BACKGROUND:

FILE REFERENCE: P1010627-14 REPORTING OFFICER: Colleen Dixon RESPONSIBLE DIRECTOR: Garry Dunne, Director Service Units DATE: 31 July 2007 MAP / SCHEDULE: N/A At its meeting held on 27 February 2007, the Marketing, Sponsorship and International Relations Committee approved an in-kind sponsorship amount of $8,404 for the inaugural Black Swan Portraiture Prize for the use of the Perth Town Hall in September 2007.

DETAILS:

Since the original request for corporate sponsorship from the City of Perth was approved, Fire Dragon Creations Inc. has restructured its major prize arrangements. The original plan was to offer one $10,000 People’s Choice prize, plus five $1,000 sponsors’ prizes. Each sponsor’s prize was to be named, chosen and presented by a sponsor. Correspondence has been received from the Director/Curator of the Fire Dragon Creations Pty Ltd advising that it has been necessary to restructure the major prize arrangements for the Portraiture prize event. The Committee’s approval for in-kind sponsorship was conditional upon the event organisers providing a number of sponsorship benefits. However, some of the sponsorship benefits have changed and a decision needs to be made by the Committee to revoke the previous sponsorship benefits and replace them with the revised benefits. The original proposal was for a $10,000 People’s Choice prize, plus five $1,000 sponsors’ prizes. Due to concerns raised by a number of artists the proposal is now for a $10,000 Judges’ Award, plus one $5,000 People’s Choice Award. Youth prizes have been added to the Awards. The date for the Black Swan Portrait Portraiture Prize has also changed from 6-15 July to 14-23 September 2007.

COMMENTS:

For an in-kind investment of $8,404, the City of Perth has secured the benefits of a Gold Sponsorship and the minor changes to the sponsorship benefits have not materially changed the value of the sponsorship to the City.

REVOKES BY AN ABSOLUTE MAJORITY part 3 of its decision of 27 February 2007 as follows:- “3. the event organisers being required to provide the following

sponsorship benefits:-

3.1 naming rights to one of the five supporting $1,000 prizes;

3.2 opportunity for the winner of this prize to be chosen by the City of Perth Elected Members;

3.3 media opportunity to present this award to the Artist;

3.4 potential for Artist’s works to be used in City

promotional material, including Town Hall promotional material;

3.5 invitation for the Lord Mayor or representative to open

the event;

3.6 twenty five invitations for Elected Members and representative staff to attend the award presentation evening to be held at the closing of the exhibition;

3.7 acknowledgement of the City of Perth as one of five

Silver Sponsors in all advertising and promotional materials, pre-and post-exhibition;

3.8 inclusion of the City of Perth crest in all promotional

material and publications relating to the event, including the catalogue and People’s Choice voting paper;

3.9 inclusion of City of Perth signage at the event;

Award, consisting of $100 worth of art supplies;

3.5 opportunity for the winner of this prize to be chosen by the City of Perth Elected Members;

The 2008 Oz Concert will be held in the grounds of Government House on Friday, 25 January 2008 and will showcase the diversity of Australia’s cultural heritage. The event will involve performers from Western Australia’s cultural and arts organisations and the wider community. The Government House venue has a capacity for 6,000 patrons and tickets to the concert will be distributed by a coupon system to be advertised in The West Australian throughout metropolitan and regional Western Australia. The concert is also available to a wider audience via a live broadcast on the Access 31 network and on the internet. The Department of Foreign Affairs and Trade, the Department of Defence, Australian Embassies and Consuls around the world will promote the internet broadcast to the expatriate community and servicemen and women posted overseas. Forrest Place Each year the organisers advertise in The West Australian inviting performers to audition for the Oz Concert. For the 2007 concert, auditions were held in Forrest Place and this will continue for the 2008 concert with auditions to be held at lunchtime on Sunday, 14 October and Saturday, 20 October. The auditions will take place during Celebrate WA’s, WA Week and will be included in the advertising and promotion of this event. The auditions in Forrest Place will provide an opportunity for the organisers to promote the Oz Concert. Funding The organisers have requested $26,000 (excluding GST) to assist with the presentation of the Oz Concert. The event must contribute to the achievement of one or more of the City’s marketing objectives:- • to position the City of Perth as a city of regional and international significance; • to increase visitation to the city; • to increase economic investment in the city; • to create a vibrant, energetic 24-hour city. The concert attracts 6,000 people to Government House and is broadcast live on community television Access 31 and on the Internet via Highway 1. The concert is also telecast Australia-wide on SBS-TV at a later date. Although the Access 31 network reaches a limited audience, the broadcast helps to position the City as a place of cultural significance. This year marks the events 63rd anniversary and with over 12,000 people attending the event annually, it is now one of Perth’s longest running and most popular Christmas events. The event is organised by the Apex Club of Perth who aim to present a high quality family event and also raise money for charity. To date, organisers have raised over $535,000 for Perth charity groups.

