Subject: Conditional Acceptance of Nomination for Proposed Hawaii Scenic Byway:Maunalua-Makapu' u Scenic Byway

On behalf of the Hawaii Department of Transportation (HDOT) Highways Division, I am

pleased to inform you that your Hawaii Scenic Byway nomination application for the"Maunalua-Makapu'u Scenic Byway," submitted on April 30,2013, has been conditionallyapproved.

We appreciate all of the effort that went into your nomination application and were especiallyimpressed by your personal level of commitment. The byway itself is outstanding and we lookforward to it receiving official designation. However, HDOT and the Scenic Byways AdvisoryCommittee believe the following imporlant items must be addressed before full approval of this

nomination can be granted. These items are:

Scenic Byway sponsor: Sponsoring a byway is potentially outside the purview of aneighborhood board. Also, board members can change over time, resulting in a loss ofsupport for the project. Further, it is likely that a neighborhood board is not in a positionto procure future services that may be needed for the required Corridor ManagementPlan. It is therefore recommended that the sponsor be changed to a 501c3, with the Board

and/or select members continuing to play a critical role in both the eventual Local BywayCommittee and the future of the project. If good faith measures are taken to seek an

alternate sponsor and one is not found by the deadline indicated below, HDOT wouldrequire Department of the Corporation Counsel's clearance and approval of the

Neighborhood Board's authority to serve as a byway sponsor.

Maps identifying scenic byway and key attributes: Several of the required maps for the

nomination phase were not included in the application. Only two maps were included: a

map showing the beginning and end points of the byway and a map showing points ofinterest along the by way. An updated checklist must be resubmitted along with all the

other necessary maps.

Dear Ms. Velasco,

One of the Hawaii Kai Neighborhood Board's main endeavors is to have the stretch of KalanianaoleHighway from Hawaii Kai Drive to Makai Pier designated as a Hawaii Scenic Byway.

The HKNB has discussed this issue several times, including a public meeting on the topic as part ofour March 26 regular meeting, and prepared and submitted an application for nomination on April30. The application process is fairly extensive, requiring a route narrative, videos, and photos.

The Hawaii Scenic Byways program is part of the State Department of Transportation. Eachproposed byway requires a sponsor, which the program defines as:

The Scenic Byway Sponsor is the local governmental entity or non-governmental(non-profit) organization that prepares the application for byway designation.

The Scenic Byway Sponsor is the organizer, convener and facilitator of thedesignation process for a byway. It maintains the lead responsibility for preparingthe nomination for the scenic byway and, in subsequent steps, organizes andmaintains a Local Byway Committee for the byway, presents the application fordesignation as a Hawaii Scenic Byway to the State Scenic Byways AdvisoryCommittee and coordinates the development and implementation of the CorridorManagement Plan (CMP) for the byway.

The Scenic Byway Sponsor need not be an agency or organization having legalownership or jurisdiction over any portion of the byway. The primary qualificationfor a Scenic Byway Sponsor is the ability to organize and maintain a Local BywayCommittee that will prepare and formally submit the documents necessary fordesignation as a Hawaii Scenic Byway. Therefore, the local Scenic Byway Sponsormay be a local governmental entity or a non-profit organization. The long-termstability of the Scenic Byway Sponsor is an important consideration.

In response to the HKNB’s application, the State DOT has given us a “conditional acceptance.”

In a June 10 letter to me, DOT Director Glenn Okimoto wrote that one of the conditions that mustbe addressed related to the HKNB serving as sponsor. He wrote:

Sponsoring a byway is potentially outside the purview of a neighborhood board.Also, board members can change over time, resulting in a loss of support for theproject. Based on the definition of a byway sponsor and the caliber of the Hawaii Kai Neighborhood Board, I believe the HKNBis uniquely and eminently qualified to serve as a sponsor. The DOT's response relating to board member turnover andcommitment does not do justice to the stability and long-term advocacy that is a hallmark of the Hawaii Kai NeighborhoodBoard, nor to the 40-year-old Neighborhood Board system.

More than any other government entity or non-profit organization, the Hawaii Kai Neighborhood Board is in the bestposition to provide long-term leadership and support for this area project. It has become a legacy project and a sourceof community pride. With the HKNB as sponsor, the project belongs to the entire community, which would not be thecase with any other organization. The HKNB is in the best position to bring all stakeholders together and ensure theproject’s success.

For the HKNB’s June 25 meeting, I have placed items on the agenda that will demonstrate our commitment to thisproject, and, I hope, provide a way to partner with a non-profit if situations arise that are not within our jurisdiction:

7.1. Discussion/Action on Board’s sponsorship of Maunalua-Makapu‘u Scenic Byway:7.1.1. Status report on “conditional acceptance” of nomination.7.1.2. Reaffirmation of Board’s commitment to serve as project sponsor.7.1.3. Formation of a “Local Byway Committee” as a Board standing committee to develop a

“Corridor Management Plan.” Committee members will include representatives of bywaystakeholder organizations.

7.1.4. Authorization to seek Board partnership with a non-profit community organization forfinance-related aspects of byway sponsorship.

The State DOT says it will accept clearance by the Department of the Corporation Counsel to allow the board to serveas a byway sponsor.

Please initiate a request to Corporation Counsel on behalf of the Hawaii Kai Neighborhood Board so that we mightcontinue as the byway sponsor and direct this project to its successful completion. Thank you.

Dear Mr. Zevenbergen,

This is to verify that the Ka Iwi Coalition, which operates within the Livable Hawaii Kai Hui, hasagreed to serve as sponsor of the proposed Maunalua-Makapu'u Scenic Byway.

The Ka Iwi Coalition has a proud history of preserving and protecting the scenic features and qualityof life values of the Ka Iwi coastline and its surrounding communities. It is best known for the "SaveSandy Beach" initiative that harnessed community support and voter approval to prevent residentialdevelopment across from Sandy Beach in the late 1980s.

As its adoptive parent organization, the Livable Hawaii Kai Hui is a 501 (c) (3) non-profit communityorganization that embraces similar interests affecting Hawaii Kai and the greater East Oahu area. TheHui was recently honored by the Honolulu City Council for its nine years of community service.

Recognizing that the Maunalua-Makapu'u Scenic Byway nomination proposal was initiated andprepared by the Hawaii Kai Neighborhood Board, the Hui and Ka Iwi Coalition are pleased that theboard's lead individual on the project, Greg Knudsen, will continue to serve as the projectcoordinator under the Ka Iwi Coalitiods sponsorship. He is fully authorized to act on behalf of thesponsoring organization on allmatteSfrelating to the Maunalua-Makapu'u Scenic Byway.
