The following letter should be sent to the bank to which you make your regular monthly mortgagepayments.

Demand for your Mortgage Note and Service Agreement [SAMPLELETTER]

To whom it may concern: I own the property at the address listed above, and your bank services mymortgage.

Over the last several weeks there have been many stories documenting the problem that banks areforeclosing on homes without proof that they own the loan. I have learned that in many cases, bankslike yours do not even know who owns the loans you service. Employees at several leading bankshave admitted to rubber stamping tens of thousands of foreclosures every month, without evenchecking to make sure that the bank had a legal right to proceed with foreclosure. In some cases, banks allegedly falsified mortgage documents to cover up their mistakes. There have been reports oftwo banks trying to foreclose on the same home, banks foreclosing on homeowners who were currenton their payments, and even of a bank foreclosing on a home where the homeowner had never takenout a mortgage to begin with. This is not merely a technical problem!it is the difference between

having a warm bed at night and being out on the street."s a homeowner and a customer of your bank, I am horrified. I had always believed that it I played bythe rules, I would be protected, but now I know that banks like yours think the rules don#t apply tothem.

To protect myself and my family, I need to know who owns my mortgage. $ithin thirty days, I wouldlike to know the name, address, and phone number of the bank or investor that owns my mortgage.%urthermore, in light of the recent allegations of foreclosure fraud, I demand to see the originalmortgage note proving ownership over my home loan. I would like to see copies of all endorsementsand assignments of my mortgage note and where and when the assingment&s' (if any ! wererecorded. I also ask that you provide me with evidence of your firm being contractually retained toservice my loan.

If you fail to provide the information I am legally entitled to, I will be forced to consider all optionsavailable to me to ensure that my family and my home are protected.

I ask that I receive my response in writing.

Thank you for your attention to this matter.

Throughout this entire proceeding, not once did the plaintiff attorney representing theFederal Credit Union address the most important question: who is the holder of the note? This question is important because under the Truth in Lending Act pursuant to ! U"C## $%&$$'( )full disclosure*, + hae a right to -now who the true party of interest inthis transaction is. Therefore, it needs to be stipulated whether the plaintiff attorney or

The plaintiff attorney did not proide any proof to sufficiently satisfy her claim underU.C.C. & A1T+CL/ 2 &2%3 that she or the Federal Credit Union is the note holder indue course.

The plaintiff attorney did not stipulate whether or not she or the Federal Credit Union isthe holder in due course.

The plaintiff attorney did not stipulate whether this loan was securiti>ed as required bylaw. Therefore, the plaintiff attorney admit to the following: * 7ou admit that you are asericer of the promissory note. 3* 7ou admit that the loan has been securiti>ed. 2* 7ou

Eecause plaintiff attorney is unable to proide this proof0 then she admits to not being aparty of interest and cannot rightfully request the presiding (udge to enforce claim underU.C.C . & A1T+CL/ 2 # 2&2%.

+n addition, under Title 3 # 33$.2 )regulation G* part )a*, a sericer does not hae therights of a holder in due course and therefore, do not hae the right to foreclose. Therefore, any attempt ia the "heriffs to foreclose on my property will be construed as

+t is the creditors responsibility to -eep a borrower and the Court informed as to whoowns the note and mortgage and is sericing the loan, not the borrowers or the Courtsresponsibility to ferret out the truthH

Therefore, presiding (udge should dismiss this case with pre(udice since, plaintiffattorney did not proide eidence proing the holder in due course for my promissorynote.

Under the Federal 1ules of Ciil 5rocedure 1ule 2$, the plaintiff attorney has 2% daysshould she wish to contest any of the aboe allegations with specific proof.