The Apex Club of Perth will present the 2007 IGA Carols by Candlelight in Supreme Court Gardens on Sunday, 23 December. The event program will be similar to 2006 with guest solo artists and choir performances. The organisers are also currently seeking a major headline act, yet to be confirmed. Due to the increasing competition from suburban carol concerts, the Apex Club has significantly increased expenditure in the last few years and will do so again for the 2007 event. The aim is to present Perth’s premier Carols by Candlelight event. The 2007 event will include a giant screen, introduced at the 2006 event, showing video footage of the stage, and a special fireworks finale that will be higher and more visible to the audience than previous years. The Apex Club continue to place a strong focus on audience participation. For the 2007 event the song book will include the words to all the songs being performed at the event, not just the audience participation songs, enabling the audience to sing along with the guest artists. Funding The organisers are seeking cash sponsorship of $16,000 (excluding GST) and in-kind sponsorship of $8,404 (excluding GST) from the City. The event creates a vibrant and exciting experience for families visiting the city in the Christmas period and positions the City as the premier destination for Christmas activities. The event must take place in the public spaces of the City of Perth. The event is to be held in Supreme Court Gardens. The event may or may not be cultural or arts based. The event is cultural and arts based. Preference will be given to events which provide free attendance. A cost does apply to people attending the Carols by Candlelight; $20 for a family pass which includes two adults and two children, $8 for adults and $4 for children. All profits are donated to charity. Preference will be given to events that will be held exclusively in the City of Perth. The event is held exclusively in the City of Perth. A proposal has been received from the Australian Hotels Association (AHA) seeking sponsorship for the 2007 AHA Hotel Awards for Excellence. The 2007 AHA Awards for Excellence recognise the importance of the hotel industry and its contribution to Perth and Western Australia. Major 3, 4 and 5 star hotels located in Perth have a significant impact on the economy of the city. The Awards provide the City with an opportunity to recognise the value that these properties provide to guests and visitors to the city. The AHA provides a number of Award Categories, each recognised and supported by a sponsor. The AHA is seeking sponsorship from the City of Perth for the Concierge and Guest Services Award category. The Award will be presented to a Concierge Team that demonstrates:- • sound knowledge of tourist attractions, events and activities, shops and street

layout. • useful contacts and able to secure restaurant reservations, concert tickets, tour

itineraries and tickets.

The event is being organised by the Diploma of Event Management students in consultation with the course lecturer. The Thai Festival Perth 2007 is to be held in Russell Square, the Hellenic Community Hall and on Parker Street on Sunday 21 October 2007 from 10.00am to 6.00pm. The festival is proposed to be similar to events organised by Thai communities in other states, including the Thailand Grand Festival in Sydney and the Thai Festival in Melbourne. This will be the first Thai Festival to be held in Perth and the event organisers aim to make it an annual event. Based on similar cultural events previously held in Perth and the Thai Festivals held in other states, the event organisers estimate that approximately 5,000 people will attend the festival. The proposed Thai Festival Perth will showcase the Thai culture and will include:- • displays on Thai products, culture and tourism information; • Thai food stalls; • stage performances of music and dance; • Thai boxing demonstrations; • fashion parades; • cooking classes. The event is also to include musical performances to celebrate the birthday of the King of Thailand who will turn 80 in December 2007. A VIP luncheon will be held in the Hellenic Community Hall during the festival. Invited guests will include representatives from State Government and the Honorary Thai Consul General to Perth.

