Development Application and Works within Riparian Reserve Mrs Jane Malecky has submitted the following questions on notice:

1. A recent development application DA-2015-64 at 16 Browns Road, Kingston was granted a development/use permit by Council’s Manager Development Services on 13 May 2015. Why was this decision based on a TIA dated 20 August 2012 (this TIA addressed DAS-2102-28 at 18 Browns Road) that was not only outdated, but failed to take into account the very heavy volume of vehicular traffic, both residential and commercial, that travels Browns Road every day, especially on weekdays when the light industries on the northern side of Browns Road are in operation, making the road hazardous due to the volume and speed of vehicles?

2. Why have the owners of 24 Browns Road and 757 Channel Highway, Kingston been permitted to alter the course of Browns River, and in so doing, negatively impact the riparian reserve on both sides of the river, and to severely degrade the hillside on the western side of Browns River by quarrying terraces into the hillside?

Former Vodafone Complex The following Question on Notice was submitted by Cr Winter: Is Council aware of any private or public sector interest in relocating to the old Vodafone site at Huntingfield? Is Council involved, or aware of Tasmanian Government involvement, in attracting a new tenant(s) to the site? Officer’s Comments Responsible Officer: Gary Arnold – General Manager I have been in regular contact with the owners of the Huntingfield property since Vodafone announced earlier this year they were vacating the site. At the most recent meeting with the owners, the Mayor and myself offered to facilitate a meeting with the State Government if required but were advised it was premature as the Vodafone lease does not expire until November 2016. The owners further advised that they were in the process of preparing national and international marketing brochures for the site. C233/10-15 PROPOSED AMENDMENT TO THE KINGBOROUGH INTERIM PLANNING SCHEME 2015 MOVED Cr Street SECONDED Cr Black That the Tasmanian Planning Commission be notified that the Kingborough Planning Authority agrees with:

(a) the intended reduction in frontage requirements –

for new lots to 6 metres under the performance criteria for the General Residential, Inner Residential, Low Density Residential, Rural Living, Environmental Living and Village Zones in the Kingborough Interim Planning Scheme 2015; and

for internal lots and access strips to 3.6 metres under the performance criteria for the General Residential, Inner Residential, Low Density Residential, Rural Living, Environmental Living and Village Zones in the Kingborough Interim Planning Scheme 2015; and

(b) the change of clauses 13.5.1 P4(a) and 14.5.1 P4(a) for the Rural Living and

the construction of a new Day Respite Centre at Gormley Drive, Kingston;

(b) provide matching funds drawn from the sale of the existing Manor Gardens property and from Council’s own funds, as incorporated within future appropriate budget allocations; and

(c) if unsuccessful with this grant application, to continue to work closely with the Kingston Rotary Club in pursuing other external funding opportunities that will enable the expansion of services provided by the existing Manor Gardens Day Respite Centre.

National General Assembly opened in a sombre mood with the sad announcement to all present of the passing of Mayor Barry Jarvis. As a sign of respect, all rose to their feet and observed one minute silence. Barry will be sorely missed at all levels.

Warren Truss, Deputy Prime Minister & Minister for Infrastructure and Regional Development opened Conference and made mention of the numerous grant programs available.

He advised that the Federal Government’s aim is to build a stronger Australia and that Local Government (LG) was an essential partner to achieve the infrastructure needs.

Reforms of Federation and Taxation (white papers): gives all the opportunity to have a say, local government revenue raising capabilities need to be in LG control, and not to rely on the Federal Government. A once in a generation opportunity to engage in the process and shape what comes out of it.

2015/16 budget aims to grow jobs with productive infrastructure, aimed at economic, not social, to those regions experiencing disadvantage.

Roads 2 recovery : no sunset clause.

It is a good time to build infrastructure projects and support long term growth in regional communities. L G has a big role to play in driving and facilitating continued growth in our economy. Councils have a history of managing their community plans well. We all must be smarter how we plan for our long term infrastructure needs.

Troy Pickard, ALGA President welcomed delegates, and called on the government for an early restoration to CPI for FAG’s. The three year ‘temporary freeze’ will cost LG $925m in the three years, and if restored later than 3 years, would result in the base being 13% below of what it would have been. LG share of taxation revenue continues to fall; 1% in 1996, down to 0.7% now and 0.5% in three years despite costs for LG continuing to rise.

Reform of Taxation: It can provide opportunities, not only threats. LG must be an active participant, seeking to improve government funding to our respective communities.

Australian Centre of Excellence in Local Government- Associate Professor Roberta Ryan spoke of ‘Why L G Matters’. Roads, rates and rubbish have not been regarded as the only roles for LG for many years. Communities want LG to be responsible for a diversity of activities in the local community, with planning for the future being the most important.

