The FCBA held its 2010 Annual Meeting and Luncheon on June 30th at the Mayflower Hotel where FCC Commissioner Mignon Clyburn gave the keynote speech. DEAR MEMBERS :

Unlike Congress, our Bar does not recess in the August heat.However, just as Members of Congress leave Washington totravel to their home districts, we take advantage of the monthof August to recognize the key role played by FCBA membersand activities outside the Beltway.

FCBA Regional Chapters: Although the majority of FCBAmembers practice in the metropolitan Washington area, theassociation consistently expands its profile around thecountry. No matter where your travels take you you’ll find the FCBA. We havereached a record 10 chapters, each bringing its own regional flavor to the practice ofcommunications law. We also added a number of impressive new co-chairs to ourleadership in the field. Our 2010-11 chapter co-chairs are: Atlanta (JenniferHightower, Carolyn Roddy, and Kennard Woods); Florida (Will Cox, Beth Keating,David Konuch, and Frank Rullan); Midwest (Robert Neumann, Robert Reiland,Grant Spellmeyer, and Lisa Washburn); New England (David Bogan, GregoryKennan, and Julie Laine); New York (Jennifer Kostyu, LaVonda Reed-Huff, MicheleThomas, and Susanna Zwerling); Northern California (Rachelle Chong, RobertMillar, and Mary Wand); Pacific Northwest (Greg Kopta, Dan Menser, KevinMinsky, David Rice, and Angela Wu); Rocky Mountain (Stanton Dodge, CraigDonaldson, and Ray Gifford); and Texas (Brad Bayliff and Roger Borgelt). This yearwe also welcome new leadership in the Carolinas where Teresa Artis, John Stanley,and Robin Tuttle are working to form a new FCBA Chapter. If you are interested orhave friends, colleagues or clients in the Carolinas please contact John, Teresa orRobin! If you practice in Washington, the next time you find yourself in one ofthese regions, reach out to a chapter co-chair. Similarly, if you are a chapter membervisiting D.C., be sure to connect with your fellow FCBA members. Together, theWashington-based core and the small, but mighty, chapter membership can “Pay ItForward” by strengthening relationships within the Bar.

New England and Florida Chapter Programs: It’s not free ice cream, but onSeptember 30, 2010, the New England chapter will host a program onTelecommunications in Vermont. The Florida Chapter will also be hosting aprogram on September 23, 2010, in Tallahassee, FL, on Telecommunications andElectric Utilities: Current Issues. See page 6 for details and registration informationfor both events.

Seminar West: The FCBA strikes gold in San Francisco on Tuesday, October 5,2010, with the return of FCBA Seminar West, at the Moscone Center. The programis still taking shape but we have an impressive list of panelists already confirmed.Panel topics include, among others, Venture Capital, Smart Grid, and Privacy.National Broadband Plan architect Blair Levin, CPUC Commissioner DianGrueneich, and Former FCC and CPUC Commissioner Rachelle Chong are all onboard. Look for more details in the coming weeks. Whether you practice inWashington or in one of our chapters, don’t miss Seminar West!

Finally, looking outward fromWashington is another great opportunity to think abouthow to “Pay It Forward.” While so many of this initiative’s efforts may be focused onour local community and on the Bar’s efforts in D.C., we can do more. Among otherthings, we can help promote broadband adoption in rural communities and bringcommunications law and policy to colleges and law schools around the country. Ifyou are interested in volunteering please contact the FCBA offices or reach out to meat [email protected]. Our association is national, and our networking,educational, and community service efforts, as well as our FCBA activities, shouldserve the whole nation. I look forward to our continued travels together.

PANEL I : ECPA’S WILD R IDE :1986 TO 2010ECPA was enacted before thewidespread adoption of the Internet andnew technologies such as personalcomputers, email, text messaging, andmobile phones, which are now a

standard part of our lives. Since then,courts, government agencies, lawenforcement and businesses havegrappled with how to apply ECPA inthe midst of rapid technological change.Balancing privacy rights with the needsof law enforcement in the digital worldis a challenge. Our panel of experts willexplore how ECPA has beenimplemented and interpreted over itsfirst 15+ years and highlight coveragegaps, circuit-splits, and related issuesraised by growing national securitythreats and the advent of newtechnologies and applications such associal networking, online advertising,geolocation and cloud computing – allof which suggest that the time to reformECPA is now.

