MINUTES OF THE MEETING OF STA BOARD HELD ON 7.4.2006 AT 4.00 P.M. AND 18.4.2006 AT 3.00 P.M. IN THE CONCERENCE ROOM OF COMMISSIONER (TRANSPORT)/CHAIRPERSON, STA BOARD Meeting were held of the STA Board under the Chairmanship of Commissioner (Transport)/Chairperson (STA). Application of M/s PCTI Ltd. for a licence to operate “Rent A Motor Cycle Scheme 1997” as a two wheeler Metro Feeder Sevice to the daily travelers of Metro Rail by transporting them from their residence to the Metro Station and from the Metro Station to their work place. Agenda Item No.12, deferred in the last meeting of STA Board on 29.10.2005.
1. M/s. PCTI Ltd. has applied for a licence to operate ‘Rent a Motor Cycle Scheme 1997’ as two wheeler metro feeder service to the daily travelers of metro rail by transporting them from their residence to the metro station and from the metro station to their work place. The company has also applied in the prescribed format Form –1 of the said scheme along with a demand draft of Rs.1000/- in favour of State Transport Authority, Delhi as an application fee.

2. It has been indicated by the applicant that the Company is in the process of getting concessional agreement with DMRC, separately. Till date, we have not received any information either from the DMRC or from the applicant. 3. The applicant M/s. PCTI Ltd. is 15 years old group engage in providing servicing. It is a public limited company registered under the name of PC Training Institute Ltd. The company has opened a separate division by the name of 2W Metro Feeder Service and we shall be operating the service under this division of the company. 4. Section 75 of Motor Vehicles Act, 1988 is reproduced herein under which Rent a Motor Cycle Scheme 1997 has been notified by the Government of India. A copy of the scheme is enclosed herewith as Annexure – I. 75. Scheme for renting of motorcabs.- (1) The Central Government may, by notification in the Official Gazette, make a scheme for the purpose of regulating the business of renting of [motorcabs or motor cycles to persons desiring to drive either by themselves or through drivers, motorcabs or motor cycles] for their own use and for matters connected therewith. 5. Some of the important paragraphs of the ‘Rent a Motor Cycle Scheme 1997’ has been reproduced hereinunder.
Definitions.-In this scheme unless the context otherwise requires,- (iii) ”licence” means a licence granted or renewed under paragraph
6 to engage in the business of renting of motor cycles to persons desiring to drive the motor cycles themselves for their own use;
(iv) “licensing authority” means the State Transport Authority
constituted under sub-section (1) of section 68 of the Act; (v) “operator” means the holder of permit issued under sub-section
(1) of section 74 of the Act in respect of not less than 5 motor cycles; 5. Scrutiny of application.- A licensing authority shall, before
granting or renewing a licence, take into consideration the following, namely,-

(i) That the applicant has a good moral character and has intimate knowledge of passenger transport business;
(ii) That the applicant has necessary facilities for the housing,
maintenance and repair of his vehicles, sanitary block and reception room; (iii) That the applicant has at least one telephone which is
accessible throughout day and night; (iv) That the financial resources of the applicant are sufficient to
provide for the continued maintenance of motor cycles and for the efficient management of the establishment;
(v) That the applicant maintains not less than 5 motor cycles duly
covered by permits issued under sub-section (1) of the Act, with comprehensive insurance, fitness certificates, motor vehicles tax paid up to date.
6. Grant of licence.- The licensing authority may, on receipt of an
application under paragraph 4 and after satisfying himself that the applicant has complied with the requirements of paragraph 5, grant or renew the licence in Form 2;
Provided that no application for licence shall be refused by the
licensing authority unless the applicant is given an opportunity of being heard and reasons for such refusal are given in writing by the licensing authority.
9. Collection of hire charges.- The holder of a licence shall
collect the hire charges from a foreign national or non-resident Indian only in foreign exchange and shall hold for the purpose a licence to transact in foreign exchange. 5. Critical examination of the applicant reveals the following facts. (i) The applicant has no knowledge of passenger transport business. It is difficult to comment upon the character of the applicant at this stage. Similarly, the applicant does not have the provisions as mentioned in paragraph 5 (ii), (iii), (iv) and (v) of the ‘Rent a Motor Cycle Scheme 1997’. It is also not known whether the applicant has a licence to transact in foreign exchange as per the requirement of para 9 of the scheme. (ii) It is not known whether DMRC will allow the applicant to use his parking space for said scheme.

(iii) The drivers of the Rent a Motor Cycle Scheme 1997 would require a driving licence of transport category alongwith public service vehicle badge. Being Transport vehicle, road tax shall be charged for commercial purpose. Government has to notify fares for such vehicles. As on date, all these requirements are not available in the Transport Department and need necessary amendments in respective software. (iv) In Section 75 (1) of the Motor Vehicles Act, 1988 it has been stated that “the Central Government may, by notification in the Official Gazette, make a scheme for the purpose of regulating the business of renting of [motorcabs or motor cycles to persons desiring to drive either by themselves or through drivers, motorcabs or motor cycles] for their own use and for matters connected therewith”. Here, the intention of the legislative is to operate such scheme for broader prospective and not to confine upon short distance travel for a particular purpose i.e. to provide feeder service to Metro. The application may also need examination in this aspect also. (v) The ultimate motive of metro is to decongest Delhi by means of removing personalized vehicles from the road. Such an arrangement of renting a motorcycle would definitely defeat the very purpose of operating mass rapid transits system. Government has already directed DTC to purchase low and semi low floor modern and better fully built CNG Propelled buses. Some of these buses shall also be put on metro feeder services. This aspect has been dealt in the EFC Memorandum also. 6. In the light of the above, it is proposed that the matter may be placed before the STA Board for appropriate decision as per the requirement of Para 2 (iv) of the Rent a Motor-cycle Scheme. Decision:
The matter contained in the agenda note was discussed and it was unanimously decided that more details in respect of operations of the proposed arrangement are required and that an opportunity may be given to M/s PCTI Ltd. to explain his proposal to the STA Board.
Notice be given to applicant to appear before the STA Board in the meeting to be held on 1.6.2006.
2. Resolution No.2/2006 Agenda Item No.8/2006
Ex-post-facto approval of STA Board for the order made by Chairman (STA) vide which officers of Transport Department were directed to try 358 number of vehicles referred by Delhi Traffic Police which

were found with tampered / defective/without speed control device during the joint inspection of Transport Department and Delhi Traffic Police for making recommendation to STA for cancellation of their permits.
1. Vide Rule 61-A of Delhi Motor Vehicles Rules, 1993, the State Transport Authority may by general or special resolution recorded in its proceedings and subject to the restrictions, limitation and conditions that it may impose, delegate to Group ‘A’ and Group ‘B’ gazetted officers, its power under Section 86 of the Motor Vehicles Act, 1988 to suspend a permit or to recover form the holder thereof a sum of money agreed upon in accordance with sub-section (5) of Section 86 of the Motor Vehicles Act, 1988.
2. State Transport Authority vide resolution no.1/1998 has already delegated its power of suspension of permit to the followings :-
(i) All SDMs and DCs.
(ii) All officers of Delhi Police of the rank of Assistant Commissioner of Police and above.
(iii) All the officers of Transport of the rank of Dy. Director and above.
Subject to the condition that the delegation shall be liable to be reviewed form time to time and also subject to the limitation that the power to charge compounding fees in lieu of suspension in case of fatal accidents by stage carriage buses shall be exercisable by officers of the level of Deputy Director and above of the Transport Department only.
3. Delhi Traffic Police in association with technical wing of Transport Department has recently conducted a drive to check the speed control devices in Transport vehicles and has found the vehicles violating the provisions of law and Supreme Court’s directions. Delhi Traffic Police vide various letter has referred a list of 358 number of vehicles for cancellation of their permits under relevant provisions of Motor Vehicles Act, 1988.
4. During the meeting held on 30.1.2006 with Joint Commissioner of Police, Traffic, it was decided by Chairman (STA) that the vehicles found with tempered/defective/without speed control devices during the joint inspection of Transport Department and Delhi Traffic Police shall be tried by the officer of Transport Department under section 86 of the Motor Vehicles Act, 1988 for cancellation of their permits. These officers shall conduct quasi-judicial proceedings for the cancellation of the permit and shall give their recommendation to State Transport Authority. On these

recommendations, STA shall again here the permit holder and then pass appropriate order.
5. In this regard, Chairman, STA in the past had made an order-bearing no. PCO/STA/2005/15/385-399 dated 24.3.2006 vide which officer of this Transport Department were directed to try these cases under Section 86 of Motor Vehicles Act, 1988 and give their recommendation to State Transport Authority.
6. STA Board is requested to grant ex-post-facto approval for the aforesaid order.
Annexure GOVERNMENT OF NCT OF DELHI STATE TRANSPORT AUTHORITY TRANSPORT DEPARTMENT 5/9 UNDER HILL ROAD DELHI-54 F.NO.PCO/STA/2005/15/ Dated:- O R D E R Whereas Supreme Court of India vide order dated 20.11.1997 in the matter of M.C. Mehta Versus UOI & others – CWP No.13029/85 has directed that no heavy and medium transport vehicles, and light goods vehicles being four wheeler would be permitted to operate on the roads of NCR and NCT of Delhi, unless they are fitted with suitable speed control device to ensure that they do not exceed the speed limit of 40 kmph and any breach of the aforesaid directions by any person would, apart from entailing other legal consequences, be dealt with as contravention of the conditions of the permit which could entail suspension/cancellation of the permit and impounding of the vehicle. Whereas general condition attached to all permits vide Section 84 of the Motor Vehicles Act, 1988 states that the vehicle to which the permit relates carries valid certificate of fitness issued under Section 56 at all times, so maintained as to comply with the requirements of this Act and the rules made there under. Whereas Rule 118 of the Central Motor Vehicles Rules, 1989 states that on and from the (commencement) of this rule, such Transport vehicles as may be notified by the (State Government) in the Official Gazette shall be fitted by the operator of such transport vehicle with a speed governor (speed controlling device) conforming to the {Standard AIS : 018}, as amended from time to time in such a manner that the speed governor can be sealed with an official seal of the State Transport Authority or a

