• BIM provides us with the ability to advance collaboration. Collaboration intensifies an individual’s allegiance to the project and you experience what others have termed “best for project decision making” as compared to best for designer, best for builder, best for owner etc. “Best for Project Decision Making” increases productivity.
• Small internal task force to study the benefits and challenges of implementing BIM at the University. We need to know what we wanted and how to get it in order to transition from reactive BIM to active BIM.

• How do you determine if team members can collaborate effectively ?o Would it be beneficial to add organizational and behavioral specialists to selection committees to evaluate interactions and relationships?
• How do you assess the technology capabilities of firms and teams ? o Would it be beneficial to add IT expertise to selection committees ?

• If a breach of the Standard of Care triggers liability and professional liability insurance coverage, how is this trigger impacted? • Who is insured by traditional professional liability policies? And who is not?• Are traditional policies which are based on a determination of “fault” in conflict with the collaborative process?
• Should we continue to rely on traditional insurance as our primary construction risk financing tool.

• Intellectual property rights are important to preserve the integrity of the design and to prevent inappropriate reuse of the design. Need to ensure that such rights do not get lost in the collaborative process.

RISK ALLOCATION
The challenge for the Project Owner is to develop a fairly balanced risk profile for all BIM participants so as to foster collaborative relationships. In order to properly and fairly assign risk, the Contract must at a minimum, address the following questions:
1. What is the purpose of the Model(s)? Visualization, Cost Estimating, Facility Operations, etc.
2. What Level of Development is necessary to accomplish those objectives? (3D, 4D, etc.)
3. When should key portions of the Model(s) be ready for use?
4. Who will be relying upon the Model(s)?
5. Should the Model(s) be considered a Contract Document?

6. Who will be responsible for Model Development & Coordination among the participants, Model Control (access, security, encryption) and Model Management (formatting, archiving, coordinate systems, e-signatures).
7. How (if at all), will design responsibility for the Model(s) be allocated among the various parties?
8. How (if at all) will the risk of interoperability be allocated among the parties? (Loss of data; software incapability)
9. Model Ownership: Who will own and/or maintain the Model after the project is complete?