Interested in Hosting an FCBA event?The FCBA greatly appreciates the support of our members’ firms andcompanies who provide space for our brown bag lunches, committeemeetings, and CLE Seminars throughout the year. We are, however, alwayslooking for new locations that can host FCBA events. We will beexperimenting with some new presentation technology in future CLEseminars, which require more technical support than we have needed in thepast.

In general terms, we need conference rooms that can seat at least 30 (more ifpossible) people at tables for brown bag lunches and committee meetingsand conference rooms that can seat a minimum of 60 for CLE seminars.Firms and companies hosting brown bag lunches provide beverages anddesserts; firms and companies hosting CLE seminars provide beverages andsnacks. CLE seminars are generally held from 6:00 – 8:30 p.m. Additionally,for CLE seminars we need facilities that can provide technology support formicrophones for as many as six speakers on a panel, the ability to tie thehouse sound system into a teleconference bridge, video projectioncapabilities for PowerPoint presentations, and access to the internet forpresentations by speakers. 2009-2010 FCBAFoundation AnnualReportThe Federal Communications BarAssociation Foundation, celebrating the19th Anniversary of its founding, had asuccessful year providing charitablesupport for education and children’sissues in furtherance of the goals set outin its Mission Statement to:

1) Support worthwhile communica-tions-related and educational projects,as well as other community serviceprojects, particularly those directedtowards children and students, throughfinancial contributions and throughvolunteer services provided byFoundation members and others.

2) Foster greater public awareness andunderstanding of the development ofcommunications technology, resourcesand law.

The Foundation’s accomplishments thisyear included raising about $175,000for the Internship and ScholarshipPrograms; including $12,000 raisedduring the annual Charity Auction co-sponsored with the FCBA’s YoungLawyers Committee, donating $75,000to Bright Beginnings raised during theannual Charity Auction, and numerousvolunteer activities. These activities,and the Foundation’s overall success, isa direct result of the generous supportof individual FCBA members, as well astheir firms and companies. This AnnualReport summarizes the Foundation’sactivities during the recently completed2009-2010 year.

TRUSTEES

The Foundation is governed by a Boardof Trustees, most of whom are electedby the FCBA membership, but whichalso may include persons appointed inaccordance with the Foundation’s By-Laws. This year’s Trustee’s were KyleDixon, Erin Dozier, Julie Kearney,Natalie Roisman, Megan Anne Stull,

Anita Wallgren, Jennifer Warren, andRick Whitt. The Foundation’s officers,as elected by the Board of Trustees,were: Stacy Fuller, Chair; MikeAltschul, Treasurer; Jamie Hedlund,Assistant Treasurer; Celia Nogales, Co-Secretary; and Henry Rivera, Co-Secretary.

Three non-Board members workedextensively with the Board as co-chairsof the Volunteer Services Committee,Joanna Georgatsos, Howard Weiss, andTom Van Wazer. The FCBA’s ExecutiveDirector Stan Zenor, Director ofMember Services Kerry Loughney, andWendy Parish provided invaluablesupport to the Foundation.

SCHOLARSH IP PROGRAM

The Foundation’s scholarship program,the Chairman Robert E. LeeScholarship Fund, is its most significantundertaking, both in terms of the fundsawarded and in the amount of timerequired to administer the program.The scholarships and the laptopsawarded to the scholarship recipientshave the Foundation committingapproximately $140,000 to this year’sscholarship program, helping these verydeserving students.

Information and biographies of thescholarship recipients appear on page14 of this issue of the FCBA News.

The scholarships are awarded based ona number of different criteria, includingthe student’s predicted ability to succeedin college, past academic performance,participation in school activities, schoolattendance, service to the community,financial need, and other relevantfactors that may apply to eachindividual applicant. The scholarshipapplicants are reviewed on the basis of awritten application (includingbiographical information, academicperformance and an essay) and apersonal interview with members of theFoundation’s Board of Trustees andother FCBA volunteers.

