o MMH, LLC v. Fife:o City of Fife has put forward an argument that federal law pre-
empts I-502.
o The Attorney General (AG) has intervened in the case. AG isarguing that I-502 does not forbid localities from banning
marijuana businesses.o ACLU has also intervened on behalf of marijuana business owners
in case. They are asking that the Superior Court rule that localgovernments must allow marijuana businesses, and that I-502 isnot pre-empted by federal laws.
o Case to be decided on November 7th(as of current court schedule).

that has been made in August.

o In recent testimony by Jennifer Shasky, the Director of FinCEN(Financial Crimes Enforcement Network), she stated that 105 financialinstitutions nationwide say their customers include at least one-marijuana related business (since issuance of banking guidelines).
o There are an estimated 13,525 financial institutions in the US(sources: FDIC and Credit Union National Association).
o This means that .8% of financial institutions have customers in themarijuana business.
