BETWEEN

THE GOVERNMENT OF THE REPUBLIC OFSOUTH AFRICA

THE GOVERNMENT OF THE REPUBLIC OFINDIA

AND

THE GOVERNMENT OF THE FEDERATIVEREPUBLIC OF BRAZIL

ON

COOPERATION IN THE FIELD OF HIGHEREDUCATION

PREAMBLE

The Government of the Republic of India, the Government of the Federative Republicof Brazil, and the Government of the Republic of South Africa (hereinafter jointlyreferred to as the "Parties" and separately as a "Party");

RECALLING the Agreement for Scientific and Technological Cooperation betweenthe Government of the Federative Republic of Brazil and the Govenunent of theRepublic of India signed on the 22"' of July, 1985, and the Technical CooperationAgreement between the Government of the Federative Republic of Brazil and theRepublic of South Africa signed on 1" ofMarch, 2000; !

CONSCIOUS thereof that there is a commitment on the part of the Parties to establishsustained collaborations in fourteen sectors under the India-Brazil-South AfricaDialogue Forum (hereinafter referred to as the IBSA framework);

RECOGNISING that there is a tradition of exchanges and cooperation between Indian,Brazilian and South African academic institutions; and

ACKNOWLEDGING that there is mutual interest on the part of the Indian, Brazilianand South African academic institutions to further develop cooperative exchangeprogrammes;

HEREBY AGREE as follows:

ARTICLEl

OB.jECTIVES OF THE MEMORAMDUM OF UNDERSTANDING

The objectives of the Memorandum ofUnderstanding are as follows:

(a) The creatiqn of conditions for cooperation between Indian, Brazilian and SouthAfrican academic institutions, faculties, researchers and students on the basis oflasting institutional arrangements and by means ofjoint research projects inareas that are agreed upon beforehand as being of mutual interest;

(b) the exploration, investigation and development of new forms of South-Southlinkages in the ,field of education;

(c) the alignment of the higher education systems in the way that they relate to eachother, to social and economic development and to local communities;

Cd) the strengthening oftrahting and high-level professional developmentprogrammes; and

(e) the enhancing of the exchange of scientific information and specialiseddocumentation among the three countries.

ARTICLE 2

AREAS OF COOPERATION

The following academic areas will be the focus of the cooperative exchangeProgramme:

(a) Engineering, Computer Sciences and Mathematical Sciences;(b) Biotechnology, Agriculture and Livestock;(c) Sustainable Development;Cd) Social Transformation and Empowerment; and(e) Higher Education Studies.

ARTICLE 3

IMPLEMENTATION

(l) The following orgarrisations shall, on behalf of the Parties, be responsible for the co­ordination, execution and evaluation ofthis Memorandum ofUnderstanding

(a) The Coordination for the Improvement of Higher Education Personnel(CAPESIMEC) on behalf of the Brazilian Ministry of Education;

(b) The University Grants Commission (DGC) working with the Ministry of HumanResource Development on behalf of India; and

(c) Higher Education South Africa (HESA) on behalf of the Department ofEducation of South Africa.

(2) The Parties shall publish national announcements to inform each ofthe respectiveuniversity communities ofthe scope and subject areas ofthe cooperative exchange.

(3) Participating research groups shall be required to present to the Parties projectsdetailing the plans for collaborative research and postgraduate education.

(4) The provisions ofthis Memorandum of Understanding shall only take effect athigher education institutions that were appointed by the Parties.

ARTICLE 4

MODALITIES

The following steps shall be taken in order to accomplish the objectives set forth inArticle 1:

(a) Exchange ofpostgraduate students and postdoctoralfellows;

(b) the establishment of an adjunct faculty exchange programme;I,

(c) the establishment of workshops to support the development of the themesas research areas;

(d) the establishment ofresearch projects in each of the thematic areas;

(e) the establishment of suitable funding mechanisms to support theseactivities;and

Cf) the publication of work related to research undertaken within the frameworkof this Memorandum of Understanding.

ARTICLES

FINANCE

The Parties agree to endeavour to mobilise sufficient funds for the suitablefunctioning of this Memorandum ofUnderstanding.

ARTICLE 6

AMENDMENT

This Memorandum of Understanding may be amended by mutual consent of all threeParties 'through an Exchange of Notes bernreen the Parties through the diplomaticchanneL

ARTICLE?

DISPUTE RESOLUTION

(1) Any dispute between the Memorandum of Understanding Parties arising out of theinterpretation or implementation of this Memorandum of Understanding shall be settledamicably through consultation or negotiations between the Parties.

(2) The Parties will seek to resolve all disputes that may arise out of this Memorandumof Understanding through the diplomatic channel.

ARTICLE 8

ENTRY INTO FORCE, DURATION AND TERMINATION

(1) This Memorandum of Understanding shall enter into force on the date of signaturethereof.

(2) This Memorandum of Understanding shall remain in force for a period offive years,whereafter it shall automatically be renewed for another term of five years, unlessit is terminated in terms of sub-Article (3).

(3) This Memorandum of Understanding may be terminated by either of the Partiesgiving six months' written notice in advance through the diplomatic channel to theother Parties of its intention to terminate this Memorandum of Understanding.Termination shall occur without penalty.

(4) Any such termination shall not affect projects already underway, the continuity ofwhich shall be guaranteed, except when the Parties jointly agree otherwise.

(5) If this Memorandum of Understanding is terminated, none of the Parties shall beliable to the others for any monetary or other losses that may result from suchtermination.