Jamie Hedlund, Jennifer Warren, andRick Whitt served as the Foundation’sScholarship Committee Co-Chairs,overseeing the entire program. ErinDozier also provided invaluable supportto the program. The Foundationreceived applications from high schoolstudents of diverse backgrounds fromBell Multicultural, Cardozo, McKinleyTech, Theodore Roosevelt, andThurgood Marshall High Schools in theDistrict of Columbia. Twelve of thesehigh school students were then selectedfor interviews, and 11 emerged as thestrongest applicants. Nine of thesestudents were awarded scholarships;two, as they received full scholarshipsfrom their colleges, are being assignedmentors in recognition of theirqualifications. The scholarships(funded over four years) will assistthese nine students as they moveforward in their educational careers. Inaddition, all 11 of the winners will beawarded a laptop computer to assistwith their studies and will be assignedmentors to help them advanceacademically and professionally.

The Foundation thanks Lisa Fowlkes,Sarah Jameson, Erin Kim, NancyMurphy, and Anisa Latif for serving asthe Scholarship Committee’s liaisons toeach of the participating D.C. publichigh schools in 2009-2010. The Foundation also continued itsmentoring program of soliciting FCBAmembers interested in serving as amentor to a scholarship recipient.Jennifer Holtz coordinated this programagain this year. The mentors areavailable to help support the students intheir transition to college. This is animportant component of the scholarshipprogram, as most of the scholarshiprecipients lack family members or otherpeople to whom they can turn whohave gone through the collegeexperience to provide advice andassistance. At year-end, theFoundation’s Board approved an eventwhere the scholarship recipients, theirmentors, and several Foundation Boardmembers attended the June 29Washington Mystics basketball game.Thanks to the National Association ofBroadcasters, who donated tickets totheir Executive Suite at the VerizonCenter for the Foundation to host thisevent.

INTERNSHIP PROGRAM

The Foundation’s internship programawards stipends from the ChairmanRobert E. Lee Scholarship Fund to lawstudents serving in unpaidcommunications-related legal summerinternships. The Foundation madeawards to seven students, totaling$35,600. The base amount of eachstipend is $5,000, which is intended tohelp defray the student’s expensesduring the internship. One student is

selected to receive an additional $600Max Paglin Award, in honor of theformer FCBA member, FCC GeneralCounsel and Executive Director, andfounder of the Golden JubileeCommission on Telecommunications.This year’s recipients are:

A group ofFoundation Trustees reviewed theapplications, evaluating the applicants’financial need, academic achievements,community service, and the relationshipof their proposed internship tocommunications law.

CHARITY AUCT ION

The 2009 Charity Auction was held onNovember 12, 2009. Co-sponsored bythe Foundation and the FCBA YoungLawyers Committee, this year’s eventraised $75,000 to benefit BrightBeginnings and $12,000 to benefit theFCBA Foundation Scholarship Program.Founded in 1991, Bright Beginnings(http://www.brightbeginningsinc.org) isa DC-based non-profit organization thatprovides free, full-day, year-rounddevelopmental care to infants, toddlers,and preschoolers whose families live inshelters and transitional housing.Bright Beginnings will use proceedsfrom the Charity Auction towardsopening a second center east of theAnacostia River so it may serve morehomeless children and families.

TheBoard of Trustees remained committedto funding scholarships and internshipsusing funds raised during the currentyear rather than drawing on theFoundation’s reserves. At the sametime, the Board hoped to further buildthe Foundation’s reserves towardseventually reaching a level at whichincome from the reserves is sufficient tohelp fund the Foundation’s on-goingwork. Fundraising is, therefore, acritical element to the Foundation’sability to fulfill its mission. Erin Dozierand Natalie Roisman co-chaired theFoundation’s Fundraising Committee,taking the lead in what was a verysuccessful year for donations,particularly for the Robert E. It is named inmemory of former FCC ChairmanRobert E. Lee, who passed away in April1993 after serving on the FCC foralmost 30 years. CONCLUS ION

The Foundation’s Board of Trusteesworked hard this year to build upon thesuccess of past years. The continuedgenerosity and dedication of FCBAmembers contributed to making thisanother successful year for theFoundation, helping to make adifference in the lives of students andchildren who are the direct beneficiariesof the Foundation’s programs. Volunteer Outreachfor Martha’s Table –August 29Many of us are stretched for time thesedays, but why not consider spending afew hours on a Sunday to help theFCBA Foundation’s partner charities?For several years now, the FCBA hasbeen providing volunteers to Martha’sTable and McKenna’s Wagon. Theseorganizations rely on the good work ofour members each month, so grab afriend, colleague or family memberand join your fellow FCBA volunteers!

