RULING OF THE CHAIR
Mr. Ahsan Iqbal Chaudhary, MNA rising on a point of order objected that an Adviser cannot move a Bill
under the Rules, whereupon, Honourable Speaker ruled that an Adviser is appointed under clause (1) of
Article 93 of the Constitution of the Islamic Republic of Pakistan. Under clause (2) of the said Article,
the provision of Article 57 shall also apply on Adviser by virtue of Article 57 an Adviser shall have the
right to speak an otherwise take part in the proceedings of the either House, or a Joint Sitting or any
Committee thereof but shall not by virtue of Article 57 be entitled to vote. Mr. Speaker also quoted an
example that, in 2010 the Constitution (Eighteenth Amendment) Bill, 2010 was moved by Mian Raza
Rabbani as an Adviser, therefore, an Adviser can move/pilot a Bill.

OBSERVATION MADE BY THE HONOURABLE SPEAKER
On an objection raised by Mr. Bilawal Bhutto Zardari, MNA regarding voting procedure in the Joint
Sitting, Honourable Speaker observed that clause (4) of Article 72 of the Constitution of the
Islamic Republic of Pakistan provides that subject to the Constitution, all decisions at a joint
sitting shall be taken by the votes of the majority of the members present and voting. (Clause
(3) of Article 70 of the Constitution also provides that if a Bill passed by the votes of the
majority of the members present and voting in the Joint Sitting it shall be presented to the
President for assent).

right of review and re-consideration in giving effect to the
