the Ohio Civil Rights Commission.

Provost Kim Copeland gave welcoming remarks and thanked the Commission on behalf of the

University for agreeing to hold it’s meeting at Denison.

Report from the Ohio Attorney General’s Office

Lori Anthony, Chief, Civil Rights Section, Ohio Attorney General’s Office updated

Commissioners on pregnancy discrimination case.

Report from the Chief Legal Counsel

Stephanie Demers, Chief Legal Counsel for the OCRC, gave a summary of an enforcement case

that was on the agenda today. She explained the cases that were heard today were all

employment and housing, but the Commission also has jurisdiction over places of public

accommodation and that – in fact - Ohio law was on the books far in advance of the federal

Americans with Disabilities Act of 1990. It is unlawful under Ohio law for a place of public

accommodation to discriminate against a person based on protected class, including disability.

In 2014, the Commission received a charge against Respondent, Norwalk Raceway Park, which

is a place of public accommodation. The Charging Party asserted certain areas of the facility are

inaccessible to the disabled. Respondent entered into a CACO voluntarily agreeing to come into

compliance with the law by making modifications to the facility, such as providing a sufficient

amount of parking spaces and van-accessible spaces and wheelchair-accessible seats dispersed

throughout the facility with companion seating. The Commission recently learned that

Respondent had not made the changes they agreed upon. The commission’s investigator

conducted an on-site with an expert witness, who is an architect, and confirmed this.

Consequently, the Commission is referring the matter to the Ohio Attorney General’s office

seeking them to enforce the CACO.

Report from Executive Director

Executive Director G. Michael Payton thanked Denison University for hosting the OCRC. He

also thanked Mary Turocy and Desmon Martin for the planning and preparation for the meeting.

The Employee Engagement Committee is planning to revisit the Mission, Vision and Values for

the OCRC. The committee will also hold a contest for new ideas on the agency’s slogan.

Director Payton and Mary Turocy met with the Ohio State University, Kirwin Institute regarding

plans to develop a curriculum to study implicit bias.

Director Payton extended an invitation to attend a presentation on the Zanesville Water Case on

October 13, 2016. He also thanked Commissioner Singh for visiting the OCRC Cleveland

Regional Office and providing lunch for the staff.
