CHAPTER 1 - ADMINISTRATIVE SECTION 1.1: GENERAL PROVISIONS 1.1.01 TITLE. These regulations promulgated by the County of Medina, State of Ohio, shall
be known as the Medina County Building Regulations hereinafter referred to as “MCBR”.
1.1.02 PURPOSE. The purpose of these regulations is to provide basic uniform regulations and
reasonable performance objectives to achieve reasonable safeguards for the safety, health and welfare of the occupants of the buildings and the general public.
1.1.03 EFFECTIVE DATE. These regulations shall take effect as provided herein and shall
supersede any previously adopted Medina County Building Codes. 1.1.04 MINIMUM REQUIREMENTS. The provisions and requirements of these regulations
shall be construed to be minimum requirements, and where not in conflict with any specific provision herein, shall not prohibit any person from exceeding these minimum requirements.
1.1.05 RELATIONSHIP TO OTHER LAWS. Nothing contained in these regulations shall be
deemed to nullify or repeal any provision of the zoning regulation or any other law pertaining to the location, use or type of construction of any structure or other condition to which these regulations may apply, except as such nullification or repeal may be specifically asserted by specific provisions of these regulations.
1.1.06 PARTIAL INVALIDITY. In the event any part or provision of these regulations is held
to be illegal or void by a court of competent jurisdiction, such decision shall not have the effect of making illegal or void other parts or provisions of these regulations. It shall be presumed in such event that these regulations would have been enacted had such illegal or invalid parts or provisions not been included, and the remainder of these regulations shall continue in full force and effect regardless of the extent to which such illegal or invalid parts or provisions may be integrated in the remaining portions of these regulations.
1.1.07 AUTHORITY. Authority to adopt these regulations is per Ohio Revised Code (ORC)
3781.01 & 307.37 including the requirement to advertise and hold public hearings. SECTION 1.2: STATE STATUTES, RULES, COUNTY REGULATIONS, ZONING AND FIRE AUTHORITIES 1.2.01 RESIDENTIAL CONSTRUCTION, OHIO LAW (STATUES AND RULES).
Medina County shall regulate residential construction (one-, two-, and three-family dwellings and their accessory structures) in accordance with ORC 3781 and the rules adopted by the State of Ohio pursuant thereto in accordance with the certification issued by the State of Ohio, as herein.
1.2.02 NON-RESIDENTIAL CONSTRUCTION, OHIO LAW (STATUTES AND RULES). Medina County shall regulate non-residential construction as defined by ORC

3781.06(B)(10) in accordance with ORC 3781, 3791, and the rules adopted by the State of Ohio pursuant thereto in accordance with the certification issued by the State of Ohio, as amended herein.
1.2.03 MANUFACTURED HOME INSTALLATION, OHIO LAW (STATUTES AND
RULES). Medina County shall regulate manufactured home installation as defined by ORC 4781.01(B) & (C) in accordance with ORC 4781 and the rules adopted by the State of Ohio pursuant thereto in accordance with the certification issued by the State of Ohio.
1.2.04 MEDINA COUNTY BUILDING PERMITS. Ohio law referenced above requires any
owner or authorized agent who intends to construct, enlarge, alter, repair, move, or change the occupancy of a building, residential building, or structure, or portion thereof, or to erect, install, enlarge, alter, repair, remove, convert, or replace any electrical, gas, mechanical, plumbing system the installation of which is regulated by State of Ohio rules, or to cause any such work to be done, shall first make application to the building official or residential building official as appropriate and obtain the required approval. In addition to the approvals required above, owners or authorized agents shall make application to the building department for an additional instrument, which is a building permit. Approval of a permit requires compliance with:
(A) Medina County Stormwater Management and Sediment Control Rules and
Regulations (Highway Engineering Department).
(B) Medina County Flood Damage Reduction Regulations (Highway Engineering Department).
(C) Medina County Commissioners’ Highway Use Manual (Highway Engineering
Department).
(D) Medina County Sanitary Engineering Department regulations.
(E) Medina County Health Department regulations.
(F) Medina County Auditor regulations regarding tax map parcel documentation.
(G) Requirements in this regulation regarding heating, ventilation, and air conditioning contractor registration and electric contractor registration.
(H) Zoning regulations as enforced by the township, village, or city zoning authority.
(I) State of Ohio rules adopted by the Board of Building Standards and the Ohio
Manufactured Homes Commission as applicable. Expiration of plan approvals under these rules causes the County permit(s) to be invalid.
1.2.05 RELATION TO TOWNSHIP, VILLAGE, AND CITY FIRE CODES. In addition to
complying with the Medina County Building Regulations it is the responsibility of the applicant to comply with all local fire codes in a township, village, or city that has enacted such codes.

