The Groveland Township Planning Commission was called to order by Jennifer Sevigny at 7:00p.m. Members present were Howell, Schank, Mason, Christopher, Sova and Sheridan. See attached list of others in attendance.

PLEDGE OF ALLEGIANCE:

APPROVAL OF MINUTES FOR:

A motion was made by Schank, seconded by Mason to approve the minutes of the March 25, 2014 meeting as submitted. ALL YES. MOTION CARRIED.

APPROVAL OF AGENDA:

A motion was made by Schank, seconded by Sova to approve the Agenda as submitted. ALL YES. MOTION CARRIED.

COMMUNICATIONS AND NOTICES:

North Oakland Head Waters- No changes

NEW BUSINESS:

DISCUSS HARD SURFACE FOR RIVER ROCK AND BOTIOMS UP Mr. DePalma stated that River Rock has 61 parking spaces and 59 are needed for pat rons. Bottoms

up needs 56 parking spaces fo r t heir patrons and employees. Bottoms up will be hard surfacing the side area and the back L shape. They plan to use concrete to surface the addi tional area. Discussion on this being the original site plan numbers.

M ason believes the crushed asphalt is as good as the pavement for the over flow for River Rock and Bottoms up.

The Bed and Breakfast was approved for some other construction material for their drive. Grandma's Ice Cream also is not paved.

Dust does not seem to be a problem with Bottoms up, dust is all around the Township. Sevigny and the board are in agreement that the area is in comp liance with the site plan and do not need to pave the over flow area.

Also discussed a Special Use Permit will be needed for a Halloween Special/Zombie Run/Halloween Dinner Theater.

Are there bike racks? Yes, with the Motorcycle parking. The traffic gets bad on other parking area; can anything be done? The road was widen to 2 ~lanes. It would cost X of a million dollars and move wetlands. There are no safety problems. No patrons (public) are in the park overnight. RV's come and go at night and do not stay in the park. There is a camp ground for the workers. Working at getting a bus for transportation from Mt. Holly and they are trying to get on the Oakland County Sheriff year round contract.

Michigan Renaissance would like to go to a 5 year permit and or try and get a permanent business license. The five year is possible; however the permanent license would trigger a lot of problems. Such as, code up grades, insurance, if buildings are up graded would people be able to live in them?, paved parking lot. Mr. DePalma could check with the Lawyers if they would like. They will be good for a five year and not permanent business. Also they would like to look at a permanent sign.

We will check into the five year permit. Ben Tallerico Planner and Nick Brass Engineer have no changes and approved the Site plan and Special Use Permit.

Sova motion to approve the Site Plan and Special Use Permit for Michigan Renaissance Festival Site Plan #SP-0085-2014, G 02-07-351-001, G 02-07-351-002, and G 02-18-101-002, three year permit 2014 to 2017, with the recommendation of the Planner and Engineer. Mrs. Parker will still bring in the Oakland County Sheriff contract, Health Dept. and all other papers. Motion seconded by Mason. ROLL CALL VOTE. YES-HOWELL, SCHANK, SEVIGNY, CHRISTOPHER, SHERIDAN. N0-0 MOTION CARRIED.

PUBLIC HEARING FOR BLIGHT ORDIANCE. Mr. DePalma said that Will Hosler, Township lawyer, advised him that the court order of a case has

changed the way Blight can be handle. The case that a Township went and cleaned up a taxpayer's home and charged him for the cleanup, he never responded to the request from the Township to clean it up or contact them. They decided that it was okay and the Taxpayer would have to pay for the cleanup. He had his time to respond and did not.

The planner responded by bringing in Monroe's blight ordinance. Mr. DePalma and Ms. Lawrence sat down with Mr. Tallerico and removed several items from Monroe's ordinance to comply with our area more. Ms. Sevigny would like our ordinance kept and the violations added to the ordinance.

The Planner Tallerico will strike everything before 14-373 and leave the rest. He will rewrite the Ordinance and bring it back.

MINING PERMIT. 2014-2015 STARBATT, INC, SEC. 19, DIXIE HWY. AND SHIELDS RD, HOLLY Engineer Brass discussed his May 12, 2014 review letter. Brass met with Mark Hill the

Operating Manager to go over the site.

There will be continued mining and reclamation operations on 58 acres of 89 acres, per market demand for sand, stone and crushed gravel. An aerial map and topographic contour map dated November 13, 2013. Engineer Brass provided a summary for the mining operations, clearing stockpiles and mining pit bottom for shaping to the final grade with in the west area. Mining in the

. east area is proposed to continue westward and southward. The storm water will be maintained on site and directed towards the proposed retention basin. Screening and berms and vegetation shall remain during operations.

