1.0 APOLOGIES There were no apologies. 2.0 MESSAGES OF SYMPATHY

PASSING OF DOROTHY JOAN LARSEN 15/12/1937 – 29/05/2010 Cr Sellers referred to the passing of Dorothy Joan Larsen. She delivered the following message.

“Dorothy Joan Delbridge was born on the 15th December 1937, second child and daughter of Bertie and Emma Delbridge in Harvey, Western Australia. As a child Dot was involved in many pastimes including choir, piano, marching girls and possibly her greatest passion, netball. Dot went to school at Harvey Primary and High School and was considered to be an average student. After school finished she began work at Cook’s Cafe and Bakery in Harvey and commenced working for some bookies in WA which was a sign of things to come when she moved to Queensland. She had a great love of dancing but rarely did she take much serious interest in boys. However this was all to change in the early 1960’s when she met a Danish immigrant dairy technician at one of these dances. Time went on and eventually Dot and Laurits (Les to all who now know him) were married in a ceremony in Harvey on October 3 1964.

Les obtained a job offer in Gladstone at the PCD Factory and in late 1969 they moved to Queensland. Dot became heavily involved in work at the TAB and Gladstone Netball Association. Netball in Gladstone flourished under her guidance and the courts/clubhouse were part of the improved facilities that she helped establish. She was awarded Life Membership and continued to play and coach for many years. Dot had to give up her great love of playing netball in the late 1980’s when she was diagnosed with skin cancer and had major surgery on her mouth. However she continued to umpire netball both indoor and outdoor for many years. Dot became involved in a number of other sports such as squash and ten pin bowling and she was still participating in bowling earlier this year until illness prevented her from continuing.

Dot was involved in many organisations: Friends of the Theatre volunteers, “Be Pampered” ladies group, Sothertons Fashion Awards and The Leukaemia Foundation were all part of Dot’s volunteering passions and she helped a number of fund raising ventures such as Walk for Life and Relay for Life. These charities had assisted her during her battles with lymphoma and cancer and she wanted to give them something back in return.

Dot was always late. It did not matter what it was – sporting events, dinner, christenings – she would always be late. In fact when she was diagnosed with the blood illness last April 2009 she was given 2 months’ to live. Well she was even late for that.

Dot is survived by her husband Les, sons Shaun and Gary, daughter-in-law Judy and grandsons Cory and Luke.

Rest in peace Dot.” Cr Cameron joined the meeting while Cr Sellers was delivering the message (at 9.03am).

4.0 OFFICER REPORTS 4.1 DIRECTOR COMMUNITY SERVICES

4.1.1 PROPOSED TRANSFER OF RESERVE 503 (WEST OF POLICE CREEK) – GLADSTONE GOORIE CENTRE INDIGENOUS CORPORATION LTD

10/189 It was moved by Cr Chapman, seconded by Cr Butler,

“That the Department of Environment and Resource Management be advised that Council would be prepared to relinquish Trusteeship of Reserve 503 (Lot 1 on SP225788) to enable the property to be transferred to Gladstone Goorie Centre Indigenous Corporation Ltd on the condition that suitable road reserve is dedicated along the existing Esplanade on the western-side of Police Creek to enable future construction of a link road from the redirected Callemondah Drive to Blain Park sports fields.”

Carried 4.1.2 EXPRESSIONS OF INTEREST – AGED ACCOMMODATION Cr Burnett advised that he is a member of the Gladstone Central

Committee on the Ageing and queried if that constituted declaring a material personal interest. The Chief Executive Office assured him it was not necessary to make a declaration on this occasion.

1. Council concludes that it is in the community interest to offer Council-controlled land for the purposes of having further aged accommodation developed in Gladstone Region.

2. Accordingly, the Chief Executive Officer be authorised to invite

expressions of interest from not-for-profit providers of aged accommodation facilities/services for use of the following sites:

a. Tannum Sands Precinct

i. Tannum Sands Road (Lot 500 on SP215266, Parish of Iveragh)

ii. Coronation Drive (Lot 900 on SP152499, Parish of Iveragh)

b. Gladstone i. Philip Street, Gladstone (Lot 7 on RP618441, Parish of

Clinton) as part of a broader development on this site. ii. Park Street/Palm Drive (Reserve 745 for Health/Aged

Care – Lot 1 on CP867607) c. Calliope RSL Hall site (32 Stirrat Street, Reserve for Soldiers

Memorial Hall, Lot 104 on C1665Crown land) 3. The draft Expression of Interest brief and associated material be

endorsed, with the Chief Executive Officer authorised to conclude before public advertising.

4. Gladstone Retirement Village Committee be invited to participate in the

assessment of proposals.” Carried

4.1.3 OCCUPANCY ARRANGEMENTS – AGNES WATER MEDICAL CENTRE 10/191 It was moved by Cr Burnett, seconded by Cr Hansen,

That: 1. Subject to receipt of final positive examination results and registration

processes for the nominated general practitioner, Psychup Pty Ltd be offered a licence to occupy Agnes Water Medical Centre and the Chief Executive Officer be authorised to conclude negotiations and execute the necessary documentation.

