Purchase of property located south of King Street, east of Kennedy Road - Campbells Cross, Town of Caledon, Regional Municipality of Peel, under the "Greenlands Acquisition Project for 2011-2015", Flood Plain and Conservation Component, Humber River watershed.

THE EXECUTIVE COMMITTEE RECOMMENDS THAT 5.96 hectares (14.72 acres), more or less, of vacant land being Part of Lot 27, Concession 2 EHS (Chinguacousy) and designated as Blocks 22 and 23 on a Draft Plan of Subdivision prepared by Ivan B. Wallace, Ontario Land Surveyors Ltd., Drawing No. 5-9104-M, dated February 10, 2012, Town of Caledon, Regional Municipality of Peel, located south of King Street, east of Kennedy Road - Campbells Cross, be purchased from 1029626 Ontario Inc.;

THAT the purchase price be $2.00;

THAT Toronto and Region Conservation Authority (TRCA) receive conveyance of the lands free from encumbrance, subject to existing service easements;

THAT Gardiner Roberts LLP, be instructed to complete the transaction at the earliest possible date. All reasonable expenses incurred incidental to the closing for land transfer tax, legal costs, and disbursements are to be paid;

AND FURTHER THAT authorized TRCA officials be directed to take the necessary action to finalize the transaction including obtaining needed approvals and signing and execution of documents.

CARRIEDRATIONALEThe subject property falls within TRCA's approved master plan for acquisition for the Humber River watershed as outlined in the approved Greenlands Acquisition Project for 2011-2015. Through the review of residential subdivision 21T-07002C, TRCA staff established the limits of the open space lands (i.e. Blocks 22 and 23 on Draft Plan of Survey) which are comprised of the Regional Storm flood plain and valley corridor of a headwater tributary of the West Humber River at this location.

Since TRCA does not presently own any adjoining property east, north or south of the open space lands to be acquired and the abutting residential lots to the west will effectively isolate Blocks 22 and 23, an access easement over the proposed stormwater management facility (i.e. Blocks 25 and 26 to be transferred to the Town of Caledon) will be granted to TRCA as part of this transaction in order to periodically inspect Blocks 22 and 23.

TAXES AND MAINTENANCEBased on TRCA's preliminary review of the environmental criteria for lands that are eligible to receive a property tax exemption under the provincial Conservation Land Tax Incentive Program, it would appear that all of the subject property would be eligible for exemption for the 2013 taxation year. The addition of the subject parcel of land will not significantly impact TRCA's maintenance costs at this location.

Negotiations have been conducted with Mr. Vince Perricone of Cosman & Associates, Barristers & Solicitors, who acts as agent on behalf of the owners.

Attached is a plan showing the location of the subject lands.

RATIONALEThe subject property falls within TRCA's approved master plan for acquisition for the Humber River watershed as outlined in the approved Greenlands Acquisition Project for 2011-2015. Through the review of the City of Vaughan Committee of Adjustment Application B035/11 for the creation of an additional residential lot, TRCA staff established the limits of the open space land (i.e. Part 3 on Draft Plan of Survey) which is comprised of a portion of the Regional Storm flood plain of the East Humber River at this location.

Access to the subject lands is available through an existing permanent easement previously granted to TRCA for an erosion control project dating back to the early 1980s for this property and the neighbouring lot to the south. The repaired streambank is presently in a stable condition and is being periodically monitored by TRCA staff.

THAT the purchase price be $2.00;

CARRIEDBACKGROUNDThe West Etobicoke Creek South Britannia Road East Project involves work to be carried out on TRCA-owned property. Development of the project started in 2007 when TRCA monitoring staff reported concerns of slope instability in the ravine of Etobicoke Creek in the vicinity of the site known as 1880 Britannia Road in the City of Mississauga, Regional Municipality of Peel. The professional engineering firm Jacques Whitford Environment Ltd. then completed geotechnical investigations and recommended slope restoration and channel bank stabilization works in combination with tableland drainage to mitigate the risk of slope failure. TRCA undertook a Class Environmental Assessment (Class EA) to identify a remedial solution for the West Etobicoke Creek South of Britannia Road East Erosion Control Site Project. The study proposal received approval to proceed at Authority Meeting #7/10 held on September 17, 2010.

TRCA also retained W.F. Baird and Associates to assist with geomorphic, geotechnical and engineering consultant services in support of the Class EA. The approved preferred alternative includes a vegetated rip rap embankment with stream barbs, combined with regrading, drainage improvements (french drain system), and revegetation of the valley wall. The opposite embankment is also to be re-shaped and vegetated to maintain channel width.

The landowner of 1880 Britannia Road was advised to establish a 5 m wide buffer along the crest of the unstable slope, to regrade the existing parking lot to encourage drainage away from the valley slope, and to avoid placing snow stockpiles along the crest of the valley. The landowner initiated the recommendations in December 2011.

A permanent easement is required from the 1880 Britannia Road property for construction, maintenance and repair purposes related to the project. The site is outside of the regional storm floodplain at the north east corner of Luke Road and Britannia Road and abuts the Etobicoke Creek. The property is currently utilized for trucking operations and is located within an existing industrial area. The permanent easement acquisition is described as having a ‘T’ shape containing a 5 metre wide strip, more or less along the rear portion of the site that abuts the ‘West Etobicoke Creek South Britannia Road East Project’, together with a 5 metre wide access strip to the frontage of Luke Road.

Negotiations have been conducted with Leah Elliot of Borden Ladner and Gervais LLP for the owner.

Attached is a plan showing the location of the subject easement.

RATIONALEThe subject permanent easement is required for the construction, maintenance and repair of the proposed erosion control works know as the ‘West Etobicoke Creek South Britannia Road East Project’.

TAXES AND MAINTENANCEThe owner of the property will continue to be responsible for taxes and maintenance associated with the lands subject to this permanent easement.

FINANCIAL DETAILSFunds for the costs related to the purchase are available in the West Etobicoke Creek South Britannia Road East capital account.