Celebrate WA also manages Western Australia’s Australia Day Oz Concert on behalf of Oz Concert Inc, a not for profit organisation that presents the Oz Concert at Government House gardens on the eve of Australia Day. WA Week has the support of the Government of Western Australia, which funded a WA Week Small Grants Scheme to enable 20 regional and 13 metropolitan events throughout the State. The East Perth Crime and Safety Committee presented the inaugural East Perth Christmas Picnic in 2004. The City of Perth provided a donation to assist with administrative and program initiative costs associated with community safety and crime prevention. The East Perth Crime and Safety Committee was established in 2001 under the Safer WA program, now known as the Community Safety and Crime Prevention program and is a member of the Investing in Communities (Western Australia) Incorporated. The program is based on the premise that the most effective approach to dealing with crime and community safety is through the development of partnerships involving the police, state government agencies, local government and the community. The annual picnic in Victoria Gardens helps to develop community awareness of crime and safety in East Perth and also raises money through gold coin donation and raffles to purchase Christmas gifts for those in care at St Bartholomew’s House in East Perth. Historically, the concert has received cash and in-kind support from the East Perth Redevelopment Authority (EPRA), however, EPRA have advised the event organisers that they will be unable to support the event in 2007.

The event will be staged as a fashion parade using fashion from retail outlets in Forrest Chase. It will include a live disc jockey, dance performances prior to the parades and a celebrity judging panel. Contestants will receive a gift bag of sponsors’ products. The City is being offered the exclusive rights to the Cosmopolitan Search in Western Australia. Funding The cost of the event is estimated at $29,800 (excluding GST). The event organisers are requesting 100% funding from the City. The budget provided by the event organiser does not include a marquee structure. This may be required given the likelihood of inclement weather at the time of the event. This has been advised to the applicant. The budget includes a $6,000 ‘fee’ for the City to have exclusive rights to the Western Australian event.

The Cosmopolitan Model Search has national sponsors including QV Face, SWISSE Vitamins, Smith & Miles and Soft Lips Lip Balm. The national sponsors will not be contributing cash funding to the Perth event but do provide in-kind sponsorship through products for the contestant gift bag. At the Marketing, Sponsorship and International Relations Committee meeting held on 24 July 2007 the following alternative recommendation to the administration was adopted:- That the Council:- 1. notes the request by West End Festival Inc. for cash sponsorship of $150,000

(excluding GST) to the West End Festival to be held from 23 November to 1 December 2007;

2. notes that any sponsorship above $45,000 will have an impact on the City

providing sponsorship for other requests that may be received during the year; 3. directs the administration to initiate discussions with the event organiser to seek

additional sponsorship from other sources. A group of business people comprising key stakeholders of the city’s ‘West End’ precinct produced the inaugural West End Festival in October 2004. The Festival was developed to promote the business, social and cultural sectors bounded by King Street, Thomas Street, Kings Park Road and the railway line. The festival celebrates the West End as a great place to work, live and play and activities have added vibrancy to the precinct and have encouraged visitation to the precinct. In 2006 the traders formed the incorporated body, West End Festival Inc., as detailed in Schedule 11. The event organisers have provided a 2006 post event report which indicated the following:- • the 2006 Festival included 43 events; • the 2006 Festival attracted an audience of over 23,000; • the Festival received media exposure to the value of $302,000; • this included media partnerships with The Sunday Times, Nova 93.7, Picton

Press and Foxtel; • in-kind sponsorship to the value of $230,000 was received; • total expenditure for the 2006 Festival was $45,997.

DETAILS:

The 2007 West End Festival will take place from Friday, 23 November to Saturday, 1 December 2007. Total attendance at the 2006 Festival activities was over 23,000 and the event organisers expect an increase in attendance for the 2007 Festival. The Festival is organised by the West End Festival Inc, members being from key West End businesses that included Box Deli, The Melbourne Hotel, Woodside, Parmelia Hilton, Shafto Lane, Linc and the Local Chambers. Key events proposed for the 2007 West End Festival include:- King Street Launch and Concert The Festival will be launched in King Street on Friday, 23 November and will include a fashion parade by entrants of the Face of Perth model competition, dancers and music. The event organisers propose to utilise the closure of King Street for the launch to present entertainment in King Street on Friday evening and Saturday. This will include a variety of activities and a free open-air concert. Outdoor Markets A new event for 2007 is outdoor markets to be held on Hay Street in the West End from Saturday, 24 to Sunday, 25 November. The markets will feature food, clothing and other products from West End retailers presented on the pavement and parking bays along Hay Street east of King Street to Milligan Street. Westend vs Eastend Corporate Relay Race Challenge On Thursday, 29 November the inaugural Westend vs Eastend Corporate Relay Race Challenge will be held in Forrest Place and Murray Street Mall. The event seeks to directly involve the business community in the Festival. A series of races will be held to determine the winning corporate team. Awards will be given to the fastest team, slowest team, craziest dressed team and individual. Other proposed Festival activities include:- • vintage car exhibition; • local jazz and swing bands performing at various venues; • art exhibition; • heritage walks; • His Majesty’s tour; • Friday fashion lunch; • Face of Perth Final; • West End Festival wrap party.

