Short title and commencement 1. The rules may be called the Petroleum Rules, 1976. 2. They shall come into force on the Ist day of August, 1976. 2. Definitions In these rules, unless the context otherwise requires; 1. "Act" means the Petroleum Act, 1934 (30 of 1934); 2. "adequate" (a) in relation to ventilation, means where the concentration of the inflammable gas in gasair mixture does not reach the lower inflammable limit, or (b) where applied to provision of facilities for firefighting means the facilities so provided are in accordance with the preva lent recognized standards or codes safety; 3. "approved" (a) where applied to specification, means that the specification is authorized by the Chief Controller; (b) where applied to an appliance or fitting, means that the appliance or fitting bears a label of a designated test organi zation certifying conformity with a specification approved by the Chief Controller or with a laboratory test report ac cepted by the Chief Controller, or (c) where applied to any facility for petroleum means that it conforms to these rules; 4. "Chief Controller" means the Chief Controller of Explosives; 5. "competent person" means a person recognized by the Chief Control ler to be a competent person, or a person who holds a certificate of competency for the job in respect of which competency is required from an institution recognized by the Chief Controller in this behalf; 6. Conservator includes any person acting under the authority of the officer or body of person appointed to be Conservator of a port under Sec.7 of the Indian Ports Act, 1908(15 of 1908); 7. "container" means a receptacle for petroleum not exceeding 1,000 litres in capacity. 8. Chief Controller of Explosives, Deputy Chief Controller of Explo sives includes Joint Controller of Explosives and Deputy Controller of Explosives. (8a) "Defence Forces of the Union includes General Reserve Engineering Forces under the Director General, Border Road, the Central Reserve Police Force, Assam Rifles, Border Security Force and National Security Guard under the Ministry of Home Affairs and Special Security Bureau under the Cabinet Secretariat."] 9. "District Authority means (a) in towns having a Commissioner of Police, the Commis sioner or a Deputy Commissioner of Police; (b) in any other place, the District Magistrate; 10. "District Magistrate" includes an Additional District Magistrate and in States of Punjab and Haryana and in the Karaikal, Mahe and Yenam areas of the Union Territory of Pondicherry, also includes a Subdivisional Magistrate; 11. "electric apparatus" includes motors, starters, lamps, switches, junc tion boxes, fuses, cut outs or any other appliance, equipment or fitting which operates electricity; 12. "form" means form given in the First Schedule; (12a) "hot work" means any work which involves welding, burning, soldering, brazing and blasting, chipping by sparkproducing tools, use of certain powerdriven tools, nonflame proof electrical equip inent or equipment with internal combustion engines and including any other work which is likely to produce sufficient heat, capable of igniting inflammable gases; 13. "Inspector" means an officer authorized by the Central Govern ment under subsection (1) of Sec. 13 of the Act; 14. "installation" means any premises wherein any place has been specially prepared for the storage of petroleum in bulk, but does not include a wellhead tank or a service station; 15. "petroleum in bulk" means petroleum contained in a tank irrespective of the quantity of petroleum contained therein; 16. "protected area" means the necessary for the maintenance of the distances required under the conditions of the licence to be kept clear between any installation, service station or storage shed and any protected works; 17.     18. "samplingofficer"meansanofficerauthorizedbytheCentralGovernmentundersubsection(1)ofSec.14oftheAct

    19. "Schedule"meansaScheduleannexedtotheserules20. "servicestation"meansanypremisesspeciallypreparedforthefuellingofmotorvehiclesand

    includes such places within the pre mises which have been specially approved by thelicensingauthorityfortheservicingofmotorvehiclesandforotherpurposes

    21. "store shed" means a building used for the storage of petroleum otherwise than in bulk,whether formingpart of an installation or not, but does not include a building used for thestoresofpetroleumexemptfromlicenceunderSecs.7,8or9oftheAct

    22. "tank"meansareceptacleforpetroleumexceeding1000litresincapacity,23. "tankcart"meansahanddrawnoranimaldrawnvehicleequippedwithatank24. "tanksemitrailer"meansatanktrailerconstructedinsuchamannerthatwhenit isdrawn

    bya tractorbymeansof fifthwheel connection, somepart of the load rests on the towingvehicle

    25. "tanktrailer"meansatankmountedthereonorbuiltasintegralpartthereofandconstructedinsuchamannerthatithasatleasttwoaxlesandallitsloadrestsonitsownwheels

    26. "tanktruck"meansasingleselfpropelledvehiclewithatankmountedthereon27. "tankvehicle"meansanyvehicle,includingatankwagonwithatankofacapacityexceeding

    1,000litresmountedthereon28. "tankwagon"meansarailwaycarriagewithatankmountedthereon.29. "testing officer" means an officer authorised by the Central Government to test petroleum

    underSec.17oftheAct30. "vehicles means all carriages, including animaldrawn carriages for the transportation of

    petroleumeitherinbulkorotherwisethaninbulk31. "wellheadtank"meansatankintowhichcrudepetroleumflowingorbeingpumpedfroman

    oilwellisfirstdischarged.

    PartII:GENERALPROVISION

    3.Restrictionondeliveryanddespatchofpetroleum

    1. NopersonshalldeliverordespatchanypetroleumtoanyoneinIndiaotherthantheholderofa storage licence issued under these rules or his authorized agent or a port authority orrailwayadministrationorapersonwhoisauthorizedundertheActtostorepetroleumwithoutalicence.

    2. Thepetroleumdeliveredordespatchedundersubrule(1)shallbeoftheclass,andshallnotexceedthequantity,whichthepersontowhomitisdeliveredordespatchedisauthorizedtostorewithorwithoutalicenceundertheAct.

    3. Notwithstandinganythingcontainedinsubrule(2),petroleumClassBnotexceeding15,000litres in quantity packed in sealed air tight approved containers may be despatched to apersonnotholdingastoragelicenceprovidedthatthepersondespatchingthepetroleumhassatisfied himself that prior arrangement have been made by the person to whom thepetroleumisdespatchedfortheimmediatedisposal intheoriginalsealedpackagesorsuchquantityasinexcessof2,500litres.

    4. Nothing insubrules (1)and (2) shall apply to thedeliveryof despatchof petroleum to theDefenceForcesoftheUnion1[andtothedeliveryordespatchofkerosene(PetroleumClassB)tothepersonholdinglicenceinFormXVIfordecantationintocontainersfromtankvehicle:

    Providedthat thepersondespatchingthekerosenehassatisfiedhimself thatpriorarrangementshavebeenmadebythepersontowhomthekeroseneisdespatchedforimmediatedisposalintocontainersinlotsof2,500litresorless.

    4.Approvalofcontainers

    1. ContainersexceedingonelitreincapacityforpetroleumClassAandfivelitresincapacityforpetroleumClassBorpetroleumClassC.shallbeofatypeapprovedbytheChiefController.

    2. Where theapprovalof theChiefController issought toa typeorcon tainernotpreviouslyapproved,anapplicationaccompaniedbytwelvecopiesofadrawingthereoftoscaleshowingthedesign,materials to beused, themethodof constructionand capacity of the containertogetherwithtwosamplecontainersandafeeofrupeesfiftyforscrutinyshallbesubmittedtotheChiefController.

    3. Nothinginsubrules(1)and(2)shallapplytocontainers inthepossessionof theDefencesForcesoftheUnion.

    5.ContainersforpetroleumClassA

    1. ContainersforpetroleumClassAshallbeconstructedoftinned,galvanisedorexternallyrustproofedsheetironorsteelandbeofatypeapprovedbytheChiefController.

    2. The containers shall be so constructed and secured as not to be liable except undercircumstances of gross negligence or extraordinary accident to becomedefective, leaky orinsecureintransitandtheyshallbekeptinproperrepair.

    3. Thecontainersshallhavewellmadefillingaperturewhichshallbefittedwithwellfittingandsecureairtightscrewplugsofscrewcapsorothercaps.

    4. Containersmadeofsheetironorsteelshallhavethefollowingthicknessofmetal:5. Thecapacityofanycontainer,otherthanthoseapprovedbytheChiefControllerforspecified

    purposes,shallnotexceed300litres.6. Anairspaceofnotlessthan5percent.ofitscapacityshallbekeptineachcontainer.7. Thecontainershallbearastamped,embossedorpaintedwarningexhibitinginconspicuous

    characters the words "Petrol" or "Motor Spirit" or an equivalent warning of the highly

    inflamablenatureofthepetroleum.8. Nothinginsubrules(1),(3),(4),(5),(6)and(7)shallapplytocontainersinthepossessionof

    theDefencesForcesoftheUnion.6.ContainersforpetroleumClassBandClassC

    1. ContainersforpetroleumClassBorpetroleumClassCshallbeconstructedofsteelor ironandbeofatypeapprovedbytheChiefController.

    2. Anairspaceofnot less than5percent.of its capacityshallbekept ineachcontainer forpetroleumClassBandnotlessthan3percent.ofitscapacityineachcontainerforpetroleumClassC.

    3. Nothinginthisruleshallapplytocontainers inthepossessionoftheDefenceForcesoftheUnion.

    7.Empty receptaclesAll empty tankswhich had petroleumClassA or petroleumClassB andempty containers which had petroleum Class A shall, except when they are opened for thepurpose of filling or cleaning and rendering them free frompetroleum vapour, be kept securelycloseduntiltheyhavebeenthoroughlycleanedandfreedfrompetroleumvapour.

    8.Repairstoreceptacles

    1. Nopersonshallcausetoberepairedorrepairbytheuseof1[hotwork]anytankorcontainerwhich had petroleum unless it has been thoroughly cleaned and from petroleum andpetroleumvapourorotherwisepreparedforsafelycarryingoutsuchhotrepairandcertified,inwriting,byacompetentpersontohavebeensorepaired.

    2. Thecertificaterequiredundersubrule(1)shallbepreservedbytherepairerforaperiodofatleastthreemonthsandproducedtoanInspectorondemand.

    9.PreventionofescapeofpetroleumAlldueprecautionsshallbe takenatall times topreventescapeof petroleum intodrain, sewer, harbour, river orwatercourseor over anypublic roadorrailwayline.

    10. Prohibition of employment of children and intoxicated personsNo child under the age ofeighteenyearsandnopersonwhois inastateof intoxicationshallbeemployedontheloading,unloadingortransportofpetroleumorinanypremiseslicensedundertheserules.

    11.Prohibitionofsmoking, fires, lights,etc.Unlessexpresslyprovided in these rules,nopersonshallsmokeand]nomatches,fires,lightsorarticlesorsubstancescapableofcausingignitionofpetroleumshallbeallowed,atanytimeinproximitytoaplacewherepetroleumisrefined,storedorhandledorinavehicle,carriageorvesselinwhichpetroleumistransported.

    12.Specialprecautionsagainstaccident

    1. No person shall commit or attempt to commit any act which may tend to cause a fire orexplosioninoraboutanyplacewherepetroleumisrefined,storedorhandledoranyvehicle,carriageorvesselinwhichpetroleumistransported.

    2. Every person storing petroleum and every person iii charge of or engaged in the storage,handlingortransportofpetroleumshallatalltimes(a)complywiththeprovisionsoftheserulesandtheconditionsofanylicencerelatingthereto(b)observeallprecautionsforpreventionofaccidentbyfireorexplosionand(c)preventanypersonfromcommittinganyactreferredtoinsubrule(1).

