6. Other/New Business 6.1. Verbal update from James Bisson, Manager, Licensing Enforcement, Corporate

Services, re: Definition of "Taxi Business" in the Excise Tax Act.

James Bisson, Manager, Licensing Enforcement, Corporate Services, advised that staff have reviewed the new definition of "taxi business" in the Excise Tax Act and there are no implications to the taxicab industry. In addition, Mr. Bisson provided information on the collection of HST by ride-share companies under this Act. The following motion was considered.

TC003-2018 That the verbal update from James Bisson, Manager, Licensing Enforcement, Corporate Services, to the Taxicab Advisory Committee Meeting of February 27, 2018, re: Definition of "Taxi Business" in the Excise Tax Act be received.

6.2. Discussion re: Taxicab Stand on 8 Nelson Street.

James Bisson, Manager, Licensing Enforcement, Corporate Services, advised that due to safety concerns, the City-owned property adjacent to the Nelson Street taxi stand will be fenced to restrict access. Mr. Bisson explained that this property was often used by taxi drivers as a staging area to access the taxi stand on Nelson Street.

Committee discussion on this matter included:

Risks associated with the subject property

Alternative options for taxi stand overflow on Nelson Street and a request that staff investigate the opportunity to use space in the transit terminal area

Status of proposed changes to the lane configuration on George Street

6.3. Discussion at the request of the City Clerk's Office, re: Change to the Membership

Status of Lynn Slade on the Taxicab Advisory Committee.

Peter Fay, City Clerk, provided background information on the composition of the Taxicab Advisory Committee, noting that Lynn Slade was appointed to this Committee as a Driver Representative. Mr. Fay informed Committee that Ms. Slade recently became a taxicab plate owner, and thus is ineligible to continue as a Driver Representative, based on the Committee’s terms of reference. Mr. Fay advised that Committee may consider a motion which acknowledges Ms. Slade’s status change and recommends her continued representation on the Committee for the remainder of this term of Council. The following motion was considered.

TC004-2018 Whereas the Taxicab Advisory Committee terms of reference define its

composition to include taxicab driver representatives (as defined in Licensing By-law) and who are not plate owners; and

Whereas Lynn Slade was appointed to the Committee early 2016 as a Driver Representative, and has made valuable and productive contributions to the Committee, including an exemplary attendance record; and

Whereas Lynn Slade recently became a taxicab plate owner, and thus is technically ineligible to continue as a Driver Representative, based on the Committee terms of reference; and

Whereas there are only two scheduled meetings of the Committee remaining this term (after February 27, 2018) and Lynn Slade’s continued representation and contribution to the Committee will contribute to effective meetings;

Therefore Be It Resolved That, having regard for her valued contributions and attendance with the Committee to date, Lynn Slade, originally appointed to the Committee as a Driver Representative, be permitted to continue to serve on the Committee for the remainder of this term, despite having now become a Plate Owner Representative.

6.4. Discussion at the request of Jaswant Uppal, Committee Member, re: Status Update – Work Plan for Ride-Sharing Company Licensing.

In response to questions from Committee on this matter, J. Bisson, Manager, Licensing Enforcement, Corporate Services, advised that:

the work plan is currently underway and options for a ride-sharing program will be presented to this Committee for feedback

industry feedback (taxicab and ride-share), as well as public input will be collected and form part of the draft proposal

benchmarking of ride-share licensing programs in other municipalities will be undertaken

a report on a ride-sharing program for Brampton is anticipated to be presented to Committee of Council in May 2018

Committee discussion on this matter included the following:

Protection of residents using ride-sharing services

Enforcement of ride-share operations in Brampton and an indication that the City has no authority to stop vehicles and demand proof of insurance, driver’s licence, etc., and no jurisdiction on GO Station property

In response to a question from a member of the public, P. Morrison, Director, Enforcement and By-law Services, Corporate Services, provided information regarding charges for ride-sharing operations in Brampton.

P. Morrison, Director, Enforcement and By-law Services, Corporate Services, advised Committee of the need to schedule a meeting in April 2018 to review options for a ride-sharing program in Brampton. The following motions were considered.

Uber driver facing charges after fatal crash on Gardiner Expressway

An Ottawa man facing four charges of dangerous driving causing death and criminal Negligence causing death in relation to a two-vehicle crash on the Gardiner Expressway last week has been released on bail.

Twenty-three-year-old Abdibared Bishar Mussa left the courthouse at 2201 Finch Avenue on Wednesday after the Crown consented to Mussa’s release on $3,000 bail. As part of Mussa’s release, he is not allowed to be in the front seat of any vehicle.

Toronto police said the collision happened around 3:30 a.m. on March 21 in the westbound lanes between South Kingsway and Islington Avenue.

Global News has learned Mussa was behind the wheel of his 2012 Hyundai Sonata, which he was operating as an Uber, and was transporting a young couple to Toronto Pearson International Airport.

Police said Mussa was east of Royal York Road when he was attempting to re-enter the highway of the shoulder at the time of the crash.

A police source told Global News that Mussa had pulled off into the shoulder of the highway and stopped because his cellphone, which was mounted on the dash, had fallen. After picking up his phone and remounting it on the dash, Mussa pulled out into live traffic instead of slowly accelerating in the shoulder before merging into traffic.

A male passenger in the back seat of the Hyundai suffered life-threatening injuries in the crash and died in hospital the following day. Three other people were injured.

Global News has learned the man who died was 28-year-old Nicholas Cameron. His girlfriend who was also a passenger in the Uber at the time and said the couple, who had been dating since October, were going to the airport in order to board a flight to Mexico before the two planned to return to Florida for her father’s wedding. She described Cameron “a great guy who cared so much and who didn’t deserve this.”

Cameron worked as a web developer for a company called BrainStation. Jason Field, the company’s CEO, said in a written statement to Global News that employees were “deeply saddened” after learning of Cameron’s death.

“Nicholas was a valuable member of our team here at BrainStation as a part-time web development instructor and continuously made contributions to his community through teaching and mentoring at the Ladies Learning Code,” he said.

Cameron was also the youngest child of the late Bill Cameron, a former Global News and CBC broadcaster.

Uber spokesperson Kayla Whaling said the ride-sharing company is co-operating with officers.

“Our hearts are with those grieving for the loss of their loved one following this horrible tragedy. We will support the police investigation in every way possible,” she said.
