Sub: Revision of Pension from V PC to VI PC:Cases of certain Pre-2006 RailwayPensioners, retired from specific posts.

Ref: DOP&PW OMs dated: 28.01.2013,05.03.2015 & 30.07.2015.

DOP&PW, the Nodal Ministry on Pension matters,has laid down two policy directives for the purposeof stepping up of pension from VPC to VI PC:-

1. Para 2 of OM 28.1.2013 :” .. would befurther stepped up to …. corresponding to the pre-

revised scale from which the pensioner retired,as arrived at w.r.t. the Fitment Table issued byMOF(DOE) for pay fixation of serving

employees. “( emphasis added) (“Pre-Revisedscale” means “Pre-Revised scale of pay applicableto the Post” as per Annexure C of RBE 108/2008)

2. MODIFIED PARITY IN PENSION: V PCReport : Para 77 & VI PC Report Para 5.1.47 “ ..a modified parity-formula has been evolved for preand post 1.1.1996 pensioners. The overall formulaassures a min. pension of 50% of the min. pay ofthe post held at the time of retirement, asrevised from time to time.” This Modified Parityformula is endorsed by VI PC also, and acceptedby GOI, vide DOP&PW Resolution dt. 29 Aug 2008.( S.No. 12) ( Emphasis added)

Some, not all, Zonal Railways are adoptingPB 2 for pay fixation of serving employees andPB1 for stepping up of pension of certain pre 2006retirees, resulting in denial of entitled min. pensionRs. 6750 w.e.f. 1.1.2006. This is due to erroneousinterpretation and implementation of DOP&PWinstructions, by applying the Concordance Tableto all pre-2006 Pensioners across the board thoughthis table is applicable to only those retired fromPOSTS CARRYING IV, V, VI PC PAY SCALESmentioned in the table. Modified Parity standdiscontinued in VI PC, in spite of DOP&PW specificinstructions to continue Modified Parity in VI PCalso.

Bharat Pensioners Samaj request FinancialCommissioner, the decision making authority at

the helm now, that necessary instructions maykindly be caused to be issued to all concerned toadopt the Fitment Table of serving employees forRevision of pension also, thereby complying withthe Nodal Ministry extant instructions, which willalso ensure Modified Parity in pension in VI PC.This will also result in correct delivery of justice tothese affected octogenarian pensioners at yourhands, after a long struggle.

cont’d from p-2not find any justification to condone the said delay.That apart, we have carefully perused the petitionsfor review, the order impugned and the papersannexed in support thereof. We do not find anyground therein warranting review of theaforementioned order.

The review petitions are, accordingly,dismissed on the ground of delay as well on merits.

b) ORDERS OF SUPREME COURT DATED

1-9-2016 IN CIVIL APPEAL NO. 6371 OF 2010

Civil Appeal No. 6048/2010

Having heard learned counsel for theappellants, and having perused the record ofthe case, we find no justification whatsoeverto interfere with the impugned order, directingrestoration of 2/3rd pension in respect of therespondent herein, after the expiry of the requisiteperiod of commutation. The instant appeal isaccordingly dismissed.”

2. a)100% Pension of all Central GovernmentPensioners is restored after 15 years – (whether

they got one-third of their Pension Commuted or

40% as applicable thereof) and they continue toget balance two-third or 60% (as applicable) oftheir Pension after their retirement till the fullcommuted portion of pension is restored tothem after 15 years. But PSU absorbees whogot the 100% Commutation done got nopension after their retirement till one-third wasrestored vide DOP&PW orders dated 30-9-1996cited above and they continued to be deprivedof the restoration of the balance two-third of

their Pension after 15 years of the commutation,with the result that, unlike other Central

Government Pensioners who receive fullPension after 15 years of retirement, PSUabsorbees receive only one-third of pension

after 15 years of retirement.

3. This is discriminatory and in violation of lawof natural justice as well violation of Articles 14, 16and 39 of the Constitution of India.

4. It is to remove this discrimination that theHon’ble Supreme Court has restored the balancetwo-third of the Commuted portion of pension after15 years from the date of commutation in respectof the Government servants who had drawn lump-

sum amount on their absorption in a Public SectorUndertaking / Autonomous Body.

5. Rationale for this restoration was that thelump-sum settlement given to this group ofpensioners was tantamount to commutation aspermissible as per Secn.10 of the Pension Act.

1. It is, therefore, once again requested that:

i) Two-third commuted portion of pension after15 years from the date of commutation may pleasebe restored in case of all Government servants whohad drawn lump-sum amount on their absorptionin a Public Sector Undertaking / Autonomous Body.

ii) Further delay and litigation on this issue mayplease be avoided - compelling other similarlyplaced elderly pensioners to approach the Courtsof law.

Sub: Continuation of Medical facilities underRELHS and Complimentary Passfacilities for Unmarried/Widowed/Divorced daughters and Handicappedchildren of deceased Pensioners eligiblefor Life Time Family Pension.

With due respect, I would like to draw your kindattention to the following matters for favour of yourimmediate action please.

1. That Sir, as per extant rules, the Un-married/Widowed/Divorced daughters and Handicappedchildren of deceased Pensioners are entitled to getLife Time Family Pension, after the death of theirboth the parents.

2.That Sir, they are also entitled to avail Medicalfacilities and PRC Passes along with their parentswhen any one of them is alive.

3. But after the death of both of the parents,they are debarred from availing both of the abovefacilities i.e. Medical as well as Passes.

4. That Sir, as regards Medical facilities underRELHS, they are allowed to avail the same as andwhen, family pension is sanctioned in their favour,

when they are treated as a common pensionerafresh, and they are required to deposit an amount,double of their last basic pension, to the utterdisregard of the fact that an amount equivalent tolast emoluments was deducted from the settlementdues of the Ex. Employee for RELHS of self andfamily members which included his eligible childrenalso.

In fact, names of the above children arementioned in the family Medical Identity card ofthe ex. employee to avail medical facility.

5. That Sir, as regards facilities of PRC Passes,names of the above children are included in the familyidentity card as dependent of the ex-employee of his/her spouse and after the death of both the parents,their entitlement is discontinued. This is most inhumanand an inhumane act done to the said children ofEx-Railway Employees. Under the circumstances, Iwould request you to kindly accord your decision asbelow :-

(i) Entitlement for availing Medical facilitiesshould be continued even after the death of theirparents without any extra payment for the same.

(ii) The above children should also besanctioned one set of Complimentary Pass peryear, till they receive Life Time Family Pension.

Secretary (Postal and Ors) /BPS-MChandramowli at the invitation of S N Singh, Secy-  All India P & T AND Other Central  GovtPensioner’s Assn, Gaya visited Gaya on April 16th2017, to attend and address the 13th BiennialConference of  A I P&T AND OTHER  CGPensioner’s Assn. In his address, he dwelt uponthe recommendations of 7th CPC relating torevision of pensions; GOI not implementing option1; opening of more CGHS Wellness Centres forbetter medicare; extending CGHS facilities topensioners residing outside CGHS areas ; postalpensioners to be extended the facility of CGHSirrespective of the fact whether during service hewas a beneficiary of CGHS or not and alsoresiding in CGHS applicable areas or not; mergerof all postal dispensaries with CGHS asrecommended by 7th CPC etc.

National Health Policy, 2017approved by Cabinet.

Focus on Preventive and PromotiveHealth Care and Universal access to goodquality health care services

The Union Cabinet chaired by the PrimeMinister Shri Narendra Modi in its meeting on15.3.2017, has approved the National HealthPolicy, 2017 (NHP, 2017). The Policy seeksto reach everyone in a comprehensiveintegrated way to move towards wellness. Itaims at achieving universal health coverageand delivering quality health care services toall at affordable cost. This Policy looks atproblems and solutions holistically with privatesector as strategic partners. It seeks topromote quality of care, focus is on emergingdiseases and investment in promotive andpreventive healthcare. The policy is patientcentric and quality driven. It addresses healthsecurity and make in India for drugs anddevices.