Funding The City provided $45,000 (excluding GST) for the 2006 Festival. The Festival organisers are requesting cash sponsorship of $150,000 from the City to present the 2007 West End Festival. The Festival organisers have indicated that the increased level of sponsorship is to:- a) cover the shortfall in funding of individual activities; b) contract an event manager to manage the operations and to source further

sponsorship; c) cover the cost of road closures and infrastructure for the King Street events and

Outdoor Markets in Hay Street; d) contract a marketing company to promote the event. The event organisers wish to make the West End Festival a significant event but lack the staff resources and finance to enable this to happen. Tasks they require funding for include administration, sourcing sponsorship, liaising with retailers and suppliers and coordinating the Festival’s events. The City of Perth’s resources would not extend to provide this service for the Festival. The following table shows other events that receive similar funding from the City:-

The equivalent value of rates earned in this area is $1.08 million. The Perth’s Biggest Office Party, an activity that has historically been part of the West End Festival is currently seeking direct sponsorship from the City for their event to the value of $5,923. There is the potential for organisers of other West End Festival events to seek direct sponsorship from the City. Consideration could be given to deducting the value of the sponsorship to the Perth’s Biggest Office Party or other individual Festival events from the total given to West End Festival. Assessment of Application. To be eligible for event sponsorship:- The total value of the event must exceed the cost of sponsorship. The estimated total cost of the Festival is $150,000. The organisers have requested the City contribute the full cost of the Festival. The event must contribute to the achievement of one or more of the City’s marketing objectives. • to position the City of Perth as a city of regional and international significance;

The event must take place in the public spaces of the City of Perth. The Festival takes place in the City’s public spaces and in buildings accessible to the public. The event may or may not be cultural or arts based. The Festival is diverse in content and includes activities associated with the arts, business and hospitality. Preference will be given to events which provide free attendance. All activities are free to the public, with the exception of the final of the Face of Perth model competition. Tickets for the Face of Perth final are $25 with part proceeds going to a charity. Preference will be given to events that will be held exclusively in the City of Perth. The Festival is held exclusively in the City of Perth. Dates and amounts of any previous sponsorship to the applicant / event. The City has sponsored the Festival since its inception and has previously provided the following support:-

The Sunday Times has been confirmed as media partner for the Festival and has proposed a promotional campaign valued at $180,000. The package includes an eight-page feature in STM lift-out the week prior to the Festival and numerous features in the social pages prior to and during the Festival. Radio station Nova 93.7FM has also been confirmed as a media partner, committing to radio advertising and an outside broadcast at one of the Festival activities, at a total estimated value of $50,000. Foxtel will feature the West End Festival and Face of Perth event in a one hour documentary on the Aurora and Lifestyle channels. The event organisers have confirmed sponsorship with Picton Press to assist in the production of promotional material for the Festival, including:- • 100 posters; • 2,000 flyers; • 15,000 programs; • 1,000 Face of Perth calendars. The applicant has estimated the value of media exposure as $345,000. The applicant must provide adequate guarantee that they can deliver the event. This proof of capacity may be (but not limited to) any of the following:- a) history of previous dealings with the City of Perth; b) evidence of support from governing body; c) evidence of funding from other sources; d) statement of the organisation’s income and expenditure, and auditor’s

certificate; e) evidence of the capacity of the organising committee to manage, present and

market the event. The West End Festival has been presented since 2004. The event receives a high level of non-financial support from the local entertainment and business sectors and activities have previously been well attended. The organisers work closely with the City to ensure that activities comply with the City’s requirements.

COMMENTS:

The Council, at its meeting held on 18 July 2006, endorsed City Elements, which has been prepared by the Chamber of Minerals and Energy WA (CMEWA) and the Australian Petroleum and Exploration Association (APPEA) as a strategic conceptual vision and as a first step to bring together a partnership of relevant stakeholders, including the City of Perth, to develop a resources industry precinct for Perth.