Regional Transport Authority in such a way that it cannot be removed or tampered with without the seal being broken. Whereas Transport Department, Govt. of NCT of Delhi vide Gazette Notification bearing no. PCO/STA/II/2001PF-2/194, dated 24-02-2003 has notified the manner in which the speed control device conforming to AIS:018 Standard shall be installed and maintained. Now, therefore, Chairman, State Transport Authority, Govt. of NCT of Delhi has directed that the following officers shall try the number of vehicles whose registration number is indicated against each under Section 86 of the Motor Vehicles Act, 1988 for cancellation of their permits and give their recommendations to State Transport Authority so that State Transport Authority may pass appropriate orders.

3. Resolution No.3/2006 Agenda Item No,9/2006

1. 3. In view of the above, following is submitted for the consideration and approval of STA Board.
Chairman, STA in the past had made an order bearing no. F.21(19)/Secy/STA/03/2005/329-341, dated 27-01-2006 vide which Motor Licensing Officers of Transport Department were designated as officers to try the cases under Section 86 of Motor Vehicles Act, 1988 of defaulters under Rule 7A of Delhi Motor Vehicles Rules, 1993. A copy of the said order is enclosed herewith for ready reference. However, it may be mentioned that these powers have been delegated only to try the cases contained in the said order and position will be reviewed after six months as to whether the powers of trial could be delegated to these officers on regular basis.
4. The matter is placed before the STA Board for appropriate decision.
Annexure GOVERNMENT OF NCT OF DELHI STATE TRANSPORT AUTHORITY TRANSPORT DEPARTMENT 5/9 UNDER HILL ROAD DELHI-54
No.F.21(19)/Secy/STA/03/2005/ Dated:- O R D E R (1) As per Sub-rule 1 of Rule 7-A of the Delhi Motor Vehicles Rules, 1993, every holder of a permit shall furnish within ten days of receipt of the permit, a list of drivers who are engaged by him together with their photographs of passport size and such other particulars as the Commissioner may by order specify to establish the identity of such persons to the Secretary, State Transport Authority, Delhi. Sub-rule 4 of Rule 7-A of the Delhi Motor Vehicles Rules, 1993 further states That no transport vehicle shall be driven by a person other than the authorized driver, referred to in sub-rule (3) and its violation shall be treated as breach of the conditions contained in the permit and as contravention of the provisions of these rules. (2) Chairman, State Transport Authority, Govt. of NCT of Delhi is pleased to designate the following Motor Licensing Officers of this department as

4. Resolution No.4/2006 Agenda Item No.10/2006
Ex-post-facto approval for creation of RTV/Mini Buses routes to run as Feeder Routes to Metro Vide resolution 04 of 2005, STA Board has accorded approval to creation of 18 RTV / Mini Buses Routes to run as Feeder Routes to Metro in addition to the 12 Metro Feeder Routes. Out of the 18 approved routes code not alloted to one of the route no. mentioned at a serial no. 13 as it is understood that part of the route falls in territory of UP state. The route code no. re-alloted to all other 17 approved routes and the permits are issued as per the recommendation of the DMRC. On opening of the Metro Line 3 of Phase-1 DMRC has further requested for creation of 31 routes to operators of feeder routes. One of the routes out of the 31 was not as per the policy of the Department and was rejected. As the DMRC has pressing hard to provide connectivity to its commuters and also the fact the other 30 routes were apparently complying with the policy of the Department. Chairman, STA Board accorded approval for creation of 30 RTV Routes to run as Feeder Routes to Metro subject to the ex-post facto approval by the STA Board. The 30 created routes are given as below: -

5. Resolution No.5/2006 Agenda Item No.12/2006
Ex-post-facto approval by STA Board for Stage carriage permits issued to RTVs as per the approval of Chairman, STA Board on Metro Link Routes as per recommendation of DMRC. STA has created 59 dedicated RTV/ Mini Bus Routes to ply as Metro Links for the benefit of the commuters traveling by Metro. They have requested that the permits be issued to the operators on specific routes as per their recommendation. STA Board vide resolution 4/2005 has directed the stage carriage permits may be issued on the recommendation of DMRC to the existing contract carriage/ stage carriage RTVs permit holders only. According to the above resolution, Chairman, STA Board has approved the issuance of 65 Stage Carriage Permits to RTVs/ Mini Buses which were recommended by DMRC on these 59 Routes subject to the Ex-post facto approval by STA Board. Further rationalization of routes with same origin and destination. Sh. Mohan Singh Ahluwalia operator of the vehicle no. DL1PA – 7009 operating on route no. 400 (Okhla Village to Minto Road) has requested to merge his route with route no. 894A this is also Okhla Village to New Delhi Railway Station. It may be mentioned that UTT Committee vide minutes dated 19.8.2003 rationalized the non-rationalized Route No. 9241 & 9262 by allotting a route code no. 894A. These were point to point routes where no via was mentioned in the permit. Even though, UTT Committee

rationalized this route by allotting route code no. 894A, it has not specified any via of this route. As a result even after rationalization, this route is without a via. Therefore, in the fist instance, it is necessary to refer the case to UTT Committee to specify the via of route no.894A and any other route which is rationalized but not having via. The comparision of both the routes are as follows: -

The contention of the operator of route no. 400 is” that they have to follow long via to reach Minto Road (i.e. N.D. Rly Station). Whereas the buses running on route no.894A operates through a shortest via. As a result, the commuters prefer to travel in route no. 894A as they can reach their destination early. Therefore, the route no. 400 become uneconomical and only 3 buses are operating at present. DTC also has withdrawn their buses from this route. Since, the starting destination and the terminating destination of these routes are same, they may be allowed to merge their routes to 894A”. As per record, there are few more routes which are similar to the above routes where the starting and terminating destination is same but via and route code number is different. It is possible that one of such routes may be more attractive and popular in commuter points of view while other route may not be that attractive, and therefore the operator operating on less attractive route may be suffering financially. Although the both operators are operating between same destination points but on different via. The following course of action is proposed in the interest of both commuters and operators.
i) In those cases where the UTT Committee recommended the
rationalization of routes but had not specified any via for the routes and operators are still operating on point to point basis, such cases may be referred back to UTT Committee to specify via for each route.
ii) The routes where starting and terminating points are same but
operating under a different via and a route code, in such routes if the operators wants they may be allowed to opt for the other route having the different via but the same originating point and destination.
STA Board may like to take a decision in the matter.

Approved. 7. Resolution No.7/2006 Agenda Item No.20/2006 Approval of terms and conditions of Radio Taxi Scheme – 2006
A Radio taxi scheme was framed and notified by the transport department Govt. of NCT of Delhi in leading newspaper on 8th Sep 1998. The scheme was introduced for the purpose of providing air-conditioned taxi fleet fitted with electronic fare meters and wireless radio systems.
As per terms & condition of the earlier scheme the license would be granted to the operator once they get 25 vehicles registered. Thereafter, they were required to register the vehicles @ 25 vehicles per month for initial four months and balance @ 50 vehicles per month till the figure of 500 Radio Taxies reached at the end of first year.
Performance of Operators to whom licences were granted, was poor in terms of induction of vehicles. Due to this, the visibility of this type of taxies on road remained rather limited. None of the operators has inducted vehicles as per schedule given in terms and conditions. Further, these operators do not have sufficient parking space arrangement. The terms & condition of renewal of bank guarantee at the time of renewal of license were also not clearly specified and the bank guarantee of Rupees Five Lakhs appears too low. Most of these operators are also not having back ground of transport business. Accordingly, it was considered that the scheme be reframed after carrying out the necessary changes. Some of the Major improvement in the present scheme over the earlier scheme is listed here below.
1. The induction schedule is made flexible so that the license can achieve
targeted 500 vehicles with specified time of one year. The operator has to induct minimum prescribed vehicles so that the permanent licence is given to serious operators.
2. The duration of the license is sought to be linked with satisfactory performance of the license, desirability of the scheme and conditions prescribed by the STA. The Bank Guarantee has been enhanced to Rupees Fifteen Lakhs and would be in the nature of performance guarantee.
3. All operators are required to demonstrate operational i.e. Radio net work based on GPS/GPRS or any other acceptable technology. This

requirement has been made as condition precedent for grant of permanent license.
4. The Radio taxi operators is sought to be made responsible for providing safe reliable and trust worthy drivers by adding the specific provision to the effect. A copy of terms & conditions for Radio Taxis scheme 2006 giving details of operator profile, operational infrastructure, fleet size, vehicle profile, working conditions, drivers profile, issue, duration and renewal of license, general conditions, fare, induction schedule, power of licensing authority to suspend or cancel the license, appeal and its procedure and misc. conditions is enclosed at Annex “A”. These terms & conditions have been approved by the Hon’ble Minister of Transport in principal. This agenda items may be placed for consideration in the meeting of STA board for seeking approval of the above referred terms & condition as added at Annex “A” to this agenda note.

