Agenda Items No. 1 Confirmation of the minutes 157th
meeting of Executive Committeeheld on 28.05.2010 .
It was noted that 157th meeting of Executive Committee was held on28.05.2010 at New Delhi. The minutes of the same have been circulatedto all the member vide letter No. 5-1/2010 (157th) dated 14.06.2010 forperusal. Simultaneously the members were requested to suggest theaddition/deletion if any within 10 days from the date of issue of thesame. No comments were received.
It was also noted that while confirming the minutes, Vice-President(Unani), Prof. Hakim Syed Khaleefathullah raised the point that name ofthe members of Sub Committee constituted to assess the work load ofteaching staff of the college have not been mentioned in the minutes.
Executive Committee agreed to the same.

Agenda Items No.2 Ratification of the action taken byPresident, CCIM.
(i) Regarding Amrit Vishwavidyapeetham Coimbatore
It was noted that the request of Amrit Vishwavidyapeetham, Coimbatorewas forwarded by Government of India vide letter No.V.27016/1/2010-Ay. Desk dated 11.5.2010 for inclusion/recognition of Ayurvedacharya(BAMS) Qualification awarded by Amrita Vishwa Vidhyapeetham inSecond Schedule to IMCC Act 1970 for necessary action at the end ofCCIM as required under section 14(2) of IMCC Act 1970. Afterexamination of the proposal following observation were made.
1. Amrita School of Ayurved Amritapuri, Kollam is a part of thisUniversity.
2. University is following the syllabus, Curriculum and nomenclatureof the degree in toto as prescribed by CCIM.
Office Remarks After receipt of the proposal from Government of Indiaas required under Section 14 (2) of IMCC Act, 1970 and observing thatUniversity is fulfilling the requirement of the Act, and Regulations,President, CCIM agreed to send the recommendations to the Governmentof India for inclusion in Second Schedule to IMCC Act, 1970.Accordingly, recommendations were sent to the Government of Indiavide letter No.4-102/2010-Uni dated 15.6.2010.
Executive Committee ratified the same.
(i) Enhancement of the tenure of Ayurveda Experts
It was noted that following three Ayurveda Experts have joined office asper details given below for three months at first instance.
1. Dr. Kamini Kaushal2. Dr. Seema Ahlawat3. Dr. Aarti Mal
Accordingly tenure of Dr. Kamini Kaushal and Dr. Aarti Mal, AyurvedaExpert has over on 28.6.2010 & 07.7.2010 respectively, therefore,period of Dr. Kaminimi Kaushal and Dr. Aarti Mal, Ayurved Experts hasbeen extended for 11 months subject to satisfactory services after givingone day gap as under:-

Further, Dr. Seema Ahlawat Saroha has resigned from her duties on09.6.2010.
It was proposed that an Ayurved Expert appointed for smooth functioningof the office of CCIM, therefore, advertisement may be issued.
Executive Committee ratified the same and further decided toengage one Unani Expert and two Ayurveda Experts for smoothfunctioning of the office of CCIM.
Agenda Items No.3 Notification of amendment sanction Act, byGovt. of India under Section 36 of IMCC act.1970.
It was noted that detail programme of internship was not underconcerned Regulation 1989. Moreover, it was also felt that subject ofPanchkarma was also not in the Regulations, therefore, it was decided toamend the Regulations, therefore the proposal were passed by CCIM andwere sent to State Government for their comment as required underSection 22 of IMCC Act, 1970. Thereafter, the same were sent to Govt.of India for sanction as required under Section 36 of IMCC Act, 1970.The Government of India has conveyed the sanction for the same.
Executive Committee approved the draft notification for issuingNotification in the Gazette of India.
Agenda Items No.4 Consideration of visitation Report ofthe College to furnish therecommendation to Government ofIndia for Letter of Permission.
It was noted that in pursuance of decision of the Executive Committee atits meeting held on 28.5.2010 the following colleges have been visited tofurnish the recommendation to Government of India for issuing LOP inresponse of Letter of Intent issued by Government of India. VisitationReport was placed before the committee, after considering the visitationreport and relevant papers decided as under mentioned against thecollege:-

Agenda Item No.6 Consideration of visitation Report of theCollege.
It was noted that visitation of Mannam Ayurved College, Pandalam couldnot be conducted because while Govt. of India vide letterNo.R.12011/29/2005-EP dated 30.12.2009 granting the permission forthe session 2009-10 had asked the college to fulfill the shortcomings by15 March /31 March, 2010. It is also submitted that visitation ofMayurbhaj Ayurved College, Baripada was also conducted becausecollege asked time of six months to fulfill the shortcomings pointed outby Government of India as recommendations has to be sent toGovernment of India, therefore, visitation was conducted and afterconsidering the visitation reports decided as under:-

Agenda Item No.7. Approval of Annual Report and AuditedAccounts for the year 2009-10.
It was noted that the Annual Report and Annual Audited Accounts of theCentral Council of Indian Medicine for the year 2009-10 after printing areto be sent to the Ministry of Health and Family Welfare Dept. of AYUSHNew Delhi to be laid down on the table of both the Houses of Parliamentbe fore 30th November as usual.
It was noted that due to shortage of time the Annual Report and AuditedAccounts for the year 2009-10 could not be prepared, therefore,Executive Committee authorized Dr. Jayaprakash Narayan, Vice-President (Ayurveda) and Prof. Hakim Syed Khaleefathullah,Vice-President (Unani) to finalized the same.
Agenda Item No.8. Approval of Annual accounts for theyear 2009-10 under Non-Plan and Plan-regarding.
It was noted that Annual Account for the year 2009-10 (Plan and underPlan) are to be submitted to DGACR by 30th June to conduct the audit ofthe same in due course of time as per provisions of the GeneralRegulations of sub clause 1 of clause 86 .
Executive Committee approved the Annual Account for the year2009-10 to send DGCAR. It was also pointed out that receipt offee from the colleges be bifurcated in respect of Ayurveda, Unaniand Siddha colleges separately.