Martha’s Table feeds hundreds ofhungry, homeless adults and childrenon the streets of Washington daily,through its mobile soup kitchen.Children and friends are also welcome.We will begin at 10:00 am and workuntil 1:00 p.m. Martha’s Table islocated in a yellow building at 2114Fourteenth Street, NW, in the District,near the intersection of 14th and UStreets. On-street parking is available.Volunteers are asked to bring food ifpossible, (e.g., cold cuts, bread, peanutbutter, jelly, vegetables and potatoes)because the center often runs out ofdonated food.

McKenna’s WagonSeeking Volunteersfor August 22McKenna’s Wagon is a mobile soupand sandwich wagon that goes “onlocation” to deliver food to the needy.For those who have volunteered, it hasbeen a wonderful experience and agreat way to help the needy in theD.C. community. This is an especiallygood experience for the teens and pre-

teens among us who do not have a fullappreciation of the many privilegesthey enjoy. Community service creditsare also available.

The Wagon is a white van that isloaded up with sandwiches, snacksand soup. We meet at Martha’s Tableat 4:45 pm in comfortable clothes andshoes. Martha’s Table is located in ayellow building at 2114 FourteenthStreet, NW, in the District, near theintersection of 14th and U Streets.On-street parking is available.

Upon arrival we get assignments(some of us will distribute snacks andsandwiches, others will serve soup),and put on aprons before we depart inthe van to 5th and New York Ave., NW(near the new Convention Center).We are driven by one of ourexperienced volunteers and the trip todistribution location takes about 10-15minutes.

We serve about 30-75 people per visitincluding a few mothers who come forfood for their families. The area iswell patrolled by police. The fooddistribution is conducted in anefficient, calm and orderly fashion andmany of the people we serve are quiteappreciative of our efforts. Once weserve all of the food, we do a clean upof the immediate area. Total time forthe distribution takes about one hourand we usually return to Martha’sTable by or before 6:30 p.m.

FCBA Foundation Awards9 College Scholarships and7 Internship StipendsThe FCBA Foundation, celebrating its 19th Anniversary, ispleased to announce that it has awarded nine collegescholarships to graduating seniors from five District ofColumbia high schools and seven stipends to law studentswho accepted unpaid communications-related legal summerinternships.

Thanks to the generosity of FCBA member companies andlaw firms, as well as FCBA members, the Foundation raisedabout $175,000 for the Internship and Scholarship Programs.In addition to direct donations, funds for the Programs alsoare raised through the annual Chairman’s Dinner, GolfTournament, and Raffle at the Annual Seminar.

The Foundation received 37 applications from law schoolsacross the country and seven students were selected to receivea stipend in the amount of $5,000 to help defray his or herexpenses during their summer internship. In addition, theFoundation selected one student to receive the Max PaglinAward, representing an additional stipend of $600. TheFoundation also received applications from high schoolstudents of diverse backgrounds from Bell Multicultural,Cardozo, McKinley Tech, Theodore Roosevelt, and ThurgoodMarshall High Schools in the District of Columbia. Twelve ofthese high school students were then selected for interviews,and 11 emerged as the strongest applicants. Nine of thesestudents were awarded scholarships; two, as they received fullscholarships from their colleges, are being assigned mentorsin recognition of their qualifications. The scholarships(funded over four years) will assist these nine students as theymove forward in their educational careers. In addition, all 11of the winners will be awarded a laptop computer to assistwith their studies and will be assigned mentors to help themadvance academically and professionally. Information abouteach of the recipients appears on the following pages.

Olamide is Vice President of theStudent Government Association, anda member of the Honor Roll Societyand Future Business Leaders ofAmerica. He had the honor of beingone of two students chosen to attend and document theinauguration of President Barack Obama. He is self-driven,disciplined and takes his education very seriously. HisEnglish teacher describes him as being “…an asset to ourschool, and an extraordinary young man.” Olamide isdetermined to fulfill his father’s dream of seeing his childrencomplete college.

Olamide completed his community service hours atMethodist Home of DC, where he worked in the activitiesdepartment with residents with special needs. His supervisorsays that Olamide “displayed leadership skills” and has“proven to be a compassionate human being with patienceand understanding.”

