I wish to draw Mr Speaker’s attention to a matter of privilege concerning a false and misleading statement made by the Member for Toowoomba North while speaking to the Education (Accreditation o f Non-State Schools) Bill 2017 (Bill) on 10 August 2017.

Mr Speaker, I submit the Member for Toowoomba North’s statements about the funding of the hall at Wilsonton State High School were false and misleading and submit the Member has deliberately misled the House and is in contempt of the Parliament, in breach of Standing Order 266 of the Standing Rules and Orders of the Legislative Assembly (Standing Orders).

There are three elements to be proven in order to establish that a Member has committed the contempt of deliberately misleading the House:

1. The statement must have been misleading:2. The Member making the statement must have known, at the time the statement was made, that it was incorrect; and3. In making the statement, the Member intended to mislead the House.

Mr Speaker, I refer you to page 2207 of the Hansard from 10 August 2017. I have attached a copy for your reference.

The relevant exchange follows:

As outlined above, there are three elements to be proven in order to establish that a Member has committed the contempt of deliberately misleading the House. I \will address each of these in turn.

1. The statement must have been misleading

The election commitment to build a hall at Wilsonton State High School made by the Member for Toowoomba North in 2015 was unfunded.

I have received advice from the Department of Education and Training that this project was not funded or costed by the former LNP Government and was not included in the forward estimates.

It is a matter of public record that the hall at Wilsonton State High School was not included in the 2014-15 budget delivered by the former LNP Government. I have attached a copy of the Department of Education, Training and Employment Capital Statement 2014-15 for your reference.

This year, the Palaszczuk Government funded a new $6 million hall at Wilsonton State High School out of the Advancing Queensland Schools Fund.

Mr Speaker, the statements made by the Member for Toowoomba North are contradictory to the information provided by the Department of Education and Training. They are clearly false and misleading. It is my submission the first element is satisfied.

2. The Member making the statement must have known, at the time the statement was made, that it was incorrect

Mr Speaker, having established the first element, I now turn to the question of whether the Member making the statement must have known, at the time the statement was made, that it was incorrect.

On 12 May 2016, the Member for Toowoomba North asked a Question on Notice about the funding of the hall at the Toowoomba State High School Wilsonton campus. I have attached a copy for your reference.

In my answer, I advised the Member for Toowoomba North that when I took office in 2015 there was no funding allocated to build the hall.

On 30 January 2017, the Member for Toowoomba North wrote to me about the construction timeframes for the hall at Wilsonton State High School.

In my response of 15 February 2017,1 wrote “Trevor, you had three years to fund this project and failed. Kate". I have attached copies of the correspondence for your reference.

I submit the Member for Toowoomba North was aware that his 2015 election commitment was unfunded by the former LNP Government, as evidenced by 2014-15 budget papers and my advice to him In May 2016 and again In January 2017.

I submit, Mr Speaker, that at the time of making his statements on 10 August 2017, the Member for Toowoomba North was aware his statement was incorrect.

3. In m aking the statement, the Member Intended to mislead the House.

Mr Speaker, when the Member for Toowoomba North was making misleading statements on 10 August, I Interjected and corrected the Member.

The Member had the opportunity to correct the record then, but chose to continue misleading the House by claiming "It was fully funded”.

Mr Speaker, I am confident this submission provides sufficient information to establish the Member for Toowoomba North made statements to the House that are misleading, knew them to be incorrect and that, in so doing, intended to mislead the House.

I therefore ask, Mr Speaker, that you refer this matter to the Ethics Committee for its consideration of whether the Member for Toowoomba North is in contempt.

everyone needs to stop talking. The point of order was taken and an apology was given. The ministerhas now resumed her seat. I will now call the member to continue, and I need everyone else to listen in silence.

Mr WATTS: We of course have Rockville State School, Wilsonton State School, Newtown State School and Harlaxton, which I visited recently. The distance travelled by the students is very important, and they are kicking some really good goals in literacy despite a tough demographic. I went there the other day and planted a tree with the kids, and they were having a fantastic time as part of NAIDOC week. Fairview Heights recently got their best results on NAPLAN, and I was out there visiting them. They were thankful for the Master Teachers program and they thanked us for the funding in the Great Results Guarantee, because it has made a difference to their ability to get those literacy results.