CHAPTER 2 - BUILDING DEPARTMENT AND PERMITS SECTION 2.1: MEDINA COUNTY BUILDING DEPARTMENT 2.1.01 CREATION. The Medina County Building Department hereinafter the “Building
Department” is hereby created to administer and enforce these regulations. 2.1.02 MISSION. It is the mission of the Medina County Building Department to safeguard
the public through enforcement of the Ohio Building Code, Ohio Mechanical Code, Residential Code of Ohio, and County regulations. The County is committed to delivering qualified field inspections, timely and thorough plan review and professional, courteous service.
SECTION 2.2: PERMITS 2.2.01 PERMITS REQUIRED.

2.2.02 APPLICANTS SHALL PROVIDE THE FOLLOWING AS APPLICABLE. All
applications shall be completed in full and be accompanied by the documents required by the Chief Building Official.
2.2.03 CONDITIONS OF PERMIT
(A) Payment of Fees.

(1) No permit shall be issued and no amendment to a drawing, application for permit, or other submission shall be approved or certified until fees have been paid.
(2) The Board of County Commissioners by resolution shall establish fees to be
charged by the Building Department for performance of the duties established herein. When incidental instances arise that do not conform to the existing fee schedule, the Chief Building Official shall have the discretion to institute a fee for the particular permit, plan review, or administrative service.
(3) Any person, firm, or corporation who fails to obtain the required permit prior to
the erection, construction, alteration, or repair of any structure within the jurisdictional area of the Medina County Building Department shall upon detection, be required to obtain the necessary permit, and when applicable, register with the Building Department. To cover the administrative cost incurred, the Chief Building Official may determine that the violator shall be required to pay an administrative fee in addition to the permit fee. The maximum amount of this fee will be double the amount of the required fee, payable to the Medina County Treasurer. Nothing herein shall preclude the prosecution of the violator for conduct which otherwise constitutes a violation of the provisions of these regulations.
(B) Re-inspections Required. A fee shall be paid for each re-inspection made necessary
by incomplete, incompetent, or negligent work. A fee shall also be paid if ready or safe access to the job site is not provided.
2.2.04 REQUEST FOR INSPECTION
It shall be mandatory that the holder of a permit notifies the proper inspection agency when work is ready for the various inspections required by the State of Ohio rules. Such notice shall be given no later than 3:00 pm the workday prior to the desired inspection day. Before giving such notice, the holder of the permit shall first test the work and satisfy himself/herself that it conforms to the approved plans and specifications and the requirements of the Code.
CHAPTER 3 - APPEALS SECTION 3.1: MEDINA COUNTY BOARDS OF BUILDING APPEALS 3.1.01 NON-RESIDENTIAL, OHIO STATUTE AND POWERS. The Medina County Board
of Building Appeals is established per ORC 3781.20. It’s powers to grant variances and exceptions are described at ORC 3781.20 & 3781.19.
3.1.02 RESIDENTIAL, OHIO RULE AND POWERS. The Medina County Residential Board of Building Appeals is established as required by the Residential Code of Ohio (RCO) (Chapter 4101:8 Ohio Administrative Code), Section 112. It shall hear and decide appeals from the decisions of the Chief Building Official or other officer assigned to perform their duties pertaining to the enforcement of the RCO and these regulations. This Board shall consist of the members of the Medina County Board of Building Appeals plus a Medina County registered electrical contractor and a Medina County