The main objective of the National HealthPolicy 2017 is to achieve the highest possiblelevel of good health and well-being, through apreventive and promotive health careorientation in all developmental policies, andto achieve universal access to good qualityhealth care services without anyone havingto face financial hardship as a consequence.In order to provide access and financialprotection at secondary and tertiary carelevels, the policy proposes free drugs, freediagnostics and free emergency care servicesin all public hospitals. The policy envisagesstrategic purchase of secondary and tertiarycare services as a short term measure tosupplement and fill critical gaps in the healthsystem. The Policy recommends prioritizingthe role of the Government in shaping healthsystems in all its dimensions. The roadmapof this new policy is predicated on publicspending and provisioning of a publichealthcare system that is comprehensive,

integrated and accessible to all. The NHP,2017 advocates a positive and proactiveengagement with the private sector for criticalgap filling towards achieving national goals. Itenvisages private sector collaboration forstrategic purchasing, capacity building, skilldevelopment programmes, awarenessgeneration, developing sustainable networksfor community to strengthen mental healthservices, and disaster management. Thepolicy also advocates financial and non-incentives for encouraging the private sectorparticipation.

The policy proposes raising public healthexpenditure to 2.5% of the GDP in a timebound manner. Policy envisages providinglarger package of assured comprehensiveprimary health care through the Health andWellness Centers. This policy denotesimportant change from very selective tocomprehensive primary health care packagewhich includes geriatric health care, palliativecare and rehabilitative care services. Thepolicy advocates allocating major proportion(upto two-thirds or more) of resources toprimary care followed by secondary andtertiary care. The policy aspires to provide atthe district level most of the secondary carewhich is currently provided at a medical collegehospital.The policy assigns specificquantitative targets aimed at reduction ofdisease prevalence/incidence, for healthstatus and programme impact, health systemperformance and system strengthening. Itseeks to strengthen the health, surveillancesystem and establish registries for diseasesof public health importance, by 2020. It alsoseeks to align other policies for medicaldevices and equipment with public healthgoals.

The primary aim of the National HealthPolicy, 2017, is to inform, clarify, strengthenand prioritize the role of the Government inshaping health systems in all its dimensions-investment in health, organization and

financing of healthcare services, prevention ofdiseases and promotion of good healththrough cross sectoral action, access totechnologies, developing human resources,encouraging medical pluralism, building theknowledge base required for better health,financial protection strategies and regulationand progressive assurance for health. Thepolicy emphasizes reorienting andstrengthening the Public Health Institutionsacross the country, so as to provide universalaccess to free drugs, diagnostics and otheressential healthcare. The broad principles ofthe policy is centered on Professionalism,Integrity and Ethics, Equity, Affordability,Universality, Patient Centered & Quality ofCare, Accountability and pluralism. It seeks toensure improved access and affordability ofquality secondary and tertiary care servicesthrough a combination of public hospitals andstrategic purchasing in healthcare deficit areasfrom accredited non-­governmental healthcareproviders, achieve significant reduction in outof pocket expenditure due to healthcare costs,reinforce trust in public healthcare system andinfluence operation and growth of privatehealthcare industry as well as medicaltechnologies in alignment with public healthgoals. The policy affirms commitment to pre-emptive care (aimed at pre-empting theoccurrence of diseases) to achieve optimumlevels of child and adolescent health. Thepolicy envisages school health programmesas a major focus area as also health andhygiene being made a part of the schoolcurriculum. In order to leverage the pluralistichealth care legacy, the policy recommendsmainstreaming the different health systems.Towards mainstreaming the potential ofAYUSH the policy envisages better access toAYUSH remedies through co-location in publicfacilities. Yoga would also be introduced muchmore widely in school and work places as partof promotion of good health.

The policy supports voluntary service in

rural and under-served areas on pro-bonobasis by recognized healthcare professionalsunder a 'giving back to society’ initiative. Thepolicy advocates extensive deployment ofdigital tools for improving the efficiency andoutcome of the healthcare system andproposes establishment of National DigitalHealth Authority (NDHA) to regulate, developand deploy digital health across the continuumof care. The policy advocates a progressivelyincremental assurance based approach.

Background:

The National Health Policy, 2017 adoptedan elaborate procedure for its formulationinvolving stakeholder consultations.Accordingly, the Government of Indiaformulated the Draft National Health Policy andplaced it in public domain on 30th December,2014. Thereafter following detailedconsultations with the stakeholders and StateGovernments, based on the suggestionsreceived, the Draft National Health Policy wasfurther fine-tuned. It received the endorsementof the Central Council for Health & FamilyWelfare, the apex policy making body, in itsTwelfth Conference held on 27th February,2016. The last health policy was formulated in2002.The socio economic and epidemiologicalchanges since then necessitated theformulation of a New National Health Policy toaddress the current and emerging challenges.

Cabinet approves modifications in the 7th

CPC recommendations on pay andpensionary benefits

The Union Cabinet chaired by the PrimeMinister Shri Narendra Modi approved importantproposals relating to modifications in the 7th CPC(Central Pay Commission) recommendations onpay and pensionary benefits in the course of theirimplementation. Earlier, in June, 2016, the Cabinethad approved implementation of the

recommendations with an additional financial outgoof Rs 84,933 crore for 2016-17 (including arrearsfor 2 months of 2015-16).

The benefit of the proposed modifications willbe available with effect from 1st January, 2016,i.e., the date of implementation of 7th CPCrecommendations. With the increase approved bythe Cabinet, the annual pension bill alone of theCentral Government is likely to be Rs.1,76,071crore. Some of the important decisions of theCabinet are mentioned below:

1. Revision of pension of pre – 2016pensioners and family pensioners : The Cabinetapproved modifications in the recommendationsof the 7th CPC relating to the method of revision ofpension of pre-2016 pensioners and familypensioners based on suggestions made by theCommittee chaired by Secretary (Pensions)constituted with the approval of the Cabinet. Themodified formulation of pension revision approvedby the Cabinet will entail an additional benefit tothe pensioners and an additional expenditure ofapproximately Rs.5031 crore for 2016-17 over andabove the expenditure already incurred in revisionof pension as per the second formulation basedon fitment factor. It will benefit over 55 lakh pre-2016 civil and defence pensioners and familypensioners.

While approving the implementation of the 7thCPC recommendations on 29th June, 2016, theCabinet had approved the changed method ofpension revision recommended by the 7th CPCfor pre-2016 pensioners, comprising of twoalternative formulations, subject to the feasibilityof the first formulation which was to be examinedby the Committee. In terms of the Cabinet decision,pensions of pre-2016 pensioners were revised asper the second formulation multiplying existingpension by a fitment factor of 2.57, though thepensioners were to be given the option of choosingthe more beneficial of the two formulations as perthe 7th CPC recommendations. In order to providethe more beneficial option to the pensioners,Cabinet has accepted the recommendations of theCommittee, which has suggested revision ofpension based on information contained in thePension Payment Order (PPO) issued to everypensioner. The revised procedure of fixation ofnotional pay is more scientific, rational and

implementable in all the cases. The Committeereached its findings based on an analysis ofhundreds of live pension cases. The modifiedformulation will be beneficial to more pensionersthan the first formulation recommended by the 7thCPC, which was not found to be feasible toimplement on account of non-availability of recordsin a large number of cases and was also found tobe prone to several anomalies.

2. Disability Pension for Defence Pensioners :The Cabinet also approved the retention ofpercentage-based regime of disability pensionimplemented post 6th CPC, which the 7th CPC hadrecommended to be replaced by a slab-basedsystem. The issue of disability pension was referredto the National Anomaly Committee by the Ministryof Defence on account of the representationreceived from the Defence Forces to retain theslab-based system, as it would have resulted inreduction in the amount of disability pension forexisting pensioners and a reduction in the amountof disability pension for future retirees whencompared to percentage-based disability pension.

The decision which will benefit existing andfuture Defence pensioners would entail anadditional expenditure of approximately Rs. 130crore per annum.

ORDER

Annexure A 26 order to the extent it denies orrestricts the benefits of treating the period from thedate of compulsory retirement to the date ofapplicant's retirement from service is underchallenge in this case. The applicant seeks to setaside that part of the order which according to theapplicant is against Annexure A17 order. Theapplicant also seeks to set aside the order torecover/adjust an amount of Rs. 1,59,393/- towardscommutation of pension wrongly determined asrecoverable from the DCRG and for a furtherdirection to refund the commuted value ofRs.1,28,151/- which was stated to have beenillegally recovered or adjusted from the DCRG ofthe applicant. Further the applicant seeks adirection to be issued to the respondents to grantannual increments accrued to the applicant duringthe period of his compulsory retirement and thedate of his reinstatement and to refix the last paydrawn as on the date of superannuation and forother consequential benefits.

