PACKAGE PICK UP AT THE CLIPPER CLUB

With an ever-increasing volume of shipped packages being delivered to the ClipperClub on a regular basis, what started out as a simple resident courtesy has become a time consuming endeavor for the Clipper Club staff. Please remember thefollowing guidelines when picking up your packages:

To take advantage of this amenity you must be a registered resident of Watergatewith a valid Watergate ID card. Delivery of packages addressed to unregistered residents will be declined or sent back through the shipping carrier.

Packages will be released only to the person they are addressed to unless a WCApackage pickup authorization form is completed and on file signed by the addressee.

Space is limited. Packages will be held for a maximum of 7 days. Unclaimed packages will be sent back via the shipping agent. If a resident has a vacation formon file, their package will be held until their scheduled return date.

All delivered packages must be sorted and logged before they are available for pick-up. For this reason, items that are delivered to the Clipper Club will not be availablefor pick up until after 6:00 p.m. on the day of delivery, or after 10:00 a.m. thereafter, regardless of tracking or shipping confirmation sent by the shipper.

The Association is not responsible for items that are lost or damaged duringshipping. Claims or complaints should be made to the shipping agent directly.

EALTH CLUB RULE REMINDERS

A valid Watergate ID card must be left with the attendantbefore entering the Health Club. Residents with expiredor invalid ID cards will not be permitted to use the gym until they have renewed their registration in the WCAO ffice. All guests must be accompanied by a resident. There isa limit of two guests per visit. Appropriate clothing, including a shirt and shoes or other foot covering is required at all times.

Strict adherence to all posted safety regulations ismandatory. All posted rules must be observed. All equipment must be returned to its proper place.

Children under 14 years of age are permitted to enter theweight-training area provided they are accompanied and supervised by an adult. Children under 14 years of ageare prohibited from using free weights or other weight-training equipment in the gym. Children under the age of10 are prohibited from using the sauna and steam rooms.

Oils, eucalyptus leaves, etc., are not permitted in the sauna or steam room.

Use of the Health Club is at your own risk. No supervision is provided. WCA expressly disclaims liability for any injury or damage caused by negligence, misuseof, or lack of appropriate supervision regarding the use ofthe common areas or recreational facilities.

RED PHONES: If you need assistance or would like to report a safety or maintenance issue while using the Anchoror Clipper Club facilities there are three “red phones” available to direct connect you to the Clipper Club desk. The recreation attendant on duty will address your concerns, dispatch security, or notify maintenance accordingly. The phones are located in the Clipper Club gym and in the pool areas of the Anchor and Clipper Clubs. Additionally,there is a separate “red phone” in the Clipper Club pool area that is a direct connect to 9-1-1 in the event of an emergency.

PHONE AND INTERNET SCAM ALERT

All residents are urged to be aware of all phone and/orinternet (email/social media site) requests for money,especially when asked to send money via a wire transferservice. In fraud cases, the suspect will often give specificinstructions as to the location where you should send themoney from. These are red flags and should beinvestigated before money is sent.

There are countless scams floating around, such as thecall from a grandchild in need, being advised you just wonthe lottery or a sweepstakes and need ONLY to pay thetaxes. Then there are the ever prevalent “Nigerian scams”(also known as “419” scams), which are a type of advancefee fraud and one of the most common types of confidence frauds. Basically, you are asked to put money up front as ashow of good faith, with the promise of receiving an evengreater amount. If you receive a call and are asked topurchase a prepaid gift card or debit card and then askedto provide the number over the phone, this is most likely ascam.

There are also those requests for your personalinformation from individuals posing as the IRS, or as yourbank or your credit card company. You should not provideany personal identifying information to a company ororganization over the phone.

Seniors have a tendency to fall victim to these scamsbecause their hearts strings are pulled by these predators.They may provide the names of friends or family members,leading the victim to believe the call is a legitimate requestfor money.

PLEASE pass this information along to family members,friends and neighbors. Particularly, those who may nothave internet access and may not be aware of this growingtrend.

The sad and unfortunate truth about these schemes is thatonce the money is sent it is almost impossible to recovert he loss.

If you receive a request for money, you should take thetime to verify the information with a trusted friend or familymember before sending money. Here are a few warningsigns that you may be getting looped into one of theseschemes.

• If the caller is warning you to act now or you will miss outon an opportunity.

• You are being asked to pay up-front fees or taxes for agift or a prize.

