AN ACT AMEND SECTION 27-103-302, MISSISSIPPI CODE OF 1972, TO 1 PROVIDE THAT FROM AND AFTER SEPTEMBER 1, 2018, ALL BP OIL SPILL 2 SETTLEMENT FUNDS RECEIVED BY THE STATE SHALL BE DEPOSITED INTO THE 3 STATE BP SETTLEMENT FUND AND THE GULF COAST RESTORATION FUND; TO 4 CREATE A SPECIAL FUND IN THE STATE TREASURY TO BE DESIGNATED AS 5 THE "STATE BP SETTLEMENT FUND"; TO CREATE A SPECIAL FUND IN THE 6 STATE TREASURY TO BE DESIGNATED AS THE "GULF COAST RESTORATION 7 FUND" (GCRF); TO PROVIDE THAT MONIES IN THE GCRF SHALL BE USED, 8 UPON APPROPRIATION BY THE LEGISLATURE, TO PROVIDE ASSISTANCE TO 9 APPLICANTS THROUGH PROGRAMS OR PROJECTS AUTHORIZED BY THIS ACT; TO 10

THAT INCLUDES DETAILED INFORMATION REGARDING RECEIPTS AND 47 EXPENDITURES OF THE FUNDS RECEIVED AND PROVIDED AS ASSISTANCE 48 UNDER THIS ACT; TO REQUIRE THE STATE TREASURER TO TRANSFER A 49 CERTAIN AMOUNT OF FUNDS FROM THE BUDGET CONTINGENCY FUND TO THE 50 2018 TRANSPORTATION AND INFRASTRUCTURE IMPROVEMENTS FUND, 51 MISSISSIPPI HIGHWAY-RAILROAD GRADE CROSSING SAFETY ACCOUNT AND THE 52 MISSISSIPPI RAILROAD IMPROVEMENTS FUND; TO AMEND SECTION 9, HOUSE 53 BILL NO. 1, FIRST EXTRAORDINARY SESSION OF 2018, TO PROVIDE THAT 54 MONEY IN THE 2018 TRANSPORTATION AND INFRASTRUCTURE IMPROVEMENTS 55 FUND, SHALL BE DISBURSED, IN THE DISCRETION OF THE DEPARTMENT OF 56 FINANCE AND ADMINISTRATION, FOR CERTAIN PROJECTS; TO SPECIFY THE 57 PROJECTS FOR WHICH MONEY MAY BE DISBURSED; AND FOR RELATED 58 PURPOSES. 59
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 60
SECTION 1. Section 27-103-302, Mississippi Code of 1972, is 61
amended as follows: 62
27-103-302. Through August 31, 2018, all funds received by 63
or on behalf of the State of Mississippi through a negotiated 64
settlement for economic damages in connection with the explosion 65
on, and sinking of, the mobile offshore drilling unit Deepwater 66
Horizon, except for any funds that are required by the settlement 67
to be paid to any other public entity, shall be deposited into the 68
Budget Contingency Fund for appropriation by the Legislature. 69
From and after September 1, 2018, all funds received by or on 70
behalf of the State of Mississippi through a negotiated settlement 71
for economic damages in connection with the explosion on, and 72

sinking of, the mobile offshore drilling unit Deepwater Horizon, 73
except for any funds that are required by the settlement to be 74
paid to any other public entity, shall be deposited as follows: 75
(a) twenty-five percent (25%) of each annual payment of those 76
funds to the State of Mississippi shall be deposited into the 77
State BP Settlement Fund created in Section 2 of this act, and (b) 78
seventy-five percent (75%) of each annual payment of those funds 79
to the State of Mississippi shall be deposited into the Gulf Coast 80
Restoration Fund created in Section 3 of this act. 81
SECTION 2. There is created in the State Treasury a special 82
fund to be designated as the "State BP Settlement Fund." The 83
special fund shall consist of funds required to be deposited into 84
the special fund by Section 27-103-302, funds appropriated or 85
otherwise made available by the Legislature in any manner, and 86
funds from any other source designated for deposit into the 87
special fund. Unexpended amounts remaining in the special fund at 88
the end of a fiscal year shall not lapse into the State General 89
Fund but shall remain in the State BP Settlement Fund. Any 90
investment earnings or interest earned on amounts in the special 91
fund shall be deposited to the credit of the special fund. 92
SECTION 3. (1) There is created in the State Treasury a 93
special fund to be designated as the "Gulf Coast Restoration Fund" 94
(GCRF). The GCRF shall consist of funds required to be deposited 95
into the GCRF by Section 27-103-302, funds appropriated or 96
otherwise made available by the Legislature in any manner, and 97

