SETAP is an affiliate of the National Association of Legal Assistants On April 6th and 7th, I attended the annual TAPA conference hosted by the Houston Corporate Paralegal Association at the Doubletree in downtown Houston. I enjoyed networking with everyone there, got some great insight on what other groups are doing and left with some great ideas for our organization to try going forward into next year. On April 20th, SETAP held its annual Spring Seminar, which was a smashing success! I received numerous compliments on both our speakers, as well as the event itself. Our Board did a great job putting this together for you and I think it turned out great! Thank you to all our speakers for taking time out of their busy schedules to come and speak to us. I would also like to thank our vendors for coming out and supporting us. Last, but certainly not least, I want to express my most sincere gratitude to each of my executive board members. There is no way I could have done any of this year's events without each and every one of your help. On June 30th, my term as your President will come to an end. On April 6th and 7th, I attended the annual TAPA conference hosted by the Houston Corporate Paralegal Association at the Doubletree in downtown Houston. I enjoyed networking with everyone there, got some great insight on what other groups are doing and left with some great ideas for our organization to try going forward into next year.

On April 20th, SETAP held its annual Spring Seminar, which was a smashing success! I received numerous compliments on both our speakers, as well as the event itself. Our Board did a great job putting this together for you and I think it turned out great! Thank you to all our speakers for taking time out of their busy schedules to come and speak to us. I would also like to thank our vendors for coming out and supporting us. Last, but certainly not least, I want to express my most sincere gratitude to each of my executive board members. There is no way I could have done any of this year's events without each and every one of your help.

On June 30th, my term as your President will come to an end. I will continue on the board in another capacity, but I am leaving you in the capable hands of Danielle Williams. She will, no doubt, do an excellent job of leading our organization. Again, thank you for your trust and confidence in me. It has been an honor to serve as SETAP's President for the 2017-2018 term.

Inserting the Section Symbol in Microsoft Word Legal writing often requires use of the Section Symbol (§). But there is no § key on the keyboard. So how do you insert a § into your document?

The fastest and best way to do almost anything in Word is to use the keyboard. Hold down the ALT key, then type the number 0167 on the numeric keypad on the right side of your keyboard. This does not work with the number row at the top of your keyboard.

If your keyboard does not have a numeric keypad (most laptops) or embedded numeric keys enabled by a Num Lock key, there is Ribbon-based method.

- Click on the Insert tab of the Ribbon. - Click on the Symbol tool and click More Symbols. Word will display the Symbol dialog box. - Click the Special Characters tab. - Choose “Section” from the list of characters. - Click the Insert button

The Section Symbol will then appear in your document at the insertion point.

Bonus Tip: The Section Symbol is called the silcrow. The Paragraph Symbol is called the pilcrow.

MEDICAL RECORDS IN PERSONAL

INJURY CASES

Congratula�ons, you now have a stack of medical records to review eight inches high that you either subpoenaed, requested, or your client provided! What now? Reviewing and performing a medical record anlysis can be a big task, and a�en�on to detail is key. The purpose of this ar�cle is to help paralegals save the personal injury a�orney and client some �me and anxiety, and hopefully, help you to dig out the key informa�on.

When you are confronted with any task, it helps to first have a clear idea of what your objec�ve is and then work from the largest part of the task down to the finer parts. Well before you prepare the medical records request, it is most helpful to first have the client complete a medical ques�onnaire so that you have a good idea of what records you will need to request. Work with your a�orney and the client to discover the different issues to look for in the medical records so you know what to ask for from the providers.

Read The Typewri�en Records First1. Once you obtain the medical records your first task is to sort through the records and look at the ER, History and Physical, Discharge, Consults and Admissions records. These are o�en typewri�en. Ignore all handwri�en notes for now. For example, "Discharge Summaries" and "Consult Reports" are invaluable because they quickly summarize the case and point out for you where you will need to look next. Be aware that a discharge summary may simply refer to a pa�ent being discharged from one unit in the hospital, such as the emergency room (ER) or intensive care unit (ICU), and transferred to floor care or some other unit within the same hospital, so there may be more than one discharge summary for the same pa�ent.

2. You will now want to see if there are any "objec�ve" findings in the ER records or consult reports. Objec�ve findings can mean different things to different medical experts, but basically objec�ve refers to findings which are not under the voluntary control of the pa�ent. For example, an x-ray of a fracture is an 'objec�ve" finding since it will show an actual picture of the fracture. This is part of the nuance of a medical records analysis.

