CALL TO ORDER

Eben Alexander, Jr. , M.D., President of the Board of Medical Exatniners of the State ofNorth Carolina, called this meeting to order at 8:30 p.m. , May 4, 1988, at the PinehurstHotel, Pinehurst, North Carolina.

The Board members present at this meeting included: John Thomas Daniel, Jr. , M.D. ,Secretary-Treasurer; Charles Howard Duckett, M.D.; Harold L. Godwin, M.D.; HectorHimel Henry, II, M.D.; Nicholas Emanuel Stratas, M.D.; F.M.Simmons Patterson, Jr., M.D.;and Mrs. Kathryn Howell Willis.

Staff members present included: Bryant D. Paris, Jr. ; Don Pittman; William H. Breeze, Jr.;Robert J. Broyles; L. D. Beaver; and Sibyl Lamoreaux.

DEANS OF NORTH CAROLINA MEDICAL SCHOOLS, MEETING WH'H

On May 6, 1988, members of the Board of Medical Examiners of the State of NorthCarolina met to discuss mutual concerns with the following physicians representing themedical schools in this state:

William Ewart Easterling, Jr. , M.D., University of North Carolina School ofMedicine,

Robert Bruce Kinney, M.D. , Duke University School ofMedicine,

Thomas Francis O' Brien, M.D., East Carolina University School of Medicine,

James Nicholas Thompson, M.D., Bowman Gray School of Medicine.

Members of the Board of Medical Examiners and representatives from the North Carolinamedical schools discussed the following topics:

(1) The Board's requirement that a physician extender wear anidentification tag which contains the words: "physician assistant" or"nurse practitioner", rather than an abbreviation;

(2) The

requirement that prevents physicians engaged inresidency training programs from assuming supervisoryresponsibilities for physician extenders;

(3) The Board's concern that, in Departments of Psychiatry, aPsychiatrist may provide psychoanalysis and/or psychotherapy to aphysician in a Psychiatric training program and may also providebilling with a diagnosis to an insurance company;

(4) The Board's request that a faculty member report to the Dean of aMedical school any physician exhibiting symptoms of impairment;

(5) The Board's concern over a physician practicing in a pain clinicsetting at a medical school who may discharge a patient and provideprescriptions for controlled substances which may result in a localphysician's continuing to provide the patient with controlledsubstances indefinitely;

(6) The Board's authority to issue special limited licenses when, in theopinion of the Board of Medical Examiners, a physician's outstandingcredentials warrant this individual consideration;

(7) Information indicating that the University of North Carolina is in theprocess of establishing an unpaired physicians' program within itsmedical school and coordinate this program with the state PhysiciansHealth and Effectiveness Program;

(8) The Board's request that the Deans emphasize to physicians at theirinstitutions the dangers of leaving prescription pads on desks; and

(9) Information indicating that a pharmaceutical company has beenproviding physicians with unsolicited boxes of prescription padsadvertising the particular company.

The Board requested the name of this pharmaceutical company. The President of the Boardof Medical Examiners expressed the Board's appreciation to the representatives of the NorthCarolina Medical Schools for their scheduling time for, and participating in, this discussionof mutual concerns.

FORMAL AC%ON WORDING

On May 6, 1988, the Board of Medical Examiners unanimously adopted a motion made byDr. Alexander and seconded by Dr. Daniel that the Board include in each Consent Order thestipulation that the individual signing the document agrees that the content of this ConsentOrder is public information.

On May 6, 1988, the Board of Medical Examiners unanimously adopted a motion made byDr. Alexander and seconded by Dr. Daniel that, in the next Board Bulletin, the Board pluaseeach item in specific language from the North Carolina General Statutes.

PERRYMAN, PETER HUBBARD, M.D., Buffalo, New York

On May 7, 1988, the Board of Medical. Examiners unanimously adopted a motion made byDr. Duckett and seconded by Dr. Alexander: that the Board issue Dr. Perryman a datedlicense expiring at the end of one year.

On May 6, 1988, the Board of Medical Examiners unanimously adopted a motion made byDr. Godwin and seconded by Dr. Daniel that the Board extend Dr. Brantley's temporarylicense through July 1, 1989.

On May 7, the Board unaniumously adopted a motion that the Board of Medical Examinersdeny the license request of Dr. Mattos as a visiting professor and that the President of theBoard advise Dr. Bondurant of this decision.

On May 5, 1988, the Board of Medical Examiners unanimously adopted a motion that itdefer action on this matter.