• If the caller assures you there is NO need to verify theinformation with anyone.

As a general rule:

• Do not send money to someone you do not know.

• Do not give out personal information (social securitynumber, date of birth etc.) over the phone.

• Be leery of all requests or transactions where you areasked to send money via a wire transfer service.

“DRAFT” WCA BOARD OF DIRECTORS MEETING MINUTES

March 18, 2013

I. Call to Order. President Robert C. Blain called the meeting to order at 7:06 p.m. Directors present were Ron Dempster, Doug Flock, Tom Knight, Lubor Mrazek and Neil Straus. Albert Repola was absent Also present were General Manager Tim Sutherland, Controller Lisa Trabert, Assistant General Manager Jeff Kiel, Construction Manager Gus Ferriols and six residents.

II. Reports/Announcements. Secretary’s Report. Secretary Straus reported on action taken by the Board of Directors since the

February 25, 2013 Regular Session:

The Board of Directors voted to authorize a Notice of Default and Election to Sell for APN 049-1529-350.

The Board of Directors and Finance Committee reviewed the corporate operating budget proposal for 2013/2014

Treasurer’s Report. President Blain reported a favorable operating budget variance of $221,537 through 2/28/2013. Blain also reported an operating fund balance of $346,936, and a replacement fund balance of $6,824,523. The full report is available at the WCA office and watergatehoa.com

Manager’s Report. General Manager Sutherland provided an assessment analysis of other similar style condominium complexes in Northern California.

III. Statements and Requests. An owner requested that the renovations project work be accelerated, and also

asked that the old sofa in her lobby be removed and park benches used for seating as an interim measure. Another owner requested that a basketball net be installed in one of the racquet ball courts.

IV. Consent Calendar.

Approved by Unanimous General Consent:

February 25, 2013 Regular Session Minutes General, Auto (Allied) and Umbrella Liability (Great American) --

$61,873/$2171.80/$23,960 in premiums for $2M/$1M/$25M in coverage. Master Commercial Property (CIBA) - Premium of $277,175 for $198,483,222 in coverage.

V. New Business.

Board Resolution to Record One Notice of Delinquent Assessment. Secretary Straus read the following resolution:

“Resolved, the Board of Directors (“Board”) for Watergate Community Association authorizes and instructs Allied Trustee Services to Record One Notice of Delinquent Assessment (“Lien”) in the full amount of unpaid assessments, late charges, interest and collection fees and costs against the property bearing Assessor’s Parcel Number 049-1529-179 as authorized by Civil Code Sections 1367.1 and 1367.4 if such account has not been reinstated by the Notice of Intent to Lien expiration date.” Straus moved, and Knight seconded, to approve the aforementioned Notice of Delinquent Assessment. The motion to approve was unanimous.

Landscape Department Computer and Landscape Design Software. Straus moved, and Knight

seconded, to authorize $3,467.04 for a computer and software package for the landscape department. The motion to approve was unanimous.

Lobby Mirror Deposit. The Board received the final lobby fractured glass mirror drawings from Huntsman, and a request for a production deposit for the new fractured glass lobby mirrors designed by Huntsman AG. Straus, Flock, Dempster, Knight voted for the production deposit for the mirrors with Mrazek abstaining. The motion was approved.

VI. WCA Committees.

Architectural Control. Chair Elizabeth Alteiri presented the following committee recommendation:

2 Admiral Drive, B287: One Bedroom. The owner wishes to replace their bathtub with a tiled

walk in shower, and replace the bathroom fan and kitchen stove hood fan. Straus moved, and Knight seconded, to approve the modifications to unit B287 pending receipt of all required building permits. The motion to approve was unanimous.

The Architectural Control Committee is looking for additional members.

Landscape. Chair Sam Foushee explained that the committee is working on a long-term vision for the future of the existing mature landscaping, and will continue working with Robert Murphy on planning and scoping of all existing landscaping for improvements.

The Landscape Committee recommends removing tree # 84 near the D building pool. This tree has

sunk well below grade due to drainage and ground soil settlement. Straus moved, and Knight seconded, to agree to the first reading for removal of pine tree #84. The motion for a first reading to remove was unanimous.

SMOKING POLICY AT WATERGATE

There is a no smoking rule at Watergate in thecommon areas only. Additionally, the City ofEmeryville has a no smoking ordinance in all publicplaces. This leaves one's unit and balcony as the onlyplace it is permissible to smoke.