2. In the event that the required examination results are not achieved and

registration not effected in a timely manner, the Chief Executive Officer be authorised to conclude negotiations with other parties to achieve suitable tenancy of the premises.

“That in accordance with Section 484 & 485 of the Local Government Act 1993, and section 486(1)(e)4 Division 1 Section 17(1)(2) & 19(a) of the Local Government Finance Standard 2005, Council enter into a pre-qualified supplier contractual agreements with Harbour City Panel Repairs, Lowry's Panel Repairs, Mikes Paint and Panel Repairs and The Touch Up Guys for the supply of Panel Beating and Associated Repairs for the Gladstone Regional Council in accordance with tender No SOA 78/10.”

Carried 4.3 DIRECTOR GOVERNANCE 4.3.1 PROPOSED ACQUISITION OF LOT 1 RP 611353 AND ANCILLARY

MATTERS Cr Burnett declared a material personal interest as his mother is an

adjoining property owner. He left the room during discussion. 10/193 It was moved by Cr Chapman, seconded by Cr Butler,

“That Council authorise the Chief Executive Officer to complete negotiations with the owners of Lot 1 on RP 611353 upon terms he considers satisfactory and execute all relevant documents relating to: 1. the acquisition of Lot 1 on RP611353; and 2. other ancillary matters raised by solicitors acting for the land owners in

their letter to Council’s solicitor Tony Goodwin & Company dated 30/4/2010.”

Carried Cr Burnett returned to the room at this stage. 4.4 DIRECTOR FINANCE 4.4.1 GLADSTONE REGIONAL COUNCIL REVENUE POLICY 10/194 It was moved by Cr Brushe, seconded by Cr Hansen,

“That Council adopt the Revenue Policy contained in Addendum 2 to the minutes.”

(a) IQ Mail Solutions is awarded the contract for an initial period of two (2) years with two further twelve month optional periods for the Printing and Distribution of all Council notices; and,

(b) the Chief Executive Officer be authorised to execute the contract

between the Gladstone Regional Council and IQ Mail Solutions.

Carried 4.4.3 MONTHLY OPERATING STATEMENTS YTD TO 31 MAY 2010 10/196 It was moved by Cr Paton, seconded by Cr Sellers,

“That the information contained in the report be noted and the statements contained in Addendum 3 to the minutes be adopted.”

Carried 4.5 DIRECTOR ENVIRONMENT AND REGULATION 4.5.1 PROVISION OF CONSULTANCY SERVICES RFQ108/10 – EXPANSION OF

BENARABY LANDFILL 10/197 It was moved by Cr Burnett, seconded by Cr Chapman,

“That: 1. Council accept the quotation submitted by RPS Group for sum of

$143,445.48 ex GST, which is for the provision of Environmental, Water and Waste Management Services in accordance with Council’s Request for Quotation Specification - RFQ 108/10; and,

2. An allowance of a further $40,000 be approved as part of

this consultancy to allow a hydro geological survey to be undertaken over the adjacent Lot 1 RP 902548 which is also being set aside as future landfill area and will complement this study.

4.5.2 ROCKHAMPTON REGIONAL COUNCIL – REQUEST FOR EMERGENCY USE OF BENARABY LANDFILL

10/198 It was moved by Cr Sellers, seconded by Cr Cameron,

“That Rockhampton Regional Council is advised that; 1. Gladstone Regional Council considers that the Benaraby Landfill could

accept their waste in the event that a new Rockhampton Regional Council waste disposal facility is not available for use by 2014.

2. Gladstone Regional Council is currently seeking approvals to increase

the Benaraby Landfill footprint and associated volume conditions and will keep Rockhampton Regional Council informed of outcomes.

3. Gladstone Regional Council would require Rockhampton Regional

Council to submit a formal letter of intent or Memorandum of Understanding (MOU) for approval, 24 months prior to commencement of such usage with detailed supporting information on the proposal to ensure all development requirements can be appropriately managed.

4.5.3 WAIVER OF APPLICATION FEES FOR DEEMED ERA SITES 10/199 It was moved by Cr Brushe, seconded by Cr Sellers, “That

1. Council waive the application for a development permit for an ERA fee for the sites that are currently ‘Deemed ERA’s’ in this instance only.

2. Council waive the Transitional Environmental Program application fee

for the ‘Deemed ERA’ sites that propose to submit a program to achieve compliance with the conditions of a development approval for their ERA once obtained.”

Carried 4.6 DIRECTOR INFRASTRUCTURE SERVICES 4.6.1 PROPOSED PERMANENT ROAD CLOSURE OF BYELLEE ROAD 10/200 It was moved by Cr Sellers, seconded by Cr Burnett,

“That Council object to the permanent closure of Byellee Road as proposed, as access to properties beyond the proposed closure point needs to be retained.”

He left the room during discussion.

“That Council (i) Approve the erection of appropriate directional signs on the corners of

Oaka Lane and Bramston Street, as well as Goondoon and Clive Dahl Place; Bramston Streets.

