Bidders must have a buyers number to bid. To register and receive a numberyou will need to fill out a buyers form in either the RMQHA or RMPHA Sales Officeprior to the sale. You must present a current drivers license and provide bankinginformation in order to register for a number. Upon receiving your bidder’s numberyou are eligible to pay for your purchases with a personal check.

Examine horses before bidding. If you have any particular concerns aboutconformation, defects, performance, etc., check these concerns before you bid.Listen for announcements from the veterinarian provided by sale management,who may make announcements about a particular horse as it comes into the ringor you may want to have your own veterinarian inspect a cataloged horse you maybe interested in. This inspection would be at your expense.

All buyers must pay for purchases prior to getting a release to leave theNational Western Stock Show grounds. This will include releases for both brandand health and a purchase contract/trucking release from sale managementcompany(s).

Purchases of Quarter Horses will be finalized at the RMQHA(Quarter Horse) table,purchase of Paint Horses will be finalized at the RMPHA (Paint Horse) table. Allhorses must be settled for and removed from the sale area stalling no later than10:00 AM on January 8, 2012. Bring more than one check if you plan onpurchasing both quarter horses and paints. Also please bring your APHAand AQHA ID numbers which we will use for transfer of horses.

BROODMARES HAVE BEEN PREGNANCY CHECKED WITHIN 10 DAYS OFSALE. ANY PURCHASER OF A BROODMARE SOLD IN THIS SALE MAY HAVEHER RE-EXAMINED WITHIN 24 HOURS AFTER THE FALL OF THE HAMMER,AND PRIOR TO THE REMOVAL FROM SALES PREMISES, BY A VETERINAR-IAN ACCEPTABLE TO THE UNDERSIGNED. Any broodmare so examined whosepregnancy status is found not to be as represented at the time of sale may be returnedto consignor as unsold, and consignor shall pay the veterinarian's fee for examina-tion. There is no guarantee as to the breeding soundness of any filly or mare soldunless such animal be specifically designated as a broodmare prospect.

THIRD - BIDDING PROCEDURE: THE PERSON MAKING THE HIGHEST BID RECOGNIZEDBY THE AUCTIONEER SHALL BE THE BUYER. THE RMPHA/RMQHA SHALL IMMEDIATELYPRESENT THE BUYER WITH A DOCUMENT ENTITLED “ACKNOWLEDGEMENT OFPURCHASE” FOR HIS/HER SIGNATURE. SHOULD SUCH PRESENTATION NOT BE MADEPRIOR TO COMMENCEMENT OF BIDDING ON THE NEXT LOT OFFERED, THE BUYER SHALLFORTHWITH IDENTIFY HIMSELF/HERSELF TO RMPHA/RMQHA AS BUYER AND SIGN THEACKNOWLEDGEMENT OF PURCHASE. BUYER SHALL VERIFY HIP NUMBER AND PRICEBEFORE SIGNING. IN THE EVENT THAT A PERSON OTHER THAN RECOGNIZED BUYERSIGNS THE ACKNOWLEDGEMENT OF PURCHASE, SUCH ACTION SHALL NOT GIVE SUCHOTHER PERSONS ANY RIGHT OR TITLE TO THE HORSE; AND IMMEDIATELY THAT SUCHAN ERRONEOUS SIGNING OF ACKNOWLEDGEMENT OF PURCHASE BECOMES KNOWNTO THE RMPHA/RMQHA, THEY SHALL CAUSE THE ACKNOWLEDGEMENT OF PURCHASETO BE PRESENTED TO THE RECOGNIZED BUYER FOR SIGNATURE. UNLESS WAIVED BYANNOUNCEMENT, THERE SHALL BE AN UPSET PRICE OF $500 ON ANY HORSES OFFERED.IF AN OPENING BID OF THE UPSET PRICE IS NOT IMMEDIATELY FORTHCOMING TO THEAUCTIONEER’S CALL, THE HORSE SHALL BE LED OUT UNSOLD. CONSIGNORS TO THISSALE HAVE THE RIGHT TO PLACE A RESERVE MINIMUM ON ANY HORSE THEY HAVECONSIGNED PRIOR TO THE START OF THE SALE. A HORSE OFFERED WITH RESERVEBID WHICH IS NOT MET WILL BE RETAINED BY CONSIGNOR AS UNSOLD, WITHAPPROPRIATE COMMISSION TO BE PAID BY CONSIGNOR.