TERMS AND CONDITIONS FOR RADIO TAXI SCHEME-2006
Grant of permits to prospective operators of radio taxi networks shall be
considered under section 74 and other provisions of Motor Vehicle Act, 1988, and rule
made there under. Detailed terms and conditions governing the scheme shall be as
follows:
I) LICENSEE PROFILE
1. The licensee must be either a company under the Companies Act, 1956 or
a society under the Societies Registration Act, 1860.
2. The licensee must be financially sound in order to run and manage the
radio taxi operation in Delhi.
3. The Licensee must have experience and intimate knowledge of transport
business preferably in the running of motor cabs.
II) OPERATIONAL INFRASTRUCTURE
1. The licensee must demonstrate possession of adequate parking space for
all taxies and office space (minimum of 1000 sq. ft.) for accommodating
the control room with radio communication and ten telephone lines.

2. Necessary infrastructure for maintenance of the vehicle should be
available.
III) FLEET SIZE FOR LICENSEES
The minimum fleet size per license would be 500 (Five
hundred) motor cabs, which must be achieved by the licensee
within one year of the commencement of the operation.
IV) VEHICLE PROFILE
1. Every motor cab should be brand new at the time of induction.
2. The motor cab should be driven on clean fuel.
3. The vehicle should be of engine capacity of 999CC or above, JEEP type
vehicle like Gypsy etc. is prohibited.
4. The vehicle must be equipped with temperature control devises such as air
conditioning and heating and maintained in proper working order at all
times.
5. The motor cab should be fitted with electronic fare meters on the front
panel (dashboard) and maintained in a proper working order.
6. On the roof of the vehicle there should be an LCD board to display that
the vehicle is a radio taxi ; the dimensions of the LCD display panel must
conform to those prescribed by the State Transport Authority from time to
time.

7. The vehicle is allowed to carry advertisement in such a manner and to the
extent that it doesn’t become hazardous or disturbance to the safe traffic
and shall be strictly in accordance with the guidelines issued by the STA
in this regard from time to time.
8. The vehicle should meet emission standards as prescribed form time to
time.
9. The vehicle must be fitted with GPS/GPRS based tracking devises which
must be in constant communication with the Central Control unit while the
vehicles is on duty.
10. The vehicle must be equipped with a mobile radio fitted in the front panel
for communication between driver and the main control room of the
licensee.
11. The vehicle must be equipped with the first aid box containing material to
be specified in DMV rules 1993.

12. The vehicle should be replaced on completion of eight years with a brand
new vehicles meeting the prevailing emission standard.
13. Photograph of driver, license particulars of driver and details of the licensee will have to be displayed on the dashboard of the vehicle.
14. The vehicle approved for commercial taxis like Ford Ikon, Opel Astra,
Mitshubishi Lancer, Fiat Palio etc shall also be allowed to be registered as
radio taxi, provided, they are fitted with appropriate CNG kits by
approved retrofitters.
15. The color scheme of the radio taxi is white with different color strip of one
foot on both of the panels of the car differentiating each licensee.
16. Licensees of radio taxis, on request, will be considered for grant of Inter State Permit under the relevant provision of Motor Vehicle Act, 1988 up
to 100% of their fleet only for the National Capital Region.
17. Transport help line number should be prominently displayed inside and
outside of motor cab as prescribed.
V) WORKING CONDITIONS
The licensee must adhere to the provisions of Motor Vehicle Act, 1988 and the
terms and conditions prescribed by the transport department from time to time.
Working hours of drivers is to be limited in accordance to the Motor Transport
Workers Act, 1961.
VI) DRIVER PROFILE
1. The driver must have a driving license of the appropriate category for at least
five years issued by an authority in the NCT of Delhi.
2. The driver should at least be a matriculate (namely, passed board examination
of 10th or equivalent).
3. The driver shall be required to successfully pass a special driving test as and
when devised/prescribed by the Govt.
4. The driver must have a valid public service badge issued in Delhi.
5. The driver must at all times be in uniform to be approved by the Govt./STA
while on duty.

6. The driver must be of good character without any criminal record.
7. The radio taxi licensee shall be responsible for quality of drivers, their police
verification, employer control and supervision of drivers, employee behavior
etc. The employers shall also ensure that the drivers are totally safe, reliable
and trustworthy.
8. If the radio taxi licensee uses or causes or allows a vehicle to be used in any
manner not authorized by the permit or provisions mentioned herein, the

licensee/driver shall be jointly and severally responsible for any offence or
crime which has been committed by a person, including driver, using the said
vehicle.
VII) ISSUE, DURATION OF LICENSE AND RENEWAL OF
LICENCE
1. After scrutiny of application and inspection of the premises, LOI would be
issued in favour of the applicant for purchase of a minimum two hundred
number of vehicles of the prescribed category along with a temporary license
valid for a period of four months.
2. The applicant shall be required to furnish a Bank Guarantee, in a format
acceptable to the Transport department for an amount of Rupees Fifteen Lakh,
drawn in fovour of the Secretary-Cum- commissioner (Transport), Govt. of
NCT of Delhi, prior to the issue of temporary license and LOI.
3. On grant of temporary license, the Operator shall get the minimum two
hundred vehicles prescribed in the temporary license registered, and establish
a Control Room fully equipped with a Radio network and GPS/GPRS tracking
system within a period of four months of the issue of LOI.
4. In the event that a holder of a temporary license fails to fulfill these conditions
in four months, a further extension of two months may be considered to be
granted to such holder of a temporary license on his making an application
giving reasons for delay. The application must be accompanied with a penalty
of Rs.25000/- (Rupees twenty five thousand) to be paid through Demand Drat
drawn in favour of Secretary-Cum-Commissioner (Transport) Govt. of NCT
of Delhi.
5. In the event that a holder of temporary license fails to register comply with the
above stipulations within the prescribed period as applicable, his temporary
license shall automatically stand cancelled and the performance guarantee of
Rupees Fifteen Lakh shall be forfeited.
6. Alternatively, on completion/ compliance of all conditions prescribed in the
temporary license, the Operator shall be issued a regular license valid for a
period of five years.
7. The license initially granted for a period of five years shall be renewable for a
further period of five years subject to the satisfactory performance of the
license holder as per terms and conditions of the scheme, the desirability of
the scheme and any other condition prescribed by STA. The applicant may
submit an application for renewal of license at any time after completion of
four years but not less than three months before the expiry of the license with
a renewed/fresh bank guarantee of Rupees Fifteen Lakhs.

8. On receipt of the application for renewal of license, an inspection of the
business premises of the licensee shall be carried out, and performance of the
licensee shall be evaluated as per the terms and conditions of the scheme. The
Competent Authority shall keep the complaints received against the licensee
in view at the time of granting renewal of license.
9. Plying of Motor cabs by a licensee in the absence of a valid license shall not
be permitted under any circumstance.
VIII) GENERAL CONDITIONS TO BE ADHERED BY THE
HOLDER OF THE LICENSE 1. The holder of a license shall
a) Not shift the principle place of business mentioned in the license
without the prior approval, in writing of the licensing authority,
b) Keep the premises and all the records & register maintained and motor
cabs open for inspection at all reasonable times by the licensing
authority or by any person not below the rank of Motor Vehicle
Inspector as may be authorized in this behalf by the Licensing
Authority.
c) Submit from time to time to the Licensing Authority such information
and return as may be called for.
d) display at a prominent place in its main office the license issued in
original and certified copies there have attested by the Licensing
Authority.
e) maintain a compliant book with serially numbered pages in triplicate
in all its motor vehicles covered under this license and as well as at
principle place of Business and other branch offices ;
f) dispatch the duplicate copy of the complaint book any of the Licensing
Authority by registered post expeditiously and in any case not later
than seven days ; and
g) maintain a suggestion box in the main office and branch office, if any,
and forward their suggestions received with their comments, if any, to
the Licensing Authority once a month.
2. The license shall not be transferred without the prior written permission of the Licensing authority.
IX) FARE
Fare charged by the Operator shall be as prescribed, from time to time, by the
Government of National Capital Territory of Delhi for the metered radio cabs. At
present, the metered fare prescribed is Rs. 15/- (Rupees fifteen) per km. The
licencee may, however, charge less than Rs. 15/- (Rupees Fifteen) per KM.
During 11 PM to 5AM, night charges @ 25% over the normal applicable fare of
Ra.15/-per Km. would be chargeable by the operator subject to any further
changes made in the fare structure by the Govt.