THE EXECUTIVE COMMITTEE RECOMMENDS THAT staff be authorized to issue a change order on Contract RSD11-56 for a total value of $197,440.08 plus HST to McPherson Andrews Contracting Limited for the supply and installation of a 30 m long permanent bridge to be used in Phase III of the Emergency Works in Wilket Creek Park;

THAT a contingency allowance of $20,000.00 to be expended as authorized by Toronto and Region Conservation Authority (TRCA) staff be approved;

AND FURTHER THAT authorized officials be directed to take the necessary action to implement the contract including obtaining necessary approvals and the signing and execution of documents.

CARRIEDBACKGROUNDThe Wilket Creek tributary of the East Don River was one of the watercourses that suffered a significant amount of damage as the result of the August 19, 2005 storm event. The City of Toronto subsequently retained TRCA in 2007 to manage, design and implement large-scale restoration works within Edwards Gardens, and 10 repair projects focused on infrastructure protection and public safety within Wilket Creek Park, to return the park system to a state of good repair.

Shortly following completion of the aforementioned restoration work, another severe storm event hit the Toronto area on June 23, 2008, damaging three of the sites in Wilket Creek Park recently repaired by TRCA. It was evident by this point that a comprehensive study and rehabilitation plan was required to provide long-term protection for municipal infrastructure and public safety within Wilket Creek Park.

The City of Toronto authorized TRCA to assume a leadership role in the planning, design and implementation of large-scale restoration of Wilket Creek within Wilket Creek Park. During the collection of background information for the rehabilitation project, three priority areas were identified as needing emergency repairs due to the risk to municipal infrastructure and public safety. These sites are referred to as Site 3, Site 6 and Site 7. Recognizing that one of the objectives of the rehabilitation project is to identify a preferred stable alignment and geometry for the watercourse, the scope of work for the emergency repair sites will include implementation of the preferred channel planform at these locations.

The proposed works at Site 3 include:modifications to the existing planform of the channel to widen the cross-sectional area, and

move it away from an existing valley wall contact;grade control to provide minimum depth of cover to the sanitary sewer crossing;

installation of a 30 m span bridge to accommodate the increased channel width, to reduce

potential for debris blockage under the bridge, and to provide long-term protection to public safety while providing access to the existing linear trail system.

RATIONALEContract RSD11-56 was awarded to McPherson Andrews Contracting Limited in July 2011 under Resolution #A167/11, for the supply and installation of two 30 metre long bridges, and a 40 metre long boardwalk at the Site 6/7 Wilket Creek Emergency works site. At the time this contract was awarded, the design details for the channel work at Site 3 were not yet developed to the level of detail needed to confirm the crossing requirements.

With the design details for Site 3 nearing completion and the existing contract still active, an extension to said contract would permit McPherson Andrews to provide a third bridge of identical specifications for the final area requiring emergency works at an anticipated savings of between $50,000 - $75,000 based on the reduction / nullification of costs for the following activities: 1. bridge design consulting;2. tender preparation and analysis;3. bulk quantity pricing on material fabrication (deck panels and structural components);4. bulk quantity pricing on supplies and materials (helical screws, concrete, rebar, steel);5. reduced shipping costs (bulk rate);6. project administration.

As a result, staff recommend an extension of the contract as per Section 1.14.3 of TRCA's Purchasing Policy as follows:

When the extension or reinstatement of an existing contract would prove most cost-effective or beneficial. The extension shall not exceed one year.

FINANCIAL DETAILSFunding for this project is 100% recoverable from the City of Toronto, and is allocated under account code 185-08.

CARRIEDBACKGROUNDIn order to reduce ongoing costs of TRCA’s increasing inventory of wireless / cellular devices, it was determined that TRCA required a new pricing structure to improve efficiencies when acquiring new products and maintaining existing equipment. Cellular based technologies can be considered a commodity with continually changing hardware technology, fluctuating service pricing and variable contract structures. TRCA's needs are varied given the nature and breadth of the services TRCA delivers.

TRCA currently has about 370 wireless devices including blackberries, cell phones and USB internet "sticks". Managers determine the need for devices and monitor usage. Accounting and IT staff review and monitor usage and billings.

RATIONALEStaff offered each of the major wireless/cellular service providers, Telus, Bell and Rogers, the opportunity to submit a proposal for services to TRCA. Each provider was given current account details including; existing hardware, compliment lists, existing service contracts and associated costs, as well as an estimate for potential future products and services. Each vendor was required to provide TRCA with a proposal, identifying in detail the products and services they would offer TRCA and a breakdown of any associated costs. TRCA agreed to treat as confidential the details of pricing and conditions as submitted by each vendor.

Each vendor provided TRCA with a preferred cost structure based upon each of their own “Vendor of Record” (VOR) agreements that they provide the Ontario Public Service. These VOR pricing structures offer the best pricing that the vendor offers public corporations, as they reflect the pricing offered to their largest customer, the Ontario Government. Also, each vendor provided TRCA with a detailed proposal identifying the products and services they would offer TRCA and any associated costs for each product and service as well as any future ongoing costs which may be incurred. The products and services offered by each vendor were not always exactly the same as they structure their offerings differently based on the current pricing models set out in their own VOR negotiated contracts. However, the products and services were similar enough that staff was able to compare them fairly in order to identify what best fits current TRCA requirements and future needs.

Staff analysed the proposal offerings using the following categories: pricing agreement/contract;

hardware contract;

voice charges;

texting charges;

data costs;

internet sticks/hubs;

carrier conversion (requirement to convert all existing users to vendor);

hardware swap (ie. conversion);

support tier;

support rating (TRCA experience with vendor support).

Analysis of the financial characteristics of each proposal indicated that the proposals were comparable and competitive. TRCA could realize savings with each of the vendor proposals, on average a 30% reduction in costs as compared to TRCA current annual costs. However, Rogers offered superior data pricing which is significant as TRCA begins to use more smart phone and tablet technology.