funds from any other source designated for deposit into the GCRF. 98
Unexpended amounts remaining in the GCRF at the end of a fiscal 99
year shall not lapse into the State General Fund, and any 100
investment earnings or interest earned on amounts in the GCRF 101
shall be deposited to the credit of the GCRF. 102
(2) Monies in the GCRF shall be administered by the 103
Mississippi Development Authority (MDA), and shall be used, upon 104
appropriation by the Legislature, to provide assistance to 105
applicants through programs or projects authorized by this act. 106
Monies in the GCRF shall be used only for programs or projects 107
that are located in the Gulf Coast region as defined in the 108
federal RESTORE Act, or twenty-five (25) miles from the northern 109
boundaries of the three (3) coastal counties of Harrison, Hancock 110
and Jackson, but not to expand beyond the boundaries of Hancock, 111
Harrison, Jackson, Pearl River, Stone, and George Counties. If a 112
county is included in the coastal zone, then the county seat and 113
the land lying to the east, west and south within that county 114
would be considered a part of the coastal zone. 115
SECTION 4. (1) Monies in the Gulf Coast Restoration Fund 116
shall be used only for the purposes specified in this act, and no 117
other expenditure, appropriation or transfer of monies in the GCRF 118
shall be made except by an act of the Legislature making specific 119
reference to the GCRF as the source of those monies. 120
(2) If any monies in the GCRF are obligated or pledged as 121
security for any debt incurred by MDA, and the monies in the GCRF 122

that have been obligated or pledged are later expended, 123
appropriated, transferred, obligated or pledged for any other 124
purpose, the debt for which the monies were originally obligated 125
or pledged shall be the obligation and indebtedness of the State 126
of Mississippi secured by the full faith and credit of the state. 127
SECTION 5. (1) There is created the Gulf Coast Restoration 128
Fund Advisory Board for the purpose of providing guidance and 129
expertise to MDA when reviewing applications for assistance under 130
this act. The advisory board shall consist of the following seven 131
(7) members: 132
(a) Three (3) appointments from the Governor; 133
(b) Two (2) appointments from the Lieutenant Governor; 134
and 135
(c) Two (2) appointments from the Speaker of the House 136
of Representatives. 137
(2) The Governor shall appoint the chairman of the board and 138
the board shall elect such other officers as it considers 139
necessary from among its members. 140
(3) A majority of the members of the board shall constitute 141
a quorum for the conduct of meetings and all actions of the board 142
shall be by a majority vote. 143
(4) The Mississippi Development Authority shall provide any 144
necessary administrative support to the board. No person 145
nominated for, appointed to or serving as a member of the board 146
may be an elected official. 147

(5) Members of the board shall serve without compensation, 148
per diem or mileage expense. 149
(6) All expenses of the MDA in carrying out its duties and 150
responsibilities under this section shall be paid from funds in 151
the Gulf Coast Restoration Fund. 152
SECTION 6. (1) MDA shall be the administrator of the Gulf 153
Coast Restoration Fund. MDA is authorized to carry out any powers 154
and duties authorized in this act and shall handle all of the 155
day-to-day matters relating to the GCRF. 156
(2) The annual administration expenses of MDA in carrying 157
out its duties under this act shall not exceed one percent (1%) of 158
the amount of the funds deposited into the GCRF under Section 159
27-103-302 for that year. MDA may recover from applicants and 160
recipients of funds under this act a portion of the costs 161
associated with administering assistance provided under this act, 162
which shall not be subject to the one percent (1%) limitation 163
under this subsection. 164
SECTION 7. (1) Applicants who are eligible for assistance 165
under this section include, but are not limited to, local units of 166
government, nongovernmental organizations, institutions of higher 167
learning, community colleges, ports, airports, public-private 168
partnerships, private for-profit entities, private nonprofit 169
entities and local economic development entities. Projects that 170
are eligible for assistance under this section are projects that 171

have the potential to generate increased economic activity in the 172
region, as described in Section 8(3) of this act. 173
(2) MDA shall establish criteria, rules, and procedures for 174
accepting and reviewing applications for assistance under this 175
section. MDA, with advice from the Gulf Coast Restoration Fund 176
Advisory Board, shall review, compile and score all timely 177
received applications, and shall present the applications and its 178
recommendations for assistance to individual projects under this 179
section to the Legislature no later than December 1 of the year. 180
The Legislature shall determine individual projects that will be 181
funded under this section by separate line items in an 182
appropriation bill. 183
(3) Applications for assistance under this section will be 184
received through web portals set up by MDA. MDA shall set 185
criteria for the web portal which may include protection of the 186
confidentiality of any or all of the application. 187
SECTION 8. (1) MDA is further authorized, on such terms and 188
conditions consistent with the criteria set forth in this section 189
as it may determine, to establish programs for making loans, loan 190
guarantees, grants and any other financial assistance from the 191
GCRF to applicants whose projects are approved for assistance 192
under this section. MDA shall establish criteria, rules and 193
procedures for accepting, reviewing, granting or denying 194
applications, and for terms and conditions of financial assistance 195
under this section in accordance with state law. The Legislature 196

