Whereas it. appears to the Appropriate Government (herein­after referred to as "the Governmen~") that the-land spe­cified in the Schedule hereto (hereinafter referred to as the "said land") is likely to be needed for~ public purpose viz. Land Acquisition for construction of Vanxem road in V. P. Lout.ulim -Salcete.

Now therefore, the Government hereby notifies, under sub­-sectio~ (1) of section·4 of the Land Acquisition Act. 1894 (central Act 1 of 1894) (hereinafter referred to. as the "said Act") that the said land is likely to be needed for the purpose specified above-.

2. All persons interested in the. said land are hereby warned not to obstruct Oll interfere with any surveyor or other persons _employed upon the said land for the purpose of the said acquisition. Any contract for the disposal of the said ,land by sale, lease, mortgage, assignment, eXChange or otherwtse.-or any outlay commenced or improvements made thereon without the sanction of the Collector appointed under

. paragraph 4 below, after the date of the publication of this Notification, will, under clause (seventh) of section 24 of the said -Act, be disregarded by him while assessing com­pensation for such parts of the said land as may be finally acquired.

3. If the Government is satisfied that the. said land is needed for the aforesaid purpose, a. declaration to that effect under section 6 of the said Act will be published in the Official Gazette and in two daily newspapers and public-notice thereof shall be given in due course. If the acquisition is abandoned wholly or in part, the fact will also be notified in the same manner.

4. The Government further appoints, under clause (c) of section 3 of the said Act; the Land Acquisition Officer"P.W.D. (Cell) Altinho, Panaji to perform the functions of a Collector under the said Act in respect of ·the said land.

5. The Governm.ent also- authorise, under SUb-section (2) of section 4 of the said Actr the following officers to do the acts, specified therein in respect of the srud land.

Land -Acquisition for construction of drainage for effuent disposal of Margao, Industrial Estate at St. Jose de Areal.

Now, Therefore, the. Governement herehy notifies, under sub-section (1) of section 4 of the Land Acquisition Act, 1894_ (Central Act 1 of 1894) (h~reinafter ref~rred to as the

And whereas, the, Government being' of the opinion that the acquisition' of .the . said -land is - urgently neceSsary,-- hereby applies the provisions of sub-section (1) and flUh·section (4),'of section 17 of· the said Act and directs that the Collector appointed. under paragraph 2 below, shall, at any tilT.le, on the eKpiration of fifteen days from the date of the p:ubItcation of the notice relating to the said land .Wlder sub-section (l) of section 9 of· the said Act, take possession of the said land. .

AWARD

The above Industrial Dispute _between. the above parties is regarding the alleged dislllissal of the above workinan by the. emp19yer Company. It haS been referred to me for arbitration under Sec. 10 A, I. D. A~t, 1947 in pursuance of an agreement between the .parties, by the Administrator of Goa, - Daman, Diu, -Panjim. _The Govt. Notification ·of 11 June.' .1986 with the. said agreement .q.as beeri pUQIished in the Goa Govt. Gazette of 19th June 1986, Series II, No. J.2; at page 17.6; .'

2. I, therefore, issued Notices. to the representing Union and the Company to file 'th-eir Statement of Claj,m and Written_ Statement, respectively, on the .. dates mentioned in

the Notices. After taking adjournment, the workman filed his statement of claim dated 17-7-86 with a list of documents he desired to rely upon. The Company filed its written statement dated 21st November 1986 with several docu­ments and their list.

3. The workman alleged as follows. He joined the Com­pany sa Driver ClQ.Ss I, on 1st. November 1981 but the appointment letter was issued to him on 10-3-83. He tooK charge of the barge, 'Pragati', on or about 27'4-~5 along with log "Sheets Nos. 76/14 and 81/19. On checking the log sheets, he found the book balance of 3310 litres' of H. S. D. instead of 4260 litres and this error was brought to the notice of the Manager, Fleet Operation. On 1(}"4-85. Capt. P. R. J. Singh, Shri K. Shinde and V. Verlekar checked the diesel oll of the barge at berth· No. 9 in his and crew's presence and found difference iIi the oil in the two tanks as per the book balanc,e. '

4. The workman, inter alia, further alleged as follows. As _ a r~lt of the alleged difference, he was served with a show cause Notice of 10-4-85 by Capt. Singh requesting him to show cause withi+t 24· hours as to why disciplinary