Soil Erosion and Sedimentation Control permit, GRT/2003-0293/19/0T is current. Performance Bond amount is set at $475,000.

The Engineer Brass and Planner Talle rico recommend the approval for Permit for 2014-2015.

After discussion motion was made by Sova to approve the Reclamation Plan MINING PERMIT 2014-2015 STARBATT INC. SECTIONS 19, AND DIXIE HWY. AND SHIELDS RD, HOLLY and recommend to the Township Board adopt the Bond amount of $475,000, upon the recommendations of t he Township Engineer's and Planner's at the meeting. Mason seconded the motion. ROLL CALL VOTE. YES-HOWELL, SCHANI<, SEVIGNY, CHRISTOPHER, SHERIDAN. N0-0 MOTION CARRIED.

MINING PERMIT BEDROCI< 2014-2015, 1-75 AGGREGATES, SEC 19, 1-75 AND GRANGE HALL RD. HOLLY

Engineer Brass discussed his May 12, 2014 review letter. Engineer Brass was unable to meet with owner. The site is located in Section 19 east of 1-75 and north of Grange Hall Road. An aerial map was done on November 13, 2013. Aerial map appears to show accurate site conditions at the end of 2013. Screening berms and trees surround the site's frontage. Access is provided along Grange Hall Rd; also access approach is also used by the adjacent mining operations north of site. The wood recycling operations is proposed to continue through this permit year.'

There will be continued mining and reclamation operations proposed on the 83.8 acres during 2014/2015 permit years. Final reclamation grades and clearing stockpiles, mining along the south is encroaching setbacks. However Applicant is buying house on south border so the setbacks will be fine. Engineer Brass provided a summary of Parcels 1, 2, and 3, detailing all activities on the site.

Soil erosion and sedimentation control permit is required for the proposed work. The applicant shall provide the SESC permit.

The Township agreement between 1-75 Aggregates was previously agreed upon in lieu of a performance guarantee. Permanent reclamation was not completed during the 2013/2014 permit year therefore Engineer Brass recommends the Township's agreement remains unchanged.

It is the opinion of Engineer Brass that the mining permit application is in substantial compliance with the Township Ordinance 200 and the consent judgment. Planner Tallerico recommends the approval of the Permit for 2014/2015 for Bedrock/1-75 Aggregates.

, SEC19, 162401-75 AND GRANGE HALL RD., HOLLY. Based upon the Township Engineer's letter May 12, 2014 and Planner's recommendations at the meeting, agreement in lieu on bond. They will need to submit the SESC Permit for Soil Erosion. Seconded by Schank.

Subject-to review by the Township Board they approved the 2014/2015 mining permit. They will need to submit the SESC Permit for Soil Erosion. ROLL CALL VOTE. YES-HOWELL, SEVIGNY, MASON, CHRISTOPHER, SHERIDAN. N0-0 MOTION CARRIED.

MINING PERMIT 2014/2015 DESERT SAND/GIBRALTAR, SEC 19, 1-75 AND GRANGE HALL RD .. HOLLY

Engineer Brass discussed his May 12, 2014 review letter. There will be continued mining operations within the site per market demand for sand and stone. Aerial map and topographic contour map appears to accurately show the site conditions. Site is w ithin a complex of mining operations therefore screening berms and fences are not required. Access is provided at Grange Hall Rd through the adjacent Groveland Township property to the south. 6.3 minable acres were approved in the 2013/2014 permit for mining along east portion. Applicant is proposing to continue north to final reclamation grades

Re clamation has not begun on-site to date nor is proposed. A performance bond in the amount of $85,000 is to be posted with the Township. A Soil Erosion and sedimentation control Permit is required. The applicant shall provide the SESC Permit.

The opinion of Engineer Brass, the mining permit application as submitted is in ·substantial compliance with the Township Ordinance 200 and the consent judgment. Planner Tallerico recommends the approval of the Permit for 2014/2015 for Desert/Gibraltar.

After discussion, a motion was made by Sova, seconded by Mason to approve the reclamation plan. DESERT/GIBLRATAR., SEC. 19, 1-75 AND GRANGE HALL RD., HOLLY based upon the recommendations of the Township Engineer's letter May 12, 2014 and Planner's recommendations at the meeting. Bond amount of $85,000. The motion by Sova is as it conforms to the Engineer and Planners recommendations.
