DRAFT MINUTES WORK SESSION & MEETING OF THE

FORT MYERS BEACH FIRE CONTROL DISTRICT BOARD OF COMMISSIONERS

TIME: 9:30 AM DATE: March 13, 2019

PLACE: 2755 Estero Boulevard – Public Library Fort Myers Beach, Florida 33931

IN ATTENDANCE: Chairman Wood, Vice-Chairman Fleming, Secretary/Treasurer Raymond, Commissioner Liszak, Commissioner Bennett, Fire Chief Love, District members and members of the public.

1. Meeting Called to Order

2. Pledge of Allegiance Add-In Chairman Wood discussed changing the order of the agenda. The Board agreed to switch item three (3): Restate Agenda Items, with item four (4): Adoption of the Agenda.

3. Adoption of the Agenda [Discussion/Approval] The Board agreed to switch item (A): Board Policy Manual Updates, with item (C): Proposed Sanction Rescinding under New Business. Chairman Wood called for a motion to adopt the amended agenda. Commissioner Liszak made a motion to approve the amended agenda. Vice-Chairman Fleming seconded. The motion was approved unanimously 5 – 0.

4. Restate Agenda Items [Information]

6. Consent Agenda [Approval] Items listed are considered routine and action will be taken by one motion; if a Commissioner desires discussion, the specific item will be removed and considered separately. A. February 27, 2019 Regular Meeting Minutes

Chairman Wood called for a motion to approve the Consent Agenda. Vice-Chairman Fleming made a motion to approve the consent agenda. Secretary/Treasurer Raymond seconded. The motion was approved unanimously 5 – 0.

7. Unfinished Business A. Facility Planning [Information/Discussion/Approval]

Chief Love stated that the District continues to work with a Broker on property options.

8. New Business A. Proposed Sanction Rescinding [Discussion/Approval]

Vice-Chairman Fleming gave an explanation and provided the history of the sanction. Vice-Chairman Fleming requested that the Board rescind the sanction brought against him in November 2018. The Board discussed the sanction and the validity of the sanction. Chairman Wood made a motion to rescind the sanction against Commissioner Ron Fleming. Commissioner Liszak seconded. The motion was approved unanimously 4 – 0. (The Board agreed to not have Vice-Chairman Fleming vote on this item)

B. Term Limits [Discussion] The Board discussed the advantages and disadvantages of term limits. The Board requested that staff provide information on other department’s term limits and a history of our previous Commissioners terms. The Board also discussed offering a survey to our community, as well as the cost for a referendum.

C. Board Policy Manual Updates [Discussion] Chief Love discussed some items covered in the Board Retreat. The Board and Chief Love discussed and agreed to update the Violation Section by adding the Super Majority and other verbiage. This will be presented at the following meeting. The Board agreed that they would like to review the entire Board of Commissioners Handbook in future meetings, section by section. Add-In: Vice-Chairman Fleming requested an update on the Short Term Ordinance program for the next Work Session & Meeting.

9. Fire Chief Remarks[Information/Discussion]

Chief Love stated that he spoke with the Local 1826 Union representatives and they agreed to have the “Reports from Union Representatives Districts 3 and 15” removed from the agenda. Local 1826 will contact the Fire Chief if they would like to report anything and it will be added to the agenda. Chief Love reminded the Board of the FASD Conference in June and requested that they identify to staff if they would like to attend by the end of the week.

11. Commissioners Remarks Vice-Chairman Fleming thanked the Board for rescinding the sanction against him. Vice-Chairman Fleming wished all First Responders and eventful, but safe shift. Commissioner Bennett stated that he enjoyed walking in the parade and hearing all of the nice comments from the community regarding our department. Commissioner Bennett congratulated Chief Love on his recent award. Commissioner Bennett congratulated Firefighter Joel Martinez for winning the shrimp-eating contest. Commissioner Bennett stated that he is proud to be a part of this organization. Commissioner Liszak thanked Chief Love for everything he did for the Shrimp Festival event. Commissioner Liszak also thanked the staff who participated in the event. Commissioner Liszak congratulated Chief Love on his recent award. Commissioner Liszak reported that the fundraiser they held at the Sea Gypsy brought in $2,500 to give to the Harry Chapin Food Bank for their assistance this past year. Commissioner Liszak stated that she is looking forward to the St. Patrick’s Day Parade. Chairman Wood stated that he is so proud of Chief Love’s recent award.