. action should not be t8ken against him for the alleged concealment of misappropriation of 1000 -litres of diesel oil and for falsifying, 'the official record. ~The Notice -was received by him some time between 11th and 15th April 1985 and he denied the allegations against _ him by his reply of 16th Ap-rll 85. Yet he was served with a Cl?-arge­sheet alleging that on 10,..4-85, the physical sounding showed a total of 1,250 litres _of diesel oil- and not 1,160 litres of oil -as MOwn' in the log sheet. The ,Charge-sheet further stated that he had -shown, a consumption of 300 litres of oil, instead of 40 liti'es of oil for a trip to CortaJim and he had .thus committed misconduct of_ theft, fraud and grave dishonesty in connection with the employer's -business and property. The misconduct alleged against him was, that he had committed acts subversive to good order and· discipline, that his reply of 16-4-85 was not satisfactory and that he had been 'suspended with immediate effect. In the Charge­-sheet he was asked to attend the domestic. inquiry on 24-4-85 at 11,.00 a. m. before the Enquiry _Officer, Shri ·l'fagarsenk.ar.

5. The_ workman further alleged as- follows. He gave his­written statement by his l~ter of 9th May 1985 and requested the Managing Director to withdraw the suspension -order­and the- Charge-sheet. But he was there'after served with a Notice and Reports of the Findings of the Enqufry Officer of 2-9-85 and he was directed to show cause why his 'service s?ould not be terminated.

6. The workman further alleged 'as follows. There was no material to juStify the conclusion, that he was guilty of the alleged misconduct. The findings of the Enquiry Officer are perverse and liable to be set aside as they have been based on irrelevant and extravenous matter. None of the members of the crew have deposed against him and the Enquiry Officer has· not considered the' evidence of Messers. Texeiro, Gaude, _ Barua, Dapholkar and Honavarkar. Thus the findings are perverse and the Management has wrongly. concurred with them. The order of termination of his service, is, there­fore, illegal, null_ and void and is liable to be set aside.

7. The workman made the followf,ng allegations also. He is a prominent and active executive member of the - action Committee of the United Bargemens' Association. Due to these trade Union activities the Management offered him Rs 15,000/- by way of mutual settlement in addition to his legal dues for resigning from the irervice. He refused to comply with its suggestion and hence, the Company has termi­nated his services and this action of the Company is nothing but his victimization and an unfair labour practice. The ch8.rge lu!s not been proved against ,him and the termination. of his service may be declared to' be illegal, null and void and he may be reinstated with full back wag-$ and other fit and proper reliefs.

8. By its written statement, the: Company, inter alia, raised 'the following contentions. The dispute raised is an individual , and not an -industrial dispute as the workman did not first raise the dispute regarding his termination of service by any letter of demand served on the Management. The dispute has, also not been espoused- by the employees of the Company. The

, arbitration is" therefore, not proper and the Arbitrator has no power ~d jurisdiction to proceed in the matter.

9. The Company further raised the "following --contention~: .,' As a Driver the workman was responsible for pro'perly, operat- ~ ipg the main engines and for maintaining account of, H. S. D., .:l:ud lubricating oil. But he was not sincere in the perfonnance,

of his duties. The oil pilfered from the t~ of .-the barge was transferred to a fishing vessel with the help_of ~ hosepipe. ,'fh~ crew members could· not make any complaint as they were tempted with a share in the· wrongful gain. The Company, therefore, asked -Capt. Singh to have 'a. -surpriSe check of the actual stock in the tanks' of the barge and the entries in -the' log-sheet. He, therefore, made a surprise check on 10-4-85 a.xid found that the records had been tampered Wi~h. He also found that the Driver showed a consumption of 300 lUres of- diesel oil- for a voyage from berth No. 9 to Cortaliro though it actually consumes only 40 litres of d. oil. On his report of th:i!s, the CO.nli>any issued the charge-sheet dated· 18-4·85 to' the effect, that the Driver had committed theft, fraud and dis­honesty in connection with the Company's business and pro­perty. The Driver submitted his explanation of 16-4-85 but It was found to be unsatisfactory.