FOURTH - BIDDING DISPUTES: SHOULD ANY DISPUTE ARISE BETWEEN OR AMONG TWOOR MORE BIDDERS, THE AUCTIONEER SHALL FORTHWITH ADJUDICATE THE DISPUTE,AND HIS DECISION SHALL BE ABSOLUTE, FINAL, AND BINDING ON ALL PARTIES. BIDSTENDERED AFTER FALL OF HAMMER ARE NOT GROUNDS FOR DISPUTE. BIDS RECEIVEDBY PERSONNEL EMPLOYED BY THE AUCTIONEER HAVE THE SAME STATURE AS BIDSRECEIVED BY AUCTIONEER. IN CASE OF DISPUTE, THE BIDDING SHALL BE REOPENEDFOR ADVANCE BIDS, AND, IF THERE IS NO ADVANCE BID, THE HORSE IS SOLD TO THEPERSON FROM WHOM THE AUCTIONEER RECOGNIZED THE LAST BID. ADVANCE BIDDINGSHALL BE RESTRICTED TO THE DISPUTING PARTIES UNLESS THE BID IS REDUCEDBELOW THE LEVEL OF THE RECOGNIZED BID AT COMMENCEMENT OF DISPUTE, IN WHICHCASE BIDDING IS REOPENED TO ALL. THE AUCTIONEER RESERVES THE RIGHT TOREJECT ANY AND ALL BIDS.

FIFTH - TITLE AND DELIVERY: TITLE PASSES TO BUYER AT THE FALL OF THE HAMMER.ALL RISK OF INJURY TO THE HORSE BECOMES BUYER’S RISK AT PASSING OF TITLE.BUYER OR HIS REPRESENTATIVE SHALL ASSUME CARE, CUSTODY, AND CONTROL OFTHE HORSE IMMEDIATELY AT THE FALL OF THE HAMMER. BUYER SHALL IMMEDIATELYPRESENT HIMSELF/HERSELF OR IN CASE OF A CORPORATION, A DULY AUTHORIZEDREPRESENTATIVE, TO MAKE SETTLEMENT BUT, IN ANY CASE, SHALL SO PRESENTHIMSELF/HERSELF WITHIN THIRTY (30) MINUTES OF CONCLUSION OF THE SALE. UPONSETTLEMENT BY BUYER, HORSE WILL BE DELIVERED PURSUANT TO A BILL OF SALEAND RELEASE PROVIDED BY RMPHARMQHA TO BUYER OR HIS/HER REPRESENTATIVE.BUYER OR HIS/HER REPRESENTATIVE SHALL PRESENT RELEASE TO DESIGNEE OF THERMPHA/RMQHA TO REMOVE HORSE FROM SALE PRESMISES AFTER TAKINGPOSSESSION, BUT, IN ANY CASE, TAKING POSSESSION OF THE HORSE BY BUYER ORHIS/HER REPRESENTATIVE SHALL CONSTITUTE DELIVERY. UPON DELIVERY, BUYERSHALL CAUSE HORSE TO BE REMOVED PROMPLTLY FROM THE SALE PREMISES ORSHALL BE SUBJECT TO STABLE CHARGES AS DETERMINED BY THE RMPHA/RMQHA. INADDITION, SHOULD BUYER FAIL TO CAUSE HORSE TO BE REMOVED PROMPTLY, THERMPHA/RMQHA MAY CAUSE HORSE TO BE REMOVED FROM SALE PRESMISES ATBUYER’S RISK AND EXPENSE. COGGINS AND BRAND CERTIFICATE WILL BE GIVEN TOBUYER AT TIME OF SALE, AND THE REGISTRATION PAPERS WILL BE SENT TO BUYERAFTER THE CHECK HAS CLEARED. PLEASE ALLOW TWENTY-ONE (21) BANK BUSINESSDAYS FOR CHECK TO CLEAR.

