primarily solving the inconsistencies between texts.

Background: The expanded Committee will be invited to consider, for adoption, draft amendments to the International Life-Saving Appliance Code (LSA Code). The proposed amendments, approved by MSC 84, are contained in annex 4 to document MSC 85/3 and have been circulated, in accordance with article VIII of the 1974 SOLAS Convention, by circular letter No.2876 of 21 May 2008 (annex 4).

(Paragraph 4.7.2 - Carrying capacity of a free-fall lifeboat)

Background: Design of free-fall lifeboat seats and seating space has been reviewed by the DE Sub-Committee. Implication: As a result of the above amendments, a new lifeboat will be larger (wider). Therefore, not only the manufacturers of lifeboats, but also manufacturers of launching device as well as shipbuilders should consider design impacts to accommodate larger (wider) freefall lifeboats. Application: Free-fall lifeboats

(Paragraph 4.4, 4.7 and 5.1 - “General requirements for lifeboats”, “Free-fall lifeboats” and “Rescue boats”)

Background: Increasing the assumed weight of persons on cargo ship lifeboats to 82.5 kg, while retaining the existing 75 kg criterion for passenger ship lifeboats. Implication: Owing to the change of the weight of occupants, design of a survival craft will be changed, subsequently, it will imply that design load for the launching appliances will be increased. Application: Free-fall lifeboats and rescue boats

Amendments to the International Safety Management Code (ISM Code)

Background: The expanded Committee will be invited to consider, for adoption, draft amendments to the International Safety Management Code (ISM Code). The proposed amendments, approved by MSC 84, are contained in annex 5 to document MSC 85/3 and have been circulated, in accordance with article VIII of the 1974 SOLAS Convention, by circular letter No.2876 of 21 May 2008 (annex 5). A further proposal was submitted by IACS (MSC 85/3/9). Implications: Shipowners & Ship managers are to pay due attention to the change, which will affect company’s or ship’s safety management system, e.g., period of the internal audit is now clearly identified as annual. Application: To ships engaged on the international voyages (500 gt or over for cargo ships, no tonnage limitation for passenger ships) and to companies managing such ships.

Adoption of the International Maritime Solid Bulk Cargo (IMSBC) Code) (IMSBC Code)

Background: IMO has been working to revise the BC Code with a view to make the Code mandatory. It is intended that:

Implications: Shipbuilders, shipowners and ship managers are invited to note the above development. Mandatory application will have significant impact, for example,

• Owing to the segregation requirements, coal will not be allowed to be stored in a cargo hold if the adjacent fuel tanks are heated.

• If the ship intends to carry DRI (B), an installation for nitrogen inerting system (portable or permanent nitrogen gas generator or nitrogen bottles) must be provided.

Applications: Ships carrying solid bulk cargoes.

Adoption of the International Code on Intact Stability 2008 (2008 IS Code)

Background: The expanded Committee will consider, for adoption, the draft International Code on Intact Stability, 2008. The draft Code approved by MSC 83 is contained in document MSC 85/3/2. The Code will be mandatory under the 1974 SOLAS Convention and 1966 Load Lines Convention. The Intact Stability Code (IS Code) was adopted in 1993 by resolution A.749 (18) and later amended by the MSC in 1998 (Resolution MSC.75 (69)). The revision of the IS Code involves restructuring it and, as a long-term task, developing performance-based stability criteria to replace, or add to, the existing prescriptive provisions. This task takes into account “Dynamic Phenomena” in seaways.

The following main modifications to the IS Code:

- Restructure of the IS Code in two different parts: Part A which includes the mandatory stability criteria; and Part B which provides guidance and recommendations;

- Part A of the IS Code will be made mandatory through ILLC and SOLAS. Part A includes the general criteria (updated A.749(18) paragraph 3.1), as well as, the existing mandatory intact stability standards according others IMO instruments (Oil Tankers, Cargo ships carrying timber deck cargoes, Cargo ships carrying grain in bulk and High speed craft);

- Weather criterion is included in the mandatory Part A of the Code. Alternative methods to calculate the wind heeling lever and/or the angle of roll by means of model experiments may be accepted subject to the approval of the Administration. MSC 81 approved “The Interim Guidelines for Alternative Assessment of the Weather Criterion” (MSC Circ 1200) to provide guidance in applying the alternative methods. It must be noted that MSC 82 approved “Explanatory Notes to the Interim Guidelines for Alternative Assessment of the Weather Criterion” (MSC Circ. 1227) which provides an example of the alternative assessment of severe wind and rolling criterion according MSC Circ.1200;

- According Part A (mandatory) of the IS Code, if a stability instrument is used as a supplement to the stability booklet for the purpose of determining compliance with the relevant stability criteria such instrument shall be subject to the approval by the Administration. A new chapter 4 has been included in Part B to provide guidance regarding stability calculations performed by stability instruments. The IS Code also refers to the “Guidelines for the Approval of Stability Instruments” (MSC Circ. 1229) which was approved by MSC 82; and

- General update of the information contained in A.749(18) which covers a wide range of issues like the calculation of the free surface effects, the lightweight determination guidelines, the calculation of stability curves, consideration of buoyancy of higher tiers of enclosed superstructures or the review of the MSC Circ. 707 referred in the IS Code chapter 5 (MSC Circ. 1228 on “Revised Guidance to the master for avoiding dangerous situations in adverse weather and sea conditions” approved by MSC 82).

In order to make the part A of the IS Code mandatory, the Committee approved the draft text of the amendments to both in the 1974 SOLAS Convention and the 1988 Protocol to the Load Line Convention with a view to subsequent adoption at MSC 85. It was agreed that these amendments would have the same entry into force date for both instruments.

Implication Vessels with large breadth to depth or breadth to draught ratios will be able to comply with the alternative intact stability criteria for Offshore Supply Vessels rather than the general stability criteria. Application The revised intact stability code will come into force for new ships over 24 metres in length in 2010. Ships with large breadth to depth or breadth to draught ratios will be able to apply the Offshore Supply Vessel criterion.

