CLAIMS AGAINST THE ESTATE-UNJUST ENRICHMENT

1. Strict proof is required in claims against a decedent’s estate which may have been brought during the decedent’s lifetime.

2. An interested party may not testify to events occurring before a decedent’s death in claims involving a deceased individual.

3. The doctrine of unjust enrichment involves a class of obligations imposed by law for reasons dictated by justice.

:CLAIMS AGAINST THE ESTATE

OPIN I O N

This matter comes before the Court on claims made against the Estate of William M.

Ackerman for services rendered. William M. Ackerman (hereinafter "Decedent") was a resident

ofMomoe County, Pennsylvania with an address of 2162 Deerfield Way, Pocono Township.

Decedent also owned an adjacent lot. James and Sarah Hagner were Decedent's neighbors.

Suzanne DePaolo is the mother of James Hagner and resides with him and his wife. All three

have made claims against Decedent's estate. Although Decedent owned a home, there was

evidence given at the time of hearing that he was unable to live there because of a hoarding

problem and a lack of running water dating back to 2015. Decedent was instead living in his

truck. Decedent suffered from a number of ailments including diabetes. At some point in 2016,

he required a toe amputation. After that procedure, Decedent moved into the Hagner's home for

a period of time. Although visiting nurses came out to the home to care for the Decedent, Mrs.

Hagner and Ms. DePaolo took care of Decedent the majority of the time he resided with them.

There was testimony that throughout his stays with the Hagners, Decedent required extensive

care for activities of daily living and managing his finances. After he recovered from his surgery,

Decedent continued to live with the Hagners during the winter, but stayed in his truck during the

warmer months. In May of 2018, Decedent was involved in a major car accident which required

him to spend three months in the hospital. Afterwards, he once again moved into the Hagner's

home and Mrs. Hagner and Ms. DePaolo resumed caring for him. In the early fall of 2018, KMB

Plumbing and Electrical was hired to clear out and clean up Decedent's property. KMB issued

four invoices for the work totaling $9,911.46. These invoices were addressed to Mr. Hagner.

Soon thereafter, Decedent was again hospitalized and eventually passed away on November 28,

2018.

On February 5, 2019, Joseph Pisano (hereinafter "Executor") was appointed executor of

Decedent's estate upon Petition for Letters Testamentary. In addition to being the executor of the

estate, Mr. Pisano is also the sole beneficiary. The assets of the Estate consist primarily of the

two aforementioned parcels of real property that were sold by Order of Court, and personal

property that was sold at auction. On June 12, 2019, three separate claims were filed against the

Estate. The first, made by the James C. Hagner Irrevocable Trust, was for $23,000.00. This clai

was later withdrawn without prejudice on November 1, 2019. The second, in the amount of

$61,763.46, was made by James Hagner and Sarah Hagner, for improvements to Decedent's

property. The final claim, made by Sarah Hagner and Suzanne DePaolo, in the amount of

$184,200.00 , was for home healthcare provided to the Decedent. There were two hearings on

these claims; the first was held on November 1, 2019, the second on January 24, 2019. The

record was then kept open so that the parties could take an additional deposition and submit it to

the Court. That is now done and the record is closed and the claims are ready for disposition.

Discussion

Claims which are not made directly against a person during his or her lifetime must

thereafter be made against the decedent's estate. "To successfully assert a claim against a dead

man's estate is being steadily made more difficult. To establish such claim by parol evidence

requires proof direct and positive. The terms of the liability must be certain and definite." In re

Schwoyer's Estate, 288 Pa. 541, 544, 136 A. 798, 799 (1927) quoting In re Gross' Estate, 284 Pa.

73, 75, 130 A. 304, 304 (1925). Furthermore, "[a] claim against the estate of a decedent for

board, nursing, household services, etc., must be as definite and precise as is required to recover

a debt in an action at law. Claims against decedent's estate, which might have been made against

him while living, are subjects of just suspicion and strict proof is required." In re Sanders' Estate,

370 Pa. 208,210, 87 A.2d 923, 924 (1952) (internal citations omitted). Therefore, claimants

require something more substantial than simply their own word to establish monies owed to the

by a decedent's estate.