Staff also evaluated each of the proposals in terms of key non-financial characteristics;flexibility (ability to maintain existing services from other vendors if most effective solution);

quality of customer support and reporting;

potential TRCA future service requirements (using additional internet hubs/sticks for remote

areas, data pricing for future use of tablet devices, etc.).

Flexibility of the contract is a key consideration as the requirement to move all of TRCA's existing service inventory to a specific carrier would result in upfront costs (cancellation charges) but more importantly staff time costs (migrating phones, contacts, Blackberry Enterprise Server (BES) changes etc.), potential downtime for users and general aggravation of users having to get IT staff to assist them in the migration of contacts, apps etc. to a new service. Telus required that all devices be moved to their plans to achieve the required cost savings. Rogers and Bell did not require this "exclusivity".

Customer support in terms of timely, efficient response to wireless software and hardware issues is a key characteristic. Downtime for staff when wireless devices fail and IT staff time in dealing with these issues result in reduced productivity. Staff has used both Rogers and Telus for many years and concluded that Rogers offered superior customer service and support. Staff has had little experience with Bell as TRCA has not used their wireless services. TRCA has experienced delays and less than optimal service response from Bell in terms of traditional phone services.

DETAILS OF WORK TO BE DONEIn conclusion, following a thorough review of each proposal in the context of the characteristics listed including costs, flexibility, customer support and future potential needs, staff has determined that the proposal offered by Rogers best meets the requirements of TRCA. The Rogers proposal is cost competitive overall, flexible (does not require the conversion of all existing equipment from other carriers), offers excellent Tier 2 customer support and offers the best data pricing (important going forward with increasing requirements of apps / tablets / sticks / hubs).

Staff recommends that Rogers be appointed as TRCA's primary provider of wireless/cellular services. TRCA will continue to use Telus and Bell where it is cost effective to do so or where a particular technological issue requires that their services are most appropriate. There is no single contract for all services. The Rogers proposal is a compendium of contractual services for the various devices and products TRCA requires. As noted, wireless/cellular services are very much "commodities" which means that TRCA will continue to source and acquire the best product or service that meets TRCA's needs recognizing that this market shifts continuously.

FINANCIAL IMPLICATIONSTRCA currently pays about $30,000 monthly in total for wireless and cellular services from its two major providers, Telus and Rogers. Under the proposed pricing structure, staff estimate conservatively that the monthly savings could be in the $8,000 to 10,000 range. Staff will monitor closely the new pricing arrangements and can report back at year end on actual savings achieved.

WHEREAS Toronto and Region Conservation Authority (TRCA) and the Ontario Ministry of the Environment (MOE) have worked together over the past 12 years to build and operate the Provincial Groundwater Monitoring Network (PGMN);

WHEREAS the PGMN program provides valuable data in support of watershed planning and source water protection programs at TRCA;

WHEREAS MOE has provided a new agreement to continue the PGMN for the next four years;

THEREFORE LET IT BE RESOLVED THAT TRCA enter into the Provincial Groundwater Monitoring Network Agreement with MOE commencing April 1, 2012, and continuing for a period of four years;

THAT the agreement be on terms and conditions satisfactory to TRCA officials and, as necessary, TRCA solicitors, including but not limited to, being subject to funding being available;

AND FURTHER THAT authorized TRCA officials be directed to take such action as is necessary to implement the agreement, including the signing and execution of documents.

CARRIEDBACKGROUNDMOE and TRCA entered into an agreement in June, 2000 to initiate TRCA's component of the PGMN. Since that time, TRCA and MOE have worked together to build a network of 22 monitoring wells across the TRCA jurisdiction. The program involves the collection of both water level and water quality data.

The prime responsibilities for TRCA under this agreement are as follows:operate and maintain the equipment;

maintain the integrity of the wells and well sites;

fund the costs associated with data transmission (telemetry systems);

collect manual water level measurements from all wells at least quarterly;

review and correct the raw data on a semi-annual basis;

collect water samples on an annual basis;

communicate program details to local stakeholders; and

participate in the PGMN Protocol-For-Actions (Exceedance Protocol) on an as-required

basis.

MOE provides funding to cover the costs of analytical services, sample shipment and equipment replacement on an as-needed basis. In addition, MOE provides technical support and centralized data management services. Should TRCA identify requirements for new monitoring wells, TRCA is responsible for the assessment and construction of such wells. A portion of the funding for new monitoring wells and decommissioning of wells that are no longer needed will be supported by MOE.

The previous agreement expired in June, 2006, and was extended three times, most recently to March 31, 2012. This new agreement will begin April 1, 2012 and will be for a period of four years. There is no significant change to either MOE or TRCA's responsibilities and/or financial obligations under the new agreement.

RATIONALEData from this program were used as key inputs to watershed plans for the Rouge River and Humber River watersheds well as TRCA's Assessment Report and Tier 1 Water Budget prepared under the Clean Water Act. TRCA staff use the data on an ongoing basis to assess changes to background groundwater quality and quantity across the TRCA jurisdiction, and the results are now incorporated into reports under the Regional Water Monitoring Program. Therefore, continued participation in this program is beneficial to TRCA and the watershed management and source protection work we are undertaking.

FINANCIAL DETAILSFunding of TRCA's costs for this program that are not covered by MOE are provided from the regional municipalities of Peel, York and Durham, as well as the City of Toronto, through TRCA's Regional Watershed Monitoring Program (account code 124-37). If this funding should not be available, TRCA retains the authority to cancel the agreement with six months notice.

CARRIEDBACKGROUNDThe Toronto Transit Commission has requested public input to naming the new stations that are associated with the Toronto-York Spadina Subway Extension project and TRCA has been invited to participate. Through consultation with TTC staff, TRCA staff has been advised that there are two main policy considerations for the naming of stations. The first is that the station be named after its geographic location, namely the local crossroad. The second criterion is that the name should be simple. It was noted that consideration may be given to naming stations after a regional destination.