February 2019 Fire Chief Report

February has been an exciting and busy month as “season” seems to be in full swing with visitors and spring breakers. As you know, traffic can become a stressful situation here on the island during February and March, especially for our Firefighters and Paramedics responding to emergencies. We recently distributed a media release to remind our residents and visitors to avoid blocking intersections or driveways to businesses, as this can become very troublesome for our crews to gain access to critical incidents. We thank our community for assistance during this busy time of the year. This month I had the opportunity to attend the Golden Coconut Award Ceremony at Beach Elementary. Every year, the Beach Kids Foundation announces a winner for the Golden Coconut Award to an educator who goes “Above and Beyond” for the students at Beach Elementary. I would like to congratulate this year’s winner Lori Zamniak for receiving this outstanding award. This month we held hiring assessments for Firefighter Paramedics. I would like to thank Executive Assistant Fire Chief Wirth for organizing the hiring assessments and working with our partners at San Carlos Fire Department who allowed us to use their facility. The Firefighter Paramedics who passed through this portion are now going through the final round of hiring assessments. Thank you to everyone who assisted with the hiring assessments. Executive Assistant Fire Chief Wirth and I attended educational sessions with the Florida Public Employer Labor Relations Association (FPELRA) this month. This year Executive Assistant Fire Chief Wirth has started a series of courses to complete the Certified Labor Relations Professional Program, better preparing us to continue the great labor relations we have established. Recently, Fort Myers Beach hosted the 61st Annual Shrimp Festival which brought in thousands of visitors to our island. This event is always a crowd favorite and a great boost for the businesses in our community. I would like to thank the Lions Club for hosting another very successful event this year. I also want to thank the members of our Department who participated in the events. Last but not least, I would like to congratulate Firefighter Joel Martinez for winning the shrimp eating contest for the second year in a row! The annual International Association of Firefighters (IAFF) Union Local 1826 Muscular Dystrophy Association (MDA) Boot Drive took place a few weeks ago and I am happy to announce that they exceeded their goal and brought in over $250,000 to help children with Muscular Dystrophy! These critical funds help transform the lives of those affected by muscle disease, ALS, and other muscular debilitating diseases. I would like to thank our team for their participation in this event and for those of you who generously donated to make a difference!

Operations Branch Operations Branch Supervisor-Executive Assistant Fire Chief Scott Wirth February was a solemn month for local emergency service agencies. FMBFD received word that an active member of the Cape Coral Fire Department had passed away. Our Department, along with several others, formed a Strike Team of Engines to provide coverage so Cape Coral could attend a private service in honor of their fallen brother. In addition, the Florida Highway Patrol suffered an unexpected loss of one of their own. Master Sergeant Daniel Hinton passed away after suffering a medical emergency during a training event. FMBFD joined our emergency service partners from across the region in honoring Master Sergeant Hinton at the funeral at Hertz Arena. Please keep these families in your thoughts and prayers as they struggle to recover from their losses. The Operations Branch is actively working on its portion of the 2019/2020 Budget, with the current focus on Capital Sustainment Planning. We are also continually assessing out-of-service times for all appratus, especially our ambulances fleet. We have seen some increaed maintinence issues as we address recurring suspension matters, as well as Ford recall issues exacerbated by long lead times for backordered parts. We will continue to assess this for future year considerations.

Training, Education & Safety

Training Division Supervisor- Assistant Chief Vinny DiCristofalo

February included the introduction of the FMBFD Training Matrix which provides an easy to follow outline of the assigned training each month. In order to comply with Florida Administrative Code and Occupational Health and Safety Administration (OSHA) requirements, all personnel received an overview presentation of respiratory protection requirements and familiarization with the SCOTT self-contained breathing apparatus (SCBA), including emergency operations. Fire personnel completed company-level training focused on use of their SCBA. Evolutions included:

Crews performed Target Hazard Walkthroughs to familiarize themselves with structures and facilities within their response zone that present a significant life safety issue or whose damage/destruction would be detrimental to the community as a whole. This will be a recurring monthly activity for all crews. All supervisors completed a web-based assignment focused on recognizing and addressing conflict in the work environment. FMBFD fire units participated in the quarterly Lee County Training Cooperative session. Over three (3) days fire companies from throughout Lee County worked together on a simulated multi-jurisdictional response to improve communications and coordination of functions and assignments. FMBFD personnel performed fire attack, search, vertical ventilation, and forcible entry skills. Five (5) firefighters completed the Aerial Operations course hosted by Sanibel Fire Rescue. The 45-hour course provides foundational knowledge of aerial apparatus systems and opportunity to practice skills on a variety of aerial apparatus. Completion of this course is a requirement to progress to Firefighter Second Class and eventual promotion to Driver Engineer. Three (3) personnel attended “Stretching for Success” hosted by Bonita Springs Fire Rescue. This course provided “street-smart” tips for placing the first fire attack line in service and hose line management with two-member attack teams. One of our Urban Search and Rescue (USAR) Firefighters participated in a 40-hour USAR Confined Space course presented by the Region 6 USAR Team. This member will be bringing back this knowledge for the betterment of our team as well. Training hours for February included:

Emergency Medical Services (EMS)

EMS Division Supervisor- Division Chief Randy Kraus Our February Protocol review continued with trauma recognition as well as decisional capacity determination in patients. We also started our bi-annual recertification of our American Heart Association Basic Life Support and Advanced Cardiac Life Support classes. These classes are required by the State of Florida to be renewed every two years by all Paramedics and Emergency Medical Technicians in Florida. Each class is four hours in length, and encompasses all aspects of cardiovascular and stroke care. Division Chief Kraus, Captain Devito, and Driver Engineer Gonzalez all attended a Pediatric Provider Instructor class in Davie Florida given by Dr. Peter Antevy, who is one of the Leading Pediatricians in the country. FMBFD already uses the most comprehensive pediatric care programs in Dr. Antevy’s “Handtevy Pediatric” program, and our instructors are prepared to advance this application to all patients that we provide care to in the pre-hospital arena. Our organization received approval from the Board of County Commissioners to continue our excellent transport service for two more years. Bi-annually, FMBFD has to meet certain performance standards to receive a Certificate of Public Convenience (COPCN) from Lee County to operate our ambulance transport service. FMBFD was the first agency in Southwest Florida to provide ambulance transport, and we are proud of that, and the fact that we continue to lead Lee County in innovative pre-hospital emergency care. The Division is also proud to congratulate Paramedics Jordan and Lorenzo for receiving their Paramedic Credentialing Privileges in February from our Medical Director Dr. Lemmons.

Life Safety & Support Services Branch

Life Safety & Support Services Branch Supervisor- Executive Assistant Fire Chief Ron Martin The month of February was an active and exciting month for the Life Safety and Support Service Branch. We welcomed Deputy Fire Marshal Jennifer Campbell to our team and she has hit the ground running. She has started the process of implementing Plan Review and began conducting her assessment of the Life Safety Division. Our Life Safety Support Services Assistant Amber Datko has been working to reconcile short-term rentals registered with the Town, in comparison to rentals registered with our Department. We are making great strides in this area. In terms of risk reduction activities, we have been receiving and providing several requests from Condominium Associations and businesses for CPR Training. The largest class

being Fish Tale Marina. We have also been busy with car seat installation requests this month. Support services continued an in-depth inventory management software build out of consumables and uniforms to build an active inventory management system using Operative IQ, or information management system. There were also facility repairs and maintenance projects accomplished in February to include reallocation of space at Fire Station 32 to accommodate our services.

Administrative Services Branch Finance & Administrative Services Branch Supervisor- Director Jane Thompson

• The District invited 43 qualified Firefighter applicants to attend the written, physical and medical

assessments in February. Those who were successful completed all three assessments and were invited to interview with the hiring panel. Seven candidates received a conditional offer of employment pending successful completion of additional pre-employment screening.

• The annual inventory of all capital assets went smoothly and recommendations for asset replacements

for the budget year 2019/2020 is nearly complete.

IX. Violation A. If it is believed that a Commissioner has violated the items found in this

document, or any other District Policy or Procedure, the alleged violation will be brought before the Board for review at a Board Meeting.

B. The Commissioner who allegedly violated the item will have the opportunity to

present a response to the allegations.

C. An alleged violation brought to the attention of the Board may only be voted on at a subsequent Board meeting and not the initial meeting it was identified.

D. Following the information presented, the Board will vote on the proposed discipline.

1.The Board member accused of the violation may not vote. 2.The vote must pass by a super majority of all remaining District Board

members (3 out of 4, 3 out of 3). 3.The Board may provide a formal sanction upon the violating

Commissioner to include a publically voted on statement of record by the District.

E. Any violation of Local, State, and/or Federal law may be escalated to the proper

authorities by any individual, or on behalf of the District via a super majority vote, of all existing District Board members, minus the Board member accused of the violation (3 out of 4, 3 out of 3).

SECTION 5: Florida Sunshine Law

I. Purpose of Florida’s Government-in-the-Sunshine Law The purpose of Florida’s Government-in-the-Sunshine Law is to provide a right of access to governmental proceedings at both the state and local levels. It applies to any gathering of two or more members of the same board to discuss some matter which will foreseeably come before the board for action. There is also a constitutionally guaranteed right of access. Virtually all state and local collegial public bodies are covered by the open meetings requirements with the exception of the judiciary and the state Legislature which has its own constitutional provision relating to access.

II. Sunshine Law Refresher Commissioners are encouraged to receive annual refresher training of at least four (4) hours on subjects that pertain to applicable Sunshine Laws and/or Ethics.