10. The Company also raised the f~Ilowing contentlon.s. The Enquiry Officer has made a legal and valid inquiry intO' the Charges and has giv~n his report on the soundings on 21-8-85'. He has given his flndings and report of 31-8-85 stating that· the· charges were proved beyond doubt. The Driver's explana­tion against the proposed punishment' of his . dismissal from service was found unsatisfactory and hence he was dismissed from service of the Company With effect from 23-9-85 by its letter of that date. Th~ Enquiry Officer has observed. the principles of natural justice in the conduct of the inquiry and has given to him full and fair opportunity to' defend himself and to rebut the charges levelled against him. The findings of the E. O. are based on the evidence and documents ell record and the Driver's allegation, that they are illegal and perverse, has not- been substantiated. The action ·of the Company in dismissihg the workman on the basis of the findings of. the E. -.0. regarding the Charges is just, proper and proportionate. T,he Company will be able to· prove the charges independently even by additional evidence ,before, the Arbitrator. The allegation of victimization is J:laseless.

11. The Company further raised the following contentions. The wO'rkman was never offered Rs. 15,000/- for' ~tt1ement of the dispute by tendering his resignation from Company's service. The Driver was not dismissed for his refusal to comply -with the Company's suggestion as. 3.1leged. He has been dismissed from service for his misconduct of theft which has been proved beyond doubt. The act of ·misconduct of the workman is such that the Company can no longer repose -any -confidence in him as he had been resorting to illegal activities.. The -workman is now engaged -in gainful employment and is working for the U.- B. Association at -Vasco-Da-Gama from which he is receiving regular pay­ments. The reference fO.r the several reliefs prayed for, therefore, deserves to be rejected. In-to-to.

12. At the hearing of the reference at Panjim on 25-11-86, the workman's Advocates, the Union Representatives,

, Shrt Mohan Rao and Shri, Joseph, the workman, (Shrl' G. Anthony), and the Company's Advocate, Shri Navelkar were present. .Shri Navelkar, Advocate, contended on behalf of the Company, _that the dispute is not an industrial dispute as i~ was never a subject-matter of a Demand of the workman made by hirfl and 'served on the Company. The Union, how­-ever, requested for time to file its RejOinder to the W. S. of the Company. The request was granted ana the Union has filed.the Rejoinder of 4-12-86. The Company has filed its sub­-rejoinder in, that- respect which is dated 23rd, De,c. 86. The parties raised their contentions r~garding 'my jurisdiction to proceed in this matter._ The CQmpany contended that though it was a party to the agreement to ,refer the dispute to me for arbitration, the dispute cannot be said to be an industrial dispute for the reasons detailed in its W. S. The parties were heard on the preliminary issue as to whether the ,dispute-is an industrial dispute in the sitting at P. D'Mel1o Bhavan, Bombay-38, on 26-12-86. Having regard to the contentions and arguments of both the parties, I came to the conclusion, and found, that the dispute is an Industrial Dispute arid adjourned the case for. further hearing to 10th Jan, 87, at Co.'s office, Bombay.

13. There was a hearing of the arbitration a.t Company's Office at Ninnal, Bombay-21, on 10th Jan., '87 but it was adjourned several times _ thereafter at the request of the parties. The reference was fixed for hearing at the Union's Hall, . Carnac Bunder, .Bolllbay-38, on 30-4-'87 after service of Notices on the parties. 14. Before I took up the dispute for recording evidence, the parties and their Advocates expres,sed their. sincere -and keen deSJire lo _ try to settle the matter by mutual negotiation and thus to come to a mutual' agreement which would be fair, just and acceptable to both the parties. I was happy to know that and g~ve them some time to do that. After mutual talks and' negotiations between the parties assisted by their Advo­cates, they arrived at a settlement and reduced it to a written two-page agreement. They. produced it before me. The

.settlement, inter alia, provided for payment of Rs. 50,000/­by way of monetary benefit to be given to the worl{man ·by the Company in full and fanal settlement Qf al,l his claims and reliefs including that of reinstatement with full back wages· and continuity of service. It is thus. clear that the workman has accepted the Domestic Inquiry to be fair, ju~t and legal and accepted the dismissal to be termination of s~rvice which is proper. It is fiUr and just as· the Com·pany has agreed to pay to the workman Rs .. 50.000/~ only, (Rs. Fifty Thousand), in addition to other legal dues, which may be payable, but inclusive of Retrenchment compensation. and Gratuity. The said .settlement was read over an explained to the partieS by me. They admitted that they have volun~ tartly arrived at the said settlement and the tenns agreed upon have been truly arid correctly recorded. I, therefore, directed the parties to put their signatures· on it, which they did in my presence. Their Advocates also l;iave .signed for them. I find that the settlement· is fair, legal and proper and so I record the same as a full and final settlement of the dispute and make the following Award in tenns of the Settlement accepted by the parties before me as fair and just.