The City could encourage the West End Festival organisers to work with the CMEWA and APPEA on delivering some of CMEWA and APPEA’s proposals through the Festival with funding from CMEWA and APPEA members. The funding request is a considerable sum. The request places full funding responsibility on the City. The City needs to consider the strategic importance of funding precinct festivals to this extent. Should it be considered that sponsorship of the event be approved, then the following benefits will be requested to be provided to the City:- 1. the City of Perth to be recognised as a key partner; 2. recognition of the City of Perth in the following manner:-

At its special meeting held on 22 December 2003, the Council approved to provide in-kind sponsorship of $16,076 (excluding GST) for the David Bowie Concert on Monday, 1 March 2004.

Dream Entertainment has requested cash sponsorship of $3,226 (excluding GST) and in-kind sponsorship of $9,485 (excluding GST) for their production of the Josh Groban Concert. Josh Groban is a soloist performer who has released two multi-platinum albums, his self-titled debut in 2001 and Closer in 2003. He has established himself in the classical crossover genre. Songs are performed mostly in English and Italian, although he has undertaken Spanish and French songs. His music includes many diverse classical and pop recordings. Dream Entertainment is seeking the following in-kind assistance:- • reserve hire and fee for Supreme Court Gardens ($5,055); • closure of Governors Avenue, traffic management and road closure advert

($3,455); • event parking tickets for VIP ticket holders and guests in the Terrace Road Car

Park ($975). The cash component is requested as a contribution towards the event’s clean-up. The application has been assessed under the Policy for event sponsorship. Assessment of Application. The Western Australian performance is to be held in the City of Perth, however, other performances will be held in Sydney, Melbourne and Adelaide. Dates and amounts of any previous sponsorship to the applicant / event. Dream Entertainment has not previously received sponsorship from the City. The Director of Dream Entertainment was previously the event coordinator of Creative Events Management, which received sponsorship from the City for the Jose Carreras and David Bowie Concerts. The applicant must detail how they will promote the support of the City of Perth. The Marketing, Sponsorship and International Relations Committee has delegated authority in relation to issues concerning the Australia Day Celebrations. This report provides an update in relation to each of these issues:- Delegated Authority Issues:- Decide on an appropriate name for the Australia Day Celebrations in association with the principal sponsor. The City has submitted its Grant Application to Lotterywest for Skyworks 2008 for funding of $485,000 to cover fireworks ($300,000), indigenous cultural festival on Supreme Court Gardens ($30,000), advertising production costs ($70,000), banners for community service messages ($10,000) and emergency services compounds ($75,000). The Grant Application will be considered by the Lotterywest Board in August. Naming rights is a benefit offered to Lotterywest in return for the grant. Determine the location of selling points and negotiate and issue exclusive selling rights on the foreshore for food and catering, drinks, amusements, merchandise and icecreams.

The contract for Mobile Catering Services (Quotation 050-06/07) was approved for Skyworks 2007 and has been renewed for Skyworks 2008. An offer of renewal was made to the Merchandise Services (Quotation 106-05/06) contract for Skyworks 2007 and was declined by the contractor. Formal quotations will be sought for the Merchandise Services contract for Skyworks 2008. Engage the services of appropriate consultants to undertake actions in line with Australia Day Celebrations and project budget. Russell Lanyon has been re-appointed as co-ordinator of the Australia Day Air and Water Show components. Determine the location and number of entertainment boxes to be located on the foreshore and arrange sponsorships accordingly. The City has received six bookings for Corporate Boxes for Skyworks 2008. Invitations and information will be distributed by the end of August. It is expected that The Esplanade and William Street Stations will be operating by 26 January 2008. Due to the stations’ close proximity to the Corporate Box area, it is advised that each Corporate Box guest be provided with a ticket to travel to the event by train. Special arrangements will be made for ACROD guests. Negotiate the advertising and promotion campaign with the principal sponsors. The promotional and advertising campaign and schedule will be reported on later in the year. Negotiate the rights to broadcasting the Australia Day fireworks event with a radio network. At its meeting of 18 July 2006 the Council appointed Perth FM Radio Pty Ltd, trading as MIX 94.5, as the contractor to provide the radio station promotion and broadcast (Tender 113-05/06), and Channel Seven to provide the television promotion and broadcast (Tender 114-05/06) for Skyworks 2006 – 2009. The tender specification includes a requirement to deliver a draft soundtrack for consideration by the City and the pyrotechnic supplier by the end of October. Make recommendations to Council on tenders related to the Australia Day celebrations. The City has approved the following contracts effective for 2008:-

• licence for Merchandise Service; • provision of Concept Development and Supply of Goods and Services for the

