PUBLIC ANNOUNCEMENT Supervisor Flach continued by reading the following public announcement: We are continuing the program of electronic recycling which was begun last year. The next collection day will be on Wednesday, April 25th at the Beautification Department building (old firehouse), 70 South Main Street, in Coeymans. Hours will be 7:00am – 3:00pm. Town personnel will be available to assist, however, items can not be dropped off before or after the designated times. Town residents are asked to bring only those items on the list: televisions (portable or console), computer equipment, typewriters, video game systems, cell phones, I-pods, monitors, scanners, ink cartridges, fax machines, printers, keyboards and other computer accessories. Do not bring liquids, air conditioners, dehumidifiers, refrigerators, kitchen or personal appliances, batteries or fluorescent lamps. This information has been posted on the Town’s website along with a complete list of items that can be accepted. I’d like to not that there will be a special Lion’s Club sponsored collection box for cell phones. The Lion’s Club is collecting cell phones to support various activities whose funds are primarily for sight and hearing assistance.

***************************** PUBLIC COMMENT Supervisor Flach invited the public to comment at this time. Ms. Donna Pasquini stated that she lives in the Hamlet of Coeymans and added that last year she came with the Neighborhood Association to address 9 First Street, which they call the pigeon motel and they addressed how bad it was with water in it, bricks falling off and everything caving in and they were told that there was nothing that the Town could do because the taxes were paid. She continued by saying that there are three current Board Members who were on the Board at that time and added that it is a lie because Albany County owns it and said that the Town could have torn it down at anytime they wanted and all they had to do was ask permission and now she understands that the house is going to be saved. She went on by saying that it is a pigeon motel and dangerous and should be torn down and they should let the County tear it down and stop fighting them when the Town could have done it themselves and refused to do it. Councilman Dolan stated that it is not true that the Town could have torn it down at anytime and the only time that it could have been torn down was after the County took possession of it. He added that the County has condemned it and in turn some people with his assistance contacted the County to see if they could take over the house and rehabilitate it. Ms. Pasquini stated that she talked with the Finance Manager at the County and he said that the County has paid the full tax amount for five years and advised that all the Town needed to do was ask and in turn it could have been turned over to the Town, who could have torn it down and he also advised that with the condition that it is in, the assessment was never lowered and they paid the full tax amount for the full five years because the Town never lowered the assessment. She continued by saying that she does not think that the Finance Manager for the State who is in charge of this is lying to her on the phone about it because he seems to know what he is talking about. Supervisor Flach stated that after one of the Town Board Meetings, not too long ago, the Assessor got in touch with him and said that this piece of property at 9 First Street just went up for taxes and it was going to Albany County and a few days later they got in

touch with Albany County and at time they came down to look at the building and said that they can get it torn down. He added that in the meantime, someone had talked to Councilman Dolan about rehabilitating the property and he had not heard about it since then, which was a few weeks ago. Ms. Pasquini stated that her point is that there was a group from the Neighborhood Association and they distributed pictures to the Town Board as to how bad it was and the whole idea was to try and get it taken down. She added that the County stepped in and said they wanted to take it down but they had received a call from Councilman Dolan asking them not to because he is trying to come up with funding to save it. She then asked why they would try to save something that is in such bad shape and an eye sore when there are other houses that are in or going into foreclosure that could actually use the grant money to be fixed. Councilman Dolan stated that he did not receive an offer for grant money for any other property except that particular one. Ms. Pasquini stated that she understands that the outside was built in the 1800’s and he had told the County that the inside was the 1700’s and Ms. Fori had told her that it is not true because it was built the same time that hers was, which was the 1800’s. Councilman Dolan stated that the main part of the house was the 1800’s. Ms. Pasquini stated that she was just wondering why the Town Board didn’t consider the dangers that the Neighborhood Association as a serious matter and now it is a big turn around with trying to save it. She continued by saying that a while ago Town Clerk Millious had an employee who left and she was begging for help and she was at the meeting when it was tabled because they wanted to see if they could save some money by not replacing the employee, even though the money was in the budget to do so and now she sees on the agenda that they are hiring 7 part-time Police Officer’s. Councilman Dolan stated that it is not correct and added that Town Clerk Millious did hire her person. Ms. Pasquini stated she knows that because she was at the last meeting, she added that it did get put off for a while. Councilwoman Rogers interjected that it was tabled because she did not get the ad in the paper. Ms. Pasquini stated that she thought it was tabled in the beginning because Councilman Boehm said that he didn’t know if they should spend the money and maybe it should be saved to put toward this year’s budget. Councilman Boehm interjected that he is always looking to save the taxpayers money. Supervisor Flach stated at the next meeting they went ahead with it because she had not even had it in the paper and they gave her permission to put it in the paper at that time. Ms. Pasquini stated that she understands all that and added that if they were thinking about trying to save money then, how are they now hiring 7 part-time Police Officers and continued by asking if they are replacing Officers that have left or are leaving. Supervisor Flach stated that one full-time Police Officer left and they want to hire part-time people and added that there are full-time Officers that are getting more overtime than they would like and they are paying overtime because of the lack of Officers to fill in the gaps and by hiring part-time, they can save that money in overtime and they can save money in benefits. Ms. Pasquini asked if the part-time Officers get any benefits other than their uniforms and boots.