There is demand and support for LG to deliver services for a healthier and fairer society, and that decisions regarding services should not be decided just on value for money. Research indicated that 93% of Australians want to be involved with Govt in making decisions about what services are delivered in their communities. 75% believe LG delivers what matters where people live. The environment is important to our communities, and LG by supporting the Arts are community building and providing identity for the community.

Is local government a real Partner?

Australian Council for the Arts: Partnerships with Govt at all levels is important, most importantly with LG. LG participate, invest and enjoy the Arts in their own communities.

Wentworth Group of Concerned Scientists: Individuals, communities, business and LG strive to live sustainably - water conservation, recycling, solar panels, community coastcare, landcare and bushcare groups. Australia’s heritage is breathtaking. There is no reason why we cannot grow our economy, create jobs and enjoy a healthy environment. Short term decision making is not helping our environment. We can respond to environment challenges that will create opportunities for a healthy environment, economic growth and job creation.

Innovative and Community Engagement:

Roberta Ryan (ACELG)- Our communities want to be engaged and communicated with. They also want LG to put their issues to other levels of government on their behalf. Community engagement is information giving, information gathering, discussing opinions, power sharing and citizen control. It is also a voluntary process as our community choose to participate. When scheduling a meeting, an open mind is required and not already having the answer. Should the decision not give the community what they want, the reasoning must be explained.

Joe Caputo (Federation of Ethnic Communities’ Councils of Australia) – In the 1980s 22% of the population in Joes’ community were Italian, however no one at Council spoke Italian. Requests from the Italian community seemingly were refused / never considered. A modest annual festival event started within this community was finally taken on board by the Council and has since grown into one of Victoria’s major festivals.

Darryl Nichols (Garage Sale Trail)- This event was born as an awareness of rubbish dumping – ‘Don’t dump it – Sell it’ at a Bondi Beach Festival. Australia is the world’s 2nd largest consumers, but most ends up in landfill. This annual event has united

communities and stimulated local economies, BUT relies on LG involvement. Last year SBS broadcast the Garage Sale Trail in 9 languages to reach more communities. This year’s event will be held on Saturday 24 October 2015.

White Paper on Taxation (Deloitte)- The Australian Government re-think tax discussion paper claims that Australia’s current tax system is holding Australia back and that it was designed in a different era, when we had a different economy. Many features of the present system discourage – Investment, - Jobs growth, - People from working. Tax reform offers opportunities to improve growth in standards of living, and to simplify and improve fairness. Australia relies more on taxes with high costs to economic growth than other developed countries.

Tax reform issues for LG include implications should state governments seek to raise more revenue from recurrent property taxes. The ongoing grants from other levels of government may be reformed as part of a Federation Reform. Could FAGs be under threat?

The Attorney-General’s Department-Combating violent extremism- Refer www.livingsafetogether.gov.au LG must promote social cohesion within our respective communities.

Reforms- Dr John Bannon AO- Observations : Both reform processes provides a very important opportunity for LG. There is a lack of respect and trust between all 3 tiers of government. Consensus is essential to any reform. Must focus on results and community. LG needs to be part of discussions at state level. LG will in future be an essential part of delivery of projects. Small LG is not less efficient.

Developing a Framework for Managing Coastal Climate Risk in Australia - Dr Dave Rissik (National Climate Change Adaptation Research Facilities)-Developing coastal climate risk management tool / framework to guide local and state governments and others to make better decisions of managing risks from coastal climate change. National in scope, recognising variations in climate, and regulatory and planning systems.

Challenges faced – Lack of integrated planning, lack of communication, lack of awareness / understanding, lack of long term planning decisions, too much / not enough data / information. What can we trust?, where do we get it?

Rosie Batty – Australian of the Year 2015-Family violence -All local communities have a significant problem ; 1 in 3 women are affected by family violence, and 1 in 4 children affected, whilst 2 women per week are being murdered by partner / ex-partner. Now is the time to bring this sad and unacceptable family violence issue out from behind closed doors. The focus has been on the victim, but why has the perpetrator been allowed to commit these violent and vicious attacks on women and children?

She is encouraged by LG taking up the cause, but need 100% of Councils throughout Australia to be involved. Family violence has been a complex and difficult issue in our communities, a problem that has been ignored for many years. Our communities are now beginning to recognise and take this issue seriously. We have a duty for future generations, and need to discuss and find solutions to protect our women and children. Help organisations are under attack from funding, and hopefully a new Court system will be introduced shortly to give greater support and protection to women and children.

Australia has a long way to go to support, to respond, to prevent, and to accommodate those in need. Rosie thanked her own Council for the ongoing support to her, and thanked LG for continuing to support others affected by family violence. Rosie called on all