As an example, less obviously objec�ve is an x-ray of the neck that shows a "loss of cervical lordosis" or a "straightening of the cervical curve." The cervical spinal column in the neck has a natural curve, and a loss of this curve may show that the neck was going into muscle spasm and thereby caused the neck to involuntarily straighten.

"Spasm" is the involuntary �ghtening of muscles and is frequently associated with strain/sprain type injuries and pain. Healthcare prac��oners, such as chiropractors and physical therapists, are trained to feel muscle spasm when they examine a pa�ent. In par�cular, if you see a nota�on of asymmetric spasm, this might be a more reliably "objec�ve" finding. For example, try tensing the muscles of just one side of the back of your neck, and you will realize just how hard it would be to fabricate such a finding.

RECORDS IN PERSONAL INJURY CASES - CONT’D3. You should now look through the records for whatever radiology reports are available. Fortunately, these are almost always typewri�en and easy to read. Look for key words such as "acute" which indicate that the injury happened during the car crash. When looking at a spinal CT or MRI scan report, look for terms that indicate that the nerves are pinched, such as with an "impingement," or that something is rubbing up against the nerves as when something is "effaced." Disc bulges or protrusions are obvious, but also look for less obvious things, such as an "annular fissure" or a "torn annulus." A simple annular tear may not seem like much, but this tear in the spinal disc can be quite painful and very difficult to treat. A finding of an annular tear is something to bring up with your neurology expert for a further opinion.

4. Much less reliable will be the intake notes as to how the incident happened. For a vehicle collision, the doctor will want to know the pa�ents ini�al symptoms during the crash, but will not be concerned with who was at fault. It is s�ll worthwhile to look for in the intake records, par�cularly if there is no police report, to at least get the plain�ff's recollec�on of events close to the �me of the incident. However, be forewarned that the caregivers who do follow-up care will frequently just quote the intake notes, along with any inaccuracies, when beginning their own chart notes.

5. Look for condi�ons that may require follow-up care. For example, "ORIF" is simply jargon for "open reduc�on internal fixa�on" surgery to repair a broken bone using surgical screws. So in that instance, you would con�nue to search the typewri�en records to see if there is anything about how long the cast (if any) was in place; if a course of physical therapy was started a�er the cast was removed; and if there were any adverse reac�ons to the surgical screws. It would not be too unusual to have to remove some of the surgical hardware if it was causing inflamma�on or some other sort of problem. There should be some indica�on of such inflamma�on in the follow-up reports if it existed.

6. Ordinarily, you can just ignore the reams of laboratory data that will inevitably accompany a pa�ent's records. However, if for some reason a par�cular lab value, such as blood sugar (glucose), is important to the case, there will usually be a guideline as to what "normal" values should be. Find these normal values at the top or bo�om of the page, or some�mes on a separate page, and then just go back and look at what the actual measured values were.

Be aware, however, that the lab values found in an autopsy report are not exactly like the medical record of a living person. Alcohol, for example, ferments in the body a�er death. So a blood alcohol level taken on autopsy a�er death does not necessarily correspond with the blood alcohol as it existed at the �me of death. You will almost certainly need to consult a pathologist for an expert opinion on the post mortem toxicology.

Medica�onsIf you run into an unfamiliar medica�on or medical condi�on while reviewing the records, do not be afraid to "Google" it. We have available to us wonderful and instant access to a whole range of medical knowledge, if we simply take a few minutes to research it on the internet. Looking up a condi�on, such as "carpal tunnel" may not make you an instant expert, but you will at least know whether or not it can be caused by trauma.

RECORDS IN PERSONAL INJURY CASES - CONT’DCommon Abbrevia�ons Found in a Medical Record ReviewWhile reading the typewri�en or even handwri�en notes, look for abbrevia�ons which may easily indicate what is being referred to. For example, "C/O" in the "History and Physical" notes is shorthand for "complaining of." What follows will immediately summarize the pa�ent's complaints as they existed at that �me. Similarly, a number "2" with what looks like a degree symbol a�er it stands for "secondary to." In other words, for example, neck pain "secondary to" a car accident simply means that the onset of neck pain happened a�er a car accident.

Other abbrevia�ons refer to frequency, such as when an ordered medicine is to be given. QID means four �mes a day; TID means three �mes a day; BID means twice daily, and PRN means that the medica�on, such as pain medicine, is to be taken as o�en as needed for pain control. "PO" means that the medica�on is to be given orally. A small "c" with a line over it means "with" and a small "s" with a line over it means "without." Remember that medical records use scien�fic terminology, so a small triangle means "change," and not "defendant," as it would in law.