IN WITNESS WHEREOF the undersigned, being duly authorised by their respectiveGovernments, have signed and sealed this Memorandum of Understanding in threeoriginals in the Hindi, Portuguese and English languages, all texts being equallyauthentic. '

Preambulo

o Govemo da Republica Federativa do Brasil(doravante denominados co!1iuntamente "Partes" e separadamente"Parte"),

Recordando 0 Acordo sobre Coopera9ao nos Campos da Ciencia eTeCIlOlogia entre 0 Govemo da Republica Federativa do Brasil e 0Govemo da Republica da India, assinado em 22 de julho de 1985, eo Acordo entre 0 Govemo da Republica Federativa do Brasil e 0Govemo da Republica da Africa do Sui sobre Coopera9ao Tecnica,assinado em lOde mar90 de 2000;

Conscientes do compromisso das Partes em estabelecercolabora90es duradouras em catorze setores no ambito do Forum deDialogo India-Brasil-Africa do Sul (doravante denominado"IBAS");

Reconbecendo a tradi9ao de intercambio e coopera9ao entre asinstitui<;oes academicas brasileiras, indianas e sul-africanas; e

Reconhecendo 0 interesse mutuo das instituiyoes academicasbrasileiras, sul-africanas e indianas em promover 0

desenvolvimento de programas de cooperayao e intercfunbio,

Resolvem estabelecer 0 seguinte:

Artigo 1

Objetivos do Memorando de Entendimento

Os objetivos do Memorando de Entendimento sao os seguintes:

a) a criayao de condiyoes para a cooperayao entre instituiyoesacademicas, faculdades, pesquisadores e estudantes brasileiros,indianos e sul-africanos em bases institucionais duradouras e emforma de projetos conjuntos de pesquisa em areas acordadaspreviamente como de interesse mutua;

b) a explorayao, pesquisa e desenvolvimento de novas formas devinculos Sul-Sul no campo da educayao;

c) b alinhamento dos respectivos sistemas de educayao superior dafanna como os mesmos se relacionarn mutuamente, com 0

desenvolvimento social e economico e com as comunidadeslocais;

d) o· fortalecimento de treinamento e de programas dedesenvolvimento de recursos humanos de alto nivel; e

e) 0 incremento do intercfunbio de informayoes cientificas e dedocumentayao especializada entre os tres paises.

Artigo 2

Areas de Cooperayao

As seguintes areas academicas consistirao no foco do Memorandode Entendimento:

! '.a) Engenharia, Ciencia da Computayao e Matematica;

b) Biotecnologia, Agricultura e Pecuaria;

c) Desenvolvimento Sustentavel;

d) Transformayao Social e Empoderamento, e

e) Estudos em Educayao Superior.

Artigo 3

Implementayao

As seguintes instituiyoes sedo, em nome de cada Parte,responsaveis pela coordenayao, execuyao e avaliayao do presenteMemorando de Entendimento:

a) pelo lade indiano, a Comissao de Bolsas Universitarias (UGC),representando 0 Ministerio de Desenvolvimento de RecursosHumanos;

b) pelo lado brasileiro, a Coordenayao de Aperfeiyoamento dePessoal de Nivel Superior (CAPES/MEC), representando 0

Ministerio da Educayao; e

c) pelo lade sul-africano, a Educayao Superior da Africa do Sui(HESA), representando 0 Departamento de Educayao.

Os grupos de pesquisa interessados deverao encaminhar as Partesprojetos contendo os pianos para pesquisa conjunta e pos­gradua9ao.

Asdisposi90es deste Memorando de EntendimentQ .terao efeitoapenas para as institui90es de educa9ao superior indicadas pelasPartes.

Artigo 4

Modalidades

Os objetivos estabelecidos no Artigo 1 serao alcan9ados por meiode:

a) intercfunbio de estudantes de pos-gradua9ao e pos-doutorandos;

, b) estabeleclmento de urn programa de intercambio para docentes;

c) realiza9ao de semlnarios para fomentar a defini9ao de temasfomo areas de pesquisa;

d) estabeleclmento de projetos de pesquisa em cada urna das areastematicas;

e) 0 estabelecimento de mecanlsmos de financiamento adequadospara apoiar as atividades;

f) publica9ao de trabalho relativo as pesquisas conduzidas noambito do mecanismo deste Memorando de Entendimento.

As Partes se esforyarao em mobilizar fundos suficientes para 0

adequado funcionamento deste Memorando de Entendimento.

Arrigo 7

Resoluyao de controversias

Qualquer controversia entre as Partes resultante da interpretayao ouimplementayao deste Memorando de Entendimento sera resolvidaamigavelmente mediante consultas ou negociayoes entre as Partes.

As Partes procurarao resolver todas as controversias que resultaremdeste Memorando de Entendimento por meio de canaisdiplomaticos.

Artigo 8

Entrada em vigor, durayao e denUncia

o presente Memorando de Entendimento entrara em vigor na datade sua assinatura.

o presente Memorando de Entendimento permanecera em vigorpelo periodo de cinco anos, ap6s 0 que sera automaticamente

renovado por novo periodo de cinco anos, salvo se denunciado nostennos do parigrafo 3 deste Artigo.

Este Memorando de Entendimento poderi ser denunciado porqualquer das Partes, mediante notificayao escrita as outras Partes,por via diplomitica, com seis meses de antecedencia. A denimciado Memorando de Entendimento nao acarretari penalidades.

A denimcia do presente Memorando de Entendimento nao afetaraos projetos em andamento, cuja continuidade seri garantida, excetose as Partes decidirem de outra fonna.

Em caso de denimcia do Memorando de Entendimento, nenhumadas Partes sera responsivel perante as outras por quaisquer perdas,inclusive monetirias, que possam resultar da denimcia.

Em f" do que, os abaixo assinados, devidamente autorizados porseus respectivos Govemos, assinaram 0 presente Memorando deEntendimento em tres exemplares originais, nos idiomas ingles,hindi e portugues, sendo todos os textos igualmente autenticos.