There are numerous examples of stations being named after local or regional destinations, with the major crossroads appearing in brackets as a subset of the main station name. There are numerous other examples of the station being named after the local community. These examples are:

TTC has recently approved a request from the City of Vaughan to rename the Vaughan Corporate Centre Station to the Vaughan Metropolitan Centre Station in recognition of Vaughan's new downtown area. The Vaughan Metropolitan Centre was renamed from the Vaughan Corporate Centre in 2009 as a result of a public process. The name has been formally adopted by Vaughan Council and York Region Transit. Vaughan Centre has no formal status with either of these local and regional levels of government. TTC noted that their approval to name this station the Vaughan Metropolitan Centre is an exception to its naming policy, which is to have simple names for stations to geographically inform travelers, in the most understandable way possible, of their location. The renaming was also approved in recognition of the fact that the City of Vaughan is a major funding partner and should be respected in its contribution to the station naming process.

TTC has also approved the naming of the “Highway 407 Station”. This station is located on the banks of Black Creek, a tributary of the Humber River. Through discussion, TRCA members have expressed concerns regarding the appropriateness of this station name. It will be the first of two subway stations located at Highway 407, as there will be a second (unnamed) Highway 407 station built on the Yonge subway line in the future. Members noted that a way to differentiate between the two Highway 407 stations could be to include “Black Creek” in the naming of the Highway 407 Station, for example, name the station Black Creek (Highway 407 Station), or to include the other major crossroad street, namely Highway 407 - Jane. At this time, TTC is also constructing an LRT line across Eglinton Avenue, with a station being located at Black Creek Drive. Names for stations on this line have not been approved.

It is recognized that the multiple naming of stations as “Black Creek” is both improbable and impractical. Recommending station names that reflect local crossroads is beyond the mandate of TRCA and would be better addressed by our municipal partners. As such, the focus of this report has been confined to a recommendation that the Steeles West station be named to reflect the proximity to, and significance of, Black Creek Pioneer Village.

RATIONALEBlack Creek Pioneer Village is owned and operated by Toronto and Region Conservation Authority, and supported with significant annual funding from the City of Toronto and The Regional Municipality of York. The Village is located in the community of Black Creek, in the City of Toronto, as well as in the City of Vaughan. It is a replica of a typical crossroads community from the early to mid-19th Century. Approximately one-half of its buildings have been relocated from across the Greater Toronto Area, the remaining half are on their original foundations. The artifacts and collections at the Village are of local, national and international significance.

Black Creek Pioneer Village is recognized as a heritage destination by Tourism Toronto, has buildings of significance to the Ontario Heritage Trust, and is affiliated with the Ontario Museum Association and the Canadian Museums Association. Black Creek Pioneer Village is also a "living" museum, with artisans, interpreters and educators working interactively with visitors and students to provide individuals and groups with knowledge and experience. It is a regional cultural tourism destination in the Greater Toronto Area.

Black Creek Pioneer Village is located approximately 800 metres from the Steeles Avenue West station. To reflect the significance of the Village, as well as respecting the naming policy of the Toronto Transit Commission, it is suggested that the name reflecting Black Creek Pioneer Village be considered. Options considered include:

Black Creek Pioneer Village Station;

Black Creek Village Station;

Pioneer Village Station;

Black Creek Pioneer Village (Steeles West);

Black Creek Village (Steeles West);

Pioneer Village (Steeles West);

Steeles West (Pioneer Village Station);

It is the recommendation of TRCA staff, in consultation with its members, that the name selection be based on the Village itself, including Black Creek Pioneer Village Station; Black Creek Village Station; Pioneer Village Station; Black Creek Pioneer Village (Steeles West); Black Creek Village (Steeles West) or Pioneer Village (Steeles West). Given the precedent set by TTC in naming numerous other stations after places of local or regional significance, it is recommended that the name Black Creek Pioneer Village (Steeles West) be recommended to TTC in the naming of the Steeles West Station. Of additional note is that the TTC Jane Street bus notes “Black Creek Pioneer Village” as its destination thus the naming of the subway station to reflect the significance of the Village already has precedent.

BACKGROUNDThe Ministry of Tourism and Culture has operating "Standards for Community Museums in Ontario" to set levels of professional practice in these institutions. These standards set guidelines for appropriate methodology and practices. They are also required by Ontario Regulation 877 - "Grants for Museums" - for museums to be eligible for the Ministry of Tourism and Culture Community Museum Operating Grant (CMOG) program. Black Creek Pioneer Village receives approximately $220,000 annually through the CMOG program.

There are a total of 10 standards that museums are required to develop policies for. Black Creek Pioneer Village now has policies that cover eight of the standards. The ninth to be developed and submitted for approval is the Community Standard Policy. The final "Physical Plant Policy" to meet the Physical Plant Standard will be developed and submitted in 2012.

Creation of the original six standards commenced in 1981 in order to provide necessary museological standards for Ontario's community museums. The first six standards for museum operations were in the areas of: collections records management, staff training, research, conservation, interpretation and education, and exhibition. This has since been expanded to ten including Governance, Finance, Physical Plant and Community.

These standards and the policies developed for them relate to the following:

Collections StandardThe artifacts in the museum's collection are a tangible representation of the community's heritage and to retain their informational and historical value they must be properly cared for and documented. The museum will demonstrate its stewardship and facilitate access to the collections and the information they hold by maintaining a well-organized, managed and documented collection. (Res.# A53/01 - Approved by the Authority on April 6, 2001)

Human Resource StandardA museum's ability to fulfill its purpose depends to a large degree on the professionalism and capabilities of its staff. The museum is better able to meet its mandate and carry out its activities by recruiting qualified staff and providing ongoing training opportunities. As an employer, the museum is concerned with the safety, security, well being and continued motivation of the people working for it. Physical PlantThe museum's buildings and grounds must provide a safe and functional environment for visitors, staff, the collection and associated activities. The achievement of this objective will be balanced with the need to preserve the integrity of heritage buildings as artifacts themselves, as well as archaeological resources present on the property. (To be submitted in 2012).