Move On To The Handwri�en NotesAt some point you are probably going to need to deal with the handwri�en notes. When a medical records request is made, they will contain nurses notes, which are o�en handwri�en. For example, there may be no typewri�en discharge summaries or intake reports, and you are simply going to have to go through the records looking for documents en�tled as such. Some prac��oners, such as chiropractors, frequently have handwri�en notes only, so you will have to try to wade through the usually unintelligible handwri�ng. Fortunately, even here there should be a couple of helpful areas in the file for you to focus on.

1. The first is the "pain diagram," which is a schema�c outline of a body with coded areas of pain. This is usally filled out by the pa�ent, and is an invaluable record, in the pa�ent's own "words," of what the pa�ent was complaining of at the �me.

2. The other helpful handwri�en records will be labeled "SOAP" notes. This is just a standardized "Subjec�ve-Objec�ve-Assessment-Plan" format. The doctor may not s�ck strictly to the format, but you should be able to at least make out what the pa�ent's subjec�ve complaints were when first seen; what objec�ve findings were found; and what the diagnosis (assessment) was. The other place to quickly find the typed diagnosis from a chiropractor is on the billing pages.

Follow Up and Final ReviewBy now you should have a good idea of what is in the medical records and performed the medical record summary so there may not be any need to dig further into the handwri�en notes.

Now is a good �me to consider if you want to hire a medical legal expert, such as a neurologist or orthopedic surgeon, or you may find that you need to subpoena or do a request for medical records first. A final and more detailed review should then be done.

RECORDS IN PERSONAL INJURY CASES - CONT’D1. For example, go back now and pay par�cular a�en�on to the "pa�ent history" sec�on of the ER and consulta�on reports. If there is any indica�on of pre-exis�ng chronic pain or a previous accident, for example, there may be more records from other care providers that you will need to subpoena before you can contact your expert or complete the Judicial Counsel Form Interrogatory responses. Also, be sure to pay a�en�on to the "current medica�ons" sec�on of the ER or "History and Physical" records. If the pa�ent was already on narco�c pain medica�on, for example, there may be a pre-exis�ng problem which you are not aware of.

In the example of carpal tunnel above, you would have found from your "Google" search that this is a syndrome that frequently comes on slowly over �me from repe��ve use of the wrist, such as when typing, rather than from a trauma�c event. So you would now need to search the records for complaints of "parasthesias" (unusual sensa�on such as numbness) in the hands before the incident. You might need to subpoena previous records to find out if the carpal tunnel was caused by work and not by the incident.

2. Before you answer the Form Interrogatories or hire an expert, there is one last source of rela�vely cheap informa�on that you should not ignore. Contact the trea�ng doctor. For example, if you have a plain�ff who had a torn ACL in the knee repaired a�er a collision; contact the surgeon to confirm the surgeon agrees that the car accident was the cause of the injury and created the need for surgery. You can almost always set up a short free telephone conference or perhaps one cos�ng only a couple of hundred dollars. This can do a lot to flesh out your medical records review and summary.

3. Although not strictly related to the records, you should make every a�empt to a�end the defense medical examina�on. At the defense medical examina�on you can personally observe what tests were actually performed by the doctor and, more importantly, see for yourself how the plain�ff reacts. Check the narra�ve report for the results of orthopedic tests that the defense doctor claims were performed.

I hope this overview helps the next �me you are reviewing a stack of apparently disorganized and illegible medical records. Always remember that whatever you find in the medical records yourself is only part of the picture. Ul�mately you are going to need a medical expert who knows the records and can tes�fy to an opinion on the cause of each injury, the nature and extent of each injury, and the reasonably necessary past and future medical charges associated with the injuries. However, a well done medical records review can go a long way for ge�ng to the facts of the personal injury case.

Judicial Committee on Information Technology Recommends Additional Roles for Re:SearchTX

The Judicial Committee on Information Technology (JCIT) met on May 4th to discuss additional recommendations to the Supreme Court regarding Re:SearchTX (the statewide electronic court document portal). The committee recommended expanding the system by adding roles for Attorneys not on a case and for Registered Users (general public with a registration process). The committee also recommended fees of $0.10/page up to a max of $6 per document. The money generated from these fees would go directly to the county where the document originated.

The committee is still finalizing permissions for Registered Users, but is expected to make recommendations by the end of June.

As a reminder, Re:SearchTX is up and running for all Judges, Clerks, and Attorneys on a case. Register by going to https://research.txcourts.gov.