Amendments to SOLAS chapter VI concerning Material Safety Data Sheet (MSDS) and related guidance

Background: The expanded Committee will be invited to consider, for adoption, the draft revised SOLAS regulation VI/5-1 and other relevant amendments to SOLAS chapter VI; and related Guidance on the provision for MSDS when carrying oil, including fuel oil, in accordance with SOLAS regulation VI/5-1. Implications: Revised text includes bunkers. This has substantial impact on day to day ship’s operation for ship owners and bunker fuel suppliers. Application: All ships

Amendments to non-mandatory instruments - amendments to the revised recommendation on testing of life-saving appliances (resolution MSC.81 (70))

Background: The expanded Committee will consider, for adoption, draft amendments to the revised recommendation on testing of life-saving appliances, in conjunction with the adoption of the draft amendments to the LSA Code given above. Implications: Testing procedure for a free-fall lifeboat is revised. Application: Approval of a free-fall lifeboat.

It proposes revised section 12.1

“12.1 The Company should carry out internal audits on board and ashore at least annually to verify whether safety and pollution-prevention activities comply with the safety management system.”

MSC 85/3/10 (Secretariat) - Amendments to the draft International Maritime Solid Bulk Cargoes (IMSBC) Code The Committee is invited to consider, with a view to adoption, modifications to the draft IMSBC Code. MSC 85/3/11 (Secretariat) - Modifications to the draft amendments to SOLAS chapter II-2 and the 2000 HSC Code The Committee is invited to consider proposed modifications to the amendments to the 1974 SOLAS Convention and the 2000 HSC Code which are envisaged to be considered with a view to adoption. This document provides further amendments to SOLAS Regulation II-2/19 and the table 19.3

5. Measures to enhance maritime security (Agenda Item 4)

Executive synopsis on this agenda item Background: The Committee will consider the report of the correspondence on security aspects of the operation of ships which do not fall within the scope of SOLAS chapter XI-2 and the ISPS Code re-established by MSC 83 and instructed to report to MSC 85. MSC 84, whilst noting the information (MSC 84/4 (Secretariat)) on the Fifth special meeting of the United Nations Security Council Counter-Terrorism Committee with International, Regional and Sub-Regional Organizations and the associated Joint Statement and Plan of action invited SOLAS Contracting Governments to review the Plan of Action (MSC 84/4, annex) and to submit reports on actions they have taken in relation to, and observations on, the activities listed therein as being associated with the Organization, for consideration during MSC 85. Pursuant to the decisions of MSC 84, the Committee consider the development of guidance on port facility security audits taking into account the suggestions set out in document MSC 84/4/3 (Canada) and any related submissions from SOLAS Contracting Governments and international organizations. MSC 85/4/3 (International Association of Classification Societies (IACS)) - Proposed revised amendments to MSC/Circ.1097 This document addresses the need to consider the text of MSC/Circ.1097 to facilitate improvement of the security system and prevent recurrence in addition to restoring compliance after a deficiency has been identified; and to provide appropriate practical guidance on how conflicts between safety and security can be addressed.

LR position: The prescriptive approach will be discussed based upon the outcome of the Pilot. Panel will complete its second phase of the trial application of Tier III – Verification requirements. There is a significant attempt being made to understand what Goal-based standards mean for the Organisation and its Member States in the context of the development of statutory national and international regulations across all areas of IMO involvement. This is a substantial undertaking which could require significant resource and time to develop. The application of GBS process in that respect is less defined. There are advocates of Safety Level Approach, however there is still a long way to go to reach unified understanding what this approach means for the safety of commercial ships. LR does not consider that a safety case approach to designing and building ships is appropriate. Any Goal-based framework should establish a scheme which will be “Rules for Rules” as opposed to “Rules for ships”. Implications: The most significant effect from the discussion at this session will result from consideration of the amendments to SOLAS to introduce the “prescriptive” GBS concept for bulk carriers and oil tankers. At this session, MSC is trying to approve the text of the International conventions. The entry into force and applicability provisions will be discussed. If GBS would necessitate introduction of IACS CSR changes, then there could be an effect on ship designs. Application: At the moment the application of GBS is for the Classification Rules for bulk carriers and oil tankers as defined in IACS CSR. MSC 85/6/2 (International Mobile Satellite Organization (IMSO)) - Outcome of the Twentieth Session of the IMSO Assembly This document provides information on the outcome of the Twentieth Session of the IMSO Assembly, held in Malta, from 29 September to 3 October 2008. Among the items considered by the IMSO Assembly were matters related to:

.1 Global Maritime Distress and Safety System (GMDSS).

8. Ship design and equipment (Agenda Item 7)

Executive synopsis on this agenda item Background: The Committee will consider matters emanating from the fifty first session of the Sub-Committee not considered by MSC 84 and take action as indicated in paragraph 2 of document MSC 85/7. Action in respect of the Sub-Committee’s work programme will be taken under agenda item 23. The Committee will also be invited to consider the report of the intersessional Working Group on Interpretation of the Definition of Bulk Carrier established by MSC 84 (see circular letter No.2886) and take appropriate action.

- Definition of bulk carriers: IMO has been working to define “Bulk Carrier” in a clearer manner. Since amendments made to SOLAS Chapter XII (SOLAS 2004 amendment (MSC.170 (79), a bulk carrier is now defined based upon its use (ship which is intended primarily to carry dry cargo in bulk), rather than its unique configuration (Constructed generally with single deck, top-side tanks and hopper side tanks in cargo spaces). By this amendment, any ship carrying solid bulk cargoes is now a bulk carrier but some of the requirements developed for the application to a bulk carrier based upon its unique configuration cannot be applicable to a ship which does not share such structural character. It also created inconsistencies between the definition given in SOLAS Chapter XII and Chapter IX, and Assembly Resolution A.744 (18).