shall appropriate monies from the GCRF to the MDA to fund the 197
programs established under this section in an amount requested 198
annually by MDA for such purpose. 199
(2) Applicants who are eligible for assistance under this 200
section include, but are not limited to, local units of 201
government, nongovernmental organizations, institutions of higher 202
learning, community colleges, ports, airports, public-private 203
partnerships, private for-profit entities, private nonprofit 204
entities, and local economic development entities. 205
(3) MDA shall establish programs and an application process 206
to provide assistance to applicants under this section that 207
prioritize: 208
(a) Projects that will impact the long-term 209
competitiveness of the region and may result in a significant 210
positive impact on tax base, private sector job creation and 211
private sector investment in the region; 212
(b) Projects that demonstrate the maximum long-term 213
economic benefits and long-term growth potential of the region 214
based on a financial analysis such as a cost-benefit analysis or a 215
return-on-investment analysis; 216
(c) Projects that demonstrate long-term financial 217
sustainability, including clear performance metrics, over the 218
duration of the project; 219
(d) Projects that leverage or encourage leveraging of 220
other private sector, local, state and federal funding sources 221

with preference to projects that can demonstrate contributions 222
from other sources than funds from the BP settlement; 223
(e) Projects that are supported by multiple government 224
or private sector entities; 225
(f) Projects that can move quickly and efficiently to 226
the design, engineering, and permitting phase; 227
(g) Projects that enhance the quality of life/place and 228
business environment of the region, including tourism and 229
recreational opportunities; 230
(h) Projects that expand the region's ability to 231
attract high-growth industries or establish new high-growth 232
industries in the region; 233
(i) Projects that leverage or further enhance key 234
regional assets, including educational institutions, research 235
facilities, ports, airports, rails and military bases; 236
(j) Projects that are transformational for the future 237
of the region but create a wider regional impact; 238
(k) Projects that enhance the marketability of existing 239
industrial properties; 240
(l) Projects that enhance a targeted industry cluster 241
or create a Center of Excellence unique to the region; 242
(m) Infrastructure projects for business retention and 243
development; 244
(n) Projects that enhance research and innovative 245
technologies in the region; and 246

(o) Projects that provide outcome and return on 247
investment measures, to be judged by clear performance metrics, 248
over the duration of the project or program. 249
SECTION 9. (1) Assistance provided under this act may not 250
be used to finance one hundred percent (100%) of the cost of any 251
project. 252
(2) Contracts executed by MDA with recipients of assistance 253
under this act must include provisions requiring a performance 254
report on the contracted activities, must account for the proper 255
use of funds provided under the contract, and must include 256
provisions for recovery of assistance if the assistance was based 257
upon fraudulent information or the recipient of the assistance is 258
not meeting the performance requirements established by MDA of the 259
assistance. Recipients of assistance under this act must 260
regularly report to MDA the status of the project on a schedule 261
determined by MDA. 262
SECTION 10. (1) The scope of a financial audit of 263
recipients of assistance under this act shall include funds 264
related to any year in which the recipient receives assistance 265
under this act. The scope of review for these funds shall 266
include, but is not limited to, compliance with state and federal 267
laws related to the receipt and expenditure of those funds and the 268
criteria established by MDA. 269
(2) The State Auditor shall conduct performance audits of 270
MDA's administration of the GCRF under this act. The scope of 271

review shall include, but is not limited to, evaluating internal 272
controls, internal audit functions, reporting and performance 273
requirements required for use of the assistance, and compliance 274
with state and federal law. The audit shall include any funds 275
disbursed under this act and matching funds provided in the 276
contract with MDA. 277
(3) In addition to the rules of the State Auditor, the State 278
Auditor shall adopt rules for the form and conduct all financial 279
audits performed by independent certified public accountants and 280
for audits of recipients of assistance under this act. 281
(4) The State Auditor may report findings to the Secretary 282
of the Treasury of the United States in addition to the reporting 283
requirements under state law. 284
(5) The costs of the audits performed as provided in this 285
section may be paid from the GCRF. 286
SECTION 11. MDA shall file an annual report with the Speaker 287
of the House, the Lieutenant Governor, the Chairs of the 288
Appropriations Committees of the House and the Senate, and the 289
Legislative Budget Office not later than December 1 of each year, 290
including detailed information regarding at least the following 291
specific areas: 292
(a) Receipts and expenditures of the funds received and 293
provided as assistance under this act; 294
(b) Expenditures for all administration expenses of MDA 295
in carrying out its duties under this act; 296