Councilman Dolan and Councilwoman Rogers collectively stated it is correct. Supervisor Flach stated that it is also his understanding. Ms. Pasquini inquired as to why they need 7 part-time to replace 1 full-time. Chief Darlington stated that toward the end of last year, the Town Board approved hiring 4 part-time and 1 full-time Officer and 1 part-time and 1 full-time was hired at that point, resumes were gone through and interviews were conducted. He added that the first three are the remaining three from that approval and then a full-time Officer left and to save some money and cut down on overtime he is now asking to hire 3 part-time to replace the full-time that left. Ms. Pasquini stated she thought that it said 7 and she was wondering why they are hiring such a large number and she was just curious and has nothing against the Police Department but one minute they are giving someone a hard time for one and then they are approving others without question. Councilman Dolan interjected that it is the same principal they he applied to Town Clerk Millious’ request and that it is to fill a position that is already budgeted and passed by the Town Board for this year’s budget and it includes no extra money for the Police Department and it should actually result in savings. Ms. Pasquini inquired if hiring these people to replace the one is the same amount of money in the budget. Collectively the Town Board replied that it is. Supervisor Flach asked if anyone else wished to comment. Mr. Laszlo Polyak stated that as they know he ran for Village Justice and he wanted to give some feedback on his ten day write-in campaign so they can have some ideas, which he is not saying are good or bad, and some feedback from the approximately 300 people that he spoke with. He continued by saying that the first one that he wants to address, which is a frustrating peeve of his, is that he had four people tell him that they used to drive through our community but now they come down Rte. 144 and get on the thruway and exit at Coxsackie, which he finds sad. He added that like Councilman Dolan and the newly elected Judge, he got quite a few complaints and frustrations about an Officer that has been full-time for approximately 4-5 years and he also has a complaint and has a 50-H on this particular Officer, which is the Town’s right to depose a person and it costs thousands of dollars. He went on by saying that he does not have to go into that in detail because they pretty much already have enough calling and complaining about this particular person. He continued by saying that he would like something nice to come out of this because he knows that the Albany Police Department has a form and there are instructions that you can go to the Police Chief or Supervisor/Mayor and get for a complaint against an Officer and in turn it would be duly investigated. He then asked if this type of form was available and if not, could one be created so they can get a realistic picture of when Officer’s are doing something not so good and in turn can be reprimanded for or dismissed. He continued by saying that also during his ten day campaign it was colorful enough to know that his only two signs on a truck, were consistently complained about, no matter where it was parked either on public property or a public road and added that he can take that because it is part of slinging mud at each other. He added that in running for Judge, if elected, he will have very narrow abilities to begin with and he has repeated to many in the community that Judge’s can only deal with things that come in front of them so if there is a problem with a certain Policeman, it has to go through the Chief and then further on to the Town Board because the Chief is the Officer’s boss and the Town Board is the Chief’s boss. He went on by saying that judges routinely throughout the country do dismiss tickets that are out there that don’t make sense and some of the things that people said when they were pulled over and the reason why they were pulled over, were seniors being pulled over because they were 12 inches away from the curb, and three people who said they were ticketed for having snow on their roof. He continued by saying that he is just telling the Chief what the feedback was,

and whether it is true or not is his job and this is why he is getting paid between $80,000.00 - $90,000.00 a year and added that he is sure that 90% of it is getting dismissed and to those who it has happened to, it is very real. He added that he got 60 votes and he has no family here, and the people that came out were people that apparently worked in the city or were State workers and people that have never been pulled over, but they are concerned. He went on by saying that he does not know if he has solutions because some of the issues with the Police Department have been going on for 20 – 30 years and half the community feels as though they are not adequately covered, such as those in the Hollow and some people say that because of budgetary problems, the Police Department should be dissolved and he does not know how or what to do because where he grew up there were only County police. He continued by saying that he had stated that the Police Department has a 1 ½ million dollar budget but the Chief said it is $500,000.00, but he was including all of the amenities that go along with it such as communications and the purchase of new cars and equipment, overtime, etc. He then asked how they know and where it is reflected when people file law suits, how much