X) INDUCTION SCHEDULE
1. An applicant must submit an induction schedule in respect of not less than
five hundred vehicles at the time of making an initial application for grant of
temporary license or LOI. The department may approve the schedule with or
without modification, or may require the applicant to submit a modified
induction schedule, prior to the issue of temporary license.
2. The licensee shall submit a compliance report of each stage of the approved
schedule to the department.
3. The failure by the licensee to induct the motor cabs as per the schedule is
liable to result in cancellation of the license and as well as forfeiture of bank
guarantee.
XI) POWER OF LICENSING AUTHORITY TO SUSPEND OR
CANCEL THE LICENSE.
If the licensing Authority after giving the Licensee an opportunity being heard; is
of the opinion that
1. A licensee has failed to comply with any of the terms and conditions as
detailed herein, or,
2. A licensee has failed to maintain the motor cab in compliance with the
provisions of the Motor Vehicles Act and or Rules framed there-under, or
3. An employee of licensee is guilty misbehavior with customers or
4. A complaint against the licensee by any hirer has been proved beyond
reasonable doubt,
The licensing Authority may suspend the license for a specified period or cancel the
license.
Where the licensing Authority of the opinion that having regard to the
circumstances of the case it would be necessary to cancel or suspend the
license, and if the holder of the license agrees to pay a fine that may be
imposed by the Licensing Authority, then notwithstanding anything contained
in the Para above, the Licensing Authority may instead of canceling or
suspending the license as the case may be recover from the holder of a license
the set fine.
When the license is suspended or cancelled as per paragraph 1 above, the
holder of the license shall surrender the license to the Licensing Authority.

XII) APPEAL
Any person aggrieved by any order of the Licensing Authority may within
thirty days of the receipt of the order, make an appeal to the State
Transport Appellate Tribunal.

XIII) PROCEDURE FOR APPEAL
1.An appeal shall be preferred in duplicate in the form of memorandum
setting forth the grounds of objections to the order of the Licensing
Authority and shall be accompanied by fee as may be specified by the
Govt.
2.The State Transport Appellate Tribunal may, after giving an
opportunity of hearing to the parties and after such enquiry as it may
be deem fit pass appropriate order.
MISCELLENOUS
XIV) The present scheme supersedes as all the previous schemes on the
subject. The department reserves the right to change any or all of the
above terms and conditions in public interest.
XV) All pending applications and any further continuation of permit/license
of the existing licensees shall be governed by the terms and conditions
contained herein above.
XVI) A Licensee may at any time surrender the license issued to him of the
Licensing Authority, and on such surrender the Licensing Authority
shall cancel the license. The holder of the license shall clear all dues
before surrendering the license and seeking release of Bank Guarantee
Decision: Approved.

On going through the above table, it is evident that only one operator Shri Vijay Kumar at serial no.1 is having a permit issued under SC category and remaining operators are issued permit under general category. The claim of these SC/ST operators is that they have availed loan from DFC at a higher interest and it is not possible for them to repay the loan unless they are given economically viable routes. They have also informed that some of the operators are not able to repay the loan and

DFC is auctioning their vehicles. Since they belong to socially backward communities and they have no other source of income and unless their cases are considered sympathetically they will be financially ruined. The case of Shri Vijay Kumar who has availed loan from DFC, has been recommended by Chairperson and Managing Director of DFC vide D.O. No.DFC/CMD/Tpt/2005-06/127 dated 29.8.2005. SC/ST operators were allotted their choice routes during 2002-2003 and also subsequently allowed one or two changes as the permits of those operators who have not brought the CNG buses were cancelled by the order of Supreme Court. As per the previous application dated 26.6.2005 of Shri Vijay Kumar for change of route and the matter was referred to UTT Committee and UTT Committee vide para 25 of minutes dated 18.8.2005 opined that the matter is not within the purview of UTT Committee. Earlier UTT Committee used to recommend cases of change of route of SC/ST operators. Such recommendations were implemented after the approval of Chairperson (STA). However, it was pointed out by the then Secretary (STA) that UTT Committee should confine to its mandate to recommend alternate routes only in cases of –(i) a non-rationalized route (ii) single bus on a particular route. Taking into account this observation, UTT Committee has recommended alternate routes for the said two category of cases only. In view of the above, a policy decision may be taken by STA Board so that UTT Committee may also be entrusted to recommend alternate route of those SC/ST operators who have availed permit under the SC/ST category provided that they have not availed one change after the initial allotment of routes. The individual such cases may thereafter also be placed before the STA Board along with recommendation of UTT Committee for consideration and approval.
Decision:
After detailed discussion, it was decided to call for an additional information on :- i. Number of operators / permits category-wise i.e. SC/ST/Ex-
Servicemen etc. ii. Exemptions already availed by the above operators category-wise. iii. Total number of buses operating on the routes on which the
operators of aforesaid categories are granted permits.

Agenda Item No.4/2006 Restoration/Alternative Route for operation of Route No.817
The Operators of Route No. 817 were plying their buses between Najafgarh to Kauriya Pul. A meeting was held on 25-05-2004 in DMRC Office on Integration of Delhi Metro with Road Transport under the Chairmanship of the then Commissioner (Transport). A decision was taken vide para 5 of minutes to curtail the route 817 upto Inderlok. The Minutes are reproduced as under:
“Route no: 817 which is presently operating from Najafgarh to Kauriya Bridge is to be terminated to Inderlok for DTC and STA both. Further this decision will be open for review if required.”
The route was curtailed upto Inderlok after the approval of the Commissioner(Transport)/Chairman(STA). The affected Operators filed a petition in the High Court and the Hon’ble High Court while disposing the petition directed the UTT Committee to hear the suggestions of operators and the Commissioner thereafter take a decision on the recommendation of the UTT Committee (copy of order of Hon’ble High Court is enclosed as Annexure -B). The matter was discussed in the meeting of UTT Committee dated 10.12.2004 and the committee entrusted Shri Chander Prakash, Manager, DTC to suggest some alternative route to the operators. Shri Chander Prakash vide his letter No.TR/She/STA/13/04/5021 dated 17.12.2004 (copy enclosed as Annexure–C) given suggestion which are accepted by the UTT Committee vide minutes dated 04.01.2005 and which are reproduced as under: -
a) Route No.817 may not be disturbed as this route is running
parallel with metro only 2 Kms. b) If/ all this is not accepted, a new route No.811 may be alloted to
these buses to start from Dwarka Sector-14 to Bhai Mati Dass Chowk to run via Sector-13, Netaji Subhash Institute, Kakrola More, Uttam Nagar, Moti Nagar, Zakhira, Shastri Nagar Sarai Rohilla, Filmistan, Azad Market, Ice Factory, ISBT and Bhai Mati Das Chowk.
Some of the operators plying their buses on route 817 may be
adjusted on the proposed route as suggested above.
c) One more route No.748 has been suggested to operate in between Dwarka Sector-23 and Anand Vihar Bus Terminus to run via Dwarka Sector-22 SPG Complex, Shahbad Mohd.Pur, IGI Airport, Nangal Dairy, Mahipal Pur, Vasant Kunj Police Post,

Nelson Mandela Marg, Munirka, R.K.Puram Sectgor-1, Sector-11, S.N. Depot, S.N. Market, S.J. Airport, Prithvi Raj Road, Shahjahan Road, Tilak Bridge, ITO (AGCR), Laxmi Nagar, Shakar Pur, Hasan Pur Depot and Anand Vihar Bus Terminus.
However, the then Chairman (STA) approved that this matter be taken separately in the Policy file. The matter was again put up in the UTT Meeting and Committee vide para 4 of its minutes dated 8.7.2005 reiterated its earlier recommendations. At present there are 64 buses plying on this route and the route length is approximately 22 kms. As such the frequency is two minutes and there is competition among the operators. The problem can be sorted out if the route is restored as there is not much overlapping with Metro operation. Further the minutes of 20-05-2004 by which the decision was taken to curtail the route also provide that the decision will be open for review if required. In order to find out preference of the operators who are presently operating on the curtailed route of route no: 817 in out of different options a questionnaire has been designed. 27 operators of the Route No. 817 responded to the questionnaire and submitted their reply which is reproduced in a table form. The operators were asked to respond to the following questions:-

on each of three routes to remain viable for commuters/ operators (write the numbers against each column given under route code.
Question No.2: Please indicate in the order of preference, if
any i.e. 1st, 2nd and 3rd below each route. Please put a cross in the column in which no option is exercised.
All the operators did not respond to the question. However, from the response received a mean average is taken which is produced below:

From the above response, it can be seen that the existing route no. 817 and one of the recommended Route No. 811 by the UTT Committee is more popular.
Since STA has already curtailed the Route No. 817, it will not be appropriate to reverse the decision. Moreover, by the opening of the line 3 of Metro another stretch of route from Uttam Nagar to Moti Nagar also become parallel to the route. Therefore, it will not be appropriate to restore the full route as recommended by the UTT Committee.
The proposed Route No.811 seems to be more popular with the operators as per the response shown. However, as per the extension of the programme of line 3 which is likely to be operational shortly more areas of this route near Dwarka will be matching with the Metro. In these circumstance, it will not be appropriate to create a route which will be objected by DMRC. The proposed Route No. 748 to run between Dwarka to Anand Vihar. By going through the via of the route it can be seen that it is not running to the parallel to Metro, therefore it can be considered.
However, UTT Committee had made this recommendation on the basis of the then prevailing situation. Now by the opening of the Metro Line 3 the field situation has totally changed. A list of 38 routes have been sent by DMRC, which according to them are running parallel to Metro and wants same be cancelled. The route number 817 also included in the list.
Taking into consideration of the above, STA Board may decide whether to accept the earlier recommendation of the UTT Committee or to refer the case back to UTT Committee for fresh recommendation as per the changed scenario. It is pointed out that a quick decision needs to be taken in the issue in view of the directions of Hon’ble High Court.
STA Board may like to take a decision.
Decision:
After detailed discussion on Agenda Item, it was agreed that with the commissioning of Metro Line-3, substantial part of this route is now parallel to Metro Rail. Hence the, restoration of original route (prior to curtailment up to Inderlok) will not be possible. The curtailed route up to

