Change from the Board is appropriate and important because Board rules need

to keep current with our rapidly changing professions and how those professions impact the health, safety and welfare of the public.

Another change for the Board is my election in May as the 2017-2018 Chair. I have witnessed during my six-plus years on the Board the Chair position rotate to land surveying, engineering, interior design, professional soil science, and public members. Such diversity of perspectives from the Chair has strength-ened the Board. As current Chair, I want to keep that momentum going. Here are my two primary goals:

Rule packages continue progress along path to adoption The Board is nearing completion of the Statement of Need and Reasonableness (SONAR) and proposed rule amend-ments to Chapter 1800. Once we receive approval from the Governor’s Office, we intend to publish the Dual Notice of Intent to Adopt Rules in the State Register. The text of the proposed rules, SONAR, and Dual Notice will be available

for review on the Board’s website this fall.

The proposed modifications will update rules regarding definitions, noncompli-ant conduct, application procedures, education and experience requirements, qualifications for licensure, and certi-

fication and signature, as well as make housekeeping updates.

The Board also continues its work on preparing a draft of proposed rule amendments to Chapter 1805, other-wise known as the “Rules of Professional

Governor Dayton appoints eight members to BoardHilbert reappointed; Blume, Dwyer, Friske, Reichert, Rooney, Stenseth, Whitmyer join as new members

Governor Mark Dayton appointed eight members—seven new and one returning—to the Board effective June 30, 2017. Their terms will expire January 6, 2021. You can read their biographies below.

Dave Blume, PE, LEED AP, has worked in the electrical engineer-ing industry for more than 20 years. As the Electrical Department Head and Chief Electrical Engineer at Gausman & Moore, Dave leads projects in the government, military, healthcare, educa-tional, institutional, commercial and industrial sectors. He has been a partner in the firm since 2009. Dave also served in the US Air Force for 12 years, flying the F-4. This background as a fighter pilot allowed him to develop a solution-oriented, decisive leadership style, particularly on the 100+ projects he’s completed

with the US Army Corps of Engineers. When not working, Dave enjoys camping with his wife, Rachel. They’ve visited 35 of the 46 National Parks in the lower 48 states.

Rachel Dwyer, Public Member, is currently in her dissertation phase as a PhD candidate in archaeology at SUNY, University at Buffalo. She specializes in the recovery, identification and analysis of carbonized plant remains found in the soil matrix at archaeo-logical sites. Ms. Dwyer looks forward to representing the people of Minnesota as a public board member on the MN Board of AELSLAGID and using her complementary expertise.

Wayne Hilbert, Architect, is the president of CNH Architects. Being an owner and principal architect of an architectural firm for the last 30 years, he has designed and managed building projects for both private and public clients. His work includes the first new buildings in Minnesota to earn green globe rating as certified by the Green Building Initiative. Mr. Hilbert attended the University of Minnesota where he received a Bachelor of Architecture degree and the University of Minnesota Carlson School of Management where he earned his Masters of Business Administration.

Eric Friske, JD, Public Member, is a business litigation attorney who represents individuals and businesses in a range of complex business and commercial disputes. He earned his BS degree from the University of Wisconsin-Madison, his MS from the University of Pennsylvania, and his JD from the University of Minnesota Law School. In his free time, he enjoys spending time outside near his home in Carver.

Claudia Reichert, CID, has served as President of IIDA and served on the Community Enhancement Committee for the Commercial Real Estate Develop-ment Association for many years. She is a graduate of the University of Minnesota Design Program. She started her career working for an office furniture dealership and later became Design Director. In 1988,

she joined Emert Design (later Edesign), eventually becoming a partner. In 2004, the firm merged with Philadelphia’s NELSON. As a result of the merger, the Minneapolis NELSON office has grown to 50 teammates. Claudia continues to be Managing Partner of the Minneapolis office. Claudia spends her free time gardening, biking and going to concerts. She and her husband Bruce have two adult children, Laura and Nick.

Jody Rooney, Public Member, has been a professional economist since 1973, doing benefit cost analysis, performance mea-surement, work unit supervision, study and program management in a cross-dis-cipline, problem-solving environment. She has experience with the disciplines represented by the Board: Jody has served as tribal facilitator for the US Army Corps

of Engineers. As a business planner for the Mille Lacs Band of Ojibwe, she wrote scopes of work and negotiated contracts to hire architectural, interior design, land surveying, and engi-neering services. As the owner and principal of J. L. Rooney & Associates LLC, she has sub consulted for engineering firms, local units of government, and private entities. Jody is a proud Gopher graduate of the University of Minnesota’s Minneapolis Economics Program (BA) and the St. Paul Campus’s Applied Economics Program (MS).