    13.Paymentoffees

    1. AllfeespayableundertheserulestotheChiefControllerorControllerofExplosivesshallbepaid intoa treasuryandcoveredbya treasuryreceiptmarked"original"andshowingcreditundertheCentralHeadofAccount"120IndustriesAGeneralReceiptsunderPetroleumActOtherCollections."

    2. Fees payable under these rules to any authority other than the Chief Controller or theControllerofExplosivesshallbepaidincashorbycheque.

    3. Ifanapplicationforthegrant,renewaloramendmentofalicenceisrejected,thefeepaidbytheapplicantshallberefundedtohimbythelicensingauthorityifthefeehasbeenpaidincashorbychequeor(ii) if the feehasbeenpaid into a treasury, by that treasuryon theproductionof a signedorderfromthelicensingauthoritydirectingsuchrefund.

    4. Feespayableundertheserulesforpurposesotherthanthegrant,renewaloramendmentoflicencesshallnotberefundable.

    IMPORTATIONOFPETROLEUM

    PartI:GENERAL

    14.LicenceforimportofpetroleumPetroleum,otherthanpetroleumwhichmaybestoredwithoutalicenceunderSecs.7,8and9oftheAct,shallnotbeimportedintoIndiaexceptunderalicencegrantedundertheserules.

    15.Petroleumexempted

    1. Nothing in thischapterapplies topetroleumClassBorpetroleumClassCcomprising inaship'sstoresandmanifestedassuch

    2. Nothinginrules14,19and26shallapplytopetroleumimportedbytheDefenceForcesoftheUnion.

    PartII:IMPORTATIONBYSEA

    16.Partsintowhichpetro1eummaybeimported

    1. Petroleum shall not be imported into India by sea except through the ports of Bombay,Calcutta, Cochin, Haldia, Kandla, Madras, Mormugao, Okha, Port Blair, Visakhapatnam,TuticorinorMangalore.

    2. Notwithstandinganything contained in subrules (1), theCollector ofCustomsmay, on therecommendationoftheChiefController,allowimportationofpetroleumClassBorpetroleumClassC,otherwisethaninbulk,throughanyotherport.

    17.Declarationbythemasteroftheshipcarryingpetroleumortheship'sagent

    1. Themasterofeveryship~carryingpetroleumshalldelivertothepilotbeforeenteringanyportmentioned in subrule (1) of rule 16, a written declaration in Form 1 under his signature :Provided that no such declarations is necessary if the agent of a ship deliver Such adeclarationsignedbyhimtotheConservatorbeforethearrivalofsuchship.

    2. The pilot shall make over the said declaration to the Conservator without delay and theConservator shall forward the declaration to the Collector of Customs of the port with allconvenientdespatch.

    18.Anchorageofshipscarryingpetroleum

    1. Every ship having petroleum on board shall be anchored at such anchorage as theConservator shall specify in this behalf and shall not leave such anchorage without thegeneral or special order of the Conservator and subject to such conditions as may bespecifiedinsuchorder.

    2. Theanchorageshall innocasebe thesameas that forvessels ladenwithexplosivesandshallbeatsuchdistancefromtheanchorageforvesselsladenwithexplosivesastorenderitimpossible for a fire originating at the former anchorage to affect vessels at the latter :ProvidedthatnothinginthisruleshallapplytoshipshavingonboardpetroleumClassC.

    19.Productionofcertificateandlicenceforimport

    1. EverypersondesiringtoimportpetroleumshallfurnishpersonallyorthroughhisagenttotheCollectorofCustoms(a)certificateofstorageaccommodationinFormIIsignedbysuchpersonorhisagentand(b) the licence or an authenticated copy of the licence for the import and storage of suchpetroleumProvided that nothing in this rule shall apply to the importation, otherwise that in bulk, ofpetroleumexemptedunderSecs.7,8,9and10oftheAct:Provided further that the furnishingofa licenceunderCl. (b)shallnotbenecessary for theimportationofpetroleumClassCinbulkinquantityexemptedunderSec.7oftheAct.

    2. Notwithstandinganythingcontainedinsubrule(1)apersonmayimportpetroleumClassAinbulk,even,if(i)heisnotholdingalicenceforstorageattheportofimportationor(ii)thestorageaccomodationinthepremiseslicensedinhisnameisnotsufficienttoholdthequantityofpetroleumintendedtobeImported:Provided in both cases adequate advance arrangements to the satisfaction of theConservatoraremadeby the importer todistribute thepetroleumfromtheportof import topremiseslicensedtostoresuchpetroleum.

    20.PermissionofCollectorofCustomstolandpetroleum

    1. No imported petroleum shall be landed except with the permission of the Collector ofCustoms.

    2. IftheCollectorofCustomsafterreceiving(a)ofthetestingofficer'sreportonthepetroleum(b)thecertificateofstorageaccommodationinForm11ifrequiredunderrule19(c)thelicenceoranauthenticatedcopyofthelicenceifrequiredunderrule19,and after making such further enquiries as he deems necessary, is satisfied that thepetroleumcanbelawfully importedandthat there issuitableaccommodationfor it,heshallpermitittobelanded.

    3. IftheCollectorofCustomsissatisfiedthatanypetroleumimportedotherwisethaninbulk isnotintendedtobestoredinIndiabutisintendedtobedespatchedimmediatelyafterlandingtoanyplaceoutsideIndia,hemaywaivetherequirementsofrules14and19andbywrittenorderpermitsubjecttosuchconditionsashemayspecifysuchpetroleumtobelandedforthepurposeofimmediatedespatchtothatplace.

    4. NothinginthisruleshallaffectthepoweroftheCollectorofCustomstodetainthepetroleumunderanyotherlaworruleforthetimebeinginforce.

    21. Landing Of Petroleum Class B or petroleum Class C in anticipation of the testing officer'sreport

    1. Notwithstandinganythingcontainedinrule20wheretheconsigneefurnishesaguarantee toreship the petroleum if the testing officer's report proves unfavourable the Collector ofCustoms may in anticipation of the testing officer's report permit any petroleum which hebelievestobepetroleumClassBorpetroleumClassCtobedischargedintoboatsor tobelanded.

    2. Thepermissiongrantedundersubrule(1)shallbesubjecttotheconditionthattheboatsintowhichthepetroleumisdischargedshallremainatsuchplaceastheConservatormayspecifyorthatthepetroleumshallbelandedatalandingplacedulyspecifiedforthepurposebyhimandstoredinaninstallationlicensedundertheserules.

    22.UnloadingofpetroleuminbulkSubject totheprovisionsofPart11ofChapter Ill,petroleumimported in bulk shall be discharged into storage tanks on shore either directly or bymeans ofbargesorlightersspeciallyconstructedforcarryingpetroleuminbulkandonlyatsuchplacesastheConservatormaybygeneralorspecialorderdirect.

    23.Unloadingofpetroleumotherwisethaninbulk

    1. SubjecttotheprovisionsofPart11ofChapterIll,petroleumimportedotherwisethaninbulkshallbelandedeitheratjettiesprovidedforthepurpose,orinbargesorlightersandonlyatsuchplacesastheConservatorshalldirect.

    2. Nopetroleumcontained incontainersshallbe landedunlesssuchcontainersare free fromleakageandareofsuchstrengthorconstructionasnot tobe liable tobebrokenor to leakexceptincasesofgrossnegligenceorectraordinaryaccident:Providedthatpetroleumcontainedincontainerswhichdonotsatisfytherequirementsofthissubrule,may,imposesubjecttoprovisionsofPartIIofChapterIIIandtosuchconditionsastheConservatormayimpose,belandedatseparatelandingplaceapprovedforthepurpose.

    24. Transhipment of Petroleum Petroleum may be transhipped from one ship to another forconveyance to any other port, whether within or beyond the territory of India subject to theprovisionsofPartIIofChapter111.

    IMPORTATIONBYLAND

    25.Petroleumtobe importedby landonlyatauthorizedplacesNopetroleumshallbe importedintoIndiabylandexceptatplacesspeciallyauthorizedforthepurposebytheCentralGovernment.

    26. Declaration and certificate to be furnished and licence to be produced before importingpetroleumbylandEverypersondesiringtoimportpetroleumbylandshallfurnishtotheCollectorofCustoms

    a. adeclarationinForm1signedbyhimorhisagentb. acertificateofstorageaccomodationinForm11signedbyhimorhisagentandc. the licenceor anauthenticated copy of the licence held for the importation and storage of

    suchpetroleum:ProvidedthatnothinginthisruleshallapplytotheimportationofpetroleumexemptedunderSecs.7,8and9oftheAct:Provided further that the furnishingofa licenceunderCl. (c)shallnotbenecessary for theimportationofpetroleumClassC,inbulk,inquantityexemptedunderSec.7oftheAct.

    27.PermissionoftheCollectorofCustomstounloadpetroleum

    1. NopetroleumshallbeunloadedexceptwiththepermissionoftheCollectorofCustoms.2. IftheCollectorofCustoms,afterreceiving

    (a)thetestingofficer'sreportonthepetroleum(b)thecertificateinFormII,ifrequiredbyrule26,and(c)thelicence,ifrequiredbyrule26and after making such further inquiries, as he deems necessary, is satisfied that thepetroleumcanbelawfully importedandthat there issuitableaccommodationfor it,heshallpermitittobeunloaded.

    3. If the Collector of Customs is satisfied that any petroleum imported is not intended to bestored in India but is intended to be despatched immediately after unloading to any placeoutsideIndia,hemaywaivetherequirementsofrules14and26andbywrittenorderpermit,subjecttosuchconditionsashemayspecify,suchpetroleumtobeunloadedforthepurposeofimmediatedespatchtothatplace.

    4. Nothing in this rule shall effect the power of theCollector of Customs to detain petroleumunderanyotherlaworruleforthetimebeinginforce./li>

    TRANSPORTOFPETROLEUM

    PartI:GENERAL

    28.Restrictionon leaky receptaclesNo leaky tankor container contain ingpetroleumshall betenderedfortransport.

    29. Loading of containers Barrels, drums and other containers filled with petroleum shall beloadedwithandhungupwards.

    30.Restrictiononpassengers,combustibleandinflammablecargoSaveasprovidedinrules38,39 and 52 and Cl. (b) rules of 60, no ship, vessel or vehicle shall carry petroleum in bulk orpetroleumClassA otherwise than in bulk if it is carrying passengers or any combustible cargoother than petroleum : Provided that nothing in this rule shall prohibit the use of dunnage forpackingpurposeinthecaseofcoastwisetransportofpetroleumClassAotherwisethaninbulk.

    31. Prohibition of smoking, fires, lights No person while engaged in loading or unloading ortransporting shall smoke or carry matches, lighters or other appliances capable of producingignitionorexplosion.32.Restrictiononloadingandunloadingbynight

    1. Petroleumshallnotbeloadedinto,orunloadedfrom,anyship,vesselorvehiclebetweenthehoursofsunsetandsunrise,unless(a)adequateelectriclightingisprovidedattheplaceofloading,unloadingandtheprovisionsofChapterIVarecompliedwithand(b)adequate firefighting facilitieswithpersonnel are kept readyat theplaceof loading forimmediateuseintheeventofafire

    2. Nothinginthisruleshallapplytotherefuellingofanaircraftbythevesselorvehicleslicensedundertheserules inaccordancewiththeprovisionsoftheIndianAircraftRules,1937,ortotherefuellingofanaircraftbyDefenceForcesoftheUnion.

    ExplanationForthepurposesofthisrule,theChiefControllershalldeterminetheadequacyorotherwiseoftheelectriclightingthefirefightingfacilities.