RATIONALEAll standards in the CMOG program require written policies approved by TRCA. These policies are to be implemented by Black Creek Pioneer Village in order to meet the minimum requirements of the Ministry for the professional operation of a community museum.

FINANCIAL DETAILSThe Village has been a recipient of grant monies through the Ministry since the 1970s and through the CMOG program since 1981. In the 2011 financial year, Black Creek Pioneer Village received $220,744.00 through the CMOG program. This represents approximately 5% of the Village's operating budget. These monies were deposited into the 512-99-069 account and allocated towards the Village operating costs.

These funds enable the Village to implement its Statement of Purpose. They also link the Village to the Ministry and the provincial museum community. The CMOG grant means that Black Creek Pioneer Village can continue to operate public and education programs, special events, care for the large historical collections and buildings, create and showcase exhibits, reach out and involve our local community and promote our cultural heritage within our community, the GTA and beyond.

DETAILS OF WORK TO BE DONEThere is one further policy in this series that needs to be developed. This is to meet the Ministry of Tourism and Culture Physical Plant Standard. This standard addresses museum buildings, grounds and working environment.The policy for it will be developed by the end of June 2012 and brought to the Authority for approval.

CARRIEDBACKGROUNDGeocaching is an outdoor sporting activity in which participants use a GPS device to hide and seek containers called “geocaches" or “caches”, anywhere in the world. A typical cache is a small waterproof container in which a logbook and trade items are placed. Participants find the location of these caches by inputting coordinates found on geocaching websites on to a GPS unit and then venture out to seek their location. There exist thousands of these geocaches in the Toronto region and due to the outdoor nature of this sport - many geocachers are drawn to TRCA properties to place caches. At the present time, TRCA does not have a policy directed at this type of activity.

TRCA staff has studied the geocaching activity and investigated other geocaching policies developed by conservation authorities, municipalities and Parks Canada, and have consulted with geocaching club members and enthusiasts. Staff has conducted site visits to numerous caches located on TRCA property. In addition, several departments within TRCA were consulted in the development of the policy and modifications were made to satisfy their concerns. Rouge Park has also drafted a similar policy and shared their ideas with TRCA staff. City of Toronto staff support the draft TRCA Geocaching Policy and have indicated that they will use our policy as a template to develop their own. See Attachment 1 for the policy statement.

RATIONALEGeocaching is a very popular activity for outdoor enthusiasts who visit TRCA parks and conservation lands. By combining technology with nature, geocaching encourages a new generation of people to use our facilities. This geocaching policy provides both the public and conservation staff with set rules and regulations for the activity of placing or finding geocaches on TRCA property. Through a detailed search of caches that are located on TRCA lands, many of these items are placed in environmentally sensitive areas that TRCA does not want readily accessible to the public. By establishing set regulations for this activity, such placement of caches will only be allowed within the normal active-use areas of any publicly accessible TRCA property. In addition, any cache that has been placed in an area considered to be closed from the public, is made of (or contains) items that are deemed unsafe or hazardous to the environment can be removed.

This policy supports a number of other TRCA strategic documents including:The Living City Strategy;

Finally, TRCA municipal partners and other conservation authorities who have been consulted support TRCA's draft policy and, once the policy is approved, will use it to develop their own policies.

Attachment 1Toronto and Region Conservation Authority Geocaching Policy

Background

Geocaching (pronounced geo-cashing) is a worldwide game of hiding and seeking treasure. A geocacher can place a geocache anywhere in the world, pinpoint its location using GPS technology and then share the geocache's existence and location online. Anyone with a GPS device can then try to locate the geocache. More information about geocaching or how to get started in this activity can be found at www.geocaching.com or www.ontgeocaching.com.

Geocaching is an ideal way to discover Toronto and Region Conservation Authority (TRCA) lands. However, it is important to keep in mind that these areas are some of the last fragile natural areas left in the Greater Toronto Area and need to be protected.

The following guidelines have been developed to ensure the protection of the Natural Heritage System when geocaching on TRCA park lands and conservation properties.

POLICY STATEMENT

Geocaching activities are permitted on TRCA properties that are available to the public, provided the geocaching activities are in full compliance with the Conservation Authorities Act, TRCA regulations the provisions and guidelines of this policy.

GUIDELINES

1. Placement of Geocaches:

a. Geocachers must apply to TRCA for permission prior to placing a cache on TRCA lands. The application form can be found on the Geocaching Activity page located on the TRCA website (www.trca.on.ca).

b. All caches must be placed within 1m of marked trails, or be within a maintained public area (e.g. picnic areas).

c. Geocachers must travel on marked and maintained trails or in maintained public areas at all times. Caches may not be placed within any culturally, ecologically or geologically significant areas.

d. No digging or disruption of the ground is permitted when placing a cache.e. If marked and or maintained trails do not exist, Geocachers must seek approval for

this activity from the Conservation Area Coordinator, Superintendent or Land Manager prior to entering the property.

f. All caches must be external to any building or structure on TRCA property.

2. Geocache Contents

a. Trade items are permitted in caches provided they are family and environmentally friendly (non-polluting).

b. A cache shall not contain a trade item which attracts wildlife or is potentially harmful to humans, wildlife or the environment.

c. A cache shall not contain food, alcohol, firearms, drugs, dangerous items, batteries, adult items or any other items deemed unacceptable by TRCA.

3. Existing Conservation Rules and Policies

Geocachers must pay all applicable fees and adhere to all rules and policies including: using only designated access points or parking areas; visiting only during regular hours of operation; and respecting all trail closure signs.

4. Right to remove a cache

TRCA reserves the right, at its sole discretion, to remove a geocache if the geocache fails to adhere to the Geocaching Policy or any other TRCA policy, guideline, regulation or practice.