Inderlok is declared as Metro affected route and shall be dealt with in accordance with the policy of Metro affected routes, as covered in Agenda Item No.18. The recommendations of the UTT Committee regarding the new routes cannot be accepted as the formation of new routes was not within the purview of UTT Committee. Moreover, the policy of Metro affected routes as covered in Agenda Item No.18 will give the wider choice to the operators of route No.817 which is also a Metro affected route. Therefore, the operators of route No.817 may be informed accordingly in view of orders of Hon’ble High Court.
11. Resolution No. 11/2006 Agenda Item No.5/2006
Creation of RTV Route to ply between Chander Nagar to Kauria Bridge
Shri Bhim Singh Arora, one of the operators having contract Carriage permit of RTV has made a representation to cast a fresh RTV Route between Chander Nagar to Kauria Pul for the RTVs to ply under point to point scheme. On the body of the letter the Minister of Transport, Government of NCT of Delhi has marked ‘Commissioner (Transport) please examine and do the needful’. The matter also came up for discussion in the weekly review meeting convened by the Minister of Transport, GNCT of Delhi. A letter addressed to the Commissioner (Transport) also received from Dr. Harsh Wardhan, MLA and President of BJP, Delhi State recommending the case. Letters from Mrs. Dipika Khullar, Municipal Councilor. The Trans Yamuna Colony Welfare Association, All India Crime Reforms Organization are also received recommending the case and issuance of permit to RTVs in the proposed route to run under point to point Scheme. Another letter signed by 105 members of the area demanding the route and also recommending 13 RTVs which will run on the proposed route. It is brought out through these letters that there is no public conveyance available to the residents of Chander Nagar. Earlier there were two bus routes 222 and 311 connecting Chander Nagar to Kauria Pul which has now been discontinued as the operators did not bring CNG buses.
As per the Departmental Policy, Stage carriage permits to existing, contract carriage RTVs/ mini buses should be aimed as (a) feeder service for full-sized buses (b) for operation in area where full-sized buses cannot operate and (c) these RTVs/ minibuses should not be given routes that overlap with routes of full-sized buses for a total stretch exceeding 3 (three) kilometers for any individual RTV. Further, that the operation of RTVs should be confined to Trans-Yamuna and Outer Delhi and even there the routes should be carefully worked out because our aim is a first

rate road-based mass transit system that integrates with the rail-based system.
The proposed route is crossing the Yamuna and is partially inside the Ring Road which is not as per the guidelines. The applicant are asking stage carriage permit under point to point scheme same as given to the Maxi Cab. However, so far RTVs are not issued any permit under point to point scheme same as Maxi Cab. However, it is pertinent to mention that Maxi Cab scheme has come to effect during year 1994-95.
The matter was placed in the last STA Board Meeting dated 29-10-2005 and Board vide resolution 7/2005 has observed that it is necessary to consult all stake holders before taking a holistic view on the request of the representationist. As per the above observation a letter has been sent to DTC and letter has been placed in STA Notice Board, inviting objection if any by 22-02-2006. DTC has not responded to the letter. However, representation has been received from (1) Maxi Cab Owners Orgn. Shop No: 3, Mahamai Mandir G.T. Shahadra, Delhi 110032 (2) Delhi Pardesh Motor Cycle Rickshaw Union, 8/23, Geeta Colony, Delhi-110031 against creation of this route (3) Operators of Route No.F 202, F 204 and 301.
Fresh recommendations also received from Shri Arivender Singh Lovely, Minister of Education, GNCTD and Dr. Narender Nath, Chairman, Trans Yamuna Area Development Board recommending creation of this RTV route.
The points to be considered for taking a decision is illustrated as below:- In favour of creating the route i) The concerned operators ii) The residence of the area of Chander Nagar. iii) Various dignitaries as mentioned in the preceding paras.

Taking into consideration of various view points, STA Board may like to take a decision in the matter.

After detailed discussion, it was decided that a survey regarding traffic potential / traffic demand on the proposed route may be got conducted through an independent agency and report in this regard may be submitted to STA within six weeks. Thereafter the STA will decide further course of action keeping in view, the existing policy on RTVs.
12. Resolution No.12/2006 Agenda Item No.6/2006
Approval of minutes of UTT Committee meetings dated 11.1.2005, 8.7.2005, 15.7.2005, 28.7.2005, 18.8.2005 and 30.9.2005. The 6 minutes of the UTT Committee were placed in the last meeting of
the STA Board 29.10.2005. While discussing the minutes, the STA Board has desired that all the recommendations of UTT may be shown in a GIS Map depicting the present route and the recommended route so that a clear opinion can be made before taking a decision and directed Chairman, UTT Committee to show the same in the next STA Board meeting.
Number of meetings were held in the chamber of Secretary (STA) to expedite the process in making the GIS map where Assistant Secretary(STA), Chairman, UTT Committee and System Analyst Sh. Krishan Kumar was also present and discussed the matter. Letters also sent to the Chairman, UTT Committee on 01.12.2005, 07.02.2006 & 14.02.2006 to expedite the process in preparing the GIS Map. It is understood that the GIS Map is available only with the EICHER Company and in one of the meeting the representative of EICHER Company also attended. As per the discussion, he has agreed and to complete the process in a short duration provided the data is still available with the company. However, it has come to know that the person has informed that he has to develop the data afresh, therefore it will take more time. A note in this regard was also put up by the Secretary (STA) to the Commissioner (Tpt) requesting that Computer Branch be directed to engage a computer firm for developing a software regarding all the routes including showing them in graphic form on GIS map or revive the agreement with EICHER if possible and Commissioner (Tpt) has directed the Special Commissioner (Tpt) to expedite the work. In this regard, a meeting was also held in the chamber of Special Commissioner (Tpt) on 24.02.2006 which was attended by the Secretary (STA) and Assistant Secretary (STA) also and he has taken initiative in getting GIS map prepared and the process is likely to take some more time but may not be completed before the meeting on 7.4.2006.

In view of the above, the minutes of UTT Committee meeting may be placed only as and when the GIS mapping is completed. This is for the information of STA Board.
Decision:
The Board observed that although there was clear direction of STA Board in its meeting dated 29.10.2005 to the Chairman, UTT Committee and Computer Branch of Transport Department, the work regarding depiction of bus routes as per the recommendations of UTT Committee, on GIS map have not been completed. It was felt that it will not be appropriate to delay the matter further and therefore, it was decided that the matter for depiction of routes on GIS map may be de-linked in public interest to avoid further delay. The Board directed that the Chairman, UTT Committee in coordination with the official members of the UTT Committee shall prepare separate agenda items for each of minutes of UTT Committee meetings clearly justifying the recommendations of the UTT Committee by giving the detailed reasons therefor. He should also prepare and illustrate through comparative graph / map/sketch/road map, the routes which formed the basis of recommendation of UTT Committee. The separate agenda items on the above lines duly approved by COT / Chairman, STA Board should reach Secretary (STA) by 25th April, 2005 positively. The Official Members of the UTT Committee shall remain present in the next meeting of the Board which is to be held on 4.5.2006. Further, Additional Commissioner of Police (Traffic) has informed that Delhi Traffic Police have arranged GIS map of Delhi through NIC and Traffic Police is ready to share the map with STA for depiction these city routes. It was decided that Chairman, UTT Committee in coordination with System Analyst of Computer Branch of Transport Department shall obtain GIS map from the office of Addl. Commissioner of Police (Traffic) and NIC and shall depict all the routes which are common for DTC and private operators on GIS map. CMD, DTC shall provide necessary assistance in terms of expertise to Chairman, UTT Committee. STA Branch will also provide assistance wherever necessary. The work should be completed expeditiously. The STA Board may be apprised about the progress its next meeting and also in subsequent meetings. Addl. Commissioner of Police (Traffic) will also provide necessary assistance to coordinate with NIC.