With exceptional drive and maturity well beyond his years,Olamide has and will continue to persevere. He plans toattend West Virginia University, where he will major incomputer engineering.

YANELYS BARETT$20,000 – News Corporation

Yanelys Barett arrived in the UnitedStates from the Dominican Republicwhen she was 11 years old. Yanelysspoke no English, and needed helpwith reading, writing and vocabulary.Although things were difficult at first,Yanelys managed to assimilate herselfinto the new culture and began tothrive. In a short period of time,Yanelys blossomed into a talented, bright and outgoingstudent full of promise. Her Social Studies teacher describesher commitment to excellence as being “like a breath of freshair.” Yanelys continuously challenges herself academically.Her hard work and perseverance are paying off: She ranks fifthin a class of 127.

Yanelys is a respected member of her school’s newspaper. Sheis dedicated, hard-working and always makes sure that the jobgets done. She always makes herself available to work onstories, and is willing to help others work on theirs.

Yanelys is determined to make the most of the opportunitiesher parents gave her when they moved to the United States.She plans to attend Howard University or Trinity University inthe fall.

MACHE ’ CHASEMache’ Chase is currently rankedsecond in a class of 71 at ThurgoodMarshall Academy. Although she hasreceived several offers from differentcolleges and universities, Mache’ plansto attend the University of Vermont inthe fall to study psychology – a fieldabout which she is passionate.

Mache’ is a highly motivated,enthusiastic and goal-oriented youngwoman. She was elected Lead Student Ambassador for herschool, has earned Honor Roll awards for AcademicExcellence, and has been selected to the Dean’s List. She is a

member of the National Honor Society, a Summa Scholar, anda recipient of the Outstanding Achievement Award forCommunity Outreach at MetroTeen AIDS, where she workstirelessly to educate her peers about HIV and AIDS. She isalso a recipient of the Mayor’s Scholastic Award and the Billand Melinda Gates D. C. Achievers Scholarship.

Compassionate about education and its impact on her future,Mache’ works diligently to be the first in her family tocomplete college.

NIG IST GETANEH$25,000 – AT&T Services, Inc.

A recent immigrant from Ethiopia,Nigist Getaneh was thrown into a newculture she knew very little about.Instead of shying away, however, shedecided the make the most of theopportunity that her new school andcountry had to offer.

Four months after arriving in theUnited States, Nigist was one of 15 students selected toparticipate in the National Cathedral Scholars Program. Theprogram allowed her to meet with many different people andincreased her knowledge of the American way of life. Nigistbecame involved with several other programs as well,including her school’s student government, Future BusinessLeaders of America (FBLA), O’Ambassadors (Oprah’sorganization that works to prevent hunger around the world),and the tennis team.

Nigist has been on the Honor Roll, inducted into the AllanDavis Chapter of National Honor Society, recognized foroutstanding achievement in Chemistry and acknowledged forher outstanding performance and contributions to the tennisteam.

Nigist plans to attend Purdue University, where she will studychemical engineering.

DREW JOHNSON$12,000 – 2009 FCBA CharityAuction Committee Scholarship

Drew Johnson is ready to build on hissuccess at Thurgood MarshallAcademy and plans to attendUniversity of Maryland Eastern Shorein the fall of 2010.

A natural leader, Drew has receivedawards for his participation in footballand basketball while making the honor roll. In addition,Drew is a talented musician and was a founding member ofthe school’s first recording band.

Drew’s accomplishments in math and science will help himpursue a degree in computer science or mechanicalengineering. He has taken on a great deal of responsibility fora young person and looks forward to being able to give backto his community.

His FCBA Scholarship award is essential to Drew’s plans forthe future. As one of his teachers noted, he is “a seriousindividual and sees the need for a good education in order tosucceed in life.”

KEOSHA LAMBERSON$12,250 – Comcast Corporation

Keosha Lamberson is a mature,compassionate student who looksforward to entering Delaware StateUniversity this fall. She has been anoutstanding student leader atThurgood Marshall Academy whilevolunteering in the community andcarrying extra responsibilities at home.