    PartII:TRANSPORTBYWATER

    33.Conditionofcarriageofpetroleuminbulkbywater

    1. Petroleuminbulkshallnotbecarriedbywaterexcept inashiporothervessel licencedforthecarriageofpetroleum inbulkbyanofficerappointedby thecentralGovernment in thisbehalf(hereinafter in tbisPart referred toas the licensingauthority) and in suchmannerasmaybeapprovedbygeneralorspecialorderbythelicensingauthorityafterconsultationwiththeChiefController:Providedthat(a)nothinginthisruleshallapplytoshipsimportingpetroleum(b)petroleumintankvehiclesmay,withthepermission,inwriting,oftheChiefControllerandsubjecttosuchconditionsashemayspecify,betransportedacrossariverbyaferry.

    2. Thelicencereferredtoinsubrule(1)shallbegrantedinFormIII,andshallremaininforceforaperiodofoneyearfromthedateofitsissue.

    34.RequirementsastotheconstructionofvesselsEveryshiporothervesselcarryingpetroleuminbulk,otherthanaferrypermittedtotransporttankvehiclesunderCl.(b)oftheprovisiontosubrule(1)ofrule33,shallbemadeofironorsteelwellandsubstantiallyconstructedwithscantlingsofampledimensionsinproportiontothesizeofthevessel:Providedthatthelicensingauthoritymay, inspecialcircumstances,allowuseofsuchshipsorvesselsconstructedofmaterialsotherthan iron or steel under such conditions, as it may, in consultation, with the Chief Controller,specify.

    35. Tank Fittings on ships or vessels The following provisions shall apply for the transport ofpetroleum,otherthanpetroleum,ClassCinshipsorothervessels,namely:

    a. Alltanksshallbefittedwithindependentapprovedfillingandsectionpipesandvalves,orwithstandwithbankflangesallpipesbeingcarrieddownnearlytothebottomofthetanks,andnopetroleuminbulkshallbetakenonboardordischargedexcept through,suchpipesandvalves,unlessotherwisepermittedbytheChiefControllerinwriting

    b. all tanks shall be fitted withmanholes having screwdown cover with petroleumtight joinsand, in thecaseof tanks intendedforusewithpetroleum,ClassA,withventilatorsor reliefvalveofapprovedpatternprotectedwithgaugeofameshnot lessthan11meshestothelinearcentimetreand

    c. ventilatorssimilarlyprotectedshallbefittedtoallspacesaroundtank.36. Selfpropelled barges The following conditions shall be observed in selfpropelled bargestransportingpetroleumotherthanpetroleumClassC,namely:

    a. (a) the whole of the machinery shall be at the stern of the barge and shall be entirelyseparated from the cargo by a cofferdam consisting of two transverse petroleumproofbulkheadsseparatedbyaspaceofatleast15centimetres

    b. (b)eachexhaustoutletfromthemachineryshallbefittedwithwithanapprovedtypeofsparkarrestor

    c. (c)nopetrodrivenengineshallbeusedeitherasmainengineor for thepurposeofdrivinganyauxiliarymachineryorpumps

    d. (d) a quickaction closing valve which can be operated from outside themachinery spaceshallbefittedtoeachfuelfeedpipeatitsjunctionwiththefuelservicetank

    e. (e)thebargeshallbeprovidedwithaheavywoodbeltingandf. (f)suitableventilatorsshallbefittedtothecargospace.37.Petroleuminbulkonbargesand

    flatsPetroleuminbulkshallnotbetransported inabargeor flatunlessthebargeor flat isselfpropelledorisintowof,orotherwiseattendedby,asteamerortugandcarries(a)atleastfourfireextinguisherssuitableforextinguishingoilfiresandacoveredstandbox,ondeck,containingatleast0.02cubicmetresofdrysand(b)asuitablehammerofnonsparkingmetaland(c)aredflag.

    38.Restrictiononcargoorpassengers

    1. No ship or other vessel shall carry petroleum in bulk if it is carrying passengers, or anyinflammablecargootherthanpetroleumorcoal.

    2. This rule shall not apply to petroleumClass C used as fuel and carried in cellular doublebottomsunderengineandboilercompartmentandunderordi~naryholdssuchfueloiltanksandinstallationsconnectionstherewithshallcomplywiththeprovisionoftheIndianMerchantShipping(ConstructionandSurveyofPassengerSteamers)Rules,1956.

    39. Petroleum carried as cargo in unberthed passenger ships PetroleumClass A shall not betransportedascargobyanunberthedpassengershipasdefined in theMerchantShippingAct,1958(44of1958):Providedthatcertifyingofficer referred to inSec.243of theMerchantShippingAct,1958(44of1958),mayincaseswherehe issatisfiedthatnoothermeansof transportingthepetroleumareavailable, permit petroleum Class A in quantity not exceeding 1,250 litres to be transportedotherwisethatinbulkbyanunberthedpassengershipsubjectto,

    a. the condition that no more persons shall be carried in the ship than can with safety beaccommodatedintheship'slifeboatsincaseofanaccidentand

    b. suchotherconditionsasthecertifyingofficermay,afterconsultationwiththeChiefController,impose:Provided further that C1. (a) of the first proviso shall not apply in the case of unberthedpassenger ships engaged on voyages in the course of whichthey do not go beyond 32kilometresfromland.

    40. Prohibition of transport of petroleum Class A by country craft No country craft shall carrypetroleumClassAititiscarryingpassengers.

    41.Restrictionsonsteamersortugsemployedintowingorattendingapetroleumvessel

    1. Nosteamerortugemployedintowingorotherwiseattendingabarge,flatorlightercarryingpetroleum, other than petroleumClassC in bulk, shall at the same time tow or otherwiseattendanyothervesselcarryingoninflammablecargootherthanpetroleumorcoal.

    2. Nosuchsteamerortugshallcarryanyinflammablecargootherthanpetroleumorcoal.3. Allsuchsteamersortugsshallbefittedwithefficientsparkarresters.42.Ventilationandcleaningofholdsandtanks

    1. Beforeanypetroleumisdischargedfromashiporvessel,theholdsofsuchvesselsshallbethoroughlyventilated:ProvidedthatnothinginthissubruleshallapplytoanyvesselcarryingpetroleumClassAnotexceeding30litresorpetroleumClassBnotexceeding2,500litresorpetroleumClassC.

    2. Afterallpetroleumhasbeendischargedfromanysuchvessel,theholds,tanksandbilgesofthevesselshallberenderedfreefrominflammablevapour.

    3. Subrule(2)shallnotapplytothetanksofashipimportingpetroleumwhichleavestheportwithout delay after unloading of cargo or remains only for the purpose of taking on boardbankers,storesorballastorforsuchotherpurposesasmaybeapprovedbytheConservator,ifthetanksofeverysuchshiparesecurelyfasteneddownimmediatelyafterthedischargeofthecargo.

    4. Subrule (2) shall not apply to barges or lighters continuously engaged in the transport ofpetroleuminbulk,if(a)anintervalofnotmorethan72hoursislikelytoelapsebetweenanoperationofunloadingandthenextloadingoperationand(b)thetanksaresecurelyfasteneddownimmediatelyafterunloading.

    5. Subrule(2)shallnotapplytospeciallyconstructedsteeltankmotorvesselsapprovedbytheChiefControllerwhichareengagedinthetransportofpetroleuminbulkonsuchriversandonsuch ports thereof as may be approved by him in areas outside port limits, or by theConservator within port limits, if the tanks of such vessels are securely fastened downimmediatelyafterunloadingandthevesselsdepartnotlaterthan12hoursaftercompletionofunloadingfortheirnextplaceofloading.

    6. Allshipsorothervesselswhichbysubrule(3)orsubrule(4)orsubruleareexemptfromtheapplication of subrule 2 shall until their holds and tanks have been rendered free frominflammable vapour, comply with all the rules applicable to ships or other vessels whencarryingpetroleuminbulk.

    43.Masterofvesselsspecially responsible Themasterorotherofficerinchargeofanyvesselwhichhadcarriedpetroleumonboardwhetherasacargoorasfuel,oranyvessellicensedunderrule33shallberesponsibletoseethat

    a. alldueprecautionsaretakenforthepreventionofaccidentduetoignitionofpetroleumorpetroleumvapourb. so longasthere ispetroleumorpetroleumvapour ina tankallopeningsfromthetankto theatmosphereexcept

    thegasescapelinearekeptclosedandlockedorotherwisesecurelyfastenedandwhen it isnecessary to takedipsorsamples,thesullageplugsorsightingportsareclosedimmediatelyaftersuchdipsorsamplesaretaken:Provided that subject to the provisions of Cl. (c) the master or officerin charge may cause the necessaryopeningstobeopenedorunlockedforthepurposeoftakingonboardorunloadingpetroleumClassBorpetroleumClassCforcleaningthetanksorforothersufficientreasons

    c. nopersonenters a tankor anenclosed spacewhich had, or is suspected to have contained petroleum withoutwearing a breath ing apparatus of a type approved by the Chief Controller unless an officer appointed by theCentralGovernmentinthisbehalfhasexaminedthetankorspacewiththeaidofanapprovedpetroleumvapourtesting instrument and has been certified by him in writing that the said tank or space is free from petroleumvapour

    d. the vessel does not undergo repair by hot work to any of its tanks, part or fittings which are likely to containpetroleumvapourorpetroleumunlesseachsuchtank,partoffitting,asthecasemaybe,hasbeenexaminedbyan officer appointed under Cl.(c) with the aid of an approved petroleum vapcurtest instrument and has beencertifiedbyhiminwritingthatthetank,partorfittingisfreefrompetroleumvapourorpetroleum

    e. thevesselusedforthecarriageofpetroleuminbulk,oracargoisnot takenamongothershipsor toadrydockunless(i)thevesselisproceedingtoanoilberth,or(ii)acertificatefromanofficerappointedunderCl.(e)totheeffectthathehasexaminedallthetanks,cofferdams,pumproomsandsuchotherpartsasaredeemednecessarywiththeaidofanapprovedpetroleumvapourtestinginstrument and that such tanks, cofferdams, pump rooms and other parts are free from petroleum vapour anddeclarationfromtheMasterthattothebestofhisknowledgethereisnopetroleumvapour,present inotherpartsofthevesselnotcoveredbytheabovecertificateareproduced

    f. the officer granting certificate under C1.(c) or C1. (d) or C1. (e) may specify such conditions and make suchrecommendationsasarenecessarytomaintaingasfreeconditionoftranks,space

    g. the certificate referred to in Cls.(c),(d)and (e)shall be granted only on reciept of fee fixed by the CentralGovernmentfromtimetotime

    h. thevesseloranysteamerortugtowingorotherwiseattendingonsuchvesselexhibitsconspicuously(i)fromsunrisetosunsetaredflagnotlessthan90centimetressquarewithawhitecircularcentre15centimetresindiameterifpetroleumClassAiscarriedandaredflagnotlessthan90centimetressquareifpetroleumClassBiscarriedand(ii)fromsunsettosunrisesuchwarninglights.asmayberequiredbytheConservator]

    44.Loadingandunloadingofbulkpetroleum

    1. Theloadingandunloadingofpetroleuminbulkshallbebyarmouredhouseandmetalpipes.2. Allhouses,pipesandotherappliancesusedintheloadingorunloadingofpetroleumshallbe

    electricallycontinuousandfreefromleakage.45. Precautions on suspension of loading or unloading When the loading or unloading ofpetroleumhasbeencommenced,suchloadingorunloadingshallproceedwithduediligenceand,ifitisdiscontinued,thetanks,andholdsoftheshipsorothervesselsconcernedandallloadingorunloadingvalvesshallbeclosedimmediately.