David Stenseth, CPA, Public Member, has worked as a Certified Public Accountant since the early 1990s. He is a member of the AICPA and the MN Society of CPAs where he serves on its Tax Conference Planning Task Force, which he formerly also chaired. As president of Stenseth Samuelson & Boese, Ltd, David works with small to mid-sized businesses and

individuals with a focus on manufacturers and service related industries. The services that he provides include establishing and maintaining accounting and information systems, compil-ing and reviewing financial statements, income tax planning and preparation, and business consulting services. David has managed the firm’s adoption of new technologies and speaks on panels regarding technology adoption by accounting firms. In his free time, David enjoys golfing or watching the Wild with his wife Sheila and daughter Amy.

Robert Whitmyer, PSS, is a soil scientist and president of MATRIX Soils & Systems, Inc., formed in 1999. His experience and current responsibilities include business and project man-agement; soil investigations and dispute resolution assistance; feasibility and water use studies; and site evaluation, design, construction and operation plan development. Prior to MATRIX Soils & Systems, Bob was a soil scientist for Ayres Associates and, before that, served as a wastewater treatment system code enforcement officer for the Washington County Department of Public Health. He has served as treasurer of the Minnesota Association of Professional Soil Scientists, chair of the Minne-sota Pollution Control Agency SSTS Technical Advisory Panel, and member of the City of Rice Lake Planning & Zoning and Board of Adjustment commissions.

In the Matter of Jeremy Freihammer, Unlicensed

Facts: Mr. Freihammer is not currently and never has been licensed by the Board as a Professional Engineer in the State of Minne-sota. He held himself out and practiced as a Professional Engineer in Minnesota within the meaning of Minnesota Statutes §326.02, subd. 3 (2016) by preparing and signing as a professional engineer a Grade Separation Study Final Report that compared and eval-uated options for redesigning two existing at-grade railroad crossing locations for a project in Minnesota.

Enforcement Action: On March 23, 2017, the Board issued a Findings of Fact, Conclu-sion of Law and Cease and Desist Order. Mr. Freihammer was ordered to cease and desist holding out and practicing as a Professional Engineer in Minnesota until such time as he becomes licensed as a Professional Engineer in Minnesota.

     

In the matter of Charles Grant Mayes, Architect License #19008

Facts: Mr. Mayes was first licensed in 1988. On June 20, 2016, he renewed his license. He affirmed he had met the Board continuing education requirements for renewal, which included two ethics hours earned prior to renewal and during the reporting period that ended June 30, 2016. On September 23, 2016, the Board notified Mr. Mayes that he had been selected as part of the continuing education audit. Documents submitted by Mr. Mayes for the audit failed to support his original affirmation that he had met the ethics requirement prior to renewing. Mr.

Facts: Mr. Weyandt was first licensed in 2001. On April 28, 2016, he renewed his license. He affirmed he had met the Board continuing education requirements for renewal, which included two ethics hours earned prior to renewal and during the reporting period that ended June 30, 2016. On September 23, 2016, the Board noti-fied Mr. Weyandt that he had been selected as part of the continuing education audit. Docu-ments submitted by Mr. Weyandt for the audit showed he had only one

ethics hour and so failed to support his orig-inal affirmation that he had met the ethics requirement prior to renewing. Mr. Weyandt later submitted one continuing education hour earned after the June 30, 2016, report-ing period to fulfill the ethics hours required.

Enforcement Action: On May 11, 2017, the Board issued a Stipulation and Order. Mr. Weyandt was reprimanded for the forego-ing conduct and ordered to pay a $500 civil penalty.

Facts: Mr. Ooten was first licensed in 2010. On June 30, 2016, he renewed his license. He affirmed he had met the Board continuing education requirements for renewal, which included two ethics hours earned prior to renewal and during the reporting period that ended June 30, 2016. On September 23, 2016, the Board notified Mr. Ooten that he had been selected as part of the continuing education audit. Documents submitted by Mr. Ooten for the audit failed to support his original affirmation that he had met the

In the Matter of Clark Wicklund, PE License #40922

Facts: Mr. Wicklund was first licensed in 2001. His license expired on July 1, 2016, and was reinstated on January 9, 2017. During the time his license was expired, Mr. Wicklund held out and practiced as a PE on twenty-one separate projects. Mr. Wicklund self-reported and took corrective action. He was extremely cooperative and forthcoming with the Board, his employer and associates.

Enforcement Action: On May 11, 2017, the Board issued a Stipulation and Order. Mr. Wicklund was reprimanded for the foregoing conduct and ordered to pay a $4,000 civil penalty.

     

In the matter of Beth Anderson, PE License #18774

Facts: Ms. Anderson was first licensed in 1987. Her license expired on July 1, 2016, and was reinstated on August 11, 2016. During the time her license was expired, Ms. Ander-son held out and practiced as a PE when she prepared and signed the fire scene inspection report on a project located in Minnesota.

Enforcement Action: On July 11, 2017, the Board issued a Stipulation and Order. Ms. Anderson was reprimanded for the foregoing conduct and ordered to pay a $1,000 civil penalty.