Shipowners: Significant impact, it not only will affect applicable requirements to the particular ship, but if a ship is re-categorized as a bulk carrier, it may affect Company’s DOC issued in accordance with the ISM Code, e.g., re-audit and re-certification if the type of the ship under management has been changed. Shipbuilder: Significant impact, as some of the requirements which are not applicable to multi-purpose ship may be applicable to these ships. Flag Administration and R.O. Significant impact as it will affect survey checklist, a certificate of ship, ship’s data etc.

Application: To ships carrying solid bulk cargoes.

- Draft amendments to SOLAS regulation II-1/3-5.2 The DE Sub-Committee agreed the proposal of Japan on the total prohibition of asbestos onboard the ship, and agreed to submit the proposed revision to SOLAS Reg. II-1/3-5 to MSC 85 for approval and subsequent adoption. Implication: Although the draft text of the revised SOLAS is not clear about the actual implementation scheme, it is envisaged that the total prohibition applies both to new ships and to existing ships, when the parts (which may contain asbestos exempted previously as essential use) of existing engine are replaced with the new ones. The availability of such replacement parts that do not contain asbestos as well as the status of the spare already purchased may require careful consideration. Application: to be clarified. It is envisaged that the total prohibition applies to any equipment installed from the date that will be set by MSC.

- Draft MSC/MEPC circular on Blanking of bilge discharge piping systems in port

The DE Sub-Committee considered the IACS comments with concern. IACS informed the Sub-Committee that in several instances deficiencies were raised by PSC inspectors and other surveyors requiring the ship staff to blank off bilge pumping overboard discharges. In IACS’ view, this is in contravention of SOLAS chapter II-1, regulation 21, as the bilge pumping arrangement is rendered inoperative and leads to a potentially dangerous situation where the ship is left unable to efficiently and promptly tackle an emergency situation in case of flooding or fire. Subsequently, the Sub-Committee prepared a draft MSC-MEPC circular for the attention of the PSC Authorities. A national delegation suggested bringing the matter to the attention of the regional PSC MOUs. Implication: This draft circular was prepared with an aim to foster correct understanding of the International Regulation among PSC Officers. Shipowners and ship managers are invited to note the development and to consider providing masters with a copy of the circular in order to avoid any dispute during PSC inspection.

- Draft MSC circular on Interpretation of SOLAS regulations II-1/1.3 and II-1/3-6 as interpreted by MSC/Circ.1176 – application of the requirements for Means of Access

The following interpretation proposed by IACS was agreed by the DE Sub-Committee;

Means of access contained in Table 1 of the Technical Provisions should not apply to tankers converting from single hull to double hull. However, if, in the course of conversion, substantial new structures are added, these new structures should comply with the regulation.

The term ”substantial new structures” means hull structures that are entirely renewed or augmented by new double bottom and/or double side construction (e.g., replacing the entire structure within cargo area or adding a new double bottom and/or double side section to the existing cargo area).

Implication: Shipbuilders and shipowners are invited to pay due attention in planning conversion of the single hull tanker to double hull tanker. Application: converted double hull tankers.

- Draft MSC circular on Interpretation of SOLAS regulation III/16.1

Although SOLAS does not specify a precise location of an embarkation station for non-davit launched liferafts, IACS considers that it was logical that persons can embark at any point along the ship’s length to gain access to a liferaft that has been thrown overboard. Texts of the IACS Unified Interpretations are available at its website. (http://www.iacs.org.uk/publications/publications.aspx?pageid=4&sectionid=4) Implication: Nominal, as it has been implemented by IACS members since 1 July 2007. Application: cargo ships of less than 85 m in length other than oil tankers, chemical tankers and gas carriers

- Draft MSC circular on Unified interpretation of SOLAS regulation II-1/32.1

As agreed at DE 50, the DE Sub-Committee considered a unified interpretation of SOLAS regulation II-1/32.1, providing guidance for a relaxation of the explicit requirement for redundancy of safety valves for steam boiler and boiler feed systems. The Sub-Committee agreed with the following interpretation:

“With respect to the application of SOLAS Chapter II-1, regulation 32.1 for the redundant requirement of safety valves for steam boilers and unfired steam generators, the satisfaction of the Administration that adequate protection against overpressure is provided should be confirmed by carrying out a satisfactory technical risk assessment.”

Implication: The required “risk assessment” approach, although giving flexibility in considering the matter on a case by case basis, may be difficult in actual application compared to the prescriptive approach. It is envisaged that the intent of this interpretation is that there should be sound technical reasoning for such exemption. Application: Safety valves of steam boilers and unfired steam generator.

Section A-I/7 of the STCW Code requires the Secretary-General to maintain a list of competent persons approved by the Committee. This document gives, for the approval of the Committee, a list of persons nominated by Parties, to act as competent persons pursuant to section A-I/7 of the STCW Code.

11. Flag State implementation (Agenda Item 10)

Executive synopsis on this agenda item Background: The Committee will be invited to consider the report of the sixteenth session of the Sub-Committee and took action as indicated in paragraph 2 of document MSC 85/10. Action in respect of the Sub-Committee’s work programme will be taken under agenda item 23. LR position: To monitor discussions, especially discussions on the following: 1. the draft MSC/MEPC circular on Blanking of bilge discharge piping system in port

(FSI Report action item 9) The circular has been approved by MEPC, and expected to be concluded at MSC 85. The FSI Sub-Committee was of the view that it does not need any change, and its request to the Secretariat to provide all PSC regimes with a copy of the draft circular, as requested by DE 51 (paragraph 7.50);

2. the FSI Sub-Committee’s consideration of the issue of annual testing of the automatic identification system (AIS) (FSI Report action item 10)

LR will pay due attention once matter is concluded. 3. the MSC-MEPC circular on Unified interpretation of the application of regulations

governed by the building contract date, the keel laying date and the delivery date for the requirements of the SOLAS and MARPOL Conventions (FSI Report action item 11)

The matter was originally initiated by IACS. LR will pay due attention once matter is concluded.