Diversion of Route No.323

The operators of route no.323 have applied for diversion of their route, as the present via of their route is lengthy. The present route is from Dhaula Koan to UP Road Bus Terminal NOIDA via Moti Bagh, Nauroji Nagar, AIIMS, Andrews Ganj, Lajpat Nagar, Ashram, PS Nizammudin, Sunder Nagar, Pragati Maidan, Road Bridge, Pusta Xing, Phase-I, Hindon Regulator, Naya Bans, Sector 27, BO Block Sector 12 NOIDA, Sector 22 H Block NOIDA, Sector 23/53 NOIDA UP Roadway Bus Terminal. The contention of the appellants are since this route is taking a diversion from Ashram to Nizammudin, Sunder Nagar, Pragati Maidan etc., it is taking more time and commuters are not preferring to travel by their buses. The operators also contested that the DTC has withdrawn their buses from route no: 323 and operating their buses on route no: 392 (Dhaula Kuan to Sector-62 NOIDA) and route no: 398 (Dhaula Kuan to Mayur Vihar Phase-III) via NOIDA Toll Bridge. Therefore, it is requested that they may also be allowed to operate either from Toll Bridge or DTC may be asked to withdraw their buses operating on route no. 392 or 398. If the same is not possible at least their present route may be shortened by allowing the diversion. However, as per the agreement between Delhi State and UP State only state owned transport corporation buses will be allowed to operate through NOIDA Toll Bridge. The new route proposed by the operators in case their request for operation through NOIDA Toll Bridge is not allowed is:- Dhaula Kuan, Moti Bagh, Nauroji Nagar, AIIMS, Andrews Ganj, Lajpat Nagar, Maharani Bagh, Sarai Kale Khan, Nizamuddin Flyover (Yamuna Over Bridge), Pusta Crossing, Mayur Vihar Phase-I, Hindon Regulatory, Naya Bans, Sector-27, NOIDA Sector-12, NOIDA Sector-22, H-Block, NOIDA Sector-23, 53, NOIDA Sector-34, NOIDA, UP Roadways Bus Terminal. This matter was referred to the UTT Committee and the UTT Committee vide minutes dated 18.8.2005 has opined the route no. 323 is a rationalized route and considerable number of buses are plying in this route. Therefore, change of via is outside of purview of the Committee. Representation has also been received from few operators who are operating their buses in the Mudrika and Tivra Mudrika Routes against the proposed diversion of the route no. 323 as the proposed change will affect their operation. The individual operators of route number 323, Mudrika, Tivra mudrika have been asked to fill up a questionnaire to express their view/option. 20 operators of the Route No. 323 filled up the questionnaire while one of the operator of Mudrika/ Tivra Mudrika responded to the questionnaire. All the 20 operators of the Route No. 323 given the same reply to the questionnaire. All the 20 operators of the route no. 323 who have

Our passengers are traveling by the buses of DTC because it is 9 km short in distance.

From the above illustration, the first option of the operators of route no. 323 is the same route as DTC is operating via Toll Bridge. However, as per the agreement between UP and Delhi only buses of State Transport Corporations and undertakings can operate via Toll Bridge. The second option of the operators are the same as they are operating at present upto Ashram and then instead of going to the Nizamuddin, Sunder Nagar, Pragati Maidan going straight to Maharani Bagh, Sarai Kale Khan and Nizamuddin flyover and then following the existing route. The full route is given as the second option, which is as follows: - “Dhaula Kuan, Moti Bagh, Nauroji Nagar, AIIMS, Andrews Ganj, Lajpat Nagar, Maharani Bagh, Sarai Kale Khan, Nizamuddin Flyover (Yamuna Over Bridge), Pusta Crossing, Mayur Vihar Phase-I, Hindon Regulatory, Naya Bans, Sector-27, NOIDA Sector-12, NOIDA Sector-22, H-Block, NOIDA Sector-23, 53, NOIDA Sector-34, NOIDA, UP Roadways Bus Terminal.”
There are 77 private buses operating in Mudrika Routes and 77 buses in Tivra Mudrika Routes. Out of that only one of the operator responded to the questionnaire and he has recorded his objection against the column no objection.
Therefore, the second option as above given by the operators of route no: 323 can be considered.
However, in case the second option is accepted, these buses will not be available to the areas viz. Nizammuddin, Sunder Nagar and Pargati

Maidan. Therefore, to cover the loss the commuters of the area may be offered a new route to cover these areas from where this route has been diverted. The new route (proposed number 323A) will run as a circular service in clockwise and anti clockwise starting and ending at Ashram covering Nizammuddin, Sunder Nagar, Pragati Maidan, Sarai Kale Khan. 2 buses each in both the direction can serve the commuters of the area. Route 323A may first be offered to the willing operators who are at present operating in route no. 323. In the event that all 4 slots are not taken up by existing operators of route no. 323, any other operators who wants to shift their operation to this route may be permitted on first come first basis.
STA Board may like to take a decision in the matter. Decision:
Approved. For the proposed circular route, preference shall be given to the existing operators of Route No.323, after which these routes shall be offered to the operators of Metro affected routes.

Ex-post-facto approval for RTVs stage carriages permit of the successful candidates in draw of lots where the fitness in stage carriage has done before 01-03-2005 and approval of granting fresh permit of a similar case M/s Bakhsh Travels Pvt. Ltd., 928, Ruhulla Khan, S Street, Darya Ganj, operator of vehicle no. DL1V-8052 was successful in draw of lots in route no. F409 in the scheme of granting stage carriage permit for RTV Mini Buses. The operator was issued letter of indent and got the fitness done by change in the colour of the bus and fitting speed governor etc. on his vehicle on 23.10.2004. However, Department has stopped issuing fresh stage carriage permits to RTV Mini Buses except in the case of Metro Feeder routes. On his representation, since the operator had already completed the requisite formality for the stage carriage permit before 01.03.2005, Chairman, STA Board accorded approval for granting permit subject to the Ex-post facto approval by the STA Board.
In similar case, Sh. Gulrez Alam operator of the vehicle no. DL1V-7853 has applied for grant of stage carriage permit in route no. F 409. The operator was successful in draw of lots conducted for issuance of stage carriage permit for RTV Mini Buses in route no. F 409, facts has been verified from record by A.S.(STA) The operator has got the fitness of his vehicle as per the stage carriage scheme from I.U. Burari on 16.8.2004 by changing the colour and fitting the speed governor etc. But, he has not

produced any copy of the letter of intent issued to him nor the same cannot be verified from the office record as the same record is not available. However, it is pertinent to mention the Inspection Unit, Burari issues fitness as per stage carriage scheme as per the letter of intent issued by STA. The operator also filed an affidavit stating that the LOI has been issued to him. Hence, the operator had already completed the requisite formalities for issuance of stage carriage permit before 01.03.2005, STA Board may like to approve the granting of stage carriage permit for the vehicle no. DL1V - 7853 on route no. F 409 (Ashram to Abdul Fazal Enclave). Decision: Approved
15. Resolution No.15/2006 Agenda Item No.13/2006
Ex-post-facto approval for cases of Transfer of permits decided in pursuance of Resolution No.22/2005 of STA Board meeting dated 29.10.2005 STA Board vide resolution no. 22/2005 delegated the power to approve the transfer of permit to the Secretary (STA). The Board also desired the detail of such cases i.e. SC/ST/Ex-Servicemen/ Graduate Scheme etc.) and whether necessary change in the data base of the Department in respect of change of ownership of the permit has already been carried out or not which have been approved for transfer of permit between the intervening period of meetings of STA Board on dated 29.10.2005 and the next minutes be furnished before STA Board in its next meeting. In accordance with the above resolution, Secretary (STA) has approved transfer of permits of 331 cases where the operator had already deposited the permit in transfer mode. Accordingly the Data Base has been modified in the name of Transferee and the cerification to this effect has been obtained from the concerned officials. This is for the information of STA Board. Noted. Further, taking note of the fact that a large number of cases for transfer of permits are coming, the Board recommended that a proposal may be sent to the State Government to increase the transfer fee from the existing level i.e. Rs.5000/- to a higher amount.
16. Resolution No.16/2006 Agenda Item No.14/2006
Granting of stage carriage permit to RTVs plying on route No.F501A and F502A as per the direction of Public Grievances Commissioner Shri Anil Sood has made a complaint to the Public Grievances Commission stating that buses on Route No. 66, 602 & 605 are not plying as per schedule and once in a while a lone DTC bus plies on the aforesaid route that to at odd hours. As a consequences due to non-availability of buses on these routes, the school/ college going children, senior citizens, men/ women, working couples are put to lot of harassments as they have to resort to either asking for a lift or use auto rickshaws who demand astronomical fares or follow longer route to catch the buses via Mehrauli. These routes are starting from Vasant Kunj to various destinations. As per the STA record, no private stage carriage buses are operating on the above routes. DTC informed the Commission that they are operating only shuttle services on route no. 605 as this route are not economical. However, this route does not cover the area of Vasant Kunj C-Block. After hearing the parties the Commission has observed that having access to the public transport is a legitimate right of the residents and the complainant would be satisfied if an RTV route is granted connecting the Vasant Kunj C Block to the nearest area road terminal preferably Munirka so that residents can get the buses from there to various places and directed the Department to consider the same and file the reply in the next date of hearing. After examining the record, it was found that Department has already granted two RTV routes connecting Vasant Kunj C-Block, i.e. Code No. F 501A and F 502A the details of which are given as below: -

4 permits were issued on route no. F 501A and 3 of them were already deposited on permit mode and the other 01 deposited on replacement and at present no vehicle is plying on the route. On route no. F 502A, 2 permits are issued and both of them are live.
Department in its reply to the Commission has pointed out that private operators will ply on particular route only if it is economical viable. However, more if more willing operators apply for permits on these 2 routes, Department may consider their case having consideration to the grievances raised by the residents of the Vasant Kunj area specially C Block. The vacancy position can be placed in the Transport Department website and STA Notice Board and the area zonal office of the Transport Department and also to the Residence Welfare Association of the Vasant Kunj area for the information of the all concerned operators. In view of the above, STA Board may like to accord approval for granting more permits to the existing operators of RTVs who are willing to operate on route no. F 501A & F 502A.