(ii) Council install a “Shared Zone – 10k/hr” speed signage in Clive Dahl

Place. (iii) The Gladstone Central Committee on the Ageing be advised

accordingly.” Carried

4.7.6 COORDINATOR GENERAL’S EVALUATION REPORT FOR GLNG PROJECT EIS

Council commended the approach taken by the Coordinator-General in

relation to the report with only a small criticism relating to the proposal to allow Class C effluent to be discharged into the harbour. It was noted that the Coordinator-General is working with Council to resolve the issue.

6.1 GLADSTONE MUSICAL SOCIETY AND QCWA (GLADSTONE BRANCH) PROPERTIES - OAKA LANE, GLADSTONE Cr Hansen referred to issues the Gladstone Musical Society and QCWA

(Gladstone Branch) are having with Queensland Rail over the lease areas of their Oaka Lane halls. He said it was very concerning to the groups who have occupied their premises over many years. The Member for Gladstone, Liz Cunningham MP, is providing support to the organisations.

6.2 GLADSTONE AIRPORT Cr Cameron protested strongly at the treatment of the Gladstone region in the

Queensland State Budget. He made particular reference to allocations for Toowoomba, Bundaberg and Whitsunday regions but he said there was no mention of the Gladstone Airport. The Gladstone Region was a major contributor to the State economy and once again it has been ignored. He said unfortunately it was not the time to do this to the region as it was on the cusp of another surge of major industry.

6.3 COUNCIL COMMITMENT TO FORMER MIRIAM VALE SHIRE AREA Cr Cameron referred to the considerable effort committed by Council staff to

issues relative to the former Miriam Vale Shire area. He referred to time spent in regard to the Agnes Water Medical Centre issue and that spent on other major projects in the area. He said there was a disproportionate amount of time spent on a relatively small percentage of the region's population and he hoped residents were aware of the commitment. He said Council was well and truly looking after that section of the region.

6.4 10 YEAR ANNIVERSARY OF DEATH OF REG TANNA (FORMER

GENERAL MANAGER GLADSTONE PORT AUTHORITY) Cr Sellers advised that the 10th anniversary of Reg Tanna's death had been

recognised at last Saturday night's mass at the Star of the Sea Church. 6.5 RED SHIELD APPEAL Cr Butler said he had been asked by the Red Shield Appeal Committee to

convey its appreciation to Councillors for their support of the business launch on 11 May and door knock on 30 May, 2010.

6.6 2010 MOUNT LARCOM SHOW Cr Butler advised that the Mount Larcom Show will be held on 26 and 27 June

and encouraged Councillors to attend. 6.7 BOYNE TANNUM HOOKUP 2010 Cr Brushe praised the efforts of the volunteer organisers of the "HookUp". She

said it was a wonderful event, having significant impact on local business.

The conference was very informative and speakers covered issues that are before local governments now and into the future. 2.0 Cr Gail Sellers

2.1 Astsyakka –Many hands make arts work The first of the Regional Swapmeets 2010 was held in Gladstone on

29th and 30th of May. I opened the Forum on Saturday morning and there were thirty people attending. Eight representatives were present from Queensland Arts Council and the remainder were from Gladstone, Rockhampton, Maryborough and Biloela. It was great to see this regional exchange of ideas and resources which will help to drive the arts and cultural projects for the region over the next year.

2.2 Gladstone and District Sports Foundation Trust Race Day Event The Race Day fundraiser was held on 29th May and was a great

success. Over one hundred women attended the function and $4500 was raised for the Gladstone and District Sports Foundation Trust. This will now bring the balance of the Investment Account to $170 000. The aim of the committee is to reach $200 000 which could make the fund self-sustaining.

2.3 Harmony Day

A small Fashion Parade was held at the Gladstone Regional Art Gallery and Museum on Sunday 30th May. It featured children from many nations dressed in their National Costumes. It was a lovely afternoon and recognised Harmony Day and supported the theme “Live and work together in harmony, to make a greater future for our children”. Liz Cunningham, Member for Gladstone, Councillors Hansen and Sellers were present for the parade.

2.4 Netherlands – Winterswijk

Through my website I received a request from the Mayor of Winterswijk, Thijs van Beem. His son Mathijs and his girlfriend Corine were in Australia and would be in our area in June and could he send a package. The children spend the weekend with us and thoroughly enjoyed the area, BAM and EcoFest. They were also delighted to meet the Mayor George Creed and Leonie at Tondoon Botanic Gardens on Sunday. www.winterswijk.nl

2.5 Youth with A Mission (YWAM) Reef to Outback The YWAM Australia and PNG ship Tour arrived in Gladstone on June

8th. YWAM has operated ships in the Pacific nations since 1991. During that time they have called at 160 ports in 16 nations and have provided over $37 million worth of free services to over 200 000 people. On Wednesday 9th June, a small civic reception was held for the group. During the afternoon tea, a presentation of mosquito nets and the collection of eyeglasses were presented to Captain Jeremy Schierer by Councillors Hansen, Chapman and Sellers.