they are for and if they are resolved before going down to a disciplinary action or court. He continued by saying that an officer can bring in money via tickets by writing ticket after ticket and more tickets and for example may bring in $25,000.00 but the Town is losing $30,000.00 in sales tax revenue. He added that he decided to run for Judge because he personally feels from George Washington to now, that everyone should have a choice because our Veteran’s go off and fight those against communism and dictatorship and they come back and do not even have a choice and at least with him running there is a choice between two dictators. He continued by saying that Frank Nunziato came to his house and you have to have passion and love for someone who is well respected and has lived and done things in this community most of his life and he point blank said that it is destroying his business and something needs to be done because he is losing business and people have already closed businesses on Main Street and Rte. 9W and this is another way to look at it because you look at the short term of raising money vs. the long term factor of losing money. He added that he suggested to Breslin about 15 years ago that they explore the possibility of bringing all of the towns into the County and you would make every Police Chief a Divisional Chief and then of course you would have a Commissioner, which would be all of the Police under the County’s Budget. He continued by saying that over the years he has seen even the Mayor come here and say that he does not see police coverage for his constituents and displayed his frustration, which is part of the record. He went on by saying that maybe it has come to the time when they can look at exploring other avenues to keep costs down and in looking at the budget, as he has every year, approximately 50% of the budget is going toward the Police Department for communications or retirement benefits and perspectively, it is a lot of money for 8,000 people. He added that he has police in his family from local police to special agents and even has a cousin that is a New York City cop and it is a thankless job that they work hard at but when people have legitimate complaints they should have an avenue to address it. He went on by saying that he also had some issues with this particular officer during his campaign when he used a hay wagon with his name on it and was pulled over and he is a little confused because if someone has been working for the Town for four years they should have the presence of mind to know that when you live and work in a community that is half farms and farmers, you would by now know that it is legitimate. He added that he also questions about having a parade with a hay wagon during an election and the last time he checked it was protected under the constitution while campaigning and he has friends that have been fined and/or letters sent to them to remove their signs that were political in nature. Councilman Dolan inquired if the issue that he mentioned about the hay wagon was a ticket issue. Mr. Polyak stated that there was not a ticket issued yet and added that later on in the day the same Officer pulled him over and he immediately requested his supervisor and in the conversation the Officer asked if he ever got a ticket, which he knew because the last ticket he got was from him over 2 ½ years ago and they are in a 50H. He continued by saying that it was a directional ticket, which was dismissed because in the video while trying to do a sobriety test in which they found out he was not drunk, his directional was flashing for 15-20 minutes. He added that there are other avenues that they can do, which frustrate people, and they can video tape and audio tape everything the police officer do

today and then put them on You Tube. He continued by saying that he would like to see some kind of form that people can get at the Town Clerk’s Office or the Police Department for filing a complaint and added that the way it is now, many people don’t file complaints and just like in the write-in, there is a possibility that he had more votes, but because it was not filled out right, it didn’t count but it was not enough to make him the winner. He went on by saying that the news media contacted him because of the appearance of what is going on here with the ticket and hay wagon and he informed them that he is going through the normal procedures and having his attorney’s look at it and let it play out in the system. He concluded by saying that ironically there are checks and balances and there are Police Chiefs around the country who have a right to un-arrest someone, for whatever reason and is usually done in situations like down in New York City where there are a bunch of people sitting in a park and 500 get arrested and 4-5 of them may be innocent and when it comes up for review it gets dismissed. Supervisor Flach asked that he conclude his public comment because it had been 15 minutes and added that he wants him to have his time but there are other people that want to speak. Councilman Dolan inquired as to if he is asking them for a complaint form. Mr. Polyak stated that he is and added that because of the ticket he put in a phone request to talk to the Chief and he also talked with Supervisor Flach and he would like to sit down with the Police Chief in the Supervisor’s Office and discuss it to see if they can resolve it. He continued by saying that he has 90 days to file a complaint and it is going to be another 50H and his attorney’s