    46. Prohibition of naked lights, fire and smoking on board a vesselNo fire, naked light, fuses,matchesorotherappliancesforproducingignitionorexplosionandsmokingshallbeallowedonboard any barge, flat or lighter carrying petroleum in bulk or on board any vessel used for thetransportofpetroleumClassAotherwise than inbulkor for the transhipmentofpetroleum toorfromanyvesselwithinthelimitsofanyport:Providedthatnothinginthisruleshallpreventtheuseonaselfpropelledbargeofthemachineryorpropulsion.

    47.Prohibitionofsmoking,fireandlightsduringloadingandunloadingAtalltimesduringloadingorunloadingofshiporothervesselanduntilsuchtimeasallpetroleumshallhavebeen loadedintoorunloadedfromtheholdsortanksandtheholdsortanksshallhavebeensecurelycloseddownand,inthecaseofunloadingrenderedfreefrominflammablevapour,thereshallbenofireorartificial lightorsmokingonboardsuchshiporothervesselorwithin30metresof theplacewherethepetroleumisbeingloadedorunloaded:Providedthatnothinginthisruleshallapply

    i. to the use of lamps, cookers or other similar apparatus, electric or otherwise sodesigned,constructedandmaintainedastobeincapableof ignitinginflammablevapour.orinthecaseofpetroleumClassCtheuseofgallyfires

    ii. totheunloadingorloadingofashipunderconditionsapprovedbytheConservatorbymeansofsteamfromherownboilersorpowergeneratedbyelectricmotorsor internalcombustionenginesplacedinapositionawayfromcargoholdsandpumproomsorbymeansofelectricmotorssodesigned,constructedandmaintainedas tobe incapableof igniting inflammablevapour andmaintained in accor dancewith the requirements specified by Lloyds or othershipsurveyorsapprovedbytheCentralGovernment.

    48.FireextinguishingappliancestobereadyforuseVesselsunloadingorloadingpetroleumshallhaveadequatefireextinguishingappliancessodisposedthattheycanbeputintoimmediateuseandifthepetroleumClassAshallhavetheirowningsfurled.

    49.Restrictiononthesimultaneousconveyanceofdifferentclassesofpetroleum

    1. PetroleumClassAshallnotbeconveyedtotheshorefrom,or loadedintothesamevesselsimultaneouslywithpetroleumClassBorpetroleumClassC.

    2. >TheChiefControllermay,bywrittenorderexemptspeciallyanyparticularoperationfromtheprovisionsofsubrule(1)ifseparateanddistinctpipelinesandpumpsareprovidedforloadingorunloadingofpetroleumClassAsimultaneouslywithpetroleumClassBorpetroleumClassC.

    50.TransportbyseaofpetroleumwhichhasnotbeentestedPetroleumwhichhasbeenimportedintoanyportspecified insubrules(1)and(2)ofrule16andwhichhasnotbeentestedatsuchportiiiaccordancewiththerulescontainedinChapterX,shallnotbetransportedtoanyportotherthanaportatwhichimportationispermittedundersubrule(1)ofrule16andinaccordancewiththeprovisionsofalltherulesinChapter11.

    COASTWISETRANSPORTOFPETROLEUMCLASSAOTHERWISETHANINBULK

    51.APPLICATION

    1. Therules in thisPartapplyonly to the transportcoastwiseofPetroleumClassAotherwisethaninbulk.

    2. UnlessotherwiseexpresslyprovidedinthisPart,nothingcontainedinPartIIofthisChaptershallapplytoanypetroleumtransportedinaccordancewiththisPart.

    52.ConditionsoftransportbyunberthedpassengershipsPetroleumClassAmaybetransportedotherwisethaninbulkbyanunberthedpassengershipasdefinedintheMerchantShippingAct,1958 (44 of 1958), in accordance with the provisions of rules 29, 30, 39 and 54 to 60 (bothinclusive).

    53.Maximum quantity allowed to be carried PetroleumClass Amay be transported otherwisethaninbulkbyacountrycraftorsteamormotorvesselsotherthanunberthedpassengershipsasdefinedintheMerchantShippingAct,1958(44of1958),subjecttotheprovisionsofrules29,30and54to60(bothinclusive),ifthequantityofpetroleumdoesnotexceed

    1. in the caseof a country craft, the licensed carrying capacity of the vessel after taking intoaccount theweightofbarrelsor tins inwhich thepetroleum iscarriedor (b) in thecaseofsteamormotorvessels,15tonnes.54.CarriagebelowdecksPetroleumClassAshallnotbecarriedbelowdeckindeckedvesselsunlessthereareefficientventilatorsinthehold.

    2. Halfoftheventilatorsreferredtoinsubrule(1)shallbecarrieddownnearlytothebottomoftheholdsand theotherhalf of suchventilators terminatedonly a short distancebelow thedeck the short ventilators shall be labelled "Outlet or to Leeward" and the long ventilatorsshall be labelled "Inter or toWindward," such ventilators shall have large cowl heads, theopeningsbeingcoveredwithdoublecopperornoncorrodingmetalgauzenot less than11

    meshesperlinearcentimetres.55.ProvisionbulkheadInallvesselsotherthancountrycraft,asolidgas~tightbulkheadwithoutopenings,and incountrycraftasolidbulkheadwithoutopenings,shallbebetweentheholdandtheafterdeckwherethecrewareaccommodatedandinvesselsfittedwithapoopthebulkheadshallbeplacedimmediatelyinfrontofthepoop.Indeckedvesselsthebulkheadshallreachuptothedeckinallothervesselsitshallreachtowithin15centimetresofthegunwale.

    56.Prohibitionoffire,lightsandsmoking

    1. No fire, naked light of anydescriptionandnosmokingshall beallowedonanypart of thevesseltransportingpetroleumClassAexceptabaftthesolidbulkhead.

    2. Thenavigationallightsonanysuchvesselshallbecarriedabaftthebulklxead.57.ProvisionsoffireextinguishersFireextinguisherssuitableforfightingoilfiresshallbeplacedatconvenientpointsonanyvessel transportingpetroleumClassA.Not less than twosuch fireextinguishersshallbeplacedontheafterdeck.

    58.ConstructionofsteamormotorvesselsSteamormotorvesselsnotspeciallyconstructedforthecarriageofpetroleumshallnotcarrypetroleumunlesstheyareconstructedofironorsteelorofanyothermaterialapprovedbytheChiefController.

    59.TransportinsteamormotorvesselsOnsteamormotorvesselsnotspeciallyconstructedforthecarriageofpetroleum

    1. anypetroleumshalleitherbecarriedinseparatecompartmentswhichshallbegastightandshallbeeffectivelysealed,or inahold inwhichthereareefficientventilatorsinaccordancewithsubrule(2)ofrule54orondeckinaccordancewithrule60

    2. petroleumClassAshallbepackedincontainerscomplyingwiththeprovisionsofrules4and5

    3. specialprecautionsshallbe takenagainstsmokingand theuse (if lightsor fireofanykindwhile the cargo is being loaded or un loaded or while the hatches are off, or any deckopenings are uncovered before any lights are used in a compartment which containspetroleum,precautionsshallalsobetakentoensurethatthespaceisclearofvapourandallemptycontainerswhichhavecontainedpetroleumClassAarekeptsecurelyclosed.

    60.TransportofdeckPetroleummaybecarriedindeckinsteamormotorvesselsnotspeciallybuiltforthecarriageofpetroleum,subjecttothefollowingconditions,namely:

    1. incargoshipspetroleumClassAshallnotoccupymore than50percent.of theopendeckarea and shall be so stowed as riot to interferewith the navigation of the ship ormake itunseaworthy

    2. in passenger ships a limited quantity of petroleum Class A may be carried provided thatproper precautions are taken regarding stowage and keeping the packages away frompassengers,promenadeordeckspace

    3. thepetroleumshallbeprotectedfromthedirectraysofthesunbytheuseofcanvasawningsorotherwiseand>

    4. conspicuousnoticesshallbepostedupdrawingattentiontothedangerarisingfromsmokingorstrikingmatchesnearthedeckcargo.

    61.ConditionsoftransportbycountrycraftNopetroleumClassAshallbetransportedinacountrycraftunlessthefollowingconditionsaresatisfiednamely:

    1. Thepetroleumshallbecarried(i) in200litrescapacitysteelbarrels, thescrewbungsofsuchbarrelsbeingwell fittingandsealedor(ii)in200litrescapacitysealedsteeldrumsnotmorethanthreetiersofwhichmaybecarriedonanysinglevesselor(iii) in10 litrescapacitysealedtins,notmorethansix tiersofwhichmaybecarriedonanysinglevesselor

    2. all barrles or tins shall be carefully examined and no leaky barrel or tin shall be taken onboardthecraft

    PartIV:TRANSPORTONLANDBYVEHICLES

    62.Application The provisions of this part shall apply to the transport of petroleumon land byvehiclesexcepttransportof

    a. petroleumClassA inquantitynotexceeding100 litresandpetro leumof anyother class,otherwisethaninbulk,subjecttotheprovisionsofrule67

    b. petroleumofanyclasstransportedbytheDefenceForcesoftheUnion.

    63.Tankvehicles

    1. Everytankvehicleusedforthetransportofpetroleuminbulkonlandshallbebuilt,testedandmaintainedinaccordancewiththerequirementslaiddownintheThirdScheduleandbeofatypeapprovedinwritingbytheChiefController:Provided that theChiefController, ifhe isof theopinion that theenforcementofanyof theprovisions of the Third Schedule will cause undue hardship, may waive any of therequirementsofthesaidSchedulesubjecttosuchconditionsashemaydeemfittoimpose.

    2. Whereapprovalissoughttoatankvehicleortoanyofitsspecialsafetyfittingsnotpreviouslyapproved,12copiesoradetaileddrawingthereoftoscaleandascrutinyfeeofrupeesfiftyshallbeforwardedtotheChiefController.

    3. IftheChiefController,afterreceiptof thedrawingundersubrule(2)andaftermakingsuchfurtherenquiresashedeemsnecessary,issatisfiedthatthetankvehicleorthespecialsafetyfittings,asthecasemaybe,meetwiththerequirementslaiddownintheThirdSchedule,heshallapprovethedrawingandreturntotheapplicantonecopythereofdulyendorsed.

    4. Nothinginthisruleshallapplytotankwagonsforthecarriageofpetroleumbyrail.

    64.Tankcapacity

    1. Inthispart,"thetankformingpartofatankvehicle"shallbedeemedtoincludeanynumberoftanksonthesamechassisandanylimitationhereinspecifiedthecapacityofatankshallbeconstruedsoastopermitofthetankcontainingthequantityspecifiedundervaryingdegreesoftemperature.

    2. Thenetcarryingcapacityofatankshallbe97percentofitsgrosscarryingcapacityinthecaseofpetroleumClassAandpetroleumClassBand98percentinthecaseofpetroleumClassC.

    3. Thenetcarryingcapacityofatanktruckoratanksemitrailershallnotexceed25kilolitresofpetroleumand thenetcarryingcapacityofanytanktrailershallnotexceed5kilolitresofpetroleumProvided that theChiefControllermay under such conditions as hemay specify allow carriage of petroleum inbulk,inatanktruckortanksemitrailerhavinganetcarryingcapacityexceeding25kilolitresofpetroleumorinatanktrailerhavinganetcarryingcapacityexceeding5kilolitresofpetroleum.

