    A regular meeting of the Board of Directors (the Board) of The New York RacingAssociation, Inc. (NYRA) was conducted on February 27, 2013 at 3:30 p.m. in the 37th FloorConference Room of the Office of the NYS Empire State Development Corporation, located inNew York, New York pursuant to notice duly given.

    Dr. Skorton called the meeting to order. Mr. Viscusi recorded the minutes. Mr. Handalconducted a roll call of the Directors and Special Advisors.

    1. Approval of J anuary 25, 2013 Regular Board Meeting Minutes.

    The first item addressed was the minutes of the January 25, 2013 regular meeting of theBoard. A motion to approve the minutes was made by Mr. Subotnick and seconded by Mr.Duncker. The resolution was carried without dissent and the minutes were ordered to be added tothe permanent records of the corporation. A copy of the resolution is attached hereto as Exhibit1.

    2. Report of the President.

    Ms. McClain discussed the current status of NYRAs business, including items relating tohandle, reduction of race days, Belmont Park Racetrack race meeting preparation, horse

    fatalities, security assessment, Horse Watch Detail, capital projects, Longshots, Genting,marketing, risk assessments, tote contract, Global Betting Exchange and the New York Cityopportunity.

    3. Report of the Chair.

    Dr. Skorton introduced Dean Michael Kotlikoff, Special Advisor for Equine Health andSafety to the Board. Dr. Skorton led a discussion regarding the final version of the three yearBoard work plan and NYRAs undertaking of the underage gambling initiative. Then, Dr.Skorton introduced Karen Murphy as Special Advisor to the Board. Dr. Skorton, then discussedthe Boards long-term vision.

    4. Committee Reports.

    a. Compensation CommitteeMr. Tese gave the report of the Compensation Committee. Mr. Tese discussed

    the compensation consultants proposed incentive-based pay scheme for a new NYRAChief Executive Officer.

    b. CEO Search Committee

    Dr. Skorton gave the report of the CEO Search Committee. Dr. Skorton discussedthat the committee is reviewing various candidates for the office of NYRA Chief

    Executive Officer.

    c. Public Hearings and Communications CommitteeMs. Rosenthal gave the report of the Public Hearings and Communication

    Committee. Ms. Rosenthal discussed that the committee met to discuss ideas for publichearings and for its charter.

    d. Equine Safety CommitteeMr. Bonomo gave the report of the Equine Safety Committee, which met earlier

    on the date of this meeting. Mr. Bonomo led an equine safety discussion. A proposedresolution to authorize Dr. Anthony Verderosa, NYRA Chief Examining Veterinarian, toorder necropsies of training horse fatalities was read and discussed. The motion wasmade by Mr. Bonomo and seconded by Mr. Spinelli. The resolution was carried withoutdissent. A copy of the resolution is attached as Exhibit 2.

    5. Administrative Matters.

    a. Open MeetingsDr. Skorton led a discussion regarding open meetings. All NY RA Board of

    Directors committee meetings will be open to the public but will not be webcast.

    b. Recruiter for CEO SearchMr. Handal read a proposed resolution to authorize management to enter into a

    contract with RSR Partners to conduct a search for a Chief Executive Officer. The matterwas discussed and a motion approving the resolution was made by Mr. Wait andseconded by Mr. Subotnick. The resolution was carried without dissent. A copy of theresolution is attached as Exhibit 3.

    c. Approval of NY RA Peace OfficersMr. Handal read a proposed resolution appointing NYRA peace officers to serve

    at the pleasure of the Board and officers. The matter was discussed and a motionapproving the resolution was made by Mr. Bonomo and seconded by Mr. Riggio. Theresolution was carried without dissent. A copy of the resolution is attached as Exhibit 4.

    6. New Business

    a. Medication Updates

    Mr. Violette led a discussion regarding the current medication updates in the Mid-

    Atlantic states. It is expected that the Mid-Atlantic states will soon announce medicationrules comparable to those of NYRA.

    b. Breeders Cup Limited Fall Championship Event

    Mr. Flay reported the possibility of NYRA hosting the Breeders Cup LimitedWorld Thoroughbred Championships in 2014. The matter was discussed at length.

    c. Two-Y ear old Race Incentive Bonus Program

    Mr. Violette discussed the proposal to extend to 2013 the 2-year old incentive

    bonus to be paid to the owner of any 2-year old that breaks its maiden at NYRA duringthe Aqueduct Racetrack winter/spring or Belmont Park spring/summer meets and goes onto win a graded stakes at Saratoga Race Course, Belmont or Aqueduct in 2013. Aproposed resolution to authorize this incentive bonus was read and discussed. Themotion approving the resolution was made by Mr. Riggio and seconded by Mr.Subotnick. The resolution was carried without dissent. A copy of the resolution isattached as Exhibit 5.

    Adjournment.

    Dr. Skorton called for additional business. There being no further business to come

    before the Board, the meeting was concluded at 5:10 p.m.

    Ms. LANDRIEU (for herself and Mr. GRAHAM) introduced the following bill;which was read twice and referred to the Committee on Health, Edu-

    A BILL

    To prevent human health threats posed by the consumption

    of equines raised in the United States.

    Be it enacted by the Senate and House of Representa-1

    tives of the United States of America in Congress assembled,2

    SECTION 1. SHORT TITLE.3

    This Act may be cited as the Safeguard American4

    Food Exports Act of 2013.5

    SEC. 2. FINDINGS.6

    Congress finds that7

    (1) unlike cows, pigs, and other domesticated8

    species, horses and other members of the equidae9

    sumption;2

    (2) equines raised in the United States are fre-3

    quently treated with substances that are not ap-4

    proved for use in horses intended for human con-5

    sumption and equine parts are therefore unsafe6

    within the meaning of section 409 of the Federal7

    Food, Drug, and Cosmetic Act;8

    (3) equines raised in the United States are fre-9

    quently treated with drugs, including phenylbuta-10

    zone, acepromazine, boldenone undecylenate, omep-11

    razole, ketoprofen, xylazine, hyaluronic acid, nitrofu-12

    razone, polysulfated glycosaminoglycan, clenbuterol,13

    tolazoline, and ponazuril, which are not approved for14

    use in horses intended for human consumption and15

    equine parts are therefore unsafe within the mean-16

    ing of section 512 of the Federal Food, Drug, and17

    Cosmetic Act; and18

    (4) consuming parts of an equine raised in the19

    United States likely poses a serious threat to human20

    health and the public should be protected from these21

    unsafe products.22

    SEC. 3. PROHIBITIONS.1

    Section 301 of the Federal Food, Drug, and Cosmetic2

    Act (21 U.S.C. 331) is amended by adding at the end the3

    following:4

    (ccc) Notwithstanding any other provision of this5

    section6

    (1) equine parts shall be deemed unsafe under7

    section 409 of this Act;8

    (2) equine parts shall be deemed unsafe under9

    section 512 of this Act; and10

    (3) the knowing sale or transport of equines or11

    equine parts in interstate or foreign commerce for12

    purposes of human consumption is hereby prohib-13

    ited..14
