Division of High Courts (Amendment) Ordinance promulgated on
03.05.2018 to:
Reduce minimum value of dispute from Rs 1 crore to Rs 3 lakh.
Constitute Commercial Courts at district level where High Courts have ordinary original
civil jurisdiction.
Introduce pre-institution mediation through authorities under Legal Services Authorities
Act, 1987.
Proposal to establish 210 Mediation Centres at identified DLSAs and 5
Charter High Courts, being taken up with 15th Finance Commission.
Bombay High Court has designated 12 City Civil Courts as Commercial
Courts where 10,426 cases of commercial nature being adjudicated.
Delhi High Court is in the process of identifying courts in each district
to designate them as Commercial Courts.
Specific Relief (Amendment) Bill, 2017 passed by Lok Sabha and
pending in Rajya Sabha : To provide for specific performance of
contracts.

Faster disposal of appeals by ITAT
Improving Efficiency, Transparency and Accountability by Digitization
Pendency of appeals reduced from 1,03,238(in 2014) to 91,954 (till March 2018).
New Benches established at Cuttak, Surat and Varanasi
Alternative Dispute Redressal Mechanism
Amendment to The Arbitration and Conciliation Act, 1996 by the Arbitration and Conciliation (Amendment) Act 2015 to expedite the speedy resolution of disputes by prescribing timelines.
A High-Level Committee (HLC) set up by the Central Government has recommended setting up of an independent body namely, Arbitration Council of India (ACI) to inter-alia grade arbitral institutions, accredit arbitrators and impart training and award certificate in the ADR field.
The HLC has also recommended a proposal to set up Institute of National importance namely, New Delhi International Arbitration Centre, by taking over the undertakings of International Centre for Alternate Dispute Resolution (ICDR)

Improving Litigation
Litigant Legal Information Management & Briefing System (LIMBS)
• LIMBS brings transparency and sense of ownership in all stakeholders during the entire life cycle of a court case
• More than 260861 court cases in 2095 courts on the platform. 7451 registered users. Presence of 15296 advocates
• 1068 Arbitration cases on the portal
• Critical legal advice being provided to prevent any legal infirmity in the steps taken by the Government
Fee of Law Officers, Arbitration Panel Counsels and other Government Legal Counsels has been upwardly revised to the extent of by 50% from October 2015 from earlier prescribed rates of 2011.

Removal of Gender Disparities
The Muslim Women (Protection of Rights on Marriage) Bill, 2017 was passed by LokSabha on 28th December, 2017 and is pending in Rajya Sabha
Bill protects the rights of married Muslim women and prohibits divorce by pronouncing talaq having the effect of instantaneous and irrevocable divorce by their husbands.
Pronouncement of such talaq shall be void and illegal with a punishment of up to 3 years.
Such offence cognizable and non-bailable.
Enables the married Muslim Women to such subsistence allowance for her and her children and also the custody of children as may be determined by Magistrate.
E-POSTAL BALLOT SYSTEM FOR SERVICE VOTERS
Notification issued on 21st October, 2016 enabling service voters including armed forces personnel to cast votes through e –postal ballot
Blank e-postal ballot would be transmitted to the voter entitled to postal ballot
After marking vote in the postal ballot, it would be returned to concerned Returning Officer by post
This would drastically reduce the delay in postal transit
Armed forces personnel serving in remote and border areas would be greatly benefitted
PROXY VOTING FOR OVERSEAS ELECTORS
As per the extant Rules, overseas Electors are required to be present in person to cast their votes at the time of elections
In order to mitigate the hardship faced by them, the Representation of People(Amendment) Bill, 2017 has been introduced in the Lok
Sabha providing for proxy voting by overseas Electors
When enacted, overseas Electors would be able to cast their votes in elections by appointing their proxies
UPDATION AND DIGITIZATION OF CENTRAL ACTS
English version of Central Acts from the year 1939 to 2018 (numbering 760) have been updated and uploaded on the website.
Hindi version to Central Acts from the year 1927 to 2016 (numbering 764) have been updated and uploaded on the website.
These acts are available on Department’s website http://legislative.gov.in under Documents – Legislative References.
Legislative Department has developed a new India Code Web Portal for providing a one stop repository of all the Acts and their respective subordinate Legislations
• Ministry is also coordinating with the State Governments and UT Administrations for uploading of their Acts and Subordinate legislations on the new India code Portal.
International Cooperation
Mutual Legal Assistance Treaties (MLAT) signed with Afghanistan and Oman
Apart from MLATs, MoUs have been signed with five countries Turkey, China, Russia, Qatar and Morocco.
MoU with Morocco was signed in April, 2018
MoU with UK is under negotiation
Department of Legal Affairs is the Central Authority under Hague Convention of 1965 for service abroad of judicial and extra judicial documents in civil and commercial matters. Under this obligation, more than 3000 requests have been processed during the last four years.