    65.RestrictiononotheruseTankvehiclemeant for thecarriageofpetroleum inbulkshallnotbeused foranyotherpurposeexceptwhensoauthorizedbytheChiefControllerinwriting.

    66.Trailers

    1. Atanktrailernotexclusivelyusedfor transportingpetroleumshallnotbeattached toanyvehicle for transportingpetroleum.

    2. Atanktrailertransportingpetroleumshallnotbeattachedtoanyvehicleotherthanavehicleusedexclusivelyfortransportingpetroleumandnotmorethanonetrailershallbesoattached.

    3. Atanktrailershallnotbeattachedtoatanksemitraileroratrailer.4. A tank trailer or tank semitrailer shall have reliable brakes and all wheels which shall be capable of efficient

    operationfromdriver'sseatofthevehicletowingthetrailer.5. Thewidthofthetanktraileroratanksemitrailershallbelessthantheoverallwidthofthetowingvehicle.6. Atanktrailershallbesoconnectedtothetowingvehicleastocausethetrailertofollowsubstantiallythepathof

    thetowingvehicleandtopreventthetanktrailerfromwhippingorswervingsidetosidedangerously.7. IfatanktrailercarryingpetroleumClassAisattachedtoavehiclecarryingpetroleumClassBorpetroleumClass

    C,thetowingvehicleshallcomplywithalltheprovisionsoftheserulesrelatingtoavehicleforthetransportationofpetroleumClassA.

    8. Atrailerotherthanatanktrailershallnotbeattachedtoanytanktruck.9. Wherea tank trailer isattached toa tank truck the totalquantityofpetroleum transported in the tank trailerand

    tanktruckshallnotexceed15kilolitres.10. Notanktrailershallbeattachedtoatanktruckhavinganetcarryingcapacityexceeding12kilolitresofpetroleum.11. No tank trailer attached to a tank truck shall be operated within a thickly populated area without the written

    permissionofthedistrictauthority.67.Vehiclefortransportotherwisethaninbulk

    1. Every vehicle on which petroleum otherwise than in bulk is transported shall be strongly constructed and withsidesandbackofadequateheight,andshallbemaintainedingoodcondition.

    2. In the case of animaldrawn vehicles, push carts and pedal carts, the requirements of subrule(1) regarding thesidesandbackofthevehiclesshallnotapplyiftheloadissecurelyfastenedtothevehicle.

    3. Allcontainersshallbesopackedasnottoprojectbeyondthesidesorbackofthevehicle.4. PetroleumClassAotherwisethaninbulkshallnotbetransportedinatrail,attachedtoanyvehicle.68.CompositevehiclesPetroleumincansor inothercontainersshallnotbetransportedbyroadonanytankvehicleused for the transport of petroleumunless the vehicle is so constructedas to complywith the rulesapplicable to thetransportofpetroleumotherwisethaninbulkaswellaswiththerulesapplicabletothetransportpetroleuminbulk.

    69. Carriage of other articles prohibitedNo vehicle shall carry any other articlewhile it is carrying petroleum exceptwhenspecificallyauthorizedinwritingbytheChiefController.

    70.Enginesofmechanicallypropelledvehicles

    1. IneverymechanicallypropelledvehicleusedforthetransportbyroadofpetroleumotherthanpetroleumClassBotherwisethaninbulkorpetroleumClassC(i)theengineshallbedieselengineoraninternalcombustionengine(ii)theexhaustshallbewhollyinfrontofthetankortheload,asthecasemaybe,andshallhaveampleclearancefromfuelsystemandcombustiblematerialsandshallnotbeexposedtoleakageorspillageofthefuelorproductoraccumulationofgreaseoroil(iii)theexhaustpipeshallbefittedwithanapprovedsparkarrester(iv)themufflerorsilencershallnotbecutofffromtheexhaustsystem(v) the engine air intake shall be fittedwith an effective flamearrester, or anair cleaner havingeffective flamearrester,characteristics,substantially installedandcapableofpreventingemissionof flame from thesideof theengineintheeventofbackfiring(vi)thecabofthevehicleshallbeofallmetalconstructionanditsrearwindow,ifprovided,shallbefullycoveredwithwiredglassalternatively, thecaband theengineshallbeseparated from the tankor the load,as thecase

    maybe,byafireresistingshieldwhichfullycoverthetankorload.2. Thefueltanksofeverysuchvehicle,ifinstalledbehindthecabofvehicle,shallbe

    (a)sodesigned,constructedandinstalledastopresentnounusualhazard,andshallbesoarrangedastopermitdrainagewithoutremovalfromtheirmountingsand(b)protectedagainstblowsbystoutsteelguardsandprovidedwithalockinthefillingcaps.

    3. IneveryenginerunningonpetroleumClassA,aquickactioncutoffvalveshallbefittedtothefuelfeedpipeinaneasilyaccessiblepositionwhichshallbeclearlymarked.

    4. Notwithstandinganythingcontainedinthisrule,provisionsofsubrules(1)to(3)exceptCls.(i)and(iii)ofsubrule(1),shallnotapplyfortransportationofPetroleumClassAotherwisethaninbulkexclusivelyusedbyhelicoptersandaeroplanesforaerialcropsprayingpurposesonly.

    71.ElectricalinstallationIfelectriclightorinstrumentoranyotherelectricallyoperatedequipmentisemployedonanyvehicleincludingatrailerusedinthetransportationbyroadofpetroleumotherthanpetroleumClassC

    i. thepressureoftheelectriccircuitshallnotexceed24voltsii. electricalwiringshall

    (a)beheavilyinsulatedandbeadequateformaximumloadstobecarried(b)beprovidedwithsuitableovercurrentprotectionintheformoffusesorautomaticcircuitbreakersandinstalledsoastobeprotectedfromphysicaldamageandcontractwithpossibleproductspilleitherbylocationorbybeingencasedinmetalconduitorotheroilresistantprotectivecoveringand(c)havealljunctionboxessealed

    iii. thegenerator,battery,switches,fusesandcircuitbreakershallbecarriedinthecabofthevehicleorintheenginecompartmentandthebatteryshallbeinaneasilyaccessiblepositionwithaheavydutyswitchclosebytocutoffthebattery

    iv. generatorsandmotorsandswitchesthereofwhicharenotinstalledwithintheenginecompartmentshallbeof theapprovedflameprooftype.Provided thatwheresuchgeneratorsormotorsorswitches thereofare installed inanenclosedspace,adequateprovision shall be made for air circula tion to prevent overheating and possible accumulation of inflammablevapours:Provided further that the provisions of this rule except Cl.(i) and sub clause (a) of Cl.(ii) shall not apply fortransportation of petroleum Class A otherwise than in bulk exclusively used by helicopters and aeroplanes foraerialcropsprayingpurposesonly.

    72.Meansofextinguishing fire tobecarriedAportable fireextinguishersuitable forextinguishingpetroleumfireshallbecarriedinaneasilyaccessiblepositionandawayfromthedischargefaucetsoneveryvehicletransportingpetroleumbyroad.

    73.Vehiclestobeconstantlyattended

    1. Everyvehiclewhichisengagedin4thetransportofpetroleumbyroadshallbeconstantlyattendedtobyat leastonepersonwhoshallbefamiliarwiththerulesinthisPart.Providedthatsuchavehicle,ifitstanksorcompartmentsareemptybutnotfreefrompetroleumvapour,maybe,leftunattendedinplacespreviouslyapprovedforthepurposeinwrittingbytheChiefController.

    2. Everyvehicle inwhichmore that 5 kilolitresof petroleum,other thanpetroleumClassC is being transportedbyroad, or which, while transporting petroleum, other than petroleum Class C, by road is being trailed by anothervehicle,shall,solongasit is inmotion,beattendedtobythedriverandat leastonemorepersonbothofwhomshallbefamiliarwiththerulesinthisPart.

    74.ProhibitionastoparkingNovehiclecarryingpetroleumbyroadshallbeparkedonapublicroadorinanycongestedareaorataplacewithin9metresoranysourceoffire.

    75.LicencenecessaryforthetransportinbulkofpetroleumClassesAandB

    1. No person shall transport petroleum Class A or petroleum Class B, in bulk, by road except under and inaccordancewiththeconditionofalicencegrantedundertheserules.

    2. Nothinginthisruleshallapplytothetransportbyrailwayadministrationofpetroleumwhichisinitspossessioninitscapacityasacarrierortothetransportofpetroleumilltherefueller,licensedundertheserulesbetweenplaceswithinthesameaerodrome.

    76.Restrictionagainstloadingandunloadingoftankvehicles

    1. Nopersonshallloadorunloadatankvehiclewithallyclassofpetroleumexceptataplacewhichissituatedwithinpremiseslicensedundertheserulesandisapprovedinwriting,forloadingorunloadingofsuchclassofpetroleum,bytheChiefController:Provided that petroleumClassCmay be loaded or unloaded at a placewhere such petroleum is allowed to bestoredwithoutlicenceunderSecs.7and10oftheAct:Providedfurtherthat(a)atankwagonmaybeloadedorunloadedatrailwaysidingscarmarkedforthepurposeand(b) a tank vehiclemaybeunloadedat anyother placewith all due precautions against fire and under adequatesupervisionifsuchunloadingisnecessitatedbyanaccidentorbreakdown.

    2. Every tank vehicle,while it is being loadedor unloadedanduntil its valveshavebeen shut and filling pipe anddischargefaucetsclosed,shallbeattendedtobyapersonwhoisfamiliarwiththerulesinthispart.

    3. No person shall under any circumstances allow filling or replenishment of the fuel tank of anymotor vehicle orinternalcombustionenginedirectlyfromatankvehiclsProvided that nothing in this subrule shall restrict filling or replenishment of the fuel tank of an aircraft inaccordancewiththeruleframedunderAircraftAct,1934(22of1934)

    77.ProhibitionofloadingofleakyordefectivetankvehiclesorunlicensedtankvehiclesNopersonshallload

    i. anyclassofpetroleumintankvehicleifanytank,compartment,valve,pipesoranysafetyfittingthereofbecomesleakyordefectiveanduntilsuchleaksarerepairedandthedefectsrectifiedand,inthecaseofanyleakinatankoracompartmentuntilall the tanksorcompartmentare retested in themanner laiddown inpara.5of theThird

    theserules.78.Precautionsagainststaticcharges

    1. Allpetroleumpipelinesenteringanytankvehicleloadingorunloadingareashallbeelectricallycontinuousandbeefficientlyearthed.

    2. Anearthbosswithaflexiblecablehavingrobustclaspingdeviceshallbeprovidedadjacenttotheloadingpoint.3. Sound and electrically continuous hoses or metal pipes shall only be used for loading or unloading of a tank

    vehicle.Wherestandpipesormetallicloadingarmsareprovided,swiveljointsshallbeelectricallycontinuous.4. The tank, filling pipe and the chassis of the tank vehicle shall, during loading of a tank vehicle, be efficiently

    bondedandconnectedwiththeearthbossreferredtoinsubrule(2)bymeansofaflexiblemetalwireoftape.5. Thebondingandearthingconnectionsshallnotbebrokenuntilloadingofthetankvehiclehasbeencompletedand

    thefillinganddippipesthereofhavebeensecurelyclosed.6. Diprod,ifused,shallbeloweredintothetankorcompartmentbeforeloadingofpetroleumstartssucharodshall

    notbecompletelyraisedabovetheliquidlevelduringorwithinoneminuteofthecompletionofsuchloading.7. Notankvehicleshallbeloadedatarateexceedingonmetrepersecondatthedeliveryendofthefillingpipeuntil

    the fillingpipe is completely submerged inpetroleumand thereafter the loading ratemaybegradually increasedbutitshallatnotimeexceedsixmetrespersecondatthedeliveryandofthefillingpipe:Provided that theChiefControllermayspecifya faster loading rate in respectof crudepetroleumandpetroleumproductswhichhavearelativehigherconductivityrate.

