Sri K.M.Das ,Addl. Director of Industries & Commerce (US) & Member Secretary ,State Level Committeewelcomed the members and explained the purpose of the meeting and requested the members todeliberate on the Agenda placed before the Committee.Agendal: Confirmation of the minutes of the last SLC: The Minutes of the ss" State Level Committee heldon 15.05.2019 were circulated among the members .As there was no observation or comments form anymembers ,the Committee confirmed the Minutes.Agenda 2: Discussion & approval of claim of 30% CCiS(Below Rs.1.5 Crore )

The Member Secretary placed before the the Committee a total of 34 Nos of CCiSclaims and 1 Noof Court Cases.

The Member Secretary in formed the committee that:

All the claims were scrutinized as per policy guidelines issued by DIPP,Governemnt of India fromtime to time .He further informed about the procedures adopted for scrutinizing the claim before placingit to the Committee.AII the claims placed before the Committee had already been scurtinized at variouslevels. Physical verification was initially done by the office of the GM,DICC .Senior Finance & AccountsOfficer and Audit Cell of the office of the Commissioner of Industries & Commerce ,Assam also verified theclaims and admissibility of the investment submitted by the claimants in the light of guidelines issued byGovetnernnt of India till date. The Committee was also informed that the claim put up through agendanote by the office of the Commissioner ,Industries & Commerce. Assam were found to be eligible inaccordance with the revised guidelines.

The Member Secretary further informed that all the financing banks /institutions were also invitedto the SLCto apprise the status of their financing units.

After threadbare discussion and obtaining the views of the officials of the Banks / FinancialInstituions of the claim financed by them ,the Committee examinded all 34 Nos of Central CapitalInvestment Subsidy claims placed before the SLC and approved 18 Nos of claims and deferred ~ Nos andrejected ~Nos cases.

Agenda3. Discussion on l(one) nos of Court Case manufacturing Ayurvedic Medicine.The matter regading Hon'ble High Court W.P(C) Nos .4649/2013 of M/s Emami Ltd.The Order of the Hon'ble High Court passed W.P.(C) Nos 4649/2013 order dated 25.06.2019

The decision of the State Level Committee case wise is placed at Annexure - I,II,III,IV,V.The meeting ended with a vote of thanks form the Chair.

The Claim was placed before the 51st SLC dtd.16.08.2018 and the claim was rejected as there is no production returne shown and there is percentage decrese in IT return one year afterexpansion compared to one year prior to expansion. The Govt. has forwarded the appeal of the unit for need ful action. Accordingly the claim placed before the 59th SLC,dtd. 15-05-2019and the committee deferred the claim and directed to furnish expansion figures for the year 2018-19. Now the unit has submitted the expansion figures 2018- I9 as below for consideration.

The committee observed that the unit was sold out through auction by AFC to Shri Nishant Pathak. The original partners of the unit were l.Shri [agat Goswami, 2.5mti BimalaAgarwala and 3. Smti Wahida Begum. Shri Nishant Pathak has became new propritor of the unit by virtue of taking over possession of the unit from AFC. On scrutiny of the claimit is found that all the documents are found in the name of old partners.

Decision of SLC: The committee resolved that the claim application is contrary to the policy guideline. Hence the committee rejected the claim.

The claim was returned to the GM, DICC, Nagaon on 15.02.2019. The GM re submitted the claim with clarification. As per EM Pt-II the original DOCP was recorded as 30.04.2015which was issued by the previous GM. Subsequently the DOCP of the unit has been changed by the later GM as 23.05.2015.

Decision of SLC: The committee directed to re examine the claim by Sr Officer from Commissionarate and actual date of commercial production to be acertained.