4. applicability of IMO Conventions to FPSOs and FSUs (FSI Reprot action item 13 and MSC 85/10/1)

LR supports the document submitted by joint industry members, including IACS. (MSC 85/10/1)

5. Examination of the outside of the ship’s bottom on passenger ships (MSC 85/10/2) LR noted that although the matter has been tasked to the DE Sub-Committee, owing to the heavy work load of the Sub-Committee, the item has not been included in the agenda of the next session of the Sub-Committee. For this reason, LR shares concerns expressed by CLIA.

proposals for the completion of the study on the combination of casualty and port State control data and to identify the datasets that might be needed for combining casualty and PSC data (paragraph 3.15.2*);

MSC 85/10/1 (Panama, IACS, IADC, ITF, OCIMF and OGP) - Applicability of IMO Conventions to FPSOs and FSUs This document provides comments on the views expressed at STW 39 and FSI 16 concerning the safety regime under IMO Conventions applicable to FPSOs and FSUs. MSC 85/10/2 (CLIA) - Examination of the outside of the ship’s bottom on passenger ships This document notes the lack of progress at FSI 16 in drafting an amendment to the Survey Guidelines under the HSSC to recognize the possibility of an extended dry-dock interval for passenger ships as decided at MSC 84 and thus emphasizes the need for such action. Recognizing that underwater inspections for cruise ships are already a matter of record and constitute current practice for ships flying many flags and classed by many classification societies, CLIA believes that technical guidance regarding these procedures should be adopted by the referenced amendment to the Survey Guidelines under the HSSC as soon as practicable. MSC 85/10/3 (International Chamber of Shipping (ICS)) - Safe Transport of Containers by Sea, Guidelines on Industry Best Practice This document informs the Committee of the International Chamber of Shipping (ICS) and the World Shipping Council (WSC) publication “Safe Transport of Containers by Sea, Guidelines on Industry Best Practice. It will be recalled that in response to recent incidents involving containerships, most notably the collapse of a stack of containers on board the Annabella, and issues arising from the loss of the MSC Napoli, ICS and WSC undertook to develop comprehensive best practice guidance for the maritime container industry, with a view to minimizing the dangers to containerships, their crews and all personnel involved with the transportation of containers.

12. Safety of Navigation (Agenda Item 11)

Executive synopsis on this agenda item Background: The Committee will consider the report of the fifty-fourth session of the Sub-Committee and took action as indicated in paragraph 2 of document MSC 85/11. LR position: LR will pay special attention to the following items: (Approval of the mandatory Instrument) 1. Amendments to SOLAS Regulation V/19 – Carriage requirements for shipborne

navigational systems and equipment (Navigational Bridge Watch Alarm System (NBWAS)

Background Bridge watch alarm system is a device which triggers alarm if an Officer on Watch (OOW) becomes incapable of performing the OOW’s duties. IMO had adopted the performance standard as MSC. 128 (75) and there are ships which have already installed the equipment on a voluntary basis. Currently, there are two types, i.e., one which requires a watch officer to press a button in an interval (if he fails to do so, it triggers the alarm), or one which detects movements of a watch officer, using motion sensor technology. (So far as long as the sensor finds movement of the watch officer, the alarm will not go off). The Sub-Committee agreed the introduction of such requirements based upon the understanding: - There should be flexibility in introducing requirements; - The introduction should not be a tool for further reducing manning levels; - The requirements will apply to existing ships as well; - The alarm system should be based upon sensor technology (to avoid distracting

the watchkeeper). Implication: (Shipbuilders) - Although the text is not yet formally adopted, builders are encouraged to take

these requirements into consideration when designing a ship with a keel lay date on or after 1 July 2011.

- This is not stand alone equipment on a navigation bridge. The secondary alarm will be activated in a master’s cabin, thus wiring to other part of crew accommodation area will be required. Due attention is to be paid for wire penetration at fire-protection boundaries.

- BNWAS is required to meet IMO’s performance standard (MSC.128 (75). - BNWAS is to be type approved by the flag Administration or its Recognized

Organization (e.g., Classification Society) (Shipowners) - Once the requirements are formally adopted by IMO, BNWAS will be required on

existing ships (at the first survey after the date specified) as well. Owners are to be prepared to make retrofitting arrangements. It is encouraged to take an opportunity of dry-docking, if there is such an opportunity prior to the first survey after the date mentioned in the draft amendments.

(Flag Administrations & its Recognized Organizations) - It will be necessary to type approve the system in a timely manner; - Relevant survey guidelines should be prepared. Application: The draft amendments stipulates as follows: - All new passenger ships (regardless of size) and all other ships of 150 gt or over -

on or after 1 July 2011 (keel lay base); - ships constructed prior to 1 July 2011 will have to fit the BNWAS by the 1st survey

after 1 July 2012 (cargo ships of 3000 gt or over and passenger ships), or 1 July 2013 (cargo ships of 500 gt or over but less than 3000 gt) or 1 July 2014 (cargo ships of between 150 gt or over but less than 500 gt);

- The requirements will apply to ships not engaged on international voyages as well.

- Several delegations expressed their views that the application should be limited to ships of 500 gt or above engaged on international voyages only;

- One delegation proposed to retrofit the system at intermediate or renewal survey so that ship retrofitting work may be done during dry-docking periods which will facilitate hot works that may be necessary; however, that view was not supported by the Sub-Committee;

- A large number of ships will be required to install the system. Therefore, it will be a great challenge for manufacturers as well as the flag Administrations (Recognized Organizations) who will type approve the system;

- At this moment, no corresponding requirements have been developed for High Speed Craft. The NAV Sub-Committee confirmed, in order to develop carriage requirements for High Speed Craft, it is necessary to have a new work programme which must be approved by the Maritime Safety Committee;

- Although there was general agreement that the alarm should be based on sensor technology, it is not indicated in the draft SOLAS text or current performance standards;

- It is not allowed to switch off the alarm while a ship is at sea, which includes at anchorage.

