Summary Statement: The City of Palmer Airport Advisory Commission has recommended this amendment to update the “Intent” language of the Code and amend Building Setbacks in PMC Chapter 17.44 A-C Airport Commercial District, 17.48 A-I Airport Industrial District and 17.49 A-M Airport Mixed Use District.

Background: Currently, the “Intent” language of the Code in the Airport Districts references “the airport layout plan prepared by HDL Engineering Consultants, July 2004”. This text amendment will update the language to reference “the latest Airport Layout Plan approved by the Federal Aviation Administration”.

In addition, the current building setbacks in the Airport Commercial, Industrial and Mixed Use Districts from lot lines are “10 feet minimum.” This is more restrictive than the setbacks in the C-G General Commercial District and limits the ability to provide compact commercial style development on the Airport. Providing an opportunity for “zero lot line” development enhances development alternatives at the airport.

The “zero or 10 feet minimum” would be determined by design and conformance with building code.

After review of the Airport Districts in the Code and discussion with the Airport Manager, City Manager and Building Inspector, it was determined by the Commission to recommend that the 10-foot minimum building setback from the lot line requirement should be changed to “zero or 10 feet minimum,” and that the intent language be updated to reference the latest Airport Layout Plan. This text amendment will update the building setback from lot lines in the Airport Districts.

THE CITY OF PALMER, ALASKA ORDAINS:

Section 1. Classification. This ordinance shall be permanent in nature and shall be incorporated into the Palmer Municipal Code.

Section 2. Severability. If any provision of this ordinance or any application thereof to any person or circumstance is held invalid, the remainder of this ordinance and the application to other persons or circumstances shall not be affected thereby.

Section 3. Chapter 17.44.010 is hereby enacted to read as follows (new language is underlined and deleted language is stricken):

To prohibit uses that are not industrial- or manufacturing-oriented and dependent upon or related to aircraft and their use; D. To prohibit residential use of land; E. To be consistent with the airport layout plan prepared by HDL Engineering Consultants, July 2004 latest Airport Layout Plan approved by the Federal Aviation Administration; and F. To give preference to aeronautical uses.


17.49.010 Intent. The A-M district is intended to provide for the safe and orderly use of lands where the best use is for airport-related noncommercial, commercial and retail purposes. The specific intent in establishing this district is:

A. To provide land for noncommercial, commercial, and retail operations that are dependent upon the use of aircraft or are involved in the maintenance of aircraft or aircraft parts and equipment; B. To locate aircraft-related uses in an area where their activities will have minimal effect on residential areas;

Summary Statement: In accordance with IM No. 16-029 and Resolution No. 16-017, the City Manager applied for a Water and Waste Disposal Grant with the U.S. Department of Agriculture (USDA) Rural Utilities Service. Upon review of the application and discussions with the City, the USDA has offered the City of Palmer a loan and grant in the amount of $8,334,290.00 for required improvements and upgrades at the Waste Water Treatment Plant (WWTP). This funding is broken into a $3,518,290.00 grant and a $4,816,000.00 loan (1.875% interest). This offer will cover both phase 1 and 2 of the required upgrades over a two-year construction period. Additionally, the loan amount does not fully use our voter approved borrowing capacity ($5.9M including prior year approvals). Grant and loan disbursement is subject to USDA requirements as outlined in the Letter of Conditions. Administration’s Recommendation: Approve Resolution No. 17-007 accepting the USDA grant for $8,334,290.00 for required upgrades to the Palmer WWTP.

WHEREAS, the City of Palmer needs monies to bring the city Waste Water Treatment Plan into compliance with its permit requirements, Environmental Protection Agency standards and Federal consent decree requirements and;

WHEREAS, the U.S. Department of Agriculture Rural Utilities Service has offered the City

of Palmer a grant and loan in the amount of $8,334,290.00 dollars to assist in bringing its Waste Water Treatment Plant into compliance;

NOW, THEREFORE, BE IT RESOLVED, the Palmer City Council hereby accepts the grant and loan from the U.S. Department of Agriculture Rural Utilities Service in the amount of $8,334,290.00 dollars.

Summary Statement: The City of Palmer has been granted a State of Alaska, Department of Transportation and Public Facilities, Small Federal Programs, Alaska Transportation Alternatives Program Grant in the Amount of $115,300.00 for the Installation of American’s with Disabilities Act Compliant Sidewalks, Driveways and Curb Ramps, in accordance with the City of Palmer 2006 Comprehensive Plan. This is a federal match program with federal funds in the amount of $93,240.00 and city match of $22,060.00. The city match was budgeted in capital funds. The purpose of this project is to update and bring additional Palmer sidewalks, driveways and curb ramps into ADA compliance. This grant will allow the City of Palmer to update sidewalks, driveways and curb ramps from the East side of S. Cobb St. to the West side of S. Alaska St, and from the North side of W. Dahlia Ave to the North side of W. Dogwood Ave. This a continuation of work on ADA compliant curbs and ramps the city has conducted in the past and will continue as funds are available in the future. WHEREAS, the City of Palmer needs monies to bring city sidewalks, driveways and curb ramps into ADA compliance and;

WHEREAS, the State of Alaska, DOT&PF, Alaska Transportation Alternatives Program Grant

in the amount of $115,300.00 dollars has been awarded to the City of Palmer;

NOW, THEREFORE, BE IT RESOLVED that the Palmer City Council hereby accepts and appropriates the State of Alaska, DOT&PF, Alaska Transportation Alternatives Grant in the amount of $115,300.00 to General Capital Improvement Projects Fund 08 for upgrading City of Palmer sidewalks, driveways and curb ramps.

Summary Statement: Staff is requesting approval to purchase 151 new LED street light luminaires factory direct from Cree Lighting c/o Arctic Sales. They have provided a lump sum quote of $107,774.00.

The Department of Public Works will remove existing high pressure sodium street light luminaires that are mast arm mounted and install the new LED street light luminaires on Eagle Avenue, North Gulkana Street, East Steel Loop, South Chugach Street, Anderson Circle, Glacier View Drive, East Cope Industrial Road, South Colony Way, West Evergreen Avenue, South Bailey Street, South Colony Way, and North Valley Way.

Installation of the new LED lights will reduce power consumption by approximately 50% and reduce repair and maintenance man hours and equipment time.

The Department of Public Works has a budget of $110,000.00 for LED Street light replacement in 2017, and with sole source factory direct purchasing, can purchase 151 LED street light luminaries.

Palmer Municipal Code allows for proprietary procurements. A sole source purchase as provided in PMC 3.21.230 A.3., is appropriate in this case to assure the procurement of equipment that is consistent with the previous light fixture purchases to reduce repair part inventory and improve efficiency in maintaining these fixtures.

Summary Statement: The City issued a request for bids on November 8, 2016 for the procurement of Phase I Moving Bed Bioreactor (MBBR) equipment for upgrades at the Waste Water Treatment Plant (WWTP). This is the Moving Bed Bioreactor equipment and media. Two responsive bids were received and opened on December 6, 2016. Upon review, it was determined that Kruger, Inc. had the lowest responsible, responsive bid.

Kruger, Inc. - $918,760.00 World Water Works - $1,054,321.00

Approval of this contract will set the first phase of the upgrades to the WWTP in motion. Final design and material procurement documents will be completed by January, 2017, with a request for bids for construction of the MBBR issued in early spring 2017.