1 7. Resolution No.17/2006 Agenda Item No.15/2006
Payment of certain sum of money by permit holder in lieu of suspension or cancellation of permit under section 86 of M.V. Act, 1988.
1. Vide Rule 61-A of Delhi Motor Vehicles Rules, 1993, the State Transport Authority may by general or special resolution recorded in its proceedings and subject to the restrictions, limitation and conditions that it may impose, delegate to Group ‘A’ and Group ‘B’ gazetted officers, its power under Section 86 of the Motor Vehicles Act, 1988 to suspend a permit or to recover form the holder thereof a sum of money agreed upon in accordance with sub-section (5) of Section 86 of the Motor Vehicles Act, 1988.
2. State Transport Authority vide resolution no.1/1998 has already delegated its power of suspension of permit to the followings :-
(iv) All SDMs and DCs.

(v) All officers of Delhi Police of the rank of Assistant Commissioner of Police and above.
(vi) All the officers of Transport of the rank of Dy. Director and above.
Subject to the condition that the delegation shall be liable to be reviewed form time to time and also subject to the limitation that the power to charge compounding fees in lieu of suspension in case of fatal accidents by stage carriage buses shall be exercisable by officers of the level of Deputy Director and above of the Transport Department only. 3. Section 86 of Motor Vehicle Act 1988 states that the Transport Authority which granted a permit may cancel the permit or may suspend it for such period as it thinks fit on the breach of any condition specified in section 84 or any condition contained in the permit, apart from other provisions as contained in section 86 (a) to (f) provided that no permit shall be suspended or cancelled unless an opportunity has been given to the holder of the permit to furnish his explanation. 4. Sub-section 5 of Section 86 of Motor Vehicles Act, 1988 (photocopy enclosed) state that :-
(5) Where a permit is liable to be cancelled or suspended under clause (a) or clause (b) or clause (e) of sub-section (1) and the Transport Authority is of opinion that having regard to the circumstances of the case, it would not be necessary or expedient so to cancel or suspend the permit if the holder of the permit agrees to pay a certain sum of money, then notwithstanding anything contained in sub-section (1), the Transport Authority may, instead of canceling or suspending the permit, as the case may be, recover from the holder of the permit the sum of money agreed upon.
5. In view of the above, following is submitted for the consideration and approval of STA Board.
Under the provisions of sub-section 5 of Section 86 of Motor Vehicles Act, 1988, it may be decided that if a permit holder in lieu of suspension or cancellation of his permit agrees to pay Rs.5000/- per day for big buses having seating capacity more than 25 number of passengers and Rs.1000/- per day for mini buses having seating capacity less than 25 number of passengers, in lieu of suspension of his permit and an amount of money equivalent to suspension for six months, in case of cancellation of permit, the number of days equal to the paid sum, will be deducted from period of suspension or the cancellation will be condoned/restored as the case may be, subject to the following conditions :-

(a) The agreed sum shall not be recovered for the order in which suspension of permit is made by the delegated authority for less than 5 days. (b) The authority passing suspension order shall in his order itself incorporate the aforesaid proviso for the information of the permit holder so that the permit holder can avail this opportunity. The permit holder shall submit an application in writing specifying the number of days for which permit holder intends to deposit .the sum agreed, in lieu of suspension/cancellation, as the case may be to the delegated authority who had passed suspension order and to Secretary, STA in case of cancellation of permit after surrendering / impounding his vehicle at designated place in pursuance to Rule 61 (5) of Delhi Motor Vehicle Rules, 1993. The delegated authority after ensuring that the vehicle has been impounded shall immediately refer the application of the permit holder along with in the case file to Secretary (STA) for getting approval from the Chairman (STA). Secretary (STA) shall pass order only after getting approval in writing from Chairman, State Transport Authority. Only on depositing the sum of money agreed upon by the permit holder for that particular case, the order for deducting/ condoning the period equivalent to that calculated as per the above criteria, shall be passed.
(a) For the aforesaid purpose, in one month 30 days shall be counted. (b) Secretary (STA) shall apprise the number of such cases to STA
Board from time to time.
6. The matter is placed before the STA Board for appropriate decision.

Delegation of powers u/s of M.V. Act, 1988 to Pollution Control Officers, Motor Licensing Officers, Asstt. Director and Public Relations Officer of Transport Department.

Power to suspend permit of transport vehicles has already been delegated to the Dy. Commissioner of this Department by STA. Vide rule 61-A of Delhi Motor Vehicles Rules, 1993, STA can delegate its power of suspension of permit to Group ‘A’ and Group ‘B’ gazetted officers. To conduct proceedings under Section 86 of Motor Vehicles Act, 1988, for those vehicles which have been referred by Delhi Traffic Police, Enforcement Wing of Transport Department and by commuters in individual capacity for the violation of permit conditions, Chairman, STA from time to time delegates such powers of suspension of permit to Group ‘A’ and Group ‘B’ gazetted officers other than Dy. Commissioners of this Department, for which ex-post facto approval of STA Board is obtained from time to time. It is proposed that the powers of suspension of permits may be delegated to Pollution Control Officers, Motor Licensing Officers, Assistant Director and Public Relation Officer of Transport Department.
4. The matter is placed before the STA Board for appropriate decision.

Transfer of ownership of Transport Vehicles to DFC/Financiers in default of payment of loan. 1. Vide letter-bearing no. DFC/Tpt./2005-06/20530 dated 30th March, 2006, Delhi Finance Corporation has stated that the corporation took possession of 11 vehicles under section 29 of the State Finance Corporation Act, 1951 and sold the same to various buyers. DFC has further stated that letters in this regard have been issued to the purchasers with copy to Motor Licensing Officer for transfer of the vehicles in the name of the purchaser. DFC has requested State Transport Authority, Delhi to cancel the permit in respect of the 11 vehicles mentioned in the list. A photocopy of the letter along with list of 11 vehicles is enclosed herewith as Annexure – I. Photocopy of D.O. dated 10.03.2006 placed at Annexure – II of chairperson DFC may also be seen in this regard.
2. As per the existence policy of Transport Department, Motor
Licensing Officer transfers the ownership of transport vehicles only after getting “surrender slip of permit” from STA Branch. The said slip is issued in the following cases:-
i) Permanent Surrender of permit ii) Replacement of vehicles iii) Transfer of permit (Documents required:- Application in prescribed format by the permit holders NB In the restricted category of permit the personal appearance of the permit holder is recorded and signed by Assistant Secretary, STA or Motor Vehicles Inspector, Original permit, upto date tax report, challan clearance of Enforcement Branch of Transport Department, challan clearance from Delhi Traffic Police, up to date DTC stand fee as applicable, Affidavit stating that the vehicle is not involved in fatal accidents). 3. So the Motor Licensing Officer cannot transfer the ownership till the STA Branch issues surrender slip. On the other hand surrender slip is issued by STA on the aforesaid transactions, if duly applied by the permit holder.
4. Section 51 of the Motor Vehicles Act, 1988 states about the special provisions regarding motor vehicle subject to hire-purchase agreement, etc. A photocopy of the extract of Section 51 of the Motor Vehicles Act, 1988 is enclosed herewith at Annexure – III Relevant provisions of Section 51 are reproduced herein under:-

51. Special provisions regarding motor vehicle subject to hire-purchase agreement, etc -- (i) Where an application for registration of a motor vehicle which is held under a hire-purchase, lease or hypothecation agreement (hereafter in this section referred to as the said agreement) is made, the registering authority shall make an entry in the certificate of registration regarding the existence of the said agreement. (ii) XXXXXXXXXX (iii) XXXXXXXXXX (iv) No entry regarding the transfer of ownership of any motor vehicle which is held under the said agreement shall be made in the certificate of registration except with the written consent of the person whose name has been specified in the certificate of registration as the person with whom the registered owner has entered into the said agreement.
(v) Where the person whose name has been specified in the certificate of registration as the person with whom the registered owner has entered into the said agreement, satisfies the registering authority that he has taken possession of the vehicle (from the registered owner) owing to the default of the registered owner under the provisions of the said agreement and that the registered owner refuses to deliver the certificate of registration or has absconded, such authority may, after giving the registered owner an opportunity to make such representation as he may wish to make (by sending to him a notice by registered post acknowledgement due at his address entered in the certificate of registration) and notwithstanding that the certificate of registration is not produced before it, cancel the certificate and issue a fresh certificate of registration in the name of the person with whom the registered owner has entered into the said agreement.
Provided that a fresh certificate of registration shall not be issued in respect of a motor vehicle, unless such person pays the prescribed fee.
Provided further that a fresh certificate of registration issued in respect of a motor vehicle, other than a transport vehicle, shall be valid only for the remaining period for which the certificate cancelled under this sub-section would have been in force.

