INTRODUCTION On the 51 rolls of this microfilm publication, M1969, are reproduced criminal case files of the U.S. District Court for the District and Territory of Alaska, Second Division (Nome), 1900–1955. These records are part of the Records of the District Courts of the United States, Record Group (RG) 21, and are housed at the National Archives and Records Administration–Pacific Alaska Region (Anchorage).

BACKGROUND The Judiciary Act of September 24, 1789 (1 Stat. 73), provided for a system of dis-trict and circuit courts in addition to the Supreme Court of the United States. The act divided the country into 13 districts, each with a district court and district judge. These districts were grouped into circuits. A circuit court, made up of the district judge and two Justices of the Supreme Court, was to convene twice a year in each district. By an act of 1802 (2 Stat. 156), the district judge and one Supreme Court Justice were assigned to each circuit court. The Judiciary Act of 1789 outlined the jurisdiction of both the district and circuit courts. They shared original jurisdiction in certain types of cases, but the district court had exclusive jurisdiction over admiralty and maritime issues, seizures of land, suits for penalties and forfeitures incurred under the laws of the United States, and suits against consuls and vice consuls. The jurisdictions of the district and circuit courts varied over the years. Generally, however, district courts were courts of original jurisdiction with authority to hear criminal, admiralty, bankruptcy cases, and civil cases except as reserved to the circuit courts. The latter heard appeals from district courts and had original jurisdiction in law and equity involving suits in excess of $500 in which the United States, an alien, or citizens of different states were parties. The organization of the district courts has remained substantially unchanged since 1789. As a rule, each judicial district had a single district judge until the increase in population and the resulting increase in workload made it necessary to appoint two or more judges for each district. From time to time the number of judicial districts and district judges increased. The Judicial Code of 1911 (36 Stat. 1105) grouped 78 districts into 9 judicial circuits. The Judiciary Act of 1789 conferred a very limited criminal jurisdiction upon the district courts of the United States. The district courts were to have jurisdiction only over crimes and offenses where the punishment did not exceed a whipping of 30 stripes, a fine of $100, or six months’ imprisonment. On August 23, 1842, Congress extended the criminal jurisdiction of the district courts to all crimes and offenses against the United States not punishable by death (5 Stat. 517). Later acts further extended the criminal jurisdiction of the district courts. ALASKA COURT HISTORY From the purchase of Alaska in 1867 to its organization by Congress as a civil district in 1884, there were no courts in the vast territory acquired from Russia. In 1868

Congress extended to the new land the laws of the United States relating to commerce, navigation, and customs and specifically stated that violations would be prosecuted in the Federal courts of California, Oregon, or Washington. It also gave those courts original jurisdiction in Alaskan cases. The U.S. Army exercised practical jurisdiction until 1877 when the War Department withdrew its garrisons. From 1879 until the creation of the first civil government in 1884, authority rested with the U.S. Navy. Between 1877 and 1879, the limited governmental authority that existed lay with the collector of customs and, for a brief time, with HMS Osprey. In 1884, as part of the civil organization established by the Organic Act (23 Stat. 24), Congress created one judicial district for all of Alaska and directed that a term of the court be held each year in Sitka and in Wrangell. In addition, the Organic Act authorized the court to maintain offices in Juneau City and “Oonalashka.” U.S. Commissioners authorized for each of these four towns had civil and criminal powers similar to those conferred on justices of the peace in Oregon. The U.S. District Court for the District of Alaska first met on November 4, 1884, at Sitka. (See Appendix I.)

Sparked by the gold rushes, Alaska’s population underwent explosive growth after 1900. By an act of Congress on June 6, 1900 (31 Stat. 321-322), Alaska was divided into three judicial divisions with headquarters at Juneau, Saint Michael (at the mouth of the Yukon River), and Eagle City (closest American town to the initial gold strikes). The First Division, comprising southeast Alaska, encompassed the region east of 141' West Longitude. The Second Division included all of northwest Alaska from where the Colville River emptied into the Arctic Ocean, roughly halfway between the Canadian boundary and Point Barrow, then south and west to Kuskokwim Bay, en-compassing almost all the Bering Sea and Arctic Ocean coasts. The Third Division encompassed all of the areas not included within the First or Second Divisions. Gen-erally, this meant a long corridor between the Canadian boundary at 141' W on the east, to the border with the Second Division on the west and from the Pacific to the Arctic Ocean. It also included the 2000-mile stretch of the Alaska Peninsula and Aleutian Islands.

This three-part structure remained in existence until 1909 when a fourth judicial divi-sion was created by slicing off the top two-thirds of the Third Division. The reduced Third Division’s headquarters were relocated to Valdez. The new Fourth Division’s boundaries consisted of all areas lying east of the Second Division, north of the Third, and west of 141' W. The court seat was at Fairbanks. On July 7, 1958, Congress passed the Alaska Statehood Act (72 Stat. 348) and constituted a U.S. District Court for the new state. During the transition period, the territorial court was authorized to operate for up to a three-year period unless the President proclaimed that the U.S. District Court was prepared to assume its functions. The four-part structure was dis-solved and a single judicial district for the State of Alaska was authorized pending the admission of Alaska as a state. The structure of the territorial court continued to meet and keep offices at Anchorage, Fairbanks, Juneau, and Nome. On February 20, 1960, President Dwight D. Eisenhower declared the U.S. District Court for the District of Alaska in operation (E.O. 10867, 3 CFR).