2. Here is the gist of the case pleaded by theapplicant. The applicant entered the service asTime Scale Clerk on 7.9.1979. That post wassubsequently re-designated as Postal Assistant.He was promoted to the cadre of Inspector PostOffices on 6.11.1989 and again to the cadre of

Assistant Supdt. of Post Offices on 4.1.1995. Adisciplinary action was initiated against theapplicant alleging that while functioning as the Asst.Supdt. Of Post Offices (ASP) Ernakulam PostalDivision on 7.2.1997 he selected one KEPushkaran who had secured only 265 marks inthe SSLC ignoring another candidate Mr. MK Balanwho had secured 276 marks. Similarly he had alsoon 31.3.1997 while functioning as ASP selectedone MA Jessy who had secured only 264 markswhile NK Bhadran had secured 267 marks in theSSLC examination was ignored. The selection waspurely based on the marks obtained in the SSLC.After conducting the inquiry, he was ordered to becompulsorily retired from service vide AnnexureA1 order. That was challenged in Appeal. AnnexureA1 order was confirmed in appeal by Annexure A2.The revision filed against the same was rejectedvide Annexure A3. Challenging the same he filedOriginal Application before this Tribunal as OA 789/2003 which was dismissed by this Tribunal as perorder dated 13.3.2006. That was challenged by theapplicant by filing WP No. 35435/2007. It is statedthat the Hon'ble High Court disposed of the saidWrit Petition by judgment dated 16.1.2009 settingaside the order passed by the Tribunal on13.3.2006. That order has not been produced bythe applicant. Similarly the subsequent judgmentof the Hon'ble High Court dated 16.1.2009 has alsonot been produced. However, it is stated that theorder passed by the Tribunal on 13.3.2006 wasset aside and the matter was remanded back tothe Tribunal consequent whereto an order waspassed by the Tribunal afresh. That order isAnnexure A4. By Annexure A4 dated 28.7.2009,the Tribunal directed the appellate authority toreconsider the case of the applicant in the light ofthe discussion made therein. It was in that case(Annexure A4) the Tribunal held that since it wasan omission on the part of the applicant, it shouldbe treated as one of negligence simplicitor. Thenthe question was whether the penalty imposed iscommensurate with the gravity of misconduct.Since the Tribunal was not competent to substituteany punishment, the matter was remanded to theappellate authority to consider that lone aspectwhether the applicant deserves any other penaltyother than termination from service. That waschallenged before the Hon'ble High Court in WP

No. 23275/2010. Annexure A7 is the judgmentdated 1.11.2010 passed by the Hon'ble High Courtin that case. The Hon'ble High court held that thedepartment should consider a lesser punishmentto the respondent (applicant herein) as suggestedby the Tribunal. It was made clear that no furtherinquiry is required and based on the inquiry reportwhich has become final by virtue of Tribunal's orderconfirmed by the Hon'ble High Court and inaccordance with the rules and norms followed bythe department, punishment will be considered. Inpurported implementation of Annexure A7judgment the applicant was served with AnnexureA8 Memo dated 13.12.2010 informing him that theappellate authority proposed to award apunishment of reduction to a lower grade to whichA11 representation dated 7.12.2010 was submittedby the applicant requesting to impose a minorpenalty with the least possible loss considering hisloss and suffering on account of major penalty ofcompulsory retirement imposed on him. AnnexureA12 is the consequent order passed by therespondents on 23.12.2010 as per which it wasordered that the applicant be reinstated in servicewith immediate effect reverting to the cadre ofPostal Assistant carrying pay scale of Rs. 5200-20200 with Grade Pay of Rs. 2400/- at the stageof Rs. 5200/- for a period of two years withcumulative effect. It was further held that the periodspent by the applicant in between date ofcompulsory retirement and reinstatement will notbe eligible for any amount for the period he hasnot worked for which he has received pensionduring those period as by the High Court. AnnexureA12 is the consequential order dated 23.12.2010issued by the respondents whereby the applicantwas reinstated in service with immediate effect andreverted the applicant to the cadre of PostalAssistant and posted him as Postal Assistant,Ernakulam HO in the pay scale Rs. 5200-20200with Grade Pay Rs. 2400/- at the stage of Rs. 5200/- for a period of two years with cumulative effect. Itwas further ordered that the period spent inbetween the date of compulsory retirement andreinstatement will not be eligible for any amountfor the period he has not worked since he hadreceived pension during those period as orderedby the Hon'ble High Court of Kerala. The applicantthen filed a Contempt Petition before the Hon'ble

High Court contending that Annexure A12 Memodated 23.12.2010 issued by the respondentsreverting the applicant to the post of PostalAssistant which is two ranks below in hierarchy andfour grades below the post of ASP which theapplicant was holding. That Contempt Petition No.73/2011 was dismissed leaving open to theapplicant to take appropriate steps to challengeAnnexure A12 order before the appropriate forum.It was directed by the Hon'ble High Court byAnnexure A14 judgment that what is the distinctionbetween a lesser punishment and a harshpunishment is to be decided on consideration ofvarious factors including the economic effect of thepunishment and if such a consideration is requiredit cannot be said that the respondents are guilty ofcontempt of courts in passing such an order.TheContempt Petition was dismissed but it was leftopen to the applicant to take appropriate steps forchallenging the proceedings before appropriateforum.

3. Since the contempt petition was dismissed,the applicant was given liberty to challenge theimpugned orders, he filed OA 83/2011 challengingAnnexures A12 and A13 orders. Annexure A17 isthe order dated 7.3.2012 passed by the Tribunalwhich directed the respondents to reinstate theapplicant as Assistant Superintendent of PostOffices within sixty days from the date of that orderbut it was stated that as directed by the Hon'bleHigh Court no back wages are to be paid. It isfurther ordered that as the applicant is to retire on31.10.2012 the retirement benefits already paid, ifany, should not be recovered but be adjustedagainst the payment on his retirement onsuperannuation. Annexure A19 representationdated 19.7.2012 was then given by the applicantrequesting regularization of the period ofcompulsory retirement and to fix his pay onreinstatement. He later retired on superannuationon 31.10.2012.

4. The applicant was thereafter served withAnnexure A25 memo dated 28.3.2013 proposingto treat the period between the date of compulsoryretirement (15.2.2001) and the date of hisreinstatement on (20.6.2012) as non-duty whichwill not count for any purpose and also proposedto restrict the pay and allowances for the aboveperiod to the pension already drawn and paid to

the applicant, explaining the position that his periodof compulsory retirement should be treated as non-duty for all purposes in accordance with FR54(A)(1). On 28.5.2013 the first respondent issuedAnnexure A26 Memo dated 28.5.2013 claimingincrements to the applicant during the period ofcompulsory retirement as duty solely for pensionpurpose. The applicant was sanctioned withprovisional pension as per Annexure A27 Memodated 17.5.2013.Thereafter the applicant wasserved with Annexure A28 Pension PaymentOrder, Commuted Value of Pension (CVP)authority and intimation of gratuity as per PPOforwarding entries dated 12.9.2003. ThereafterAnnexure A29 representation dated 18.11.2013was submitted by the applicant to the 2ndrespondent requesting not to recover or adjust thecommuted value of Rs. 1,59,393/- from the CVP.Annexure A30 letter was sent by the 2ndrespondent to the Senior Supdt. of Post Offices,Trichur for providing calculation of amount ofrecovery, commuted value etc. In reply to AnnexureA30 letter the Supdt. of Post Offices, TrichurDivision forwarded the details of excess commutedvalue recovered from the applicant vide AnnexureA31 letter dated 25.3.2014. It is stated therein thatRs. 1,28,151/- was recovered from the applicantin excess. It is stated that even after the lapse ofmore than seven months the excess amountrecovered from the applicant was not refunded tohim. Inaction on the part of the respondents torefund the excess amount is arbitrary and illegal.As on the date of compulsory retirement on15.2.2001 the applicant has received Rs.7700/-.On reinstatement the applicant is legally entitledto receive the due from 1.1.2002 onwards and assuch the applicant is entitled to get his pay fixed atRs. 21420/- as on 1.7.2006 and on the date ofretirement the applicant was entitled to get Rs.25620/-. Hence the basic pension of the applicantwould be Rs. 12810/-. Annexure A32 is the tabularstatement prepared by the applicant showing thedetails as aforesaid but the applicant was grantedonly Rs. 14330/- as against Rs. 25620/- onreinstatement as evidenced by the pay fixationstatement dated 25.7.2012 vide Annexure A33.Thus the applicant was granted the basic pensionof Rs. 9465/- as against Rs. 12810/-. Consequentlythe retirement benefits of the applicant was

calculated on a reduced rate. The applicant wasdenied his legitimate due towards retirementbenefits. Thus the applicant has approached thisTribunal seeking the relief as aforesaid.