Pyrotechnics, Laser and Special Effects Display;

• provision of Promotion and Broadcast by a Radio Station; • provision of Promotion and Broadcast by a Television Station; • provision of Infrastructure; • corporate Box Equipment Hire and Installation; • provision of Waste Management Services; • provision of Corporate Box Catering Services; • licence for Mobile Catering Service. MENU SELECTION

At the meeting held on 31 October 2006 the Council approved the appointment of Mustard Catering to provide the catering service for the Skyworks Corporate Box facility. Three menu options have been provided by Mustard Catering for consideration by the Marketing, Sponsorship and International Relations Committee and are attached as schedule 12. GENERAL INFORMATION Consortium Steering Group A Consortium meeting was held on 27 July 2007 with representatives from Austereo (Mix 94.5), Channel Seven, Howard and Sons Pyrotechnics and Lotterywest. The meeting included discussion on the following creative elements for Skyworks 2008:-

• soundtrack content; • narration; • pyrotechnic and laser display content. Sound bites demonstrating the “multicultural” instrumental music were presented to the Consortium. The example included Australian music and traditional instrumental music indicative of cultures represented in Australia. Suggestions on the content of the narration included “Happy Australia Day” being said in different languages and representatives from the City of Perth’s sister cities wishing Perth a happy Australia Day. These options are being explored by the broadcast contractors. Howard & Sons presented a one minute example of the pyrotechnic content for Skyworks 2008. The example included pyrotechnic firing locations from six buildings and across 600 metres of Perth water, an increase of 200 metres from Skyworks 2007. Howard & Sons suggested using the western point of Heirisson Island as an additional pyrotechnic firing location. Using this location would not reduce the amount of pyrotechnics fired from the Perth water or buildings. This option is to be explored at the pyrotechnic operational meeting.

Howard & Sons presented three laser show options for Skyworks 2008, these being:- 1. 10 blitz lasers presented on seven pontoons positioned on Perth water, 50 to

100 metres from the Corporate Box area. The special effects would be limited to the Corporate Box precinct.

2. The same laser display as above located on Perth water 50 to 100 metres from

Langley Park. The special effects would be limited to the audience on the west end of Langley Park and the foreshore area in front of Langley Park.

3. 4 x 40W YAG lasers located in the middle of Perth water, the same laser

display as Skyworks 2007. Two facing north and two facing south. A description of blitz lasers and YAG lasers is attached in Schedule 13. Within the allocated budget, only one of the three above options is possible. Option one would provide limited viewing for the public. Option two could be included in Skyworks promotions and used to attract crowds to Langley Park. Option three would provide viewing for all spectators, however, the display would be the same as Skyworks 2007. Maps showing the location of the three options are attached in Schedule 14. Foreshore Development MIX 94.5 have confirmed that the Listener Party for Skyworks 2008 will be relocated to the new foreshore area in front of The Esplanade. A map indicating the location is attached in Schedule 13. Emergency Services Meeting A meeting was held on 11 July and was attended by representatives from WA Police, St John Ambulance, Swan River Trust, Main Roads WA, Town of Victoria Park and the City of Perth. Issues addressed were:- • WA Police will increase the police presence along the Narrows Bridge to manage

and prevent pedestrians crossing the freeway. • Investigation of additional fencing in Sir James Mitchell Park, South Perth, to

assist with crowd management. • the WA Police’s recommendations for the Supreme Court Gardens event to

ensure public safety. • Department for Planning and Infrastructure Marine Safety to ensure better

containment of spectator crafts at the event. Waste Management Meeting A meeting was held on 18 July and was attended by representatives from Keep Australia Beautiful, the contracted waste management company and City of Perth. Issues addressed were:-

• changing the distribution points of the litter bags to issue to people as they arrive at the event;

• investigation of a waste facility that is able to recover recyclable materials from the waste collected at the event.

Road Closure Meeting A meeting was held on 1 August and was attended by representatives from Main Roads WA, WA Police, Perth Transport Authority, Kings Park and Town of Victoria Park. Issues addressed were:- • the Narrows Bridge freeway to remain open during the pyrotechnic display; • an additional road closure on William Street between St Georges Terrace and

Riverside Drive to accommodate the pedestrians leaving and entering The Esplanade Train Station;

• all other road closures to remain the same.

FINANCIAL IMPLICATIONS:

There are no financial implications related to this report.

