A KID Report: Executive Summary

Since 2002, KID has released an annual report detailing the U.S. Consumer Product Safety Commission (CPSC)’s children’s product recalls throughout the previous year. This year’s report examines children’s product recalls in 2018. Main findings of this report include:

The number of children’s product recalls in 2018 (52 recalls) decreased 44% from 2017 (93 recalls), the lowest in at least 10 years.

There were 2,312,750 total units of children’s products recalled in 2018, compared to 11,854,605 units recalled in 2017.

Nursery products accounted for the highest number of children's product recalls in 2018. Thirteen out of the 52 total children's products recalled (25%) were nursery products. The high number of nursery product recalls is alarming because caregivers specifically purchase nursery products to keep children safe while sleeping, playing and eating.

Both the CPSC and manufacturers posted recalls on Facebook at lower rates in 2018 compared to 2017. CPSC posted only 45% of 2018 children's products recalls on its Facebook page. This was a sharp decrease from 75% in 2017, the first year CPSC used Facebook. Of the 48 companies who issued recalls in 2018, only 31% were announced on the company’s Facebook page, down from 51% in 2017.

CPSC is recalling fewer products for design flaws. This year, recalls due to rule violations increased (43% in 2017 to 62% in 2018) and recalls from design flaws decreased (57% in 2017 to 38% in 2018). Design hazards that do not violate a mandatory rule take more time and effort to recall but are equally important to remove from market. Ninety percent of the 1,275 total incidents reported in 2018 and 100% of the total injuries reported (21) were from recalls due to design flaws.

Lead recalls are back on the rise. In 2017, there was one recall for a lead hazard. In 2018, despite fewer recalls, there were five recalls for lead hazards -- nearly 10% of children's product recalls.

The CPSC has stated that one child dies every 10 days from a furniture or TV tip-over, yet there were no furniture recalls in 2018. In 2017, Conner DeLong died when an IKEA Hemnes dresser tipped over. Despite his death and a viral video showing the same dresser tipping on twin toddlers, the dresser has not been recalled.

KID will continue to fight for stronger federal standards and product safety following changes implemented from the CPSIA and Danny’s Law. We demand that the CPSC and manufacturers do more to make recalls effective and urge consumers to check their products against recall lists.

Introduction KID’s annual recall report examines data and trends in children’s products that have been recalled by the U.S. Consumer Product Safety Commission (CPSC). This year’s report examines children’s product recalls during the 2018 calendar year.

Congress created the CSPC in 1972 through the Consumer Product Safety Act (CPSA). This legislation directed the CPSC to protect the public “against unreasonable risks of injuries associated with consumer products.” CPSC has jurisdiction over more than 15,000 types of consumer products and is charged with protecting consumers from products that pose choking, fire, electrical, chemical, or mechanical hazards or others than can injure children. In 2008, Congress passed the Consumer Product Safety Improvement Act (CPSIA). This law, which includes a section named for Danny Keysar, whose parents founded KID, requires standards for juvenile products, bans lead and other harmful substances, and mandates independent testing for most children’s products.

KID is a nonprofit organization dedicated to protecting children by fighting for product safety. KID was founded in 1998 by Linda Ginzel and Boaz Keysar after the death of their 16-month-old son, Danny, in a dangerous recalled portable crib.

Methodology A children’s product is defined as any product designed or intended for the care of or use by children. Products that pose potential dangers to children but that are not intended for their use, such as cigarette lighters with faulty child-resistant locks and window blinds are not included in this definition. We have expanded this definition to include some dresser recalls in the past, given that the product is often purchased for and located in a child’s room. Children’s products were further categorized for this report by the type of product (clothing, furniture, nursery, outdoor & sports, jewelry, kitchenware, and toys). The product name, manufacturer, date of recall, number of units recalled, type of hazard posed, and number of incidents and injuries were also recorded for children’s products recalled in 2018. See Appendix A. KID obtained all recall information for this report from press releases issued jointly by product manufacturers and the CPSC that are publicly available at www.CPSC.gov/Recalls. Press releases outline the incidents, fatalities, and injuries caused by the product prior to the date of recall. All numbers, facts, and figures contained in this report originated in these press releases. Only children’s products under the jurisdiction of the CPSC were considered. This excludes car seats and booster seats regulated by the National Highway Traffic Safety Administration (NHTSA). The CPSC does, however, have oversight of car seats that also function as infant carriers.


Children’s Product Recalls In 2018, there were 258 recalls issued by the CPSC, of which 52 (20%) were children’s products. Compared to 2017, this is a 7% decrease in overall CPSC recalls, but a 44% decrease in children’s product recalls. In 2017, CPSC recalled 93 children’s products.