registered HVAC contractor appointed by the Medina County Board of Commissioners for a five year term. The Medina County Residential Board of Building Appeals shall have the same powers regarding the RCO as ORC 3781.20(f) & 3781.19 grants to the Medina County Board of Building Appeals regarding the Ohio Building/Mechanical/Plumbing Codes (Chapters 4101:1, 2, & 3 Ohio Administrative Code).
3.1.03 COMPENSATION. The County Commissioners may from time to time set the
compensation, if any, of the Board members for time served at Board meetings. 3.1.04 CONFLICT OF INTEREST. No member of either Board shall pass upon any question
in which he/she has financial or personal interest (ORC 102, 2921.42, & 2921.43). 3.1.05 MEETINGS AND RECORDS. Board meetings shall be held at the call of the Chairman
or Chief Building Official and at other times as the Board determines. All public hearings before the Board shall be open to the public. The Board shall keep minutes of its proceedings, showing the vote of each member upon every question, or if absent or failing to vote, indicating such facts, and shall also keep records of its examinations and other official actions. The minutes and records are public records. A majority of appointed members shall constitute a quorum and a majority vote of the members present shall rule.
3.1.06 PROCEDURES. The Boards shall establish rules and regulations for their own
procedure not inconsistent with the provisions of the Medina County Building Regulations, State of Ohio rules and statutes. The fee for each appeal to a Board shall be set by the County Commissioners. The Board members shall annually, by majority vote, select one of the members to serve as chairman, who shall hold office for a term of one year or until his/her successor is elected and qualified.
3.1.07 APPEAL PROCEDURE
(A) Who may appeal. Any person, County officer or official or any public body aggrieved by the action of the Chief Building Official, Residential Building Official or Official acting in their place, may take an appeal to the appropriate Board. The Chief Building Official or any County officer or official of any public body, or any member of the Board, may request a hearing by a Board on any subject over which the Board has jurisdiction or power, as set forth in law, or may request the Board to review or interpret any provision of the Medina County Building Regulations.
(B) Time, fee and notice. An appeal from any decision of the Chief Building Official or
Residential Building Official may be taken within thirty days from the date of the decision from which the appeal is taken by paying the required fee and filing with the Chief Building Official and with the appropriate Board a notice of appeal, specifying the grounds therefore. The Chief Building Official shall then transmit to the Board, the record upon which the action was taken.
(C) Action on appeals. A Board shall hold a public hearing on each appeal and shall
give notice to the Chief Building Official and other interested parties, as the Board directs and shall give notice to the public by posting, publication or otherwise as

necessary for compliance with ORC 121.22. At the hearing any party may appear in person or by his/her agent or attorney.
(D) Decision. A Board shall hear and act upon all cases within thirty (30) days; unless
additional time is mutually agreed upon by the Board and applicant. Every decision of the Board shall be in writing and shall indicate the vote upon a decision. Every decision shall be promptly filed in the office of the Building Department. A copy shall be sent by mail, or otherwise to the applicant or other interested party.
CHAPTER 4 - CONTRACTOR REGISTRATION SECTION 4.1: REGISTRATION. Registration is required for all contractors listed in
Section 4.3 before a permit shall be issued or any work is performed on any project within the jurisdiction of the Medina County Building Department. See Section 4.2 for exceptions.
SECTION 4.2: RESIDENTIAL PROPERTY OWNER’S EXEMPTION. All work shall
be done in conformity with the provisions of State statutes and rules; no work shall be done unless all permits required by the County Building Regulation are obtained. A permit is not a license to employ, using any method of compensation, any entity to perform any work covered by a permit or portion thereof.
4.2.01 AFFIDAVIT. The owner may obtain any and all necessary permits for construction
project on his/her primary dwelling unit in lieu of all registration requirements provided that a signed and sworn affidavit, affirming that they will be responsible for the installation(s) covered under the permit, is provided. This includes, but is not limited to the following permit categories: building, electrical, and HVAC. Falsification of an affidavit may be subject to felony prosecution.
4.2.02 REGISTERED CONTRACTOR ALLOWED. A property owner may employ any
registered contractor to perform any aspect of the project that requires registration, provided the contractor is identified to the Building Department.
4.2.03 REGISTERED ELECTRIC CONTRACTOR REQUIRED. Due to the extremely
hazardous nature of certain projects, only registered entities may apply for and obtain permits for the following:
(A) All electrical wiring covered in National Fire Protection Association standard 70,
National Electrical Code, Article 680 Swimming Pools, Fountains, and Similar Installations.
(B) Active electrical service upgrades. (The owner of the dwelling unit may obtain a
permit provided they agree to contact their electrical supplier and coordinate power deactivation. At no time shall a property work on an energized electrical service.)

