Early Peddlers Marengo Co. Deed Book AI, p. 63 11 May 1847. Moses Levi to Julius Lehman. Whereas Levi is indebted to Lehman, is engaged in the business of peddling in Sumter Co. AL, and is possessed of but little and small means. First Recorded Deeds ofLands in Range 1 East A portion of western Marengo County falls in the six-mile-wide strip of land known as Range I East. Below are all deeds for that range found in Deed Books A and B; no deeds were recorded for the range in Townships 16 or 18. A number of land sections bordering the Tombigbee River or Clarke County were "fractional"; here the notation "frs" is u ed to indicate such sections. Thomas Ringgold and George Cuninghame. who appear as witnesses in several deeds, were, respectively, the judge and clerk of the county court.

Income from sd. property is very small; there is a good house on the land, but "no valuable timber or other things" on sd. land that would make it desirable to hold as an investment. She waives her right to dower, asks that land be sold for partition bet. herself and sd. minor. Depositions of Alley Etheredge and Ashby Etheredge of Putman, AL (signed A. P. Etheredge and A. H. Etheredge 21 Dec 1929 bef. cmmr. Jewell Loftin): We are over age 21, acquainted with Mamie E. Adams (over age 21) and Ruby Maline Downey (age 7), knew R. E. Downey during his life. He owned sd. land, left no other heirs at law or next of kin besides sd. widow and child. Sd. land consists of about 85 a. of hill land located about 2 miles E of Putman and about lOa. on Horse Creek. These lands have been cleared and wore out, but part of it is still very good working land. The most valuable part of it is dwelling house located on it, at pres nt in very good state of repairs. There is no timber on the land that could be sold. Land cannot be divided equitably for the reason that house, as it stands, is worth mor than the land, and the house would be worth very little without the land. Mrs. Mamie E. Adams now resides and has a home at Thomasville. She and little girl could not live on the land by themselves and earn a Jiving, so they have been compelled to leave the place. House and land would not rent for as much as taxes and interest on the money it would sell for and house being left unoccupied or rented out would soon go to ruin and be a total loss.

Estate Records of a Stranger in Town On 30 Apr 1825, Julius Martiniere of Marengo Co. filed his 29 Apr 1825 petition for temporary letters of administration on the estate of Louis Debat, alleging: • Debat, of Demo lis, died 28 Apr 1825 • at his d ath he possessed property to a large amount, precise sum unknown, c<Esisting of notes, money, and articles unknown to petitioner • said notes and money are in hands of a woman who lately lived with decedent • h has heirs but none of them reside in Alabama • unless prtVer steps are taken, all decedent's property now in possession of said woman Magdaliene may be totally losb to his heirs (and any creditors), as the same appears to consist of money and paper securities, liable to be embezzled and removed out of the state • said woman has no known property nor relations and will in .til probability leave this country • deced nt's estate may be worth from three to four thousand dollars (petitioner knows this only by ing informed, decedent being a stranger and not long a resident of this coun!}).

Wiggins, who died in 1840s leaving minor children Martha M., Rosetta, and Rowe A. and about 24 slaves, all now hired out in Marengo Co. AL: man Frank, man Randall, man Newbern, man [blankl, woman Edy, woman Charity, w man Tempy, woman Listra, w man Pindia, about fifteen children (issue ofsaid women). "The value of slaves in Alabama is now very high; on account of the good character of most ofth slaves ab venamed ... they would sell at the present time for a high price; such sale could be made without separating any of the families that compose said slaves ... refer to the accompanying affidavit of Memorable W. Creagh, W. F. Perkins and others who are men of high respectability and much experience residing in the County of Marengo in the neighbourhood in which the slaves have been living and are well acquainted with their character and situation."

Affidavit: "State of Alabama, Marengo County} Before me, Young M. Moody, an acting justice ofthe peace in and for Marengo County and State of Alabama personally came Memorable W. Creagh, Salem T. Newton, Thomas McCorkle, William Morris, & Wm. F. Perkins, who being duly sworn they are they [sic] acquainted with the negroes belonging to the estate of the minor children ofThomas R. H. Wiggins deceased. There are some men, som breeding women, and there are many children among them. That they believe the interest of the children entitled to said negroes will be materially [promoted] by their sale for the following reasons: Negroes are now commanding a very high price and they believe they would all sell high. That there are many breeding women among them who require much more attention than persons only hiring them are willing or will give them, and for the want of this attention we believe they will loose some of them which by proper care would not die. That there are also many children belonging to said estate, and from our experience of the attention usually given to negro children by persons only having the interest ofa hirer in them, we are satisfied that for the want of that care which those o'>'ming them would gi e them, many will die. The men belonging to said estate too having no owners present to restrain their hirers and watch over their wei fare bel ieve [sic] be neglected and subject to hardsh ips wh ich will cause them to depreciate in value. The only person having control over the e said negroes, or rather to see after their welfare, being an agent of the guardian of said minor, we are satisfied that they will not be properly cared tor. TIlese facts together with the expense which will nee ssarily be attendant on their neglected state induce [us] to believe that the money which would be now obtained for said negroes would be more advantageous to the children interested in said negroes than to obtain possession of them and hire them out."