5. Limits on Cache Numbers

TRCA reserves the right, at its sole discretion, to monitor and limit the number of caches in locations on TRCA lands.

6. Cache in, Trash Out and Leave No Trace

Geocachers are encouraged to follow the “cache in, trash out” (CITO) practice which contributes to the maintenance of Conservation parks and lands. For more information about this clean-up practice, please refer to www.geocaching.com.

Visitors are also encouraged to visit the Leave No Trace website at www.leavenotrace.ca. This website offers helpful principles and practices for planning safe and environmentally respectful outdoor recreational activities.

CARRIEDBACKGROUNDAt Executive Committee Meeting #9/82, held on June 30, 1982, Resolution #186 approved the policy on payment of relocation expenses for employees in Toronto and Region Conservation Authority (TRCA) designated houses as follows:

"When a full time employee is required by the Authority to relocate as a result of being transferred from a position requiring an Authority residence to a position also requiring an Authority residence, the employer shall pay for the employee's moving expenses."

At Executive Committee Meeting #7/77, held on May 4, 1977, Resolution #142 approved the Retirement Policy which was further revised at Authority Meeting #5/05, held on June 24, 2005, via Resolution #A130/05, as follows:

THAT the Rehiring of Retired Employee Policy be rescinded and the following substituted:

"Retired employees cannot be rehired under contract within 12 months of their retirement date unless for extraordinary purposes and with the proper approvals. Former employees can be rehired as employees or contract staff within a year however not if the employee has received a severance package at the time of his or her departure.

All contractual extensions of employment beyond the normal retirement date must be approved by the Chief Administrative Officer and the Executive Committee."

At Executive Committee Meeting #23/68, Resolution #414 approved the Employee Suggestion Award System which was further revised at Authority Meeting #5/96, held on June 28, 1996 via Resolution #A115/96, as follows:

THAT the Employee Suggestion Awards Program be revised and;

THAT the value of Employee Suggestion Awards be increased to 10% of the first year's net savings or net revenue to a maximum of $2,000 or;

THAT the value of awards that are not related to cost savings or revenue generation but provide added value to the organization be recognized in the form of MTRCA gift certificates and have a maximum value of $200;

RATIONALE1. Relocation Policy

The strategy of using designated houses for staff in certain positions, primarily in conservation areas has been withdrawn and the need for relocation of staff from one designated location to another has disappeared, hence the need for a relocation policy is at an end.

2. Rehiring of Retired Employees PolicyAs TRCA has more and more staff retiring, there is a need to have transition plans to successfully bring on new staff or relocate responsibilities amongst existing staff. With this in mind, retirees may be requested to provide some interim support to TRCA in their post retirement. In addition, the existing policy for retiring staff was crafted in part to adhere to the guidelines of OMERS, TRCA's pension plan. With changes in OMERS operational guidelines, the need for the current rehiring policy disappears.

3. Employee Suggestion Awards ProgramThe Employee Recognition Awards have not been awarded for many years due to the insertion of such activities of process improvements and new revenue projects into the day-to-day activities of TRCA staff.

FINANCIAL DETAILSThe financial impact of rescinding of these policies is limited to the potential cost of rehiring retiring staff. The cost is mitigated by the value to TRCA of a smooth and efficient transition in the performance of the effected services and responsibilities. The potential cost of rehiring is carefully considered as part of the regular budget process.

AND WHEREAS a coordinated cross-scale approach to EAB management involving all levels of government will increase opportunities to mitigate the impacts of this threat;

AND WHEREAS TRCA is well situated to help play such a coordinating role among agencies engaged locally in EAB management;

THEREFORE LET IT BE RESOLVED THAT TRCA staff continue to facilitate communication, information sharing, consistent messaging and research dissemination between local agencies, partner municipalities and practitioners;

AND FURTHER THAT staff support the Ontario Urban Forest Council in its efforts to seek financial assistance from the provincial and federal governments for EAB management and urban forestry broadly.

CARRIEDBACKGROUNDEmerald ash borer is an invasive insect species introduced from eastern Asia that attacks and kills all native North American ash trees (Fraxinus spp.). In August of 2002 the Canadian Food Inspection Agency (CFIA) confirmed the presence of EAB in Windsor, Ontario. The beetle has since spread throughout southern Ontario and Quebec and is now well established in TRCA’s jurisdiction.

In response to this threat TRCA’s Forest Health Working Group prepared an Emerald Ash Borer Management Approach. This Approach received TRCA board approval at Authority Meeting #12/11, held on January 27, 2012. At this time Resolution #A272/11 was approved, in part, as follows:

...AND FURTHER THAT TRCA staff report back to the Executive Committee on a proposal to engage its member municipalities along with the provincial and federal governments, Association of Municipalities of Ontario and Federation of Canadian Municipalities in a coordinated plan to deal with the emerald ash borer infestation.

Agencies Engaged in EAB ManagementThe EAB infestation has now spread across a significant portion of southern Ontario. Numerous public agencies, private industry and landowners are becoming engaged in the control and management of EAB. However, many others have not been impacted to date and have yet to engage in planning or management actions. This will change as EAB continues to spread across Ontario, forcing agencies and landowners into action. More specifically to TRCA's jurisdiction, EAB has spread to all land uses and ownership types. Consequently, immediate management action will be required by all impacted private and public landowners, including TRCA and regional and area municipalities. The largest effort and cost will likely be incurred by area municipalities, specifically with respect to hazard tree management and ash tree preservation through insecticide treatment.