are say that he should follow through with it all the way to the courts and it is going to be a minimum of $5,000.00 just for the 50H because the competency of this Officer is coming into play, especially if he didn’t remember that he gave him a ticket 2 ½ years ago. Chief Darlington interjected that if Mr. Polyak wanted to file a personnel complaint, Officer Alberts is downstairs waiting for him to fill out the proper paperwork in which it will be investigated. Mr. Polyak asked if he was going to be available in the morning because he has other commitments and then asked if there is a procedure so the public knows. Chief Darlington stated that there is and you would come in and file a complaint and meet with a Sergeant who takes the complaint and added that they have had this discussion at meeting prior to this year, and added that the complaint is filed and investigated. Mr. Polyak stated that he can bring in a copy of the City of Albany’s complaint form, which is approximately 3-4 pages long. Supervisor Flach stated that as the Chief said, they do have something in their department for that. Mr. Polyak stated that because of budget constraints they may have to look at what they should do with the Police Department in the future and added that he is not against the Police Department. He continued by saying that when he was campaigning, he asked who the favorite Officer is and Officer Polverelli topped the list and he did this in trying to be fair with all the complaints about the one and concluded by saying that some of the complaints were a bit on the bazaar side and he is concerned. Supervisor Flach asked if anyone else wished to comment. Ms. Bernice Hopkins stated that they recently bought a house in the Town of Coeymans and she attends the meetings for the Neighborhood Association and added that the Hamlet is a beautiful place but the buildings in it are not doing so well and if they could build up the landing back up to what it should be, the buildings in the Town would be very profitable because it is a beautiful park. She continued by saying that she is in favor of saving the building because it is a beautiful structure and part of the history of the

town and it is a private grant that has been offered and is not a grant though an agency but rather a private person saying that they will help someone save this building. She went on by saying that they are at the point where they are seeing if the building can be saved and the next step is to talk to someone about having someone save the building and she understands that there are a lot of building that need help as well as the whole town needing help and that the Neighborhood Association is looking at doing something and their meetings are the second Wednesday of the month and the more people that can help save the community and landing, the better. She concluded that in going for a walk and looking at what has been done at the landing is pretty amazing and she wanted to say that hopefully they will be seeing each other again and went on by saying that it is not a lost cause and it is a really great history of structure of what happened in this town in the ice business and everything else. Councilman Dolan interjected that Ms. Hopkins has been doing a great job on her house in working to restore a lot of the original historic details. Ms. Hopkins stated that it was nominated for the registry on March 7th and hopefully it will be listed and hopefully they can get a couple more people to go on the registry so a tax incentive can be offered and right now they are not eligible but the more houses that they have, the more they will be able to use it. Councilman Dolan asked that when she gets on it, she should come back and tell them because they would like to hear about it. Supervisor Flach asked if anyone else wished to comment. Ms. Anne Marie Vadney stated that she wanted to let everyone know that the Greater Coeymans Ravena Area Community Business Group’s next meeting is April 12th, which is the second Thursday of each month and is held at 1635 Rte. 9W and starts at 7:00pm. She added that she would also like to request any support from any members of the Town Board that can provide within the community as roll models because she finds a consistent theme in our community of the spreading of rumors that are not factual and she does not understand the motives of the individuals doing it. She continued by saying that she thinks that if people have questions about what is going on, they should be upfront and respectful and go directly to those individuals and request answers and not start rumors. She added that some of the recent newspaper articles have contained false information and it puts our community in a horrible position when they are all trying to work toward improving the community and then there is nonfactual information being seen by thousands of people and then asked how you would then tell them it is not the truth. She went on by saying that members of our community are good people and they have to work harder to respect even those individuals that they don’t agree with and they should be kind to each other and try to seek out the truth and in their positions on the Town Board, she thinks that it makes a big difference if they identify some of these activities going on, wherever they begin and maybe they can stand up and say hold it, lets find out the facts before we do anything else. Supervisor Flach asked if there were any other comments, hearing none he moved to the next item on the agenda.