By every measure: total recalls, children’s product recalls, and units of children’s product recalls, 2018 numbers were down compared to the previous ten years for which data was collected. Although the data shown in Figures 1 and 2 may imply there was a significant improvement in the number of dangerous children’s products in 2018 when compared to previous years, it is important to note that the total number of CPSC recalls in 2018 (258 recalls), is fairly similar to the number of total recalls in 2017 (280 recalls), despite the lower number of recalls in December 2018 due to the U.S. government shutdown. Furthermore, a greater percentage of children's product recalls were fast-tracked in 2018 (52%), compared to 2017 (41%). Recalls due to a rule violation increased from 43% in 2017 to 62% in 2018, and the recalls from design flaws decreased from 57% in 2017 to 38% in 2018. KID has noticed recent non-recalls, weak settlements, and vague statements by the CPSC. In February 2018, the CPSC filed a lawsuit against Britax Child Safety, Inc. involving B.O.B. jogging strollers. The quick release on the front wheel can fail to secure the wheel to the fork, resulting in sudden detachment and injuries. At the time the lawsuit was filed, at least 200 consumers had a front wheel unexpectedly detach resulting in at least 50 injuries to children and 47 to adults. In November 2018, the CPSC settled the lawsuit with Britax and the terms of the settlement state that the remedy is an ‘information campaign’ that cannot be called a recall, despite offering replacement parts to some consumers. The BOB Information Campaign was released in January 2019 and does not provide a clear remedy. Consumers can only receive a remedy until January 10, 2020 which is an added limitation. If this were instead deemed a recall, there would not be a one-year time limit, and a recall would have made it illegal to sell the product on the secondary market. More consumers would have heard about it and understood it more if it were a recall. In May 2018, the CPSC issued a warning that caregivers should stop using inclined sleepers once their baby can roll over. If these products are used after a baby rolls over, there is an increased likelihood of entrapment for the child. However, there is not a definitive age that a baby will roll over for the first time, and sleep products are intended for children to use without direct parental supervision. If a baby rolls over for the first time in their inclined sleeper, there is a high chance of entrapment, and a small chance for a caregiver to see the child and resolve the situation. The remedy that the CPSC suggests – use restraints to attempt to keep the baby in position – is not supported by the American Academy of Pediatrics. The warning also stated that the CPSC is aware of infant deaths associated with


inclined sleep products. The CPSC does not provide information on whether there was a product recall, nor does it name any of the products associated with the infant deaths. There was only one children’s product with over 500,000 units recalled: Dr. Brown’s Lovely Pacifier and Teether Holder in which there were 590,000 units recalled for choking hazard after 67 incidents were reported. This is a sharp decrease from 2017, in which there were eight children’s products recalled that each had more than 500,000 units recalled. In 2017, an average of 127,469 units were recalled in each children’s product recall, and in 2018, the average decreased by 65% to 44,476 units.

Recall Categories In 2018, nursery products accounted for 25% of all children’s product recalls (13 recalls). These products were primarily recalled for fall hazards. Of the 13 nursery product recalls, three were high chairs and two were infant carriers. The high level of nursery product recalls is alarming because caregivers specifically purchase nursery products to keep children safe while sleeping, playing, and eating.

The number of jewelry recalls increased from one recall in 2017 to four recalls in 2018, two of which were for lead violations. Although the number of

clothing recalls decreased from 27 recalls in 2017 to 11 recalls in 2018, the total number of clothing units recalled increased from 254,605 in 2017 to 461,400 in 2018. This was primarily due to two large recalls: Infant Bodysuits by Gildan Activewear which was a 194,500-unit recall, and the 3-Piece Penguin Cardigan Set by Carter’s which was a 107,200-unit recall. The number of outdoor & sports products recalled decreased from 18 recalls in 2017 to 10 in 2018. In 2017, seven models of self-balancing scooters or hoverboards were recalled due to fire and explosion hazards. There were no hoverboard recalls in 2018.

Multiple Products Recalled by One Company 2018 saw a slight decrease in the number of manufacturers that issued more than one recall. That number decreased from five manufacturers in 2017 to four in 2018. The total number of units associated with those recalls declined from 907,100 in 2017 to 741,280 in 2018. The number of injuries remained the same: two. Skip Hop, Inc. recalled two sets of Tuo Convertible High Chairs and there were two injuries reported before the recall occurred. The other manufacturers with multiple recalls were Michael’s Store Procurement, Manhattan Toy Company, and Vtech Electronics.

