    requiredtopublishnoticeoftheirrulemakingactionintheStateRegister.PublishedeveryMonday,theStateRegistermakesiteasytofollowandparticipateintheimportantrulemakingprocess.Approximately80stateagencieshavetheauthoritytoissuerules.EachagencyisassignedspecificMinnesotaRulechapternumbers.Everyodd-numberedyeartheMinnesotaRulesarepublished.Supplementsarepublishedtoupdatethissetofrules.Generallyspeaking,proposedandadoptedexemptrulesdonotappearinthissetbecauseoftheirshort-termnature,butarepublishedintheStateRegister.

    AnagencymustfirstsolicitCommentsonPlannedRulesorCommentsonPlannedRuleAmendmentsfromthepubliconthesubjectmatterofapossiblerulemakingproposalunderactiveconsiderationwithintheagency(MinnesotaStatutes§§14.101).ItdoesthisbypublishinganoticeintheStateRegisteratleast60daysbeforepublicationofanoticetoadoptoranoticeofhearing,orwithin60daysoftheeffectivedateofanynewstatutorygrantofrequiredrulemaking.

    TheMinnesotaAgriculturalandEconomicDevelopmentBoard’s(the“Board”)feestructuretoissueconduitbondshasbeenunchangedsince2010.TheBoardcurrentlychargesaone-timefeebasedontheoriginalamountoftheconduitbondissuesof1/6thof1percent(16.5basispoints)withaminimumof$10,000andamaximumof$50,000.

    TheBoardwillbeimplementingchangesinthisfeestructuresofeesaremoreconsistentwithratesbeingchargedbysimilarentitiesandtobetterreflectthecostsinvolvedwiththesetransactions.Thefeeforinitialissuanceswillincreaseto1/5thof1percent(20basispoints)andtheminimumfeewillincreaseto$15,000butthemaximumwillbeunchangedat$50,000.

    TheBoardwillalsoincreasethefeesassociatedwithconduitrefundbondissuesto10basispoints(upfrom8.25basispoints)withaminimumof$15,000(upfrom$10,000)andmaximumfeeof$50,000whichwillbeunchanged.

    TheMidwesternHigherEducationCompact(MHEC)isaninstrumentalityof12Midwesternstates(Illinois,Indiana,Iowa,Kansas,Michigan,Minnesota,Nebraska,NorthDakota,Ohio,SouthDakota,andWisconsin).TheCompactwasestablishedin1991throughacommonstatuteenactedintolawbyeachofthememberstates(MinnesotaStatute–Section135A.20).ThepurposeoftheCompactistopromotehighereducationthroughinterstatecooperationandresourcesharing.

    MHEChasdeterminedthatdevelopingaregion-wideacquisitionstrategyforhighereducationVirtualization&DataCenterModernizationthroughoneormoreproviderswillbenefitboththehighereducationcommunityandtheprovider(s).MHECisseekingcompetitivesolicitationswiththeintenttonegotiatemasteragreementtermsandconditions,licensing,andpricing.Theresultingagreementwillallowaninstitutiontofocusmostofitsenergyonfindingthetechnologysolutionthatbestfitsitsneedsinsteadofthecontractitself.Theresultisamasteragreementthatfacilitatesadirectrelationshipbetweenthetechnologyprovider(s)andinstitutionswhichcontainsdiscountpricingaswellastermsandconditionsthatarebetterthanmosthighereducationinstitutionscannegotiateindividually.
