You have been put on a section 7 of the Mental Health Act.

This is also called a guardianship.

This leaflet is to help you understand what this means.

A health or social care professional should read through this leaflet with you.

They will be able to answer any of your questions.

What is a guardianship?

Guardianship is used to help you to get the care you need outside of hospital.

A guardian is someone from your local Social Services or someone who is approved by them.

Your guardian can say you must do certain things.

Your guardian has the right to decide where you should live.

They can require that a doctor, Approved Mental Health Professional (AMPH) or another named person is able to see you where you live.

They can require you to go for treatment, work, training or education at set times and places.

You can not be given any treatment without your consent whilst under guardianship.

Under guardianship you should still be free to come and go from the place that you live.

Why am I on a guardianship?

Two doctors say that you need a guardian, because you have a mental disorder and

An approved mental health professional has agreed with the doctors.

Even if you feel the section is wrong, for now it will continue.

You are at the centre of your care and treatment.

You must be given enough information to make an informed decisions about your care.

You will have your own care and treatment plan.

You will have care co-ordinator to help you develop this.

You will have a copy of your care and treatment plan and it will be reviewed at least once a year.

You can ask an IMHA or your care team for more information.

You have a RIGHT to an independent mental health

advocate sometimes called an IMHA.

They can help you understand your

rights and treatment options

They can help get support and legal

representation

They can help you complain

They do not work for health or social

services and will speak up on your

behalf

The service is free and confidential

If you would like an IMHA, speak to the staff, who can give

you more information.

What happens next?  

If you want to stop being under a guardianship talk to your care team or IMHA.

You can write to your local Social Services and ask them to look at your case.

You can also ask for a Mental Health Act Tribunal in the same way as a section 3.

There is another leaflet explaining this process.

Your guardianship can last for up to six months at first.

If needed your guardianship can be renewed.

The Code of Practice for Wales gives advice to staff about the Mental Health Act.

They have to think about what the code says when making decisions about your care.