2.6 Toolooa State High School – Low Carbon Diet

Toolooa State High School is encouraging the Gladstone community to become involved in reducing their carbon footprint. On Wednesday 9th June, I attended a Community Meeting at the school. The community has been challenged to become the “Biggest Reducer” during the Low Carbon Diet. There will be families, schools and community groups involved in this competition. Results will be announced on Friday 30th July.

2.7 Shell Questacon Science Circus

On Thursday 10th June, The Shell Questacon Science Circus was opened at the PCYC Gladstone. This has been operating for 25 years and is an outreach science education programme, which operates through the National Science & Technology Centre in Canberra and the Australian National University. It operated in regional, rural and remote parts of Australia delivering science shows to primary schools, plus teacher development workshops, and also engages the broader community via public exhibitions.

3.0 Cr Maxine Brushe 3.1 CQ – A New Millennium (CQ Regional Planning Committee)

I recently attended the CQ ANM meeting in Rockhampton. Stirling

Hinchcliffe, Minister for Insfrastructure and Planning chaired the meeting. Gary White, Deputy Director-General, Planning was also in attendance.

Matters discussed included: 1. Central Qld Regional Plan – Implementation activities and

changes due to the Sustainable Planning Act 2009 (SPA); 2. Land Use constraints; 3. Compact urban form; 4. Rural living; and 5. Approvals overriding the planning scheme

Gary White spoke on need for Local Governments to get Community Plans done that identify key partners, key relationships and key sequencing. These will then populate and contextualise into the Regional Plan 2011 will see the Queensland Infrastructure Plan and Roads Implementation Plan which will be tied to population and economic needs identified in the Growth Management Plan.

Meeting was advised that the CQ Regional Plan will take in the whole of

the Gladstone Regional Council area, including all of the previous Miriam Vale Shire. DIP officers also confirmed that the previous Miriam Vale Shire area will follow the key planning principles and key themes similar to the rest of the Gladstone Region in the CQ Regional Plan, and not those of the Wide Bay Burnett Regional Plan.

With regards to Rural Living, a great deal was made of the large

number of Rural Lifestyle (2000) and Rural Residential (2500) lots in the Gladstone Regional Council area, with half of them being in the southern area of the Region. The following points were made by DIP: Unlikely to support further rural residential lots in planning

schemes; Will support amalgamation of lots; Incorporate clusters of highly fragmented rural land (RLL) into rural

residential zone in new planning scheme. Compact Urban Form Minister spoke highly of current ULDA project in Gladstone and their Residential 30 Guideline. Also indicated that the department would be working on communication strategies to inform communities about different compact urban forms. I raised the matter of the need to release State land in Tannum Sands to allow residential development. Gary White undertook to investigate this matter further with DERM. Recommendation: Given confirmation by the Department of Infrastructure that the entire Gladstone Regional Council area will be included in the Central Queensland Regional Plan, Gladstone Regional Council’s observer status with Wide Bay Burnett Regional Planning Committee be cancelled.

POLICY DETAIL: The purpose of this revenue policy is to set out the principles used by Council in 2010/2011 for:

The making of rates and charges; The levying of rates; The recovery of rates and charges; Concessions for rates and charges.

[A] Principles used for the making of rates and charges In general, Council will be guided by the principle of user pays in the making of rates and charges so as to treat all ratepayers in an equitable manner and to minimise the impact of rating on the efficiency of the local economy.

Council will also have regard to the principles of: Transparency in the making of rates and charges; Establishment of rating categories to recognise the different demands placed on Council

resources especially the road network; Having in place a rating regime that is simple and inexpensive to administer; and Equity by taking account of the different levels of capacity to pay within the community.

[B] Principles used for the levying of rates In levying rates Council may apply the principles of:

Utilisation of various smoothing mechanisms available to Council under the Local

Government Act to mitigate significant fluctuations in property valuations; Utilisation of discounts to encourage the prompt payment of rates; Making the levying system simple and inexpensive to administer; and Equity through flexible payment arrangements for ratepayers with a lower capacity to pay.

[C] Principles used for the recovery of unpaid rates and charges Council will exercise its rate recovery powers in order to reduce the overall rate burden on ratepayers. It will be guided by the principles of:

Transparency by making clear the obligations of ratepayers and the processes used by

Council in assisting them meet their financial obligations; Making the processes used to recover outstanding rates and charges clear, simple to

administer and cost effective; Capacity to pay in determining appropriate arrangements for different sectors of the

community; Equity by having regard to providing the same treatment for ratepayers with similar

circumstances; Flexibility by responding where necessary to changes in the local economy; Ratepayers are expected to pay all rates and charges by the due date; and Council will

consider legal action if rates remain outstanding. [D] Concessions for rates and charges In considering the application of concessions under Part 10 ‘Rates concessions’ of the Local Government (Finance, Plans and Reporting) Regulation 2009, Council will be guided by the principles of:

Encouraging pensioners to be independent and live in their own home where possible which Council believes has a "quality of life" benefit, and

Acknowledging the role of community and sporting organisations by providing financial assistance to those non-profits organisations that would otherwise have difficulty in paying their general rates without such concession; and

Transparency by making clear the requirements necessary to receive such concessions.