The application is stoutly resisted by therespondents contending as follows: As per theorder passed in OA 83/2011 the applicant wasreinstated in service as Post Master, Thrissur HO.The applicant joined back in service on 19.6.2012as Post Master, Thrissur Head Post Office and onrejoining, his pay was fixed at the pre-revised payof Rs. 7700/- and corresponding pay in the PayBand Rs. 9300-34800 plus Grade Pay Rs.4600/-at Rs. 18930/-. Later the applicant retired fromservice on superannuation on 31.10.2012. Hisprovisional pension at the rate of Rs..9465/-wassanctioned to him vide memo/order dated27.11.2012. Details have been made regrading thepayments effected towards retiral benefits. In theinquiry the applicant was not exonerated on merits.FR 54-A(2)(ii) states that the intervening periodshall be regularized in accordance with theprovisions contained in sub rule (5) of Rule 54.The applicant was not fully exonerated by theTribunal. It is admitted that the applicant receivedreduced value of pension at the rate of Rs. 1472/-The original pension was Rs. 2453/- from whichRs. 981/- towards commutation was deducted andthus the reduced pension was worked to Rs.1472/-from August, 2001 to 19.6.2012. The petitioner washolding Rs. 31242/- till the amount was recoveredon superannuation on 1.10.2013. According to theOMs dated 24.12.1976 and 30.3.1978 issued bythe Government of India-Ministry of Financeretirement benefits paid to the officials can beallowed to be retained on payment of simpleinterest as prescribed for GPF for thecorresponding period. Thus the interest calculatedfor the period 1.8.2001 to 31.10.2013 on the DCRGamount works out to Rs. 1,13,054/-. The applicantwas informed that the period between the date ofcompulsory retirement and the date ofreinstatement as non-duty will not count for anypurpose and it was also informed that therespondents proposed to restrict the pay andallowances for the said period to the pensionalready drawn and paid to the applicant. The periodbetween 15.2.2001 and the date of reinstatementwas reckoned as duty solely for the purpose of

pension. The respondents have every right to effectrecovery of the excess payment made. Hence therespondents prayed for dismissal of the OA.

6. A rejoinder was filed by the applicant refutingthe averments contained in the reply statement.FR 54-A(1) provides that where dismissal, removalor compulsory retirement of a government servantis set aside by a court of law and such governmentservant is reinstated without holding any furtherinquiry, the period of absence from duty shall beregularized and the government servant shall bepaid pay and allowances in accordance withprovisions in Sub Rule (2) or Sub Rule (3). InAnnexure A7 it was directed by the Hon'ble HighCourt that as the applicant was already receivingpension, he need not be given the wages duringthe period of compulsory retirement. Therefore, theperiod of compulsory retirement has to be treatedas duty for all purposes except for pay andallowances for that period as the applicant hadalready received pension during that period. HenceAnnexure A26 treating the period of compulsoryretirement as duty only for the purpose of pensionis illegal. Charging interest on the DCRG and thebalance commutation portion of pension areagainst the directions issued by the Hon'ble HighCourt in Annexures A7 and A17 order of thisTribunal.

An additional reply statement has been filedrefuting the averments made in the rejoinder.Another additional rejoinder is also seen filed bythe applicant almost reiterating the samecontentions which have been raised earlier. A 2ndadditional reply statement is also seen filed refutingthe averments contained in the rejoinder. It iscontended that FR 54(A)(2)(ii) states that theintervening period shall be regularized inaccordance with provisions contained in Sub Rule5 of Rule 54. The applicant was not fully exoneratedby the Tribunal. Paragraphs 12 and 13 of A17 orderindicate that the punishment was not set aside onthe merits of the case. It is only stated that theapplicant who had already suffered adequatepunishment commensurate with the gravity of themisconduct by being out of service during theoperation of compulsory retirement and so heshould not have to suffer by inflicting anotherpunishment. It was also held that the applicant isnot entitled to any arrears of pay and allowances.

Hence the applicant is not entitled to drawincrement for the period from the date ofcompulsorily retirement till the date ofreinstatement as claimed by him.

8. We have heard the learned counsel on eitherside and have also gone through the pleadingsand documents on record.

9. It is the admitted case that in the disciplinaryinquiry conducted against the applicant, theapplicant was found guilty and a penalty ofcompulsory retirement for such a misconduct waspassed. That was challenged by him before theTribunal filing OA 789/2003. Annexure A4 is theorder passed therein. Holding that the Tribunalcannot substitute any punishment the matter wasremanded to the appellate authority to considerthe case of the lone applicant as to whether theapplicant can be awarded any other penalty otherthan compulsory retirement from service. Theappellate authority was directed to consider thecase of the applicant in the light of the discussionsmade in Annexure A4 and to arrive at a judiciousconclusion and communicate the same to theapplicant. Pursuant thereto the appellate authorityconsidered the matter again but it was held thatthe imposition of any other penalty would beinappropriate and so the penalty imposed by theDisciplinary Authority was confirmed. However thatorder was subsequently withdrawn as perAnnexure A6 dated 4.8.2010 since at that time theWrit Petition (C) No.23275/2010 filed by therespondent was pending. Annexure A7 is thejudgment of the Hon'ble High Court in the aboveWrit Petition passed on 1.11.2010 where it washeld: ...We do not find any ground to interfere withthe finding of the Tribunal because in our view, therespondent is already kept out of service for nineyears and he is stated to have another three yearsof service for retirement. Therefore, we feel thedepartment should consider a lesser punishmentto the respondent as suggested by the Tribunal.Of course we do not think respondent should begiven wages for the period he has worked becausehe is already receiving pension. The departmentis absolutely free to exercise their discretion inawarding suitable punishment to the respondentafter giving opportunity to him....' It was made clearby the Hon'ble High Court that no further inquirywas required and based on the findings in the

inquiry which has become final by virtue ofAnnexure A7 the Tribunal's order confirmed bythe Hon'ble High Court and in accordance with therules and norms followed by the departmentpunishment will be considered. SubsequentlyAnnexure A8 order dated 3.12.2010 was passed.It was informed that the Post Master General (PMG)proposed to award a lesser punishment ofreduction to a lower grade. Annexure A11 replywas given by the applicant on 7.12.2010.The PMGpassed Annexure A12 order dated 23.12.2010reverting the applicant to the cadre of PostalAssistant carrying pay scale of Rs. 5200-20200 withGP of Rs. 2400/- at the stage of Rs. 5200/- for aperiod of two years with cumulative effect. It wasfurther ordered that the period spent by theapplicant in between the date of compulsoryretirement and reinstatement will not be eligiblefor any amount for the period he has worked sincehe had received pension during those period asordered by the Hon'ble High Court. Annexure A13is the consequential order dated 27.12.2010.Complaining of flouting of the order passed by theHon'ble High Court Contempt Petition was filedbefore the Hon'ble High Court.Annexure A14 is thejudgment dated 19.1.2011 passed by the Hon'bleHigh Court in that case. It was observed by theHon'ble High Court that the direction of this Tribunalby judgment dated 1.11.2010 is to provide a lesserpunishment than the punishment of compulsoryretirement. What is the distinction between a lesserpunishment and harsher punishment is to bedecided on consideration of various factorsincluding the economic effect of the punishmentand if such a consideration is required it cannot besaid that the respondent is guilty of contempt ofcourt in passing such an order. It was observedthat at the worst there can be an error in law inreaching the conclusion. Therefore, the contemptpetition was dismissed. However it was left to thepetitioner to take appropriate steps to challengethe proceedings namely Annexures A12 and A13.Annexures A12 and A13 orders were challengedbefore this Tribunal filing OA No.83/2011.Annexure A17 is the order passed by the Tribunalin that case.