A person smoking inside their unit or on their unit’sbalcony is not in violation of the rules. However,insofar as the EPA has officially declared second handsmoke as a toxic substance, our nuisance rules applyto second hand smoke that is creating a health hazardor affecting the "quiet enjoyment" of another resident.

In order to take action we must have a writtencomplaint and the identification or unit number of theoffending smoker. A security report verifying the date,time and location is sufficient. Written notice will thenbe sent to the resident (and the unit owner in the caseof a tenant) making them aware of the complaint andrequesting they modify their behavior. Although wedon’t have the power or the authority to make anyonedo or not do anything, we hope this will provide themwith a modicum of motivation to comply with the rules.Failure to do so may result in an invitation to appearbefore the Board of Directors, with non-complianceresulting in a fine to the unit owner.

FIRE SPRINKLER INSTALLATION AND INTERIOR RENOVATION UPDATE

Fire sprinkler installation and related constructioncontinues in more than half the buildings atWatergate. E Building and C Building are nearcompletion, waiting only for the Fire Marshal’sinspection. A Building and D Building are actively inthe midst of sprinkler head installation and preliminarytesting. Minor demolition and abatement has begunin the B Building, and we are steadily working our waytoward continuing the process in the F Building.

Coordinating access for drilling and installation inevery unit is a huge task. Gus and his team, havemade it look almost easy. We appreciate thecooperation we’ve had from residents that contributeto the success of this project.

The construction team is now processing bids andplans for the interior renovation phase of the project.We’re all looking forward to beginning the cosmeticupgrades of Watergate’s common areas! Oncecontractors have been selected by the Board work willbegin, first in the lobbies, then through the corridors.A tentative project schedule has been posted on ourwebsite (WatergateHOA.com under the Renovations– Main tab) as a convenient reference.

SHOULD YOU BUY / LEASE AN ELECTRIC OR PLUG-IN HYBRID VEHICLE? - PART 2

I have driven my RAV4-EV (all electric) for only a few weeks but many folks have stopped and asked about thecar; they are curious about three things: range, cost, and performance. So let’s look at each concern:

Range: One of the problems facing the EV industry is the limited range of the cars and the concern about chargingstations. Progress has been made in both of these areas.Both the Nissan Leaf EV and my RAV4EV can go up to 100 miles on a single charge. The Chevy plug-in Volt can go 40 miles in electric only mode and then another 350miles in hybrid gas mode.

This is more than enough range to find a charging stationas more and more of them are built. I have used chargers in a parking lot, a hotel and a shopping mall. And more arecoming at malls, public parking areas and the interstate.

Cost: Yes, they are more expensive than similar gas only models but this is only before you factor in dealer and government incentives. Dealers are offering zero percentfinancing and rebates. I also will qualify for a Federal taxcredit and a nice check from the State of California. Finally,if you buy an all-electric car, you get those great white HOV stickers to zoom through the car pool lanes anytime! (Needless to say, this saves many dollars over the courseof a year.) The cost of charging is substantially less than filling up with $4/gallon gas.

Performance: I can sum it up in one word - Torque. I won’t bore you with the physics (ask Board member Neil Straus.) Electric motors give electric cars instant torque, creating strong and smooth acceleration. This has been myexperience with my RAV4EV. No more delay like many gas cars and wasted energy. Just a smooth take- off and a safe landing.

WCA RULES AND ENFORCEMENT The WCA Office receives a myriad of complaints fromresidents on a regular basis. We do our best to respond to these complaints with varying degrees of success. Inspite of our efforts, there are situations that are not resolved to the complainant’s satisfaction. A commonrefrain then becomes, “I called the Office and they didn’tdo anything about it”. It’s very rare that no action is taken by the WCA Officestaff on any issue that is brought to our attention. For many residents, community living is a new way of life.Each owner's use of his/her own unit as well as outsidefacilities must not conflict with the rights of other owners.Therefore, certain standards for individual behavior arenecessary to insure pleasant and harmoniouscommunity living. The Association rules are not ourrules, they are your rules, written by owners andapproved by your elected Board of Directors. Our job, at the instruction of the Board, is to enforce the rules. We do this as fairly and consistently as possible. Please don’t assume a lack of resolution constitutes alack of effort on our part. Our ability to enforce the rules and our effectiveness in resolving conflict are reliant onthe participation and cooperation of the residentsinvolved. We can (and do) remind, notify, fine, and/or