Many of TRCA’s partner municipalities have responded to this challenge by developing emerald ash borer management plans. The general trend among municipalities is to take a proactive approach to management that will minimize public safety risks through hazard tree removal while also retaining a small but significant portion of the ash population through the use of insecticide treatments. TRCA’s management approach will differ slightly due to the relatively remote location of the majority of TRCA-managed ash trees; as such public safety hazards as a consequence of tree mortality on remote lands will be lower than in high-traffic urban areas managed by municipalities. For this reason TRCA’s approach will focus on ensuring that forest regeneration and succession will not be restricted such that long-term forest health is threatened. For example, forests that lose a significant number of trees due to the EAB may require under story planting or modified forestry practices to help ensure regeneration of appropriate species. Invasive species may also become a more significant issue in these forests, requiring active invasive species removal and control. Hazard tree management will still represent a significant component of TRCA’s overall response and public safety will be accounted for on all TRCA properties. TRCA also plans on using insecticide treatment on a limited number of high value ash trees in public use areas on TRCA lands.

Federal and Provincial Involvement and SupportThe provincial and federal governments have been involved in the management of EAB in a range of capacities; however direct funding support for the control and recovery has been limited. CFIA currently establishes regulated areas from which the movement of all firewood and any ash material is prohibited. The Canadian Forest Service (CFS) researchers are actively pursuing new management options, including tools for early detection and biological control opportunities (e.g. native and exotic parasitoids and pathogens). In 2011 the Ministry of Natural Resources and the Invasive Species Centre hosted a multi-stakeholder EAB management workshop designed to transfer knowledge to municipal urban forest managers.

To address the gap in funding support, an informal working group of municipal urban forest managers and partner conservation authorities (TRCA and Credit Valley Conservation) formed in 2011 to cooperatively engage both the Association of Municipalities of Ontario (AMO) and the Federation of Canadian Municipalities (FCM) such that these groups would seek provincial and federal support on behalf of their member municipalities. This working group also circulated to urban forest managers a resolution template for municipalities to submit for Council approval.

The effort to gain provincial and federal government support is now being coordinated by the Ontario Urban Forest Council (OUFC). In February 2012 the OUFC sent notice to Ontario’s 440 municipal councils asking that they support a resolution that calls for provincial and federal governments to establish “urban forestry mandates and programs which includes funding assistance to municipalities for the control of and management of the Emerald Ash Borer… as well as the creation and funding of programs designed to support the on-going sustainable management of urban forests”. The full resolution template is outlined in Attachment 1. In TRCA’s jurisdiction the Council's of the City of Toronto and the Regional Municipality of York have endorsed this (or a similar) resolution.

RATIONALEA coordinated cross-scale approach to EAB management will increase opportunities to successfully manage this threat. Specifically, assistance from upper levels of government will ensure that damage caused by EAB does not threaten the long-term provision of essential ecosystem services in urban and suburban areas. A loss of ecosystem services such as air pollution removal and urban heat island mitigation may have serious implications for public health.

TRCA is well positioned to help ensure a coordinated approach within the GTA due to TRCA's established partnerships with many of the agencies engaged in EAB management (municipalities, Conservation Ontario, academic agencies, upper levels of government and NGOs), our expertise in forest management and our cross-scale jurisdictional boundary. The large urban forest collaborative, established and chaired by TRCA, has representation from many of the relevant agencies. This collaborative can act as the framework for continued and enhanced coordination on EAB management helping to facilitate information sharing, consistent messaging and research dissemination.

DETAILS OF WORK TO BE DONETRCA will continue to assist in collaborative management efforts by coordinating communication between partner municipalities and local agencies. TRCA may consider hosting an annual workshop that brings together all government, community and academic agencies in the GTA currently engaged in the management of EAB. Such a workshop can serve to identify strengths, weaknesses and opportunities within a local context. It can also be used to ensure that the latest research and best management practices are disseminated to local practitioners and that consistent messaging is delivered to the public.

TRCA will contact Conservation Ontario and request that a similar resolution be distributed to all members. Engaging all conservation authorities will raise the profile of this threat and will enable members to take a proactive approach to management before the infestation reaches a critical threshold. Effective communication between conservation authorities may also present opportunities for collaborative cross-scale management approaches. Toward this end, TRCA will also contact the Ontario Forestry Association (OFA) and the Ontario Woodlot Associate (OWA) for the purpose of working with these organizations to disseminate critical information to rural woodlot owners.

TRCA will continue to liaise with the OUFC and support their work by encouraging all partner municipalities to endorse the resolution set forward by this group.

WHEREAS over 80% of Canadians now live in urban areas and have come to rely on the environmental, ecological and economic benefits of urban forests;

AND WHEREAS the health of Canadians is sustained by their urban forests which provide services through improving air quality, cooling city streets and buildings, acting as a windbreak, shading from harmful UV rays, and filtering storm water, as well as beautifying our communities;

AND WHEREAS neither the federal nor provincial governments currently include urban forestry in their mandates except in a limited role with respect to exotic, invasive pests;

AND WHEREAS the Canadian Food Inspection Agency has not been able to stop the spread of the Emerald Ash Borer throughout Ontario and Quebec

AND WHEREAS the Emerald Ash Borer is expected to cost Canadians over $2 Billion dollars in treatment and replanting;

AND WHEREAS Canadian forestry programs and research are solely focused on industrial forests and do not at present include urban tree planting, appropriate species research, and insect control and management; and

AND WHEREAS other jurisdictions such as the United States Forest Service and the European Urban Forestry Research and Information Centre include urban forestry as a program and research area;

BACKGROUNDAs part of the Regional Watershed Monitoring Program (RWMP), TRCA collects monthly water quality samples at 43 sites throughout its jurisdiction. This is an extensive monitoring network; unique among most conservation authorities which usually rely solely on the data from the Provincial Water Quality Monitoring Network (PWQMN) through the Ontario Ministry of the Environment. The RWMP supplements the 13 PWQMN stations with 30 additional stations throughout the jurisdiction. In addition, the RWMP collects winter samples (November through March) at all sites including the PWQMN sites and has added the analysis of E. coli bacteria as a parameter of interest. The additional sites along with the winter samples help to refine the data seasonally and on a subwatershed scale. The water quality data is used to help understand the impacts of agricultural and urban areas on stream water quality and Lake Ontario.