Additionally, in considering the testimony given at the two hearings in this matter, the

Cou1i must apply the Dead Man's Rule. This rule has been codified at 42 Pa. C.S.A. §5930 and

states in part:

"[I]n any civil action or proceeding, where any party to a thing or contract in

action is dead ... neither any surviving or remaining party to such thing or contract,

nor any other person whose interest shall be adverse to the said right of such

deceased ... shall be a competent witness to any matter occurring before the death

of said party ... unless the action or proceeding is by or against the surviving or

remaining partners, joint promisors or joint promisees, of such deceased ... party,

and the matter occurred between such surviving or remaining partners, joint

promisors or joint promisees and the other party on the record, or between such

surviving or remaining pai1ners, promisors or promisees and the person having an

interest adverse to them, in which case any person may testify to such matters."

42 Pa. C.S.A. § 5930. Basically, in claims involving a deceased individual, an interested party

may not testify to events occurring before the decedent's death. This is to prevent self-interested

parties from making statements before a court which a decedent's estate cannot possibly rebut.

1. James and Sarah Hagner's Claim-

First, we turn to the claim filed by James and Sarah Hagner for monies owed to them for

repairs and cleanup of Decedent's property. Although Mr. and Mrs. Hagner originally claimed

more than $60,000.00 was owed to them, they only presented evidence pertaining to the billings

of KMB Plumbing and Electric. There was no testimony that KMB performed plumbing or

electrical work at the property, rather, they were hired to clean out items which had accumulated

as a result of Decedent's hoarding. KMB billed at its usual rates for plumbing or electrical work.

Four separate invoices were issued by KMB, totaling $10,263.46, although the claimants agree

the proper amount for work performed at the Decedent's property is actually $9,911 .46. These

were billed to the Hagners because they were the point of contact for the work that was done.

Although both James Hagner and Kevin Barry from KMB testified that Decedent had approved

and consented to the work, we must ignore that testimony under the Dead Man's Rule as the

statements were made by Decedent prior to his death and both witnesses have a financial interest

in the issue. However, Ms. DePaolo is not an interested party in this claim and does not sit to

benefit financially from it. Ms. DePaolo testified that she had a discussion with Decedent in

which he stated he would reimburse Mr. Hagner for the clean-up work on his property being

done by KMB, that such work had indeed been authorized by him, and that it was to be

performed by KMB. We find Ms. DePaolo's testimony credible and compelling. We also find

that the rate at which KMB billed was reasonable under the circumstances as there was no

specific agreement as to the rate to be billed, the Decedent knew the work was being done by

KMB, and KMB had to pay their workers, even if it was at the usual and customary rates for

plumbing and electrical work. Based upon this, Mr. and Mrs. Hagner's claim for reimbursement

of the KMB invoices in the amount of $9,911.46 is appropriate and will be granted.

Alternatively, we believe that the Hagners' claim is also proper under the doctrine of

quantum meruit, or unjust enrichment. "The equitable doctrine of quantum meruit involves a

class of obligations imposed by law, regardless of the intention or assent of the parties, for

reasons dictated by justice. The doctrine is based on the concept that no one who benefits by the

labor and materials of another should be unjustly enriched thereby." Limbach Co., LLC v. City

of Philadelphia, 905 A.2d 567, 575 (Pa. Cmwlth. Ct. 2006). "The elements necessary to prove

unjust enriclunent have been described as follows:

(1) benefits conferred on defendant by plaintiff; (2) appreciation of such benefits

by defendant; and (3) acceptance and retention of such benefits under such

circumstances that it would be inequitable for defendant to retain the benefit

without payment of value. ( citations omitted). The application of the doctrine

depends on the particular factual circumstances of the case at issue. In

determining if the doctrine applies, our focus is not on the intention of the parties,

but rather on whether the defendant has been unjustly enriched."

Id. Here, the benefit confetTed on the Decedent was having his property cleaned out as an

improvement. The work was done by KMB and its would be inequitable for the Hagners to pay

for the clean-up services which were engaged for the benefit of the Decedent, and later enjoyed

by his estate. Although it appears the property still needed to be cleaned further before it was

sold, the Hagners had begun the process before Decedent's death and saved the Estate both time

and money. Therefore, Mr. and Mrs. Hagner's claim is also appropriate under the doctrine of

quantum meruit.