Recall Hazards Children’s products are recalled due to a variety of hazards. In 2018, 42% of products recalled posed choking, strangulation or suffocation hazards, up from 33% in 2017. Many of these products, such as Dr. Brown’s Lovey Pacifier & Teether Holders (590,000 units recalled), can result in the detachment of small parts, posing a choking hazard to young children. Other products can pose strangulation hazards, such as the Babynest Crib Bumpers, which were recalled because the strings on the crib bumper exceed a safe length. An additional 29% of products were recalled due to bodily injury hazards such as falls or lacerations. Topson Downs’ Cat & Jack Girls' Star Studded Skinny Jeans were recalled because the metal stars on the jeans can detach, posing a laceration hazard. There were five reports of lacerations caused by these jeans before the product was recalled.


The negative health effects lead pose to children are well known. In 2017, only 1% of products recalled (1 recall) were for lead hazard. In 2018, nearly 10% of children's product recalls (5 recalls) were for lead violations: two pieces of jewelry (Boy Scouts of America Neckerchief Slides, and the pendant necklace from H.I.S.’s Girl’s Clothing Sets), two toys (Rubber Critter Toys by BSN SPORTS, and INNOCHEER Children's Musical Instrument Sets), and one set of water bottles (Reduce Hydro Pro Water Bottles). Recalls due to a rule violation increased from 43% in 2017 to 62% in 2018, and the recalls from design flaws decreased from 57% in 2017 to 38% in 2018. Design hazards that don’t violate a mandatory rule take more time and effort to recall but are equally important to remove from market. In fact, of the 1,275 total incidents reported, 1,151, or 90%, were from recalls due to design flaws, and 100% of the total injuries reported (21) in 2018 were from recalls due to design flaws. Recalls due to rule violations accounted for only 124 incidents and no injuries.

Incidents Reported Prior to Recall In 2018, 1,275 incidents were reported prior to recall for the 52 products recalled, or an average 24.5 incidents per product. This is an increase from an average of 17.5 incidents per product in 2017. Thirty-three products, or 63% of recalls in 2018 involved reports of prior incidents, up from 57% of recalls in 2017. In many cases, consumer incident reports alert a manufacturer to the necessity of a recall. However, if manufacturers designed and tested children’s products to higher safety standards and issued recalls more quickly once consumers reported potential dangers, these numbers should decrease. Three products had over 100 incidents reported before they were recalled. Hauck Nerf Battle Racer Go-Karts had 639 incidents of the steering wheel detaching, breaking or cracking. One additional consumer reported another incident four months after the recall to SaferProducts.gov that did not result in an injury. Playtime Pals Pop-Up Hideaway Hut Children’s Tents had 270 incidents of tent rods breaking. Nine months after the tent’s recall, a consumer reported an incident that resulted in an injury to SaferProducts.gov. Yvolve Sports Neon One Wheel Electric Skateboard had 128 incidents of flat tires before they were recalled. No additional incident reports were filed to SaferProducts.gov after that recall. The incident numbers provided by CPSC’s recall press releases only represent incidents that were reported and occurred prior to the recall.

Injuries Reported Prior to Recall There were 21 injuries caused by six different products prior to recall in 2018. This is a decrease from 153 injuries caused by 16 different products in 2017. Approximately 12% of products were not recalled until at least one child was hurt. Some manufacturers failed to issue a recall until after several reports of injuries. For example, Fantasia Accessories’ Slap Bracelets, Topson Downs’ Cat & Jack Girls' Star Studded Skinny Jeans, and Graco Table2Table 6-in-1 Highchairs caused five injuries prior to recall. Injuries ranged from lacerations and minor cuts to bumps and bruises. For the second year in a row, there were no deaths reported prior to a recall.

It is notable that there is often no correlation between the number of recalls of a product type (see Table 1) and the amount of injuries reportedly caused by said product type. For example, although toys accounted for 21% of recalls in 2018, they caused no injuries prior to the recalls. On the other hand, jewelry accounted for only 8% of recalls, but caused 24% of the injuries prior to the recalls.

Social Media Use to Promote Recall Awareness Beginning in 2015, KID examined the social media profiles of manufacturers to determine the extent to which manufacturers use these platforms to publicize recalls. Social media can be an important tool in reaching customers who follow the company’s brand with relevant recall information. Of the 48 companies who issued recalls in 2018 (four companies each had two recalled products), only 16 were announced on the company’s Facebook page, or 31%. In 2017, however, 51% of manufacturers who issued recalls announced them on Facebook. In 2018, 17 recalls, or 33% of recalls, were announced on Twitter (similar to 33% in 2017), and only two recalls in 2018, or 4%, were announced via Instagram (compared to 18% in 2017). Our research found that of the manufacturers that had recalls in 2018, 65% have Facebook pages, 65% have a Twitter account, and 60% have an Instagram account.

