What is Mediation?

Mediation is a process which enables parties to resolve disputes through dialogue and negotiation, facilitated by an impartial, qualified third party – the mediator.

The mediator does not take sides, judge or give advice, their role is to facilitate discussions objectively, helping the disputing parties to identify the core of their dispute and arrive at a solution which works for them.

Mediation is a voluntary process. It is confidential and “without prejudice”, so parties are free to discuss matters openly. Issues can be resolved swiftly and, if a solution is not found through the mediation process, parties are free

to resume legal proceedings.

Booking a Mediator

We have established a panel of mediation specialists experienced in a wide range of legal areas including: Civil & Commercial | Family | Workplace and Community Mediation.

You can easily book one of our mediators using the booking form on the mediation page on our website. Simply complete the type of claim, value, location and preferred dates and our Booking Team will provide you with a selection of qualified mediators from which to choose. Alternatively, if you have a specific person in mind, just complete the form on that individuals’s page.

Papers regarding the mediation can be securely uploaded via our online portal or sent direct to the mediator. Fees are payable in advance of the mediation session. We only accept mediators who have successfully completed training with an accredited trainer, have no history of professional indemnity claims and adhere to the European code of conduct for mediators. Our mediators are bound by strict confidentiality provisions and must advise us immediately if there is any reason why they cannot take a case, including conflict of interest.

Q What do your mediation fees cover?

A Our quoted fees include one day’s mediation (10am - 5pm), 4 hours’ preparation,

mediator’s travel time and all administration.

Q Can I choose a mediator?

A You are free to select any mediator from our panel, or we can recommend a choice of

mediators, based upon your specific requirements.

Q Will the mediator reach a judgment on the dispute?

A No; the mediator will remain wholly neutral and will use his/her skills to facilitate

discussions and negotiations with a view to enabling the parties to reach a settlement.

Q Can the mediator be called to give evidence in subsequent proceedings?

A No; you agree prior to the mediation that you will not take any steps to require the mediator to give evidence or produce documents in respect of the dispute. The mediation is confidential and without

prejudice.

Q Can the mediation be terminated early?

A Yes; mediation is an entirely voluntary process and any participant is free to end the mediation

at any stage.

Q Can Kearns arrange a venue for the mediation?

A Yes; a venue and catering can be arranged for an additional cost; please contact us for further details.