Last Will and Testament ofAlbert Sander, 1922 The last will and testament of Albert Sander of Demopolis, of sound mind and disposing memory, and over age twenty-one, was dated 26 Jan 1922 at Demopolis and witnessed by 1. B. Taylor and Henry McDaniel. t was filed 20 Jul 1922 and recorded in Marengo County Will Book E on pages 129 to 131.

ITEM 1. Executors to pay all my just debts and fi.meral expenses as soon after my death as practicable.

ITEM 2. Bequest to the Jewish Widows and Orphans Home of New Orleans LA, $300. To be paid by my executors as soon after my death as practicable.

ITEM 3. Bequest to the United Charities of Demopolis, S1000, and to the Temple Guild of the Jewish Synagogue of Demopolis, $200; each bequest to be known as Lee and Albert Sander Memorial Fund. To be paid by my executors to Robertson Banking Company of Demopolis as trustee as soon after my death as practicable. Bank shall lend out funds to best advantage possible and on first class security or invest same in U.S. and State bonds. Net income from sd. $1000 to be paid annually to United Charities of Demopolis, to be used by it as its officers may direct. Income from sd. $200 to be paid annually to Temple Guild to be used in keeping up, caring for, and beautifYing the Jewish Cemetery located at Demopolis.

Long: all of the land owned by me in Marengo Co. outside Demopolis, being my small (160-a.) farm located below Old Spring Hill, known by me as the Royall Place, and my 340-a. farm in the Jefferson-Moscow section (which I bought from Dr. G. E. Jones). ITEM 5. To my sister Mrs. Emma Long: all my real estate in Demopolis, being my store house and lot. ITEM 9. My nine nieces and nephews are to share equally in my estate with the exception of the special bequests in [terns 4 and 5, but as two of my sisters are still living, it is my will that they may during their lifetimes have charge ofand enjoy the income from the part of my estate devised to their children.

Estate ofJohn Wills, a Minor This [11 Mar 1872] being the day appointed to hear the application of Nancy Wills for Letters of Guardianship on said Estate to be granted to W. A. Stickney as the Guardian of said Minor: Now comes the said applicant and moves the Court that such application be granted. And it appearing to the Court that said John Wills is over fourteen years of age and has nominated said W. A. Stickney and requests the Court to appoint said Stickney to be the Guardian of him the said minor. And it further appearing that all of said parties reside in this County and that the said W. A. Stickney is a suitable person to be the Guardian of said Minor: It is therefore ordered and decreed by the Court that said W. A. Stickney be and he is hereby appointed Guardian of the person and Estate of said Minor; and said Stickney having filed his bond as such Guardian in the sum of$l 00.00 with W. M. Booker and W. B. Collins as his sureties therein, which bond and security has been approved by the Judge oftbis Court: It is ordered by the Court that the proper Letters of Guardianship do issue forthwith to the said W. A. Stickney. It is further ordered that said application be recorded, and the same is in words and figures, to wit: Faunsdale P. Office, State ofAlabama, Marengo County. To the Hon. R. L. I offer the plea ofnecessity to sustain my petition for this appointment at your hands. 15t I am incapable of discharging that office myself in behalf of my own & son's interest. 2nd I seek protection of my legal rights to my son's earnings, which his father has usurped & made way with the past six years, without recognizing in any manner my maternal rights or bodily wants. 3rd I am constitutionally feeble & unable from periodick mental affliction to maintain myselfuniformly in scanty comfort. 4th I am not willing longer for this father to take any charge of my son's industrial interests, b cause of unfitness to act a correct or just part by my son or self, from his wasteful dissolute intemperate habits; & because he is the recognized husband of a wife with a large family of children, as well as the father of numerous children, ages & sexes, about him fi:om vatious mothers. Now for these foregoing reasons & th"t hereafter Jmay be secured beyond all doubt in my lawful rights & privileges to enjoy the presence & services of my only son, I humbly beg that you will appoint as his Guardian the Rev. 11 Mar 1841. Maria S. Tillinghast to John B. Hogan. He has covenanted with her to payoff all debts owed by her to sundry creditors by various undertakings of hers, debts owed by her as exx. ofher late husband David H. Tillinghast on account of his debts at his death, and debts she contra,,1ed in management ofaffuirs ofsd. estate, so that her separate property shall not be subject to payment of same. "EARTHQUAKE: ALABAMA TO THE FRONT WITH A SHOCK That Shakes up the Waters of the Flowing Tombigbee." Mobile, Feb. 16 - Capt. Stone, of the steamboat Moore, brings news ofan earthquake Saturday at daylight on the Tombigbee river, in Choctaw, Sumpter, and Marengo counties. The noise, as of distant discharge of cannon, was followed by a trembling of the earth continued for two minutes. Many people thinking the roofs of their houses were falling fled without waiting to dress. At Moscow the ground raised up and down about half a foot and suddenly subsided, while trees swayed from side to side, accompanied by the falling ofdecayed limbs. At Beckley's Landing, the plastering in Mrs. Crane's house was shaken down. She escaped in her night clothes. At Rembert's Landing crockery was thrown from the shelves, chairs overturned, etc. Oak and china trees rocked terribly, and men and cattle were thrown from their feet. The same is true at Tompkin's Bluff, but Dot further down the river. [According to the U.S. Geological Survey (http://neic.usgs.gov/neisistatesialabamaJalabama_history.html), this is the second earthquake of consequence in Alabama for which there are records, the first being one nine days earlier in the same area.]