COMMENTS:

This report is submitted for information and discussion by the Committee. It was therefore recommended that the Committee receives the information on the progress of Australia Day Celebrations 2008 as detailed in the report dated 27 July 2007. MP231/07 SPECIAL EVENTS LOCAL LAW 2007 - APPROVAL TO ADVERTISE

For a number of years, the City of Perth has been Australia Day celebrations, however in previous years the event experiences problems with large household items being left on the foreshore and the consumption of liquor. As a means for controlling such behaviour, the City of South Perth introduced a local law, prior to the 2006 event, that enabled officers to confiscate large items such as lounge suites, refrigerators, swimming pools and spas that were brought to the foreshore, as well as controlling the consumption and possession of liquor. Various operational briefings between the City and various stakeholders have highlighted the desire of the WA Police and the City’s enforcement officers to introduce a local law similar to that introduced by the City of South Perth to provide consistency of legislative provisions. At its meeting held on 13 September 2005, the Council approved the advertising of a Special Events Local Law 2005, which was modelled on the City of South Perth’s original local law. However the local law process was abandoned as deficiencies were identified by the City of South Perth and the Joint Standing Committee on Delegated Legislation. The introduction of the Red Bull Air Race in 2006 also highlighted the need to amend the City of South Perth Local Law and proceed with a City of Perth Local Law to include this event. These deficiencies have been rectified and provision has been made to include the Red Bull Air Race in the new Special Events Local Law. This report seeks approval from the Council to advertise a new City of Perth “Special Events Local Law 2007”.

Legislation Local Government Act 1995. Section: 3.12 – Procedure for making local laws. Strategic Plan Key Result Area: Leading City. Strategy: City Leadership.

DETAILS:

The following information details the main provisions under the new “Special Events Local Law 2007” and a brief description of those provisions. PART 1 - PRELIMINARY Purpose and Intent The purpose of this local law is to provide for the regulation, control and management of the possession and consumption of liquor and the possession and use of large objects and sound equipment at special events held in public places within the district, and a means of enforcing those provisions. The effect of this local law is to establish the requirements with which any person attending a special event in the district with liquor, sound equipment and large objects, must comply. Inconsistency This clause removes any inconsistency between other City of Perth Local Laws and the Special Events Local Law 2007 only on special event days and within special event locations. The provisions of the City of Perth Parking Local Law 1999 will prevail over the Special Events Local Law 2007. This was required to account for the parking of vehicles within the special event location on special event days. Application The local law applies in those areas determined by the Council as special event locations on special event days. Details of a special event location, alcohol free location and special event day are included within the Second Schedule of the local law and are detailed further in this report. Definitions Describes the relevant definitions used within the local law to provide clarity and understanding of the terms used. As the local law has been created to control the use of large objects and stereos at special events, the following definitions have been included:-

• “large object” includes-

(a) a lounge chair; (b) a couch; (c) a bed; (d) a mattress; (e) a refrigerator; (f) a spa; (g) a swimming pool; (h) a wading pool; (i) a table with any dimension that is greater than 1.2 metres; (j) an esky or box with any dimension that is greater than one metre; or (k) another object with any dimensions greater than 1.5 metres, but excludes-

(i) shade structures (such as beach umbrellas or beach tents) which may have a maximum permissible dimension of 2.5 metres; and

(ii) vehicles; • “loud stereo” means any electronic sound equipment with-

(a) any speaker that, when amplified, has a sound output greater than 40 watts root mean square; or

(b) any combination of speakers that, when amplified, have a total sound output greater than 60 watts root mean square.

Agreement to use local government property The City may from time to time engage contractors and other service providers for such special events and this clause ensures that such approved contractors can operate without being affected by the local law. PART 2 – POSSESSION AND USE OF ITEMS Possession of liquor Within a special event location and on a special event day, a person cannot possess any liquor within an alcohol free location unless the person is transporting the liquor to private property or a licensed premises or has the prior approval of the City. The definition of liquor also includes liquor in a sealed container. Possession and use of large objects A person cannot bring or use a large object (see “definitions”) in a public place within a special event location and on a special event day unless the person is transporting the large object to private property or has written approval from the City. Use of loud stereos A person cannot use a loud stereo in a public place within a special event location and on a special event day so as to cause a nuisance.