5. Hence, it may be inferred from Sub-clauses (1) to (4) of section 5 that the registering authorities may make a note of such agreement and cancellation of such agreement in the certificate of registration on a joint application by both the parties. It prohibits transfer of ownership of such

vehicle without the written consent of the other party to the agreement. Sub-clause (5) provides for the issue of fresh certificate of registration to the financier by the registering authorities where the financier has taken possession of the vehicle for default of the hirer and hirer has refused to hand over the certificate of registration. In such cases the registered owner shall be given an opportunity to make such representation as he may wish to make. However, before granting the transfer of ownership, clearance of dues such as road tax, challan clearances etc. are required from the registered owner. Similarly, no dues clearance is required from the STA Branch including clearance for Bus Queue Shelters fee payable to Delhi Transport Corporation.
6. In this regard, Section 86 (1)(c) state that the Transport Authorities, which granted a permit, may cancel the permit or may suspend it for such period as it thinks fit, if the holder of the permit ceases to own the vehicle covered by the permit. Section 71(3)(d)(i)(ii) state that the State Transport Authority while considering the application for grant of stage carriages permit shall consider the financial stability of the applicant and satisfactory performance as a stage carriages operator including payment of tax if the applicant or has been an operator of stage carriages services. Further, section 81 (4) state that the State Transport Authority may reject an application for the renewal of a permit on one or more on the following grounds:- (a) the financial condition of the applicant as evidenced by insolvency, or
decrees for payment of debts remaining unsatisfied for a period of thirty days, prior to the date of consideration of the application;
(b) the applicant had been punished twice or more for any of the following
offences within twelve months reckoned from fifteen days prior to the date of consideration of the application committed as a result of the operation of a stage carriage service by the applicant, namely:-
(i) plying any vehicle –
(1) without payment of tax due on such vehicle; (2) without payment of tax during the grace period
allowed for payment of such tax and then stop the plying of such vehicle;
(3) on any unauthorized Route no.
(ii) making unauthorized trips:

Provided that in computing the number of punishments for the purpose of clause (b), any punishment stayed by the order of an appellate authority shall not be taken into account. Provided further that no application under this sub-section shall be rejected unless an opportunity of being heard is given to the applicant.
7. In the instant case, since the transfer of ownership has to be made in the name of Delhi Financial Corporation or in the name of any other person if legally feasible/allow under the provisions of law/notification, and owing to the fact that DFC has seized the vehicle, it is assumed that the registered owner shall not come forward to pay the dues recoverable by MLO and STA Branch. In such a scenario, it would be appropriate, that the Delhi Financial Corporation or the Financier shall have to take up the responsibility to pay the dues recoverable by both the branches before the transfer of ownership to DFC or any other person if legally feasible/allowed under the provisions of law/notification which will be decided by the Operation Branch. Similarly, many such cases regarding transfer of commercial vehicles to the Financier or even other Government Bodies may be referred to this Department.
8. Therefore, the following procedure may be adopted in such cases:- a) Registering Authority while issuing mandatory notice under section 51
of M.V. Act to the registered owner shall also send a copy of the same to Asstt. Secretary (STA). Asstt. Secretary (STA) shall work out the dues recoverable from the vehicle owner / permit holder, in connection with the permit issued by the STA branch, up to a specified date and an intimation in this regard shall be sent to Registering Authority. Before the transfer of ownership of the concerned vehicle in favour of DFC or concerned Financier, the Registering Authority (in consultation with Computer Branch), shall ensure that –
b) A suitable and effective mechanism shall be worked out to ensure that
all the statutory dues payable to Transport Department in respect of enforcement challan, traffic challan etc. are deposited prior to the transfer (registration) of the vehicle in the name of the transferee (buyer).
c) Affidavit / undertaking as deemed fit in connection with transfer of
ownership is obtained.
d) After completing all the required formalities, the Registering Authority shall issue order regarding transfer of ownership of the vehicle as per the relevant provisions of law and send the copy of the order to Asstt.

Secretary (STA) along with a copy of the Registration Certificate of the vehicle (after effecting the transfer) and the details of the dues collected on behalf of STA Branch (indicating relevant head as per Computer Software) so that the records of STA branch are updated.
II. On receipt of intimation from Registering Authority to the effect that ownership of the vehicle has been transferred, the STA shall issue notice under section 86 of M.V. Act to the permit holder directing him to show cause as to why the permit should not be cancelled. Further, proceedings u/s 86 of M.V. Act may be conducted, if necessary.
Hence, the proposal as explained above, is submitted for the
consideration and approval of STA Board.
Decision:
Approved. The policy shall be again reviewed by the Board after the disposal of matter referred by DFC regarding transfer of 11 vehicles.

Policy note for Metro Affected Routes Metro Line 3 from Barakhamba Road to Dwarka have been commissioned with effect from January,2006 and Metro Line 1 & 2 had already become operational. With this the creation of Metro Feeder Routes have also become necessary. Therefore, on recommendation of DMRC 59 Metro Feeder Routes have already been approved by STA to provide link to all the Metro lines, for the convenience of passengers / commuters. However, it is felt that some of the bus routes running parallel to the Metro lines and to the Metro Feeder Routes, have been affected and some of them may have become uneconomical. A number of representations have also been received from the Bus Operators, in this regard. Moreover, DMRC have also recommended for closure/modification of 38 bus routes, which are stated to be running parallel to metro line 3. Earlier also on recommendation of DMRC STA closed/modified few bus routes which were found running parallel to metro line 1 and 2. After all this change of transport scenario, further rationalization of bus routes have become imperative. For this the following strategy may be formulated:-
PHASE-I (i) The bus routes which are running parallel to metro lines for a
distance of 50% or more may be identified.

To identify such routes the recommendation of DMRC may be taken into consideration and the factual position may be further got verified / confirmed from DTC. The final decision to declare that the particular routes is actually running parallel to the metro line for a distance of 50% or more may be taken by the Commissioner (Transport) / Chairman, STA Board.
ii) The Bus Operators of the bus routes which will be found running
parallel to the metro lines for a distance of 50% or more, may be given option to shift to the other bus routes on which vacancies exist.
The bus operators will have to give two preferences for routes of their choice from among the notified routes where vacancies are notified so that in case the bus route of their first preference is not possible due to less number of vacancies/more applications than the number of vacancies, the subsequent preference for the other routes can be considered.
iv) In the event of more applications/options of bus operators than the vacancies on a particular bus routes having received, the decision will be taken by draw of lots.
Ascertaining the vacancies 1) The average annual increase in transport demand is estimated
to be above 10%. Thus for the convenience of public and to meet the transport requirement of increasing population more buses at least 5% of the existing strength of buses on popular bus routes can necessarily be increased.
2) To identify the popular routes/the bus routes on which the
transport demand is more and to further work out the vacancies to accommodate more buses on various routes, Commissioner (Transport) / Chairperson, STA Board may work out the suitable strategy / modalities.
3) After identification of the bus routes which are running parallel
for a distance of 50% or more, to the metro lines and working out number of vacancies on various routes, the same will be published in the Newspapers/ as well as displayed on the web site of the Transport Department, Govt. of NCT of Delhi, inviting applications from the bus operators. Thereafter, the process as explained above may be followed for accommodating the buses as per the vacancies.

4) The exercise for inviting applications for the vacancies if any on the identified bus routes, will be undertaken by STA on half yearly basis.
PHASE-II Besides the metro affected bus routes, there are number of representations from the bus operators that many other unpopular/less preferred bus routes have become uneconomical. It is also observed that there are many bus routes on which the numbers of buses are very less i.e. 4 or less than that. It is contended by the bus operators that due to less number of buses on such routes the viable frequency cannot be maintained and therefore less people prefer to travel on the buses operating on such routes as they have to wait for long time.
Therefore, it is also felt essential to identify such uneconomical routes and if possible buses may be shifted to other bus routes, without compromising on the interests of public/commuters.
This exercise may be undertaken after the work of first phase i.e. bus routes affected by the metro line, is completed successfully.
The proposal is submitted STA Board for consideration/approval.

Necessity of Permanent Account Number (PAN) and Bank Account Number at the time of grant and transfer of permit ( The agenda was placed on table during the meeting.)
In accordance with the directions of Ministry of Finance, Govt. of India, the registering authorities are required to ensure that PAN (Permanent Account Number) or form 60 as the case may be is submitted by the registrant, at the time of registration and transfer of any motor vehicles.
On the same times, it is felt essential that at the time of grant of the permit for all transport vehicles, the permit issuing authority/officer must ensure the submission of self-attested photocopy of PAN (Permanent Account Number) and Bank Account Number. PAN and Bank Account Number shall form part of the office record and maintained in the computerized data base.

Further, at the time of transfer of permit of all type of vehicles, the concerned authority/officer shall obtain the self-attested copy of PAN card and Bank Account Number of the transferee. In no case, the new permit shall be granted or any permit is transferred, to the person who does not have PAN number and Bank Account Number.
All the existing permit holders shall file a self-attested photocopy of the PAN card and the Bank Account Number to the concerned permit issuing authority/officer within six months from the date of issue of instructions in accordance with the resolution adopted by the STA Board. In the event, however, that the permit holder wishes to transfer the permit before the expiry of six months, or the permit requires renewal, or the vehicle on which such permit is granted becomes due for annual inspection and certification for fitness, the permit holder (or the transferee as the case may be) shall furnish a self certified copy of his PAN card and Bank Account Number forthwith.
The matter is placed before the STA Board for consideration and approval.