- A flag Administration may accept any alarm system which is inferior to the performance standard if such alarm is already fitted onboard.

- In principle, the STCW Convention requires a lookout in addition to Officer on Watch (OOW). The convention allows OOW to act as a sole lookout only during daylight periods if the circumstance justifies it. The draft SOLAS Regulation requires NBWAS regardless of the presence of a lookout in addition to OOW, or duration of voyage.

2. Amendments to SOLAS Regulation V/19 – Mandatory carriage requirements for

shipborne navigational systems and equipment – Electronic Chart Display and Information System (ECDIS)

Background ECDIS (Electronic Chart Display and Information System) is a shipborne navigational equipment, which is regarded as an equivalent to paper charts as per SOLAS Reg. V/27 and Reg. V/19.2.1.4, in other words, it is an optional equipment. At NAV 53 held in 2007, the Sub-Committee, while it shared merit of using ECDIS in general including contribution to the safety of navigation and fatigue/stress reduction of officers on navigation watch, was unable to reach an agreement, thus the matter was further discussed at this session. The Sub-Committee, at this session, in general agreed to develop mandatory carriage requirements of ECDIS for all ships, including existing ships, of certain size with some time allowance for introduction. However, there were still concerns expressed over the availability of electronic navigation charts & their costs, an exemption clause, an introduction scheme, training issues – revision of STCW convention etc. IHO was requested to provide annual reports on ENC coverage. After a lengthy and exhaustive discussion, which included capacity building for developing States, the Sub-Committee developed draft amendments to SOLAS Regulation V/19. In principle, ECDIS will be mandatory for new ships in 2012

(passenger ships and oil tankers) or 2013/2014 (other ships). Existing ships will be required to retrofit the system. Implication: (Shipbuilders)

- Although the text is not yet formally adopted, builders are encouraged to take these requirements into consideration when designing a ship with a keel lay date on or after 1 July 2012/2013/2014;

- Builders are to note that ECDIS is required to meet IMO’s performance standard (A.817(19), as amended by MSC 64 (67), MSC. 86 (70) and MSC. 232 (82);

- Backup arrangements for the ECDIS will need to be agreed and approved among owners/flag Administrations (Recognized Organizations).

(Owners/Ship management companies) - As ECDIS will be required for existing ships (at the first survey after the date

specified), owners will be required to make retrofitting arrangements. It is encouraged to take an opportunity of dry-docking, if there is such an opportunity prior to the first survey after the date mentioned in the draft amendments;

- Owners are to ensure supply of the Electronic Navigational Chart (ENC) provided by a Hydrographic Authority or its agents for the intended voyages;

- Ship managers are to ensure that appropriate training and familiarization will be incorporated into company’s SMS for the use of ECDIS in accordance with paragraph 6.5 of the ISM Code. Deck officers must be fully familiar with the operation of ECDIS prior to the first voyage after the installation of ECDIS in accordance with paragraph 6.3 of the ISM Code. Due attention is to be paid to the draft SN circular for the Guidance on transitioning from paper chart to ECDIS Navigation given below.

It should be noted that:

- A proposal for arranging the retrofitting deadline for existing ships at dry-docking survey was dismissed at NAV 54, with a view to keeping consistency of retrofitting requirements throughout SOLAS Regulation V/19.

- Transition from paper chart to ECDIS requires careful consideration, especially the familiarization and training of seafarers onboard.

- It should be noted that fitting ECDIS and making the system operational may take hours after installation, in order to make ENC fully updated.

- In retrofitting ECDIS onto the existing ship, due consideration should be made to the available space on the navigational bridge.

- Exemption clause is provided for ships which are scheduled to be taken out of service within two years after the implementation date for existing ships given in the above table. “Two years” will be counted from “the first survey”.

- The IHO observer expressed that there should be enough coverage of ENC as well as its commitment to continued production of paper charts for small ships.

- For High Speed Craft, carriage of ECDIS is mandatory since 1 July 2008 under both the 1994 HSC Code and the 2000 HSC Code. (by MSC. 221 (82) and MSC 222 (82)).

The Sub-Committee prepared draft guidelines to develop performance standards for submission to MSC 85. According to the guidelines, any future performance standard should consist of:

- Sensor/source module - Operational/functional module - Interfacing module - System and equipment documentation module.

From the perspective of the manufacturers promoting this concept the benefit is in a consistent definition and description of equipment and system functionality. This should support inter-operability. Implication: There will be consistency in a structure and contents of performance standards of any shipborne equipment. There will be no immediate impact out of the guidelines. Application: to the performance standards, not directly on ships’ structure/equipment.

2. Corrigenda on SN/Circ. 227 concerning AIS Data entry - Impact of resolution

MEPC.118 (52) upon existing AIS shipboard installations MSC 84 noted that, by adoption of MEPC 118 (52), pollution categories of MARPOL Annex II substances were changed from A, B, C and D to X, Y, Z and OS (Other Substances). The NAV Sub-Committee noted that although old and new categories were substantially different in the actual nature of the substances, handling requirements and so on, however, broadly equivalent in its AIS data entry process, i.e., so far a number of categorizations is the same (four), an operator can choose right ID No. for data entry into AIS. Subsequently, the Sub-Committee revised the Annex 2 of SN/Circ.227 and prepared a draft Corrigendum to SN/Circ.227 for approval by MSC 85.

3. Draft SN Circular for the Guidance on transitioning from paper chart to ECDIS

Navigation To assist with the transition from paper chart to ECDIS navigation, a circular was a draft for approval by MSC 85.

Implications: Shipowners and ship managers should pay due attention in order to ensure timely and smooth transition from paper chart to ECDIS. Application: To ships on which ECDIS is required to be installed (see above).