Highfields State School is where I had children attend for primary. Again, that is a great school that was nearly closed back some 40-odd years ago, but now it is one of the biggest primary schools in the district. East State School, which probably is the biggest school in the district, has recently had a principal change. I certainly wish Richard Gibson success in his appointment there. I visited North State School the other day, and they were telling me about the fete they have coming up and some of the fundraising they are doing.

Overall I think people can see that, whilst it is a little electorate in a provincial town, we certainly punch above our weight in terms of educating future generations. I think that streamlining some of the processes involved in the non-state school sector is very important. We have a very strong non-state sector in Toowoomba at both the primary and secondary levels. At the secondary level we host a lot of students from northern New South Wales, overseas and all over Western Queensland in the form of our boarding population. A lot of these kids come to our town after going through remote learning or very small schools, and they are always welcomed into our town. I think they have a good time because a lot of them stick around and think of Toowoomba, if not as home, as their second home.

I would like to say that I think these changes will help the non-state sector continue the great work they do. As we all know, choice is very important to people who live in Queensland, including choice in education to ensure that their children get not just the best option that they can find but one that really suits their personality. I would suggest to anybody raising children in Queensland that, if they are not sure they can find the school they are looking for where they live, they should move to Toowoomba North because we certainly have a school that will fit the bill for whatever their child needs in terms of their educational future.

Total capital purchases for the Education, Training and Employment portfolio (including the Department o f Education, Training and Employment and related entities) are $411,7 m illion in 2014-15. Total capital grants for the portfolio are $107.6 m illion in 2014-15,

TAPE Queensland was established as a statutory body under the TAFE Queensland A c t 2075 on 1 July 2013. Q n1Ju ly2014 :

TAFE Institutes and associated corporate functions w ill transfer from the Department of Education, Training and Employment to the TAFE Queensland statutory body

Ownership o f the state's training infrastructure and equipment w ill transfer to the Queensland Assets TAFE Management Authority (Q TAM A), a new specialist commercial asset manager.

Department of Education, Training and Empioyment

Education

The 2014-15 capital works program provides capital purchases o f $353 m illion towards the construction and refurbishment of educational facilities, kindergarten services, as well as to complete financially committed TAFE projects.

Capital works planning targets Government priorities and needs through consideration of population growth and shifts, changes in educational needs and addressing high priority needs such as student and staff health and safety.

Program H ighlights (Property, P lan t and Equipm ent)

$59.3 m illion for the 2014-15 allocation to the $1,380 b iilion Queensland Schools Public Private Partnerships project for 10 new schools in South East Queensland.

$117.7 m illion to commence construction for the new secondary school at Highfields, undertake new stages for four recently-opened schools, and to provide additional classrooms at existing schools in growth areas throughout the State.

$93.8 m illion to continue preparations to introduce Year 7 as the first year o f secondary schooling from 2015 under the Flying Start initiative.

$24.4 m illion to commence delivery o f Round 5 of the Australian Government Trades Skills Centres Program.

MR WATTS ASKED THE MINISTER FOR EDUCATION AND MINISTER FOR TOURISM AND MAJOR EVENTS (HON K JONES) -

QUESTION:

Will the Minister provide a guarantee to the people of Toowoomba North and Wilsonton area that the funds required for the construction of an Arts and Sports Hall at Toowoomba State High School Wilsonton campus will be included in the upcoming Budget?

ANSWER:

The previous LNP Government made an unfunded election commitment to build a new hall during the 2015 election.

When I became the Minister I was advised there was no funding allocated to build this hall.

The Member would be aware that capital works funding for the 2015-16 and 2016-17 budgets has been placed under considerable pressure due to the decision o f the previous Government to enter into Public Private Partnerships (PPP) to only build new schools in South-East Queensland and completely neglecting regional Queensland.

I am advised the PPP model was entered against the advice of the former Department of Education, Training and Employment at the time because of the hundreds of millions of dollars that would be diverted from the statewide capital funding budget.

There are currently no plans to fund this hall given these financial constraints.

Dear Minister,

I would like to thank you for your reply to my Question on Notice No. 1953, dated 2 November 2016 pertaining to the construction of the Wilsonton State High School hall facility.