4. Payment of an infrastructure charge for sewerage headworks. Based on

current policy this charge amounts to $ 6,277.50 per additional unit, assessed in accordance with Council’s Transitional Planning Scheme Policy No 4 - Water Supply and Sewerage Infrastructure Headworks. This contribution is to be paid prior to Building Works approval and at the rate applicable at the time of payment.

5. Payment of a parkland contribution in accordance with Council’s Local

Planning Policy Number 2. Based on current charges this contribution amounts to $1,841 per additional unit and is to be paid prior to Building Works approval and at the rate applicable at the time of payment.

6. Payment of a Major Road Infrastructure Contribution in accordance with

Council’s Transport Infrastructure Policy. Based on current charges the contribution amounts to $3,778 per additional unit and is to be paid prior to the commencement of the use and at the rate applicable at the time of payment.

7. The applicant is required to obtain a Development Permit for Building and

Plumbing Works in accordance with the Sustainable Planning Act 2009. Construction is to comply with the Building Act 1975, the Building Code of Australia and the requirements of other relevant authorities.

8. Building Works application shall detail the proposed location of water tanks as

required by Part 25 of the Queensland Development Code.

9. Provision of a minimum of 4 car parking spaces on site including 2 covered spaces. Car parking spaces and driveways shall be sealed, drained and line marked in accordance with Part 14, Schedule 2, Division 4 of the Planning Scheme and AS2890.1. 17.

10. The proposed access driveways are to be constructed in accordance with

Council’s Standard Drawing RT-0055. (This will require an application to Council’s Infrastructure Services along with the appropriate fee).

11. New water connections necessitated by the development are the responsibility of the applicant. Water connection applications are to be made to Council for a quotation for the necessary works.

12. Individual water meters (sub-metering) shall be provided for each unit in

accordance with the Water and Other Legislation Amendment Act 2007.

13. Any strata titling of the development will require certification from a Hydraulic Engineer that the metering of water for the development complies with the Water and Other Legislation Amendment Act 2007.

14. All roof water and paved areas within the development site is to be collected,

treated and discharged into the existing drainage system in accordance with

Stormwater drainage is to be designed for paved areas to cater for an ARI 10 year event, roof areas an ARI 100 year event and surcharge/overland flows an ARI 100 year event, without affecting adjoining allotments.

15. Prior to the issuing of a Development Permit for Building Works, the applicant

is required to submit to Council details demonstrating how the roof water and paved areas within the development will be discharged into the existing drainage system. This water is not to be directed or onto any adjoining allotments, nor are they to be affected by water runoff or pooling.

16. Prior to the issuing of a Development Permit for Building Works, the applicant

is to provide a report prepared by a RPEQ engineer demonstrating how the development will not adversely impact upon any neighbouring properties in terms of stormwater runoff from the site.

17. Any filling carried out on site is to be in accordance with AS3798-1996 and

shall be certified by a suitable qualified person as being carried out in accordance with the standards and specification. The certification shall indicate level of testing responsibility that has been used i.e. Level 1 or Level 2.

18. All works to be designed and constructed in accordance with the following:

GCC Road and Transport Design Standard 2005 GCC Stormwater Design Standard GCC Water Reticulation Standard 2003 GCC Sewerage Design Standard 2005 Gladstone Storm Water Management Strategy – Drainage Management

20. Landscaping is to be carried out in accordance with the submitted plan KAP

205 dated 25 March 2010 prepared by PH Build Pty Ltd. This is to include the nominated planting along the Parsloe Street frontage and the deep planting at the rear boundary. All landscaping is to be maintained to an appropriate standard at all times.

21. Further to the landscaping requirements outlined in Condition 20 above, the

applicant is to submit plans to Council prior to application for Building Works demonstrating access to the rear of the allotment to ensure the landscaping is maintained at all times.

22. The footpath areas to the Parsloe Street frontage are to be top dressed and turfed on completion of building works.

23. Appropriate erosion and sediment control measures are to be utilised during

any operational or building works carried out in association with the development.

24. Any security lighting shall be so designed to ensure that nuisance is not

caused to adjoining areas by the spillage of light.

ENVIRONMENT & REGULATION SPECIFIC CONDITIONS

SCHEDULE A - GENERAL CONDITIONS A1 In carrying out the activity, all reasonable and practical measures are to be

taken to minimise releases and the likelihood of releases of contaminants to the environment, except as otherwise provided by the conditions of this development approval.

A2 The holder of this development approval must:

(a) install and operate all works and control equipment, and (b) take all measures, perform all acts and do all things, necessary to ensure

compliance with the conditions of this development approval. A3 Notwithstanding any other condition of this development approval, this

development approval does not authorise any release of contaminants that causes or is likely to cause an environmental nuisance beyond the boundaries of the registered place.

SCHEDULE B - AIR B1 Odour and visible contaminants, including but not limited to dust, smoke,

fumes and aerosols must not be released to the environment in a manner that will or may cause environmental harm or environmental nuisance unless such release is authorised.

