Provide a Quick Reference Comparison Guide?
4a. I am petitioning/requesting that MLS consider making the "Lev Condo" field a "required field" in MLS.
Naturally, the field that lays "Levels" can tell the agent/consumer how many levels the actual unit has (1
story condo, or multi-level town home or condo). However, determining what floor the condo is on (i.e. LL,
1st, 2nd, 3rd) feels like a constant cat and mouse game with listing agents and builders.
I find that the "Lev Condo" field is left blank as much as 30%-40% of the time. I end up digging through
marketing remarks or agent remarks to learn what floor a unit might be on, and when that doesn't work, I am
pouring through the pictures looking for vaulted ceilings, or to see if I can find steps or detect tree lines or
parking lots out of the windows on listing photos. For example: If you search ALL active condo listings in
W12, 40% of the active listings have this field blank. I find this unfair and aggravating to agents who are
seeking a condo unit on a particular floor.
My suggestion would be that the "Lev Condo" field be converted to a "required field" with a drop down, and
that agents have the option of selecting "LL/Garden Level, 1, 2, 3,.... 30." Going up to 30 would cover
buildings like the Madison House, The Regency (Hyde Park), Edgecliff (Walnut Hills), Hammond North
(College Hill) and all the downtown developments as well.

4b. Per our phone conversation would you please propose the following suggestion.
Make the Subdivision entry as a drop down list to choose from, instead of typing in the name. This would
prevent misspelled subdivision names, which prevent listings from showing in our saved searches. Our
Remax system is set up that way. I've also polled lots of people across the US and many have the drop down
feature.

4c. The final hurdle to remove for your members is to set up an RPR account for anyone that hasn't yet done
so. Currently, 1,521 RPR accounts have been created by your members.
We are able to create RPR accounts for all REALTOR® subscribers participating in the MLS. Account
Creation enables the MLS subscriber to bypass the process of creating their initial RPR account. RPR will
use your MLS roster, validating your subscribers with NAR's NRDS database. We will then create the RPR
account automatically, enabling your subscribers to more easily access and begin taking advantage of the
RPR site.
Please let me know if you would like us to create accounts for your members and we can further discuss the
details.
Here's how the process works. The MLS sends out an email to everyone that has not created an RPR
account or has not logged in for quite awhile (we can decide on that time frame). In the email you let them
know that to assist them in using this power member benefit, an RPR account will be created for them. This
email is sent about a week in advance of the account being created. You would send a follow up email the
day before the account is created, just to remind them about it. RPR will then send them an email to let them
know that an account has been created. The email will include a link that takes them to the RPR and
prompts them to create a new password.
We can provide you with sample content for both of the emails that you'll send.
We can then do quarterly account creations for anyone that is new and has not created an account.
The only "promotional" information that these new RPR users receive, is just updates regarding the release
of new functionality and features to the RPR or if there should be some planned maintenance which could
impact availability. Chances are that you're currently receiving these periodic emails from RPR.
We currently do not take extra steps for other 3rd
party vendors.

MLS Enhancement
Mandatory Reporting of Seller Concessions
In July 2013, an MLS enhancement was implemented to provide the voluntary input of seller
concessions at the time of closing. A YES or NO could be entered to indicate whether or not any seller
paid concessions were included in the sale transaction. If a YES was entered, the user could further
input (voluntarily) a % or dollar amount for the concession. Attached is a summary of the YES and NO
activity on closed single family and condominium sales, by month, through the end of February 2015.
In summary, of the 37,146 closed sales, 3,455 had a YES marked and 3,606 had a NO marked, for a
total of 7,061 closed sales. This represents 19.0% of the total closed transactions.
Also attached is the appraisal requirement to report and analyze seller concessions, along with a list of
potential concessions.
Since this input has been voluntary, it is not known how many other sales were closed that may have
had seller paid concessions. The marking of YES with dollar amounts or percentages has certainly
reduced the number of phone calls, emails, and text messages from appraisers to the listing agents.
For those marked NO, appraisers have had to take the next step to contact the listing agents for
details. When contacting listing agents to get seller concession information, some have responded
with “We can’t provide this, it’s confidential.”
We believe the confidentiality issue has been mitigated via state statute and recent changes to the
CABR Contract to Purchase:
Statute Changes. Agents in Ohio are now permitted to disclose seller concessions involved in a
purchase transaction. The following is from an OAR website page with the heading: “New OAR backed
Legislation Limits REALTOR Liability (OR: Sept 2011)”:
Disclosure of Seller Concessions
The terms of a purchase contract are considered to be confidential and therefore cannot be
disclosed by licensees without their client’s consent. This includes disclosure of any
concessions made by the seller to anyone, including appraisers. However, the fact that such
seller concessions were made is often information that appraisers want to know in order to
properly reflect the true price of comparable sales in the area. Because the Ohio Division of
Real Estate believes this is legitimate information that appraisers need to comply with their
obligation to analyze all facts and circumstances under USPAP, a “limited” exception has been
added to the new license law.
Under this new amendment, licensees are permitted (but not required) to disclose their seller
concessions to appraisers for the limited purpose of conducting an appraisal without violating
their duty of confidentiality to their client.
Here is the actual language:
Sec. 4735.74 Duties following closing of transaction. Unless otherwise agreed in writing, a licensee owes no further duty to a client after performance of all duties or after any contract has terminated or expired, except for both of the following: (B) Keeping confidential all information received during the course of the transaction unless: "(6) Disclosure is regarding sales information requested by a registered appraiser assistant or a licensed or certified appraiser for the purposes of performing an appraisal. No cause of action shall arise on behalf of any person against a licensee for releasing information pursuant to this division."