Agenda Item No.9 Reporting of decision on the proposal forstarting PG course/increasing intakecapacity in UG & PG Courses.
It was noted that in pursuance of decision of Executive Committee of themeeting held on 28.5.2010 the proposal for which LOI were issued by theGovernment of India received under Section 13 A of IMCC Act, 1970 inthe year 2009-10 for 2010-11 for starting PG course/increasing intakecapacity in UG/PG Course were examined by the Screening Committeeand recommendations has been sent to the Government of India in viewof the decided policy as follows:-

Agenda Item No.11 Declaration of Resolution/notificationPassed/issued by CCIM regardingpractice of Modern Medicine by ISMpractitioners.-as ultra virus.
It was noted that Civil Writ Petition No. 10033/2005 was filed by NationalIntegrated Medical Association before High Court of Kerala atEranakulum. The petitioners were holding ISM qualification and were also

practicing Modern Medicine on the basis of CCIM notification issued fromtime to time (especially notification dated 19.05.2004 and 30.10.1996)and wanted protection of the Court. The Court vide judgment dated7.02.2006 dismissed the above petition and observed that CentralCouncil cannot issue notifications enabling ISM practitioners to practiceModern Medicine. If the practitioners are having enrolment on StateMedical Council of Modern Medicine under the Indian Medical Council Act,1956, only then they are entitled to practice modern medicine.Therefore, National Integrated Medical Association filed and LPA againstabove judgment vide W A No. 1260/2006 which has also been dismissedby stating that Medical Advances mentioned in Section 2 (e) of the IMCCAct, 1970 can not be interpreted to means Allopath Medicine.
The SLP was filed by the Central Council of Indian Medicine in Hon’bleSupreme Court of India. The Supreme Court of India has dismissed thesame.
As opinion of the Retainer was obtained regarding the legality ofnotification issued by CCIM opined as under:-
“1. I have pursued the case file Ld Single Judge, Division Bench of HighCourt, Sr. Adv. PP Rao of Supreme Court and the Supreme Court itself,are all in agreement on this issue i.e. ISM practitioners can not bepermitted to practice ‘modern scientific medicine’, which is an altogetherseparate system of medicine and regulated by altogether differentenactment.
2. As per law recently settled by the Apex Court, once any provisionhas been declared ultra virus by any High Court, it is not onlyapplicable in that State, but to the whole country. As such, ourNotification dated 19.5.2004 stands quashed.
3. An analysis of the said Notification dated 19.5.2004 also revealstwo glaring details;
a) Firstly, it empowers ISM practitioners to practice “modern scientificmedicine”, which is untenable.
b) Secondly, emphasis has been made on “modern advances”, whichgives impression of advances made in modern medicine, i.e.allopathic system of medicine.
4. Since CCIM is duty bound to incorporate newer improvements inthe field of medicine, an accordingly improve our curriculum etc.,there may be a case to move away from the word “modern” and toissue a fresh notification incorporating “technological advances ofrelevance” in the field of Indian Medicine, that gets support fromthe ‘Mukhtiar Chand’ Judgment.

5. This issue needs to be deliberated by the Ex-Council/CCIM before afinal decision is arrived at.”
As per legal opinion on the notification 2004 issued by CCIM regardingpractice of modern medicine is referred above the notification andother letters issued in this respect by the CCIM does not sustained inLaw.
Executive Committee decided to withdraw the notification alsodecided to obtain the legal opinion from Advocate of SupremeCourt and call him for discussion in the ensuing meeting ofExecutive Committee.
Agenda Item No.12 Reporting of the decision in respect ofrecommendations of CCIM furnish tothe Government of India under Section13 A of IMCC Act, 1970.
It was noted that recommendations in respect of following colleges weresent to the Government of India as required under Section 13 A of IMCCAct, 1970. It was noted that the Shri Lal Babu Mahto, UDC after rendering theservices of 37-1/2 years in this council is going to retire on 30.06.2010on superannuation.
As preparation and maintenance of Central Register of Indian Medicine isone important work of the CCIM and office is facing the acute shortagestaff since long, therefore, services of Shri Lal Babu Mahto may beobtained after the retirement. President, CCIM agreed to it.
Executive Committee ratified the action taken of President, CCIMand decided to pay Rs.12,000/- per month as consolidated salary.

Executive Committee decided to conduct the visitation of ZVM UnaniMedical College, Pune by Dr. Bashir Ahmed, Member, Unani Committeeand Dr. Shamshad Bano, Unani Expert for verification of the figure of IPDrecord in respect of number of OPD, Number of bed days occupied andnumber of patients admitted in the hospital specifically.
It was noted that Dr. Rashidullah Khan pointed out that the workdistribution of the employees of CCIM were not equal. In view of thesame, Executive Committee authorized Dr. Rashidullah Khan toassess the work of the employees of CCIM weekly for two monthsand reported to the President, CCIM.