B2 Suitable screens and/or barriers shall be erected during excavation and

building works, where required, to reduce the emission of dust, water effluent or other matter from the site.

B3 No incineration or open burning shall be carried out on site. B4 Following site preparation and clearing, all greenwaste material for disposal

shall be stockpiled and removed to an approved refuse disposal facility or wood chipped on site. Burning of material prior to removal is not permitted due to interferences with the surrounding areas.

B5 During construction, stockpiles and areas of bare soil or earth that are likely to become eroded must be adequately protected – by upslope surface water diversion, downslope sediment fencing and temporary surface coverings.

B6 A water truck or equivalent measure will be utilised to minimize dust emissions

while earthwork activities are being conducted.

SCHEDULE C – WATER / STORMWATER C1 A sediment and erosion plan is to be implemented. C2 Contaminants must not be directly or indirectly released from the site to which

this development approval applies, to any waters or stormwater. C3 Access to the site shall be restricted to a stabilised construction entrance. The

entrance shall be an appropriate size, with corduroy or metal grid provided to help shake mud from vehicle tyres.

C4 This approval does not relate to structural integrity. The approval holder is

responsible for ensuring that the designed facilities, along with ancillary drains, channels and pipes, shall be designed and constructed in accordance with good engineering practice. This approval does not remove any obligation on the holder to obtain any other approval legally required by any other authority.

SCHEDULE D – WASTE MANAGEMENT D1 Where waste is a contaminant, waste must not be released to the environment

where the release will or may cause environmental harm or environmental nuisance, unless such release is authorised.

D2 Building refuse shall not be stored on a public place during building operations.

All refuse shall be satisfactorily contained on site and stored in bulk refuse bins where appropriate.

D3 Building materials shall not be stored on Council’s footpaths. No construction

work is to take place on the footpath. D4 Concrete wastes, or washing concrete mixers, must not be deposited in any

location where they may flow or be washed into any stormwater system or kerb drainage.

D5 Paintbrushes, rollers, tins, trays etc shall not be washed out or emptied into

stormwater drain/system. D6 A designated bin site shall be provided to accommodate easy access for

service by a refuse vehicle.

D7 Provision is to be made for an allocated waste reciprocal area/s adequate to

store the wheelie-bins for all dwellings. The standing room for the wheelie-bins is to allow for two 240 litre mobile garbage bins per dwelling.

SCHEDULE E - MONITORING AND REPORTING E1 All complaints received by the holder of this development approval relating to

releases of contaminants from the activity must be recorded and kept in a log book with the following details:

(i) time, date and nature of complaint; (ii) type of communication (telephone, letter, personal etc.); (iii) name, contact address and contact telephone number of complainant

(note: if the complainant does not wish to be identified then "Not identified" is to be recorded);

(iv) response and investigation undertaken as a result of the complaint; (v) name of person responsible for investigating complaint; and (vi) action taken as a result of the complaint investigation and signature of

responsible person.

E2 As soon as practicable after becoming aware of any emergency or incident which results in the release of contaminants not in accordance, or reasonably expected to be not in accordance with the conditions of this development approval, the holder of the registration certificate to which this development approval relates, must notify the administering authority of the release by telephone or facsimile.

E3 The notification of emergencies or incidents as required by condition E2 must

include but not be limited to the following:

(i) the operator of the activity to which this development approval relates; (ii) the location of the emergency or incident; (iii) the name and telephone number of the designated contact person; (iv) the time of the release; (v) the time the holder of the registration certificate became aware of the

release; (vi) the suspected cause of the release; (vii) the environmental harm and or environmental nuisance caused,

threatened, or suspected to be caused by the release; and (viii) actions taken to prevent further any release and mitigate any

environmental harm and/or environmental nuisance caused by the release.

E4 Not more than 14 days following the initial notification of an emergency or

incident, the holder of the development approval must provide written advice of the information supplied in accordance with condition number E3 in addition to: (i) proposed actions to prevent a recurrence of the emergency or incident;

SCHEDULE D – WASTE MANAGEMENT D1 Where waste is a contaminant, waste must not be released to the environment

where the release will or may cause environmental harm or environmental nuisance, unless such release is authorised.

D2 Building refuse shall not be stored on a public place during building operations.

All refuse shall be satisfactorily contained on site and stored in bulk refuse bins where appropriate.

D3 Building materials shall not be stored on Council’s footpaths. No construction

work is to take place on the footpath. D4 Concrete wastes, or washing concrete mixers, must not be deposited in any

location where they may flow or be washed into any stormwater system or kerb drainage.

D5 Paintbrushes, rollers, tins, trays etc shall not be washed out or emptied into

stormwater drain/system. D6 A designated bin site shall be provided to accommodate easy access for

service by a refuse vehicle. D7 Provision is to be made for an allocated waste reciprocal area/s adequate to

store the wheelie-bins for all dwellings. The standing room for the wheelie-bins is to allow for two 240 litre mobile garbage bins per dwelling.