.10 endorse the outcome of the deliberations with respect to the impact of resolution MEPC.118(52) upon existing AIS shipborne installations and note that the Marine Environment Protection Committee has been informed accordingly (paragraphs 9.4 to 9.6 and 9.17 to 9.20);

1. Explanatory notes the SOLAS chapter II-1 subdivision and damage stability

regulations The SLF Sub-Committee finalized the explanatory notes to the amendments to SOLAS chapter II-1 (Resolution MSC.216(82)). During the deliberation at the Sub-Committee, including those in the Working Group, a proposal to make those items, which were considered to be essential to maintaining the intended safety standards, mandatory (regulation 4, paragraph 1; regulation 5-1, paragraphs 2, 3 and 4; regulation 7, paragraphs 1 and 2; regulation 7-2, paragraphs 2, 4.1.1, 5.2.1, 5.2.2 and 5.3.1; regulation 7-3, paragraph 2; regulation 9, paragraphs 1, 2, 6, 7, 8 and 9; and regulation 15-1, paragraph 1) was not supported. Implication: To support consistency in applying the explanatory notes to ensure that the safety standards are maintained. Different ways of interpreting the regulations can result in different levels of compliance. Provided that the explanatory notes are followed the same standard will be achieved for all ships. It is not thought that significant changes in design will be required as a result of the new interpretations. Application: The amendments to SOLAS are due to come into effect from 1st January 2009, and will apply to cargo ships over 80 metres in length and to all passenger ships. Cargo ships which comply with subdivision and damage stability regulations in other IMO instruments (Annex I to MARPOL 73/78, except OBO ships with type B freeboards; IBC Code; IGC Code; Offshore supply ships (MSC 235 (82)); Special purpose ships MSC 266 (84); Load line regulation 27 except ships intended for the carriage of deck cargo) are excluded. Such ships will be expected to comply with both the regulations and the relevant parts of the explanatory notes. Lloyd’s Register will apply the explanatory notes, once adopted by MSC 85, unless instructed by flag administrations to do otherwise.

2. Draft MSC Circular on Guidelines for Flooding detection systems

SOLAS regulation II-1/22-1 requires that all passenger ships carrying 36 or more passengers constructed on or after 1 July 2010 are fitted with flooding detection systems for watertight spaces below the bulkhead deck. The guidelines for flooding detection systems were finalized after much discussion and a draft MSC Circular developed for submission to MSC 85. A flooding detection system will be required in all watertight spaces below the bulkhead deck that either has a volume in cubic metres that is more than the ship’s moulded displacement per centimetre immersion at the deepest subdivision draught or has a volume of more than 30 cubic metres whichever is greater. Flood detection sensors will be required to be fitted in accordance with the guidelines. Implication: New ships will require flood detection systems to be fitted which will require audible and visual alarms on the navigation bridge and the safety centre if this is located separately from the navigation bridge. Application: The requirements to fit a flooding detection system will apply to all passenger ships carrying 36 or more passengers constructed on or after 1 July 2010.

3. Early implementation of the revised intact stability code

Background The revised intact stability code (2008 IS Code) is due to come into force for ships constructed on or after 1 July 2010. There is an opinion that the benefits of the

new code should be available earlier than the official date and the Working Group was tasked to draft an appropriate MSC Circular. Discussion and conclusion A draft MSC circular was developed and agreed by the Sub-Committee. The draft circular will be submitted to the MSC 85 for approval. Implications Some flags may take up the option of early implementation. Ship builders and owners should ascertain whether Administrations with which they flag their ships will apply the 2008 IS Code earlier.

(Documents submitted) MSC 85/12 (Secretariat) - Report of the fifty-first session of the Sub-Committee The Committee is invited to take action on matters emanating from SLF 51 Action requested of the Committee:

.1 adopt the draft MSC resolution on Explanatory Notes to the SOLAS chapter II-1 subdivision and damage stability regulations (paragraph 3.20 and annex 1)*;

.2 approve the proposed amendments to the footnotes to the revised SOLAS regulations II-1/4.1 and II-1/13.7.6 and request the Secretariat to amend the footnotes in the next consolidated edition of SOLAS (paragraph 3.23);

.8 endorse the Sub-Committee’s course of action regarding the development of the Agreement on the implementation of the 1993 Torremolinos Protocol, noting, in particular, that the Sub-Committee agreed that the Secretariat should initiate a consultation process with States, on the basis of the questionnaire developed by the Sub-Committee, and also agreed to the Roadmap towards entry into force of the 1993 Torremolinos Protocol (paragraphs 5.27 to 5.30 and annex 5);

.9 note the outcome of the Sub-Committee’s consideration on development of options to improve effect on ship design and safety of the 1969 TM Convention, in particular with regard to the incorporation of the tacit acceptance procedure for amendments in the Convention (paragraphs 6.5 to 6.13);.

spaces, agreed to the specifications for the drainage capacity and the scupper grating construction, for referral to FP 53 for coordination purpose, and considered the work on the item completed (paragraphs 12.3 and 12.4);

.12 note that the Sub-Committee, with regard to the Committee’s instruction to identify those non-mandatory instruments for which information on their implementation should be collected, supported, in general, the development of a GISIS module on non-mandatory instruments and recommendations to be kept updated by the Secretariat (paragraph 16.4);

.13 note the Sub-Committee’s opinion that, in respect of safe gap that arises for ships built under the provisions of the 1988 LL Protocol versus ships built to the 1966 LL Convention, it would be for Member States to take appropriate action to address the problem, and decide as appropriate (paragraph 16.6);

.14 note the Sub-Committee’s consideration regarding ambiguities in regulation 24(4) of the 1988 LL Protocol, relating to minimum freeing port area calculations on vessels with open superstructures, in particular IACS’s intention to submit relevant information to the Committee (paragraphs 16.8 and 16.9); and

14. Dangerous goods, solid cargoes and containers (Agenda Item 13)

Executive synopsis on this agenda item Background: The Committee will be invited to consider urgent matters emanating from the thirteenth session of the Sub-Committee. LR position: LR will pay particular attention to the following items: 1. Proposed text of SOLAS & 2000 HSC Code amendments (already approved by MSC