CABR Contract to Purchase Changes. The Contract to Purchase was revised in November 2014 wit this
added clause (lines 46-49):
Settlement Charges: In addition to costs incurred in order for the Seller to fulfill the terms of the
Contract and to provide marketable title, Seller agrees to pay actual settlement charges on behalf of
the Buyer, including, but not limited to, discount points, closing costs, pre-paids, and any other fees
allowed by Buyer’s lender in an amount not to exceed, ________________________.
Summary
We believe that number of closed sales with seller concessions is higher. The only way to obtain the
highest accuracy in the reporting and analysis of, and determining the impact on, a property’s market
value is to make the YES or NO input mandatory, along the with dollar amount or percentage.
The mandatory entry process will eliminate nearly all of the time-consuming calls, emails and text
messages between appraisers and listing agents, and more importantly, assist appraisers in developing
more accurate market values.

Addendum
Appraisal Requirements
The following is a stated requirement in Fannie Mae’s and Freddie Mac’s Universal Appraisal Reports
for single family and multi-family properties:
Adjustments to the comparables must be made for special or creative financing or sales
concessions. No adjustments are necessary for those costs which are normally paid by sellers as
a result of tradition or law in a market area; these costs are readily identifiable since the seller
pays these costs in virtually all sales transactions. Special or creative financing adjustments can
be made to the comparable property by comparisons to financing terms offered by third-party
institutional lender that is not already involved in the property or transaction. Any adjustment
should not be calculated on a mechanical dollar for dollar cost of the financing concession but
the dollar amount of any adjustment should approximate the market’s reaction to the financing
or concessions based on the appraiser's judgment.

Metropolitan Information Systems Inc. (MRIS) now have free access to a trove of new-home listings
and specifics about developments under construction.
Homebuilder marketing company Builders Digital Experience Inc. (BDX) is providing MRIS members
with a branded “new home channel” that’s accessible through their MLS interface.
The channel is a customized version of NewHomeSourceProfessional.com, which is designed
specifically for agents and claims to have the largest collection of new homes available anywhere,
including plans, builder promotions and community-level data.
The data is compiled solely from “real estate agent-friendly” builders committed to paying agents
participating in a transaction, the company said

“Nationally, based on our research of consumers and real estate agents, 48 percent of agents prefer
selling new construction homes and our relationship with MRIS allows them to bring an unprecedented
level of new home information directly to their clients,” said BDX CEO Tim Costello in a statement.
A joint venture between realtor.com operator Move Inc. and homebuilder consortium Builder Homesite
Inc., BDX BDX also powers the “new homes and communities” section of realtor.com
and operates new-home listing sites NewHomeSource.com and NewHomes.Move.com.
BDX announced agreements with 16 MLSs in October 2013, with seven feeds up and running at that
time.

1. The more data you can put in a regression analysis, generally the more accurate the
analysis. When you try to use regression to analyze differences in property you need several
examples of each of those differences you are regressing for. The more examples you have the
more accurate the analysis.
The beauty of regression analysis is the use of older sales. Regression can account for changes in
market conditions allowing appraisers to use more similar properties even if they were over a year
ago. Fannie Mae, and their lenders who sell to them, are beginning to loosen the requirements
around the use of older sales. An appraiser can use an older sale, and if supported through
regression analysis, make a valid market change adjustment. Many times this will support more
recent contract prices. It is a real win for the agent community.
I understand the reservation about data harvesting. Limiting the number to 200 is a reasonable
requirement. Many times I will simply run 2 different exports and append the data. This is
somewhat time-consuming and mistakes are easy. If you do not check the correct set of records
the 2nd time around, sometimes you can miss records or create duplicate entries. Bob at the MLS
office can explain the process of multiple downloads and demonstrated for you.
That being said, if we could increase the import limit to 500 records it would be more than
sufficient 95% of the time. This would still be a throttle on potential data harvesting. I also
envision this regression analysis used by real estate agents for their CMA's. I would be glad to
provide some training at the agent level on how to do this.
2. On the quick search listing locator on the main page after signed in, could an active status
checkbox be added? That way you could click from that main page that you want to search
ACTIVE listings on Main St and get say 30 results instead of 30,000 from ALL listings ever
listed on Main St. Would really serve the purpose of the quick search.
a. Per Rapattoni, this is not an option right now. The module is a standard module not
intended for modification.
3. For categorizing a house by architecture, I propose that up to two types can be checked. For
example, you can have a contemporary ranch, or a contemporary tri-level. These classifications
are not mutually exclusive, leading to confusion if someone is searching for a contemporary
home, but the agent classified it as a ranch (which it technically is). Also, some of the categories
(like Saltbox) could more appropriately be classified as Traditional or Historic. In my opinion,
this whole category could use cleaning up/fine tuning. Happy to help come up with a more
eloquent proposal for the group if that would help.
4. It would be a great help if the search criteria for Building Sq Ft (Realist) (on page 1) could be
modified to include a checkbox for:
Include 0 Sq Ft
Since Realist is not providing a consistent data feed for building square feet, this would help us
see if there are properties that appear with 0 sq. ft. that may be within the GLA range (after we
look it up in auditor's records) using our other search criteria (distance, age, sale price,
etc.). Right now, the search has to be run twice to catch the 0 sq. ft. properties.
