INCIDENT REPORT
Title of Incident: Demolition at Sitio Gilo, Brgy. Mirab, North Upi, Maguindanao
Date: April 18 at about 9:00 AM
Affected/Damages: 16 houses (1 semi-concrete) and 1 tribal prayer hut mostly made of light
materials demolished affecting 20 Teduray families with 64 individual members.
Responsible for the demolition: about forty individuals backed by PNP Personnel of Nuro led
by Chief of Police Gabudao and personnel from the 38th IB based in Mirab, North Upi,
Maguindanao
Narrative Account of the Incident:
About 9:00 O clock in the morning of April 18, 2013 the demolition team and the land title
owner accompanied by the PNP Personnel from Nuro led by a certain Chief of Police Gabudao
and the personnel from the 38IB arrived at the place. The resident just welcome them thinking
they are politicians campaigning for the election. The PNP Chief of Police approached one
Barangay Council member and told her about their purpose to the place - to implement the
court order after the lapse of the 45 days Temporary Restraining Order to demolish the houses
considered to be illegally occupying the land titled to Mrs. Florisita Roxas. He even told the
Barangay Council Member that the honorable Mayor Piang of North Upi is also aware of their
demolition mission. Through the mobile phone of the Chief of Police, the Barangay Council
member managed to talk to Mayor Piang. The honorable mayor advised them not to initiateany violent reaction and just let the demolition team do their job. Upon hearing this, the Brgy.
Council Member and the other residents just stay calmly and helplessly witness the demolition
team dismantling their houses one after the other.
The contested land claimed by the Roxas family, a migrant from Luzon covers 48 hectares. This
is further divided into two areas: area 1 with 27 hectares and area 2, the site of the latest
demolition with 21 hectares. According to interviewed residents, they know that the land was
owned by the grandparents of the Dagloc, Tambala & Bello even before the Roxas came to the
place.
Florisita Roxas agreed to give 5 hectares out of the 21 hectares where the affected families can
construct their houses but they refuse because it is not enough to support their agricultural
means of living.

Actually, this is not the first case because in August 19, 2009, they also were harassed by
members of the Nuro PNP that resulted to the shooting and death of Dino Bello, one of the
resident and an active CAFGU member.
Damages:
16 houses and 1 tribal prayer house were demolished rendering 20 families with 64individual members all are indigenous peoples belonging to the Teduray tribe homeless.
They are now temporarily taking temporary refuge in four different evacuation
sites:(make shift tent, the Good News Chapel, a day-care center and purok center)
inside the contested area.

Initial Assistance received:
1. DSWD North Upi have extended relief goods twice: 1st consist of ( 5 kilos of rice, 1sardines, sugar, coffee and milk) for each of the 16 families and second five kilos rice for
27 families) last April 18 and 19 respectively.
2. Mindanao Human Rights Action Center personnel also went to the place to documentthe incident right after the incident last April 18
3. Office of Assemblywoman Alba of the Regional Legislative Assembly (RLA) and Office forSouthern Cultural Communities (OSCC) through the Executive Director Fatima Kanakan
also went to conduct initial fact finding and extended relief assistance (2 sack rice,
sardines and medicines) to 16 affected families last April 20 & 21, 2013.
Recommended Assistance as felt by the affected residents:
1. Food assistance as they cannot concentrate working on their farms for fear of anyfurther eventualities
2. medicines for children already catching sickness due to deplorable living condition3. makeshift tent as temporary shelter to shield them especially children and elderly from
harsh weather condition
4. Relocation site where residents can transfer while the case is being resolved.5. on the long term, to conduct an in depth investigation/study of the case to determine
the proper intervention and long term solution to the problem

The residents temporarily seek refuge to four different sites:. the damaged makeshift tent that serve as temporary
evacuation center of some of the residents (Picture 1) homeless residents constructing extension room to the Purok
center to house some of the affected families (Picture 2) while others stay at the Good News Chapel (Picture 3).
Children are staying while their parents are out to find works and food to eat (Picture 3 & 4) with their belongings still
packed in empty sacks (Picture 6)

Other two damaged houses (Picture 1 &2), what used to be food basket to keep food away from dogs is now an inch
away from the ground (picture 3). the pot cover used to cook foods are just scattered around (Picture 4). the staff of
OSCC Director Kanakan handing the relief goods to some of the residents (picture5). The site is just 10 -15 minutes away
from the national Highway to Upi by foot passing through this unpaved road (Picture 6)