SIXTH - TERMS FOR SETTLEMENT: BUYER SHALL MAKE SETTLEMENT WITH THE CASHIEROF THE RMPHA/RMQHA. PAYMENT TO OTHERS, INCLUDING CONSIGNORS OR THEIRREPRESENTATIVES, DOES NOT CONSTITUTE SETTLEMENT. BUYER SHALL PRESENTHIMSELF/HERSELF TO MAKE SETTLEMENT, AS PROVIDED IN THE FIFTH CONDITIONABOVE, FOR THE FULL PRICE, SUCH SETTLEMENT TO BE IN THE FORM OF U.S.CURRENCY OR EQUIVALENT ACCEPTABLE TO CASHIER OF THE RMPHA.

SEVENTH - DEFAULTERS:IF ANY PERSON SHALL PURCHASE A HORSE AND FAIL TO PAY FOR IT WITHIN THE TERMSAS SET FORTH IN THE FIFTH AND SIXTH CONDITIONS ABOVE, NOTHING CONTAINEDHEREIN SHALL PREVENT THE RMPHA/RMQHA OR CONSIGNOR FROM FILING SUIT TOCOMPEL SUCH PERSON TO PAY FOR IT. THE RMPHA OR CONSIGNOR SHALL ALSO HAVETHE OPTION TO RETRIEVE THE HORSE FROM BUYER, AT BUYERS EXPENSE, AND RESELLAT PUBLIC OR PRIVATE SALE WITHOUT NOTICE. COSTS, INCLUDING ATTORNEYS FEES,OF SUCH SUIT OR RESALE SHALL BE BORNE BY BUYER. SHOULD SUCH RESALE FAILTO SATISY THE DEFAULTING BUYERS ACCOUNT IN FULL, DEFAULTER SHALL BE LIABLEFOR THE AMOUNT OWING, INCLUDING ALL COSTS OF COLLECTION AND ATTORNEYSFEES. FURTHER UPON DEFAULT, THE BUYER IN DEFAULT SHALL BE LIABLE FOR ADELINQUENCY OR LATE CHARGE AT THE RATE OF 1 Ω % PER MONTH ON THE UNPAIDPURCHASE PRICE FOR THE DATE OF SALE UNTIL PAID. ALL EXPENSES OF MAINTAININGAND TRANSPORTING OR RESELLING OF ANY HORSE ARISING FROM BUYER’S DEFAULTWILL BE PAID BY THE BUYER. EXCEPT AS SET FORTH IN PARAGRAPH NINE, BUYERSSHALL BE RESPONSIBLE FOR SALES COMMISSION TO RMPHA/RMQHA REGARDLESS OFWHETHER BUYER TAKES POSSESSION OF THE HORSE.

EIGHTH - WARRANTIES AS TO SOUNDNESS: UNLESS EXPRESSLY ANNOUNCED FROMTHE AUCTION BOX OR BY OFFICIAL PUBLICATION OF THE RMPHA/RMQHA, THERE IS NOWARRANTY OR GUARANTEE OF ANY KIND AS TO THE SOUNDNESS OR CONDITION OROTHER QUALITY OF ANY HORSE SOLD IN THIS SALE. IF YOU HAVE QUESTIONS, PLEASECONTACT THE SALE VETERNINARIAN PRIOR TO THE SALE, ALTHOUGH EVERY HORSEWILL BE EXAMINED BY A SALE VETERINARIAN PRIOR TO THE SALE THIS IS BY NO MEANSA “PRE-PURCHASE EXAM” AND SHOULD NOT BE RELIED UPON AS SUCH BY APROSPECTIVE BUYER. IF A BUYER WISHES TO CONDUCT A FULL PRE-PURCHASE EXAM,BUYER IS RESPONSIBLE FOR HAVING THEIR OWN INDEPENDENT VETERINARIANCONDUCT SUCH EXAM BEFORE THE SALE. CONSIGNOR IS THE SOLE GUARANTOR OFSOUNDNESS.