CPSC on Social Media In January 2017, the CPSC joined Facebook. They have used this platform to bring awareness to product safety issues and to publicize recalls, including children’s product recalls. In 2018, CPSC publicized only 45% of children's product recalls on its Facebook page. This was a sharp decrease from 75% in 2017. It appears the CPSC is abandoning the use of Facebook despite having just started using it in 2017. The CPSC publicized only 57% of 2018 recalls on Twitter, and just 35% of 2018 recalls on Instagram. As with manufacturer presence on social media, these outlets are a crucial pathway to publicize recalls to consumers. In our 2016 report, we speculated whether CPSC’s presence on social media would impact recall effectiveness. Unfortunately, due to both poor quality of recall effectiveness data and data that the CPSC failed to provide after FOIA requests, it is impossible to evaluate the effect CPSC’s social media presence has had on recall effectiveness. High quality data is essential to evaluating the effectiveness of this and other interventions and improvements to the product safety system. However, we do know that CPSC’s presence on social media will not have an impact on recalls they do not publicize.


Conclusion This report shows the product safety system has a long way to go to ensure the safety of our most vulnerable consumers – children. Although trends from 2018 recalls revealed decreases in the number of children’s product recalls and units recalled, as well as incidents and injuries reported prior to recall, the fact remains that children are still getting injured from product incidents. Furthermore, the CPSC and manufacturers should better publicize recalls to consumers. KID recall reports usually include recall effectiveness information from two years prior. But this year, KID received even less of the data needed from CPSC than usual. KID will release recall effectiveness analysis later this year. KID recommends the following:

Continued implementation of Danny’s Law is imperative to continued improvements in children’s product safety. Mandatory standards should continue to be developed and implemented. Danny’s Law has proven to be effective and should continue to be enforced.

Consumers must be aware of a recall and know how to comply in order to raise effectiveness rates of these recalls. Therefore, recall efforts should involve multiple methods – such as direct notification and using social media – to reach consumers and get hazardous products out of their homes.

Manufacturers and the CPSC should act to recall unsafe products before hundreds of incidents have been reported, as any delay increases the risk that these incidents result in injury or even death.

CPSC should publicize all recalls on social media. Given the sharp decline in Facebook posts regarding recalled products from 2017 to 2018, it seems that the new CPSC leadership does not value the use of Facebook as a recall effectiveness tool as much as the previous administration.

Policymakers should strengthen and mandate furniture standards to prevent tip-overs. The CPSC has stated that one child dies every 10 days from a furniture or TV tip-over, yet current standards to prevent dresser tip-overs are only voluntary and not strong enough. In 2017, Conner DeLong died when an IKEA Hemnes dresser tipped over. Despite his death and a viral video showing the same dresser tipping on twin toddlers, the dresser has not been recalled.

CPSC Compliance should reinvigorate their efforts to find products that have design hazards and get them off the market sooner. Most are recalled only after incidents or injuries have been reported. In fact, of the 1,275 total incidents reported in 2018, 1,151, or 90%, were from recalls due to design flaws, and 100% of the total injuries reported (21) were from recalls due to design flaws. Recalls due to rule violations accounted for only 124 incidents and no injuries.


KID will continue to fight on behalf of children and caregivers to improve this system. We also urge every parent and caregiver to take the following four steps to protect children in their care. 1) Be aware of the problem: Visit www.KidsInDanger.org for more information on children’s product safety and to sign up for free email alerts to stay up-to-date on recalled products. Consumers can also sign up at www.cpsc.gov to receive notice of recalls by email. 2) Check your products: Take an inventory of the products used with children—at home, at childcare, and elsewhere—and check it against the list of recalls at www.cpsc.gov. Check for safety information on car seats at the National Highway Traffic Safety Administration (NHTSA), by visiting www.nhtsa.gov. Repeat the check every time a child receives a new product, gift, or hand-me-down. 3) Spread the word: Report any injuries or problems with products at www.SaferProducts.gov. After learning of a recall, share the news with friends and family and urge them to pass it along. Always fill out product registration cards so manufacturers can send recall information. Product registration cards and online registration are required for durable infant and toddler products, but you can use the same online sites to register other products such as toys from the same company. 4) Fight for product safety: Let local, state, and national lawmakers know that children’s product safety is important.