In 2006, Keosha had a life-changing experience when shespent a week helping with Hurricane Katrina relief efforts.Keosha gained an appreciation for what she and her familyhave, and became determined to apply herself to be able tohave a better life. Her schoolwork improved and she was oneof a few students selected for a summer internship withSuperior Court Judge Gardner.

After a close family member was severely injured in a hit-and-run accident two years ago, Keosha renewed her childhooddream to become a surgeon. She is now pursuing hereducation to work in health care, having been impressed bythe caring and competent medical support she witnessedduring that period.

Keosha is honored to receive the FCBA Comcast scholarshipbecause it demonstrates that “there is another believer in me”and will motivate her to achieve her dreams.

JUAN LARA$12,000 – Karen A. KincaidScholarship

Unlike some high school seniors whoare undecided about what they wantto do in the future, Juan Lara alreadyhas a game plan. After graduation,Juan plans on attending college, wherehe will major in Business Managementand Administration and minor inAccounting. He plans on opening hisown accounting firm in his current community.

In spite of hardships that he has encountered, Juan hasmanaged to maintain a 3.66 G.P.A. while taking AdvancePlacement courses. His accomplishments demonstrate hismotivation, will power and strength used to overcome theobstacles that have been placed in his life. Juan serves thecommunity by volunteering with So Others Might Eat(SOME) and Neighbors of Seaton Place, where he works withchildren. Juan is also a member of the National HonorSociety, and is active in the JROTC, First Robotics and thebasketball and baseball teams. He strongly believes thathigher education will map the way for him to be successful.He has the ambition, drive and discipline that it takes tobecome successful. Juan is determined to set a positiveexample for his younger siblings.

Juan plans on attending the University of Maryland EasternShore.

CARVERY LUU$16,250 – DIRECTV

Born and raised in the United States,Carvery was raised in a Chinese andVietnamese culture. Based on herunderstanding of this impact on herEnglish capabilities, Carvery alsovolunteers as a tutor and translator atthe Vietnamese-American CommunityService Center, where she assistschildren who are learning the Englishlanguage. Carvery enjoys workingwith these children because she sees herself in them.

Carvery is pursuing her dreams of going to college andbecoming an aerospace engineer. Carvery has been acceptedto George Mason University and hopes that she will receive allthe necessary financial assistance needed to attend this fall.She has worked very hard to reach where she is today.

Carvery has strong academic skills and is determined to stayfocused and do well so she can assist her parents financially.

NOSA ODIG IE$12,500 – Google Inc.

A native of Southeast Washington,D.C., Nosa Odigie has alreadyovercome substantial obstacles. Hegrew up in a home with a single, hard-working mother, in a neighborhoodthat is constantly crippled with fatalviolence. At his young age, Nosa hasalready experienced this violencepersonally and through the loss offriends. Despite all this, Nosa is determined to earn a collegedegree.

Nosa has proven that he can retain focus despite having beentold that he cannot and will not make it because of where heis from, that his dreams and aspirations are for naught. In theface of this negativity, he has managed to maintain a 3.8 G.P.A.He is a member of the National Honor Society and the VarsityBasketball and Baseball teams.

With exceptional drive and maturity well beyond his years,Nosa has persevered and will be attending Virginia StateUniversity this fall, where he will major in marketing andbusiness management.

ALDRIN PERALTA$8,000 – Microsoft Corporation

Aldrin Peralta learned a lesson in hisfirst 18 years that many learn over alifetime: that not only should onereceive, but one also must give back.For Aldrin, giving back has entailed anactive volunteer schedule with theAsian American Leadership,Empowerment and Development forYouths and Families (AALEAD).Aldrin’s mentors at AALEAD call him a “model student” whounderstands what leadership means.

Born in the Philippines, Aldrin came to the U.S. as he wasstarting high school. He quickly learned English so that hecould take advantage of all of the opportunities that CardozoHigh School and Washington, D.C. have to offer. In additionto a rigorous academic schedule, Aldrin was a key member ofCardozo’s Science Olympiad team, the Chess Club, Art Club,Science Club and African Caribbean Club.

Aldrin has excelled academically at Cardozo High School.This fall, he will matriculate at the University of the District ofColumbia. He plans to fulfill his dream of becoming acomputer programmer, so that he can combine his math andscience talents and his love of technology.

