Welcome to the Missoula Art Museum and thank you for join-ing us for two exemplary contemporary art auctions. We feel honored to host these events and share the artworks of so many talented and skilled artists—right here in our dynamic home. Given today’s economic climate, the arts remind us that we are defined by more than our account balances. Populations have long relied on the arts for inspiration, to hold up morale, to fight anxiety, and to express our democratic values. Most of us appreciate the intrinsic benefits of the arts—its beauty and vision and how it inspires, soothes, provokes, and con-nects us. These two annual auctions are critical to the financial success of the Missoula Art Museum. As MAM’s primary fundraiser for the year, the auctions directly support exhibitions and programming for more than 30,000 visitors annually, while ensuring FREE admission. Proxy Bid RulesBidders who will not attend the live auctions may submit proxy bids on all live and silent auction items at MAM, by phone or email. Bids will be made on your behalf and not exceed your stated maximum bid amount. Proxy bidding is anonymous.

The deadline for submitting proxy bids for the silent and live auctions is February 17, 12pm for Artini Auction: Wear Oh Ware and February 26, 12pm for the 38th Benefit Art Auction.

PaymentAll items must be paid for by the end of the evening. MAM accepts cash, checks, travelers’ checks, Discover, MasterCard, and Visa.

A 90-day same-as-cash payment plan is available to MAM members. Sign up for a membership before the live event, or add a membership to your evening’s total purchase.

Pick-UpWhen you have paid for your winning items, you will be issued a receipt. Please present this receipt at the Pick-Up Table to claim your winning items. If you are unable to take your new artwork home safely that evening, you may ar-range for pick-up at MAM at a later date. All artworks must be claimed by May 31, 2010.

Terms of SaleUnless otherwise noted, all certificates for goods and services must be used within one year of the auction date. All items and services are subject to the terms and conditions specified by the donors.

All sales are final. There will be no exchanges or refunds. MAM does not make any expressed or implied warranties or guarantees on auction items regarding quality or value of items or services. MAM has attempted to describe and catalog all items correctly, but all items are offered and sold “as is” and “with all faults.”

MAM neither warrants nor represents, and in no event shall be responsible for the correctness of descriptions, genuineness, au-thorship, provenance or condition of the items. No statement made in this catalog or made orally at the auction or elsewhere shall be deemed such a warranty for tax purposes or market value. Items have not been appraised unless otherwise noted.

Reservations for trips and vacation accommodations must be mutually arranged with the donor unless otherwise noted. No refunds will be allowed on travel packages for canceled tickets and/or accommodations.

By the buyer’s purchase, the buyer waives any claim for liability against Missoula Art Museum, its elected and appointed officials, members and employees, sponsors, volunteers connected with the auction, and/or the donor of the item. Neither the Missoula Art Museum nor the donor is responsible for any personal injuries or damage that may result from the use of the property or services.

Tax InformationYour purchase receipt lists the fair market value of each item as established by the donor. Any amount you pay in excess of the fair market value would normally be available to you as a charitable contribution for tax purposes. Please check with your tax advisor for specifics.

Auction FormatRegistration

All bidders must receive a bid number from the Missoula Art Museum. You may register at MAM, by phone or online. Use

only the bid number assigned to you for bidding on silent and live auction items.

38th Benefit Art Auction FormatLive bidding on all artworks will begin at 7:15pm on Saturday, February 27 at the Missoula Art Museum.

Six fun and unique non-art items are included in the Silent Auction. Silent bids may be placed on these items at the

event on February 27 from 5pm until the auctioneer closes the Silent Auction. An attendant will mark the bid sheet

when the auction is closed.

Artini Auction: Wear Oh Ware Auction FormatLive bidding on all artworks will begin at 7:30pm on Thursday, February 18 at the Missoula Art Museum.

Ten unique non-art items are included in the Silent Auc-tion. Silent bids may be placed on these items at the event

on February 18 from 5:30pm until the auctioneer closes the Silent Auction. An attendant will mark the bid sheet when

the auction is closed.

Silent Auction Bid RulesThe minimum bid for each item is written on the bid sheet by

the item. The minimum raise on all items is $25 at the 38th Benefit Art Auction and $10 at the Artini Auction: Wear Oh Ware. To be valid, bids must comply with these minimums

and be legible. To place a bid, sign your bid number with your bid amount on the bid sheet. Doing so constitutes a legal con-tract to purchase that item at the price you stated if your bid is

the winning bid.

Live Auction Bid RulesWhen bidding, please hold up your bid number toward

the auctioneer. A bid acknowledged by the auctioneer is a legal contract to purchase the item. If you are the winning

bidder, listen carefully as the auctioneer restates your bidder number and winning bid amount. The sale amount is docu-

mented and the sale is final.

The Missoula Art Museum reserves the right to withdraw any item at any time without notice before the actual sale. In the event of a dispute, the Missoula Art Museum shall act as final

authority in determining the winning bid.