SCHEDULE E - MONITORING AND REPORTING E1 All complaints received by the holder of this development approval relating to

releases of contaminants from the activity must be recorded and kept in a log book with the following details:

(i) time, date and nature of complaint; (ii) type of communication (telephone, letter, personal etc.);

(iii) name, contact address and contact telephone number of complainant (note: if the complainant does not wish to be identified then "Not identified" is to be recorded);

(iv) response and investigation undertaken as a result of the complaint; (v) name of person responsible for investigating complaint; and

(vii) action taken as a result of the complaint investigation and signature of responsible person.

E2 As soon as practicable after becoming aware of any emergency or incident

which results in the release of contaminants not in accordance, or reasonably expected to be not in accordance with the conditions of this development approval, the holder of the registration certificate to which this development

approval relates, must notify the administering authority of the release by telephone or facsimile.

E3 The notification of emergencies or incidents as required by condition E2 must

include but not be limited to the following:

(i) the operator of the activity to which this development approval relates; (ii) the location of the emergency or incident; (iii) the name and telephone number of the designated contact person; (iv) the time of the release; (v) the time the holder of the registration certificate became aware of the

release; (vi) the suspected cause of the release; (vii) the environmental harm and or environmental nuisance caused,

threatened, or suspected to be caused by the release; and (viii) actions taken to prevent further any release and mitigate any

environmental harm and/or environmental nuisance caused by the release.

E4 Not more than 14 days following the initial notification of an emergency or

incident, the holder of the development approval must provide written advice of the information supplied in accordance with condition number E3 in addition to: (i) proposed actions to prevent a recurrence of the emergency or incident; (ii) outcomes of actions taken at the time to prevent or minimise

environmental harm and or environmental nuisance; and (iii) the results of any environmental monitoring performed.

SCHEDULE G - DEFINITIONS

G1 For the purposes of this development approval any term not otherwise defined

in the Environmental Protection Act 1994, and the Integrated Planning Act 1997 and any subordinate legislation made pursuant to these Acts or in the Definitions Schedule of this development approval has the meaning conferred to that term in its common usage.

2. Future Building Works application over proposed Lot 1 & proposed Lot 2 shall be in conjunction with the Building Envelopes provided by the applicant in plan no. G3327-01 as part of this approval.

3. All alterations to services and municipal facilities necessitated by the proposal

shall be the responsibility of the applicant. 4. Payment of an infrastructure charge for water headworks. Based on the current

policy this charge amounts to $3,413.20 per additional lot assessed in accordance with Council’s Transitional Planning Scheme Policy No 4 - Water Supply and Sewerage Infrastructure Headworks. This contribution is to be paid prior to the issue of a Development Permit for Building Works and at the rate applicable at the time of payment.

5. Payment of an infrastructure charge for sewerage headworks. Based on current

policy this charge amounts to $7,030.80 per additional lot assessed in accordance with Council’s Transitional Planning Scheme Policy No 4 - Water Supply and Sewerage Infrastructure Headworks. This contribution is to be paid prior to the issue of a Development Permit for Building Works and at the rate applicable at the time of payment.

6. Payment of a parkland contribution in accordance with Council’s Local Planning

Policy Number 2. Based on current charges this contribution amounts to $2,866 per additional allotment and is to be paid prior to the issue of a Development Permit for Building Works and at the rate applicable at the time of payment.

7. Payment of a Major Road Infrastructure Contribution in accordance with

Council’s Transport Infrastructure Policy. Based on current charges the contribution amounts to $6,404 per additional lot and is to be paid prior to the commencement of the use and at the rate applicable at the time of payment.

8. Provision of a minimum of two (2) on site car parking spaces per lot, one (1) of

which must be covered is required. Car parking spaces shall be drained in accordance with Part 14, Schedule 2, Division 4 of the Planning Scheme and AS2890.1.

9. The applicant shall demonstrate that each individual allotment is capable of

being drained of its potential roof water without affecting adjoining lots. Where roofwater from proposed allotments cannot be drained into the kerb and channel using approved kerb adapters, piped roofwater drainage collection systems are to be provided for each allotment in accordance with Council’s Standard Drawings.

10. Separate connections are to be provided to the reticulated water supply for each

lot. 11. Separate connections are to be provided to the reticulated sewerage for each

lot. Note: this will require Operational Works approval.

12. The location of the building envelopes shall comply with Council Policy 007 - Building Adjacent to and Over Sewers, particularly in relation to the new sewer to be constructed.

13. Submission for approval of a Development Application for Operational Works

must be completed for additional water, sewer and stormwater infrastructure which indicates full detailed working plans and specifications of all civil engineering work to Council’s Standards. Such plans and specifications shall be prepared by a Registered Professional Engineer in Queensland (RPEQ) and be accompanied by the relevant fee based on an approved estimate of cost.

14. The civil works being executed under the supervision of a RPEQ, on

completion, give to Council “as constructed” details of the civil works including certification from the supervising RPEQ that all civil works have been completed in accordance with the approved plans and specifications. Council reserves the right to utilise for its own purposes and the sale of information provided within the “as constructed” drawings provided by the applicant.