***************************** APPROVAL OF MINUTES Supervisor Flach stated that there were two sets of minutes for Town Board approval, a Town Board Meeting on March 12, 2012 and a Town Board Workshop on March 20, 2012 and then asked for a motion to approve them. MOTION On motion of Councilwoman Rogers, seconded by Councilman Dolan, the Town Board Minutes were approved and accepted as read. VOTE – AYES 5 – NAYS 0 – SO MOVED

I would like to extend my thanks to Eric and his co-worker from the Coeymans Landing Marina, for their assistance in installing the poles on the docks, which includes new ones that were damaged during the flooding from Hurricane Irene last year. This demonstrates the kind of cooperation between private enterprise and government that can make the community better for all residents. The swings at both Coeymans Landing and Joralemon Park have been installed. The nets are up at the tennis court at Joralemon Park. The banners in Coeymans Hamlet have been switched out from winter flags and the spring/summer flags are hung. All tractors, zero turn mowers, and other equipment are ready for the mowing season in the parks and cemeteries. The Beautification Department built four (4) new picnic tables. (three 6 feet long and one 8 feet long) All existing picnic tables have been refurbished. Additionally, all trash cans have been repaired and re-stained for the season. Parks and Recreation Maintenance Supervisor Perry stated that very shortly he will be working on the gazebo and having it ready. Supervisor Flach asked for a motion to approve the report. MOTION Councilman Dolan stated that he would offer a motion with the addition of substituting Eric’s co-worker with the name of Neil Dolan. MOTION On motion of Councilman Dolan, seconded by Councilwoman Rogers to approve the request from the RCS Wellness Committee to hold an RCS Community Wellness Walk at Joralemon Park on May 6, 2012. VOTE – AYES 5 – NAYS 0 – SO MOVED Supervisor Flach asked if there were any comments about the Wellness Walk. Councilman Boehm stated that it is a new event and they will be walking from Sycamore Golf Course to Joralemon Park and they are looking for community support. He added that they have supporters and Father’s Produce has donated 500 pieces of fruit and DeCrescente Distributing has donated 500 bottles of water. He continued by saying that the reason for it is that it is an effort to get people out to vote for the School Budget and Doug Porter was at the last meeting with more detailed information with the map and concluded by saying that it is a great community event and he is glad that they support it. Ms. Vadney from the audience asked if it is a School Board event. Supervisor Flach stated that it is not a school or town event and that it is just a Wellness Walk for the community. Ms. Vadney asked who is coordinating the event. Supervisor Flach stated that Mr. Doug Porter is and she can call his office for his number if she wishes. Supervisor Flach asked for a motion to approve the Capital Bicycling Racing Club Time Trial and Road Race. Request from Capital Bicycle Racing Club to Hold Coeymans Hollow Time Trial and NY Capital Region Road Race MOTION On motion of Councilman Boehm, seconded by Councilman Dolan, approving the request of the Capital Region Bicycle Racing Club to hold a Coeymans Hollow Time Trial on Wednesday, June 13th as well as approving the request for the NY Capital Region Road Race on Saturday, July 28, 2012. VOTE – AYES 5 – NAYS 0 – SO MOVED Councilman Boehm stated that the NY Capital Region Road Race is an event that has been going on since he was first on the Board and it is a race that goes through a portion of Coeymans Hollow and new this year they are adding a Time Trial that is going to start just outside Star Road on the bridge and they will be timing out to Rte. 32 and back for individual racers on July 13th and added that for the race on July 28th they will be marking the routes. He concluded by saying that they donate money to the Rescue Squad and Coeymans Hollow Fire Company and that it is a great event and he hopes that the community supports it. Councilman Masti reiterated that there will be signs so people will be aware because there are a lot of cyclists. Councilman Boehm stated that on race day you should exercise caution.