10. The learned counsel for the applicant wouldsubmit that since Annexure A17 is the last orderpassed in the matter the parities are bound by this

inter-party order passed by the Tribunal. ThisTribunal set aside Annexure A13 order dated23.12.2010 mentioned above and directed therespondents to reinstate the applicant as AssistantSuperintendent of Post Offices within a period of60 days from the date of receipt of a copy of theorder. It was held that no back wages are to bepaid. It is further stated that as the applicant is toretire on 31.10.2012 the retirement benefits alreadypaid, if any, should not be recovered, but beadjusted against the payment on his retirement onsuperannuation. The relevant portion is quotedbelow for a better understanding of the case nowprojected by the applicant:

'13. Annexure A13 order dated 23.12.2010 isset side. The respondents are directed to reinstatethe applicant as Assistant Superintendent of PostOffices within a period of 60 days, from the date ofreceipt of a copy of this order. As directed by theHon'ble High Court, no backwages are to be paid.As the applicant is to retire on 31.10.2012 theretirement benefits already paid, if any, should notbe recovered, but be adjusted against the paymenton his retirement on superannuation. No costs.'The learned counsel for the respondents wouldsubmit that Annexure A17 order passed by theTribunal is contrary to the direction issued by theHon'ble High Court in Annexure A7 judgment.Since Annexure A7 judgment was passed by theHon'ble High Court and since that has becomefinal, the Tribunal cannot bye pass the directioncontained therein. The only direction issued by theHon'ble High Court in Annexure A7 is to considera lesser punishment to be imposed on the applicantwhich would mean that the finding entered againstthe applicant that he is guilty of the charges levelledagainst him stood confirmed and as such thereinstatement was not the order that could bepassed in the light of Annexure A7. What wasdirected by the Hon'ble High Court as per AnnexureA7 is only to consider awarding of a lesserpunishment. Reinstatement is not a lesserpunishment. Even if there was anything wrong inAnnexure A13 order that cannot be set at naughtaltogether but it could have been modified by theTribunal in Annexure A17 in tune with AnnexureA7 but on the other hand this Tribunal by AnnexureA17 has virtually superseded Annexure A7judgment of the High court. There is force in the

submission so made by the learned counsel forthe respondents. It is also true that the AnnexureA17 order is not in conformity with the directionissued by the Hon'ble High Court in Annexure A7.The finding of guilt against the applicant stoodconfirmed by Annexure A7 judgment though thegravity of the same was turned down. As suchappropriate punishment should have beenimposed, the respondents counsel submits. Thedirection contained in Annexure A7 is seen to besidelined or bye-passed by the Tribunal by orderingreinstatement, the respondents contend. But thefact remains that A17 order of the Tribunal wasnot challenged before the High Court. Therefore,even if Annexure A17 order is wrong, since it is aninter-party order and since that has become finalthe respondents cannot ignore Annexure A17 orderstating that earlier the Hon'ble High Court inAnnexure A7 held otherwise. Though therespondents now contend that Annexure A17 isactually against the spirit of the judgment(Annexure A7), for reasons best known to them,Annexure A17 was not challenged and allowed itto become final. Therefore, what remains is virtuallythe implementation of Annexure A17 order.

11. The learned Senior Counsel appearing forthe applicant would submit that the order impugnedin this case (Annexure 26) issued on 28.5.2013 isnot in tune with Annexure A17. In Annexure A12the CPMG has stated that the applicant was notfully exonerated by the Tribunal and that para 12and 13 would clearly indicate that the punishmentwas not set aside on merits of the case but it wasonly indicated that the applicant who had alreadysuffered adequate punishment commensurate withthe gravity of misconduct by being out of service,due to the operation of the order of compulsoryretirement, should not be made to suffer by inflictinganother punishment. Therefore, it was held by theCPMG that FR 54-A(3) can be applied only if he isfully exonerated based on the merits of the case.It may be true that the applicant was not fullyexonerated, but still there is a snag.Annexure A17order is binding on the respondents. In AnnexureA26 the CPMG has further held that the punishmentof compulsory retirement inflicted on the applicantwas for a grave misconduct committed by him andthat in Annexure A17 the Tribunal only found thatthe punishment was excessive and ordered to

reinstate him into service in the cadre of AssistantSuperintendent of Post Offices which was the cadrein which he was working at the time of compulsoryretirement. It is further stated that the applicant isnot entitled to arrears of pay and allowances asthe applicant was out of service during the periodof compulsory retirement from 15.2.2001 to20.6.2012 and so the benefit of increment claimedby the applicant cannot be allowed. It may be truethat the applicant was not fully exonerated by theTribunal. The order passed in Annexure A26 is thatthe aforesaid period can be treated as duty solelyfor pension purpose. In other words, according tothe respondents the applicant is not entitled to getnotional increment for the period from 15.2.2001to 20.6.2012. It was further observed in AnnexureA26 that the pay and allowances for the period ofcompulsory retirement will be restricted to pensionalready drawn and paid.

It may be correct that the applicant was notfully exonerated and that only the punishment ofcompulsory retirement was substituted and sinceit was also held that the applicant is not entitled toback wages it has to be held that the applicant isnot entitled to get the increment as claimed in theOA, the respondents counsel vehemently argues.

13. Since Annexure A17 has become final it isnot necessary to delvedeep into other aspects. Theapplicant has already been reinstated in service.The only question that remains for considerationis regarding the consequential benefits theapplicant is entitled to get. It was already held inAnnexure A17 that the applicant is not entitled toback wages for the period till the date of hisreinstatement. Hence the only other question thatfalls for consideration is whether the applicant isentitled to notional increment.Since there is anorder of reinstatement and what has beenprohibited is only the payment of back wages, thecontention that the applicant is not entitled to getnotional increment cannot be sustained. If therespondents had any objection to the directionissued under Annexure A17 that should have beenchallenged before the Hon'ble High Court or areview application should have been filed. That wasnot done. Therefore, though the applicant is notentitled to get back wages for the period in questiontill the date of reinstatement, he cannot be deniedthe benefit of notional increment. In the case of State of Punjab and others v. RafiqMasih (Whitewasher), etc. [2014 (8) SCC 833],it was said that recovery of any excess amountmade to a pensioner is not permissible. Rule70 of CCS (Pension) Rule,1972 which deals with“Revision of Pension after Authorization”contends that it is not permissible to recoveror revise the pension to the disadvantage ofthe pensioner. Hence, revised pension paymentissued to the Applicant herein, who retired asChargeman (Technical) and worked underGeneral Manager, Ordnance Factory (R.No.2herein) on 1.4.2006 fixing his Pay Band of Rs.9,300-34,800 with Grade Pay of Rs 4,200 isillegal even if the Applicant received onepromotion before posted as Master Craftsman

Facts: The Applicant herein, retired asChageman (Technical) while working in OrdnanceFactory (R.No.2 herein) on 31.10.2011. TheApplicant joined the service as Labourer“B”promoted as Examiner and was later placed asMaster Craftsman in March,2005. Thereafter, hewas promoted as Chargeman (Technical) witheffect from 1.4.2006. At the time of his retirement,he was in the pay scale of Rs. 9,300-34,800 withGrade Pay of Rs. 4,600. Accordingly, he wasgetting a monthly pension of Rs 9,475. By A-7Communication, his monthly pension was reducedas Rs. 8,905 and the Respondents asked him tore-credit the excess pension of Rs. 84,235 paid tohim. Aggrived by that Communication (A-7), he filedthis OA for quashing the relevant Annexures at A-4,A-5,A-7 and A-10 declaring that he is entitled toa monthly pension of Rs.9,475 with effect from1.11.2011 and for refunding the amount alreadyrecovered by Cheif Manager, State Bank of India(R.No.4 herein) with intrerest of 12 per cent. TheRespndents clarified that such persons who havenot been placed as Master Craftsman before1.1.2006 from Highly Skilled, Grade II to HighSkilled, Grade I are not eligible for the 3rd MACP.Hence, the recovery was made. It is further clarifiedthat placement of Highly Skilled Grade as that ofMaster Craftsman prior to 1.1.2006 shall be treatedas one promotion under MACP benefits. Hencethe pay of the Applicant was re-fixed with GradePay of Rs.4,200. Hence recovery of excess amountpaid to him was recovered on grant of Grade Payof Rs.4,600/-. The Applicant was informed whichis impugned in this OA.