(c) Overview of applications reviewed and a detailed 297
description of applications approved for assistance for the 298
current year; and 299
(d) Schedule of all applications for which assistance 300
was provided under this act detailing status of progress, start 301
date, anticipated completion date, benchmark achievements, and any 302
modifications to the original application after receipt of 303
assistance. 304
SECTION 12. (1) The State Treasurer shall transfer funds 305
from the Budget Contingency Fund to the following special funds in 306
the following amounts: 307
(a) Fifty-two Million Eight Hundred Ninety-three 308
Thousand Dollars ($52,893,000.00) to the 2018 Transportation and 309
Infrastructure Improvements Fund created in House Bill No. 1, 310
First Extraordinary Session of 2018; 311
(b) One Million Dollars ($1,000,000.00) to the 312
Mississippi Highway-Railroad Grade Crossing Safety Account created 313
in Section 57-43-15; and 314
(c) Seven Million Five Hundred Thousand Dollars 315
($7,500,000.00) to the Mississippi Railroad Improvements Fund 316
created in Section 57-46-1. 317
(2) The State Treasurer shall transfer seventy-five percent 318
(75%) of the amount remaining in the Budget Contingency Fund after 319
the transfers required in subsection (1) of this section into the 320
Gulf Coast Restoration Fund created in Section 3 of this act. 321

SECTION 13. Section 9, House Bill No. 1, First Extraordinary 322
Session of 2018, is amended as follows: 323
Section 9. (1) A special fund, to be designated the "2018 324
Transportation and Infrastructure Improvements Fund," is created 325
within the State Treasury, which shall consist of funds made 326
available by the Legislature in any manner and funds from any 327
other source designated for deposit into such fund. The fund 328
shall be maintained by the State Treasurer as a separate and 329
special fund, separate and apart from the General Fund of the 330
state. Unexpended amounts remaining in the fund at the end of a 331
fiscal year shall not lapse into the State General Fund, and any 332
interest earned or investment earnings on amounts in the fund 333
shall be deposited into such fund. 334
(2) Monies deposited into the fund shall be * * * disbursed, 335
in the discretion of the Department of Finance and Administration, 336
as follows: 337
(a) To pay the costs incurred by the Mississippi 338
Transportation Commission and the Mississippi Department of 339
Transportation to widen Mississippi Highway 16 to three (3) lanes 340
as follows: 341
(i) From near the Neely Town Road at the DeKalb 342
City Limits to the point at which Old Philadelphia Road ties into 343
Mississippi Highway 16; and 344
(ii) Between the two (2) points at which 345
Mississippi Highway 39 ties into Mississippi 346

(c) To assist the East Metropolitan Corridor 353
Commission, which is a commission operating as a local public 354
agency representing the Jackson Municipal Airport Authority, the 355
City of Brandon, Mississippi, the City of Flowood, Mississippi, 356
and the City of Pearl, Mississippi, in paying the costs associated 357
with land acquisition and implementation of the East Metro 358
Corridor project in Rankin County, Mississippi, from its current 359
terminus at the southeast corner of, and within, the 360
Jackson-Medgar Wiley Evers International Airport, traversing 361
easterly and southerly and terminating at Interstate 20 at 362
Crossgates Boulevard in Brandon, Mississippi........ $8,000,000.00. 363
(d) To assist DeSoto County, Mississippi, in paying the 364
costs of rebuilding Holly Springs Road in DeSoto County and 365
drainage improvements to the road................... $3,000,000.00. 366
(e) To assist Carroll County, Mississippi, in paying 367
the costs of repair, renovation or replacement of a closed bridge 368
on County Road 157 in Carroll County................ $ 500,000.00. 369

(f) To assist Lamar County, Mississippi, in paying the 370
costs associated with necessary infrastructure improvements in 371
Beat 5 of Lamar County and/or construction of recreational 372
facilities in Beat 5................................ $ 500,000.00. 373
(g) To assist Lamar County, Mississippi, in paying the 374
costs of improvements to the intersection of Scruggs Road and 375
Mississippi Highway 589, including, but not limited to, the 376
relocation of portions of the road, the purchase of property 377
related to the relocation, signage, paving, other costs related to 378
improving the safety of the intersection and other road safety 379
projects in Supervisors District 5 of 380
Lamar County........................................ $1,500,000.00. 381
(h) To assist Bolivar County, Mississippi, in paying 382
the costs associated with preplanning and construction of a 383