SECTION 4.3: REQUIREMENTS AND ELIGIBILITY
4.3.01 ELECTRICAL, MECHANICAL, HYDRONICS, & REFRIGERATION. To be eligible for registration as a contractor the following requirements must be met. (A) A current Ohio Construction Industry Licensing Board (OCILB) license per ORC
4740 and OAC 4101:16-1 through 4. (B) Proof of liability insurance in the amount of $300,000 or more, naming the Medina
County Building Department as a certificate holder.
(C) An affidavit signed by the contractor affirming compliance with the Ohio Bureau of Workers’ Compensation (OBWC) law (ORC 4123 & OAC 4123) or a copy of a current OBWC certificate. The name of the company and individual on the State license document(s) must match the company and individual on all documents submitted as part of the registration. This includes, but is not limited to, insurance and OBWC certificates.
SECTION 4.4: APPLICATION FOR REGISTRATION. All applications shall be submitted to the Medina County Building Department in neatly printed completed form. The required fee shall accompany all applications along with the required certificates of insurance and qualifications. SECTION 4.5: EXPIRATION AND RENEWAL OF REGISTRATION.
4.5.01 EXPIRATION. All registrations shall expire at 12:00 A.M. midnight on January 31st of each year, and no permit shall be granted until the registration has been secured for the ensuing year.
4.5.02 RENEWAL.
(A) Renewal of registrations before their expiration date may be made for the ensuing year during the months of November, December, and January.
(B) Failure to renew a registration on or before March 31st of the year following its
expiration date will necessitate a new application and the payment of all fees associated therewith.
(C) All renewal applications shall be accompanied by the requirements of 4.3.01. A
reduced fee for renewal will be effective through Midnight of March 31st.
(D) No permits shall be granted until registration is current. SECTION 4.6: REGISTRATION SUSPENSION OR REVOCATION BY THE CHIEF BUILDING OFFICIAL
4.6.01 SUSPENSION FOR 21 DAY MAXIMUM. The Chief Building Official may suspend a registration for up to twenty-one (21) days. Such suspensions may be appealed to the Medina County Board of Building Appeals. A contractor’s successful challenge to a suspension under this section shall result in a return of the filing fee paid to take the

matter before the Medina County Board of Building Appeals. The Chief Building Official may authorize an entity who’s registration’s suspended under sections 1-3 below to continue work for any period deemed necessary to correct the work giving rise to the suspension.
(A) Misrepresentation of a material fact in obtaining a registration or renewal thereof.
(B) Subcontracting to an unregistered contractor. A registered contractor may
subcontract work to any subcontractor holding a valid Medina County registration. However, the original contractor continues to be the owner’s agent and is responsible to comply with construction code requirements unless the second contractor obtains a separate permit for that construction. A registered contractor may hire employees to work directly for the contractor and to actually perform the work involved. The registered contractor shall, however, be responsible for all work performed under his registration by his employees.
(C) Failure to secure the permits, inspections or approvals required by the construction
codes.
(D) Work not in conformity with the permit issued therefore.
(E) Suspension or registration by the Ohio Construction Industry Licensing Board. 4.6.02 SUSPENSION EXCEEDING 21 DAYS OR REVOCATION. The Chief Building
Official may recommend the revocation, or suspension of a registration for a period in excess of twenty-one (21) days for good cause including but not limited to those listed below. The Chief Building Official shall forward a recommendation to the Medina County Board of Building Appeals, setting forth the nature of the violation, the length of the suspension or revocation requested, and the reason for the particular time frame involved. A copy of the recommendation with the date of the hearing shall be forwarded to the contractor. The contractor shall be advised of the right to appear at the hearing and present evidence through counsel or personally to oppose the revocation or suspension. (A) Any reason listed in 4.6.01 above. (B) Dishonest or unfair practices in the conduct of a business or practice of a trade.
(C) Consumer fraud violations.
SECTION 4.7: FEE IN APPEAL ACTIONS. The fee established by the Medina County Board of Commissioners shall accompany each application for an appeal to the Medina County Board of Building Appeals. CHAPTER 5 - WORK RULES
SECTION 5.1: GENERAL. All work shall be done in conformity with the provisions of these rules and Ohio law.