Councilman Boehm stated that he wanted to offer a motion to table the hiring of the 6 part-time Police Officers to give the Supervisor and/or Chief of Police and/or Attorney enough time to seek a Memorandum of Agreement on the pay scale that the Chief put forward on March 8th, which lowers the starting pay for new hires for part-time, before they are hired. Supervisor Flach asked if anyone wished to second it, not hearing a second he asked if they wanted to put it to vote. Councilman Boehm interjected that he wants to table it so they can seek a Memorandum of Agreement. Attorney for the Town Wukitsch stated that the Board needs to focus on the fact that there already is a part-time rate in the contract and it is the rate that they will be hired at. Chief Darlington stated that was correct. Attorney for the Town Wukitsch stated that Chief Darlington is talking about proposing a reduced rate, which the Union may or may not agree to. Supervisor Flach interjected that they are going to need the part-time anyway, regardless. Councilman Boehm stated that his point is, why hire and then try to negotiate a pay cut when they can ask the Union up front for a Memorandum of Agreement to lower the pay scale for the new hires, part-time. Attorney for the Town Wukitsch stated that it is going to be difficult to obtain a pay cut once you hire them. Councilman Boehm interjected that this is what he is saying. Attorney for the Town Wukitsch stated that the Board has to decide one way or the other and either there is an urgent need to bring them onboard now, which will result in savings for the Town in the long run and with the understating that the new hires would be subject to the existing Collective Bargaining part-time rate, which they may or may not be able to achieve the reduction in the part-time rate. He continued by saying that you don’t see it that much where a Public Union agrees to a reduction of the rates and added that they may be frozen at a particular rate for a year or so and forgo a raise later in the contract life, but to come up with an actual reduction, in his opinion, would be a long shot. Councilman Boehm stated that it is not for the full-timers but rather the new hired part-timers. Attorney for the Town Wukitsch stated that he knows that. Chief Darlington stated that it would be anyone hired after January 1, 2012 and added that it is the new trend and it is his understanding that the Albany County Sheriff’s Department did this same exact thing and some employees with 2 years actually took a pay cut. Councilman Masti stated that they can negotiate it in the contract and they have to abide by it. Chief Darlington stated that his conversation, preliminary with the Union, is that they are not against it but there is some concern that they have about current employees because they are making more being pulled off the schedule and he has expressed that and people that give him regular schedules is the first thing that is put in and then everyone else is filled in after.