BRESSLER,BERNARD, M.D., Virginia

On May 5, 1988, the Board of Medical Examiners unanimously adopted a motion made byDr. Alexander and seconded by Dr. Daniel that the Board accept as information a reportindicating, effective April 25, 1988, Dr. Bressler has surrendered the medical licensepreviously issued to him by the Board of Medical Examiners of the State of North Carolina.

TRANSCUTANEOUS PACEMAKERS

On May 5, 1988, three sales representatives from firms who manufacture transcutaneouspacemakers demonstrated this equipment to the Board of Medical Examiners.

On May 5, 1988, the Board of Medical Examiners unanimously adopted a motion made byDr. Daniel and seconded by Dr. Duckett that the Board believes it will be necessary toreview more information on the use of transcutaneious pacemakers; that the Board approvesthe concept of a pilot study on utilizing external pacemakers; and the Board will scheduletune at a later meeting to review a written report from the Medical Director of the Office ofEmergency Medical Services in this regard.

PHYSICIANS HEALTH AND EFFECTIVENESS PROGRAM

On March 13, 1988, the Board of Medical Examiners of the Stateof North Carolina discussed this program. The Board membersinstructed its representatives to participate in the development of ajob description for the Medical Director of this Impaired PhysiciansProgram which reflects the reconunendations of the Board ofMedical Examiners, particularly regarding the Board's belief thatthe Medical Director of the Program should be re~suasible fordirectin~ and inonitorLng the unpaired phhsicians and theirre~cove ~ro rams. The Boarti members further stated that theMedical Director of the Impaired Physicians Program shouldfollow-up on the status of individuals referred to this program andshould provide progress reports to the Board of Medical Exatniners.

PHYSICIANS HEALTH AND EFFECI'IVENESS PROGRAM

On May 5, 1988, the Board of. Medical Examiners unanimously adopted a motion made byDr. Stratas and seconded by Dr. Daniel that the Executive Secretary communicate thefollowing information to representatives of the North Carolina Medical Society:

(1) The Board wishes to encourage the establishment of a Physicians Health andEffectiveness Program in North Carolina;

(2) The Board of Medical Examiners understands that the North Carolina MedicalSociety will be the primary source of funding for this Physicians Health andEffectiveness Program;

(3) The Board of Medical Examiners indicates its willingness to serve as a secondarysource of financial support contingent upon:

(a) the Board's monetary resources,

(b) the Board's approval of plans for implementing the PhysiciansHealth and Effectiveness Program in North Carolina,

(c) the Board's approval of the budget for the Physicians Healthand Effectiveness Program,

(d) the Board's approval of the Medical Director for thePhysicians Health and Effectiveness Program, and

(e) the Board's receiving information from the North CarolinaMedical Society identifying the priority which this Programtakes in the Medical Society's current budget and reportingmethods by which other states secure funding for PhysiciansHealth and Effectiveness Programs.

On May 5, 1988, the Board of Medical Examiners unanimously adopted a motion made byDr. Stratas and seconded by Mrs. Willis that the Board increase its registration fee to $70.00.

The Board also instructed the Executive Secretary to prepare for the Board of MedicalExatniners' consideration a projected tluee year budget.

PROPOSED REGULATIONS

On May 7, 1988, the Board of Medical Examiners unanimously adopted a motion made byDr. Duckett and seconded by Dr. Stratas that the Board adopt the proposed regulationsentitled "Impaired Physicians" and "Reinstatement of Suspended License. "

PHYSICIAN EXTENDER QUESTION REGARDING VERBAL ORDERS

On May 7, 1988, the Board of Medical Examiners unanimously adopted a motion made byDr. Duckett and seconded by Dr. Patterson that a physician must originate all controlledsubstance orders. A physician extender, either a nurse practitioner or a physician assistant,may, upon receiving an order for a controlled substance from a supervising physician,simultaneously transmit this physician's verbal order to a nurse. A physician extender maywrite an order for a controlled substance provided that a supervising physician is also at thesite to sign this order immediately. A physician extender may not independently order,either by writing or phoning, a controlled substance. A physician who supervises theextender must directly originate the order for a controlled substance.

NURSES —DAY CARE CENTER

On May 7, 1988, the Board of Medical Examiners unanimously adopted a motion made byDr. Duckett and seconded by Dr. Alexander that the Board notify Thad B. Webster that hisconcerns regarding the activities of public health nurses have been resolved.

The Executive Secretary reported to theBoard of Medical Examiners that Dr. Mischinski indicated his willingness to relinquish thelicensure approval issued to hiin in March, 1988.
