JOINT STATUS REPORT

Pursuant to the Courts Order dated August 26, 2011, Defendant Federal Housing

Finance Agency has performed a segregability analysis and released to Plaintiff all reasonably

segregable non-privileged information from the two contested documents (identified as

documents 2 and 3 in the Vaughn index). The redacted documents are attached as Exhibit A to

this Joint Status Report.

In light of this supplemental production, Defendant FHFA renews its motion for

summary judgment on the basis that these two documents are protected by the deliberative

process privilege and Defendant has produced all reasonably segregable non-privileged

information from the two contested documents. Plaintiff McKinley requests that the Court

review the material produced against the material it reviewed in camera and order FHFA to

produce any additional segregable material as required by law.