     

In the matter of Kerry A. Moore, PE License #48663

Facts: Mr. Moore was first licensed in 2010. On August 9, 2016, he renewed his license. He affirmed he had met the Board continuing education requirements for renewal, which included two ethics hours earned prior to renewal and during the reporting period that ended June 30, 2016. On September 23, 2016, the Board notified Mr. Moore that he had been selected as part of the continuing education audit. Documents submitted by Mr. Moore for the audit showed he had only .5 ethics hours and so failed to support his orig-inal affirmation that he had met the ethics requirement prior to renewing. Mr. Moore later submitted continuing education hours earned after the June 30, 2016, reporting period to fulfill the ethics hours required.

Enforcement Action: On July 11, 2017, the Board issued a Stipulation and Order. Mr. Moore was reprimanded for the foregoing conduct and ordered to pay a $500 civil penalty.

     

In the matter of Lewis Ng, PE License #16929

Facts: Mr. Ng was first licensed in 1984. His license expired on July 1, 2016, and was reinstated on January 5, 2017. During the time his license was expired, Mr. Ng held out and practiced as a PE on twenty-two separate projects. Mr. Ng self-reported.

Enforcement Action: On July 11, 2017, the Board issued a Stipulation and Order. Mr. Ng was reprimanded for the foregoing conduct and ordered to pay a $4,800 civil penalty.

In the matter of the Engineering Activities of Peter Lichomski, Unlicensed

Facts: Mr. Lichomski was first licensed as an Architect in 2007 and his license is current. He is not currently and never has been licensed by the Board as a Professional Engineer. The Committee’s position is that Mr. Lichomski practiced as a Professional Engineer within the meaning of Minnesota Statutes §326.02, subd. 3 (2016) by preparing, signing and certifying engineering plans for a utility infra-structure project in Perham, Minnesota, in September 2016. Mr. Lichomski denies violat-ing any provisions of Minnesota law enforced by the Board. However, both parties wish to resolve the complaint by mutually agreeing to the enforcement actions below.

Enforcement Action: On August 17, 2017, the Board issued a Settlement Agreement and Cease and Desist Order. Mr. Lichomski was ordered to cease and desist practicing as a Professional Engineer in Minnesota until such time as he becomes licensed as a Profes-sional Engineer in Minnesota. He was further ordered to pay a $5,000 civil penalty.

ArchitectureNCARB released their “2017 By the Numbers” Report. They noted no change in the number of overall licensed archi-tects in the US, but a 3% increase in the number of reciprocal licenses. Candidate numbers also remained unchanged. Women and minorities still lag behind in demographics, with only 2 in 5 new licensees being women and 1 in 5 identi-fying as a racial or ethnic minority.

Comparing Minnesota candidate performance to the national average, Minnesota was in the top 10 for exam pass rate. The time Minnesota candi-dates take to complete the ARE and the AXP was similar to the national average.

A reminder that the ARE 4.0 will be retired June 30, 2018. Thereafter only the ARE 5.0 will be administered.

EngineeringNCEES has announced specification and other changes to certain exams begin-ning with the April 2018 administration. The affected exams are:

• Architectural Engineering• All 3 Electrical and Computer

exams; also the “Electrical and Electronics” exam will be renamed “Electronics, Controls, and Communications”

Updates from the National Councils• Environmental• Structural 16-hour• The Civil Exam’s Construction

and Structural modules will have revised design standards.

Architectural Engineering Exam speci-fications can be downloaded from the Board’s “Professional Engineering” webpage. The other exam specifications/standards will be available in October.

Land SurveyingIn February NCEES solicited licensed sur-veyors to participate in a content review for the Principles and Practice of Survey-ing (PS) exam. The results of the study will be used to update the specifications for the exam.

Landscape ArchitectureRevisions to the Landscape Architect Registration Examination went into effect with the April 2017 administration. Among the changes to the exam are new content focusing on maintenance, histor-ical preservation, performance metrics and specialty plans. These updates will align the exam with current practice.

GeoscienceThe fee for the Fundamentals of Geology (FG) exam will increase to $200, effective March 2018. The fee for the Practice of Geology (PG) remains $250.

procedures, so that new members get quickly up-to-speed and contributing. This was especially timely, since a full third of the Board is new this year.

We also launched an updated website and other new communications tools (see the article on page 7). Please visit the website. In addition to expanded content for applicants and the public, the new website includes more information of use to you, our licensees. You’ll also find under “About > Mission/History” the Board’s strategic initiatives and most recent (2014-16) Biennial Report. Both are well worth reviewing!

Enact Rule Changes We expect to implement two proposed Rule packages this fiscal year (see other article starting on page 1). We’re making sure our education and experience

requirements and code of conduct meet today’s and tomorrow’s needs—and that the rules that describe them are clear.

Those packages are not the end of our review of Board rules—or of the statutes enacted by the Legislature that govern the Board. We’re already looking ahead to see what other changes may need to be implemented and when.

Avail yourself of the new communication tools created by the Board—the revised website, the social media accounts, and the eNewsletter—to stay informed of changes affecting your licensure or certification. Use them, too, to provide feedback to the Board.