In the rejoinder refuting the contentions of the

binding order passed by the Tribunal (AnnexureA17) the respondents cannot deny the samequoting the rule position stating that the applicantwas not totally exonerated. Whether the applicantwas exonerated or not or whether FR 54-A(3)applies or not, so far as the parties are concerned,Annexure A17 is binding on them. Though for theperiod between 15.2.2001 to 20.6.2012, the dateof reinstatement the applicant is not entitled to backwages he is entitled to get notional increment andfixation of pay as it is only notional, the applicantwill not get any arrears of pay and allowances.Grant of notional increment would certainly lead tothe re fixation of pay, based on which the retirementbenefits also may have to be re-calculated. Theamount of pension and gratuity, if any, alreadydisbursed to the applicant shall be adjusted againstthe amount that may become due to the applicanton re-fixation of pay/pension based on whichquantum of the DCRG and commuted value ofpension also have to be worked out. In the factsand circumstances of the case and in view ofAnnexure A17 the direction issued by therespondents that the applicant should pay intereston the amount of DCRG etc., received by theapplicant also cannot be sustained. It was not anamount illegally retained by the applicant. He wasnot instrumental for grant of that amount. It is onlythe amount towards the pay and allowances,DCRG or Commuted Value of Pension as the casemay be which it was ordered to be paid to theapplicant.

14. Applicant has retired from service on31.10.2012. The retirement benefits shall be re-fixed and paid to the applicant, after making suchadjustments of the amount already drawn andwhich had been paid to the applicant towardsDCRG and Commuted Value of Pension, after re-fixation of pay and pension in the light of what havebeen directed above. This shall be done within twomonths from the date of receipt of a copy of thisorder.

15. OA is disposed of as above. No order as tocosts.

respondent, the Applicant states that, as per rule70 of CCS (pension) Rules, 1972, the pensionamount cannot be reduced to the disadvantage ofthe Applicant after the lapse of three years. In thelight of the decision in the case of Punjab andothers v. Rafiq Masih (Whitewasher), etc. [2014(8) SCC 883], the Respondents are not entitled torecover any excess amount made to thepensioners. The main ground for filling this OA is,that the Applicant was not served with notice beforereducing pension and recovery. He also contendedthat as per-Rule 70 of CCS (Pension) Rules, 1972,recovery or revise his pension to his disadvantageafter 2 years of his retirement is not permissible.Rule 70- “Revision of pension after Authorization”is reproducted for clarity. The Respondentscontravened the said Rlue70 and justified theiraction.

Both sides argued to sustain their case.Respondent referred to the case of Rafiq Masih(supra) and said that referring it has to be treatedas per incuriam. It was held:

Held: “From the foregoing discussion and inthe light of the extant rules relating to the paymentsof pension and also on the recent ruling of the ApexCourt in Rafiq Masih’s case (supra), it appears thatthe OA is only to be allowed. Accordingly, the OAis allowed to the extent of holding that theRespondents are not entitled to issue Annexure-A-7 revised pension payment order two years afterthe original Pension Payments Order was issuedto the Applicant. Hence the action of theRespondents i.e A-5, A-7 & A-10 are quashed andset aside. Respondents are directed to ensure thatR.No.4 returns the amount recovered.Respondents are directed to continue payment ofpension in accordance with original PensionPayment Order issued to the Applicant immediatelyafter his retirement with all benefits and continuepayment of pension whenever upward revision isgranted to him with consequential benefits on thefamily pension”.

OA is ordered accordingly. No costs.

We are actually , very loyal servants to ourhabits and mentality. Things change quickly,but wedo not. As a result we stagnate.

Just as any thing remaining unchanged over along time gets it value downgraded, life too losesits shine if we fail to take dynamic steps. Thejourney of life becomes dynamic and fruitful only ifwe learn to go with the wind of change. -

Facility of extension of without voucher facilitywas withdrawn vide guidelines conveyed vide letterNo. 7-8/2010/EF/Part/1 dated 5.9.2011, asexpenditure control measure. To mitigate thehardship in submission and following up of medicalclaims by retired employees, the CompetentAuthority has approved revival the facility only toretired employees, as per the guidelines issuedvide letter No. BSNL/ADMN/l dated 28.2.2003under para 2.1.1.

The entitlement under this option will be 50%of the admissible amount (annual outdoor ceilingprescribed) and will be paid in four equalinstalments at the end of each quarter. The amountpayable is taxable as per the applicable Rules. Thedecision, however, will be reviewed after 6 months.

Attention is invited to CPAO’s OM No.CPAO/Tech/Simplification/2014-15/52 dated- 28.05.2014whereby it was intimated to all concerned thatpensioners were not required to visit the bank toactivate their first payment of pension. It was alsointimated that undertaking for recovery of excess/over payment of pension had been made a part ofPPO. Inspite of these instructions, banks used toinsist on pensioners to physically appear in thebank before commencing first payment of pension.Consequently, CPAO had issued instructions videOM No. CPAO/Tech/Life Certificate/2014-15/99-175 dated-28.07.2014 that banks should not insiston the pensioners to issue life certificate at the time

of first credit of pension. They were also advisedto identify the pensioner with reference toinformation already available with bank obtainedthrough KYC at the time of opening of bankaccount. The above instructions were reiteratedby 0M No. CPAO/Tech/Bank Performance/2014-15/45 dated-02.06.2016.

However. it is observed that banks are stillinsisting upon the pensioners for completion offormalities like submission of life certificate, letterof Undertaking and certificate of non-employmentto credit their first payment and other dues to theirpension account resulting into inconvenience tothe pensioners defeating the very purpose ofsimplifying the pension procedures.

In view of the above, Heads of CPPCs andHeads of Government Business Divisions of all thebanks are advised to ensure that instructionsissued by CPAO are followed by CPPCs andpaying branches and any inconvenience topensioners are avoided.

(a) Once pension has been credited to apensioner’s bank account, the liability of theGovernment/bank ceases. No further liabilityarises, even if the spouse wrongly drawn theaccount

(b) As pension is payable only during the life ofa pensioner, his/her death shall be intimated tothe bank at the earliest and in any case within onemonth of the demise, so that the bank does notcontinue crediting monthly pension to the jointaccount with the spouse, after the death of thepensioner. if, however, any amount has beenwrongly credited to the joint account, it shall berecoverable from the joint account and / or anyother account held by the pensioners/spouse eitherindividually or jointly. The legal heirs, successors,executors etc shall also be liable to refund any

amount, which has been wrongly credited to thejoint account.

(c) Payment of Arrears of Pension (Nomination)Rules 1983 would continue to be applicable to aJoint Account with Pensioner’s spouse. ThisImplies that if there is an ‘accepted nomination’ inaccordance with Rules 5 and 6 of these Rules,arrears mentioned in the Rules shall be payableto the nominee.

Existing pensioners desiring to get their pensioncredited to a joint account as indicated above arerequired to submit an application to the branchbank, from where they are presently drawingpension in the enclosed form i.e. Annexure XXIX.This would also be signed by the pensioner’sspouse in token of having accepted the terms andconditions laid down in this Office Memorandum.These instructions are also applicable to the Govt.servants who will be retiring after the issue of thisOffice Memorandum.

The hardship faced in availing escort facilityby a physically challenged Railway Servant whosespouse is also a physically challenged person, dueto a restrictive proviso in the Pass Rules has beenbrought to the notice of Board. The matter has beenexamined and in order to mitigate the difficultybeing faced by such Railway Servants, it has beendecided with the approval of Competent Authorityto suitably amend the relevant Proviso.Accordingly, the 1st Proviso, below Item No. 3(xxv)under the general Rules relating to PrivilegePasses/PTOs in Schdule-II of Railway Servants

(Pass) Rules, 1986 (Second Edition-1993) isamended as follows:-

The other conditions for availing higher classpasses/escort facility as contained in the PassRules for serving employees and the instructionscited above in respect of retired employees,including the proviso that no attendant will be givenwhen an escort has been allowed, would continueto be applicable.