84) As requested by the MSC 84, the DSC Sub-Committee reviewed the text approved by MSC 84, with a view to providing comments to MSC 85. The Sub-Committee noted some typos in the text produced by MSC 84. - SOLAS Regulation II-2/19 With regards to footnotes 20 and 21 under table 19.3, while FP 52 deleted these footnotes, which was endorsed by MSC 84, the Sub-Committee agreed that they should be re-inserted in order to be consistent with the footnote 16 for class 5.2 and to avoid any misinterpretation regarding cargoes, for which underdeck stowage is prohibited in the IMDG code. - Chapter 7 of 2000 HSC Code Existing Note 1 to table 7.17-1 has been revised to clarify an application of requirements for the Class 4 and 5.1 carriage of dangerous goods by identifying requirements for solid cargoes and liquid cargoes. Similar to the above re-insertion on the footnote for SOLAS Regulation 19, footnotes 17 and 18 under table 7.17-3 of the 2000 HSC code were also agreed for re-insertion. Footnotes 9 and 10 under table 7.17-3 were also inserted.

2. The proposed modifications to the IMSBC Code With amendments to the SOLAS Convention, the BC code (Code of Safe Practice for Solid Bulk Cargo) will be mandatory as the new IMSBC Code (International Maritime

Solid Bulk Cargoes Code). At MSC 84 (May 2008) it was decided to implement the new revised mandatory BC Code (IMSBC Code) voluntarily from 1 January 2009, and it is expected that the mandatory application date is to be 1 January 2011. It is anticipated that the Code will be formally adopted at MSC 85 (November/December 2008). The DSC Sub-Committee considered the report of the correspondence group which has been instructed to finalize draft schedules for DRI (A), DRI (B), DRI (C) and coal, and to consider other proposals on amendments to the Code. The Sub-Committee, at this session, addressed the following issues in finalizing the IMSBC Code. (Future amendments procedure for the IMSBC code) The IMSBC code will be revised every two years in order to be aligned with the IMDG Code. The Secretariat of IMO proposed an amendment procedure that is similar to that for the IMDG Code,

(Schedules for the carriage of DRI (Direct Reduced Iron)) DRI generates hydrogen gas and generates heat. It is also very corrosive. In the past, there were reported cases of explosions of bulk carriers, including cases of loss of a ship with lives of the crew. In the course of deliberation, the Sub-Committee recognized the significance of the incident, as well as the fact that ventilation is not possible, without sucking humid air into cargo hold during rough sea conditions, which will further accelerate generation of hydrogen gas and heat from DRI. While majority who expressed opinions were for the introduction of inerting requirements for the carriage of DRI C, a delegation expressed that mechanical ventilation should prevent concentrations of hydrogen gas. Concerns over the inerting methods were also expressed, such as prevention of over-pressure that may damage ships’ structure, gas-freeing procedure and so on. Lengthy discussions took place at the previous session of the Sub-Committee and at this session in the plenary, however, it could not conclude whether to pursue inerting or allow mechanical ventilation. Therefore, the decision was left to be discussed during the Working Group. The Sub-Committee, after reviewing the discussion that took place in the Working Group, finally agreed that:

- DRI A must be carried under surface ventilation (either mechanical or natural); - DRI B and DRI C must be carried under inerted atmosphere.

(Carriage of coal) There was a document stating a need for clarifying “hot area” given in the schedule for coal, which prohibits carriage of coal in a cargo hold adjacent to the hot area. However, the document was withdrawn as the Sub-Committee considered that further careful ramification would be necessary. The Sub-Committee will re-visit this issue at a future session.

With regards to carriages of coal in a ship with self un-loader, the Sub-Committee, recalled the discussion in the past and introduced a new definition of “self unloading” as follows:

A gravity fed self-unloading bulk carrier means a vessel that has gravity fed systems from the bottom of cargo holds, using gates that may be opened or closed to feed the cargo onto conveyor belts, such belts run in fore and aft direction underneath the holds, from there the cargo is carried by means of conveyor systems to the deck and discharged onto shore with a self-unloading boom that can extend over the shore and has a conveyor belt. (Keep the original as this is an extract of the text prepared by IMO) This is not applicable for the vessels with unloading systems such as cranes and grabs.

(Survey and Certification) A member supported by another member expressed concerns over the lack of survey and certification scheme in the current text of the draft IMSBC Code. These members were of the opinion that this issue should be addressed at the earliest opportunity. (Schedules for wood pellets and other wood products) The Sub-Committee, while amending a schedule for the carriage of wood pellets, having considered a report on the fatal accident caused by an oxygen deficient atmosphere on bulk carriers discharging wood pellets and other information provided, agreed to propose a new work programme to discuss this matter further. Schedules for the carriage of pulp wood and timber will be discussed at DSC 14. (Classification of formed solid sulphur) Formed solid sulphur is a bi-product that comes out from refinery process. It was proposed to produce a separate schedule for formed solid sulphur. The Sub-Committee recalled that at DSC 12, in principle, the Sub-Committee agreed to develop a separate schedule for formed solid sulphur. While such inclusion of a new schedule is generally supported, various concerns were expressed with regard to its content. The Sub-Committee recalling that at DSC 12 the Sub-Committee agreed to classify formed solid sulphur as group C in the plenary, the Working Group could not complete the review on this aspect. After exhaustive discussion in the Working Group, the Sub-Committee prepared a new schedule for the carriage of formed solid sulphur. (Implication) LR observes that implementation of the BC Code on 1 January 2009 (even on a voluntary basis) is quite challenging owing to the following reasons:

- The final text of the code (that will be produced after the final adoption of the code in December) will not be available until February 2009 - consequently any verification done prior to the release of the text could subsequently be found not complete or incorrect;

- There are numbers of technical clarifications necessary prior to the implementation (even on a voluntary basis);

- If a port (or terminal) requires a certificate prior to the port entry, ship will need to undergo a survey. In carrying out such a survey, sufficient lee-time will be required for

o Preparing survey instructions on the RO’s (Recognized Organization) side; and

o Preparing and scheduling a survey on the owner’s side - Noting that the current BC code has been implemented under the initiatives

of ports (terminals), as a condition for unloading & loading, LR is concerned that there could be problems if ports (terminals) implement the code from 1 January 2009.