NINTH - RIGHT OF RETURN: ALL HORSES ARE SOLD “AS IS” WITH ALL EXISTINGCONDITIONS AND DEFECTS EXCEPT AS SET FORTH IN CONDITIONS EIGHTH, TENTH,ELEVENTH AND TWELFTH. BUYERS SHOULD EXAMINE HORSES PRIOR TO PURCHASING.VETERINARY ASSISTANCE IS AVAILABLE AT BIDDER’S EXPENSE UPON REQUEST TOSALE OFFICIALS, OR POTENTIAL BUYERS MAY HAVE THEIR OWN INDEPENDENTVETERINARIAN CONDUCT A FULL’“PRE-PURCHASE EXAM” AT BUYER’S EXPENSE ANDMUST BE DONE PRIOR TO SALE. ALL HORSES BECOME THE PROPERTY OF THE HIGHESTBIDDER AT THE FALL OF THE GAVEL WITHOUT RECOURSE AND WITH NO RIGHT OFRETURN. IN THE EVENT CONSIGNOR AGREEES TO THE RETURN OF ANY HORSE GOINGTHROUGH SALE RING BY THE BUYER, FOR ANY REASON WHATSOEVER, CONSIGNORSHALL BE LIABLE FOR THE COMMISION AS IF SOLD. SUCH AN AGREEMENT IS BETWEENCONSIGNOR AND BUYER AND SHALL NOT INVOLVE THE RMPHA/RMQHA IN ANY WAYWHATSOEVER.

TENTH– CATALOG AND ANNOUNCEMENTS: –THE ACCURACY OF ALL INFORMATION OFTHE SALE CATALOG PAGE(S) IS THE SOLE RESPONSIBILITY OF THE CONSIGNOR.CONSIGNOR SHALL HAVE THE AFFIRMATIVE DUTY TO EXAMINE THE CATALOG PAGE (S)ON WHICH HORSES CONSIGNED BY HIM APPEAR, PRIOR TO THE SALE, REPORT ANYINACCURACIES TO AUCTIONEER AND RMPHA/RMQHA SO THAT IT MAY MAKEAPPROPRIATE ANNOUNCEMENT AT THE TIME OF SALE. WHILE CERTAIN INFORMATIONMAY HAVE BEEN PROCURED BY AUCTIONEER OR RMPHA/RMQHA FROM THIRD PARTIESON BEHALF OF CONSIGNOR, IT IS NONETHELESS SOLELY THE RESPONSIBILITY OFCONSIGNOR TO VERIFY THE ACCURACY OF SUCH INFORMATION AND TO NOTIFY THEAUCTIONEER AND RMPHA/RMQHA OF ANY CORRECTIONS PRIOR TO THE SALE. SALESENGAGEMENTS, PRODUCE RECORDS AND ALL OTHER INFORMATION SO LISTED ASREPRESENTED BY THE CONSIGNOR, TO WHOM ONLY THE BUYER SHALL LOOK FORREDRESS IN CASE OF ERRORS OF OMMISSIONS.