8. Revision of Ex-gratia to CPF/SRPF Retirees -

tional council, JCM, ex­gratia payments were made to

the CPF/SRPF retirees. These rates fixed in 1988 were

revised on 1.11.1997 and again from 2006. Presently

the rates are as under:

It has been brought to the notice of thisDepartment that in a number of cases delay occursin payment of Central Government EmployeesGroup Insurance Scheme (CGEGIS) dues, owingto missing entries, despite the fact that a provisionhas been made for making entries of subscriptionfor CGEGIS, recovered from pay & allowancesevery year in Part- VII-C of the service book.

2. In terms of para 8.1 Of the CentralGovernment Employees Group InsuranceScheme, 1980, as contained in this O.M. No.F.7(5)-EV/89 dated 15th May, 1989, which relatesto Savings Fund of the Scheme, the totalaccumulation of savings together with interestthereon will be payable to the member onretirement or on cessation of his employment withthe Central Government or to his family on hisdeath while in service. The total accumulationunder Savings Fund is provided for in terms of theapplicable Table of Benefits pertaining to aparticular year as prescribed under the relevantOrders issued by this Ministry from time to time.

3. The issue has been considered inconsultation with Department of Pension &Pensioners’ Welfare and Controller General ofAccounts. It has been decided that in order to easethe process of payment of Savings Fund onaccount of CGEGIS at the time of retirement of aCentral Government employee, in all cases wherethe service of the retiring Central Governmentemployee has been verified, payment of theaccumulation under Savings Fund of CGEGIS bemade without awaiting confirmation of deductionof each monthly subscription of CGEGIS, asservice verification is carried out based on themonthly salary payment and the CGEGIS

subscriptions are mandatory deductions from thesepayments.

4. All Ministries/ Departments are accordinglyadvised to ensure compliance of above instructionsso that the dues of CGEGIS in respect OfGovernment servants retiring on attaining the ageof superannuation are discharged with duepromptness. Further, it may be ensured thatMinistries/ Departments send their budgetrequirements for payments under CGEGIS to CCA(Finance) well in advance, preferably, at the timeof RE/ BE so that the budget under this head ismade on a realistic basis.

revised on the basis of the 7th CPC’s recommendation,

a revision of rates of the ex-gratia to the CPF/SRPF re-

tirees whose number is dwindling every day is warranted.

Staff Side, therefore, requests that the rates may be ap-

propriately revised applying the very same rationale

adopted in the case of civil pensioners.

9.Dispense with the practice of ignoring the frac-

tion while computing the Dearness Allowance : For

the sake of easy computation of DA the practice of ig-

noring the fraction was initiated. The quantum loss to

the beneficiaries in the beginning was meager. Now that

the administrative difficulties which prompted for ig-

noring the fraction has been greatly eased due to com-

puterization and taking into account the loss for six

months is no more meager, it is necessary that the prac-

tice is dispensed with. For example, the next instalment

of DA is likely to be 2.95% whereas the orders would

be issued for grant of only 2%. In the case of an em-

ployee, whose basic pay is Rs.50,000, the loss per month

in that case would be Rs.475/-. It is pertinent to men-

tion in this connection that in the case of Bank employ-

ees, the practice of ignoring the fraction is not followed.

Staff Side therefore requests that the DA hereafter be

computed without ignoring the fraction.

10.Include unmarried/widow/divorcee sisterin the definition of family for family pension:The scope of Family pension under Rule 52 of theCCS (Pension) Rules, 1972 was extended to thedependent disabled siblings (brother and sister)of Central Government servant/pensioners videDOP&PW O.M. No.1/15/2008-P&PW(E) dated17thAugust, 2009. There are cases wherein anemployee/pensioner remains unmarried andleaves behind dependent unmarried/widow/divorcee sister/sisters. Though cases of such typesmay be few and far between, nonetheless, suchhapless ladies need to be taken care by theGovernment lest they should be left to fend forthemselves, after the death of GovernmentServant/pensioner on whom they were fullydependent before his/her death. We request toinclude dependent unmarried/widow/divorceesister/sisters in the definition of family for thepurpose of family pension.

13.Counting full service of TemporaryCasual Labourers for pensionary andretirement benefits in Railways — reg : The StaffSide had discussed its demand for counting full

service of temporary status of casual labourers forpensionary and retirement benefits at the level ofRailway Ministry. Consequently, the RailwayMinistry had agreed and accordingly proposal wassent to the Ministry of Finance and DoP&T seekingclearance. Unfortunately, the MoF and DoP&Thave not accorded approval.

In this connection, the Staff Side bringsfollowing key points for consideration:

1. The Casual Labourers in Railways hadattained temporary status on completion ofprescribed days of continuous working and got thebenefits admissible to temporary Railway/Government employees such as regular Pay Scale,Medical facility etc.,

2. The Railway Administrations have howevertaken abnormally long periods to absorb them asregular staff although regular posts were vacant.

3. The status of casual labourers in railwaysafter acquiring temporary status (termed asTemporary employees) is exactly similar to thesubstitutes in whose case, the total service fromthe date of attainment of temporary status iscounted for reckoning qualifying service forpensionary benefits.

4. Various CATs, High Courts and even theApex Court have given decisions against thedifferential treatment between the casual labourand substitutes particularly when both attainedtemporary status and directed to treat them at parso far as reckoning the service from the date oftemporary status till the date of regularization forpensionary benefits etc.,

5. The SLPs filed by the Union of India beforethe Apex Court in a few cases of casual labourerswere dismissed and the Hon’ble Supreme Courthad directed the Union of India to calculate Pensionand other retiral benefits payable to the retiring/retired employees, taking into account the 100%temporary status

Staff Side, therefore, requests to consider theabove valid points and accord approval for countingtotal temporary status service of Casual Labourersfor pensionary benefits in Railways.

In addition to existing instructions, agencybanks may ensure that internal/concurrent auditat bank branches verifies whether governmentbusiness is being conducted as per rules andregulations prescribed by government/RBI.Accordingly, the internal/concurrent audit at bankbranches may also examine, among other things,various aspects of government banking such asagency commission claims and pension payments.A checklist may be provided to the inspectingofficers/auditors, which may at a minimum includethe items given in the Annex*-(published below).Accordingly, Annex 2 of the Master CircularDGBA.GAD.No.H-1/31.05.001/2015-16 onDisbursement of Government Pension by AgencyBanks dated July 1, 2015 stands withdrawn.

Checklist relating to GovernmentBusiness for internal/concurrent audit

Part A: Agency commission claims

Internal inspectors/auditors may verify theagency commission claims submitted by branchesand confirm their accuracy during the course oftheir inspection/audit. The following may bespecifically examined during the course of internal/concurrent audit at agency bank branches:

1. The system in place to arrive at total numberof transactions is robust and free of errors.

2.Categorisation of different types oftransactions (physical/electronic receipts andpension/non-pension payments) are in accordancewith RBI instructions.

3.Correctness of number of transactionsreported in agency commission claims.

4.Whether agency commission has beenclaimed on error scroll transactions. (Banks arenot eligible for commission on error scrolls as thecommission on the original transaction is beingpaid).

5.Whether proper records are maintained atbranches as regards government business andagency commission claims (wherever the branchhas a role in making such claims).

6.Whether the entries in the registers/printoutsrelating to agency commission claims are properlyauthenticated.

Part B: Pension related issues

Internal inspections should assess branchperformance in servicing pensioner customers. Inthis regard, the following may be ensured:

1. A specific questionnaire covering all aspectsof pension payment may be devised for use duringinspection of pension paying branches.

2.Inspecting officers may also, duringinspections, call up pensioners at random andenquire about their satisfaction with pension-related services.