Attorney for the Town Wukitsch stated that the options are, hire them now with the hope that he can attain some kind of reduction but no guarantee or defer the hiring until he can determine for certain whether or not they will agree to the reduced rate. Councilman Boehm stated that he had said that it is a fairly simple process and is just a Memorandum of Understanding with the Union for this specific issue and they are not renegotiating the whole contract. Attorney for the Town Wukitsch stated that the second action would be to defer the hiring now and prepare a Memorandum of Agreement with a reduced pay scale for the part-timers and go to the Union to see if they will agree to it. Councilman Boehm interjected that he thinks it makes the most sense to do it this way. Chief Darlington stated that he has requested that from them and he has not gotten any response other than them saying that they are concerned and added that Council 82 made contact with the office to open up full negotiations with the full contract that had expired in December. He added that he hears bi-weekly about the over-time and an option is to start cutting patrols or they are going to continue to pay overtime, until such time that these people are hired. He continued by saying that each two weeks that it is delayed, is an additional two week delay before they are trained and placed on the road. Councilman Masti inquired as to how much they are looking at every two weeks for overtime. Chief Darlington stated that on average, for shift coverage they are looking at easily somewhere between 3-4 shifts a week and now that spring break is coming and kids are going to be out of school a lot will be going on vacation. Councilman Masti inquired as to if coverage would be out of the part-time force. Chief Darlington stated that it would be out of the full-time and part-time and obviously the bigger the pool you have to draw from, the easier it is to cover. Councilman Masti stated that he was not trying to be pessimistic but during negotiations there is also a possibility that part-time will get a higher rate than what they are being quoted right now. Chief Darlington stated that it is true and they may never agree to this so they can postpone it or ultimately make the hire either way. Supervisor Flach stated that they really do need the part-timers regardless of getting the pay down, just because of the overtime that they are paying, and if they hire them now, how do they tell them that they may be getting a pay decrease. Chief Darlington stated that if they would hire now, they would be notified tomorrow with the understanding, as well as when they were interviewed they were told that their pay is in flux because he had presented a lower pay rate and was open with them and discussed what they are looking at and for a lot of them the amount of pay was not an issue as much as it was with their desire to work. Councilman Boehm stated that another option would be to hire 3 instead of 6 now so they still have some bargaining position with the Union going forward with the other 3. Attorney for the Town Wukitsch stated that it would be another option. Councilman Boehm stated that it seems silly to hire all those people and negotiate a lower pay scale after they are hired. Supervisor Flach stated that he understands that but at the same time, they are definitely going to need these part-timers.

Chief Darlington interjected that his issue is whether they hire them at this rate now; because nothing is going to change in the budget except that they may continue to pay overtime. Attorney for the Town Wukitsch asked if they are guaranteed a set number of hours. Chief Darlington stated that none of them were guaranteed hours except full-time and added that if they were to not hire them, the budget stays the same because he still fills it with the same people that are making the same dollar amount. Councilman Masti stated that if they hire them now, they will be paying less than they would be paying the full-time people in overtime. Chief Darlington stated that was correct and added that if they hire them now, they will not be relying on the full-time people to cover shifts when people call in. Supervisor Flach stated that Councilman Dolan had stated that it gives them a bargaining chip and then asked that he explain it. Councilman Dolan stated that his understanding is that the Union is more interested in the rates for the full-time people than they are the part-time people and if they don’t hire the part-time people, the people that are full-time can continue to benefit from their lack of part-time officers to cover the shifts. Councilman Masti interjected that the full-time people are making more than the part-timers coming in to start with. Supervisor Flach stated that economically they are giving 6 more people employment and keeping within the Chief’s budget. Councilman Dolan stated that whatever way this washes out, he has to keep his budget the same. Supervisor Flach stated that because they have to hire those part-timers, they are going to do the pay negotiations regardless. RES. #55-12 APPOINT PART-TIME POLICE OFFICERS On motion of Councilman Dolan, seconded by Councilman Boehm, the following resolution was APPROVED – VOTE – AYES 4 – NAYS 1 (Boehm) – SO MOVED WHEREAS, the Chief of Police has conducted a search for available part-time Police Officers to supplement the monthly schedule and provide the coverage desired, and WHEREAS, applications have been submitted to Albany County Department of Civil Service to review the candidate’s qualifications, NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Coeymans does hereby appoint Danielle Crosier, Henry Klein, John Laviano, Lisa Giddings-Fumarola, Peter McKenna and Peter Zownir as part-time Police Officers, effective immediately pending a successful background check and Civil Service approval. Such appointment will be compensated at the hourly rate designated in the current Collective Bargaining Agreement. Councilman Boehm stated that he thinks that they should attempt a Memorandum of Agreement with the Union because by hiring these 6 people, they have no negotiating power and it is going to be lost. He added that he knows that they are budgeted positions and he knows that they need the help but they also need the savings that the new pay scale will reflect and this is why he voted no. Supervisor Flach stated that he does not totally disagree with Councilman Boehm because he understands that and added that they have to hire these people anyway and it

