Terms and ConditionsExcept for those stated in the below terms and conditions there are no warranties, either expressed or implied, as to merchantability orfitness for a particular purpose with respect to the cattle being sold at this auction.The warranties and guarantee set forth in the “Terms and Conditions” are in lieu of all other warranties, either expressed or implied, and theremedies provided therein shall be the sole and exclusive remedy of the buyer, or any party claiming through buyer, for any breach orwarranty or guarantees therein provided, and all other obligations or liabilities.

1. BiddingEach animal will be sold to the highest bidder. The auctioneer incharge will settle any disputes as to bids, and his decision shallbe final.

2. TermsTerms of the sale are cash or check or approved credit. Settle-ment must be made to the clerk at the conclusion of the auction.

3. Purchaser’s RiskEach animal becomes the risk of the purchaser as soon as sold,but will not be delivered until settlement has been made.

4. Certificate of RegistryWhen full settlement has been made, a certificate of registrationwill be furnished and transferred to the purchaser. Give full nameand address to the secretary when making payments so the Cer-tificates of Registry will be transferred properly.

5. HealthAll animals are eligible for interstate shipment except as other-wise noted. The cattle have been tested for tuberculosis and bru-cellosis within 30 days of sale date. A certificate will be furnished.Cattle have not been tested for any other diseases and thereforeit is the responsibility of the prospective purchaser to requestany other tests on individual animals from each consignor wellin advance of the sale in order to obtain a negative test result fora given disease. Sellers may voluntarily test their cattle for otherdiseases should they be requested but have no obligation to doso. There is no implied guarantee for refund or replacement ofcattle that may test positive for any disease other than tubercu-losis or brucellosis after the sale.

6. AnnouncementsAnnouncements from the auction box take precedence overprinted matter in this catalog. All cattle will be sold by lot num-bers, as announced by auctioneer.

7. Breeding Guarantee(A) All animals are guaranteed to be breeders with the exceptionof: (a) injury or disease occurring after sale, (b) negligence orwillful misconduct on the part of the purchaser.(B) Any female is considered a breeder if she is pregnant at thetime of this sale and/or she has a calf at side.(C) Any bull which either: (1) produces viable semen; (2) settles1/3 or more of the healthy cows he serves; (3) is the sire of 20or more animals; or (4) settles cows by natural service, andpasses a fertility test made by a competent veterinarian duringany six month period trial, shall be considered a breeder.(D) Buyer must notify seller within one year of any breedingproblem found in an animal.

8. Embryo Transfer GuaranteeAll donor cows that have been worked successfully in embryotransfer are guaranteed to produce good embryos with the ex-ception of other guarantees stated in the footnotes of this catalogor announced from the auction block. It is understood that theseguarantees are valid only if: (1) a qualified person or persons dothe transfer; (2) donor cow is managed properly in embryo trans-fer (i.e. not over conditioned and/or overworked); (3) injury ordisease does not occur after the sale and (4) the purchaser isnot negligent or willfully mistreats the donor cow.

9. Options and Privileges for Return or Adjustment(A) All claims for adjustment or return must be made in writingwithin six months of the sale date.(B) Any animal that has not proven itself a breeder within thetime limits specified above, if in healthy condition, may be re-turned to seller at buyer’s expense. The seller reserves the rightand privilege of trying for a period of six months to prove the an-imal a breeder. If proven a breeder, an animal will be returned atbuyer’s expense. Should the animal fail to breed, the seller, at hisoption, may either return the purchase price or make replacementof the animal with another of equal value.(C) Any animal returned must have a veterinarian’s certificatethat it is free of Bangs and tuberculosis.

10. Rights and Obligations(A) The above terms and conditions of sale shall constitute a con-tract between the buyers and sellers of each animal and shall beequally binding upon both.(B) Animals resold following the purchase in this sale shall con-stitute a separate transaction, and the rights and obligations ofthe two parties connected thereto are not covered by the termsand conditions of this sale.(C) All persons who attend the sale do so at their own risk andthe owners nor any person connected with the management ofthe sale assume any liability, legal or otherwise, for any accidentswhich may occur.

11. Applicable LawAll cattle (or horses) in this sale are offered according to the lawsof the State of Texas. The right to bid, as provided under the law,is reserved for all Consignors, including owners and their agents,unless otherwise announced by the Auctioneer.