3.A detailed check-list relating to pensionpayments/government business may be given bybanks to internal auditors/inspectors in order toadhere to the recommendations of the PrabhakarRao Committee, constituted by the Governmentof India, relating to pension payments/governmentbusiness. These include the following:

a) Whether there is delay in payment ofpension, revision of pension, revision in dearnessrelief etc.

b) Whether the branch manager has structuredinteraction with a cross section of pensionersserviced at the branch on quarterly basis, wherethe number of pensioners of all governments anddepartments exceeds a fixed number, say, 100 or200.

c) Whether nominations have been obtainedfor all pension accounts.

d) Whether pension accounts have beenconverted into joint accounts wherever applicable.

e) Whether the bank branch has an effective

complaint redressal mechanism and thecomplaints of pensioners are attended promptlyand their grievances redressed expeditiously.

f) Whether the pension is credited topensioner’s account during the last four workingdays of the month except for the month of Marchfor which pension is to be credited on or after firstworking day of April.

g) Whether the pension paying branch obtainsLife Certificate/ Non-employment certificate/Employment Certificate from the pensioners in themonth of November every year.

h) Whether pension paying branches deductincome tax at source from pension paymentswherever applicable.

i) Whether paper tokens in acknowledgementof cheques presented are invariably given by thetax collecting branches.

j) Whether the challans are stamped givingbank’s BSR code and Challan IdentificationNumber (CIN) clearly.

k) Whether the stamped challans are kept inthe custody of bank’s staff and handed over to theconcerned tax payer only on production of thepaper token.

Obituary

BPS deeply mourns the death of ShriK Mallikarjuna Rao, retd Asstt Director(Postal Services) - founder Secretary ofPostal Officers Pensioners Assn,Hyderabad / ex-Secy (Postal & Others),BPS from December, 2008 to November,2010 who left for his heavenly abode on13.04.2017 at the age of 83 years(DOB:15-12-1933). Late Shri MallikarjunaRao strived hard for redressal ofPensioners grivances. His departure hasleft a vacuum amongst Pensioners’fraternity. May his soul rest in peace andlet the Almighty grant strength to thebereaved family to bear this irreparableloss.

Prez stressed for upward revisionof minimum pension and desired all, who havereceived arrears due to revision of pensions dueto 7th CPC, to donate liberally to the assn. Richtributes were paid were to late Selvi J Jayalalitha,chief minister of Tamil Nadu who left for herheavenly abode on 05-02-2016 and observedsilence for two minutes in memory of late C/Minister and three other members whose familieshave been given Rs.1500/- each for funeralexpenses. Vehemently criticised those who,despite in operation of’The Maintenance andWelfare of Parents and Senior Citizens’ Act, 2007‘ in the State of TN, do not give respect to seniorcitizens in various Deptt of the state govt andinformed house of its proposal to honour officialswho have shown utmost respect to Sr citizens atits annual conference scheduled for April, 2017at Nagapattinam. Desired separate  counters inRation shops for senior citizens or alternatelyissue of identity cards to obviate long waiting bySr citizens. M Subramanian desired action to beinitiated by the AICGPA for opening of CGHSwellness centre at Nagapattinam or Karaikal.Meeting ended with a vote of thanks by the branchsecy.

After lightning of lamp &garlanding photo of founder of RPA Katni late DrB S Virha, Retd M S/Rly Hospital NKJ, houseobserved 2 minutes silence in memory of thedeparted souls. Secy D R Sihote read the reportand tr. Uma Shanker Bedi presented balancesheet for 2016 and same approved. Tenoctogenarian members were honoured withshawls, gifts and citations. Chief guest gave sometips on health care. Audience enjoyed the mimicrypresentation by artist Sajay Gaikwad. Meetingended with vote of thanks to all by the c/man.

KOTTAVALASA - Vizianagram Dist (AP):Railway Pensioner’s Assn (KRPA)— AGMcoinciding with Pensioners Day was conductedon 17-12-2016, attended by large number ofpensioners/ family pensioners, was presided byits prez B S Prakash Rao with Chief Mgr,SBIKottavalasa - C Phani Raj & Tehsildar Kottavalasa-K Anand Rao as chief guests. After recitation ofprayer by M P Raju, prez Rao and secy K BabuRao explained the importance of the functiondrawing attention to the historic judgement of theApex Court on this day in 1982 which benefittedthe pensioners. Phani Kumar and six otheroctogenarian members were honoured withmementos, shawls, Valmiki Ramayana and acitation. As secy P Syamla Rao has shifted toHyderabad, K Babu Rao has taken over assecretary of KRPA. Meeting ended with a vote ofthanks by M P Raju and serving of lightrefreshments.

LUDHIANA (PB): N Rly Penrs’ Welfare Assn — held 20th AGM on 25-03-2017 presidedby its c/man Sher Singh whereat grievances ofthe pensioners and anti-pensioners attitude of theGOI was discussed. He was critical of the Ministryof Rlys move to stop complimentary and priveldgepasses and wanted to know if such a move is inoffing in respect of parliamentarians and alsostoppage of canteen facilities to ex- defenceemployees. He also deplored the increase of  0.32% recommended by 7th CPC and denial of OROP

Prez T V Singh desired ofimprovement in medi-care and remove difficultiesfaced by aged pensioners for visiting Ferozepur/New Delhi for petty operations and treatment ofage related problems.Non- reimbursement ofexpenses incurred in emergent cases byauthorities was also discussed. Genl secy B RDhawan deplored the orders of the Ministry of Rlyswithdrawing 2nd pensionary benefit to widows anddivorced daughters. NAGPUR (MAH): SEC Rly Pensioner’s Assn— Genl secy of SEC RPA /  V Prez (WZ) BPS J NRao organised a workshop on April 2nd, 2017 atNagpur to make pensioners of age group around25 years familiar with relevant rules relating tofamily pensions, technique of makingrepresentations and participation in pensionadalats etc consequent on new decisions ofgranting family pensions to unmarried, widowedand divorced daughters of railway pensioners.Nearly 30 females from Gondia, Nainpur,Bhandara, Nagpur, Dongargarh and Naghbirparticipated.

PALAKKAD (KERALA): Rly Pensioners’Assn — 37th AGM held on 11-03-2017 wasconducted in two sessions - ‘Open session’ in theforenoon and ‘Closed session’ in the afternoon.Both the sessions were presided by its prez PSyed Mohamed. Before formal inauguration by TRajkumar, ADRM/Palakkad, around 500members took a procession from Palakkad Rlyjunction to venue of meeting ie Olavakode raisingslogans regarding various demands ofpensioners/family pensioners. After prayer by SmtDhanya, K Unikrishnan, DFM(Retd) welcomed alland gave a brief of the activities of the RPA.ARDM/Pallakad - T Raj Kr lauded the RPA fortaking up the problems of the Rly pensioners. Prezin his address dwelt on the pension scheme fromits inception and role of Pensioners Assns vis - a- vis Federations in bringing about severalimprovements in pensions over the years and the

need for parity in pensions between pre-2016 andpost-2016 pensioners as all pensioners form ahomogeneous unit. Special invitees SmtChandrika Jayashankar - Sr DPO/Palakkad, TittyJohn - Sr DFM/Pallakad and K C KrishnankuttyMenon - prez NFRP/Palakkad were also invited.First two invitees expressed happiness on theirparticipation and explained steps taken byAdministration to resolve the problems of thepensioners and assured all help in future also.Prez NFRP/Palakkad - Krishnakutty Menonstressed the implementation of option 1recommended by 7th CPC bringing parity inpensions. Also briefed on steps taken by NFRPand other Federations on this. 4 student of classX  and 6 students of class XII (Plus 2)  from fivenearby schools were given cash stipend of Rs.1001/- each for their meritorious performances byADRM. 23 octogenarian pensioners/familypensioners were felicitated. Attendance ofpensioners, by now, swelled to 800. During lunchinterval, all enjoyed the light music by localamateur troupe. Genl secy M Prabhakaran, in thesecond session, presented annual report for 2016followed by treasurer K Anand Raj tabling theaccounts for 2016 and both,after discussions,were passed unanimously. Messages receivedfrom sister assns and members were read byoffice secy V Mohanan. V prez/RPA - AKrishnankutty moved 19 resolutions and sameapproved. Meeting ended with singing of NationalAnthem.

SAHIBGANJ ( JHARKHAND): Rly Penrs’Assn, E Rly — Binennial General Body meetingheld on 19-03-2017, attended by about 150members & local representatives of variousunions, was chaired by its prez Vikram PrasadSingh. Secretary N C Pramanik hoisted the flagof RPA. Later one minute silence was observedto pay homage to members including R L Sarkar-secy of RPA who have left for their heavenlyabode. This was followed by reading of report forbiennial years 2015-16 by secretary andpresentation of biennial statement of accounts bytreasurer H R Singh.