PART 3 – SPECIAL EVENT LOCATIONS, SPECIAL EVENT DAYS AND ALCOHOL FREE LOCATIONS Local public notice to be given During the lead up to a special event days, the City must ensure that it advertises the area that is affected by the provisions of this local law. This advertisement will also assist in reducing the amount of large objects being brought into the City as well as provide education relating to the consumption of alcohol. PART 4 – GENERAL Substance seizure and impounding A contravention of a provision of this local law is a contravention that can lead to impounding. This clause enables the City to confiscate any item that is unauthorised to be brought into a special event location and the City is to take such items confiscated to an appointed place. The City is to withhold any items confiscated until such costs are paid or otherwise dispose of the item in accordance with the Local Government Act 1995. Furthermore, an authorised person or a member of the WA Police may seize any substance in an unsealed container that is thought to be liquor. FIRST SCHEDULE Modified Penalties The First Schedule lists all modified penalties that apply under this local law. The amounts set are in line with levels set by the City of South Perth when introducing their special event local law for the 2005 Australia Day Celebrations. SECOND SCHEDULE The Second Schedule details the description of the special event day, special event location and alcohol free location. The special event days are defined as being the period of the day commencing at 6.00am on 26 January and finishing at midnight, and that period of the day commencing at midnight and finishing at 6.00pm on 27 January each year and four consecutive days within the period 31 October and 30 November each year which must be advertised six weeks in advance of such events occurring. The special event location and alcohol free location are defined similarly as being all that area between St George’s Terrace, Adelaide Terrace and the Swan River foreshore; Heirisson Island; and the area between Mounts Bay Road and the Swan River foreshore. A detailed map and description is supplied in this schedule.

Restrictions on the use of the Special Events Local Law 2007 During the development of the Special Events Local Law 2007, it was hoped that the local law could be used for events in the City such as the Christmas Pageant, Pride Parade, Northbridge Festival and the like. It was anticipated that special event locations could be developed for these particular events to control large objects and alcohol being brought into the area being defined as a special event location. Whilst the development of a special event location for these events can be defined, a problem exists in that the particular events occur on differing dates year to year and therefore the special event day for these events could not be specifically defined. The administration initially investigated including a clause within the local law that allowed the Council to determine a special event day and special event location by a formal resolution of the Council. Such a day and location would be advertised for public comment and once the comment period closed, it would need to be formally endorsed by the Council. However the Joint Standing Committee on Delegated Legislation is of the view that such a provision is a “determination” device and avoids the scrutiny by both the Department of Local Government and Regional Development and the Parliament as well as the requirements of section 42 of the Interpretation Act 1984 in relation to the publication of the determination in the Government Gazette, tabling in both Houses of Parliament and the possibility of disallowance. The City of South Perth included a similar clause in its original version of its local law, however the Joint Standing Committee on Delegated Legislation required the City of South Perth to remove the provision due to the reasons stated above. In view of this it is advised that this local law only applies for the Australia Day Celebrations event and the Red Bull Air Race as these events occur on the same day or within the same time span in each year and in the same location, and can therefore be specifically defined. It addition these events would be advertised six weeks in advance to ensure the necessary scrutiny is available. Local Law Creation Process The first step in creating a new local law is to advertise the City’s intention to adopt the local law detailed above. The public comment period is six weeks after which time the Council is to consider any public submissions prior to its adoption. The complete process from advertising to adoption is expected to take approximately three months. The local law is therefore unlikely to be in force in time for this year’s Red Bull Air Race event

FINANCIAL IMPLICATIONS:

Costs associated with this report relate to advertising the proposed Special Events Local Law 2007 in both Saturday and Wednesday editions of The West Australian. This is a statutory requirement under Section 3.12(3) and (3a) of the Local Government Act 1995, that both local and state-wide notice be given.

COMMENTS:

The “Special Events Local Law 2007” will have the effect of providing suitable legislative framework for the City’s officers and WA Police to control the use and possession of large objects, stereos and liquor at the Australia Day Celebrations and Red Bull Air Race special events. By adopting this local law the WA Police will have common local law enforceable on both the Perth and South Perth Foreshore. MP232/07 GENERAL BUSINESS 1. Tables and Chairs for Speakers Steps Cr Kay queried whether the tables and chairs at the speakers steps were at risk of vandalism. The Acting Director Service Units advised that arrangements were being made to replace the chairs as well as new arrangements with city staff to install and remove the chairs on Sundays. 2. Advertising Company’s Response to City’s Brief The Acting Director Service Units advised that information will be circulated to Elected Members relating to the City’s advertising agency’s response to the City’s brief.