Historically, the analysis of these samples has been undertaken at several water quality laboratories, including the Ministry of the Environment, the City of Toronto and various private laboratories. Using several laboratories has been a challenge over the years due to data compatibility. In an effort to improve the quality and consistency of the water quality data received and to allow a more consistent and robust interpretation of the results obtained, staff agreed and recommended that a laboratory comparison should be undertaken. In 2008, the RWMP undertook an inter-laboratory comparative study to determine which laboratory had results that most closely matched the processes and results available from the Ministry of the Environment. The study showed that the York-Durham Regional Environmental Laboratory provided the results most similar to the Ministry of the Environment. The ensuing report also recommended that the inter-laboratory comparison should be conducted every two years to ensure that consistency in the data was being achieved.

In the late fall of 2010, TRCA and the City of Toronto conducted a second comparative assessment which included five laboratories - the Ministry of the Environment Rexdale Lab, York-Durham Regional Environmental Laboratory, the City of Toronto Dee Avenue Laboratory, Maxxam Analytics Inc. (private laboratory) and AGAT Laboratories (private laboratory). The results of this data analysis identified strengths and weaknesses among the various laboratories assessed in terms of the equipment and analytical procedures, as well as the analytical detection limits available for certain water quality parameters. In terms of overall performance however, the laboratory which matched and/or exceeded the Ministry of the Environment results was again the York-Durham Regional Environmental Laboratory. The York-Durham Regional Laboratory is owned and operated by the regions of York and Durham and is set-up to provide contracted lab analytical services in addition to providing services for regional programs and projects.

During the 2011 procurement process, a quotation of $140.00 per sample (plus HST) or $61,000.00 plus HST was received from the York-Durham Lab. This quotation was not the lowest, however staff recommended the award of the contract based on the comparative laboratory assessment and to maintain consistency in the data obtained for TRCA's water quality monitoring.

Since a follow-up laboratory comparison has not been completed based on the two year schedule, it is recommended that for the 2012 sampling season (April through December) the York-Durham Regional Environmental Laboratory be awarded the contract for water quality analytical services for a total not to exceed $59,400.00 plus HST ($140.00 per sample). The per sample cost is the same as 2011, however the total contract amount varies from the previous year since it only reflects nine months of service.

Staff will initiate the next inter-laboratory comparison during the summer of 2012, with the intention of setting up the formal water quality services procurement on a two year basis starting in 2013. It is expected that this process, including the costs of the labour, sample analysis and data interpretation, will cost approximately $8000.00 to complete. This biennial cost has been identified and recognized in the Regional Watershed Monitoring Program as part of the overall quality assurance / quality control (QA/QC) aspect of this important program.

RATIONALEBased on the most recent comparative laboratory assessment (2010/11), and the fact that the York-Durham laboratory has not increased its per sample analytical charges from 2011 rates, staff is recommending that the York-Durham Regional Environmental Laboratory be retained to provide water quality analytical services from April 2012 through December 2012, at a total cost not to exceed $59,400.00, plus HST. Staff is of the opinion, that the results achieved from the York-Durham Regional Environmental Laboratory through the most recent comparative study, the quality of the data received over the past three years, and the benefit received in maintaining consistency in the data obtained for TRCA's water quality monitoring matched or exceeded the Ministry of the Environment Laboratory.

Staff therefore recommend award of the contract on a sole source basis as per Section 1.14.5 of TRCA's Purchasing Policy, as follows:

#3 - When the extension or reinstatement of an existing contract would prove most cost-effective or beneficial. The extension shall not exceed one year.

#5 - The required goods and services are to be supplied by a particular vendor or supplier having special knowledge, skills, expertise or experience that cannot be provided by any other supplier.

CARRIEDBACKGROUNDThe Rouge River watershed has undergone significant urbanization over the last two decades and has the potential for significant additional urbanization through development of the remaining rural lands in the municipalities of Whitchurch-Stouffville, Richmond Hill and Markham that are not part of the Oak Ridges Moraine or Greenbelt. Recent analysis conducted as part of the 2007 Rouge River Watershed Plan suggested that development in those municipalities beyond current urban boundaries could substantially increase flood flows and risk to life and property in downstream areas, even if the current stormwater management controls required by TRCA and watershed municipalities were to be applied. The Rouge River Watershed Plan made a specific recommendation for TRCA, in partnership with watershed municipalities, to conduct a detailed investigation into this issue and update stormwater control requirements as appropriate to mitigate this risk.

RATIONALEConsistent with the recommendations of the Rouge River Watershed Plan, and with the mandate and responsibility of TRCA to manage floodplain hazards, it is proposed that a study be conducted to assess the potential impacts of future development in the watershed on downstream flood risk through detailed and purpose-specific hydrological modeling and, if necessary, to develop modified stormwater management control criteria for new development to provide the necessary mitigation of flood risk. The affected watershed municipalities have been consulted on the need for and scope of the investigation and have agreed that TRCA should proceed with the study. Municipal staff will participate on the advisory committee for the project and will be updated regularly on progress and results.

AMEC has performed similar work in the past for TRCA, and staff was satisfied with the firm’s performance on these projects and have confidence that the work proposed in this study will be competently delivered.

FINANCIAL DETAILSThe total cost to be paid to AMEC for work defined in the Terms of Reference is $134,480 plus HST. An additional amount of $25,000 will be set aside to cover any contingencies related to the undertaking, for a maximum project cost of $159,480 plus HST. Of the three quotations received, staff recommends that Images Made Real be awarded the contract to fulfill Partners in Project Green 2012 event filming requirements.

For public events, it is prudent to select a vendor with experience in filming in such circumstances as there are no do-overs. Given the live nature of these events, a vendor with experience in dealing with multiple cameras, lighting and sound recording is required in order to ensure the event is captured properly. Given this requirement, TRCA staff recommend contracting the second lowest bidder given their extensive experience in filming live events, including a number of training and speaker events for Partners in Project Green.