At the time the Second Division was constituted at St. Michael, the old Russian out-post had become the key point of transit between the ocean and the Yukon River route to the Klondike. In 1898 prospectors discovered rich deposits of gold in the rivers and on the beaches of the southwestern edge of the Seward Peninsula in the vicinity of Cape Nome. Anvil City, a boom town of 10,000 people, sprang up literally overnight. In 1899 Anvil City merchants changed the town’s name to Nome after the nearby cape. By 1900, Nome had eclipsed St. Michael as the seat of governmental authority, and the U.S. District Court relocated there. The earliest cases extant for this division originated in St. Michael and were continued in Nome. During the 56-year period covered by these records, 10 judges presided: Arthur H. RECORDS DESCRIPTION In 1934 fire destroyed downtown Nome, including most government offices. The records reproduced in this and related microfilm publications are the court case files that survived the fire. These case files were badly damaged by scorching and desic-cation. Uneven darkening of the paper has, in some cases, left the documents barely legible, and desiccation and the subsequent flaking and cracking of brittle paper has resulted in the loss of portions of some documents. The materials reproduced in this microfilm publication were given extensive conservation treatment and placed in stabilizing polyester film sleeves. The original records remain closed to research. This publication reproduces 1,562 criminal cases heard by the U.S. District Court in Nome between 1900 and 1955. The case files are arranged by case number assigned in order of docketing by the court. Files for case numbers 77, 747 through 749, 1104, 1153, 1405, and 1407 are missing. Within each file, documents are arranged chronolog-ically by date of initial filing. To minimize handling of the fragile records, documents within a case have been restored to approximate, not precise, chronological order. Three case files numbers, 26, 92, and 133, were assigned more than once—first by the U.S. Commissioner’s Court, and later, when the cases were transferred, by the U.S. District Court at Nome. To distinguish one case from another, the district court assign-ed extensions (e.g., 26, 26A) to these case numbers. Typically, district court criminal case files include complaints, warrants, subpoenas, summons, affidavits, indictments, charges to jury, transcripts of testimony, motions, orders (dismissal, discharge, commitment, and special venire for trial jurors), instruct-tions to the jury, motions, pleas, verdicts, judgments and sentences of the court, and other documents relevant to the case and court proceedings. In addition, there are habeas corpus case files that contain petitions for writs, affidavits, writs of habeas corpus, respondents’ returns, recognizances, final orders of discharge

into respondents’ custody, and related papers filed in proceedings. These files relate mainly to persons imprisoned by the U.S. Marshal on orders of the U.S. District Court at Nome and persons held as trial witnesses, and other criminal cases such as those involv-ing child custody, false imprisonment, and imprisonment for non-payment of fines. Researchers can find a wealth of material on the Nome Gold Rush of 1900 including names of people, businesses, and mines; depositions describing regional conditions; and similar historical evidence. The case files for the period 1900–55 concern topics such as sale of liquor to Alaska Natives; murder, manslaughter, assault and battery, kidnapping, and carrying of concealed weapons; robbery, burglary, larceny, and criminal trespassing; frequenting an opium den; adultery and sexual assault; insanity; blackmail; perjury; contempt of court; violations of the fishing, gaming, and business license laws; and Prohibition. Until the establishment of the State of Alaska’s court system in 1960, the U.S. District Court and the lower U.S. Commissioner’s Court were the only jurisdictions in the territory. They had authority commonly assumed elsewhere in the United States by city and county governments and school districts. A U.S. commissioner, often the only judicial officer in the vast area covered by a judicial division, typically undertook other roles such as recorder of deeds, probate judge, coroner, notary, and justice of the peace, in addition to his regular duties. Appendix II is an alphabetical index, compiled by the National Archives, by name of defendant. Names are listed as they were recorded in the court documents and no attempt was made to reconcile all variants. Researchers should therefore be aware that the following issues can affect alphabetization:

• multiple spellings of names, e.g., “Christiansen” and “Christianson” • abbreviated or spelled-out given names, e.g., “Chas.” and “Charles” • initials or full names, e.g., “Nichols, J.A.” and “Nichols, Jennifer A.”

The index notes defendant’s name, case number, date the case was filed, approximate number of documents, and microfilm roll number.

U.S. DISTRICT COURT FOR THE DISTRICT OF ALASKA In 1960, two years after the passage of the Alaska Statehood Act, an executive order terminated the jurisdiction of the U.S. District Court of the Territory of Alaska and its judicial divisions and established U.S. District Court for the District of Alaska, which reverted back to a single judicial unit.