RAQUEL SARVISDespite personal family losses at theage of 14, Raquel Sarvis has managedto maintain her G.P.A and remaininvolved in Cardozo Senior High’sextracurricular activities. With thelove and support of her mother,Raquel is inspired to succeed.

As Cardozo’s Youth Ambassador toBeijing, China, Raquel had a life-changing educational journey thatoffered her unique access to activities and people within theChinese culture. She participated in a project to clean up oneof Beijing’s wetlands. This journey reinforced the foundationfor Raquel’s personal success: Traveling to China opened hereyes to the many opportunities the world has to offer.

Raquel has become an accomplished multi-tasker. In additionto attending school and participating in extracurricularactivities, she also maintains various for-profit positionsduring the summer months. These jobs allow her to earn anincome so she can assist her family, including three siblings.

Raquel keeps a positive attitude and is driven to pursueacademic excellence. She hopes to become an elementaryteacher in the D.C. Public Schools.

Joe graduated Phi Beta Kappa from the University ofWisconsin-Milwaukee in 2006 with a double major inpolitical science and journalism. As an undergraduate, Joe

was Editor-in-Chief of a student newspaper and did a summerinternship covering Capitol Hill in 2005. After a brief stintfreelancing for several publications (including The Onion), Joejoined the U.S. Air Force Reserve and was on active duty forapproximately a year prior to law school. During that year,Joe excelled academically and in his career field as a civilengineer and was named Grissom Air Reserve Base “Airmanof the Year” for 2008.

Mitchell Calhoun is a rising third-yearlaw student at George MasonUniversity School of Law. Originally fromPennsylvania, Mitchell earned hisundergraduate degree from AmericanUniversity. His diverse resumeincludes working for the U.S. House ofRepresentatives and the D.C. Superior Court. He first becameinterested in communications policy and privacy issues whileworking a local IT firm in the city.

While he believes in experiencing all the opportunities D.C.has to offer, Mitchell decided to focus his career ongovernment service and communications after entering lawschool. Last summer he worked for the InformationEconomy Project researching spectrum policy issues. Thispast spring, he interned with the Federal Bureau of Prisons intheir Office of General Counsel, and he is spending thissummer with the FCC’s Telecommunications Access PolicyDivision.

Prior to joining Wiley Rein, Karen served as a SeniorAttorney-Advisor for the Private Radio Bureau, at theFederal Communications Commission from 1989 to1993. She was a law clerk to the Honorable J. SmithHensley, U.S. Court of Appeals for the Eighth Circuitand the Honorable Leo Oxenberger, Chief Judge, IowaCourt of Appeals. She received her B.A. from CentralCollege and her J.D. from Drake University.

Yasemin Kasim is finishing her first-year at the Georgetown UniversityLaw Center and is excited to intern atthe Federal CommunicationsCommission this summer. Yasemin’sbackground demonstrates hercommitment and enthusiasm to workin communications law in the publicsector.

Prior to beginning law school, Yasemin worked for five yearsin media, primarily in television, cable, radio, and internetbroadcasting. Her responsibilities involved working with thelegal aspect of media and emerging technologies. Working asa coordinator and assistant editor in post-production, Yaseminproduced reports and provided media to studio legaldepartments in order to clear the film or television series for

broadcasting and distribution. Through this experience, shediscovered that the forms of communication are continuallyevolving, but the issues of speech, access, privacy, and securityare timeless.

While working in the media industry, it was important forYasemin to find ways to give back to the community. As anemployee at HBO, she mentored an inner-city high schoolsenior. During that time she also spearheaded andcoordinated a drive to help the victims of Hurricane Katrina.Working at an independent production company servingWarner Bros. Home Video, she instituted the office recyclingprogram. While employed at Sony Pictures Entertainment,she helped plant trees with the Tree People organization.Yasemin was just selected to be a Peer Advisor for next year’sincoming Georgetown Law students.

Before working in media, Yasemin earned a Master of FineArts in Film, Television, and Digital Media from the Universityof California Los Angeles. While in school, she produced adocumentary that aired on PBS, for which she won aHollywood Foreign Press award and several other honors.Prior to that, Yasemin graduated summa cum laude fromUCLA with a Bachelor of Arts in Philosophy.

Yasemin is honored and grateful for being awarded theChairman Robert E. Lee Scholarship.