Demopolis, Feb. 17 - Lieutenant Cornish, an army officer from Fort Pembina, Dakotah, is visiting his father, Mayor T. G. Cornish. He descibes the lands in the valley ofUpper Red river as similar to our canebrake region, and very productive ... Mr. G. H. Gunlock is building a nice residence on his lot near the railroad crossing, and the chairman of the school board, Mr. Prout, is having the academy building overhauled. The city government continue to make some nice improvements. The next thing is to be a pavilion at the artesian well in the public square.

Hasty, Judge of said Court: Your petitioner, Bob Foster, who is a resident of Demopolis, in the County of Marengo, State of Alabama, and who is over the age of twenty one years, respectfully represents lUlto your Honor: That on or about the 25th day of June, 1916, Margaret Foster departed this life in the City of Demopolis, County of Marengo, State of Alabama, leaving a last will and testament, wherein and whereby your petitioner was bequeathed the entire estate of said decedent; that said will was attested by L. G. Ward and Bob Foster, your petitioner, both of whom reside in the County ofMareogo, Alabama., and your petitioner herewith produces to your Honor and propounds for probate and record in this Court the said last will and testament of said decedent.

2. That said decedent was married at the time ofher death, your petitioner being at that time her husband, and that her next of kin so far as your p titioner knows are as follows, to wit: Bob Foster the husband at the time of her death of said decedent, who resides in the County ofMarengo, State of Alabama, and Digger [clerk indicates error for "Digger"] Jones, a grandson of said Margaret Foster over the age of twenty one years aDd whose whereabouts are unknown to your petitioner, who alleges and avers that he has not been heard ofor from within the past five years. The premises considered, petitioner prays that a day be set for the hearing of this petition, and that due notice, as required by law be given to the next of kin of said decedent, and that such other proceedings, orders and decrees may be had and made in the premises as may be requisite and proper to effect the due probate and recording of said will according to law. Hasty, Judge of Probate in and for said County, personally appeared in open Court Bob Foster who, having been by me first duly sworn and examined, did depose and say on oath, that he is a subscribing witness to the instrument of writing now shown to him and which purports to be the last will and testament of Margaret Foster deceased, late an inhabitant of this County; that said Margaret Foster since deceased, signed and executed said instrument 00 the day the same bears date, and declared the same to be her last will and testament, and that affiant set his signature thereto on the day the same bears date as a subscribing witness to the same in the presence ofsaid Margaret Foster and that such other witness L. G. Ward subscribed his name as a witness in his presence and in th presence of said Margaret Foster and that said Margaret Foster was of sound mind and disposing memory, and, in the opinion of the deponent, fully capable of making her will at the time the same was so made as aforesaid. G. Ward; that the said L. G. Ward is a non resident of the State of Alabama residing somewhere in the State ofIllinois, his exact place of residence being unknown to affiant - that as he has herein before stated., he has also examined the signature to the said L. G. Ward, one of the attesting witnesses to said will, and known that the same was written by the said L. G. Ward and that the same is in the handwriting of the said L. G. Ward; and, affiant further says, that he has talked with the said L. G. Ward, and that the said L. G. Ward stated to him affiant that he L. G.