    8. NotankofcompartmentofanytankvehiclewhichhaslastcarriedpetroleumClassAshallbefilledwithpetroleumofanyotherclassiftheinteriortherofhasfloatingnonconductinglooseobjectorwater.

    79. Precautions against electrical hazards and hazard of a running engineNomechanically propelled vehicle for thepetroleumshallbe loadedorunloadeduntil itsenginehasbeenstoppedandbattery isolated fromtheelectricalcircuit.Theengineshallnotbe restartedand thebatteryshallnotbeconnected to theelectricalcircuituntil tanksandvalveshavebeensecurelyclosed:ProvidedthatthisruleshallnotapplyinthecaseofunloadingofatankvehicleintothefueltankofanaircraftinaccordancewiththerulesframedundertheAircraftAct,1934(22of1934)orinanyothercaseasmaybeauthorized,inwriting,bytheChiefControllersubjecttosuchconditionsasliemayspecifyinthatbehalf.

    80. Precautions against movement of vehicle during loading or unload ing Petroleum shall not be loaded into orunloadedfromavehicleuntilitswheelshavebeensecuredbyefficientbrakesorbyscotchingandinthecaseofanimaldrawnvehiclesuntiltheanimalshavebeenunhitchedandremoved.

    81.Precautionagainstproductcontamination

    1. No person shall load or unload any tank vehicle unless he has selected the correct filling hose and otherwisesatisfied himself that such loading or unloading will not result in any dangerous contamination of one class ofpetroleumwithanotherclassofpetroleum.

    2. AtankorcompartmentwhichcarriedpetroleumClassAshallnotbefilledwithanyotherclassofpetroleumuntilsuch tank or compartment has been completely drained of residual oil and its discharge faucet and emergencycontrolvalvehavebeenclosedfirmly.

    82.Fillingdischargefaucetanddippipestobekeptclosedexceptduringtheoperationof loadingoremptyinga tankvehicle, the filling pipe, discharge faucet and dip pipe shall be kept securely closed.Where the filling pipes are notprovidedwithaliquidseal,thecoversshallbelockedorsealedexceptduringtheoperationofloadingatankvehicleandthekeysshallnotbecarriedonthevehicleorthetrailer.

    83.Restrictionson loadingandunloadingofpetroleumatnightExceptwhereapprovedelectric lightsasspecified inChapterIVareexclusivelyusedtheloadingorunloadingoftankvehiclescarryingpetroleumshallbeperformedbetweenthehoursofsunriseandsunset.

    84.Prohibitionsoffiresandsmoking

    1. Nofireorotherartificial lightcapableof igniting inflammablevapourshallbeallowedonanyvehiclecontained inpetroleumClassAotherwisethaninbulkorpetroleumofanyclassinbulk.

    2. Nopersonshallsmokewhileonorattendingsuchavehicle.3. Noarticleorsubstancecapableofcausingfireorexplosionshallbecarriedonsuchavehicle.85.Repairoftank

    1. No tank which has carried petroleum shall be repaired bywelding,brazing,soldering or hotriveting unless it hasbeen examined by a competant responsible person and certified in writing by such person to be free frominflammablevapoursoroil.

    2. The certificate issued by the competent and responsible person under subrule(1) shall be preserved by therepairerforaperiodofatleastthreemonthsandshallbeproducedforexaminationondemandbyaninspector.

    3. Allrepairstotankswhichhavecontainedpetroleumshallbecarriedoutbyqualifiedandexperiencedpersons.4. All thecompartmentsof thetankshallbetestedaftereachrepair inthemanner laiddown inpara.5of theThird

    Schedule.86.Specialprovisionsformotorconveyances

    1. Nomotorconveyancecarryingpassengersonhireshallcarrypetroleumotherthan(i)petroleuminthetankincorporatedintheconveyance,and(ii)petroleumnotexceeding100litresinquantityintendedtobeusedtogeneratemotivepowerfortheconveyanceofthatvehicleandkeptinthemannerprovidedinsubsection(2)ofSec.8oftheAct.

    2. Duringthefillingorreplenishmentofthefueltankofamotorconveyancelicensedforthecarriageofmorethansixpassengers on hire the driver or other person in charge of such conveyance shall not allow any passenger toremaintherein.

    3. Allpetroleumcontainerscarriedinamotorconveyancecarryingpassen~gersonhireshallbefreefromleaksandbesecurelyclosedandshallbeplacedinaspeciallypreparedreceptaclewhichisnotaccessibletopassengersin

    suchconveyanceandisnottheroof.

    PartV:TRANSPORTBYPIPELINES

    87.ApplicationTherulesinthisPartapplyonlytothetransportofpetroleumbymeansofpipelinesotherthanthoseinanyareainwhichoperationorthewinningofnaturalpetroleumornaturalgasorbotharecarriedonorwithinthelimitsofrefineriesandinstallations.

    88. Right ofway to be acquiredNo pipeline, and installation connectedwith a pipeline, shall be constructedwithoutacquiringthenecessarylandeasementsandrightsfortheconstructionthereofandfortheunhinderedaccesstheretoforinspection,maintenancerepairs,replacementsandpatrolling.

    89.Approvalofthedesignandrouteofthepipeline

    1. NopipelineshallbelaidwithoutthepriorwrittenapprovaloftheChiefControlleroftherouteofthepipeline,andofthedesign,constructionandworkingthereof.

    2. Wheretheapprovalof theChiefController issoughtfor the layingofapipeline, thepersondesirousof layingthepipelineshallsubmittobeChiefController(i) a comprehensive project report, accompanied by all necessary drawings, calculation giving references torecognizedcodeorcodesfollowed,givingfulldetailsofthedesign,constructionandtestingofthepipelineanditscomponents the route along which the pipeline will be laid and the manner of laying the class or classes ofpetroleumproposedtobetransportedinthepipelineandprovisionsproposedtobemadeforthemaintenanceandpatrollingofthepipeline(ii)ascrutinyfeeofrupeestwohundred

    90.Designofpipelineandattachments

    1. Thepipelineshallbeconstructedofsuitablesteelwhichissafefortheconditionsunderwhichitistobeused.2. Thepipelineanditscomponentsshallbedesignedandconstructedinaccordancewithacoderecognizedbythe

    ChiefControllerandshallbecapableofsafelywithstandingapressurewhichshallnotbelessthanthemaximumworkingpressurethereofplusanallowanceforsurgepressure,anticipated.

    3. Provisionshallbemade for thermalexpansionorcontractionof thepipelineand for thepreventionof excessivestressesonthepipelineoritsanchorages,guidesandconnections.

    4. Thepipelineshallbeprotectedbyacasingofsteelpipeorby increasingthethicknessof itswallor inanyothermanner approved by the Chief Controller and any other authority having jurisdiction to prevent damage to thepipeline from usual external conditionswhichmay be encountered in railway crossings, road crossings, river orwater course crossings, bridges, long selfsupported spans, unstable ground, vibrations, weight of specialattachmentsorthermalforces.

    5. Bypass relief valves, pressure limiting stations or automatic shutdown equipment of approved design shall beprovidedinthepipelinetopreventrisingatanytinieofthepressureinthepipelinetoapressurewhichexceedsthedesignedinternalpressurebymorethantenpercent.

    6. Gatevalvesbeinstalledateachofthefollowinglocations:(a)Onthesectionendandthedischargeendof thepumpstation inamanner thatpermits isolationof thepumpstationequipmentintheeventofanemergency.(b)Oneachlineenteringorleavingtheinstallationinamannerthatpermitsisolationoftheinstallationfromotherfacilities.(c)Oneachmain lineat locationsalong thepipeline system thatwillminimisedamage fromaccidental productdischarge,asappropriatefortheterraininopencountryorforthelocationnearcitiesorotherpopulatedareas.(d)Oneach lateral takeoff froma trunk line inamanner thatpermitsshuttingoff the lateralwithout interruptingflowinthetrunkline.(e)Oneachsideofawatercrossingthatismorethan30m.widefromhighwatermarktohighwatermark.(f)Oneachsideofareservoirholdingwaterforhumanconsumption.]

    91.Layingofpipeline

    1. Pipelinesshallbelaidinthemostfavourableroute,avoiding,asfaraspossible,knownobstructionsandareasinwhichunusualexternalconditionsprevail.

    2. Pipelinesshallbe laidbelowthegroundlevelexceptwherelayingthereofabovetheground level isdesirable for.topographical,economicorotherspecialreasons.

    3. Where an underground pipeline has to cross any existing underground water or gas line, cable, drain or otherservices, the pipelines shall be laid at least thirty centimeters below such services in a manner that will notobstructaccesstosuchservicesforinspection,repairsormaintenance.

    4. Thenumberof bends in thepipeline shall be kept to theminimumby proper grading of trenches of supports atcrossingandotherobstacles.

    5. Therouteofundergroundsectionsofapipelineshallbeindicatedbymarkersandnotlessthantwosuchmarkersshallhevisiblefromanypointalongtheroute.

    92.Protectionagainst corrosionThepipeline shall beprotectedagainst corrosionby suitable coating strapping, and,wherenecessary,bycathodicprotection.

    93.Hydrostatictestingofpipeline

    1. Before transporting petroleum for the first time, each pipeline or completed sections thereof shall be filled withwaterandthepressureinthelineorsection,asthecasemaybe,raisedto1.1timesthedesigninternalpressureandmaintained foraperiodof at least 24hours.Apipelineor a section thereof showing any significant drop ofpressureduringtheperiodoftestingshallnotbeusedfortransportingpetroleumuntilnecessaryrepairshavebeencarriedoutandasatisfactoryretestdone.

    2. The test specified in subrule (1) shall be carried out at least onceever 12months on each completed pipelinesectionwhichcrossesanareawherethereisdangerofwaterpollationbyanyleakage:ProvidedthattheChiefControllermaysubjecttosuchconditionsasmaybespecifiedbyhiminthisbehalfallowretestingofsuchsectionsofpipelinesasareprotectedbysleevesorotherwise

    (i)tocontainortopreventleakageatlongerintervals,and(ii)byfillingthemwithpetroleuminplaceofwaterforpurposesofthetest.

    94. Shut down of pipelinesExceptwhen shut down formaintenancework, a pipelinewhen not in operation shall beshutdownunderpressureandacarefulrecordmadeofthepressureduringtheshutdownperiod.Anysignificantdropinpressureshallbedeemedtorenderthepipelineunfitfortransportofpetroleumuntil it isrepairedanditpassesthetestspecifiedinrule93.

    95.Patrollingofpipeline

    1. Thewholeofeverypipelineshallbeefficientlypatrolled.2. Telegraphortelephoneorradiocommunicationfacilitiesshallbeprovidedatfrequentintervalsalongthepipeline:

    Provided thatonesuchcommunicationchannel shall suffice fora series forparallel pipelines laid close toeachother:Provided further that nothing in this subrule shall apply to a pipeline if the length thereof does not exceed twokilometres.

    96.CheckingofgaugesTankgaugesorgaugesatintermediateorboosterpumpstationsshallbecheckedatleastonceayear.