Ari Moskowitz is entering his thirdyear as a law student at the GeorgeWashington University Law School.He is a member of the editorial staff ofthe American Intellectual PropertyLaw Association Quarterly Journal andVice-President of the CyberlawStudents Association. Ari interned inthe Wireline Bureau of the FCC lastsummer and then spent the last two semesters as a law clerkin the office of Commissioner McDowell. Following graduation, he will be staying inWashington, D.C. and hopes to pursue a career intelecommunications law.

Fabiola Rivas, a native of Tequila,Mexico, is a rising 2L at AmericanUniversity Washington College of Lawand alumna of the University ofCalifornia at Berkeley. Washington, D.C., and playing one of her favorite sports Irish“Gaelic” football.

Between undergrad and law school, Fabiola gained valuableexperience in communications, media and intellectualproperty while working at JumpTV. She drafted andnegotiated contracts for Internet and Internet ProtocolTelevision (IPTV) rights to soccer teams and TV channelsaround the world in Spanish, Italian and English. She hopes toexpand her skills into the world of media law.

Leonard S. Joyce(1931-2010)Leonard S. Joyce, a communications lawpractitioner and resident of theWashington area, died on April 11,2010 in Los Angeles from congestiveheart failure. He was 78.

Described by his long-time partner as a“lawyer’s lawyer” who tried cases,worked on transactions, and didwhatever the clients needed to be done,Joyce specialized in the representationof radio and television stations beforethe FCC. His career extended over fivedecades, from the 1960s until hisretirement in 2002. During much ofthat time, Leonard was in partnershipwith George R. Borsari, Jr. Borsarirecalls that it was a “true partnership,”with only a one-page partners’agreement that basically provided forthe partners to agree on all matters,which Borsari recalls they did. “Ourclients didn’t belong to us individually,”Borsari remembers, “but rather to thepartnership.”

Born in Scranton, Pennsylvania, Joycegrew up in Pottsville, Pennsylvania,where he was a high-school basketballstand-out. He graduated fromGeorgetown University in 1953 andreceived his law degree fromGeorgetown’s law school two years later.He served in the Army for three yearsafter law school and then worked at theFCC for three years.

In 1962, Joyce joined the existing lawpractice of Harry Daly, and a few yearslater Borsari arrived to form thecommunications law firm of Daly, Joyce& Borsari. Joyce and Borsari continuedto practice together until 1985. Joycesubsequently formed the law firm ofBlair, Joyce & Silva with Forbes Blairand William D. Silva, with whom hepracticed for a number of years. Heconcluded his legal career as a solopractitioner.

Among Joyce’s clients were a formerpresident of the National Association ofBroadcasters and a number of broadcaststations in Kentucky. Joyce owned aradio station in Kentucky and was

named a “Kentucky Colonel” by thestate’s governor. A former colleaguedescribes Joyce as “Irish to the core.”Another recalls him as big-hearted,passionate, fond of singing, hard-working, and somewhat technologicallychallenged (he clung to dictation whenthe legal world had moved to wordprocessing).

An avid golfer and devoted family man,Joyce resided in Bethesda and attendedOur Lady of Mercy Catholic Church inPotomac. He socialized with othercommunications lawyers, oftenlunching at “Mr. Day’s” in the vicinity ofthe FCC’s former headquarters at 19thand M Streets, N.W.

He is survived by his wife of 53 years,Mary Jo McQuail Joyce, four children –Stephanie Farrell of Bethesda, TriciaJoyce Burriss and L. Stephen Joyce, Jr.,both of New York, and Mae Rhoten ofLos Angeles – and ten grandchildren.

This year’s Symposium opened with a keynote from The Honorable Pamela Jones Harbour, Commissioner of the Federal TradeCommission. Commissioner Harbour provided her perspective on privacy and data security. Three substantive sessionsfollowed. The first covered the government’s role in privacy and data security, including the effectiveness of regulatoryenforcement mechanisms and self-regulatory regimes. The second focused on requisite contract clauses, due diligencerequirements, and insurance coverage to help reduce liability for relationships with third party service providers, behavioraladvertising and social networking websites/services, and e-commerce services. The third session provided an overview ofdomestic state and federal laws, regulations, and guidelines that govern traditional telemarketing and commercial messages andpromotional efforts delivered via wireless devices, including nuances regarding text messages, bounceback messages, andwireless emails.