2. Sarah Hagner and Suzanne DePaolo's Claim-

Mrs. Hagner and Ms. DePaolo's claim against the Estate for home healthcare is more

complicated. Mrs. Hagner and Ms. DePaolo seek to recover for in-home care they provided to

Decedent at various times while he lived in the Hagner home at local home healthcare rates. At

the time of hearing, Mrs. Hagner and Ms. DePaolo each testified that the Decedent wished to

give them something for their ongoing care provided to him. However, we are required to

disregard most of those statements under the Dead Man's Rule as both witnesses have a financia

interest in their own testimony regarding statements made by the Decedent before his death.

Although we don't doubt their testimony about their conversations with the Decedent, and the

necessary and compassionate care they provided, we simply cannot consider it under the law.

There were two uninterested witnesses whose testimony we can consider. They both

stated during their testimony that Decedent had expressed an interest in trying to compensate

Mrs. Hagner and Ms. DePaolo in some manner. Dom1a Callender, a social worker who visited

the house to see the Hagner's daughters, testified that she had observed the claimants taking care

of Decedent while he was bedridden. She stated that she also had brief discussions with the

Decedent in which he expressed his desire to give something to Mrs. Hagner and Ms. DePaolo

for the care they were giving to him. She was unable to say what the Decedent had in mind by

that statement. The parties also took the deposition of Mr. Ebazer Verdanidze, a service

coordinator at PA Health Management, a company that oversees the Medicaid waiver program

for home healthcare. Mr. Verdandze worked with the claimants when they went through the

waiver application process for an elderly relative who also resides in the Hagner home. At some

point, Mr. Verdanidze went to the home and encountered the Decedent. Mr. Verdanidze testified

that the Decedent was in poor shape and bedridden. He also stated that Decedent was interested

in applying for the waiver program himself to compensate the family for helping him. Mr.

Verdanidze gave them some information on the program and had no further interaction with the

Decedent.

Although the testimony of Ms. Callender and Mr. Verdanidze seems to indicate a desire

of the Decedent to give the claimants "something" for their help, there was no substantive

evidence of what that something might be or what he specifically agreed to do. There was no

testimony that the Decedent told either witness that he actually agreed to monetarily compensate

Mrs. Hagner and Ms. DePaolo for their care, or that they should be paid at an hourly rate of

home healthcare aides, or any other specific promises made to them. Mr. Verdanidze was really

only able to testify that Decedent had considered applying for the waiver program as

compensation for the two women, but the forms were never completed. Nor can we be certain

that the application would have been approved or that any payment from Medicaid would have

been at the rates the claimants are requesting. Ms. Callender was only able to confirm that the

Decedent wanted to give something to the claimants, but he did not tell her of any specific

promises or agreements as to compensation. The court is left to speculate what the intent of the

Decedent was in that regard. As such, the claims of an agreement or promise of payment cannot

be awarded.

Even if there was some agreement or promise of payment in return for care provided, we

can only speculate as to what the rate of pay should be. There was no testimony that the

Decedent had specifically agreed to an amount of compensation or rate of pay for care.

Claimants base the amount of their claim on the home healthcare rates they are currently paid to

take care of the relative living in the Hagner home through the Medicaid waiver program, and

the hours they estimate they spent taking care of the Decedent. In attempting to set a daily value

to the care provided by claimants, we are unable to pinpoint with any accuracy how many days

and actual hours of care Decedent received. There was no testimony of exact dates in which

Decedent was at the Hagner home. We know that he was there sometime in 2016 after having

had surgery, but then left periodically. We also know that he came back to the Hagner home full

time after his May 2018 automobile accident until he was hospitalized for the last time, but

again, no exact dates were provided. Therefore, even if we were to find that some reimbursemen

was appropriate under an agreement with the Decedent, the claimants have not met their burden

in clearly establishing the amount of their claim through either documentation or testimony. We

reluctantly must deny the claims of Mrs. Hagner and Ms. DePaolo for care provided.

Finally, while we believe the doctrine of quantum menlit could be applicable, it is

impossible for the Court to place an appropriate sum on Mrs. Hagner and Ms. DePaolo's claims

because the testimony of the time Decedent spent in their care is not specific enough. Likewise,

the rate of compensation under the circumstances would also be too speculative for the court to

consider. Furthermore, it was unclear whether the Decedent contemplated the care being given

was services that were being performed in the ordinary course of business where payment would

normally be expected. Although the Decedent clearly received compassionate and necessary care

from Mrs. Hagner and Ms. DePaolo, we are unable to award any compensation from the Estate.