I am seeking your consideration and assistance in having this project moved forward allowing for the construction, commissioning and handing over of this facility in readiness for the commencement of the school year 2018.

Whilst I have not received a request from the Wilsonton State High School or the P. & C. Association to bring this projects completion date forward. SUBMISSIONS

BACKGROUND

1. The issue in question is whether the promise to build a hall at the Wilsonton State High School in the electorate of Toowoomba North by the LNP during the 2015 general election period was fully funded.

2. The Member for Ashgrove has said in the Parliament and again in correspondence to the Speaker, that this promise was not fully funded.

RESPONSE TO THE MEMBER FOR ASHGROVE

3. The Member for Ashgrove has complained to the Speaker in relation to the following exchange:^

I will take a little bit o f liberty because I know this bill is about funding those schools, but I could not continue without mentioning Highfields State Secondary College and Wilsonton. As the m inister knows, whilst there may have been a bit o f kicking and screaming about the hall being built, I thank the m inister for building that hall. It was a shame that the commitment could not have been made in the 2015 election like we did.

Ms Jones: You did not fund it!

M r WATTS: It was fully funded. Minister. You know that. Minister.

4. In para 2 The Member for Ashgrove states “ I have received advice from the Department of Education and Training that this project was not funded or costed by the former LNP Governm ent...”. I suggest that this in itself is a misleading statement, and I enclose the Budget Construction Cost Estimate and Plan that has been in the Departments possession since 23 April 2014.

5. The Member for Ashgrove has referred to the 2014-15 Budget Papers as evidence for her assertion that the statement “[the hall] was fully funded...” is wrong and misleading. Unfortunately for the Member for Ashgrove, the facts do not support her claim. As the Member for Ashgrove admits in her letter, the commitment to build the Wilsonton State High School hall occurred in the 2015 election which was held in January 2015. However the Member for Ashgrove relies on the 2014-15 Budget Papers as evidence to support her claim, but those papers were released on Tuesday 3 June 2014. The 2014- 15 Budget Papers were finalised and printed no less than six months before the commitment to build the hall. Accordingly it is perfectly reasonable that the earlier budget papers would not reflect a promise made six months after the ink dried on their pages.

6. On 24 August 2 0 1 7 ,1 clarified this matter in an adjournment speech, reported in Hansard at page 2569. I refer the Speaker to my adjournment speech and the documents tabled during my speech - especially page 16 of the bundle of documents I tabled. Page 16 of the bundle clearly shows that the LNP 2015 Election Commitments costing document (Funding Queensland’s Future pg18) allocated funding for projects including the W ilsonton State High School hall from a pool of funds set aside under the Better Schools Boost.

7. For the Member for Ashgrove to suggest that her own self-serving hand written note is evidence of anything in relation to LNP election commitments being funded is a nonsense.

8. In conclusion, the allegations made by the Member for Ashgrove in her letter dated 25 August 2017 are without merit. The LNP election commitment to build a hall at the Wilsonton State High School was fully funded in the LNP’s election costings document. The evidence offered by the Member for Ashgrove is not relevant and cannot support her claim as it was printed six months before the time of the commitment - a date admitted by the Member for Ashgrove.

CONCLUSION

9. I respectfully submit that the Member for Ashgrove’s complaint is baseless and should be dismissed as it does not warrant the further attention of the House.

Planning for the new hall has progressed in consultation with the new Principal of Wilsonton State High School.

I announced a new hall for Wilsonton State High School on 9 August 2016 and construction w'ill commence during the 2017-18 financial year, with the completion of the project expected in Term 2, 2018.

School Wilsonton Campus

Students at the W ilsonton campus o f the Toowoomba State High School can look forw ard to

a new arts and sports hall under a re-elected LNP governm ent.

M em ber fo r Toowoom ba North Trevor W atts said the s ta te -o f-the-a rt facility would support

the school's grow ing sporting, arts and extra-curricular activities and provide greater

opportun ities fo r com m unity events.

"Since 2 0 1 2 ,1 have been consulting w ith the P&C and school com m unity and I am pleased

to confirm tha t i w ill deliver th is much needed facility if I am re-elected," M r W atts said.

"Linder the LNP G overnm ent and w ith me as the M em ber fo r Toowoomba North, local

families can be assured tha t the ir kids w ill have the facilities and resources they need to

achieve great results.