SECTION 5.2: JOB ACCESS. The permit holder and the owner of record are responsible for access to building where inspections are required. Reinspection fees will be assessed for no access when called unless the Chief Building Official determines that there were no additional expenses incurred by the County while executing the inspection attempt. SECTION 5.3: DEFECTIVE/INCOMPLETE WORK. Reinspection fees will be assessed for defective/incomplete work. The permit holder will be responsible for all such fees as listed in the Fee Schedule. SECTION 5.4: THREE PERMITS IN VIOLATION. The Chief Building Official may deny permits to an entity when more than three (3) active permits are in violation of the construction codes. SECTION 5.5: WORK LACKING PERMIT OR REGISTRATION. Work done prior to registration or obtaining a permit may result in an enhanced fee for both registration and permit fee to cover additional administrative costs by noncompliance. All wiring and mechanical systems installed prior to obtaining a permit will be removed unless the installation of such systems are found to be safe and in accordance with all applicable rules. SECTION 5.6: ELECTRIC SERVICE ENERGIZATION. Before any electric service is authorized to be energized by the electric utility, all panel covers shall be installed with at least one breaker installed with a connected load. SECTION 5.7: CONCEALING WIRING WITHOUT APPROVAL. Ceilings, walls, and underground wiring shall be inspected prior to backfilling or covering. Where covered by others prior to inspection, the responsibility for exposing said wiring shall be that of the person or persons who have violated this section and the owner of record. SECTION 5.8: SERIOUS HAZARD WIRING. (deleted) SECTION 5.9: FIRE REPAIRS. Remove all branch circuits from the panel during fire repairs. Circuits for heat and ground fault circuit interrupter protected outlets may be re-established. SECTION 5.10: ELECTRIC SERVICE SCOPE. All work done beyond the weather head on overhead services, and the point of service on underground services, with the exception of meters, are subject to registration and permit requirements. Exception: An empty underground raceway may be installed by a non-registered contractor for one-, two-, and three-family residential dwellings and their accessory buildings provided.
(A) A permit is secured before any work begins. (B) All electrical wires are installed and all terminations performed by a registered
electrical contractor.
(C) The permit holder shall be responsible for inspection scheduling.

APPENDIX I STANDARDS FOR POLE TYPE CONSTRUCTION
The following standards are intended to serve as a guide for persons involved with pole construction in Medina County. They are intended to consolidate and focus on minimum requirements, which are applicable to popular pole construction methods. These standards are not meant to be substituted for, or be contrary to, governing building code regulations of the State of Ohio. If plans are submitted by a State of Ohio registered design professional, alternative construction methods will be considered. A. Footings.
1. It is the responsibility of the person who prepares the plans to design the footing according to the bearing capacity of the soil.
2. Footings shall bear on virgin soil a minimum of 48 inches below the finish grade.
B. Skirt Boards. All skirt boards shall be tongue and groove and decay resistant. Skirt boards shall be installed from the base of the slab to a point not less than eight (8) inches above the finish grade. C. Pole Building Additions. REFUNDS
No refunds will be issued except in the case of County error.
TRANSFERS OF PERMITS
Permits are issued to the owner of the real property or their representative. Permits are transferable from one party to another upon payment of the transfer fee and either (1) written request of the releasing and gaining parties or (2) written notice of the property owner.
EXPIRATION OF PERMITS
The Certificate of Plan Approval and therefore the Permit expire if:
a. Construction, erection, alteration, or other work upon the building has not commenced within twelve months of the approval of the plans or drawings and specifications. One extension shall be granted for an additional twelve-month period if the owner requests at least ten days in advance of the expiration of the permit and upon payment of a fee not to exceed one hundred dollars. [ORC 3791.04(C)]
b. In the course of construction, work is delayed or suspended for more than six months; the approval of plans or drawings and specifications is invalid. Two extensions shall be granted for six months each if the owner requests at least ten days in advance of the expiration of the permit and upon payment of a fee for each extension of not more than one hundred dollars.