15. Completion of the civil works and lodgement of the relevant plan of survey within

two (2) years of Council approving the engineering drawings. 16. The lodgement of a maintenance bond on completion of the civil works, the

equal of five (5) per centum of the total estimate, to be held by the Council during the maintenance period being not less than twelve (12) months and the commencement of the ‘on maintenance’ period will not occur until all outstanding works, including the receipt of acceptable ‘as constructed’ information have been completed.

17. An agreement shall be entered into with Ergon Energy for the provision of

underground power. A certificate of Electricity Supply is to be obtained from Ergon Energy prior to the sealing of the Plan of survey, for the supply and reticulation of electricity to each allotment.

18. Provision is to be made for and opportunity given for Telstra and the Gas

Corporation to install their reticulation at the time of construction. 19. Any filling carried out on site is to be in accordance with AS3798-1996 and shall

be certified by a suitably qualified person as being carried out in accordance with the standards and specification. The certification shall indicate level of testing responsibility that has been used i.e. Level 1 or Level 2. Where building envelopes are located in fill areas the fill shall be certified as controlled fill suitable for building construction in accordance with the requirements of the BCA and AS2820. The extent of filling, test locations and test results are to be provided as ‘As constructed’ information.

Document 2000 21. Appropriate erosion and sedimentation control measures are to be utilised

during any Building Works or Operational Works carried out as a result of the development.

22. Provision of an 1800 mm high screen fence to side and rear boundaries of both

allotments, other than that section within 6 metres of the Skyline Drive frontage which shall be no greater than 1.2 metres in height, the details of which are to be submitted with any building works application on the site.

23. As part of any future Building Works applications, the applicant shall provide an

invert crossing and driveway to both allotments in accordance with Council’s Standard Drawings RT-0055.

ENVIRONMENT & REGULATION SPECIFIC CONDITIONS SCHEDULE A - GENERAL CONDITIONS A1 The holder of this development approval must:

(a) install and operate all works and control equipment, and (b) take all measures, perform all acts and do all things, necessary to ensure

compliance with the conditions of this development approval. A2 Notwithstanding any other condition of this development approval, this

development approval does not authorise any release of contaminants that causes or is likely to cause an environmental nuisance beyond the boundaries of the registered place.

A3 Any records required to be held as a condition of this development approval

must be kept at the site to which this development approval relates for a period of at least five years and be made available for examination by an authorised person upon request. The record retention requirements for this condition will be satisfied if any daily and weekly records are kept for a period of at least three years and these records are then kept in the form of annual summaries after that period.

SCHEDULE B - AIR B1 Odour and visible contaminants, including but not limited to dust, smoke,

fumes and aerosols must not be released to the environment in a manner that will or may cause environmental harm or environmental nuisance unless such release is authorised.

B2 Suitable screens and/or barriers shall be erected during excavation and building works, where required, to reduce the emission of dust, water effluent or other matter from the site.

B3 No incineration or open burning shall be carried out on site. B4 Following site preparation and clearing, all greenwaste material for disposal

shall be stockpiled and removed to an approved refuse disposal facility or wood chipped on site. Burning of material prior to removal is not permitted due to interferences with the surrounding areas.

B5 During construction, stockpiles and areas of bare soil or earth that are likely to

become eroded must be adequately protected – by upslope surface water diversion, downslope sediment fencing and temporary surface coverings.

SCHEDULE C – WATER / STORMWATER C1 Contaminants must not be directly or indirectly released from the site to which

this development approval applies, to any waters or stormwater. C2 Access to the site shall be restricted to a stabilised construction entrance. The

entrance shall be an appropriate size, with corduroy or metal grid provided to help shake mud from vehicle tyres.

C3 This approval does not relate to structural integrity. The approval holder is

responsible for ensuring that the designed facilities, along with ancillary drains, channels and pipes, shall be designed and constructed in accordance with good engineering practice. This approval does not remove any obligation on the holder to obtain any other approval legally required by any other authority.

C4 A stormwater management plan must be submitted for approval prior to

commencement of site clearing, construction or earthworks. C5 The stormwater management plan should report on environmental site

constraints (including soil erosion hazards) and provide details of measures designed to minimize soil erosion, mitigate flow rates and capture mobilized sediment. It should also include a contour diagram (or series of diagrams) showing: excavation and stockpile sites; roads; trenches and pollution control measures.

C6 A suitably skilled site supervisor should be appointed to supervise implementation of the stormwater management plan. They should inspect the site on each working day and log observations of any deficiencies. This log should be made available for inspection on demand by any authorised officer.

SCHEDULE D – NOISE D1 The installation and operations of noise generating equipment and vehicles

shall be carried out in a manner to minimise their impacts on neighbouring properties.

E2 An area shall be set aside for segregation and storage of recyclable solid wastes. E3 Where a no-cost recycling service is available, recyclable waste must not be

deposited into the general waste stream. E4 Vehicles used for waste and recyclables collection are dual axle vehicles with

an overall length of 11.8 metres and a width of 3 metres. Provision is to be made to allow collection vehicles to access the frontage of all premises. Cul de sacs are to be so designed to allow collection vehicles to safely negotiate the street without the need for excessive manoeuvring including reversing into or out of the street.