    97.Additionsandalterationsinthepipeline

    1. Noadditionoralterationtoapipelineshallbecarriedoutwithoutthepreviousapprovalof theChiefController inwriting.

    2. Everypersondesirousofcarryingoutanyadditionoralterationinanypipelineshallsubmit totheChiefControlleranapplicationalongwith(a)additionsandalterationsandthepurposethereofand(b)ascrutinyfeeofrupeesfifty.

    3. On receipt of the drawings and fee under subrule (2) and after eliciting such additional information as may berequiredtheChiefControllershall, ifheissatisfied,approvetheproposedadditionsoralterationssubject tosuchconditionsashemaydeemfit.

    98.RepairandmaintenanceofpipelineNomaintenanceorrepairinvolvingcuttingorreweldingofanypipelineshallbecarriedoutexceptunderfollowingconditions,namely:

    i. anexperiencedengineershall inspect thesection requiringmaintenanceor repairbefore thework isundertakenandissueawrittenpermitspecifyingtherein theprecautionstobeobservedandtheprocedure tobe followed forcarrying out thework. The permit so issued shall be preserved by the owner of the pipeline for a period of sixmonths

    ii. allwork involvingcuttingorweldingshallbecarriedoutbyanexperiencedperson inaccordancewith thepernfitreferredtoinCl.(i)

    iii. thesectionofthepipelineshallbeisolatedanddrainedbeforestartingrepairsormaintenance.iv. onlymechanicalcuttersshallbeusedforcuttingthepipelinesoranyconnectionshavebeenpurgedwithaninert

    gasv. nohotworkshallbecarriedoutonanypipelineuntilthesectionthereofrequiringrepairhasbeenisolated,drained

    andpurgedwith inertgasorsteamorkept filledwithwateroruntilsuchsectionhasbeenprepared inamannerapprovedinwritingbytheChiefController

    vi. the section of the pipeline in which repairs or maintenance work has been carried out shall not be used fortransportingpetroleumuntilretestedinthemannerlaiddowninrule93

    vii. no sectionof anypipelineandno valve fitted to it shall be separateduntil an efficient electrical bond has beenestablishedbetween theparts tobesoseparatedwhichshallnotbebrokenuntil theseparatedpartshavebeenrejoined.

    99.RelayingorrepairstoapipelineinpublicinterestWheretheChiefControllerisoftheopinionthatitisintheinterestofpublicsafetysotodo,hemay,byanoticein.writinggiventotheownerofthepipeline,requiresuchowner,torelay,reneworrepairsuchpipelineinaccordancewithsuchrequirementsasmaybespecifiedinsuchnotice.

    100.Powerof inspectionandexaminationTheChiefControllerorCon trollerofExplosivesmayatany time inspectandexamineanypipeline,and theowner thereoforpersonsoperatingorusing thepipelineand thepersonsonwhoselandsuchpipeline issituatedorhisrepresentativeshall facilitatesuchinspectionandexamineandanswerall inquiriesputbytheChiefControllerorControllerofExplosivesinregardtosuchpipeline.

    101.ReportsoffireormajorleakageTheoccurrenceofanyfireormajorleakageinapipelineandconnectedfacilitiesthereofshallbereportedimmediatelybythepersonforthetimebeinginchargeofthepipelinetothenearestMagistrateor officerincharge of the nearest police station and by telegram to the Chief Controller at his telegraphic address,namely,"EXPLOSIVES,NAGPUR".

    ELECTRICINSTALLATION

    102. Restriction on electric installation and apparatus Save as provided in this chapter, no electric wiring shall beinstalledandnoelectricapparatusshallbeusedinanyrefinery,installation,storageshed,servicestationorinanyotherplacewherepetroleumisrefined,blended,stored,loadedorunloaded.

    103.HazardousareaForthepurposeofthischapter,anareashallbedeemedtobeahazardousarea,where

    i. petroleumhavingflashpointbelow650Coranyinflammablegasorvapourinaconcentrationcapableofignitionislikelytobepresent

    ii. petroleum or any inflammable liquid having flash point above 650C is likely to be refined, blended, handled orstoredatoraboveitsflashpoint.

    104.Classificationofhazardousarea

    1. Ahazardousareashallbedeemedtobe(i)adivision"O"area,ifinflammablegasesorvapoursareexpectedtobecontinuouslypresentintheareaor

    (ii)adivision"1"area,ifinflammablegasesorvapoursarelikelytobepresentintheareaundernormaloperatingconditionsor(iii)adivision "2"area, if inflammablegasesorvapoursare likely tobepresent in theareaonlyunder abnormaloperatingconditionsorfailureorruptureofanequipment.

    2. Ifanyquestionarisesas towhetherhazardousarea isadivision"O"areaoradivision "I"areaoradivision "2"area,thedecisionthereonoftheChiefControllershallbefinal.

    105.ExtentofhazardousareaTheextentofhazardousareashallbeaslaiddownintheFourthSchedule:Provided that the Chief Controller may increase or reduce the extent of hazardous area where there are specialcircumstanceswhichinhisopinion,warrantsuchincreaseorreduction,1[andthepersonsaffectedshallbeinformedofhisdecision].

    106.Fixedelectricapparatus

    1. Noelectricapparatusshallbeallowedinadivision"O"area:Provided that thesubrule shall notprohibit theuse inadivision "O"areaofan intrinsically safeapparatus of atypeapprovedinwritingbytheChiefControllerand inconnectionwithan intrinsicallysafecircuit,whereuseof suchapparatuscannotbecompletelyexcluded.

    2. Allelectricapparatusinstalledorusedinadivision"1"areashallbeeither(i)aflameprooforintrinsicallysafeapparatusofatypeortypesapprovedinwritingbytheChiefControlleror(ii)an industrialtypeapparatushoused inanenclosureor a roomwhichhasbeenmadesafebypressurizingorpurgingwithplenumoratmospherefreefromsignificantconcentrationofany inflammablegasorvapourandsoarranged and interlocked dust in case of failure of the pressurizing or purging agent, the electricity supply isautomatically cutoff or a warning is automatically given to a person in attendance who shall take suitablemeasurestopreventahazard.

    3. Allelectricapparatusinstalledorusedinadivision"2"areashallbeeither(i)anonsparkingapparatusofatypeapprovedbytheChiefControlleror(ii)anapparatusofanyofthetypespermittedundersubrule(2).

    107.Fixedelectricwiring

    1. All conductors of an intrinsically safe circuit in connection with an intrinsically safe apparatus installed in anyhazardous area shall be so laid as to prevent invasion of such circuit by current arising from contact orelectrostaticorelectromagnetic induction fromanyother circuit.Conductorsof intrinsically safe circuits shall heeffectivelyprotectedagainstmechanicaldamage.

    2. Allelectricwiringinahazardousarea,otherthantheconductorofanintrinsicallysafecircuit,shallbeeffectivelysealedatalljoints,mechanicallyprotectedandadequatelysupportedthroughoutitslengthandshallconsistof(i) approved armoured cable with correctly designed terminations complete with armour clamps, the armouringbeingcarriedandelectricalclampstoprovidemechanicalsupporttothecableandelectricalcontinuityor(ii)approvedmetalsheathedcablewithcorrectlydesignedandinstalledterminationsor(iii)singleormulticoredinsulatedcablesaccommodatedinsoliddrawnheavygaugescrewedgalvanizedconduitsusedinconjunctionwithapprovedflameprooffittings,theconduitbeingsealedatbothendsandinstalledinsuchamannerastopermitinternalcondensationtodraintoapointorpointsfromwhichitmayberemovedwhereaconduitrunsfromadivision"1"areatoadivision"2"areaoranareawhichisnotahazardousarea,anadequatesealshallbeprovidedoutsidetheboundaryordivision"I"area(iv) single ormulticoredmineral insulated cable of approved type in conjunction with approved flameproof typeglandsatalljointandterminations(v)bareconductorscontainedinanapprovedflameprooforformingpartofanintrinsicallysafecircuit.

    3. Insulatedcablewithoutmetallicsheathingorarmouringbutacconirnodatedinaconduitshallnotbeburiedintheopengroundinanyhazardousarea.

    4. Theelectricsupplycircuitsofeachelectricpumpinahazardousareashallbe(i)separatelyprotectedbya fuseorcircuitbreakerset tooperatewhen thecurrent in thecircuitsoexceeds theratedcurrentforsuchaperiodoftimeastoinvolvedangerand(ii)providedwithanindividualisolatingswitchatthemainsupplypointforeachelectricpumpincludingitsintegrallightingsystem,ifany.

    5. If theChiefController issatisfiedthat therequirementsofsubrules(1)and(2)maybemodifiedor relaxed inanyclass of electrical wiring, hemay authorise suchmodification or relaxation for such period and subject to suchconditionsashemaythinkfit.

    108.Earthingandbonding

    1. All electrical systemsand equipments andall structures, plants andother noncurrent carryingmetallic parts ofmajor electric apparatus or any major metallic object in any place where petroleum is refined, blended, stored,loadedorunloadedshallbeefficientlyearthedtheresistancevalueofandearthingsystemtothegeneralmassoftheearth1[shallnotbemorethan](a)4ohmsinthecaseofelectricalsystemsandequipmentoravalvethatensurestheoperationoftheprotectivedeviceintheelectricalcircuit,whicheverislowerand(b)10ohmsinthecaseofallnoncurrentcarryingmetallicpartsofmajorelectricapparatusoranymajormetallicobjects.

    2. Alljointsinpipelines,valves,plants,storagetanksandassociatedfacilitiesandequipmentforpetroleumshallbemadeelectricallycontinuousbybondingorotherwisetheresistancevalvebetweeneachjointshallnotexceed1ohm.

    3. Apipingwhichisnotinelectricalcontactwiththeassociatedtankorvesselshallbeefficientlyconnectedtosuchtankorvesselbyaflexibleconductorandearthed.

    109.Cathodicprotection

    1. Cathodic protection system where employed shall be designed and installed in accordance with the currentrecognizedpracticeandsomaintainedas(a)nottoaffectadverselymetallicbodiesinthezoneofprotectionand

    (b)toeliminatethedangerofsparkinginahazardousarea.2. Themetallicstructures,pipelines,valves,plantsandassociatedequipmentundercathodicprotectionshallnotbe

    brokenforrepairormaintenanceunlessaheavygaugeconductingcableisclampedtoeachsideof the intendedbreak for establishing between them an electrical bond and the cable shall remain clamped until repair ormaintenanceworkiscompletedandthebreakrejoined.

    110.Protectionagainststraycurrent

    1. Wherehighvaluesofstraycurrentsarelikelytoexist,boththerailsofspurlinesshallbeinsulatedfromarailwaysidingwhichisusedfortheloadingorunloadingoftankwagons.

    2. Onelectrifiedrailwaysystems, livecontractrailsandoverheadelectric linesshallbe terminatedoutside theareawheretankwagonsareloadedorunloadedsuchrailsoroverheadlinesshallnotbeallowedwithinarefineryoraninstallation.

    3. Nojointinapipelineorassociatedequipmentshallbebrokensaveasprovidedinsubrule(2)ofrule109.111.Portableelectricapparatus

    1. Noperson shall instal or use in a hazardous area any portable electric lamp or apparatus other than a portablelamp or apparatus of a type approved by the Chief Controller after such examination and test and for suchapplicationsashemayspecify.

    2. Nomainsoperatedportablelampshallbeoperatedatavoltageexceeding25voltsabovetheearth:Provided that the Chief Controller may, at his discretion, allow higher operating voltage not exceeding 55 voltsaboveearth.