ELEVENTH – ARBITRATION: 1) ANY CONTROVERSY ARISING OUT OF A CLAIM AS TOSOUNDNESS OR BREEDING ABILITY SHALL BE SETTLED BY ARBITRATION BETWEEN THEBUYER AND THE CONSIGNOR PURSUANT TO THE FOLLOWING PROCEDURE. UPON THERMPHA/RMQHA’S DETERMINATION THAT A CLAIM UNDER SUCH CONDITIONS OF SALEHAS BEEN TIMELY AND PROPERLY PRESENTED BY THE BUYER PURSUANT TO THESECONDITIONS OF SALE AND UPON NOTICE FROM THE RMPHA/RMQHA, THE BUYER ANDTHE CONSIGNOR SHALL EACH SELECT A LICENCED VETERINARIAN ACCEPTABLE TOTHE RMPHA/RMQHA. IF SUCH VETERINARIANS FAIL TO AGREE PROMPTLY AS TO THEVALIDITY OF THE CLAIM, THEY OR THE BUYER AND THE CONSIGNOR INVOLVED IN THECONTROVERSY, SHALL AGREE UPON A THIRD LICENSED VETERNARIAN. IF TWO SUCHVETERINARIANS OR THE BUYER AND THE CONSIGNOR ARE UNABLE TO AGREEPROMPTLY UPON THE THIRD VETERINARIAN, THE RMPHA/RMQHA SHALL APPOINT THETHIRD VETERINARIAN. THE THIRD VETERINARIAN’S FEE, EXPENSES, COSTS, AND SALESCOMMISSION SHALL BE PAID BY THE PARTY WHOSE PROPERTY THE HORSE ISDETERMINED TO BE. THE PANEL OF THREE VETERINARIANS SHALL CONDUCT ANYTESTS, INVESTIGATION OR EXAMINATIONS DEEMED NECESSARY, AND MAY, IN THEIRDISCRETION, CONDUCT A HEARING BY NOTIFYING THE RMPHA/RMQHA TO ARRANGEFOR THE HEARING AND SHALL, BY MAJORITY VOTE, DETERMINE THE VALIDITY OF THECLAIM. THE RMPHA/RMQHA SHALL DETERMINE THE AMOUNT OF REIMBURSEMENT DUETO A BUYER WHOSE CLAIM IS DETERMINED TO BE VALID AND MAY, IN ITS SOLEDESCRETION, CONDUCT A HEARING TO AID IN MAKING SUCH A DETERMINATION, ANDSUCH DETERMINATION SHALL BE INCORPORATED IN THE AWARD.2) ANY OTHER CONTROVERSY BETWEEN OR AMONG THE BUYER, CONSIGNOR, ANDTHE RMPHA/RMQHA, OR ANY TWO OF THEM, ARISING OUT OF A CLAIM MADE UNDERTHESE CONDITOINS OF SALE OR CONSIGNOR’S CONTRACT, MAY BE SETTLED BYARBITRATION AMONG THE PARTIES, AT RMPHA/RMQHA’S SOLE OPTION, IN ACCORDANCEWITH THE COMMERCIAL ARBITRATION RULES OF THE AMERICAN ARBITRATIONASSOCIATION.

3) ARIBRATION UNDER 1 OR 2 ABOVE SHALL TAKE PLACE IN THE STATE OF COLORADOIN THE CITY AS DESIGNATED BY THE RMPHA/RMQHA. JUDGEMENT UPON ANY AWARDRENDERED BY THE ARBITRATOR(S) MAY BE ENTERED IN ANY COURT HAVINGJURISDICTION THEREOF. THE RMPHA/RMQHA WILL BE ENTITLED TO REIMBURSEMENTFROM THE PARTY WHOSE PROPERTY THE HORSE IS DETERMINED TO BE FORREASONABLE ATTORNEY’S FEES AND OTHER COSTS INCURRED BY THE RMPHA/RMQHAIN THE ARBITRATION AND ANY RELATED COURT PROCEEDINGS. ANY SUCHCONTROVERSY, CLAIM, DEFENSE OR DISPUTE SHALL NOT IN ANY WAY AFFECT THEABSOLUTE OBLIGATION OF THE BUYER TO PAY THE FULL PURCHASE PRICE TO THERMPHARMQHA OR THE OBLIGATION OF THE CONSIGNOR TO PAY THE COMMISSION ASIF SOLD.

Her disposition at this time is average, around a 3-4 on a scale of 10. Sheshows lots of promise with time and the right training. She is ready to start. Herone fault is she was caught cribbing but we put a collar on her which she worefor about 6 months. The last 2 1/2 months she has not had a collar on and showsno signs of cribbing. As an adult she should reach the height of 15.3 hands andweigh around 1200 lbs. We have done some ground work with her. She loadsinto a stock trailer and is fine with worming and shots.