- The current draft of IMSBC code does not presently cover survey and certification. Lloyd's Register is concerned that if each RO/Flag State/port (terminal) uses different formats of certificates.

Application: To ships carrying bulk cargoes, other than grain, i.e. bulk carriers, general cargo ships and multi-purpose ships that carry bulk cargoes regardless of tonnage, engaged on international voyages.

(Documents submitted) MSC 85/13 (Secretariat) - Urgent matters emanating from the thirteenth session of the Sub-Committee The Committee is invited to take action on urgent matters emanating from DSC 13 and, in particular, to:

1. consider the draft amendments to SOLAS chapter II-2 and the 2000 HSC Code, concerning the application of requirements for the carriage of dangerous goods and take action as appropriate (MSC 85/3/11) (paragraph 3.9 and annexes 1 and 2 respectively)∗;

2. consider the justification for inclusion of a new item on “Amendment to MARPOL Annex III” in the Sub-Committee’s work programme (paragraph 3.16 and annex 3);

3. consider the justification for inclusion of a new item on “Amendments to the Recommendations for entering enclosed spaces aboard ships” (resolution A.864(20)) (paragraph 4.13 and annex 4);

4. consider the proposed modifications to the IMSBC Code with a view to adoption along with the draft IMSBC Code (MSC 85/3/10) (paragraph 4.17 and annex 5); and

.2 the risk level is dominated by collision and grounding scenarios with low frequencies, but potentially with a large number of fatalities; and

.3 some identified risk-control options were found to be cost effective according to the cost-effectiveness criteria in MSC 83/INF.2 for a specific example cruise ship design used in the study.

The FSA study indicates that the following area should be further examined with a view to possibly introducing the relevant legislation:

.1 implementation of guidelines for Bridge Resource Management (BRM). In addition, the following risk-control options were shown to be effective in this particular design study and may warrant further investigation:

.4 improve the damage stability (described in resolution MSC.194(80)). MSC 85/17/2 (Denmark) - FSA – RoPax ships This document reports on the FSA study on RoPax ships carried out within the research project SAFEDOR. The FSA study on RoPax ships demonstrated that:

.1 the safety level of RoPax ships lie within the ALARP region;

.2 he risk level is dominated by collision and grounding-related flooding; and

.3 some identified risk control options were found to be cost-effective according to the cost-effectiveness criteria in MSC 83/INF.2.

The following risk control options were found to be cost-effective, in order of importance:

.1 improved damage stability and survivability after flooding, in particular to avoid rapid capsize;

.2 all measures aimed at improving navigational safety not requiring additional manning levels. Risk-based maintenance of navigational systems;

.3 improved fire prevention and protection; and

.4 improved evacuation arrangements. Based on the FSA study reported in document MSC 85/INF.3, the following recommendations may be proposed to be made mandatory IMO requirements for the RoPax fleet:

.1 measures to improve the damage stability for RoPax vessels to levels consistent with current cost-effectiveness criteria and commensurate with the specialized operation of these ships. For the range of ships analysed, it was found that CAF values associated with the introduction of measures to improve survivability in flooded condition would be well below the current cost-effectiveness criterion (US$ 3 million), even for pessimistic assumptions of marginal costs; and

.2 all measures aimed at improving navigation safety, not requiring additional manning levels; they are all well below the US$ 3 million cost-effectiveness criterion.

MSC 85/17/3 (Secretariat) – Outcome of MEPC 58 This document reports on the outcome of MEPC 58 on matters related to formal safety assessment. The following is the agreement at MEPC 58 after reviewing the discussion of the informal group: .1 the group concurred with the approach proposed in section 4 of the annex to

document MEPC 58/17, which would be simplified further if a volume-based approach was followed; and

.2 the group noted, however, that it was important to show both environmental and safety criteria in the cost-benefit analysis (CBA), so that a complete picture could be formed.

3. the definition of the terms “bulk carrier” and “general cargo ship” are interrelated and therefore any outcome of discussion on the definition of “bulk carrier” under the provisions of the SOLAS Convention should be taken into account in the discussion of the definition of “general cargo ship”; and

4. any FSA studies submitted on the matter should first be reviewed by the FSA Group of Experts before establishing a working group on general cargo ship safety.

MSC 85/19/2 (Republic of Korea) - Identification of problem areas for general cargo ships This document, in response to the invitation by MSC 84, provides further information on general cargo ship safety to facilitate the identification of the problem areas for such ships. The purpose of this document is to recommend that a working group be established to consider the outcome of the results of the study carried out by the Republic of Korea and in particular to:

1. carry out an FSA study to identify accident frequency, risk levels, the causes and to recommend the risk control options;

2. collect more information on the general features of general cargo ships in order to find appropriateness in design of its features, especially on the number of cargo holds/compartments, cargo carriage pattern of general cargo ships (especially multi-purpose general cargo ships) including the use of its own cargo gears to load/discharge the heavy and lengthy cargo, if experienced any side hull damage during cargo loading;

3. agree on the high risk level of general cargo ships due to their general features of less compartments, poor maintenance because of their short voyage pattern and cargo carriage, especially of alternate loading of light cargoes and heavy cargoes, and to develop safety measures;

4. agree on the assumption that flooding in the hold is the main cause of foundering to totally lost, and to identify what is the main cause of foundering in hold of general cargo ships and what safety measures to prevent such foundering should be taken; and

5. consider the need of applying an ESP program on general cargo ships.