stimulates a bit of the economy in putting 6 people to work, even if it is part-time and they are not going outside their budget. Councilman Boehm interjected that he does not see Police Officers as a source of economic development for the Town. Supervisor Flach stated that it is a small thing and maybe his thinking is small but it gives 6 people a job and hopefully they can stimulate the local economy. Councilman Masti stated that he wanted to reiterated that there is no guarantee that they won’t be paying as much if not more and there have already been weeks of overtime where they have lost money. Councilwoman Rogers stated that she does not disagree with Councilman Boehm at all but in speaking with the Chief there have been some nights that patrols have been short and there were a couple issues when there were no Officers and she would like to get these people on board. Councilman Dolan stated that Councilman Boehm has been totally consistent in trying to save as much money whenever possible and to put off whatever they can for as long as they can. He added that he has to disagree with him on this but he respects his position in trying to save every possible dollar that he can. Councilman Dolan excused himself from the meeting as previously planned. RES. #56-12 AUTHORIZE PURCHASE OF ZERO TURN MOWER On motion of Councilman Masti, seconded by Councilwoman Rogers, the following resolution was APPROVED – VOTE – AYES 4 – NAYS 0 – ABSENT 1 (Dolan) – SO MOVED WHEREAS, the Parks and Recreation Supervisor requested funding for a new zero-turn mower in the 2012 Budget, and WHEREAS, the Town Board included funding in the budget for that purpose, and WHEREAS, Parks and Recreation Supervisor Perry has sought quotes under New York State Contract PC64361, and WHEREAS, the Town Board has reviewed the recommendation with quotes and determined that such a purchase is warranted, NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Coeymans hereby authorizes Parks & Recreation Maintenance Supervisor Perry to commence the purchase process for a John Deere 997 Commercial Diesel Max-Frame Zero Turn Mower, from Hudson River Tractor Co., Chatham, NY for the State Contract price of $12,044.24, and BE IT FURTHER RESOLVED, that Mr. Perry prepare a purchase order for review by Supervisor Flach for this purpose. changed the total for all funds. She added that when you change funds, in order to keep the funds straight, you have to do an amendment. Town Clerk Millious asked if the Board wanted an explanation for the amendment. Councilman Boehm replied that he would. Town Clerk Millious stated that for the General Fund, they were included in the Highway Fund but should have been General and in the Part-Town Fund a voucher was pulled because it was a duplicate. ADDITIONAL COMMENTS Supervisor Flach asked if there were any additional comments. Councilman Boehm stated that he thinks that it is unfortunate that they did not pursue the Memorandum of Agreement prior to the hiring of the part-time Officers and added that he believes it would have resulted in a significant savings and concluded by saying that it seems like the tail is wagging the dog sometimes and they need to take a closer look at those things going forward. Supervisor Flach asked if there were any other comments. Town Clerk Millious stated that next Monday, April 2nd is her last day to collect property taxes and they can either be paid in person or has to be postmarked that date and added that there is an outdoor box at the front steps on the west side of the building for anyone that can’t make it during her office hours. Supervisor Flach asked if there were any other comments. Chief Darlington stated that at the end of last week he met with F.E.M.A. for the close-out meeting and there were a total of 18 project worksheets that he signed, which will result in a return of $203,330.39 and they indicated that within the next couple of weeks we should start receiving the blue folders with the PW’s in them and if the work is done, he signs them and send them back and in return they should start receiving checks. Councilman Masti inquired if they are ever going to do anything about clearing out the creek. Chief Darlington stated that they are still waiting for their approval and he actually sent an e-mail to Councilman Dolan asking that he reach out to our State and Federal constituents to see if they can get a response. He continued by saying that they asked for a written explanation as to what has been done and a timeline, which was provided and they asked if they were sure that they would be able to complete by the end of 2013 and he checked with F.X. Brown who said that if they hurry up and make their decision, they can start the planning and it is not unreasonable barring weather issues. He concluded by saying that there still is no answer from FEMA. Councilman Masti asked what would happen if the locals, who own property there, took the trees that are snagged out of the creek. Chief Darlington stated that he would highly recommend that they speak to ENCON before they do anything. He continued by saying he continually hears comments about the Police Department affecting business in the Town and added that they are not in the business of affecting local businesses, however they are in the business of keeping the streets safe and in fact driving while intoxicated will not be tolerated in this town and if people are responsible and get designated drivers, or do not drink and drive, they should not affect their businesses.