    3. Allportablelampsorapparatusother thanaselfcontained lamporapparatusshallbeconnected to themains insuchmannerandusedundersucconditionsastheChiefControllermayspecify.

    112.MaintenanceofapprovedelectricapparatusandwiringAllelectricapparatusandwiringinahazardousareashallatalltimesbesomaintainedastoretainthecharacteristicsonwhichtheirapprovalhasbeengranted.

    113.Repairandtestwork

    1. No flameproof or intrinsically safe appara tus shall be opened and no work likely to impair the safetycharacteristicsofsuchapparatusorelectricwiringconnectedtheretoshallbecarriedoutuntilallvoltagehasbeencut off from the said apparatus or wiring. The voltage shall not be restored thereto until the work has beencompleted and the safety characteristic provided in connection with the apparatus and wiring have been fullyrestored.

    2. Notwithstandinganythingcontainedinthisrule,useofsolderingapparatusorothermeansinvolvingflame,fireorheat or use of industrial type apparatus in a division "1" area shall be permitted for the purposes of effectingrepairsandtestingandalterations,providedthattheareainwhichsuchapparatusorwiringhasbeeninstalled,hasfirstbeenmadesafeandcertifiedbyacompetentpersonafter testingwithanapprovedgastestingapparatus tobesafefrominflammablevapours,gasesorliquidsandismaintainedinsuchcondition,solongastheworkis inprogress.

    114.Certificateofelectricinstallation

    1. Beforeengineeringanyelectriccircuitandanyelectricapparatusinhazardousareaforthefirsttimeandaftereachrepairmaintenance or alterationwork carriedout in such circuit or apparatus, a competent person shall issue acertificateunderhissignaturetotheeffectthatthecircuitandtheapparatushavethesafetycharacteristicsuponwhichtheiruseinsuchareahasbeenapproved.

    2. Thecertificatereferredinsubrule(1)shallbepreservedbytheoccupierofthepremisesandshallbeproducedtotheInspectorondemand.Provided that the certificate issued for each repair and maintenance work need not be reserved for a periodexceedingsixmonths.

    115.Precautionsagainstcorrosion

    1. Wherenecessary,allelectricapparatusandequipmentandconduitscarryingelectricwiring in a hazardous areashallberegularlytreatedwithasuitableprotectivepaint.

    2. Thecertificationlabelindicating the flameproofor intrisicallysafenatureof theapparatusorequipmentshallnotbepaintedoverortreatedinanymannertoimpairthelegibilityoftheparticularswritten,stampedorembossedonsuchlabel.

    STORAGEOFPETROLEUMREQUIRINGLICENCE

    116.LicenceforstorageSaveasprovidedinSecs.7,8and9oftheActnopersonshallstorepetroleumexceptunderandinaccordancewithalicencegrantedundertheserules:Providedthatnolicenceshallbenecessary

    i. forthestorageofpetroleuminwellheadtankorii. for the storage of petroleum as transit cargo within the limits of a port subject to such conditions as may be

    specifiedbytheConservator.117.Precautionsagainstfire

    1. Nopersonshallsmokeinany installation,storageshedorservicestationsave inplacesspeciallyauthorizedbythelicensingauthorityforthepurpose.

    2. No person shall carry matches, fuses or other appliances capable of producing ignition or explosion in anyinstallationorstorageshedwhichisusedforthestorageofpetroleum.

    3. No fire, furnace or other source of heat or light capable of igniting inflammable vapour shall be allowed in anyinstallation,storageshedorservicestationsave inplacesspeciallyauthorizedby the licensingauthority for thepurpose.

    4. Anadequatenumberofportablefireextinguisherscapableofextinguishingoilfiresshallalwaysbekept ineveryinstallation,storageshedorservicestationatstrategicpointandallpersonsemployedinsuchinstallation,storageshedorservicestationshallbeconversantwiththeuseofsuchfireextinguishers.

    118. Supervision of operations within an installation, service station or storage shed All operations within aninstallation, service station or storage shed shall be conducted under the supervision of an experienced responsibleagent or supervisor who is conversant with the terms and conditions of the licence held for the installation, servicestationorstorageshed,asthecasemaybe.

    119.Cleanlinessof installation,servicestationorstorageshedTheground in the interiorofan installationorservicestationandtheprotectedareassurroundinganyinstallation,servicestationorstorageshedshallbekeptcleanandfreefromallvegetation,wastematerialandrubbish.

    120.Drainage

    1. Allenclouressurroundingabovegroundtanksisinaninstallationshallbeprovidedwithproperdrainagefacilitiesinsuchwaythatnowaterisallowedtoaccumulateintheenclosure.

    2. Nopart of theenclosures referred to in subrule(1) shall be below the level of the surrounding groundwithin theprotectedarea.

    3. Where drainage is effected bymeans of a pipe the pipe shall be fitted with a valve which is capable or beingoperated from the outside of the enclosure or with any other arrangement approved in writing by the ChiefController.

    4. Allvalvesandotheropeningsfordrainingoffwatershallbekeptclosedexceptwhenwaterisbeingdrainedoff.5. Thenatureofthedrainagearrangementsandthepositionofallopeningsandvalvesthereinshallbeshowninthe

    plansubmittedwiththeapplicationforalicence.121.Exclusionofunauthorizedpersons

    1. Theprotectedareasurroundingevery installationandstorageshedshall be surrounded by awall or fence of atleast1.8metersinheight.

    2. Precautions shall be taken to prevent unauthorized persons from having access to any storage shed orinstallation.

    122.Petroleumonly tobestoredNo installation,servicestationorstorageshedshall,withoutpermission inwritingfromtheChiefController,beusedforanypurposeotherthanthestorageanddistributionofpetroleumandforpurposesdirectlyconnectedtherewith.

    123. Marking of capacity of tanks The capacity in litres of every above ground tank in an installation shall beconspicuouslymarkedonthetank.

    124.Constructionoftanks

    1. Every tankor receptacle for thestorageofpetroleum inbulkother thanawellhead tankshallbeconstructedofironor steel in accordancewith the codesor specificationsapprovedby the IndianStandards Institution or anyothercodeorspecificationsapprovedinwritingbytheChiefController:Providedthatifthepropertiesofpetroleumtobestoredsorequireorforanyotherreasonitisnecessarysotodo,tanksorotherreceptaclesmaybebuiltofmaterialsotherthanironorsteel.

    2. The tanks or other receptacles shall be erected on firm foundations or supports of noncombustible material inaccordancewithsoundengineeringpractice

    3. Theheightof a storage tankshall not exceedoneandahalf times its diameteror twentymetres, whichever isless.ExplanationFor thepurposeof thissubrule theheightofa tankshallbe theheight from itsbottomto topcurbangles,

    4. Anairspaceofnot lessthanfivepercentofthetotalcapacityofthetankorthespaceprescribed in thecodeorspecificationreferredtoinsubrule(1)whicheverisless,shallbekeptineachtank.

    125.Protectionagainst corrosionAll tanksorother receptacles for thestorageofpetroleum inbulk,other thanwellhead tanks installed on the ground or below the ground, shall be protected against corrosion by the use of protectivecoatingsorcathodicprotectionorbyanyothermeansapprovedbythelicensingauthority.

    126.Testingoftanks

    1. Storage tanks or other receptacles for the storage of petroleum in bulk, other than wellhead tanks, after beinginstalledandsecuredinthefinalpositionorafterundergoingreinstallationoranymajor repairshall,beforebeingputintouse,betestedbywaterpressurebyacompetentperson.

    2. The water used for testing shall be free from petroleum and shall not be passed through any pipe or pumpordinarilyusedfortheconveyanceofpetroleum:

    3. Providedthatwherethelicensingauthorityissatisfiedthatitisnotreasonablypossibletoconveywaterbypipesorpumpsotherthanthoseordinarilyusedforconveyanceofpetroleum,hemaypermituseofapetroleumpipeorpumpfortheconveyanceofwatersubjecttosuchconditionsashemayimpose..

    4. Thecompetentpersoncarryingoutthetestasrequiredundersubrule(1)shall issueacertificate in theproformagivenbelowthecertificatesoissuedshallbesubmittedtothelicensingauthorityalongwiththeapplicationforthegrantofamendmentofalicenceor,inthecaseofanymajorrepair,aftereachsuchrepair.

    127.Earthingoftanks

    1. Everytankorotherreceptaclesfor thestorageofpetroleuminbulk,other thanawellhead tankor tanksof lessthan 50,000 litres capacity containing petroleum Class C shall be electrically connected with the earth in anefficientmannerbynotlessthantwoseparateanddistinctconnectionsplacedattheoppositeexremitiesofsuchtank or receptacle. The roof and allmetal connections of such tank or receptacle shall be in efficient electricalcontactwiththebodyofsuchtankorreceptacle.

    2. Theconnectionsandcontacts requiredundersubrule (1)shallhaveas few jointsaspossible.All jointsshallberiveted,weldedorboltedandalsosolderedtoensurebothmechanicalandelectricalsoundness.

    3. Theresistancetoearthshallnotexceed7ohmsandtheresistancetoanypartofthefittingtotheearthplateortoanyotherpartoffittingshallnotexceed2ohms.

    128.Testingofearthconnections

    1. Theconnectionsandcontactsofthetankorreceptaclerequiredunderrule127shallbeinspectedandtestedbya

    competent person at least once in every twelve months by means of a direct reading instrument, such as, amerger.

    2. The testing instrument referred to in subrule (1), if capableof producinga spark, shall be so shielded as to beincapableofignitingpetroleumvapour.

    3. Arecordofsuchinspectionsandtestsshallbemaintainedbythelicenseeinthelicensedpremisesandshallbeproducedondemandbyanyinspector.

    129.NightworkingNoinstallationstorageshedshallbeopenedandnoworkinanyinstallationorstorageshedshallbepermittedbetweensunsetandsunriseexceptwhereapprovedelectric lightsconfirming to theprovisionsofChapter IVareexclusivelyused.

    130. Certificate of safety A certificate of safety in the proforma a give below this rule and signed by a competentpersonshallbefurnishedtothe licensingauthoritybeforeanypetroleumisstored inan installationoraservicestationfor the first time orwhenever any additions or alterations to the enclosurewalls and embankments are carried out orwhenanytankisinstalledoritspositionshifted.

Every person desiring to obtain a licence to import and store petroleum inFormXII, FormXIII, FormXIV or inSpecialForm,asthecasemaybe,shallsubmittothelicensingauthorityanapplicationalongwith(a)specificationandplansdrawntoscale,induplicate,clearlyindicating(i)themannerinwhichtheprovisionsprescribedintheseruleswillbecompliedwith(ii)thepremisesproposedtobelicensed,theareaofwhichshallbedistinctlycolouredorotherwisemarked(iii)thesurroundingsandallprotectedworkslyingwithin100metresoftheedgeofallfacilitieswhichareproposedtobelicensed.(iv)theposition,capacity,materialsofconstructionandgroundandelevationviewsofallstoragetanks,enclouresaroundtanks,allvalves,fillinganddischargepoints,ventpipes,dippipes,storageandfillingsheds,pumps, firefightingfacilitiesandallotherbuildingandfacilitiesformingpartofthepremisesproposedtobelicensed(v) theareas reserved for different classesof petroleum included ing petroleum exempted under Sec. 11 of theActand(b)ascrutinyfeeof1[rupees,twenty]paidinthemannerspecifiedinrule13.
